V.- ON THE ALLEGED VIOLATION OF THE PRINCIPLE OF STATUTORY RESERVATION. On various occasions, this Chamber has held that, in tax matters and pursuant to Article 121(13) of the Constitution, the imposition of taxes and the determination of the taxable event, taxpayer, tax base, rate, benefits, and procedure are matters that must be established and regulated by formal legislation enacted by the Legislative Assembly. Nevertheless, those provisions may be developed through an Executive Decree, so it is not unconstitutional for a regulation to develop the conditions under which tax benefits may be granted. In this case, the petitioner alleges that the challenged provision is unconstitutional because it creates new law and assigns authority over a matter not contemplated by statute, contrary to the principle of statutory reservation. However, analysis of the challenged Article 65 shows that it is grounded in the Forestry Law, which authorizes the granting of benefits under specified circumstances, and also develops that grant by providing that, although the law establishes different tax benefits, the taxpayer may choose only one of them. En ese sentido, es necesario precisar que el principio de irretroactividad de la ley, no implica una inmutabilidad del ordenamiento jurídico, de tal forma que no permita que el Derecho evolucione y se adapte a las nuevas necesidades y cambios sociales. En el sub lite, la norma impugnada no establece una nueva circunstancia, ni elimina los beneficios concedidos, únicamente, establece la prohibición de acceder a varios de esos beneficios al mismo tiempo. Constitutional challenge (acción de inconstitucionalidad) brought by JULIA MAROTO MONTEJO, of legal age, widowed, holder of identity card number 3-161-208, resident of San José, in her capacity as general attorney-in-fact without limitation as to amount for INDUSTRIAS AGROPECUARIAS ASOCIADAS S.A.; against ARTICLE 65 OF DECREE NUMBER 25721-MINAE, WHICH CONSTITUTES THE REGULATIONS TO THE Ley Forestal.

Background:

  1. 1In a written submission received by the Secretariat of the Chamber at 10:55 hours on February 5, 2009, the petitioner requests that Article 65 of Decreto Ejecutivo 25721-MINAE, which constitutes the Regulations to the Ley Forestal, be declared unconstitutional. She alleges that enforcement proceedings (proceso ejecutivo) brought by the Municipalidad de Sarapiquí against the company she represents are pending before the Juzgado Civil de Mayor Cuantía de Heredia under case number 07-100190-0377-CI. She contends that, in the ordinary enforcement proceedings, the debt sought to be collected arises from the plaintiff’s application of Article 65 of the Reglamento a la Ley Forestal. In response to that claim, the company she represents raised the defense of lack of legal entitlement (excepción de falta de derecho) because it considers the provisions of the aforementioned article unconstitutional.She further states that she invoked the unconstitutionality of the provision in protection of its rights. She asserts that the portion of the article she challenges is the final provision, which states: “Fiscal incentives and payment for environmental services may not be obtained simultaneously.” She maintains that executive regulations (reglamento ejecutivo) are a regulatory instrument intended to facilitate the Public Administration’s application of the law, but that they also constitute a means of safeguarding the fundamental rights of those subject to the Administration (administrados), because they promote equal legal treatment by the Public Administration, require it to act within the limits of the law so as to comply with the principle of legal certainty (seguridad jurídica), and require it to recognize the rights granted to them by law to the same extent as the law itself, without exclusions, limitations, or impediments not established by the law itself.She states that the Ley Forestal grants incentives to owners of natural forests who manage them, in order to remunerate or compensate them for the environmental benefits they generate, pursuant to Article 23 of the Law. She notes that this is a mandatory provision, required in view of the constitutional principle that matters must be governed by statute (principio constitucional de reserva de ley), which leaves no public administration any discretion to deny or nullify incentives, regardless of their nature, when the legally prescribed requirements for granting them have been met. In that regard, she asserts that the reference made at the end of Article 23 to compliance with regulatory requirements concerns reasonable and necessary objective elements that the Administration may require in order to verify that the statutory conditions are satisfied in each case. She adds that the mandatory nature of the provision completely binds the Administration and creates at least an expectation of entitlement (expectativa de derecho) to the incentives for the owner of a natural forest who in fact falls within the statutory conditions and, naturally, a right incorporated into that owner’s assets if those benefits have already been recognized and administratively declared.She states that the provision contained in Article 65 of the Regulations exceeds the scope of executive regulatory authority (potestad reglamentaria ejecutiva), because it creates an impediment to the granting and enjoyment of the incentives that is wholly unrelated to the provisions of Article 23 of the Ley Forestal and has no basis in the law or in the legal system as a whole. She explains that this is not merely a conflict between a regulatory provision and the law, although a situation of this kind inevitably entails a direct violation of the constitutional provisions governing the hierarchy of sources of law (fuentes del derecho), such as Articles 9, 105, 121, and 140(3) of the Political Constitution. In fact, Article 65 creates new law, because it assigns authority over a matter not contemplated by statute and whose valid regulation requires legislative action. She asserts that this differs from the rulings of the Constitutional Chamber in cases in which it has created, through case law, a barrier to access to constitutional review by holding that a conflict between regulations and a statute is a matter of mere legality.Consequently, Article 65 is unconstitutional because it violates the principle that matters must be governed by statute, from a perspective that is not, strictly speaking, the one reflected in the Chamber’s judgments dismissing such claims. She argues that the challenged Article 65 affects the proprietary rights granted to owners under Article 23 of the Ley Forestal, which the Administration must recognize and declare whenever the factual conditions set forth in the latter article arise. This effect entails an infringement of the right of ownership over the economic value resulting from recognition of the tax benefits granted by law, which become part of the owner’s assets when the Administration declares and grants them in compliance with the law. She therefore considers the challenged provision to violate the fundamental right to property expressly recognized in Article 45 of the Political Constitution.She considers that the creation, through regulatory authority, of a novel ground for the unilateral cancellation of the benefits granted to owners under Article 23 of the Ley Forestal is materially equivalent, by reason of its effects and consequences, to a unilateral act depriving an owner of rights conferred by law, in violation of that owner’s right to due process. Finally, she considers the provision unconstitutional because it results in the retroactive application of a rule created by the Administration to the detriment of the owner’s acquired proprietary rights and consolidated legal situation (situación jurídica consolidada) resulting from the provisions of Article 23 of the Law and their documentary and contractual embodiment. This circumstance infringes Article 34 of the Political Constitution.
  2. 2To establish her standing (legitimación) to bring this constitutional challenge, the petitioner states that enforcement proceedings brought by the Municipalidad de Sarapiquí against the company she represents are pending before the Juzgado Civil de Mayor Cuantía de Heredia under case number 07-100190-0377-CI, and that she invoked the unconstitutionality of the provision in those proceedings (folio 7).
  3. 3Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber, at any time, including upon filing, to summarily dismiss on procedural grounds or on the merits any application submitted for its consideration that is manifestly inadmissible, when it considers that sufficient grounds exist for its dismissal, or when it merely reiterates or reproduces a previous identical or similar application that was dismissed.
  4. 4The statutory requirements have been fulfilled in the proceedings.

