Constitutional Chamber Type of matter: Amparo action CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty on the seventeenth of November of two thousand twenty-three.
Amparo action processed in expediente number 23-022789-0007-CO, filed by Nombre9119, identity card CED7306, against the MINISTRY OF HEALTH AND THE NATIONAL ANIMAL HEALTH SERVICE (SENASA).
Whereas:
In said official communication, the following is also requested, transcribed verbatim below: "(…) Due to all of the above, as the Ministry of Health, in order to safeguard people's health and safety, as this is an extremely serious and urgent case, and to prevent the spread of COVID 19, we respectfully request your office to petition the Liberia Criminal Court for the corresponding Search Warrant at the aforementioned Site, given that there has been sufficient evidence to determine that we are in the presence of an (illicit) activity contrary to the Law, on a site that constitutes private property, which has been promoted through social media, where complaints from citizens and a local news outlet already exist regarding the activities organized for March 5, 2022. (…)". (See folios 0076 to 0080) On Saturday, March 5, 2022, through summary proceeding No. 22-000376-0396-PE of the Assistant Prosecutor's Office of the I Judicial Circuit of Guanacaste, attorney Luis Alberto Ruiz Morales, Assistant Prosecutor of Liberia, requested a search, registration, and inspection warrant from the on-duty criminal judge of the Criminal Court of the First Judicial Circuit of Guanacaste, to be executed: "(…) In the dwelling where Mr.
Nombre9124 resides, located in the canton and district of Liberia, Dirección1156 , 500 meters south of Hotel Las Espuelas, a farm with a wooden gate. (…)". (See folios 0081 to 0084) On Saturday, March 5, 2022, attorney Ana Ruth Ortega Chavarría of the Liberia Criminal Court issued an official communication by which: "(…) It is resolved: THE SEARCH WARRANT IS DENIED (…)". (See folios 0085 to 0088) That day, Saturday, March 5, 2022, the authorities of the Liberia Police Delegation generated Public Force Report No. 0032742-22, which textually states: "(…) At 4:00 p.m., a check and verification of sanitary order MS-DRRSCH-DARSL-ERS-OS-006-2022, notified on March 3, 2022, to Mr. Nombre9124 ID CED7307, was carried out, which indicated not to hold mass gathering events on properties without sanitary permits at the location 100 meters northwest of Ferromax. Upon arriving at the site, approximately 300 vehicles were observed in the parking area and 1000 people inside the establishment, where they did not maintain distancing nor use face masks; there was no capacity control, violating all the rules established by the Ministry of Health.
At 10:00 p.m., a second visit was made to the site, and approximately 200 thousand people were observed inside the property where dance music was playing, as well as the sale and consumption of liquor; likewise, people did not maintain distancing nor use face masks; there was no capacity control, violating all the rules established by the Ministry of Health. A police report is made and sent to the corresponding entity. (…)". (See folios 0089 to 0090) On Wednesday, March 30, 2022, the Directorate of the Liberia Health Governing Area issued and notified sanitary report number MS-DRRSCH-DARSL-COVID19-111840278- #3-2022 for non-compliance indicated in Public Force Report No. 0032742-22. Through this sanitary report, a fixed fine of one base salary, corresponding to the sum of ¢462,200, was imposed "(…) for being remiss in complying with special or general orders or measures issued by health authorities (…)".
(See folios 0091 to 0092) On Wednesday, March 30, 2022, the execution of a sound level measurement (sonometría) was coordinated with the complainant (for this occasion) to verify the acoustic intensity level emitted by the alleged clandestine activities that were apparently taking place on the property adjacent to the one denounced. The coordination record is contained in the complaint file. (See folio 0089 of complaint file D #082-2022) Subsequently, on Saturday, April 2, 2022, a sound level measurement was carried out at 10:59 p.m., where the corresponding record was completed. (See folio 0091 of complaint file D #082-2022) On Tuesday, April 12, 2022, technical report No. MS-DRRSCH-DARSL-ER-IT-0127-2022 was prepared, recording the results of the sound level measurement, among which the average sound measurement stands out, reaching 74.6 decibels dB (the maximum permitted for that zone is 45 dB).
(See folios 0092 to 0094 of complaint file D #082-2022) On Tuesday, April 26, 2022, based on the results of the sound level measurement, sanitary order with consecutive number N° MS-DRRSCH-DARSL-ER-OS-050-2022 was notified, ordering the following: "(…) Immediately suspend any activity related to mass gathering events with musical performances or reproduction on the property located in Guanacaste, Liberia, Dirección1157 (cadastral map G-1366329-2009, Farm in Guanacaste No. 0175227) due to noise emission generated by music at a volume that exceeds current regulations. (…)". In compliance with the provisions of the Procedure for Noise Measurement (Decreto Ejecutivo N° 32692-S) article 9, the same sanitary order also ordered what is cited below: "(…) Submit to the Directorate of the Liberia Health Governing Area a noise confinement plan with its calculation report and works schedule (…)". The deadline for said sanitary order expired on Tuesday, May 10, 2022, without being complied with.
