WHEREAS

I.In this case, the Asociación Pro Conservación y Defensa de los Recursos Naturales y Culturales de la Provincia de Guanacaste (hereinafter, the Asociación) sued the Instituto de Desarrollo Rural (hereinafter INDER, then IDA), Sabomar S.A., Playa Grande S.A., Shan Gi La de Santa Ana S.A., El Cortesano Azul S.A., Playa Grande de la Bahía South Beach S.A., Club Bahía Tamarindo S.A., Consultores Financieros Cofin S.A., Diamante Flamingo S.A., Mangrove Wildlife Ltda, Nuevos Horizontes de Montaña de Tempate S.A., Grupo Doce Baulas S.A., Corporación Líquida Jeréz S.A., and the Municipalidad de Santa Cruz. It added that the relief sought was annulment of the title granted by the then Instituto de Tierras y Colonización (ITCO) to Sabomar S.A. through possessory information proceedings (información posesoria), by resolution issued at 8:00 a.m. on 26 de julio de 1972, concerning land that, it asserted, lies within the maritime-terrestrial zone (zona marítimo terrestre, ZMT) and includes mangrove areas.

It stated that the property is the Guanacaste property recorded under registration no. 26153-000. It asserted that the property was subsequently sold to Playa Grande S.A. It recounted that several subdivided parcels (segregaciones) from that property were acquired by third parties, whose property titles are also sought to be annulled. It requests that the judgment declare: a) the titling granted by ITCO to SABOMAR S.A.—the resolution issued at 8:00 a.m. on 26 de julio de 1972—of the area within the ZMT described in registered survey plan no. G-16603-1972, measuring 13.68 hectares and 19.57 m2, absolutely null and void, as is the administrative act adopted through that resolution; b) consequently, the registration of that area in the Public Registry, Guanacaste District, volume 2120, folio 229, entry 1, which created property No. 26153, is null and void; c) the subsequent subdivisions and sales made from the aforementioned property, which included all or part of the ZMT that was irregularly titled, are null and void; d) the titled property described in registered survey plan G-16603-1972 included mangrove areas constituting public-domain property (naturaleza demanial); e) all mangrove areas be excluded from the titled property; f) the portion of the registered area forming part of the ZMT and the mangrove area be excluded from the registry entries and from the corresponding registered survey plans; g) the State, through the Sistema Nacional de Áreas Silvestres Protegidas, be authorized to take definitive possession of the corresponding area of the ZMT, including the portion forming part of the Parque Nacional Marino Las Baulas de Guanacaste and the mangrove areas; and h) the defendants be ordered to pay costs in the event of opposition.

All co-defendants denied the claims, except the defendant Municipality, which was declared in default (rebelde). They raised the defenses (excepciones) of an act not subject to challenge, statute of limitations (prescripción), expiration of the action (caducidad), and lack of standing to sue and be sued (legitimación activa y pasiva), legal right, and present interest. The Court rejected them. It granted the complaint. It ordered the absolute annulment of the registry entries for the following properties: no. 26153-000 registered to Playa Grande S.A.; no. 83311-000 registered to Playa Grande S.A.; no. 86044-000 registered to Shang Gi La S.A.; no. 37627-000 registered to El Cortesano Azul S.A.; no. 82015-000 registered to Playa Grande de la Bahía South Beach S.A.; no. 113468-000 registered to Club Bahía Tamarindo S.A.; no. 085329-000 registered to Consultores Financieros Cofin S.A.; no. 87441-000 registered to Diamante Flamingo S.A.; no. 87442-000 registered to Mangroove Wildlife Estates Inc. Ltda.; no. 88398-000 registered to Nuevos Horizontes de Montaña Tempate S.A.; and no. 147715-000 registered to Grupo Doce Baulas S.A. It ordered the defendants to pay both categories of costs (ambas costas).

Dissatisfied with the decision, the representatives of INDER, Playa Grande S.A., El Cortesano Azul S.A., Playa Grande de la Bahía South Beach S.A., Club Bahía Tamarindo S.A., Consultores Financieros Cofin S.A., Mangrove Wildlife Ltda, Nuevos Horizontes de Montaña de Tempate S.A., Grupo Doce Baulas S.A., and Corporación Líquida Jeréz S.A. appeal on points of law (casación).

Appeal on procedural grounds by Playa Grande S.A. and Nuevos Horizontes de Montaña Tempate S.A.

II.Counsel for the appellants in cassation (casacionistas) raises five grounds of this nature, which are reorganized so that the complaint concerning the prerequisites of every procedural relationship—namely, the proper joinder of parties (integración de la litis)—may be addressed first. In the first objection (the second ground of the appeal), counsel for both companies alleges that the parties to the proceeding were not properly joined. She argues that the plaintiff seeks the annulment of the possessory-information proceeding (información posesoria) through which title was obtained to the property that gave rise to parent property registration no. 26153-000, in the name of Sabomar S.A., as well as the respective subdivisions (segregaciones) derived from it. She contends that the State must necessarily appear as a defendant and that its participation as a supporting intervenor (coadyuvante) or interested third party is improper.

She further maintains that the Junta Administrativa del Registro Nacional must also be joined as a necessary codefendant (litisconsorte pasivo), since several registry entries could ultimately be annulled and that agency could be liable for the registrations made. In the second ground (the third ground of the appeal), she asserts that not all owners were joined in the proceeding, even though, in reliance on the public registry record and before the complaint was filed, they acquired properties derived from the parent property. She transcribes the third claim in the complaint, which seeks annulment of the subdivisions originating from Guanacaste property no. 26153-000 that included all or part of the maritime-terrestrial zone (zona marítimo terrestre, ZMT), which, she alleges, was irregularly titled. Along those lines, she states that both the owners of the subdivided properties and the holders of any other rights over them must be joined.

In that regard, she objects that there is incomplete necessary joinder of defendants (litisconsorcio pasivo necesario), because, as she indicates based on the registry certifications submitted with her cassation brief, property no. 5-83311, owned by Playa Grande S.A., was subdivided and sold to other natural and legal persons who were not summoned to this proceeding to assert their rights. They are: Alexandra Marshall Lara (property registration no. 5-94398-001), Manfred Marshall Facio (property registration no. 5-94398-002), Edelmira García de Izeppi (property registrations no. 5-109757-001 and 002), Volesc MMIV S.A. (property registration no. 5-116785-000), Playa Grande del Tamarindo PGT S.A. (property registration no. 5-117033-000), Reventazón Riviera Villa Ltda. (property registration no. 5-117901-000), and Palo Seco de Playa Grande RPS S.A. (property registration no. 5-118999-000). On the foregoing grounds, she considers sections 12, 66.f, 71, 92.4, 120.3 and 137.a of the CPCA to have been violated.

In the third grievance (the first ground of the appeal), she alleges that the operative portion (parte dispositiva) of the judgment refers to pages and recitals (considerandos) in the court record. She states that section 155 of the Código Procesal Civil (hereinafter CPC) prohibits granting one or more forms of relief sought in the complaint merely by referring to statements made in one or more of the recitals. She asserts that, in clear violation of that provision, the judges annul in the “Por Tanto” the registry entries for the properties owned by the defendants, referring for that purpose to pages of the court record containing the registration information and other details concerning the properties. She partially transcribes the “Por Tanto”. She emphasizes that the operative portion is so vague that it merely states the property number and location, referring for everything else to pages containing the registry certification, without providing further information.