Considering:

I. FORMAL REQUIREMENTS FOR ADMISSIBILITY OF THE ACTION

A constitutional challenge is a proceeding subject to specific formalities that must be satisfied before the Chamber may validly consider the merits of the challenge. In this regard, Article 75 of the Ley de la Jurisdicción Constitucional establishes the requirements for admissibility (presupuestos de admisibilidad) of a constitutional challenge. First, there must be a prior matter pending resolution, whether in judicial proceedings or in proceedings to exhaust administrative remedies (agotar la vía administrativa), in which unconstitutionality has been invoked as a reasonable means of protecting the right or interest alleged to have been infringed. However, in its second and third paragraphs, the law exceptionally establishes circumstances in which no prior matter is required: where, due to the nature of the matter, there is no individual and direct injury; where the defense of diffuse or collective interests is involved; or where the action is filed directly by the Contralor General de la República, the Procurador General de la República, the Fiscal General de la República, or the Defensor de los Habitantes. Regarding the requirement of a matter pending resolution, this Chamber stated as follows in judgment number 04190-95, issued at eleven hours and thirty-three minutes on July 28, 1995:

“(…) First, this is a proceeding of an incidental nature, rather than a direct or popular action, meaning that a matter must be pending resolution—whether before the courts of justice or in proceedings to exhaust administrative remedies—in order to obtain access to constitutional proceedings, and the action must constitute a reasonable means of protecting the right alleged to have been infringed in the principal matter, such that the Constitutional Court’s ruling has a positive or negative effect on those pending proceedings because it determines the constitutionality of the provisions that must be applied in that matter; and only by way of exception does the legislation permit direct access to this avenue—the circumstances set forth in the second and third paragraphs of Article 75 of the Ley de la Jurisdicción Constitucional—” Accordingly, the requirement of a prior matter pending resolution is not merely formal, since neither the mere existence of an underlying matter nor the simple invocation of unconstitutionality is sufficient; the action must also be a reasonable means of protecting the right or interest alleged to have been infringed.

