Decision No.: 2025-01070 CRIMINAL CASSATION CHAMBER. San José, at ten forty-two a.m. on the twenty-fourth day of September, two thousand twenty-five.

Having reviewed the appeal in cassation (recurso de casación) filed in the present case against [Nombre 001], identity document [Nombre 001], born on 02 de enero de 1970, son of [Nombre 002] and [Nombre 003], a resident of Guanacaste, for the offense of violating the Ley de Pesca y Acuicultura, in the form of engaging in commercial or sport fishing in national parks, natural monuments, and biological reserves, to the detriment of Los Recursos Hidrobiológicos. Participating in the decision on this appeal are Justice Patricia Solano Castro and Justices Sandra Eugenia Zúñiga Morales, Patricia Vargas González, Marianela Corrales Pampillo, and Giovanni Mena Artavia, the latter two serving as alternates. Also appearing at this stage is attorney Zaray Chavarría Prado as Criminal Counsel (Procuradora Penal). Attorney Luis Diego Quesada Canales appeared as representative of the Ministerio Público.

Findings of Fact:

1. By judgment N° 2023-0506, issued at thirteen hours and five minutes on the twenty-fifth day of October, two thousand twenty-three, the Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera del Segundo Circuito Judicial de San José, ruled: “THEREFORE: The appeal against the judgment (recurso de apelación de sentencia) filed by the Procuraduría General de la República is denied. The Tribunal de Flagrancia del Primer Circuito Judicial de Liberia shall cancel the notation in the registration record of the vessel Dorka II, registration GPC-8821, Yamaha F75CEDL engine, number 68C1001884, registered in the name of [Nombre 004], and shall take the necessary steps to return it to its owner. NOTICE SHALL BE GIVEN.—Helena Ulloa Ramírez, Jorge A. Camacho Morales, and Wilson Flores Fallas. Judge and Judges of the Tribunal de Apelación de Sentencia Penal Juvenil.” 2. Attorney Zaray Chavarría Prado, acting as Criminal Counsel, filed an appeal in cassation against the foregoing decision.

3. Upon completion of the corresponding deliberation, the Chamber proceeded to hear the appeal.

4. The applicable legal requirements have been observed throughout the proceedings.

Justice Zúñiga Morales reports; and,

Whereas:

I.By decision number 2024-01035, issued at eleven thirty a.m. on the third day of October, two thousand twenty-four, this Criminal Cassation Chamber admitted for consideration on the merits the two grounds of the appeal in cassation filed by attorney Zaray Chavarría Prado, in her capacity as Criminal Counsel, against decision number 2023-0506 of 13:05 hours on 25 de octubre de 2023, issued by the Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera, del Segundo Circuito Judicial de San José, acting as the Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz seat (appearing at folios 199 through 202), which ordered: “The appeal against the judgment filed by the Procuraduría General de la República is denied. The Tribunal de Flagrancia del Primer Circuito Judicial de Liberia shall cancel the notation in the registration record of the vessel Dorka II, registration GPC-8821, Yamaha F75CEDL engine, number 68C1001884, registered in the name of [Nombre 004], and shall take the necessary steps to return it to its owner.” (folio 202, front and back)

II.In the first ground admitted for consideration on the merits, the Criminal State Attorney alleges the failure to apply Article 118 of the Ley de Pesca in relation to Articles 103(c) and 106(5) of the Código Penal, because the forfeiture (comiso) of the vessel was not ordered, on the basis of the owner’s joint and several strict liability (responsabilidad solidaria objetiva). The appellant explains that, in the challenged judgment, the ad quem ordered the cancellation of the notation in the registration record of the vessel Dorka II, registration GPC-8821, Yamaha F75CEDL engine, number 68C1001884, registered in the name of [Nombre 004], as well as the completion of the necessary steps to return it to its owner: “…Thus denying the forfeiture of the vessel used to commit the act that harmed the environment…” (folio 210 verso). The State Attorney transcribes an excerpt from the reasoning given by the appellate sentencing court in rejecting the claim that had been raised, asserting that the ruling failed to apply Article 118 of the Ley de Pesca, which provides, insofar as relevant, that the owner shall be jointly and severally liable when the owner is a legal entity or a different natural person.

She argues that Article 103(c) of the Código Penal establishes forfeiture as a consequence of the criminal act and states: “…Although the seized property belongs to a third party who was not named as a civil defendant, the fact remains that forfeiture does not require that condition for its application and that, pursuant to Article 118 of the Ley de Pesca, as well as Article 106(5) of the Código Penal, the owner of the vessel is jointly and severally liable for violations of that special legislation, which does not refer to the existence of negligence or intent, the degree of participation, or whether the conduct resulted from carelessness or negligence; hence, because the vessel was seized in the case before us and the criminal offense committed through its use was established, as was the civil obligation arising from the environmental damage, the proper course was to order forfeiture as a civil consequence, in view of the joint and several liability that the owner is required by special law to bear…” (folio 211 verso).

In presenting her objection, the appellant transcribes part of the content of this Chamber’s decision N° 2022-00437, at 16:46 hours, on April 22, 2022, which held that joint and several liability for environmental offenses is strict. She also refers to this Chamber’s decision N° 780-2000, at 10:20 hours, on July 7, 2000, which held that ordering the return of seized property to anyone who proves to be its lawful owner entails that the matter ultimately cannot be adjudicated and could potentially allow a mere formal defect to prevent the application of substantive law. Referring to the challenged judgment, the appellant emphasized that, in the view of the appellate sentencing court, because the vessel did not belong to the accused, additional findings were required; the court also concluded that a vessel is not itself an instrument but a means of transportation and that, consequently, its forfeiture could be disproportionate in cases of small-scale illegal fishing, as in this case.

In the appellant’s view: “…it was not required to make additional findings or take additional actions, because the facts giving rise to civil liability were established, including that the vessel Dorka II, registration GPC 8821, was the instrument used for that purpose and, consequently, to cause the environmental damage; hence, the Civil Action for Damages (Acción Civil Resarcitoria) was granted. Moreover, joint and several liability is strict and, pursuant thereto, the vessel’s owner was required to submit whatever evidence he deemed relevant to exempt himself from joint and several liability as an interested third party, due to the seizure affecting his property. The record contains only the document submitted on August 03, 2022, appearing at folio 119, in which he states: ‘I do not know the reasons why this young man, who knows that he cannot enter the park, did so. I know that fishing is very scarce and that he has a family to care for, this being the only work he can perform and something he has done since childhood; he cannot read or write.’ This is deemed insufficient to exempt him from strict liability, since that statement merely attributes to the accused knowledge of the unlawfulness of his conduct…” (folio 213 recto).

In addition, she clarifies that, pursuant to Article 9 of the Ley de Pesca, mere navigation in protected areas is permitted in cases of unforeseen circumstances and force majeure, for as long as such situations persist. Subsequently, attorney Chavarría Prado asserts that the vessel: “…is not merely a means of transportation, as stated by the appellate court…” (folio 213 verso), but one of the instruments used to commit the offense, because it is physically impossible to venture into offshore waters without it and the vessel was indispensable for entering and remaining in territorial waters in order to engage in illegal fishing. She further challenges the fact that the ad quem: “…makes an expansive interpretation of a criminal offense—reckless driving—that is expressly established by law as an exception to the forfeiture of property used in committing the offense and bears no similarity whatsoever to the facts in the case before us, in which the environmental offense is defined and punished under special legislation, namely the Ley de Pesca, which, in addition to ordering the encumbrance of the means—the vessel—used to commit the offense in order to secure payment of the fine, makes its owner jointly and severally liable for the violations committed…” (folio 213 verso).

The appellant further complains that, in the view of the ad quem, forfeiture of a vessel used in small-scale fishing is disproportionate: “…without analyzing the magnitude of the environmental damage that such conduct causes to ecosystems, particularly when it affects a wildlife area where, under the applicable legislation—Ley de Pesca Article 9, Decreto Ejecutivo 1562 of March 20, 1971, and Ley Forestal Article 13, as part of the State’s natural heritage—fishing is prohibited and where the flora and fauna found there receive special protection, since the marine area of Parque Nacional Santa Rosa—the location of the events—contains important areas of biological interest, including areas of high diversity, production and reproduction areas, species breeding and recruitment areas, as well as nutrient upwelling areas unique in the country and various land-sea interface and marine ecosystems; regardless of the scale at which fishing is conducted, it affects the ecological balance…” (folio 213 verso).