(See folios 0098 to 0100 of complaint file D #082-2022) Once the sanitary order had expired, on Wednesday, May 11, 2022, the case file was examined to verify the possible incorporation of documentation in compliance with the sanitary order; however, the elements to be submitted were not provided, so the corresponding technical non-compliance report was prepared; No. MS-DRRSCH-DARSL-ER-COS-002-2022. (See folio 0101 of complaint file D #082-2022) FOURTH- In order to duly inform the Justices of the Constitutional Chamber of the Supreme Court of Justice regarding the events that occurred between December 2021 and the present date, on private land with a dwelling and other constructions (farm number 0175227 with map number 5-1366329-2009), property of GABLACE (F.D.G.) Sociedad de Responsabilidad Limitada located in Guanacaste, Liberia, Liberia, Santa Lucía, in front of national route 1, 80 meters north of the La Arena bridge, it is respectfully reported that, in accordance with the data contained in the physical and electronic records of the Directorate of the Liberia Health Governing Area, there are no complaints filed by Mr.
Nombre9120 , identification number CED7308. What does appear in the documentation contained in the administrative file of complaint No. D#-082-2022 of March 1, 2022, is a message via email, sent by Junta Directiva Comunidad Dorada S.A, who, confidentially, state the following verbatim: "(…) For approximately 2 months there have been situations with the neighbor involving clandestine parties, and on Saturday, February 12, a person was wounded by 5 gunshots and died on the way to the hospital. On Sunday the 13th, an OIJ officer contacted us because the party got out of control. We always call 911 but they ultimately cannot do more. We have already spoken with the municipality, Mayor Luis Gerardo, Public Force Lieutenant Jason Padilla, and they inform us that there are complaints, 3 fines, and several processes against the person in charge; however, they express they do not have the support of a judge's order for a formal search.
(…)". FIFTH- That the Directorate of the Liberia Health Governing Area, in view of the non-compliance with the sanitary orders on the property in question, requested a search warrant since Saturday, March 5, 2022, duly before the Judicial Branch, specifically the Liberia Prosecutor's Office, and this in turn before the competent Criminal Court, but it was denied. SIXTH- Among the multiple procedures and administrative acts carried out by the Directorate of the Liberia Health Governing Area, the case documentation includes the execution of a sound level measurement (sonometría) (Saturday, April 2, 2022) during one of the mass gathering events on the denounced farm, which generated a sanitary order notified to the organizer of the activities without authorization from the Ministry of Health, Mr. Nombre9124 , thus the noise issue being addressed by this institution. Despite the foregoing, the order was not complied with.
SEVENTH- That within the physical and electronic records kept by the Directorate of the Liberia Health Governing Area, there is no record of any other formally processed complaint, other than the one already indicated with consecutive number N° D#-082-2022. EIGHTH- This Ministry, to date, has not received emails or any other type of communication, sent or filed by either the filers of the referenced complaint, or by the appellant through the Amparo Appeal, that would allow us to know that the situation has been reactivated; on the contrary, we have no recent complaint or news related to the situation described in the Appeal before us. NINTH- It is reported that the email address ...399 is the official email for receiving user requests (general email). The email address ...400 is the institutional email of an official of the Liberia Health Governing Area, but it is not specifically for complaints or first-entry requests, because she works in the Health Services Enablement, however, the complaint that entered said official's email and the general email of the Liberia Health Governing Area was duly addressed.
CONCLUSION: With the foregoing and with the documentary evidence provided, this Liberia Health Governing Area has carried out matters within its competence, where it has been accredited that what was requested since December 2021 has been addressed, performing the relevant actions; the necessary Sanitary Orders have been duly issued and notified; in accordance with what was previously mentioned in this report. It should be clarified that regarding the keeping of pigs, it is not the competence of the Ministry of Health, and there is no record in our database of any complaint regarding this, just as SENASA has not requested any type of action from us regarding the topic in question. Therefore, due to the foregoing, it is evident that the Administration has given adequate attention to the case before us, adhering to the current and applicable guidelines and legislation".

Considering:
Firstly, it must be clarified that, as of judgment No. 2008-02545 at 08:55 a.m. on February 22, 2008, this Chamber has referred to the contentious-administrative jurisdiction those matters in which it is discussed whether the Public Administration has complied or not with the deadlines set by the General Law of Public Administration (Ley General de la Administración Pública) (articles 261 and 325) or sectoral laws in special administrative procedures, to resolve by final act an administrative procedure —initiated ex officio or at the request of a party— or to hear the corresponding administrative appeals. However, it has also contemplated cases of exception to the foregoing, as occurs in the present case, since the grievance refers to alleged environmental complaints that have supposedly not been addressed. In this type of matter, constitutional jurisprudence has deemed the application of constitutional review appropriate, such that we proceed to resolve the sub iudice.
II-. OBJECT OF THE APPEAL. The appellant indicates that since January 22, 2021, a complaint was filed with Senasa regarding "pigsty and pork rind seller activities in residential areas" affecting the Hogar de Ancianos Club Retirement Community, which has not been resolved. They state that the lack of attention to this complaint puts the health of the older adults residing there at risk, due to the number of flies, the bad smell, and other factors. They accuse that a clandestine bar operates at the denounced location where chicharrón sales and parties are organized until late at night. They maintain that, despite the fact that since February 19, 2022, the corresponding complaint was filed with the Ministry of Health, no measure has been taken to resolve the indicated problem.