This means that the challenged regulations must be applicable in the underlying matter. (See, to the same effect, judgments numbers 01668-90, 04085-93, 00798-94, 03615-94, 00409-I-95, 00851-95, 04190-95, 00791-96). Likewise, other formalities must be satisfied, namely: explicit identification of the challenged regulations, with proper supporting grounds and specific citation of the constitutional provisions and principles alleged to have been infringed; authentication by an attorney of the written submission bringing the action; the copies required for the justices of the Chamber, the Procuraduría, and the parties participating in the principal matter; proof of the conditions establishing standing (powers of attorney and certifications); and a verbatim certified copy of the pleading raising the constitutional challenge (libelo de impugnación). If the petitioners fail to provide these documents, the President of the Chamber must order them to cure the deficiencies.

II. SUBJECT MATTER OF THE ACTION

The petitioner requests that the final portion of Article 65 of Executive Decree number 25721-MINAE, which constitutes the Reglamento a la Ley Forestal, be declared unconstitutional. It provides as follows:

“Article 65.- All persons who participate in the payment for environmental services (pago de los servicios ambientales), CCB, or CAF shall assign their carbon dioxide sequestration rights to FONAFIFO. Fiscal incentives and payment for environmental services may not be obtained simultaneously.” (Emphasis not in the original) In the petitioner’s view, the challenged provision is unconstitutional because it creates new law and assigns jurisdiction over a matter not contemplated by statute, which is contrary to the principle of statutory reservation (principio de reserva de ley). She further argues that the provision at issue affects the system of economic rights (derechos patrimoniales) granted to owners under Article 23 of the Ley Forestal, thereby infringing the property right (derecho de propiedad) over the economic value arising from the recognition of tax benefits (beneficios fiscales) granted by law. Finally, she claims that the provision gives rise to a retroactive application of the law because it was created to the detriment of the economic rights acquired by the owner and of the vested legal situation (situación jurídica consolidada).

III. ON THE ALLEGED VIOLATION OF THE PROPERTY RIGHT

The petitioner claims that the provision at issue affects the system of economic rights granted to owners under Article 23 of the Ley Forestal, thereby infringing the property right over the economic value arising from the recognition of tax benefits granted by law. Notwithstanding the foregoing, it should be noted that this Chamber has repeatedly held that there is no fundamental right (derecho fundamental) to obtain a tax exemption (exoneración) or tax benefit, nor to receive such a benefit permanently. On the contrary, under the Political Constitution (Constitución Política), all inhabitants of the country are required to contribute to public expenditures; therefore, exemptions or the granting of benefits constitute a tax mechanism intended to encourage or promote the development of activities in the public interest and do not confer a subjective right (derecho subjetivo) whose holders may invoke the protection of vested legal situations. In that regard, in judgment number 2006-00446 issued at 17:47 hours on 25 de enero del 2006, this Court held as follows:

“II.- There is no fundamental right to a tax exemption. Before ruling on the admissibility (admisibilidad) of this constitutional challenge (acción), it must be stated at the outset that one cannot speak of a ‘fundamental right’ to a tax exemption. Under the Political Constitution, all inhabitants of the country have an obligation to contribute to public expenditures (Article 18), and the Legislative Assembly has the authority to establish national taxes and contributions (121 subsection 13). A tax exemption (exención tributaria) is not provided for by the constituent authority as a fundamental right; rather, it is a tax mechanism that may prevent the tax obligation (obligación tributaria) from arising—a total exemption—or reduce the amount of the tax—a partial exemption, through credits or deductions—with respect to certain acts, events, or transactions, or certain taxpayers (sujetos pasivos), when a factual condition described in the provision is satisfied that, in the absence of the exemption, would result in the levy applying.

Thus, exemptions include all tax provisions that affect either the subjective or objective element of the taxable event (hecho imponible), or the elements used to calculate the tax, whether the tax base (base imponible)—through deductions and reductions—or the tax rate (tipo de gravamen). Article 61 of the Code of Tax Rules and Procedures (Código de Normas y Procedimientos Tributarios) defines an exemption as ‘…the statutory dispensation from the tax obligation.’ It is not appropriate to speak of a right not to pay a particular tax or to pay it in an amount lower than that payable by other taxpayers. Rather, the tax obligation is exempted (or repealed), or it arises in a reduced amount, as defined by the tax provision. Accordingly, the majority of legal scholarship concludes that an exemption does not constitute a subjective right, but rather an objective situation defining the tax, which may be repealed by the legislature at any time.