Reference is also made to the constitutional right to a healthy and ecologically balanced environment, regarded as a third-generation right because of its importance, on the basis of which the State Attorney asserts that: “…it is entirely permissible for instruments used to commit offenses of this nature, such as vessels, to be forfeited, since the legislature has not established them as an exception…” (folio 214 recto). She also states that although the ad quem noted that the registered owner of the vessel had not formally been made a party to the proceedings: “…[Nombre 004] appeared in the proceedings as an interested third party and provided an address for service, as reflected at folios 119 through 122 and 126 through 132, with full knowledge that his vessel had been seized due to an offense involving a violation of the Ley de Pesca. Indeed, for those purposes, in addition to requesting provisional custody (depósito provisional), he granted a special judicial power of attorney to Lic. José Manuel González Fonseca, attorney and notary, to represent him and request the return, under provisional and/or permanent custody, of the vessel bearing registration GPC 8821.

Accordingly, he had legal representation from the outset and understood that, when property has been seized, its disposition must be determined in the judgment…” (folio 214 recto). As grounds for prejudice, attorney Chavarría Prado considers that the failure to order forfeiture of the vessel impaired the State’s civil interests through the loss of property that should have been forfeited, since forfeiture is a civil consequence of the criminal act; accordingly, she considers that the ad quem: “…renders ineffective the joint and several liability that the vessel’s owner must bear for the commission of an environmental offense through the use of his property, to the detriment of the victim and civil plaintiff.…” (folio 214 recto). Based on the foregoing, she requests that the argument be granted, that challenged judgment N° 2023-0506, at 13:05 hours, on October 25, 2023, be declared ineffective, and that the case be remanded to the trial court to rule on forfeiture of the vessel as a civil consequence arising from the criminal act, by reason of the strict liability that the property’s owner must bear under the proper application of Article 118 of the Ley de Pesca in relation to Article 103(3) of the Código Penal.

The claim is granted: The appellant alleges that decision number 2023-0506 at 13:05 hours on October 25, 2023, issued by the Juvenile Criminal Sentencing Appeals Court, First Section, of the Second Judicial Circuit of San José, sitting as the Criminal Sentencing Appeals Court of Guanacaste, Santa Cruz seat, denied forfeiture of the vessel seized from the convicted person, although in her view forfeiture was warranted under Articles 103(c) and 106(5) of the Código Penal; she also challenges the decision on the ground that it failed to apply Article 118 of the Ley de Pesca y Acuicultura, which establishes that the owner and shipowner are jointly and severally liable. In her view, because “…the criminal offense committed through its use was established, as was the civil obligation arising from the environmental damage, the proper course was to order forfeiture as a civil consequence, in view of the joint and several liability that the owner is required by special law to bear” (folio 211 verso).

Regarding the specific case. For purposes of examining the alleged defect, with respect to the forfeiture of the property, the record shows that, pursuant to Seizure Record (Acta de Decomiso) MSP-DMSP-DVUE-DSNG-EGM-024-2022, the Servicio Nacional de Guardacostas seized—among other property—the vessel Dorka II, registration GCP-8821, as well as the Yamaha engine, model F75CEDL, serial number 6BC1001884 (folios 6 and 7). In oral judgment under the abbreviated procedure (procedimiento abreviado) N° 511-2023 at 15:30 hours, on September 01, 2023, the Criminal Court of the First Judicial Circuit of Guanacaste, Liberia, imposed a fine equivalent to fourteen base salaries, totaling exactly six million four hundred seventy-two thousand two hundred colones; with respect to the civil action for damages, civil defendant [Nombre 001] was ordered to pay two million two hundred seventy-three thousand forty colones and seventy-two céntimos for environmental damage, as well as personal costs in the amount of four hundred fifty-four thousand six hundred eight colones and fourteen céntimos.

With respect to the vessel, the court ordered “…the permanent return of the vessel Dorka II, registration GP-8821, and its corresponding Yamaha engine, model F75CEDL, NUMBER 6BC1001884, to whoever is shown to be its lawful owner.” The a quo made no ruling whatsoever regarding forfeiture of the property. Criminal State Attorney Zaray Chavarría Prado appealed that judgment, essentially challenging the lack of reasoning in the decision concerning forfeiture of the property and the failure to apply Article 103(3) of the Código Penal.

The Tribunal de Apelación de Sentencia Penal Juvenil del Segundo Circuito Judicial de San José, acting as the Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz, by voto 2023-0506 issued at 13:05 hours on 25 de octubre de 2023, dismissed the appeal and, in turn, ordered: “The Tribunal de Flagrancia del Primer Circuito Judicial de Liberia shall cancel the notation in the registration record of the vessel Dorka II, registration number GPC-8821, Yamaha F75CEDL engine, number 68C1001884, registered in the name of [Nombre 004], and shall take the necessary steps to return it to its owner.” (folio 202 vuelto). With regard to the forfeiture (comiso) of property, Article 103, subsection 3), of the Código Penal includes it as one of the civil consequences of the punishable act (hecho punible), while Article 110 of the same body of law, in referring to that legal institution, states: “The offense results in the forfeiture to the State of the instruments used to commit it and of the things or assets derived from its commission, or that constitute a benefit obtained by the perpetrator from the offense itself, without prejudice to any rights held in them by the injured party or third parties.

Vehicles involved in the commission of the acts defined in Article 254 bis of the Código Penal are excluded from this provision.” As for the Ley de Pesca y Acuicultura, it contains no specific regulations concerning the forfeiture of property, except for Article 134, which establishes, as a consequence of the punishable act, the forfeiture to INCOPESCA of the fishing gear used to commit the offense; and Articles 51, 52 and 154, which concern the manner in which forfeited products and property are distributed. As stated, with respect to the challenge filed by the appellant in cassation (casacionista), it is alleged that Article 118 of the Ley de Pesca y Acuicultura provides that both the owner of the vessel and the ship operator (armador)—understood as the person who, on their own account, prepares a vessel for navigation, including its provisioning and the hiring of fishers, pursuant to Article 2, subsection 8, and Article 116 of the same law—shall be jointly and severally liable (solidariamente responsables) for noncompliance with fisheries legislation when actual harm is caused.

The Procuradora Penal takes the position that, under that provision and Articles 103, subsection c), and 106, subsection 5), of the Código Penal, because the offense was established and the claim for environmental damage was granted, “…the proper course was to order forfeiture as a civil consequence, in view of the joint and several liability that the owner is required to bear under the special law” (folio 211 vuelto). In other words, in her view, forfeiture should have been ordered as part of the joint and several liability of the vessel’s owner and/or ship operator, a position with which this Sala does not agree. Nevertheless, although the legislature has classified forfeiture as a civil consequence of the punishable act, there is no consensus regarding its legal nature (naturaleza jurídica). In this regard, the Sala Constitucional has regarded forfeiture as a civil consequence arising from an infringement, stating that “…forfeiture, as defined in Article 110 of the Código Penal, is a civil consequence of the criminal offense intended to prevent the use of property or instruments for criminal purposes, or the use of property or assets derived from the commission of the punishable act, precisely as an additional civil measure that, beyond the criminal penalty, psychosocially discourages the commission of criminal acts or prevents those instruments or items of property from being used again to commit criminal acts…” (Voto N° 2011-07783 de la Sala Constitucional de las 14:31 horas del 15 de junio de 2011, reiterated in voto 08508-2016 de las 11:30 horas del 22 de junio de 2016).

For its part, this Cámara has long held that forfeiture is an ancillary consequence (consecuencia accesoria) of the punishable act and undeniably has a punitive component, because it entails the owner’s loss, in favor of the State, of the instruments used to commit the offense or of the things or assets derived from its commission. In this respect, it has stated: “The State’s interest in expropriating the property or instruments used to commit the offense, or obtained as the proceeds of unlawful activity, is evident: it is an ancillary means of punishing the criminal conduct and preventing the perpetrator from profiting from conduct recognized in the judgment as contrary to the legal system and, therefore, harmful to the legally protected interests...” (emphasis not in the original). (Voto 074-1998 de la Sala Tercera de la Corte Suprema de Justicia de las 09:15 horas del 23 de enero de 1998 con la integración de los Magistrados González A., Ramírez Q., Houed V., Chaves R., Castro M.).

There is agreement that the purpose of forfeiture is to prevent the property or instruments from being used again to carry out criminal activities or for the offender’s benefit. Thus, the forfeiture of such property to the State neither relates to nor seeks reparation or compensation for the harm caused and, consequently, is not linked to the joint and several liability that, in the matter before us, the vessel’s owner or ship operator might bear. The appellant is therefore incorrect in asserting that the challenged decision must be quashed on the ground that, pursuant to Articles 103, subsection c), and 106, subsection 5), of the Código Penal and Article 118 of the Ley de Pesca y Acuicultura, forfeiture of the vessel should have been ordered as a consequence of the joint and several liability of its owner or ship operator. However, the judgment must be quashed for reasons different from those stated by the appellant.