In her view, this is not a mere formality; rather, it concerns essential information used to annul registry entries for real property, which requires, at a minimum, an indication of all the property characteristics and registry information in order to avoid confusion. Accordingly, she believes that section 155 of the CPC was violated. In the fourth ground, she alleges lack of congruence (incongruencia). She states that the judgment grants less than, more than, and relief different from that requested (infra, ultra y extra petita). She reproduces sections 99 and 155 of the CPC, as well as section 119.5 of the CPCA. She cites a decision of this Chamber in support of her position. She argues that the relief sought included annulment of the possessory-information proceeding before the ITCO and of the registration in the name of Sabomar S.A. She notes that, on page 59 of the judgment, the Court reiterates that the requested relief is annulment of the act granting title to the property before the ITCO, insofar as the property encompasses or partially contains areas in the public domain (dominio público).

She states that the judgment repeatedly affirms that the administrative possessory-information proceeding before the ITCO did not exist, which provided the basis for annulling the subdivisions and sales involving property 26153-000. Nevertheless, she indicates that, surprisingly, the operative portion omits any ruling on that proceeding and the subsequent titling, thereby granting less relief than requested. She insists that this part of the decision does not even mention Sabomar S.A. as the applicant and original owner of the property; in other words, it does not address the titling in any way or declare it invalid, as had been requested. She asserts that this left any annulment of the subsequent registry entries without a legal basis. She states that the subject matter of the proceeding (recital V of the judgment) explains that the additional claims are consequences of the annulment of the title granted by the ITCO in favor of Sabomar S.A.; that annulment is therefore presented as the cause and basis of the remaining claims.

She then states that, in claims 1, 2, 4, 5, 6 and 7, the plaintiff sought annulment of the administrative possessory-information proceeding and the demarcation and exclusion of the mangrove areas from the registered properties. She explains that the plaintiff’s objections and claims seek annulment of the subdivisions and sales because, in the plaintiff’s view, they encompassed the ZMT. Nevertheless, she continues, no ruling was made to that effect. This, she explains, harms her because all registry entries in the area are annulled in their entirety, causing the registered properties to disappear completely and at their roots, without any limitation of effects (dimensionamiento) and without distinguishing the nature of the areas they encompass. With respect to her property, she emphasizes that the judgment reiterates on page 64 (2629) that there was “a portion” of land to which title could not be granted.

She clarifies that the record shows the commencement and processing of special expropriation proceedings against some of the companies, which raises the question of why expropriation would be necessary if no private property exists. From that perspective, she reiterates that the judgment granted more relief than requested. She further adds that, with respect to the third claim, there was another instance of granting less relief than requested, which she calls “internal” because it is inherent and exclusive to claim no. 3, the only claim granted by the Court. She objects that this claim was indeed decided only in part, without any mention of the mangrove area that the plaintiff sought to exclude from the subdivisions and sales. She argues that the foregoing amounted to granting both less relief and relief different from that requested, because all the registrations were simply annulled in an absolute, complete, and unqualified manner.

This was so, she recounts, because the proceeding sought annulment of the parent property and its subdivisions insofar as they: “…included all or part of the area of the maritime-terrestrial zone that was irregularly titled.” Nevertheless, she emphasizes that the Court disregarded this limitation, since it is undeniable that the “complete, radical, absolute, unqualified and unconditional” annulment of the properties and their transfers was never requested, as the Court ordered in manifest excess of its authority and of the relief sought (ultra petita). She adds that annulment was requested only insofar as the properties encompassed public-domain land (zona demanial); hence, the Court granted more relief than requested by annulling the entire property. Thus, she maintains, it is impossible to determine—even under the theoretical assumption that grounds for annulment existed and that annulment was proper, which she rejects—what percentage of the properties consists of beach or wetlands, that is, the ZMT.

Indeed, she states that no evidence demarcating that zone was submitted, requested, or, much less, received. She asserts that, if any public-domain status (demanialidad) existed, it would be only partial; therefore, a “complete, absolute and unqualified” annulment cannot be ordered without limiting its effects and in disregard of private property rights, beyond the relief sought by the plaintiff. She states that the content of proven fact 7 in the judgment confirms this, as it indicates that plan G-16603-72 contained duly demarcated areas of the ZMT (including a specific area), meaning that it did not encompass the entire property. She emphasizes that proven fact 7 states the following regarding that plan: “…As to its Area, it indicated that it was 37 hectares 37 square decimeters, subdivided as follows: Property area. 23 Ha.69 and “Maritime Mile” Area 13.68 hectares; said plan respecting the maritime-terrestrial mile…” In her view, the Court reiterates that the alleged ZMT, which she claims was improperly registered, comprises only part of property 26153-000 and never the entire property, such that complete annulment was unwarranted.

Along those lines, she asserts that the judges stated on page 47 of the judgment (2621): “It is also clear that the maritime mile recorded by Engineer Yanuario Matamoros Córdoba was 13.68 hectares, establishing the boundary description (derrotero) of the property to be titled and the boundary description of the maritime mile, and that the area of the property to be titled measured 23.69 hectares; nevertheless, the registry entry recorded the area of the property as a total of 37.37 hectares, meaning that it included the area reserved to the State as the ‘Maritime Mile.’” She asserts that the plaintiff sought annulment of the subdivisions and sales made from property 26153-000, never of the registrations (an entirely different matter), and that the Court therefore granted relief different from that requested. She adds that nothing was defined or decided regarding the rights and claims of Corporación Líquida de Jerez S.A., thereby granting less relief than requested.

She notes that the company was summoned and appeared as a codefendant in its capacity as creditor; nevertheless, the judgment annulled the subdivisions, sales, and registrations—exceeding the scope of the requested ruling—in their entirety and without qualification, while making no ruling whatsoever concerning that creditor’s rights. In the fifth objection, she states that a judgment is null when it is contradictory and that the challenged judgment is indeed contradictory. She contends that the plaintiff states that the possessory-information proceeding processed before the ITCO to register the parent property was not the appropriate procedure because it could be conducted only through judicial proceedings. She indicates that, when the Court addresses the issue on page 43 (2619) of the judgment, it states: “It must be understood that the reference to the possessory-information proceeding was to the procedure governed by Ley 4545, Ley de Informaciones Posesorias Administrativas, which allowed an administrative proceeding before the Instituto de Tierras y Colonización (ITCO), and that recourse was had to judicial proceedings only in the event of opposition or silence by that Institute, as provided in article 12 of that law.

In summary, it follows that, pursuant to Transitorio III of Ley 4558, private persons could obtain title to properties located in the maritime-terrestrial zone, for which purpose the interested party could resort, at its election, to the provisions of Ley 139 of 1941 or Ley No. 4545 of 1970. Having thus clarified the content and scope of Ley No. 4558 and its Transitorio III, as well as the procedure for obtaining title under Ley No. 4545, the evidence submitted by the parties must now be analyzed in order to determine the validity of the challenged administrative act.” She alleges that, after stating unequivocally that it was entirely possible to register the property in question through an administrative possessory-information proceeding processed before the ITCO, the Court states on page 48: “The second is that there is no proof that Mr. Zamora Zamora filed titling proceedings before the ITCO; instead, Sabomar S.A. did so.

but states that he acquired the property on 2 de junio de 1972, when Transitorio III had already ceased to have effect and, therefore, it was legally impossible to institute possessory-information title proceedings (titulación por información posesoria) for a portion of the Maritime-Terrestrial Zone (zona marítimo terrestre) after 14 de octubre de 1971; and although the Legislature allowed those proceedings that had been filed in a timely manner to continue until their conclusion, this applied only to applications that had been filed before the Courts, not before ITCO in administrative proceedings (sede administrativa). Thus, as of 14 de octubre de 1971, ITCO lost jurisdiction (competencia) to grant title exclusively with respect to lands in the Maritime-Terrestrial Zone pursuant to Transitorio III of Ley 4558, and even to grant title to land under the Ley de Informaciones Posesorias, since such proceedings had to be pursued through judicial channels (vía judicial).