(Judgment 1994-05282, issued at dieciséis horas cincuenta y cuatro minutos del catorce de setiembre de mil novecientos noventa y cuatro, may be consulted in this regard).” In the present case, the petitioner contends that, by providing that owners of natural forests may simultaneously elect tax incentives and Pago de Servicios Ambientales, the challenged provision infringes the property right over the economic value arising from the recognition of tax benefits granted by law. However, as noted above, tax benefits do not constitute a subjective right in favor of the beneficiary and therefore cannot be regarded as economic rights, nor may the protection of a vested legal situation be claimed with respect to them, since by their nature they may be modified or terminated by the legislature at any time. Accordingly, this Court finds that the petitioner is incorrect in alleging that the prohibition contained in the challenged provision against simultaneously electing two tax benefits violates her principal’s property right, because such benefits, even when granted subject to certain conditions, do not form part of the beneficiary’s assets (esfera patrimonial). Under these circumstances, the challenge must be dismissed on the merits (rechazar por el fondo) as to this claim.

IV. ON THE ALLEGED VIOLATION OF THE PRINCIPLE OF NON-RETROACTIVITY OF THE LAW

The petitioner claims that the provision gives rise to a retroactive application of the law because it was created to the detriment of the economic rights acquired by the owner and of the vested legal situation. In this regard, it is necessary to clarify that the principle of non-retroactivity of the law (principio de irretroactividad de la ley) does not entail the immutability of the legal system in a manner that would prevent the law from evolving and adapting to new needs and social changes. In the case at bar (sub lite), the challenged provision neither establishes a new circumstance nor eliminates the benefits granted; it merely establishes a prohibition against obtaining several of those benefits at the same time. In other words, Article 65 of the Regulations to the Ley Forestal (Reglamento a la Ley Forestal) does not provide for retroactive application to the detriment of acquired rights (derechos adquiridos), because, first, it neither eliminates nor creates a new legal circumstance; it only regulates the manner in which those benefits must be granted.

Moreover, that provision does not affect vested legal situations, since tax benefits or exemptions do not constitute a subjective right in favor of the beneficiary. If there were any dispute concerning the application of the law rather than its text, it would fall outside constitutional review through a constitutional challenge, because it would require review and a ruling in the particular case and, at most, could be the subject of an amparo proceeding (recurso de amparo) pursuant to constitutional Article 48.

V. ON THE ALLEGED VIOLATION OF THE PRINCIPLE OF STATUTORY RESERVATION

On various occasions, this Chamber has held that, in tax matters and pursuant to Article 121, subsection 13 of the Political Constitution, the establishment of taxes, as well as the determination of the taxable event, the taxpayer, the tax base, the rate, benefits, and procedure, are matters that must be established and regulated by a formal statute enacted by the Legislative Branch. Nevertheless, those provisions may be developed through an Executive Decree (Decreto Ejecutivo); consequently, it is not unconstitutional for regulations to elaborate upon the conditions under which tax benefits may be granted. In the present case, the petitioner alleges that the challenged provision is unconstitutional because it creates new law and assigns jurisdiction over a matter not contemplated by statute, which is contrary to the principle of statutory reservation. However, an analysis of the challenged Article 65 shows that it is not only grounded in the Ley Forestal, which authorizes the granting of benefits under certain circumstances, but also elaborates upon that grant by providing that, although the law establishes different tax benefits, a taxpayer may elect only one of them. Based on the foregoing, this Court does not find that the provisions of the challenged Decree contravene the principle of statutory reservation; therefore, the challenge must be dismissed as to this claim.

VI. CONCLUSION

In view of the foregoing, the challenge must be dismissed on the merits.

*090016760007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas y treinta y siete minutos del dos de febrero del dos mil diez.