As explained, when the Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, issued judgment N° 511-2023 at 15:30 hours on 01 de setiembre del 2023 through the abbreviated procedure (procedimiento abreviado), it entirely failed to rule on the forfeiture of the seized property (bienes decomisados), which was the subject of the appeal filed by the State’s representative. In deciding that challenge, the appellate court overlooked that lack of reasoning and instead set forth the reasons why it considered forfeiture of the seized vessel improper. At the procedural level, the governing procedural code imposes an obligation on judges to rule on the disposition of seized or impounded property (bienes decomisados o secuestrados); accordingly, a judgment must address the return, restitution, attachment, destruction, or forfeiture of the property (Articles 361, subsection d), 366, 367, 418, 489 and 490 of the Código Procesal Penal).

Any decision concerning the property must be duly reasoned as a safeguard for all parties; when addressing forfeiture, the judge must observe any rights that the injured parties themselves or third parties may hold in that property and, in compliance with due process (debido proceso), must summon and hear interested third parties and conduct an assessment in accordance with the principles of proportionality and reasonableness (see in this regard voto 00375-2015 de la Sala de Casación Penal de las 10:19 horas de 27 de febrero de 2015 con la integración de los y las Magistradas Chinchilla S., Arias M., López M., Cortés C., y Desanti H.). In the case before us, the trial court should have ruled on whether the property was to be forfeited, ensuring that all parties had the right to address the issue, present their conclusions, and, where appropriate, pursue the challenges permitted by law. However, in the case before us, the parties have been unable to address the forfeiture of the property because the issue was not considered before the trial court, even though it should have been decided notwithstanding that the case was resolved through an abbreviated procedure.

Therefore, on different grounds, the first ground for cassation (motivo de casación) submitted by the Procuradora Penal is granted, and judgment número 2023-0506 issued at 13:05 hours on 25 de octubre de 2023 by the Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera, del Segundo Circuito Judicial de San José, acting as the Tribunal de Apelación de Sentencia Penal de Guanacaste, sede Santa Cruz, is vacated. The case is remanded to the Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, so that, with a different composition, it may decide the matters concerning the forfeiture and disposition of the seized property. Magistrada Vargas González files a separate note.

III.In the second ground, the Criminal State Attorney claims failure to apply Article 155 of the Ley de Pesca, because the removal of the notation (anotación) against the vessel and its return to its owner were ordered without proof that the fine imposed in the conviction had been paid. The appellant states that the case file (expediente) contains no record that the fine imposed as a sentence by the Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, in judgment N° 511-2023 at 15:30 hours, on 1 de setiembre del 2023, was paid and that, in this respect, the ad quem should not have ordered either the removal of the notation encumbering the vessel by operation of law or its return to its owner, because the cited provision safeguards the effective payment of the sentence imposed, which has not occurred. As grounds for prejudice, she refers to the impairment of the State’s ability to enforce the sentence in practice: “…because it weakens the effectiveness or coercive force available to secure its payment…” (folio 215, front).

In this regard, the appellant asserts that the ruling: “…hinders enforcement of the judgment in the event of failure to pay the fine imposed, since this was a measure intended to guarantee its payment, thereby weakening the legal system’s ability to enforce the judicial decision and affecting the integrity of the proceedings and, consequently, the fulfillment of the sanction imposed…” (folio 215, reverse). Based on the reasons stated, she requests that the ruling of the appellate court be declared ineffective: “…by correctly applying the substantive legal rule established in Article 155 of the Ley de Pesca, ordering that the notation encumbering the vessel Dorka II, registration GPC-8821, Yamaha F75CEDL engine, number 68C1001884, remain in place and that the vessel not be delivered to its owner, due to the fine imposed in the conviction, in accordance with the correct application of the aforementioned substantive rule…” (folio 215, reverse).

The claim is granted. The appellant challenges the failure to apply Article 155 of the Ley de Pesca (Ley N° 8436 del 01 de marzo de 2005), stating that the Tribunal de Apelación de Sentencia Penal Juvenil del Segundo Circuito Judicial de San José, acting as the Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz, through ruling 2023-0506 at 13:05 hours on 25 de octubre de 2023, rejected the appeal against the judgment (recurso de apelación de sentencia) and, in turn, ordered cancellation of the notation in the vessel’s registration entry. Background of the case. For purposes of examining the alleged defect, the Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, in oral judgment N° 511-2023 at 15:30 hours, on 1 de setiembre del 2023 (the audiovisual recording of which appears in the record, as does the minute appearing at folios 168 and 169 of the case file), ordered “…the permanent return of the vessel Dorka II, registration GP-8821, and its corresponding Yamaha engine, model F75CEDL, NUMBER 6BC1001884, to whoever appears as its lawful owner.” Criminal State Attorney Zaray Chavarría Prado filed an appeal against that judgment, essentially alleging inadequate reasoning (falta de fundamentación) and failure to apply Article 103, subsection 3, of the Criminal Code, with respect to forfeiture (comiso) of the property.

The Tribunal de Apelación de Sentencia Penal Juvenil del Segundo Circuito Judicial de San José, acting as the Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz, through ruling 2023-0506 at 13:05 hours on 25 de octubre de 2023, rejected the appeal and, in turn, ordered: “The Tribunal de Flagrancia del Primer Circuito Judicial de Liberia shall cancel the notation in the registration entry for the vessel Dorka II, registration GPC-8821, Yamaha F75CEDL engine, number 68C1001884, registered in the name of [Nombre 004], and shall undertake the necessary steps to return it to its owner.” (folio 202, reverse). Analysis of the applicable law. Regarding the offenses established in the Ley de Pesca y Acuicultura, Article 133 authorizes the “Servicio Nacional de Guardacostas to conduct operations aimed at arresting persons and seizing (decomisar) property, equipment, fishing gear (artes de pesca), or fishery products used to commit crimes and violations of fisheries legislation or obtained as a result of such acts.

Both vessels and all other property shall be placed immediately at the disposal of the appropriate judicial authority for such action as may be required by law.” Article 155 of the same statute, in turn, provides that: “Ships or vessels used to commit the unlawful acts defined in this Law shall be liable for payment of the fines imposed on their occupants or owners for violating this Law. For such purposes, the judicial office hearing the corresponding case shall order the Registro de Bienes Muebles del Ministerio de Justicia to enter a judicial lien (gravamen judicial) against the vessel involved in the unlawful acts. The judicial office shall also immediately notify the respective port authorities of this circumstance so that they may take the corresponding precautions regarding authorizations to sail and other matters.” As may be gathered from the foregoing provisions, when an unlawful act established in the Ley de Pesca y Acuicultura is committed, the responsible authorities have a duty to detain the persons involved and to seize (decomiso) the property, equipment, fishing gear, and fishery products used in or resulting from the commission of the crimes and violations established in the law; the vessels must be placed at the disposal of the judicial authority, which must instruct the Registro de Bienes Muebles del Ministerio de Justicia to enter the judicial lien in the corresponding registry entry.

The purpose of this statutory lien is to make the vessel or ship answerable for payment of the fines imposed on its occupants or owners, and its notation serves to notify third parties of that status. The Reglamento a la Ley de Pesca y Acuicultura N° 8436 (Decreto Ejecutivo N° 36782 del 24 de mayo de 2011) extends the measure to violations falling within the jurisdiction of administrative bodies, providing in Article 146 that: “In the case of vessels or ships used in the commission of unlawful acts defined in the LPA and subject to administrative jurisdiction, the Órgano Director, through a duly reasoned and substantiated decision, upon deeming it necessary and proportionate to the acts under investigation and for the purpose of guaranteeing the potential payment of a fine that may be imposed, shall request assistance and cooperation from the competent criminal judicial authorities in the jurisdiction where the acts under investigation were committed or carried out, for the application of Article 155 of the LPA, seeking the imposition of the appropriate restrictions or notations of judicial liens against the corresponding vessel and notification to the respective port authorities for action within their authority.” The specific case.

In the present case, it can be seen that, through Seizure Report (Acta de Decomiso) MSP-DMSP-DVUE-DSNG-EGM-024-2022, the Servicio Nacional de Guardacostas seized—among other property—the vessel Dorka II, registration GCP-8821, as well as the Yamaha engine, model F75CEDL, serial number 6BC1001884. In oral judgment N° 511-2023 at 15:30 hours, on 1 de setiembre del 2023, the Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, insofar as relevant, ordered the return of the vessel and its corresponding engine to whoever appeared as its lawful owner, but made no ruling concerning the notation of the judicial lien. It was in connection with the appeal against the judgment filed by the Criminal State Attorney that the Tribunal de Apelación de Sentencia Penal Juvenil del Segundo Circuito Judicial de San José, acting as the Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz, through ruling 2023-0506 at 13:05 hours on 25 de octubre de 2023, rejected the appeal and additionally ruled: “The Tribunal de Flagrancia del Primer Circuito Judicial de Liberia shall cancel the notation in the registration entry for the vessel Dorka II, registration GPC-8821, Yamaha F75CEDL engine, number 68C1001884, registered in the name of [Nombre 004], and shall undertake the necessary steps to return it to its owner.” (emphasis not in the original, folio 202, reverse).