Of importance for the decision in this matter, the following facts are deemed duly proven:
REGARDING SENASA:
Mr. Nombre9124 understands the situation and requests the possibility of being given a few days to solve it (specifically this week) and otherwise, if he has not solved it, we should proceed with the confiscation. It is reiterated to Mr. Nombre9124 that the issued sanitary order is of immediate compliance." (See report rendered under oath by the respondent authorities of Senasa).
REGARDING THE MINISTRY OF HEALTH:
In the sub lite, the appellant indicates that since January 22, 2021, a complaint was filed with Senasa regarding "pigsty and pork rind seller activities in residential areas" affecting the Hogar de Ancianos Club Retirement Community, which has not been resolved. They state that the lack of attention to this complaint puts the health of the older adults residing there at risk, due to the number of flies, the bad smell, and other factors.
In this regard, this Tribunal verifies that on January 22, 2021, a complaint was filed with Senasa regarding a "Pigsty (pig farm) located in a place where there are dwellings and a retirement home for the elderly will soon open (sic). The smell is very unpleasant and constant." On that occasion, the complainant, Nombre9120 , indicated ...401 as the means for notifications. Therefore, on January 26, 2021, Senasa inspected the denounced site and issued sanitary order No. 0213383 against Nombre9122 , who stated they were responsible for the swine production. That document ordered: "The uncontrolled management of liquid and solid waste is ordered to be immediately suspended, in such a way as to prevent the generation of bad odor. It is ordered, within a period of 5 calendar days, to have an establishment authorized for swine production by means of a CVO, which in turn has the approval of the Location Permit for the solid and liquid waste treatment system, as well as compliance with the Reglamento de Granjas Porcinas." On February 1, 2021, Nombre9122 filed an appeal against sanitary order No. 0213383, which was rejected as untimely according to resolution SENASA-DRCH-AJ-003-2021 at 1:00 p.m. on February 3, 2023, issued by the Chorotega Region of Senasa. Additionally, on February 15, 2021, Nombre9122 requested an extension of the deadline set forth in sanitary order No. 0213383.
From the evidence, it follows that on October 2, 2023, Senasa inspected the denounced location and was attended by Nombre9124 , who stated they were responsible for the property and denied entry without a judicial order. Additionally, a sanitary order was issued stating: "It is ordered immediately to have the swine production establishment with a veterinary operation certificate (certificado veterinario de operación, CVO); if this is not the case, the presence of pigs cannot exist." Finally, according to the report rendered under oath by the respondent authorities of Senasa, on October 3, 2023, Nombre9124 appeared before the Regional Directorate of Chorotega of Senasa to request information on the operating permits for swine exploitation. Additionally, during that service, "Mr. Nombre9124 raises the fact that on a previous occasion they began the procedures to obtain the CVO, but did not complete them and remained at a stage of permits for wastewater treatment (STAR) with the MINSA (…).
It was explained to Mr. Nombre9124 that according to the current regulation on pig farms 37155-MAG, article 8, subsection b, states: 'No less than 500 meters measured horizontally, from the nearest shed to the property boundaries with respect to health establishments, educational establishments, and establishments for the elderly.' And, therefore, by not meeting this requirement, it will not be possible to grant the CVO for swine exploitation. He was informed again that, by failing to comply with the permits, it was ordered to immediately eliminate the current pigs from the property, and that if this was not done, we would proceed with their confiscation (decomiso). Mr. Nombre9124 understands the situation and requests the possibility of being given a few days to solve it (specifically this week) and otherwise, if he has not solved it, we should proceed with the confiscation. It is reiterated to Mr.
Nombre9124 that the issued sanitary order is of immediate compliance." Thus, in the sub lite, the lack of diligent and swift action by Senasa to resolve the complaint filed on January 22, 2021, regarding the keeping of pigs generating bad odors, is evident. This is because, although it is verified that, upon that complaint, Senasa inspected the denounced site and issued a sanitary order, it is not verified that it carried out adequate follow-up to verify its due compliance. In this sense, it should be noted that it was not until October 2, 2023, namely, after the Senasa authorities were notified of the resolution granting leave to proceed with this amparo, that an inspection was conducted at the site and a new sanitary order was issued. Additionally, from the case file, no evidentiary material can be inferred that would allow crediting that the complainant was notified of the outcome of the request filed in January 2021.
Therefore, the amparo is granted with respect to Senasa.
V.On the other hand, the appellant accuses that a clandestine bar operates at the denounced location where chicharrón sales and parties are organized until late at night. They maintain that, despite the fact that since February 19, 2022, the corresponding complaint was filed with the Ministry of Health, no measure has been taken to resolve the indicated problem.