Acción de inconstitucionalidad promovida por JULIA MAROTO MONTEJO, mayor, viuda, portadora de la cédula de identidad número 3-161-208, vecina de San José, en su condición de apoderada generalísima sin límite de suma de INDUSTRIAS AGROPECUARIAS ASOCIADAS S.A.; contra EL ARTÍCULO 65 DEL DECRETO NÚMERO 25721-MINAE QUE ES REGLAMENTO A LA LEY FORESTAL.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 10:55 horas del 05 de febrero del 2009, la accionante solicita que se declare la inconstitucionalidad del artículo 65 del Decreto Ejecutivo número 25721-MINAE que es Reglamento a la Ley Forestal. Alega que ante el Juzgado Civil de Mayor Cuantía de Heredia, en expediente número 07-100190-0377-CI, se tramita un proceso ejecutivo de la Municipalidad de Sarapiquí en contra de su representada. Aduce que en el proceso ejecutivo simple, la deuda que se pretende cobrar se origina en la aplicación que hace la actora del artículo 65 del Reglamento a la Ley Forestal. Dada esa pretensión, su representada interpuso la excepción de falta de derecho, porque considera inconstitucional lo dispuesto en el citado artículo. Además, indica que invocó la inconstitucionalidad de la norma en amparo de sus derechos. Manifiesta que la parte del artículo que impugna es la disposición final que indica que: “No se podrá optar por incentivos fiscales y pago de servicios ambientales en forma simultánea”.Sostiene que el Reglamento Ejecutivo, es un instrumento normativo destinado a facilitar a la Administración Pública la aplicación de la ley, pero constituye también, un medio de garantía de los derechos fundamentales de los administrados, porque propicia que la Administración Pública brinde a éstos un trato jurídico igual, actúe dentro de los límites de la ley, de manera que cumpla con el principio de seguridad jurídica y reconozca los derechos que la ley les concede en la magnitud con que esta lo hace, sin exclusiones, limitaciones o impedimentos que la ley no establezca por sí misma. Indica que la Ley Forestal concede incentivos a los propietarios de bosques naturales que los manejan, para retribuirles o compensarles los beneficios ambientales que generen, ello conforme al artículo 23 de la Ley. Señala que se trata de una norma imperativa, necesaria en vista del principio constitucional de reserva de ley, que no deja espacio a ninguna administración pública para denegar o enervar los incentivos, no importa su naturaleza, si se cumplen los requisitos legalmente previstos para concederlos.En ese sentido, asegura que la referencia que el artículo 23 hace in fine al cumplimiento de los requisitos reglamentarios, alude a elementos objetivos razonables y necesarios que puede exigir la Administración para comprobar que en cada caso se satisface el presupuesto de la ley. Agrega que el carácter imperativo de la norma subordinada por completo a la Administración, y crea al menos una expectativa de derecho a los incentivos al propietario de un bosque natural que se encuentre de hecho en el presupuesto legal y naturalmente, un derecho incorporado a su patrimonio si ya se le han reconocido y declarado administrativamente esos beneficios. Refiere que la disposición contenida en el artículo 65 del Reglamento, está fuera del ámbito de la potestad reglamentaria ejecutiva, porque crea un impedimentos para la concesión de los incentivos y el beneficio de estos, ajena por completo a lo establecido en el artículo 23 de la Ley Forestal, y que no tiene asidero en la ley, ni en el ordenamiento legal en su conjunto.Explica que no se trata de un mero enfrentamiento entre una norma reglamentaria con la ley, aunque una situación de esta clase implica inevitablemente, una violación directa a las disposiciones constitucionales que configuran el régimen de las fuentes del derecho, como los artículos 9, 105, 121 y 140, inciso 3), de la Constitución Política. En realidad el artículos 65 crea derecho nuevo, pues hace una atribución de competencia sobre materia no prevista en la ley y que exige, para su tratamiento normativo válido, de la obra del legislador. Afirma que ello difiere de lo resuelto por la Sala Constitucional en los casos en que ha creado jurisprudencialmente una barrera de acceso al control de constitucionalidad, alegando que el enfrentamiento entre el reglamento y la ley es asunto de mera legalidad. En consecuencia, el artículos 65 es inconstitucional porque vulnera el principio de reserva de ley desde una perspectiva que no es en rigor la que ha cuajado en sentencias desestimatorias la Sala.Reclama que el artículo 65 impugnado, incide en el orden de derechos patrimoniales concedido a los propietarios en el artículo 23 de la Ley Forestal, que la Administración ha de reconocer y declarar cada vez que se produce la hipótesis fáctica del último artículo citado. Esta incidencia implica una infracción al derecho de propiedad sobre los valores económicos resultantes del reconocimiento de los beneficios fiscales concedidos por la ley, que se suman al patrimonio del propietario en cuanto la administración los declara y concede en cumplimiento de la ley. Por consiguiente estima que la norma impugnada es violatoria del derecho fundamental a la propiedad, reconocido expresamente en el artículo 45 de la Constitución Política. Considera que la creación mediante la potestad reglamentaria de un supuesto innovativo de cancelación unilateral de los beneficios otorgados al propietario en el artículo 23 de la Ley Forestal, equivale materialmente, sea por sus efectos y consecuencias, a un acto unilateral ablativo de los derechos del propietario conferidos por la ley, infractor del derecho de aquél al debido proceso.Finalmente, estima que la norma es inconstitucional porque da origen a una aplicación retroactiva de una norma creada por la Administración en perjuicio de los derechos patrimoniales adquiridos del propietario y de la situación jurídica consolidada de éste órgano como resultado de lo dispuesto en el artículo 23 de la Ley, y de su expresión documental y contractual. Este hecho, causa infracción al contenido del artículo 34 de la Constitución Política.
  2. 2A efecto de fundamentar la legitimación que ostenta para promover esta acción de inconstitucionalidad, la accionante señala que ante el Juzgado Civil de Mayor Cuantía de Heredia, en expediente número 07-100190-0377-CI, se tramita un proceso ejecutivo de la Municipalidad de Sarapiquí en contra de su representada; dentro del cual invocó la inconstitucionalidad de la norma (folio 7).
  3. 3El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.
  4. 4En los procedimientos se han cumplido las prescripciones de ley.