The reasoning provided by the higher court offers no explanation for its order to remove the notation of the judicial lien encumbering the vessel. The only mention of cancellation of that lien appears where it states that the lower-court decision “…also failed to order cancellation of the notation concerning these proceedings, a defect that harms not the State, but the owner.” (folio 202). The absence of reasoning on this issue makes it impossible to understand why the Tribunal de Apelación de Sentencia Penal regarded the failure to order cancellation of the specified entry as a defect in the lower-court judgment. Moreover, the order canceling the notation of the judicial lien is contrary to Article 155 of the Ley de Pesca y Acuicultura, which establishes that the purpose of that measure is to make ships or vessels answerable for fines imposed on their occupants or owners for violations of that law.

It has been established in the proceedings that the defendant was sentenced to a fine equivalent to fourteen base salaries, for a total amount of six million four hundred seventy thousand eight hundred colones. Accordingly, under the cited Article 155, the legal requirements for maintaining the judicial lien would be satisfied so that, if the convicted person fails to pay that fine, the vessel may answer for its payment. Likewise, given that the movable property should remain encumbered to answer for potential payment of the fines imposed, if the vessel’s return were ordered, it would be returned under the status of provisional judicial custodian (depositario judicial provisional), as provided in Article 200 of the Code of Criminal Procedure, and not permanently, as ordered in the challenged decision. It is clear that, in cases such as this one, if the vessel is not forfeited, the judicial lien must remain in place at the Registro de Bienes Inmuebles so that the vessel may answer for the fines imposed.

Therefore, the second ground of cassation (casación) submitted by the Criminal State Attorney must be granted, and judgment number 2023-0506 at 13:05 hours on 25 de octubre de 2023, issued by the Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera, del Segundo Circuito Judicial de San José, acting as the Tribunal de Apelación de Sentencia Penal de Guanacaste, sede Santa Cruz, is vacated, as is oral judgment N° 511-2023 at 15:30 hours, on 1 de setiembre del 2023, of the Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, insofar as it ordered the permanent return of the vessel Dorka II, registration GCP-8821, and the Yamaha engine, model F75CEDL, serial number 6BC1001884, to whoever appears as their lawful owner. The remainder of the ruling remains undisturbed, and the notation of the judicial lien must instead be ordered unless forfeiture of the property is ordered.

The Criminal Court of the First Judicial Circuit of Guanacaste, Liberia, must take note that, upon examination of the case file concerning the entry (anotación) of the seized assets (bienes decomisados), there is no indication that notice was sent to record the judicial lien (gravamen judicial) in the corresponding registry entry; furthermore, a search of the Movable Property Registry of the Ministerio de Justicia, as may also be verified in the certification appearing at folio 130 of the case file, shows no record of that lien. The court must therefore comply with Article 155 of the Ley de Pesca y Acuicultura, unless the forfeiture (comiso) or non-forfeiture of those assets is ordered. Justice Vargas González adds a note.

Therefore:

The first and second grounds of the appeal in cassation filed by attorney Zaray Chavarría Prado, in her capacity as Criminal Prosecutor for the State (Procuradora Penal), are upheld, and consequently: i. judgment number 2023-0506, issued at 13:05 hours on October 25, 2023, by the Juvenile Criminal Judgment Appeals Court, First Section, of the Second Judicial Circuit of San José, sitting as the Criminal Judgment Appeals Court of Guanacaste, Santa Cruz seat, is vacated. ii. oral judgment N° 511-2023, issued at 15:30 hours on September 1, 2023, by the Criminal Court of the First Judicial Circuit of Guanacaste, Liberia, is vacated insofar as it ordered the permanent return of the vessel Dorka II, registration GCP-8821, as well as the Yamaha engine, model F75CEDL, serial number 6BC1001884, to whoever appears as its lawful owner; the remainder of the ruling remains undisturbed. iii. A retrial on remand (juicio de reenvío) is ordered before the Criminal Court of the First Judicial Circuit of Guanacaste, Liberia, so that, with a differently constituted panel, it may rule on the forfeiture (comiso) and disposition of the seized property (bienes decomisados). iv. The Criminal Court of the First Judicial Circuit of Guanacaste, Liberia, shall make the legally required entries concerning the seized vessel. Justice Vargas González files a separate note. Alternate Justice NOTE BY JUSTICE VARGAS GONZÁLEZ Although I concur with the decision adopted insofar as it orders a remand for a new statement of reasons (fundamentación) on certain important issues, I deem it appropriate to make some additional observations so that the trial court, if it sees fit, may consider them when ruling on the remand ordered: i) pursuant to Article 110 of the Criminal Code (Código Penal), the seizure (incautación) of the instrumentalities, proceeds, and gains of the offense is proper, except for “the rights held in them by the victim or third parties.” Accordingly, it is essential to examine whether, in light of the circumstances of the specific case, the owner of the vessel does or does not have that status; ii) the third party must be guaranteed the right to be heard (derecho de audiencia), since otherwise the principle of effective judicial protection (tutela judicial efectiva), the right of defense, and the right to property itself—all of constitutional rank—could be violated; iii) a fine is a penalty and, as such, is strictly personal (personalísimo).

To conclude that the assets of a good-faith third party—meaning someone with no connection to the events—may be used to pay the penalty imposed on another person could be constitutionally questionable because it would violate, among other rights, the right to property. I therefore consider that Article 155 of the Ley de Pesca y Acuicultura must be interpreted with the foregoing in mind and with the reminder—once again—that a fine is a criminal penalty, not a civil consequence, and that in this case the owner of the vessel was neither criminally prosecuted nor subjected to any penalty. The foregoing observations are respectfully made so that they may be considered by the court adjudicating the merits if it deems it appropriate.

Res: 2025-01070 SALA DE CASACIÓN PENAL. San José, a las diez horas cuarenta y dos minutos del veinticuatro de setiembre de dos mil veinticinco.

Visto el recurso de casación interpuesto en la presente causa seguida contra [Nombre 001], documento de identidad [Nombre 001], nacido el 02 de enero de 1970, hijo de [Nombre 002] y [Nombre 003], vecino de Guanacaste, por el delito de infracción a la ley de pesca y acuicultura en su modalidad de ejercicio de actividad de pesca comercial o deportiva en parque nacionales, monumentos naturales y reservas biológicas, en perjuicio de Los Recursos Hidrobiológicos. Intervienen en la decisión de este recurso el magistrado y las magistradas Patricia Solano Castro, Sandra Eugenia Zúñiga Morales, Patricia Vargas González, Marianela Corrales Pampillo y Giovanni Mena Artavia, estos dos últimos en calidad de suplentes. Además, en esta instancia, la licenciada Zaray Chavarría Prado como Procuradora Penal. Se apersonó el licenciado Luis Diego Quesada Canales como representante del Ministerio Público.

Resultando:

1. Mediante sentencia N° 2023-0506 de las trece horas cinco minutos del veinticinco de octubre de dos mil veintitrés, el Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera del Segundo Circuito Judicial de San José, resolvió: "POR TANTO: Se declara sin lugar el recurso de apelación de sentencia interpuesto por la Procuraduría General de la República. Proceda el Tribunal de Flagrancia del Primer Circuito Judicial de Liberia a cancelar la anotación en el asiento de inscripción de la embarcación Dorka II, matrícula GPC-8821, motor marca Yamaha F75CEDL, número 68C1001884, inscrita a nombre de [Nombre 004] y a realizar las diligencias necesarias para la devolución a su propietario. NOTIFÍQUESE.- Helena Ulloa Ramírez, Jorge A. Camacho Morales y Wilson Flores Fallas. Jueza y Jueces de Apelación de Sentencia Penal Juvenil".

2. Contra el anterior pronunciamiento la licenciada Zaray Chavarría Prado como Procuradora Penal, interpuso recurso de casación.