Thus, ITCO could properly continue granting possessory-information titles through a final administrative act (acto final) issued in compliance with the procedures described and by reference to the Ley de Informaciones Posesorias within the framework of Ley 4545, until that law was repealed, but it could not grant title to real property located in the Maritime-Terrestrial Zone after 14 de octubre de 1971, much less to property that was eligible to be titled, but by judicial authority, even if the applications had been filed before that date,…” It contends that the contradiction and nullity (nulidad) are evident, because it first says that they were valid and immediately thereafter says that they were not, or at least not with respect to real property encompassing the maritime mile (milla marítima). It argues that the contradiction is compounded when, on page 51 of the judgment (folio 2623), it states: “Furthermore, with respect to the areas of land not included within the Maritime-Terrestrial Zone, it was not ITCO, but rather the competent judicial authority, that had jurisdiction to make the relevant determination.” It therefore concludes that the judgment is contradictory and void.

III.In the first objection, counsel for both companies alleges defective joinder of the dispute (composición de la litis). It argues that the plaintiff Association seeks the annulment of the possessory-information proceeding (información posesoria) through which title was obtained to the real property from which parent property registration no. 26153-000, registered in the name of Sabomar S.A., originated, as well as the respective subdivisions (segregaciones) derived therefrom. It contends that the State must necessarily appear as a defendant and that its participation as an assisting party (coadyuvante) or interested third party (tercero interesado) is improper. It further maintains that the Administrative Board of the National Registry must also be joined as a necessary co-defendant (litisconsorte pasivo), since several registry entries could ultimately be annulled and that agency could be liable for the registrations made.

Along the same lines, it asserts that not all owners who, relying on the public notice afforded by the Registry and before the complaint was filed, acquired properties derived from the parent property were joined in the proceeding. To that end, it transcribes the third claim for relief in the complaint, which seeks the annulment of the subdivisions originating from property no. 26153-000 of the Guanacaste Registry District that included all or part of the ZMT area allegedly titled irregularly, according to the plaintiff. Consequently, it states that both the owners of the subdivided properties and the holders of any other rights therein must be joined in the proceeding. In that regard, it objects that there is incomplete compulsory joinder of necessary co-defendants (litisconsorcio pasivo necesario incompleto), because, as it indicates on the basis of the registry certifications submitted with its cassation brief (líbelo de casación), property no. 5-83311, owned by Playa Grande S.A., was subdivided and sold to other natural and legal persons who were not summoned to this proceeding to assert their rights.

It identifies them as: Alexandra Marshall Lara (property registration no. 5-94398-001), Manfred Marshall Facio (property registration no. 5-94398-002), Edelmira García de Izeppi (property registrations no. 5-109757-001 and 002), Volesc MMIV S.A. (property registration no. 5-116785-000), Playa Grande del Tamarindo PGT S.A. (property registration no. 5-117033-000), Reventazón Riviera Villa Ltda. (property registration no. 5-117901-000), and Palo Seco de Playa Grande RPS S.A. (property registration no. 5-118999-000). On the foregoing grounds, it considers sections 12, 66.f, 71, 92.4, 120.3, and 137.a of the Code of Administrative Litigation Procedure (hereinafter CPCA) to have been violated.

III.As clarified during the preliminary hearing, insofar as relevant to the alleged error, the relief sought in the complaint is: “1- That the grant of title made by the Instituto de Tierras y Colonización in favor of SOBOMAR (sic) S.A., by decision issued at 8:00 a.m. on veintiséis de julio de mil novecientos setenta y dos, over the area corresponding to the maritime-terrestrial zone (zona marítimo terrestre) described in the survey plan registered with the Catastro Nacional under number G-16603-1972, measuring 13.68 hectares and 19.57 square meters, is absolutely null and void, as is the administrative act (acto administrativo) adopted by that decision. 2- That, therefore, the registration of that area in the Registro Público de la Propiedad Inmueble, Guanacaste Registry District, volume 2120, folio 229, entry 1, which gave rise to property no. 26153, is absolutely null and void. 3- That the subsequent subdivisions and sales made from the aforementioned property, which included all or part of the maritime-terrestrial zone area that was irregularly titled, are (sic) also absolutely null and void (sic).” This Chamber observes that the determining factor regarding the State’s status as a necessary co-party (litisconsorte) is that the subject matter of the proceeding—the annulment of title—concerns real property that includes part of the ZMT, title to which would belong to the State, while its administration and beneficial use (usufructo) would belong to the defendant municipal corporation (articles 1 and 3 of the LZMT).

Thus, regardless of whether title was granted to Sabomar and the subsequent owners in accordance with the legal system, and regardless of which administrative entity might be responsible for any irregularity in that respect, the fact remains that, in order to make the requested judicial annulment of the award made through the possessory-information proceeding, the registry registration, and the subsequent subdivisions of the property legally enforceable, the State must appear in the proceeding as a party and, specifically, must be made a defendant. In this particular case, that duty is imposed upon it by section 1 of the Ley sobre la Zona Marítimo Terrestre, which provides: “The maritime-terrestrial zone forms part of the national patrimony, belongs to the State, and is inalienable and not subject to acquisitive prescription (imprescriptible). Its protection, as well as that of its natural resources, is an obligation of the State, its institutions, and all inhabitants of the country.

Its use and exploitation are subject to the provisions of this law.” Accordingly, the Procuraduría General de la República must appear in this proceeding. In that regard, section 4 thereof provides: “The Procuraduría General de la República, on its own initiative or at the request of any State entity or institution or any interested party, shall exercise legal oversight to ensure due compliance with the provisions of this law. Consequently, it shall undertake the appropriate measures with respect to any actions that violate or tend to infringe these provisions or related laws, that seek to obtain rights or recognition thereof contrary to those rules, or that seek the annulment of concessions, permits, contracts, acts, resolutions, or provisions obtained in contravention thereof. The foregoing is without prejudice to the responsibilities of other institutions or agencies in accordance with their legal powers.” Even more expressly, that mandate is contained in section 3 of the Ley Orgánica de la Procuraduría General de la República, which includes among its powers: “i) To act in defense of the national patrimony, the resources located in the maritime-terrestrial zone, the territorial sea, the exclusive economic zone, and the continental shelf.//To take the appropriate legal action to safeguard the environment, in order to guarantee every person’s constitutional right to a healthy and ecologically balanced environment (…)”.