Redacta la Magistrada Calzada Miranda; y,

Considerando:

I. SOBRE LOS PRESUPUESTOS FORMALES DE ADMISIBILIDAD DE LA ACCIÓN

La acción de inconstitucionalidad es un proceso con determinadas formalidades, que deben ser satisfechas a efecto de que la Sala pueda válidamente conocer el fondo de la impugnación. En ese sentido, el artículo 75 de la Ley de la Jurisdicción Constitucional, establece los presupuestos de admisibilidad de la acción de inconstitucionalidad. En un primer término, se exige la existencia de un asunto previo pendiente de resolver, sea en vía judicial, o bien, en el procedimiento para agotar de la vía administrativa, en que se haya invocado la inconstitucionalidad como medio razonable para amparar el derecho o interés que se considera lesionado. Sin embargo, en el párrafo segundo y tercero, la ley establece de manera excepcional, presupuestos en los que no se exige el asunto previo, cuando por la naturaleza del asunto, no exista una lesión individual y directa, o se trate de la defensa de intereses difusos o colectivos, o bien cuando es formulada en forma directa por el Contralor General de la República, el Procurador General de la República, el Fiscal General de la República y el Defensor de los Habitantes. Ahora bien, en cuanto a la exigencia de un asunto pendiente de resolver, esta Sala mediante sentencia número 04190-95, de las once horas treinta y tres minutos del veintiocho de julio de mil novecientos noventa y cinco, señaló lo siguiente:

“(…)En primer término, se trata de un proceso de naturaleza incidental, y no de una acción directa o popular, con lo que se quiere decir que se requiere de la existencia de un asunto pendiente de resolver -sea ante los tribunales de justicia o en el procedimiento para agotar la vía administrativa- para poder acceder a la vía constitucional, pero de tal manera que, la acción constituya un medio razonable para amparar el derecho considerado lesionado en el asunto principal, de manera que lo resuelto por el Tribunal Constitucional repercuta positiva o negativamente en dicho proceso pendiente de resolver, por cuanto se manifiesta sobre la constitucionalidad de las normas que deberán ser aplicadas en dicho asunto; y únicamente por excepción es que la legislación permite el acceso directo a esta vía -presupuestos de los párrafos segundo y tercero del artículo 75 de la Ley de la Jurisdicción Constitucional-” Así las cosas, la exigencia de un asunto previo pendiente de resolver, no constituye un requisito meramente formal, toda vez, que no basta con la sola existencia de un asunto base, ni con la simple invocación de la inconstitucionalidad, pues se requiere además, que la acción sea un medio razonable para amparar el derecho o interés que se considera lesionado.

Esto quiere decir, que la normativa impugnada debe ser aplicable en el asunto base. (Ver en igual sentido las sentencias números 01668-90, 04085-93, 00798-94, 03615-94, 00409-I-95, 00851-95, 04190-95, 00791-96). Asimismo, existen otras formalidades que deben ser cumplidas, a saber, la determinación explícita de la normativa impugnada, debidamente fundamentada, con cita concreta de las normas y principios constitucionales que se consideren infringidos, la autenticación por abogado del escrito en el que se plantea la acción, las copias necesarias para los magistrados de la Sala, la Procuraduría y las partes que intervienen en el asunto principal, la acreditación de las condiciones de legitimación (poderes y certificaciones), así como la certificación literal del libelo de impugnación, los cuales, en caso de no ser aportadas por los accionantes, deben ser prevenidos para su cumplimiento por el Presidente de la Sala.