3. Verificada la deliberación respectiva, la Sala entró a conocer del recurso.

4. En los procedimientos se han observado las prescripciones legales pertinentes.

Informa la magistrada Zúñiga Morales; y,

Considerando:

I.Mediante resolución número 2024-01035, de las once horas treinta minutos del tres de octubre de dos mil veinticuatro, esta Sala de Casación Penal admitió para estudio de fondo, los dos motivos del recurso de casación formulado por la licenciada Zaray Chavarría Prado, en su condición de Procuradora Penal, contra la resolución número 2023-0506 de las 13:05 horas del 25 de octubre de 2023, dictada por Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera, del Segundo Circuito Judicial de San José, en función de Tribunal de Apelación de Sentencia Penal de Guanacaste, sede Santa Cruz (visible a folios 199 a 202), en la que se dispuso: “Se declara sin lugar el recurso de apelación de sentencia interpuesto por la Procuraduría General de la República. Proceda el Tribunal de Flagrancia del Primer Circuito Judicial de Liberia a cancelar la anotación en el asiento de inscripción de la embarcación Dorka II, matrícula GPC-8821, motor marca Yamaha F75CEDL, número 68C1001884, inscrita a nombre de [Nombre 004] y a realizar las diligencias necesarias para la devolución a su propietario.” (folio 202 frente y vuelto)

II.En el primer motivo admitido para estudio de fondo, la Procuradora Penal reclama la inobservancia del artículo 118 de la Ley de Pesca en relación con los artículos 103 inciso c) y 106 inciso 5) del Código Penal, por no haberse ordenado el comiso de la embarcación, en razón de la responsabilidad solidaria objetiva del propietario del bien. Explica la recurrente que, en el fallo impugnado, el ad quem ordenó la cancelación de la anotación en el asiento de inscripción de la embarcación Dorka II, matrícula GPC-8821, motor marca Yamaha F75CEDL, número 68C1001884, inscrita a nombre de [Nombre 004], así como realizar las diligencias necesarias para la devolución a su propietario: “…Rechazando así el comiso de la embarcación que se utilizó para la comisión del hecho en perjuicio del medio ambiente…” (folio 210 vuelto). La Procuradora transcribe un extracto de la fundamentación expuesta por el tribunal de apelación de sentencia al descartar el reclamo que fue planteado, considerando que, con lo resuelto, se inobservó el artículo 118 de la Ley de Pesca, que dispone, en lo que interesa, que el propietario será solidariamente responsable cuando corresponda a personas jurídicas o a personas físicas diferentes.

Arguye, que el artículo 103 inciso c) del Código Penal establece el comiso como una consecuencia del hecho punible e indica: “…Aunque el bien decomisado pertenezca a un tercero que no fue demandado civilmente, lo cierto es que la figura del comiso no exige esa condición para su aplicación, y que de conformidad con el artículo 118 de la Ley de Pesca, así como, con el numeral 106 inciso 5) del Código Penal, el propietario de la embarcación es solidariamente responsable por las infracciones a dicha normativa especial, la cual no alude a la existencia de culpa o dolo o del grado de participación tampoco si es por descuido o negligencia, de ahí que al ser decomisada la embarcación en la causa que nos ocupa y tenerse por acreditado el ilícito penal con la utilización de esta, así como, la obligación civil por el daño ambiental, lo procedente era ordenar el comiso como consecuencia civil en atención a la solidaridad que por ley especial le corresponde al dueño de esta soportar…” (folio 211 vuelto).

Al argumentar la protesta, la recurrente transcribe el contenido parcial del voto de esta Cámara N° 2022-00437, de las 16:46 horas, del 22 de abril del 2022, en el que se determinó que la responsabilidad solidaria por delitos ambientales es objetiva. También, alude a la resolución de esta Sala N° 780-2000, de las 10:20 horas, del 7 de julio del 2000, en la que se dispuso que ordenar la devolución de los bienes secuestrados a quien demuestre ser su legítimo propietario, conlleva que el asunto no pueda ser, en definitiva, discutido y podría propiciar eventualmente que un mero defecto de forma impida la aplicación de la ley sustantiva. Al hacer referencia al fallo impugnado, la recurrente hizo énfasis en que para el tribunal de apelación de sentencia, al no pertenecer la embarcación al acusado, se exigían comprobaciones adicionales y concluyó también, que una embarcación no es en sí un instrumento sino un medio de transporte y que en ese tanto, podría resultar desproporcionado su comiso en casos de pesca ilegal a baja escala, como en este caso.

En criterio de la impugnante: “…no le correspondía realizar comprobaciones ni actos adicionales, porque los hechos que originan la responsabilidad civil fueron acreditados y entre estos que la embarcación Dorka II matrícula GPC 8821 fue el instrumento con se usó para ese cometido, por ende, el daño ambiental, de ahí que se declarara con lugar la Acción Civil Resarcitoria, además la responsabilidad solidaria es objetiva y de conformidad con esta debía el dueño de la embarcación aportar la prueba que considerara pertinente para eximirlo de responsabilidad solidaria como tercero interesado, en razón del decomiso que soporta su bien, constando únicamente en el expediente el escrito entregado el 03 de agosto del 2022 visible a folio 119 donde indica "desconozco las razones del porqué este muchacho que sabe que no puede ingresar al parque lo hizo, sé que la pesca está muy escasa y que él tiene una familia que cuidar siendo la única labor que él puede realizar y que lo hace desde niño él no sabe leer ni escribir." Con el cual, se estima no es suficiente para la exoneración de responsabilidad objetiva, con cuya afirmación solamente atribuye el conocimiento del imputado sobre la ilicitud de su actuación…” (folio 213 frente).

Aunado a lo anterior, aclara que, conforme al artículo 9 de la Ley de Pesca, se consiente la navegación simple en las áreas protegidas, en supuestos de caso fortuito y fuerza mayor, mientras duren tales situaciones. Posteriormente, la licenciada Chavarría Prado asegura que la embarcación: “…no solo es un medio de transporte como lo señala el tribunal de apelación…” (folio 213 vuelto), sino, uno de los instrumentos para la comisión del ilícito, por ser materialmente imposible incursionar aguas adentro sin esta y resultar esa embarcación, indispensable para entrar y permanecer en las aguas territoriales para poder llevar a cabo la pesca ilegal. Cuestiona además, que el ad quem: “…hace una interpretación extensiva de un tipo penal -conducción temeraria- que expresamente por ley está como excepción para el comiso del bien que se utiliza en la realización del ilícito y que no tiene similitud alguna con los hechos de la sumaria que nos ocupa, cuyo delito ambiental se encuentra previsto y sancionado en una ley especial como lo es la Ley de Pesca, la cual además de ordenar gravar el medio -embarcación- que se usa para la comisión de delito a fin de resguardar el pago de la multa, hace responsable solidariamente al dueño de esta por las infracciones cometidas…” (folio 213 vuelto).

Reclama además, la recurrente, que en criterio del ad quem, el comiso de la embarcación en pesca a pequeña escala es desproporcional: “…sin analizar la magnitud del daño ambiental que esas conductas le ocasionan a los ecosistemas, más cuando se trata de la afectación a un área silvestre que por normativa -Ley de Pesca artículo 9, Decreto Ejecutivo 1562 del 20 de marzo de 1971 y Ley Forestal artículo 13 como patrimonio natural de Estado-, es un lugar prohibido para la pesca y tiene una protección especial para la flora y fauna que ahí existen ya que en el área marina del Parque Nacional Santa Rosa -lugar de los hechos hay importantes zonas de interés biológico, como áreas de alta diversidad, zonas de producción y reproducción, zonas de crianza y reclutamiento de especies, así como áreas de afloramiento de nutrientes únicos en el país y variados ecosistemas de interfase tierra mar y marinos, y por más a escala que sea la pesca afecta el equilibrio ecológico…” (folio 213 vuelto).

Se hace referencia, además, al derecho constitucional a un ambiente sano y ecológicamente equilibrado, considerado de tercera generación, en virtud de su importancia, a partir de lo cual, la procuradora afirma que: “…los instrumentos que se utilicen para este tipo de delincuencias, como las embarcaciones, es totalmente viable que sean comisados, ya que el legislador no los ha establecido como excepción…” (folio 214 frente). También indica que, si bien, el ad quem señaló que el propietario registral de la embarcación no se tuvo como parte formalmente dentro del proceso: “…[Nombre 004] se apersonó al proceso como tercero interesado y señaló medio para notificaciones, tal y como consta en los folios 119 al 122 y 126 al 132, teniendo pleno conocimiento que la embarcación de su propiedad se encontraba decomisada debido a un delito por infracción a la Ley de Pesca, incluso para tales efectos, aunado a que solicitó el depósito provisional, otorgó poder especial judicial a favor del Lic. José Manuel González Fonseca, abogado y notario, para que lo representara y solicitara la devolución en depósito provisional y/o definitivo de la embarcación placa GPC 8821, en razón de ello, desde el principio contó con representación legal, teniendo claro que cuando un bien se encuentra en decomiso se debe resolver la situación de este en sentencia…” (folio 214 frente).