The Chamber verifies that, in December 2021, the Ministry of Health received complaints about alleged mass gathering activities on a private property located at Dirección1152 . Therefore, on December 3, 2021, Ministry of Health officials inspected the denounced property and interviewed Nombre9124 regarding a social media post calling for a mass gathering activity for the following day. That same day, the Ministry of Health issued sanitary order MS-DRRSCH-DARSL-ER-OS-096-2021, in which Nombre9124 was warned that "(…) mass gathering activities are regulated, as they are considered activities that may promote the spread of Covid-19, and therefore require authorization from the Ministry of Health (…)". Despite this, on December 4, 2021, the Public Force prepared police report No. 0174937-21, which indicated that Nombre9124 failed to comply with the provisions of sanitary order MS-DRRSCH-DARSL-ER-OS-096-2021. Additionally, on December 31, 2021, the Public Force prepared police report No. 0000061-22, which stated that Nombre9124 organized a dance activity that did not have permits from the Ministry of Health or a liquor license, and where loud music was played.
By means of sanitary order MS-DRSCH-DARSL-OS-104-2022, Nombre9124 and Nombre9125 were warned to "suspend all activities and the one intended to be held on January 29, 2022, which are not authorized by the Ministry of Health." Through sanitary report MS-DRRSCH-DARSL-COVID19-111840278-2022, the non-compliance with sanitary order MS-DRRSCH-DARSL-ER-OS-096-2021 was recorded, and the payment of a fine was imposed. Furthermore, by means of sanitary report MS-DRRSCH-DARSL-COVID19-111840278-A2-2022, the non-compliance with Public Force report No. 00000061-22 was recorded, and the payment of a fine was imposed. This act was challenged.
On February 19, 2022, from the account ...402, an email was sent to ...399, accusing that for two months the neighbors have been holding clandestine parties, in which, even on February 12, 2022, a person died from a gunshot wound.
Additionally, it was claimed that at the reported location, music is played at high volume and liquor is sold, which affects the residents of the nursing home. The foregoing was forwarded on March 1, 2022, to ...400.
The Court certifies that, on March 1, 2022, the Directorate of the Liberia Health Governing Area (Área Rectora de Salud de Liberia) assigned the consecutive number D-082-2022 to the complaint received at the email address ...400. By sanitary order MS-DRRSCH-DARSL-ERS-OS-006-2022, notified on March 3, 2022, the Ministry of Health warned Nombre9124 to “Not hold an event with a gathering of people on the property without a sanitary operating permit, because the activity (scheduled for Saturday, March 5, 2022) does not have the respective sanitary authorization from the Ministry of Health.” On March 4, 2022, the Ministry of Health filed a complaint with the Liberia Prosecutor’s Office regarding the alleged mass event to be held on March 5, 2022, so the Public Ministry requested a search warrant from the Criminal Court of Liberia, which was rejected by resolution at 12:10 p.m. on March 5, 2022. On March 5, 2022, the Public Force (Fuerza Pública) issued report no. 0032742-22 to the judicial authority, which recorded the non-compliance with sanitary order MS-DRRSCH-DARSL-ERS-OS-006-2022. Given this situation, the Ministry of Health issued sanitary report MS-DRRSCH-DARSL-COVID19-111840278-#3-2022 for non-compliance with Public Force report no. 0032742-22, for which the payment of a fine was imposed on Nombre9124.
On April 2, 2022, the Ministry of Health conducted a sonic measurement at the reported location, for which it issued a technical inspection report MS-DRRSCH-DARSL-ER-IT-0127-2022 dated April 12, 2022, which stated that the sound limit permitted for the respective zone was exceeded. By sanitary order MS-DRRSCH-DARSL-ERS-OS-050-2022, notified on April 26, 2022, the Ministry of Health warned Nombre9124 to “Immediately suspend any activity related to mass gathering events involving musical performances or playback (…) due to noise emission generated by music at a volume that exceeds current regulations (…) Submit to the Directorate of the Liberia Health Governing Area a noise confinement plan with its design calculations and activity schedule (…) Due date: Tuesday, May 10, 2022.” Finally, on May 11, 2022, the Ministry of Health issued the report of non-compliance with sanitary order MS-DRRSCH-DARSL-ERS-OS-050-2022 in relation to the failure to submit a noise confinement plan.
Thus, in the instant case, it is evident that the Ministry of Health has carried out multiple actions regarding the reported site located next to the aforementioned nursing home, which began to be performed starting in December 2021, that is, prior to the complaint filed by the claimant. Despite this, in the case under examination, it cannot be verified that the aforementioned ministry has used all the tools conferred by the legal system to compel compliance with sanitary order MS-DRRSCH-DARSL-ERS-OS-050-2022, even though, as of May 11, 2022, it was confirmed that the requirement concerning the noise confinement plan was not met. In the same vein, the Chamber finds it regrettable that the Ministry of Health has not definitively resolved the complaint filed by the petitioner on March 1, 2022, via email and to which the consecutive number D-082-2022 was assigned, nor does it certify that the corresponding party was notified to the complainant.
Ergo, the appeal is upheld with respect to the Ministry of Health.