II. OBJETO DE LA ACCIÓN

Solicita la accionante, que se declare la inconstitucionalidad de la parte final del artículo 65 del Decreto Ejecutivo número 25721-MINAE que es Reglamento a la Ley Forestal, que dispone lo siguiente:

“Artículo 65.- Todos aquellos que se acojan al pago de los servicios ambientales, al CCB o CAF, cederán sus derechos por fijación de dióxido de carbono, al FONAFIFO. No se podrá optar por incentivos fiscales y pago de servicios ambientales en forma simultánea.”(El resaltado no corresponde al original) A juicio de la accionante, la norma impugnada es inconstitucional porque crea derecho nuevo y hace una atribución de competencia sobre materia no prevista en la ley, lo cual resulta contrario al principio de reserva de ley. Asimismo, aduce que la norma cuestionada incide en el orden de derechos patrimoniales concedido a los propietarios en el artículo 23 de la Ley Forestal, lo que implica una infracción al derecho de propiedad sobre los valores económicos resultantes del reconocimiento de los beneficios fiscales concedidos por ley. Finalmente, reclama que la norma da origen a una aplicación retroactiva de la ley, porque es creada en perjuicio de los derechos patrimoniales adquiridos por el propietario y de la situación jurídica consolidada.

III. SOBRE LA ALEGADA VIOLACIÓN AL DERECHO DE PROPIEDAD

Reclama la accionante, que la norma cuestionada incide en el orden de derechos patrimoniales concedido a los propietarios en el artículo 23 de la Ley Forestal, lo que implica una infracción al derecho de propiedad sobre los valores económicos resultantes del reconocimiento de los beneficios fiscales concedidos por ley. No obstante lo anterior, cabe mencionar, que en reiteradas ocasiones, esta Sala ha señalado que no existe un derecho fundamental a obtener una exoneración o beneficio tributario, ni a obtener esa beneficio en forma permanente. Por el contrario, de conformidad con la Constitución Política todos los habitantes del país se encuentran obligados a contribuir con los gastos públicos, por lo que las exenciones o concesión de beneficios constituyen una técnica tributaria para incentivar o impulsar el desarrollo de actividades de interés público, no conceden un derecho subjetivo cuyos titulares puedan alegar la defensa de situaciones jurídicas consolidadas. En ese sentido, mediante sentencia número 2006-00446 de las 17:47 horas del 25 de enero del 2006, este Tribunal consideró lo siguiente:

“II.- No existe un derecho fundamental a la exoneración tributaria. Previo al pronunciamiento sobre la admisibilidad de esta acción, debe indicarse como punto de partida, que no puede hablarse de un “derecho fundamental” a la exoneración tributaria. Según la Constitución Política existe una obligación de todos los habitantes del país de contribuir para los gastos públicos (artículo 18) así como una atribución de la Asamblea Legislativa de establecer los impuestos y contribuciones nacionales (121 inciso 13). La exoneración o exención tributaria no está prevista por el constituyente como un derecho fundamental, sino que consiste en una técnica tributaria que puede impedir el nacimiento de la obligación tributaria –exención total- o reducir la cuantía del tributo –exención parcial, a través de bonificaciones o deducciones-, por ciertos actos, hechos o negocios, o a ciertos sujetos pasivos, al cumplirse un presupuesto de hecho descrito en la norma que, de no existir, implicaría la no excepción del gravamen.

Así, se consideran exenciones todas aquellas normas tributarias que afectan, o el elemento subjetivo u objetivo del hecho imponible, o los elementos de cuantificación del tributo, sea, en la base imponible (deducciones y reducciones) o en el tipo de gravamen. El artículo 61 del Código de Normas y Procedimientos Tributarios define la exención como “…la dispensa legal de la obligación tributaria”. No resulta adecuado hablar de un derecho a no pagar determinado tributo, o a satisfacerlo en una cantidad inferior de la que corresponde pagarla a otros contribuyentes. Se trata de que la obligación tributaria está exenta (o derogada) o surge con un monto más reducido, de conformidad como lo defina la norma tributaria. Por ello, la mayoría de la doctrina concluye que la exención no constituye un derecho subjetivo, sino una situación objetiva, configuradora del tributo, que puede ser derogada por el legislador en cualquier momento.