This obligation is also cited in sections 5, third paragraph, and 10 of the Ley de Informaciones Posesorias, which require the Procuraduría General de la República to be treated as a party and given a hearing on the outcome in all possessory-information proceedings. To this must be added the settled case law of this adjudicatory body concerning the concept of the public domain (dominio público) and the scope of section 261 of the Civil Code, insofar as that provision states: “Public things are those that, by law, are permanently allocated to any service of general utility, and those that everyone may use because they have been dedicated to public use. / All other things are private and subject to private ownership, even when they belong to the State or the Municipalities, which, for such purposes, as civil persons, do not differ from any other person.” As may be inferred, private property is defined residually; that is, this category includes everything that does not possess any of the characteristics specified for public-domain property (bienes demaniales).

Taking into account the cited provision, constitutional case law has described property comprising the public domain in the following terms: “These are assets whose nature and legal regime differ from those of private property—which is governed by the right to property under the terms of article 45 of the Political Constitution—because, by the legislature’s express will, they are dedicated to the special purpose of serving the community, that is, the public interest, and therefore cannot be privately owned; they are thus outside private commerce and cannot belong individually either to private persons or, strictly speaking, to the State, since the latter is limited to their administration and protection. […] Thus, these are assets to which the State holds title in its capacity as administrator; they must be understood as assets belonging (sic) to the ‘Nation,’ and therefore form part of the public patrimony.

Because of their special legal nature, they possess the following attributes: they are not subject to acquisitive or extinctive prescription, which means that the passage of time cannot result in the acquisition of ownership over them, or even mere possession—that is, they cannot be acquired through adverse possession (usucapión), nor can rights in them be lost by prescription. For this reason, the use permits granted over them by the Administration are always precarious, which allows the Administration to revoke them at any time for reasons of expediency or convenience—under the terms provided in articles 154 and 155 of the Ley General de la Administración Pública—and any concessions granted for their exploitation may be canceled through the corresponding procedure. They are exempt from attachment (inembargables), meaning that they cannot be subject to any encumbrance or attachment, whether by private persons or by the Administration; and they are inalienable, meaning that they are outside private commerce and therefore cannot be transferred, sold, or acquired, whether gratuitously or for consideration, by private persons or by the State.

Thus, they are excluded from private commerce and subject to a special and reinforced legal regime. Furthermore, their use and exploitation are subject to the police power (poder de policía), because, as assets that cannot be possessed, much less owned, their use and exploitation are possible only through duly authorized acts, whether by a concession or a use permit granted by the competent authority, and are subject to constant oversight by the Public Administration. Accordingly, this category comprises real property whose nature and legal regime are virtually the opposite of private property, as derived from article 45 of the Constitution.” (See, to that effect, judgments 2007-2408 of 16 hours 13 minutes on 21 de febrero de 2007 and no. 189 of 9 hours 15 minutes on 3 de marzo de 2011). It follows from the foregoing that the notion of public domain refers to assets permanently allocated to services of public utility and public use.

Emphasis is thus placed on their special purpose of serving the community and on the fact that they cannot be privately owned. Consequently, the State holds title to them in its capacity as administrator. (Sala Primera, no. 150-2017, of 14 hours 15 minutes on 21 de febrero de 2017). It follows from the foregoing that the State could not have appeared in the proceeding as an assisting party, as it initially sought to do, nor as an interested third party, as ordered by the case-management judge (juez de trámite). On the contrary, given the title it might hold over the land in dispute and, should judgment be entered for the plaintiff, the restoration of that land to its patrimony, it plainly has a direct interest in the matter that, by legal mandate, it is obligated to protect through the exercise of this action, in light of the complaint already brought by the plaintiff Association in defense of what it alleges to be a diffuse interest (interés difuso). On the foregoing grounds, the State must therefore be joined in the proceeding as a necessary co-defendant (litis consorte pasivo necesario).

IV.Now, with respect to the second objection raised by the appellant in cassation (parte casacionista), this Chamber finds that it is well founded, insofar as the matter under review involves incomplete mandatory passive joinder (litisconsorcio pasivo necesario incompleto), a defect that, as will be explained, would invalidate the judgment. As stated supra, the plaintiff Association seeks not only the annulment of the titling and registration of the Guanacaste property, registration no. 26153-000, in favor of Sabomar S.A., but also the annulment of all subsequent subdivisions (segregaciones) derived from that property and registered in favor of third parties. Nevertheless, based on the registry certifications appearing at folios 2814 through 2841, it is evident that other parties could be directly affected by the outcome of these proceedings and were not summoned to exercise their right of defense, even though they are necessary passive co-parties (litisconsortes pasivos necesarios).

They must be joined as defendants in the proceedings pursuant to Article 106 of the Civil Procedure Code (Código Procesal Civil, CPC), which applies to this subject matter by express reference in Article 220 of the Administrative Litigation Procedure Code (CPCA). These natural and legal persons acquired parcels that were subdivided from the parent property, registration no. 5-26153-000, an estate that Sabomar S.A. initially obtained title to through possessory-information proceedings (información posesoria), which were processed administratively before the then Instituto de Tierras y Colonización, pursuant to Transitorio III de la Ley 4558 del 12 de mayo de 1970. The parties in question are Alexandra Marshall Lara, Manfred Marshall Facio, Edelmira García de Izeppi, and the companies Volesc MMIV S.A., Playa Grande del Tamarindo PGT S.A., Reventazón Riviera Villa Ltda., and Palo Seco de Playa Grande RPS S.A. Given the substantive legal relationship (relación jurídica material) at issue, under which the validity of those derivative titles depends directly on the decision regarding the original titling, the Tribunal could not validly decide the merits of the matter without first joining all necessary passive co-parties, whose participation in the proceedings is strictly necessary. Their joinder in this litigation as necessary passive co-parties is therefore mandatory.

V.Finally, regarding the participation of the Junta Administrativa del Registro Público, this Chamber does not find the appellant’s argument persuasive. Although the Registry is involved and the relief sought in the complaint is partially aimed at challenging the legality of the titling of a parcel carried out by the Instituto de Tierras y Colonización in favor of Sabomar S.A.—an act that allegedly included at least part of the ZMT—it is evident that, even if that act were found unlawful, the decision in the matter under review would not be binding upon the Registro Nacional. On the contrary, it is evident that the subject matter of the action does not affect its powers or any express acts of the Registro Nacional. Accordingly, the Junta Administradora del Registro Nacional is not required to appear as a necessary passive co-party. Therefore, the appeal must be denied as to this issue.

VI.In view of the foregoing, the appeal filed shall be granted and the judgment shall be vacated. Ruling on the merits, the affirmative defense of lack of passive standing on the merits (falta de legitimación ad causam pasiva) shall be sustained. The matter shall be remanded to the Tribunal of origin so that it may set aside the proceedings conducted thus far and serve the complaint upon the State, Alexandra Marshall Lara, Manfred Marshall Facio, Edelmira García de Izeppi, Volesc MMIV S.A., Playa Grande del Tamarindo PGT S.A., Reventazón Riviera Villa Ltda., and Palo Seco de Playa Grande RPS S.A., ordering them to join the proceedings as necessary passive co-parties and duly serving them with the action. In light of the manner in which the matter is resolved, no ruling is issued on the remaining grounds of error raised in this challenge or on the other appeals filed before that court.

Por tanto

The appeal is declared partially well founded. The judgment is vacated. The case file shall be remanded to the Tribunal so that it may join the State, Alexandra Marshall Lara, Manfred Marshall Facio, Edelmira García de Izeppi, Volesc MMIV S.A., Playa Grande del Tamarindo PGT S.A., Reventazón Riviera Villa Ltda., and Palo Seco de Playa Grande RPS S.A. in the proceedings as necessary passive co-parties.