I have supported this Court’s thesis that, when the aggrieved party alleges a violation of the right to a swift and complete justice in administrative proceedings, the bodies that must hear the legal dispute are the Administrative-Contentious Courts, and not this Chamber. However, with the recent enactment of Law No. 9097, the Law Regulating the Right of Petition, it has been established that this right is susceptible to judicial protection through the amparo appeal established by Article 32 of the Law of Constitutional Jurisdiction, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in those cases where the petitioner considers that the material actions of the Administration, its administrative acts, or its response are affecting their fundamental rights. In my view, the recently enacted regulations do not imply that this Court must modify its jurisprudential line, as this Court, based on point 7 of its Law, is exclusively responsible for defining its own competence.
Therefore, except for those legal-constitutional disputes that have been recognized by this same Chamber as exceptions, which may properly be heard in this jurisdiction through the constitutional process of amparo protection, in all other cases, and for the reasons given by this Court (Judgment No. 2008-02545 of 8:55 a.m. on February 22, 2008), the competent authorities are the Judges of the administrative-contentious jurisdiction, all of which is in accordance with point 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and norms), and the corresponding legal norms based on a logical, systemic, and teleological interpretation of the legal system.
In environmental matters, it is the criterion of the undersigned that, if the Public Administration has already intervened, its consideration and resolution corresponds to the administrative-contentious jurisdiction. Nevertheless, I do hear the merits of the case when other rights of the persons affected by the source of contamination are at stake, among them, health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as is the case here, in which the petitioner alleges that since January 22, 2021, a complaint was filed before the National Animal Health Service (Servicio Nacional de Salud Animal) and the Ministry of Health regarding “pigsty and pig-raising activities in residential areas” that affect the Club Retirement Community Nursing Home, which has not been resolved. It is stated that the failure to address this complaint puts the health of the older adults who live there at risk, due to the number of flies, the bad odor, and other issues.
It is alleged that an illegal bar operates at the reported location, where chicharrón sales and parties are organized until late into the night. It argues that, despite the corresponding complaint being filed with the Ministry of Health since February 19, 2022, no measure has been taken to resolve the indicated problem. The foregoing constitutes a violation of the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.
The parties are warned that if any paper documents have been provided, as well as objects or evidence contained in any electronic, computer, magnetic, optical, telematic device, or produced by new technologies, they must be withdrawn from the office within a maximum period of 30 business days counted from the notification of this judgment. It is warned that any material not withdrawn within this period will be destroyed, according to the provisions of the “Regulation on Electronic Case Files before the Judicial Branch” (Reglamento sobre Expediente Electrónico ante el Poder Judicial), approved by the Full Court in Article XXVI of session no. 27-11 of August 22, 2011, published in the Judicial Bulletin (Boletín Judicial) no. 19 of January 26, 2012, as well as in the agreement of the Superior Council of the Judicial Branch, approved in Article LXXXI of session no. 43-12 held on May 3, 2012.
Therefore:
The appeal is declared with merit. Nombre9120 and Harold Marín Esquivel, in their respective order, general director and director of the Chorotega Regional Directorate, both of the National Animal Health Service, or whoever holds those positions in their place, are ordered to coordinate what is necessary and carry out all actions within the scope of their respective competencies, for the purpose of, within a period of TWO MONTHS, counted from the notification of this judgment, definitively resolving the complaint filed on January 22, 2021, and notifying the corresponding party to the complainant at the means indicated for such purposes. In addition, Luis Mayorga Díaz, in his capacity as director of the Liberia Health Governing Area of the Ministry of Health, or whoever holds that position, is ordered to coordinate what is necessary and carry out all actions within the scope of his competencies, so that within a period of TWO MONTHS, counted from the notification of this pronouncement, the complaint filed on March 1, 2022 via email and to which consecutively number D-082-2022 was assigned is definitively resolved, and the corresponding party is notified to the complainant at the means indicated for such purposes.
The foregoing is issued with the warning that, based on the provisions of Article 71 of the Law of Constitutional Jurisdiction, a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on those who receive an order that they must comply with or enforce, issued in an amparo appeal, and who fail to comply with it or enforce it, provided that the crime is not more severely punished. The State is ordered to pay the costs, damages, and losses caused by the facts that serve as the basis for this declaration, which shall be settled in the enforcement of the administrative-contentious judgment. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecisiete de noviembre de dos mil veintitres .
Recurso de amparo que se tramita en expediente número 23-022789-0007-CO, interpuesto por Nombre9119 , cédula de identidad CED7306, contra el MINISTERIO DE SALUD Y EL SERVICIO NACIONAL DE SALUD ANIMAL (SENASA).
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
Primeramente, debe aclararse que, a partir de la sentencia nro. 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contenciosa‑administrativa aquellos asuntos, en los que se discute si la Administración Pública ha cumplido o no los plazos fijados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales en los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo ‑instruido de oficio o a instancia de parte‑ o conocer de los recursos administrativos correspondientes. Sin embargo, también ha contemplado casos de excepción a lo anterior, como sucede en la especie, toda vez que el agravio se refiere a presuntas denuncias ambientales que supuestamente no han sido atendidas. En este tipo de materia, la jurisprudencia constitucional ha estimado procedente la aplicación del control de constitucionalidad, de modo que se procede a resolver el sub iudice.