Como agravio, la licenciada Chavarría Prado estima que, al no haberse ordenado el comiso de la embarcación, se generó un detrimento de los intereses civiles estatales, por la pérdida de un bien que debía ser entregado en comiso, por ser esa una consecuencia civil del hecho punible, con lo cual, estima que el ad quem: “…deja nugatoria una responsabilidad solidaria que debe soportar el dueño de la embarcación por la comisión de un ilícito ambiental mediante la utilización del bien de su propiedad en menoscabo de la víctima y actor civil.…” (folio 214 frente). Se solicita, a partir de lo expuesto, se acoja el alegato, se decrete la ineficacia de la sentencia impugnada N° 2023-0506, de las 13:05 horas, del 25 de octubre de 2023, y se ordene el reenvío ante el tribunal de juicio para conocer sobre el comiso de la embarcación como consecuencia civil derivada del hecho punible, en razón de la responsabilidad objetiva que debe soportar el dueño del bien, conforme a la correcta aplicación del artículo 118 de la Ley de Pesca en relación con el numeral 103 inciso 3) del Código Penal.

El reclamo se declara con lugar: Reclama la impugnante que la resolución número 2023-0506 de las 13:05 horas del 25 de octubre de 2023, dictada por Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera, del Segundo Circuito Judicial de San José, en función de Tribunal de Apelación de Sentencia Penal de Guanacaste, sede Santa Cruz, deniega el comiso de la embarcación decomisada al sentenciado, la cual en su criterio resultaba procedente conforme lo disponen los artículos 103 inciso c) y 106 inciso 5) del Código Penal, pero a su vez cuestiona que con dicha decisión se inobserva el artículo 118 de la Ley de Pesca y Acuicultura que establece que el propietario y armador son solidariamente responsables. En su criterio, al “…tenerse por acreditado el ilícito penal con la utilización de esta, así como, la obligación civil por el daño ambiental, lo procedente era ordenar el comiso como consecuencia civil en atención a la solidaridad que por ley especial le corresponde al dueño de esta soportar” (folio 211 vuelto).

Sobre el caso en concreto. Para el examen del vicio alegado, en lo que respecta al tema del comiso del bien, se tiene que mediante Acta de Decomiso MSP-DMSP-DVUE-DSNG-EGM-024-2022 el Servicio Nacional de Guardacostas procedió al decomiso -entre otros bienes- de la embarcación Dorka II Matrícula GCP-8821, así como el motor Yamaha modelo F75CEDL, serie 6BC1001884 (folio 6 y 7). El Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, en la sentencia oral de procedimiento abreviado N° 511-2023 de las 15:30 horas, del 01 de setiembre del 2023 impuso la pena de multa de catorce salarios base para un monto total de seis millones cuatrocientos setenta y dos mil doscientos colones exactos, y en lo concerniente a la acción civil resarcitoria se condenó al demandado civil [Nombre 001] al pago de dos millones doscientos setenta y tres mil cuarenta colones con setenta y dos céntimos, por concepto de daño ambiental, así como a las costas personales por la suma de cuatrocientos cincuenta y cuatro mil seiscientos ocho colones con catorce céntimos.

Respecto a la embarcación, se ordenó “…la devolución definitiva de la embarcación Dorka II Matrícula GP-8821 y su respectivo motor Yamaha modelo F75CEDL NÚMERO 6BC1001884 a quien figure como su legítimo propietario”. Y respecto al comiso del bien no hubo pronunciamiento alguno por parte del a quo. Contra dicho fallo, la Procuradora Penal Zaray Chavarría Prado interpone recurso de apelación de sentencia reprochando esencialmente la falta de fundamentación del fallo en cuanto al comiso del bien e inobservancia del artículo 103 inciso 3 del Código Penal. El Tribunal de Apelación de Sentencia Penal Juvenil del Segundo Circuito Judicial de San José, en función de Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz, mediante voto 2023-0506 de las 13:05 horas del 25 de octubre de 2023, procede a rechazar el recurso de apelación, y a su vez dispone “Proceda el Tribunal de Flagrancia del Primer Circuito Judicial de Liberia a cancelar la anotación en el asiento de inscripción de la embarcación Dorka II, matrícula GPC-8821, motor marca Yamaha F75CEDL, número 68C1001884, inscrita a nombre de [Nombre 004] y a realizar las diligencias necesarias para la devolución a su propietario.” (folio 202 vuelto).

Tratándose del comiso de bienes, el Código Penal en el artículo 103 inciso 3) lo incluye como una de las consecuencias civiles del hecho punible, y por su parte el artículo 110 del mismo cuerpo legal al referirse a dicho instituto señala que: “El delito produce la pérdida en favor del Estado de los instrumentos con que se cometió y de las cosas o los valores provenientes de su realización, o que constituyan para el agente un provecho derivado del mismo delito, salvo el derecho que sobre ellos tengan el ofendido o terceros. Se excluyen de esta previsión los vehículos involucrados en la comisión de los hechos tipificados en el artículo 254 bis del Código Penal.” En cuanto a la Ley de Pesca y Acuicultura, no contiene una normativa específica sobre el tema del comiso de bienes, salvo el artículo 134 que establece como consecuencia del hecho punible, la pérdida de las artes de pesca utilizadas en la comisión del delito en favor de INCOPESCA; y los numerales 51, 52 y 154 que se refieren a la forma en que se distribuyen los productos y bienes comisados.

Como se ha indicado, en cuanto a la impugnación planteada por la casacionista, lo que se alega es que la Ley de Pesca y Acuicultura dispone en el artículo 118 que tanto el propietario de la embarcación como el armador (entendido este como la persona que realiza por cuenta propia el aprestamiento de un barco para su navegación en su avituallamiento y contratación de pescadores, según el artículo 2, inciso 8 y 116 de la misma ley) serán solidariamente responsables por el incumplimiento de la legislación pesquera, cuando se cause un daño efectivo. Es criterio de la Procuradora Penal que, conforme a dicha norma, y los artículos 103 inciso c) y 106 inciso 5) del Código Penal, al haberse acreditado el ilícito y acogido el reclamo por el daño ambiental, “…lo procedente era ordenar el comiso como consecuencia civil en atención a la solidaridad que por ley especial le corresponde al dueño de esta soportar” (folio 211 vuelto).

Es decir, en su criterio debió ordenarse el comiso como parte de la responsabilidad solidaria del propietario y/o armador de la embarcación, aspecto que no comparte esta Sala. No obstante, la ubicación que le ha dado el legislador al comiso como una consecuencia civil del hecho punible no existe consenso sobre su naturaleza jurídica. En ese sentido, la Sala Constitucional ha considerado el comiso como una consecuencia civil derivada de una infracción, afirmando que “… la figura del comiso, tal como se define en el artículo 110 del Código Penal, es una consecuencia civil del ilícito penal dirigida a prevenir la utilización de bienes o instrumentos para fines delictivos, o a la utilización de los bienes o valores provenientes de la comisión del hecho punible, precisamente como una medida adicional de carácter civil que más allá de la sanción de carácter penal, desestimule psico-socialmente la realización de hechos delictivos, o imposibilite que esos instrumentos o bienes puedan ser nuevamente utilizados para la comisión de hechos delictivos…” (Voto N° 2011-07783 de la Sala Constitucional de las 14:31 horas del 15 de junio de 2011, reiterado en el voto 08508-2016 de las 11:30 horas del 22 de junio de 2016).

Por su parte, esta Cámara, de vieja data ha afirmado que el comiso es una consecuencia accesoria del hecho punible, que tiene consigo un innegable contenido sancionador, por cuanto conlleva la pérdida por parte del propietario de los instrumentos utilizados para la comisión del delito, o de las cosas o valores provenientes de su realización, en favor del Estado. Al efecto se ha indicado que: “El interés del Estado para expropiar los bienes o instrumentos utilizados para la comisión del delito, o bien obtenidos como producto de la actividad ilícita es evidente: es una forma accesoria de sancionar la conducta delictiva e impedir que el autor saque provecho de su actividad reconocida en sentencia como contraria al ordenamiento jurídico y, por lo tanto, lesiva de los bienes jurídicos protegidos por la norma penal..." (lo resaltado no es del original). (Voto 074-1998 de la Sala Tercera de la Corte Suprema de Justicia de las 09:15 horas del 23 de enero de 1998 con la integración de los Magistrados González A., Ramírez Q., Houed V., Chaves R., Castro M.).

Existe coincidencia en que el comiso tiene como objeto impedir o prevenir que los bienes o instrumentos sean nuevamente utilizados para la comisión de actividades delictivas o provecho de la persona infractora. De esta forma, la pérdida de dichos bienes en favor del Estado no tiene relación ni procura la reparación o indemnización del daño causado, y por ende no está vinculada a la responsabilidad solidaria que en la materia que nos ocupa tendría el propietario o armador de la embarcación. De manera que no lleva razón el recurrente al considerar que el fallo recurrido debe casarse por considerar que en atención a los numerales 103 inciso c) y 106 inciso 5) del Código Penal y 118 de Ley de Pesca y Acuicultura debió disponerse el comiso de la embarcación como una consecuencia de la responsabilidad solidaria del propietario o armador de la embarcación. Sin embargo, debe casarse la sentencia por razones diferentes a las expresadas por la recurrente.