Intervienen como coadyuvantes activos, la Contraloría General de la República, representada por Hansel Arias Ramírez; Jesús González Hidalgo y el Sistema Nacional de Áreas de Conservación representado por Oscar Eduardo Romero Aguilar, como tercer interviniente, la Procuraduría General de la República, representada por Mauricio Castro Lizano, vecino de Heredia y portador de la cédula de identidad número uno- setecientos sesenta y siete-trescientos dos, carné del Colegio de Abogados No. 6344. Las personas físicas son mayores de edad, abogados y con las salvedades hechas.

CONSIDERANDO

I.En la especie, la Asociación Pro Conservación y Defensa de los Recursos Naturales y Culturales de la Provincia de Guanacaste (en lo sucesivo la Asociación) demandó al Instituto de Desarrollo Rural (en adelante INDER, en ese entonces IDA), a Sabomar S.A., a Playa Grande S.A., Shan Gi La de Santa Ana S.A., El Cortesano Azul S.A., Playa Grande de la Bahía South Beach S.A., Club Bahía Tamarindo S.A., Consultores Financieros Cofin S.A., Diamante Flamingo S.A., Mangrove Wildlife Ltda, Nuevos Horizontes de Montaña de Tempate S.A., Grupo Doce Baulas S.A., Corporación Líquida Jeréz S.A y la Municipalidad de Santa Cruz. Agregó, lo requerido es la nulidad de título otorgado por el entonces Instituto de Tierras y Colonización (ITCO) a favor de Sabomar S.A. por información posesoria, mediante resolución de las 8 horas del 26 de julio de 1972, respecto de tierras que afirmó, se encuentran dentro de zona marítimo terrestre (en adelante ZMT) y que incluirían áreas de manglar.

Estipuló, el inmueble es la finca de Guanacaste, matrícula no. 26153-000. Posteriormente, aseguró, fue vendido a Playa Grande S.A. Relató, varias segregaciones de esa heredad fueron adquiridas por terceros; respecto de quienes también se demanda la nulidad de los títulos de propiedad. Solicita en sentencia se declare: a) la titulación otorgada por el ITCO a favor de SABOMAR S.A., -resolución de las 8 horas del 26 de julio de 1972, del área correspondiente a la ZMT que describe el plano catastrado no. G-16603-1972 con una medida de 13.68 hectáreas y 19.57 m2, es absolutamente nula; como nulo es el acto administrativo que mediante dicha resolución fue adoptado; b) por ello es nula inscripción que de dicha área se hizo en el Registro Público, Partido de Guanacaste, al tomo 2120, folio 229, asiento 1, que originó la finca No. 26153; c) son nulas las subsiguientes segregaciones y ventas que se realizaron de la mencionada finca, las cuales incluyeron total o parcialmente la ZMT que de manera irregular fue titulada; d) dentro de la finca titulada que describe el plano catastrado G-16603-1972 se incluyeron áreas de manglar, de naturaleza demanial; e) se excluyan de lo titulado todas las áreas de manglar; f) se excluya de los asientos registrales, la porción del área inscrita que forma parte de la ZMT y el área de manglar; así como de los planos catastrados que correspondan; g) se autorice al Estado, a través del Sistema Nacional de Áreas Silvestres Protegidas, entrar en posesión definitiva del área correspondiente de la ZMT, incluso la que forme parte del Parque Nacional Marino Las Baulas de Guanacaste y de las áreas de manglar; h) se impongan las costas a los demandados en caso de oposición.

Todos los codemandados contestaron en forma negativa, excepto el Municipio accionado, que fue declarado rebelde. Opusieron las excepciones de acto no susceptible de impugnación, prescripción, caducidad, falta de: legitimación activa y pasiva, de derecho y de interés actual. El Tribunal las rechazó. Declaró con lugar la demanda. Decretó la nulidad absoluta de la inscripción registral de las fincas: no. 26153-000 a nombre de Playa Grande S.A.; no. 83311-000 a nombre de Playa Grande S.A.; no. 86044-000 a nombre de Shang Gi La S.A.; no. 37627-000 a nombre del Cortesano Azul S.A.; no. 82015-000 a nombre del Playa Grande de la Bahía South Beach S.A.; no. 113468-000 a nombre de Club Bahía Tamarindo S.A.; no. 085329-000 a nombre de Consultores Financieros Cofin S.A.; no. 87441-000 a nombre de Diamante Flamingo S.A.; no. 87442-000 a nombre de Mangroove Wildlife Estates Inc. Ltda.; no. 88398-000 a nombre de Nuevos Horizontes de Montaña Tempate S.A.; y, no. 147715-000 a nombre de Grupo Doce Baulas S.A. Condenó a las accionadas al pago de ambas costas.

Inconforme con lo resuelto, la representación del INDER, Playa Grande S.A., El Cortesano Azul S.A., Playa Grande de la Bahía South Beach S.A., Club Bahía Tamarindo S.A., Consultores Financieros Cofin S.A., Mangrove Wildlife Ltda, Nuevos Horizontes de Montaña de Tempate S.A., Grupo Doce Baulas S.A. y Corporación Líquida Jeréz S.A. acuden a casación.

Recurso por razones procesales de Playa Grande S.A. y Nuevos Horizontes de Montaña Tempate S.A.

II.La representación de las casacionistas formula cinco motivos de esta naturaleza, los cuales se reorganizan a fin de conocer en primer orden el reclamo referente a los presupuestos de toda relación procesal, a saber, la integración de la litis. En el primer reparo (segundo del recurso), la representación de ambas sociedades acusa deficiencia en la composición de la litis. Alega, la actora pretende la nulidad de la información posesoria mediante la cual se tituló el inmueble que dio origen a la finca madre matrícula no. 26153-000, a nombre de Sabomar S.A., así como las respectivas segregaciones que de ella se derivaron. Aduce, el Estado debe necesariamente figurar como parte demandada, siendo improcedente su participación como coadyuvante o como tercero interesado. Además, sostiene, también debe integrarse como litisconsorte pasivo a la Junta Administrativa del Registro Nacional toda vez que, eventualmente, podrían resultar anulados varios asientos registrales y podría existir responsabilidad de esa dependencia por las inscripciones realizadas.

En el segundo cargo, (tercero del recurso), asevera, no se integraron al proceso todos los propietarios, quienes al amparo de la publicidad registral y con antelación a la demanda, adquirieron los inmuebles derivados de la finca madre. Transcribe la tercera pretensión de la demanda, en la cual solicita la nulidad de las segregaciones provenientes de la finca no. 26153-000 de Guanacaste que incluyeron total o parcialmente la ZMT, y que, según alega, fue titulada de forma irregular. En esa línea apunta, deben integrarse tanto los dueños de las fincas segregadas como los titulares de cualquier otro derecho sobre ellas. En ese sentido, reprocha la existencia de un litisconsorcio pasivo necesario incompleto, toda vez que según indica, con apoyo en las certificaciones registrales que aporta en su líbelo de casación, la finca no. 5-83311, propiedad de Playa Grande S.A., fue segregada y vendida a otras personas, físicas y jurídicas, que no fueron llamadas a este proceso para hacer valer sus derechos.