II-. OBJETO DEL RECURSO. La parte recurrente indica que desde el 22 de enero 2021 se interpuso una denuncia ante Senasa por “actividades de chiqueros y chancheros en lugares residenciales” que afecta al Hogar de Ancianos Club Retirement Community, la cual no ha sido resuelta. Expone que la falta de atención de esa denuncia pone en riesgo la salud de los adultos mayores que habitan en el lugar, por la cantidad de moscas, el mal olor y otros. Acusa que en el lugar denunciado funciona un bar clandestino en donde se organizan ventas de chicharrones y fiestas hasta altas horas de la noche. Sostiene que, a pesar de que desde el 19 de febrero de 2022 se denunció lo correspondiente ante el Ministerio de Salud, no se ha tomado medida alguna para resolver la problemática señalada.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
SOBRE SENASA:
Se le informó nuevamente, que al incumplir con los permisos se ordenaba de forma inmediata eliminar los cerdos actuales de la propiedad, que de no ser así procederíamos al decomiso de los mismos. El Sr. Nombre9124 comprende la situación y solicita la posibilidad de darle unos días de tiempo para solucionar (específicamente esta semana) y de lo contrario, si no ha solucionado procedamos con el decomiso. Se le reitera al Sr. Nombre9124, que la orden sanitaria girada es de acatamiento inmediato”. (Ver informe rendido bajo juramento por las autoridades recurridas de Senasa).
SOBRE EL MINISTERIO DE SALUD:
En el sub lite, la parte recurrente indica que desde el 22 de enero 2021 se interpuso una denuncia ante Senasa por “actividades de chiqueros y chancheros en lugares residenciales” que afecta al Hogar de Ancianos Club Retirement Community, la cual no ha sido resuelta. Expone que la falta de atención de esa denuncia pone en riesgo la salud de los adultos mayores que habitan en el lugar, por la cantidad de moscas, el mal olor y otros.
Al respecto, este Tribunal verifica que el 22 de enero de 2021 se formuló una denuncia ante Senasa en relación con un “Chiquero de (porqueriza) ubicado en lugar donde hay viviendas y pronto abra (sic) un lugar de retiro para ancianos. El olor es muy desagradable y constante”. En tal ocasión, el denunciante, Nombre9120 , señaló como medio de notificaciones ...401. Por ello, el 26 de enero de 2021, Senasa inspeccionó el sitio denunciado y emitió la orden sanitaria nro. 0213383 contra Nombre9122 , quien manifestó ser el responsable de la producción porcina. En ese documento se dispuso: “Se ordena de forma inmediata la suspensión del manejo de desechos líquidos y sólidos sin control, de tal forma que impida la generación de mal olor. Se ordena en un plazo de 5 días naturales contar con un establecimiento autorizado para la producción porcina por medio de un CVO, que a su vez cuente con la aprobación del Permiso de ubicación del Sistema de tratamientos de desechos sólidos y líquidos, como también cumplimiento del Reglamento de Granjas Porcinas”.
El 1° de febrero de 2021, Nombre9122 planteó un recurso de apelación contra la orden sanitaria nro. 0213383, la cual fue rechazada por extemporánea según resolución SENASA-DRCH-AJ-003-2021 de las 13:00 horas del 3 de febrero de 2023 dictada por la Región Chorotega de Senasa. Además, el 15 de febrero de 2021, Nombre9122 planteó solicitó una prórroga del plazo previsto en la orden sanitaria nro. 0213383.
De la prueba se desprende que, el 2 de octubre de 2023, Senasa inspeccionó el lugar denunciado y fue atendido por Nombre9124 , quien señaló ser el responsable de la propiedad y negó el ingreso a esta sin una orden judicial. Además, se dictó una orden sanitaria en la que se indicó: “Se ordena de forma inmediata tener el establecimiento para producción porcina con certificado veterinario de operación, en caso de no ser así no puede existir presencia de cerdos”. Finalmente, según el informe rendido bajo juramento por las autoridades recurridas de Senasa, el 3 de octubre de 2023, Nombre9124 se apersonó a la Dirección Regional Chorotega de Senasa para requerir información sobre los permisos de funcionamiento para la explotación porcina. Además, en esa atención “El Sr. Nombre9124 plantea el hecho de que ya en una ocasión anterior iniciaron los trámites para obtener el CVO, pero no los concluyeron y se quedaron en una etapa de permisos para tratamiento de aguas residuales (STAR) con el MINSA (…) Se le expuso al Sr. Nombre9124 que según el reglamento vigente de granjas porcinas 37155-MAG, en el artículo 8, inciso b, dicta: “No menos de 500 metros medidos horizontalmente, del galpón más cercano a los linderos de propiedad respecto a establecimientos de salud, establecimientos educativos y establecimientos para el adulto mayor.” Y, por lo tanto, al no cumplirse con este requisito, no será posible otorgarle el CVO para la explotación porcina.
Se le informó nuevamente, que al incumplir con los permisos se ordenaba de forma inmediata eliminar los cerdos actuales de la propiedad, que de no ser así procederíamos al decomiso de los mismos. El Sr. Nombre9124 comprende la situación y solicita la posibilidad de darle unos días de tiempo para solucionar (específicamente esta semana) y de lo contrario, si no ha solucionado procedamos con el decomiso. Se le reitera al Sr. Nombre9124, que la orden sanitaria girada es de acatamiento inmediato”.