Tal y como se ha expresado, el Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, al emitir la sentencia N° 511-2023 de las 15:30 horas del 01 de setiembre del 2023 por el procedimiento abreviado, omite por completo pronunciarse sobre el comiso de los bienes decomisados, aspecto que fue el objeto del recurso de apelación de sentencia de la representación del Estado. Al resolver dicha impugnación, el tribunal de alzada pasa por alto esa ausencia de fundamentación y en su lugar emite los razonamientos por los cuales considera que el comiso de la embarcación decomisada resulta improcedente. A nivel procesal, el código de rito establece la obligación de las personas juzgadoras de pronunciarse sobre el destino los bienes decomisados o secuestrados, de ahí que es un requisito de la sentencia indicar lo concerniente a la devolución, restitución, embargo, destrucción o comiso de los bienes (artículos 361 inciso d), 366, 367, 418, 489 y 490 del Código Procesal Penal).

Lo que se disponga sobre los bienes, debe estar debidamente fundamentado, como una garantía a todas las partes y tratándose del comiso de los bienes debe la persona juzgadora observar los derechos que sobre dichos bienes tengan los propios ofendidos o terceras personas, y cumpliendo con el debido proceso se debe citar y oír a los terceros interesados, así como efectuar una valoración conforme a los principios de proporcionalidad y razonabilidad (ver al respecto el voto 00375-2015 de la Sala de Casación Penal de las 10:19 horas de 27 de febrero de 2015 con la integración de los y las Magistradas Chinchilla S., Arias M., López M., Cortés C., y Desanti H.). En el caso que nos ocupa, debió el tribunal sentenciador pronunciarse sobre el comiso o no de los bienes, asegurando a todas las partes el derecho de referirse al tema y emitir sus conclusiones, y eventualmente ejercer las impugnaciones que permite la ley.

Sin embargo, en el caso que nos ocupa, las partes no han podido referirse al comiso de los bienes, toda vez que no fue un tema valorado ante el tribunal de juicio, lo que debió ser resuelto aun siendo resultado de un procedimiento abreviado. Es por ello por lo que, por razones distintas, se declara con lugar el primer motivo de casación presentado por la Procuradora Penal y se anula la sentencia número 2023-0506 de las 13:05 horas del 25 de octubre de 2023, dictada por Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera, del Segundo Circuito Judicial de San José, en función de Tribunal de Apelación de Sentencia Penal de Guanacaste, sede Santa Cruz y se dispone el reenvío de la causa al Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, para que con distinta integración, se resuelva lo concerniente al comiso y disposición de los bienes decomisados. La magistrada Vargas González pone nota.

III.En el segundo motivo la Procuradora Penal reclama la inobservancia del artículo 155 de la Ley de Pesca, por haberse ordenado el levantamiento de la anotación de la embarcación y la devolución a su propietario, sin que conste el pago de la multa impuesta en la sentencia condenatoria. Señala la impugnante, que en el expediente no consta que la multa que fue impuesta como condena por el Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, en la sentencia N° 511-2023 de las 15:30 horas, del 1 de setiembre del 2023 haya sido cancelada, y que, en este tanto, el ad quem no debía ordenar el levantamiento de la anotación que, por ley, soporta la embarcación, ni darse la devolución a su propietario, por resguardar la norma señalada, el efectivo pago de la condena establecida, lo que no ha sucedido. Como agravio, se alude a la lesión a la capacidad del Estado de hacer cumplir materialmente la pena: “…ya que debilita la efectividad o coercitividad para su cancelación…” (folio 215 frente).

En ese sentido, la impugnante afirma que lo resuelto: “…dificulta la ejecución de la sentencia ante el eventual incumplimiento de la cancelación de la multa impuesta como una medida para garantizar el pago de esta, debilitando la capacidad del sistema legal para hacer cumplir la decisión judicial y afectando la integridad del proceso, por ende, ver cumplida la sanción establecida…” (folio 215 vuelto). Solicita, con sustento en las razones expuestas, que se decrete la ineficacia de lo que fue resuelto por el tribunal de apelación de sentencia: “…aplicando correctamente la norma jurídica sustantiva establecida en el artículo 155 de la Ley de Pesca, ordenando mantener la anotación que soporta la embarcación Dorka II, matrícula GPC-8821, motor marca Yamaha F75CEDL, número 68C1001884 y sin realizar la entrega a su propietario, en razón de la multa impuesta en sentencia condenatoria, ello de conformidad con la aplicación correcta de la norma sustantiva antes citada…” (folio 215 vuelto).

El reclamo se declara con lugar. Reprocha la impugnante la inobservancia del artículo 155 de la Ley de Pesca (Ley N° 8436 del 01 de marzo de 2005), al señalar que el Tribunal de Apelación de Sentencia Penal Juvenil del Segundo Circuito Judicial de San José, en función de Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz, mediante voto 2023-0506 de las 13:05 horas del 25 de octubre de 2023 procede a rechazar el recurso de apelación de sentencia, y a su vez dispuso cancelar la anotación en el asiento de inscripción de la embarcación. Antecedentes del caso. Para el examen de vicio alegado, se tiene que el Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, en la sentencia oral N° 511-2023 de las 15:30 horas, del 1 de setiembre del 2023 (cuyo registro audiovisual consta en autos, así como la minuta visible a folios 168 y 169 del expediente) ordenó “…la devolución definitiva de la embarcación Dorka II Matrícula GP-8821 y su respectivo motor Yamaha modelo F75CEDL NÚMERO 6BC1001884 a quien figure como su legítimo propietario”.

Contra dicho fallo, la Procuradora Penal Zaray Chavarría Prado interpone recurso de apelación de sentencia reprochando esencialmente la falta de fundamentación del fallo e inobservancia del artículo 103 inciso 3 del Código Penal, en cuanto al comiso del bien. El Tribunal de Apelación de Sentencia Penal Juvenil del Segundo Circuito Judicial de San José, en función de Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz, mediante voto 2023-0506 de las 13:05 horas del 25 de octubre de 2023, procede a rechazar el recurso de apelación, y a su vez dispone “Proceda el Tribunal de Flagrancia del Primer Circuito Judicial de Liberia a cancelar la anotación en el asiento de inscripción de la embarcación Dorka II, matrícula GPC-8821, motor marca Yamaha F75CEDL, número 68C1001884, inscrita a nombre de [Nombre 004] y a realizar las diligencias necesarias para la devolución a su propietario.” (folio 202 vuelto).

Análisis normativo. En cuanto a los delitos previstos en la Ley de Pesca y Acuicultura, el artículo 133 faculta al “Servicio Nacional de Guardacostas realizar los operativos tendientes a arrestar y decomisar bienes, equipo, artes de pesca o productos pesqueros utilizados para cometer delitos e infracciones contra la legislación pesquera u obtenidos como producto de tales hechos. Tanto las naves como los demás bienes serán puestos en forma inmediata a la orden de la autoridad judicial respectiva para lo que corresponda en derecho”. Por su parte, el numeral 155 del mismo cuerpo normativo, señala que “Los buques o las embarcaciones utilizados para la comisión de los hechos ilícitos tipificados en la presente Ley, responderán por el pago de las multas impuestas a sus ocupantes o dueños por la trasgresión de la presente Ley. Para tales efectos, el despacho judicial que conozca la causa correspondiente ordenará, al Registro de Bienes Muebles del Ministerio de Justicia, la anotación de un gravamen judicial sobre la embarcación involucrada en los hechos ilícitos.

Asimismo, el despacho judicial comunicará inmediatamente esta circunstancia a las autoridades portuarias respectivas, para que tomen las previsiones correspondientes en materia de zarpes y otros efectos.” Como se extrae de las normas anteriores, ante la comisión de un hecho ilícito previsto en la Ley de Pesca y Acuicultura, es deber de las autoridades actuantes proceder a la detención de las personas involucradas, y a su vez al decomiso de los bienes, equipo, artes de pesca y productos pesqueros utilizados o resultado de la comisión de los delitos e infracciones previstos en la norma; y las embarcaciones deben ser puestas a la orden de la autoridad judicial, la que deberá disponer al Registro de Bienes Muebles del Ministerio de Justicia la anotación del gravamen judicial en el asiento registral respectivo. Este gravamen legal tiene por objeto que la embarcación o buque responda por el pago de las multas impuestas a sus ocupantes o dueños, y su anotación tendría por objeto hacer del conocimiento de terceros de esa condición.