Se trata de: Alexandra Marshall Lara (finca matrícula no. 5-94398-001), Manfred Marshall Facio (finca matrícula no. 5-94398-002), Edelmira García de Izeppi (fincas matrícula no. 5-109757-001 y 002), Volesc MMIV S.A. (finca matrícula no. 5-116785-000), Playa Grande del Tamarindo PGT S.A. (finca matrícula no. 5-117033-000), Reventazón Riviera Villa Ltda. (finca matrícula no. 5-117901-000) y Palo Seco de Playa Grande RPS S.A. (finca matrícula no. 5-118999-000). Con fundamento en lo anterior, estima conculcados los numerales 12, 66.f, 71, 92.4, 120.3 y 137.a del CPCA. En el tercer agravio, (primero del recurso), acusa, la parte dispositiva de la sentencia remite a folios y considerandos del expediente judicial. Exterioriza, el numeral 155 del Código Procesal Civil (en adelante CPC), prohíbe declarar procedentes uno o varios extremos de la demanda, refiriéndolos únicamente a lo dicho en alguno o algunos de los considerandos.

Enuncia, con evidente infracción, los jueces anulan en el “Por Tanto”, las inscripciones registrales de los inmuebles propiedad de las demandadas, remitiendo para ello a folios del expediente judicial, en los cuales se hacen constar los datos de inscripción y demás detalles de las heredades. Transcribe parcialmente el “Por Tanto”. Enfatiza, la vaguedad de la parte dispositiva es tal, que se limita a señalar el número de finca y su ubicación, remitiendo en lo demás a folios en los cuales consta la certificación registral, sin brindar mas información. En su parecer no se trata de un mero formalismo, sino de los datos esenciales con los cuales se pretende anular los asientos registrales de inmuebles, que exigen, al menos, la indicación de todas las características y datos del registro, para evitar confusiones. De esa suerte, en su criterio se violenta el precepto 155 del CPC. En el cuarto cargo reclama incongruencia.

Dice, la sentencia incurre en infra, ultra y extra petita. Edita los parágrafos 99 y 155 del CPC, así como el mandato 119.5 del CPCA. Cita fallo de esta Sala en apoyo de su tesis. Esgrime, en las pretensiones se pidió la nulidad de la información posesoria ante el ITCO y la inscripción a nombre de Sabomar S.A. Esboza, a folio 59 de la sentencia, el Tribunal reitera que lo solicitado es la nulidad del acto de titulación del inmueble, ante el ITCO, en tanto que los bienes abarcan o contienen parcialmente áreas del dominio público. Expresa, durante toda la sentencia se afirma, la información posesoria administrativa ante el ITCO no existió, lo cual fundamentó la nulidad de las segregaciones y ventas efectuadas sobre el inmueble 26153-000. No obstante, indica, de manera sorprendente, se omite en la parte dispositiva cualquier pronunciamiento sobre tal información y titulación posterior, incurriéndose en infra petita.

Insiste, ni siquiera se cita en esa parte del fallo a la empresa Sabomar S.A., como gestora y propietaria original del inmueble, es decir, no se aborda en modo alguno la titulación, ni se declara su invalidez, tal y como se había solicitado. Manifiesta, así se dejó sin base legal cualquier nulidad de los asientos registrales posteriores. Menciona, en el objeto del proceso, (considerando V del fallo), se hace ver que las pretensiones adicionales son consecuencia de la nulidad de la titulación otorgada por el ITCO a favor de Sabomar S.A., es decir, se presenta como causa y fundamento de las restantes. Luego dice, en las pretensiones 1, 2, 4, 5, 6 y 7, la accionante pidió la nulidad de la información posesoria administrativa y la demarcación y exclusión de las zonas de manglar en las propiedades inscritas. Precisa, la inconformidad y las pretensiones de la actora se dirigen a la nulidad de las segregaciones y ventas efectuadas, por cuanto en su criterio, abarcaron la ZMT.

No obstante, prosigue, no hubo pronunciamiento en ese sentido. Lo anterior, explica, le perjudica, pues se anulan en su totalidad los asientos registrales en el área, haciéndose desaparecer de raíz y en su totalidad, sin ningún dimensionamiento, las fincas inscritas, sin distinción de la naturaleza de las áreas que las cubren. Respecto a su fundo, recalca, la sentencia reitera, a folio 64 (2629), había “una porción” de tierra que no se podía titular. Aclara, en el proceso consta el inicio y trámite de los procesos especiales de expropiación seguidos contra algunas de las empresas, a lo cual cabe cuestionar, cuál es la razón de expropiar, si no existe propiedad privada. Desde esa perspectiva, reafirma, se incurrió en ultra petita. A lo anterior añade, respecto de la tercera pretensión se da una nueva infra petita, a la cual denomina “interna”, por ser propia y exclusiva de la pretensión no. 3, única estimada por el Tribunal.

Recrimina, en efecto esa pretensión se resolvió parcialmente, sin que nada se dijera sobre el manglar que la accionante pretendía excluir de las segregaciones y ventas. Con lo anterior, reprocha, se dio infra y extra petita, pues se anuló la totalidad de las inscripciones sin más, de manera absoluta, plena y simple. Ello, relata, por cuanto en el proceso se pidió la nulidad de la finca madre y de sus segregaciones, en cuanto: “…incluyeron total o parcialmente el área de la zona marítimo terrestre de que de manera irregular fue titulada”. No obstante, resalta, el Tribunal hizo caso omiso de ello, pues es innegable, nunca se pidió la nulidad “plena, radical, absoluta, simple e incondicionada” de los inmuebles y sus traspasos, tal y como lo hizo el Tribunal con evidente exceso en sus poderes y de lo peticionado (ultra petita). Agrega, sólo se lo solicitó en tanto comprendiesen zona demanial, de ahí haya incurrido el Tribunal en ultra petita en tanto anuló la totalidad del inmueble.

De esa manera, sostiene, no se sabe –aún en el ejercicio teórico de que existiesen y fuera procedente la nulidad, lo cual rechaza-, cuál porcentaje existe en los bienes, de playa o humedales, o sea de la ZMT. De hecho, menciona, no se aportó, ni pidió ni mucho menos se recibió prueba demarcando tal zona. Exterioriza, de existir demanialidad, ésta sería tan solo parcial, de ahí que no pueda efectuarse una anulación “plena, absoluta y simple”, sin dimensionamiento y con irrespeto de la propiedad privada, en exceso de lo pedido por la accionante. Enuncia, el contenido del hecho probado 7 del fallo lo confirma, cuando señala, que el plano G-16603-72, contenía zonas debidamente demarcadas (con área específica inclusive), de ZMT, es decir no todo el inmueble. Subraya, de ese plano, dice el hecho 7 citado: “…En cuanto a su Área señaló que era de 37 hectáreas 37 decímetros cuadrados subdividido de la siguiente manera: Área de la finca. 23 Ha.69 y por Área de la “Milla Marítima” 13.68 hectáreas; respetando dicho plano la milla marítimo terrestre…” En su parecer, el Tribunal reitera que la supuesta ZMT, que alega fue registrada en forma indebida, lo es tan solo en un área parcial del inmueble 26153-000, nunca en su totalidad, como para anularlo plenamente.