De este modo, en el sub lite queda en evidencia la falta de actuación diligente y célere de Senasa a fin de resolver la denuncia formulada el 22 de enero de 2021 en relación con la tenencia de animales porcinos que generan malos olores. Ello por cuanto, si bien se comprueba que, ante tal denuncia, Senasa inspeccionó el sitio denunciado y dictó una orden sanitaria, no se verifica que haya efectuado el seguimiento adecuado, a los efectos de verificar su debido cumplimiento. En ese sentido, nótese que no fue sino hasta el 2 de octubre de 2023, a saber, con posterioridad a que las autoridades de Senasa fueron notificadas de la resolución de curso de este amparo, cuando se realizó una inspección en el sitio y se dictó una nueva orden sanitaria. Adicionalmente, de los autos no se colige material probatorio alguno que permita acreditar que se haya notificado a la parte denunciante el recurso de la gestión interpuesta en enero de 2021.
Por ende, se estima el amparo en lo que a Senasa concierne.
V.Por otra parte, el recurrente acusa que en el lugar denunciado funciona un bar clandestino en donde se organizan ventas de chicharrones y fiestas hasta altas horas de la noche. Sostiene que, a pesar de que desde el 19 de febrero de 2022 se denunció lo correspondiente ante el Ministerio de Salud, no se ha tomado medida alguna para resolver la problemática señalada.
La Sala verifica que, en diciembre de 2021, el Ministerio de Salud recibió denuncias sobre supuestas actividades de concentración masivas en una propiedad privada ubicada en el Dirección1152 . Por ello, el 3 de diciembre de 2021, personas funcionarias del Ministerio de Salud inspeccionaron la propiedad denunciada y entrevistaron a Nombre9124 en relación con una publicación en redes sociales en la que se convocó a una actividad de concentración masiva para el día siguiente. Ese mismo día, el Ministerio de Salud dictó la orden sanitaria MS-DRRSCH-DARSL-ER-OS-096-2021, en la que se le apercibió a Nombre9124 que “(…) las actividades de concentración de personas están reguladas, por considerarse actividades que pueden propiciar la propagación de Covid-19, por lo que requieren de ser autorizadas por el Ministerio de Salud (…)”. Pese a ello, el 4 de diciembre de 2021, la Fuerza Pública confeccionó el parte policial nro. 0174937-21, en el que se indicó que Nombre9124 incumplió lo dispuesto en la orden sanitaria MS-DRRSCH-DARSL-ER-OS-096-2021. Además, el 31 de diciembre de 2021, la Fuerza Pública confeccionó el parte policial nro. 0000061-22, en el que se señaló que Nombre9124 organizó una actividad bailable que no tenía permisos del Ministerio de Salud ni patente de licores, en la que se mantuvo música a alto volumen.
Mediante la orden sanitaria MS-DRSCH-DARSL-OS-104-2022 se apercibió a Nombre9124 y Nombre9125 “suspender todas las actividades y la que pretende realizar el día 29 de enero de 2022, que no están autorizadas por el Ministerio de Salud”. Por informe sanitario MS-DRRSCH-DARSL-COVID19-111840278-2022 se consignó el incumplimiento de la orden sanitaria MS-DRRSCH-DARSL-ER-OS-096-2021 y se impuso el pago de una multa. Además, mediante informe sanitario MS-DRRSCH-DARSL-COVID19-111840278-A2-2022 se consignó el incumplimiento del informe de la Fuerza Pública nro. 00000061-22 y se impuso el pago de una multa. Tal acto fue impugnado.
El 19 de febrero de 2022, desde la cuenta ...402 se envió un correo electrónico a ...399, en el que se acusó que desde hace dos meses los vecinos efectúan fiestas clandestinas, en la que incluso, el 12 de febrero de 2022, murió una persona quien fue herida de bala. Además, se reclamó que en el lugar denunciado se pone música a alto volumen, además se produce la venta de licor, lo que afecta a los residentes del hogar de ancianos. Lo anterior fue reenviado el 1° de marzo de 2022 a ...400.
El Tribunal acredita que, el 1° de marzo de 2022, la Dirección del Área Rectora de Salud de Liberia asignó el consecutivo D-082-2022 a la denuncia recibida al correo electrónico ...400. Mediante orden sanitaria MS-DRRSCH-DARSL-ERS-OS-006-2022 notificada el 3 de marzo de 2022, el Ministerio de Salud apercibió a Nombre9124 a “No realizar evento con concentración de personas en inmueble sin permiso sanitario de funcionamiento, debido a que la actividad (programada para el sábado 05 de marzo de 2022) no cuenta con la respectiva autorización sanitaria del Ministerio de Salud”. El 4 de marzo de 2022, el Ministerio de Salud formuló una denuncia ante la Fiscalía de Liberia por el presunto evento masivo a efectuarse el 5 de marzo de 2022, por lo que el Ministerio Público peticionó una orden de allanamiento ante el Juzgado Penal de Liberia, la cual fue rechazada por resolución de las 12:10 horas del 5 de marzo de 2022. El 5 de marzo de 2022, la Fuerza Pública emitió el informe a la autoridad judicial nro. 0032742-22 en el que se consignó el incumplimiento de la orden sanitaria MS-DRRSCH-DARSL-ERS-OS-006-2022. Ante esa situación, el Ministerio de Salud emitió el informe sanitario MS-DRRSCH-DARSL-COVID19-111840278-#3-2022 por incumplimiento del informe de la Fuerza Pública nro. 0032742-22, por lo que se impuso el pago de una multa a Nombre9124 .