El Reglamento a la Ley de Pesca y Acuicultura N° 8436 (Decreto Ejecutivo N° 36782 del 24 de mayo de 2011), amplía la medida para cuando se trate de infracciones que son competencia de los órganos administrativos, al señalar en el artículo 146 que “En el caso de las embarcaciones o buques, utilizados en la comisión de los hechos ilícitos tipificados en la LPA, sujetos a competencia administrativa, el Órgano Director mediante resolución debidamente razonada y fundamentada, por considerarlo necesario y proporcional a los hechos investigados, a efecto de garantizar el eventual pago de una sanción de multa que pudiere ser impuesta, solicitará el auxilio y cooperación a las autoridades judiciales penales competentes de la jurisdicción donde se cometieron o realizaron los hechos investigados, para la aplicación de lo dispuesto en el artículo 155 de la LPA, procurando la imposición de restricciones o anotaciones de los gravámenes judiciales que correspondan sobre la embarcación correspondiente y la comunicación a las autoridades portuarias respectivas para lo de su cargo.” Sobre el caso en concreto.

En el caso que nos ocupa, se aprecia que mediante Acta de Decomiso MSP-DMSP-DVUE-DSNG-EGM-024-2022 el Servicio Nacional de Guardacostas procedió al decomiso -entre otros bienes- de la embarcación Dorka II Matrícula GCP-8821, así como el motor Yamaha modelo F75CEDL, serie 6BC1001884. El Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, en la sentencia oral N° 511-2023 de las 15:30 horas, del 1 de setiembre del 2023, en lo que interesa, ordena la devolución de la embarcación y su respectivo motor a quien figure como su legítimo propietario, y en cuanto a la anotación del gravamen judicial no efectúo ningún pronunciamiento. Es con ocasión del recurso de apelación de sentencia que promueve la Procuradora Penal, que Tribunal de Apelación de Sentencia Penal Juvenil del Segundo Circuito Judicial de San José, en función de Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz, mediante voto 2023-0506 de las 13:05 horas del 25 de octubre de 2023, rechaza el recurso de apelación, y adicionalmente resuelve: “Proceda el Tribunal de Flagrancia del Primer Circuito Judicial de Liberia a cancelar la anotación en el asiento de inscripción de la embarcación Dorka II, matrícula GPC-8821, motor marca Yamaha F75CEDL, número 68C1001884, inscrita a nombre de [Nombre 004] y a realizar las diligencias necesarias para la devolución a su propietario.” (lo resaltado no es del original, folio 202 vuelto).

En la fundamentación que da el tribunal superior no se dan razones por las cuales ordena el levantamiento de la anotación del gravamen judicial que pesa sobre la embarcación. La única mención al tema de la cancelación de dicho gravamen es cuando señala que en la resolución de instancia “…tampoco se dispuso la cancelación de la anotación de este proceso, defecto que no perjudica al Estado, sino al propietario.” (folio 202). La inexistente fundamentación sobre el tema no permite comprender por qué el Tribunal de Apelación de Sentencia Penal considera como un defecto de la sentencia de instancia el no ordenar la cancelación del asiento indicado. Además, la orden de cancelar la anotación del gravamen judicial es contraria a lo que dispone el artículo 155 de la Ley de Pesca y Acuicultura que establece que dicha medida tiene por objeto que los buques o embarcaciones respondan por las multas impuestas a los ocupantes o dueños por transgresión a esa ley.

Está acreditado en el proceso, que al imputado se le impuso una pena de multa de catorce salarios base, para un monto total de seis millones cuatrocientos setenta mil ochocientos colones, por lo que conforme a lo dispuesto en el artículo 155 citado, se darían los supuestos jurídicos para mantener el gravamen judicial y en la eventualidad que el sentenciado no pague dicha multa, pueda la embarcación responder por el pago de la misma. En igual sentido, dado que el bien mueble debería continuar gravado para responder eventualmente por el pago de las multas impuestas, de ordenarse la devolución de embarcación, sería en condición de depositario judicial provisional, conforme lo prevé el artículo 200 del Código Procesal Penal, y no de forma definitiva, como se ordenó en la resolución recurrida. Es claro que en casos como el presente, si la embarcación no es objeto del comiso, debe mantener el gravamen judicial en el Registro de Bienes Inmuebles para que responda por las multas impuestas.

Es por ello que, se debe declarar con lugar el segundo motivo de casación presentado por la Procuradora Penal y se anula la sentencia número 2023-0506 de las 13:05 horas del 25 de octubre de 2023, dictada por Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera, del Segundo Circuito Judicial de San José, en función de Tribunal de Apelación de Sentencia Penal de Guanacaste, sede Santa Cruz, así como la sentencia oral N° 511-2023 de las 15:30 horas, del 1 de setiembre del 2023 del Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, en cuanto ordenó la devolución definitiva de la embarcación Dorka II Matrícula GCP-8821, así como el motor Yamaha modelo F75CEDL, serie 6BC1001884 a quien figure como su legítimo propietario, en lo demás se mantiene incólume lo resuelto, debiendo en su lugar ordenarse la anotación del gravamen judicial, salvo que se ordene el comiso de los bienes.

Debe tomar nota el Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia que, al examinarse el expediente en torno a la anotación de los bienes decomisados, no se observa que se haya enviado la comunicación para la anotación del gravamen judicial en el asiento registral respectivo, y al efectuarse la consulta al Registro de Bienes Muebles del Ministerio de Justicia, lo cual es también comprobable en la certificación visible a folio 130 del expediente, no consta la anotación de dicho gravamen por lo que debe cumplir el tribunal con lo dispuesto en el artículo 155 de la Ley de Pesca y Acuicultura, salvo que se disponga el comiso o no de dichos bienes.La magistrada Vargas González pone nota.

Por tanto:

Se declara con lugar los motivos primero y segundo del recurso de casación presentado por la licenciada Zaray Chavarría Prado, en su condición de Procuradora Penal, y por consiguiente: i. se anula la sentencia número 2023-0506 de las 13:05 horas del 25 de octubre de 2023, dictada por Tribunal de Apelación de Sentencia Penal Juvenil, Sección Primera, del Segundo Circuito Judicial de San José, en función de Tribunal de Apelación de Sentencia Penal de Guanacaste, sede Santa Cruz. ii. se anula la sentencia oral N° 511-2023 de las 15:30 horas, del 1 de setiembre del 2023 del Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, en cuanto ordenó la devolución definitiva de la embarcación Dorka II Matrícula GCP-8821, así como el motor Yamaha modelo F75CEDL, serie 6BC1001884 a quien figure como su legítimo propietario, en lo demás se mantiene incólume lo resuelto. iii. Se ordena el juicio de reenvío ante el Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia, para que, con una integración diversa, resuelva lo concerniente al comiso y disposición de los bienes decomisados. iv. Proceda el Tribunal Penal del Primer Circuito Judicial de Guanacaste, Liberia a realizar las anotaciones de ley sobre la embarcación decomisada. La magistrada Vargas González pone nota. Notifíquese.

Magistrado suplente NOTA DE LA MAGISTRADA VARGAS GONZÁLEZ Si bien comparto la decisión adoptada, en el sentido de ordenar un reenvío para una nueva fundamentación de algunos tópicos de importancia, considero oportuno hacer algunas observaciones adicionales con miras a que el tribunal sentenciador, si lo tiene a bien, las considere al resolver el reenvío ordenado: i) de conformidad con el artículo 110 del Código Penal, la incautación de los instrumentos, efectos y ganancias del delito es procedente salvo “el derecho que sobre ellos tengan el ofendido o terceros”. Así las cosas, es indispensable examinar si, a la luz de las circunstancias del caso concreto, el propietario de la embarcación ostenta o no, tal carácter; ii) al tercero se le debe garantizar el derecho de audiencia, pues de lo contrario se podría estar vulnerando el principio de tutela judicial efectiva; el derecho de defensa y el propio derecho de propiedad, todos de rango constitucional; iii) la multa es una pena y en tal carácter, tiene un carácter personalísimo.

Entender que el patrimonio de un tercero de buena fe (entiéndase, alguien sin vínculo con los hechos) puede responder por el pago de la sanción impuesta a otra persona podría ser cuestionable desde la óptica constitucional, por vulnerar entre otros derechos, el de propiedad. Por ello, considero que la interpretación del artículo 155 de la Ley de Pesca y Acuicultura debe hacerse teniendo presente lo anterior y recordando —una vez más— que la multa es una sanción penal y no una consecuencia civil y que en este caso el propietario de la embarcación no fue procesado penalmente ni se le impuso sanción alguna. Las anteriores acotaciones se formulan respetuosamente, a efectos de que sean valoradas por el tribunal de mérito si lo considera oportuno.