En esa línea, asegura, los juzgadores, a folio 47 del fallo, (2621), mencionan: “También es claro que la milla marítima consignada por el Ingeniero Yanuario Matamoros Córdoba fue de 13.68 hectáreas, estableciendo el derrotero de la finca a titular y el derrotero de la milla marítimo y el área de la finca a titular era una cabida de 23.69 hectáreas; sin embargo en el asiento registral se consignó que la cabida de la finca lo era por un total de 37.37 hectáreas, sea que, incluyó el área reservada al Estado por concepto de “Milla Marítima”. Asevera, la actora pidió la nulidad de las segregaciones y ventas realizadas como derivación de la finca 26153-000, nunca las inscripciones, (cosa muy distinta), con lo cual incurrió en extra petita. Adiciona, tampoco se definió ni se resolvió nada sobre los derechos y acreencias de Corporación Líquida de Jerez S.A., incurriendo en infra petita. Comenta, dicha empresa fue llamada y se apersonó como codemandada, en su calidad de acreedora, no obstante, la sentencia anuló las segregaciones, ventas e inscripciones, (con exceso de pronunciamiento), en su totalidad y de manera simple, sin establecer pronunciamiento alguno sobre los derechos de tal acreedora.

En la quinta inconformidad expresa, la sentencia es nula cuando es contradictoria y la que se ataca lo es. Aduce, la actora expresa que la información posesoria tramitada ante el ITCO, para inscribir la finca madre, no era la vía adecuada para ello, pues solo podía realizarse en sede judicial. Indica, cuando el Tribunal aborda el tema a folio 43 (2619), del fallo, revela: “Debe de entenderse que la remisión a la información posesoria, era la regulada por la Ley 4545, Ley de Informaciones Posesorias Administrativas, que permitía un trámite administrativo ante el Instituto de Tierras y Colonización (ITCO), y que únicamente en caso de contención o de silencio por parte de ese Instituto, se acudía a la vía judicial, según lo establecía el artículo 12 de dicha ley. En síntesis, se tiene entonces que conforme al Transitorio III de la Ley 4558 fue posible que particulares titularan inmuebles ubicados en la zona marítimo terrestre, para lo cual el interesado podía acudir a los (sic) dispuesto en la Ley 139 de 1941 o a la Ley No. 4545 de 1970 a su elección.

Teniendo claridad entonces sobre el contenido y alcance de la Ley No. 4558 y de su Transitorio III, así como del procedimiento a titular bajo la Ley No. 4545, corresponde ahora, analizar la prueba aportada por las partes, a efecto de determinar la validez el acto administrativo impugnado.” Acusa, luego de señalar con contundencia que era perfectamente posible inscribir el inmueble de referencia a través de una información posesoria administrativa tramitada ante el ITCO, señala a folio 48: “La segunda es que no se acredita que el señor Zamora Zamora planteara diligencias de titulación ante el ITCO, sino que lo hace la sociedad Sabomar S.A. pero señala que la propiedad la adquiere el día 2 de junio de 1972, cuando ya el Transitorio III había dejado de surtir efectos y por ende era legalmente imposible promover diligencia de titulación por información posesoria de una porción de zona marítimo terrestre después del 14 de octubre de 1971, y si bien el Legislador permitió que las que hubieran sido presentadas en tiempo, se tramitaran hasta su fenecimiento, lo fueron únicamente para aquellas solicitudes que se habían presentado ante los Juzgados y no ante el ITCO en sede administrativa.

Así a partir del 14 de octubre de 1971, el ITCO perdió competencia, para titular exclusivamente aquellas que se refirieran a la Zona Marítimo Terrestre de acuerdo al Transitorio III de la Ley 4558, e incluso para titular terrenos al amparo de la Ley de Informaciones posesorias, cuando lo propio debía de diligenciarse en la vía judicial. Así el ITCO bien pudo seguir titulando informaciones posesorias por acto final dictado en observancia de los procedimientos descritos y por remisión a la Ley de Informaciones Posesorias en el marco de la Ley 4545, hasta que esta fue derogada, pero no podía titular inmuebles ubicados en la zona marítimo terrestre luego del 14 de octubre de 1971, menos aquellos que eran competencia de ser titulados, pero por autoridad judicial, aún cuando las solicitudes hubiesen sido planteadas antes de dicha fecha,…” Considera, la contradicción y la nulidad son evidentes, por cuanto primero dice, eran válidas y de seguido dice que no, o al menos, no para los inmuebles que comprendieran milla marítima.

Opina, la contradicción se profundiza cuando en la página 51 de la sentencia (folio 2623), señala, que: “Por lo demás, en lo que toca a las áreas de terreno no comprendidas en la zona marítimo terrestre, no era el ITCO, como sí la autoridad judicial competente la que ostentaba competencia para determinar lo correspondiente”. Concluye de esa manera, la sentencia es contradictoria y nula.

III.En el primer reparo, la representación de ambas sociedades acusa deficiencia en la composición de la litis. Alega, la Asociación actora pretende la nulidad de la información posesoria mediante la cual se tituló el inmueble que dio origen a la finca madre matrícula no. 26153-000, a nombre de Sabomar S.A.; así como las respectivas segregaciones que de ella se derivaron. Aduce, el Estado debe necesariamente figurar como parte demandada, siendo improcedente su participación como coadyuvante o como tercero interesado. Además, sostiene, también debe integrarse como litisconsorte pasivo a la Junta Administrativa del Registro Nacional toda vez que, eventualmente, podrían resultar anulados varios asientos registrales y podría existir responsabilidad de esa dependencia por las inscripciones realizadas. En ese mismo orden de ideas asevera, no se integraron al proceso todos los propietarios que, al amparo de la publicidad registral y con antelación a la demanda, adquirieron los inmuebles derivados de la finca madre.

Al efecto, transcribe la tercera pretensión de la demanda, en la cual solicita la nulidad de las segregaciones provenientes de la finca no. 26153-000 del Partido de Guanacaste y que incluyeron total o parcialmente el área de ZMT, titulada de forma irregular, según el dicho de la accionante. En consecuencia apunta, deben integrarse al proceso tanto los dueños de las fincas segregadas como los titulares de cualquier otro derecho sobre ellas. En ese sentido, reprocha la existencia de un litisconsorcio pasivo necesario incompleto, toda vez que según indica, con apoyo en las certificaciones registrales que aporta en su líbelo de casación, la finca no. 5-83311, propiedad de Playa Grande S.A., fue segregada y vendida a otras personas, físicas y jurídicas, que no fueron llamadas a este proceso para hacer valer sus derechos. Indica, se trata de: Alexandra Marshall Lara (finca matrícula no. 5-94398-001), Manfred Marshall Facio (finca matrícula no. 5-94398-002), Edelmira García de Izeppi (fincas matrícula no. 5-109757-001 y 002), Volesc MMIV S.A. (finca matrícula no. 5-116785-000), Playa Grande del Tamarindo PGT S.A. (finca matrícula no. 5-117033-000), Reventazón Riviera Villa Ltda.

(finca matrícula no. 5-117901-000) y Palo Seco de Playa Grande RPS S.A. (finca matrícula no. 5-118999-000). Con fundamento en lo anterior, estima conculcados los numerales 12, 66.f, 71, 92.4, 120.3 y 137.a del Código Procesal Contencioso Administrativo (en lo que sigue CPCA).