El 2 de abril de 2022, el Ministerio de Salud efectuó una medición sónica en el lugar denunciado, por lo que emitió un informe técnico de inspección MS-DRRSCH-DARSL-ER-IT-0127-2022 del 12 de abril de 2022, en el que se señaló que se excedió el límite de sonido aceptado para la zona respectiva. Mediante orden sanitaria MS-DRRSCH-DARSL-ERS-OS-050-2022 notificada el 26 de abril de 2022, el Ministerio de Salud apercibió a Nombre9124 a “Suspender de forma inmediata cualquier actividad relacionada a eventos de concentración masiva de personas con presentaciones o reproducción musical (…) debido a emisión de ruido generada por música con volumen que sobrepasa las normas vigentes (…) Presentar ante la Dirección del Área Rectora de Salud de Liberia un plan de confinamiento de ruido con su memoria de cálculo y cronograma de actividades (…) Fecha de vencimiento: Martes 10 de mayo 2022”. Finalmente, el 11 de mayo de 2022, el Ministerio de Salud emitió el informe de incumplimiento de la orden sanitaria MS-DRRSCH-DARSL-ERS-OS-050-2022 en relación con la falta de presentación de un plan de confinamiento de ruido.
Así las cosas, en la especie consta que el Ministerio de Salud ha llevado a cabo múltiples actuaciones en relación con el sitio denunciado que se encuentra al lado del hogar de ancianos supramencionado, las cuales se comenzaron a efectuar desde diciembre de 2021, a saber, de previo a la denuncia formulada por la parte accionante. Pese a ello, en el sub examine no se verifica que el referido ministerio haya empleado todas las herramientas conferidas por el ordenamiento jurídico a fin de constreñir el cumplimiento de la orden sanitaria MS-DRRSCH-DARSL-ERS-OS-050-2022, a pesar de que desde el 11 de mayo de 2022 se corroboró que no se cumplió lo referente al plan de confinamiento del ruido. En igual sentido, la Sala echa de menos que el Ministerio de Salud haya resuelto definitivamente la denuncia planteada por la parte recurrente el 1° de marzo de 2022 vía correo electrónico y a la que se le asignó el consecutivo D-082-2022, ni acredita que se haya notificado lo correspondiente a la parte denunciante.
Ergo, se estima el recurso en cuanto al Ministerio de Salud.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que el recurrente acusa que desde el 22 de enero 2021 se interpuso una denuncia ante el Servicio Nacional de Salud Animal y el Ministerio de Salud por “actividades de chiqueros y chancheros en lugares residenciales” que afecta al Hogar de Ancianos Club Retirement Community, la cual no ha sido resuelta. Expone que la falta de atención de esa denuncia pone en riesgo la salud de los adultos mayores que habitan en el lugar, por la cantidad de moscas, el mal olor y otros.
Acusa que en el lugar denunciado funciona un bar clandestino en donde se organizan ventas de chicharrones y fiestas hasta altas horas de la noche. Sostiene que, a pesar de que desde el 19 de febrero de 2022 se denunció lo correspondiente ante el Ministerio de Salud, no se ha tomado medida alguna para resolver la problemática señalada. Lo anterior, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
Se declara con lugar el recurso. Se les ordena a Nombre9120 y Harold Marín Esquivel, por su orden, director general y director de la Dirección Regional Chorotega, ambos del Servicio Nacional de la Salud Animal, o a quienes en su lugar ocupen esos cargos, que coordinen lo necesario y lleven a cabo todas las actuaciones dentro del ámbito de sus respectivas competencias, a los efectos de que en el plazo de DOS MESES, contado a partir de la notificación de esta sentencia, se resuelva de manera definitiva la denuncia planteada el 22 de enero de 2021, y se notifique lo correspondiente a la parte denunciante al medio señalado para tales efectos. Además, se le ordena Luis Mayorga Díaz, en su condición de director del Área Rectora de Salud de Liberia del Ministerio de Salud, o a quien desempeñe ese cargo, que coordine lo necesario y lleve a cabo todas las actuaciones dentro del ámbito de sus competencias, a fin de que en el plazo de DOS MESES, contado a partir de la notificación de este pronunciamiento, se resuelva de manera definitiva la denuncia planteada el 1° de marzo de 2022 vía correo electrónico a la que se le asignó el consecutivo D-082-2022, y se notifique lo correspondiente a la parte denunciante al medio señalado para tales efectos.
Lo anterior se dicta con el apercibimiento de que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo y que no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