(Puede consultarse al respecto la sentencia 1994-05282 de las dieciséis horas cincuenta y cuatro minutos del catorce de setiembre de mil novecientos noventa y cuatro).” Ahora bien, en el caso concreto, la accionante considera que al establecer la norma impugnada que los propietarios de bosques naturales podrán optar por incentivos fiscales y pago de servicios ambientales en forma simultánea, lesiona el derecho de propiedad sobre los valores económicos resultantes del reconocimiento de los beneficios fiscales concedidos por ley. No obstante, tal como se mencionó líneas atrás, los beneficios fiscales no constituyen un derecho subjetivo a favor del beneficiado y por ende no pueden ser considerados como derechos patrimoniales, ni puede exigirse sobre ellos la tutela de una situación jurídica consolidada, ya que por su naturaleza pueden ser modificados o extinguidos en cualquier momento por el legislador.

En virtud de ello, estima este Tribunal que no lleva razón la accionante al alegar que la prohibición de optar por dos beneficios fiscales en forma simultánea que contiene la norma impugnada, vulnera el derecho de propiedad de su representada, por cuanto ese tipo de beneficios aún cuando sean concedidos bajo determinadas condiciones, no forman parte de la esfera patrimonial del beneficiado. Bajo tales circunstancias, resulta procedente rechazar por el fondo la acción, en cuanto a este extremo.

IV. SOBRE LA ALEGADA VIOLACIÓN AL PRINCIPIO DE IRRETROACTIVIDAD DE LA LEY

Reclama la accionante que la norma da origen a una aplicación retroactiva de la ley, porque es creada en perjuicio de los derechos patrimoniales adquiridos por el propietario y de la situación jurídica consolidada. En ese sentido, es necesario precisar que el principio de irretroactividad de la ley, no implica una inmutabilidad del ordenamiento jurídico, de tal forma que no permita que el Derecho evolucione y se adapte a las nuevas necesidades y cambios sociales. En el sub lite, la norma impugnada no establece una nueva circunstancia, ni elimina los beneficios concedidos, únicamente, establece la prohibición de acceder a varios de esos beneficios al mismo tiempo. En otras palabras, el artículo 65 del Reglamento a la Ley Forestal no dispone de una aplicación retroactiva en perjuicio de derechos adquiridos, pues en primer término, no elimina, ni crea una nueva circunstancia jurídica, solo regula la forma en la que se deberán otorgar esos beneficios.

Por otra parte, esa disposición no afecta situaciones jurídicas consolidadas, dado que los beneficios o exoneraciones fiscales no constituyen un derecho subjetivo a favor del beneficiado. Ahora bien de existir algún conflicto en la aplicación de la ley y no en el texto de la ley, ello sería un conflicto ajeno al control de constitucionalidad por la vía de acción, dado que implica la revisión y pronunciamiento en el caso concreto, siendo que a lo sumo, podría ser objeto de un recurso de amparo de conformidad con el artículo 48 constitucional.

V. SOBRE LA ALEGADA VIOLACIÓN AL PRINCIPIO DE RESERVA LEGAL

En diversas oportunidades, esta Sala ha sostenido que en materia tributaria y de conformidad con el artículo 121, inciso 13 de la Constitución Política, el establecimiento de tributos, así como la determinación del hecho generador, el sujeto pasivo, la base imponible, la tarifa, beneficios y procedimiento, son aspectos que deben ser establecidos y regulados por ley formal emitida por el Poder Legislativo. No obstante, el desarrollo de esos preceptos puede realizarse a través de un Decreto Ejecutivo, por lo que no es inconstitucional que un Reglamento desarrolle las condiciones bajo las cuales se podrán conceder beneficios fiscales. En el caso concreto, la accionante alega que la norma impugnada es inconstitucional porque crea derecho nuevo y hace una atribución de competencia sobre materia no prevista en la ley, lo cual resulta contrario al principio de reserva de ley. Sin embargo, del análisis del artículo 65 impugnado, se colige que éste no solo encuentra fundamento en la ley Forestal que es la que autoriza el otorgamiento de beneficios en determinadas circunstancias, sino que además, desarrolla ese otorgamiento en el sentido que si bien la ley dispone de diferentes beneficios fiscales, el contribuyente solo podrá optar por uno de ellos.

Con base en lo anterior, no observa este Tribunal que lo dispuesto en el Decreto impugnado resulte contrario al principio de reserva de ley, por lo que la acción debe ser rechazada en cuanto a este extremo.

VI. CONCLUSIÓN

En virtud de lo anteriormente expuesto, se impone rechazar por el fondo la acción.

Por tanto:

Se rechaza por el fondo la acción.