III.Según se ajustó durante la audiencia preliminar, en lo que al agravio interesa, la pretensión de la demanda consiste en: “1- Que la titulación otorgada, por el Instituto de Tierras y Colonización a favor de SOBOMAR (sic) S.A., por resolución de las 8:00 horas del veintiséis de julio de mil novecientos setenta y dos, del área correspondiente a la zona marítimo terrestre y que describe el plano inscrito en el Catastro Nacional bajo el número G-16603-1972 con una medida de 13.68 hectáreas y 19.57 metros cuadrados, es absolutamente nula como nulo es el acto administrativo que mediante dicha resolución fue adoptado. 2- Que por tanto es absolutamente nula la inscripción que de dicha área se hizo en el Registro Público de la Propiedad Inmueble, Partido de Guanacaste, al tomo 2120, folio 229, asiento 1, que originó la finca no. 26153. 3- Que es (sic) absolutamente nulo (sic) también las subsiguientes segregaciones, y ventas que se realizaron de la mencionada finca, y que incluyeron total o parcialmente el área de la zona marítimo terrestre que de manera irregular fue titulada”.

Observa esta Sala, el factor que resulta determinante en cuanto a la condición de litisconsorte del Estado es que el objeto del proceso –nulidad de título- recae sobre un bien inmueble que incluye parte de la ZMT, cuya titularidad correspondería al Estado y a la corporación municipal accionada su administración y usufructo (artículos 1 y 3 de la LZMT). De ese modo, independientemente de si la titulación se otorgó a Sabomar y a los posteriores propietarios de conformidad o no con el ordenamiento jurídico, y a cuál entidad administrativa se le atribuiría una eventual irregularidad en ese sentido, lo cierto es que, a efecto de hacer jurídicamente ejecutable en sentencia la pretensión de anular el acto de adjudicación mediante el proceso de información posesoria, la inscripción registral y posteriores segregaciones del inmueble, es necesario que en el proceso figure el Estado como parte, y en concreto, se constituya como demandado.

En este caso en concreto, ese deber le deviene impuesto por el canon 1 de la Ley sobre la Zona Marítimo Terrestre, que reza: “La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley”. De manera que, corresponderá a la Procuraduría General de la República concurrir a este proceso. En ese sentido, el cardinal 4 ibídem dispone: “La Procuraduría General de la República, por sí o a instancia de cualquier entidad o institución del Estado o de parte interesada, ejercerá el control jurídico para el debido cumplimiento de las disposiciones de esta ley. En consecuencia, hará las gestiones pertinentes respecto a cualesquiera acciones que violaren o tendieren a infringir estas disposiciones o de leyes conexas, o que pretendan obtener derechos o reconocimiento de estos contra aquellas normas, o para anular concesiones, permisos, contratos, actos, acuerdos o disposiciones obtenidos en contravención a las mismas.

Lo anterior sin perjuicio de lo que corresponda a otras instituciones o dependencias de conformidad con sus facultades legales”. De forma aún más expresa, ese mandato está contenido en el canon 3 de la Ley Orgánica de la Procuraduría General de la República, que dentro de sus atribuciones incluye: “i) Actuar en defensa del patrimonio nacional, de los recursos existentes en la zona marítimo-terrestre, el mar territorial, la zona económica exclusiva y la plataforma continental.//Tomar las acciones legales procedentes en salvaguarda del medio, con el fin de garantizar el derecho constitucional de toda persona a un ambiente sano y ecológicamente equilibrado (…)”. También se encuentra cita de dicha obligación en los cánones 5 párrafo tercero y 10 de la Ley de Informaciones Posesorias, los cuales ordenan tener como parte y dar audiencia sobre su resultado a la Procuraduría General de la República, en todos los procesos de información posesoria.

Agréguese a ello, la jurisprudencia reiterada de este órgano decisor, en cuanto al concepto de dominio público y a los alcances del precepto 261 del Código Civil, en tanto dicha regulación estipula: “Son cosas públicas las que, por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquellas de que todos pueden aprovecharse por estar entregadas al uso público. / Todas las demás cosas son privadas y objeto de propiedad particular, aunque, pertenezcan al Estado o a los Municipios, quienes para el caso, como personas civiles, no se diferencian de cualquier otra persona.” Como se extrae, la definición de los bienes privados se hace en forma residual, es decir, pertenecen a esta categoría todos aquellos que no presenten ninguna de las características señaladas para los demaniales. La jurisprudencia constitucional, tomando en cuenta lo preceptuado por la norma citada, se ha referido sobre los bienes que integran el dominio público en los siguientes términos: “son aquellos que tienen una naturaleza y régimen jurídico diverso de los bienes privados –los cuales se rigen por el derecho de propiedad en los términos del artículo 45 de la Constitución Política–, en tanto, por expresa voluntad del legislador se encuentran afectos a un destino especial de servir a la comunidad, sea al interés público, y que por ello, no pueden ser objeto de propiedad privada, de modo que están fuera del comercio de los hombres, por lo cual, no pueden pertenecer individualmente a los particulares, ni al Estado, en sentido estricto, por cuanto éste se limita a su administración y tutela. […] Así, se trata de bienes cuya titularidad ostenta el Estado en su condición de administrador, debe entenderse que se trata de bienes que pertenecen (sic) la "Nación", con lo cual, conforman parte del patrimonio público; y que, por su especial naturaleza jurídica, presentan los siguientes atributos: son imprescriptibles, lo cual implica que por el transcurso del tiempo, no puede adquirirse el derecho de propiedad sobre ellos, ni siquiera de mera posesión, es decir, no pueden adquirirse mediante la usucapión, así como tampoco pueden perderse por prescripción; motivo por el cual los permisos de uso que la Administración conceda sobre ellos, siempre tienen un carácter precario, lo cual hace que puedan ser revocadas por motivos de oportunidad o conveniencia en cualquier momento por la Administración –en los términos previstos en los artículos 154 y 155 de la Ley General de la Administración Pública–; y las mismas concesiones que se otorguen sobre ellos para su aprovechamiento, pueden ser canceladas, mediante procedimiento al efecto; son inembargables, que hace que no pueden ser objeto de ningún gravamen o embargo, ni por particulares, ni por la Administración; y son inalienables, lo que se traduce en la condición de que están fuera del comercio de los hombres; de donde no pueden ser enajenados, vendidos o adquiridos, ni a título gratuito ni oneroso, ni por particulares, ni por el Estado, de modo que están excepcionados del comercio los hombres y sujetos a un régimen jurídico especial y reforzado.

Además su uso y aprovechamiento está sujeto al poder de policía, en tanto, por tratarse de bienes que no pueden ser objeto de posesión, y mucho menos de propiedad, su utilización y aprovechamiento es posible únicamente a través de actos debidamente autorizados, sea mediante concesión o permiso de uso, otorgado por la autoridad competente; y al control constante de parte de la Administración Pública. De manera que comprende bienes inmuebles que tienen una naturaleza y régimen jurídico virtualmente opuesto a la propiedad privada, que deriva de lo dispuesto en el artículo 45 constitucional.” (Véanse en ese sentido los fallos 2007-2408 de las 16 horas 13 minutos del 21 de febrero de 2007 y no. 189 de las 9 horas con 15 minutos del 3 de marzo de 2011). De lo anterior, se extrae, la noción de dominio público alude a bienes destinados de forma permanente a cualquier servicio de utilidad y uso público.

Así, se enfatiza en el destino especial de servicio a la colectividad y en que no pueden ser objeto de propiedad privada. De ahí, el Estado es su titular en condición de administrador. (Sala Primera, no. 150-2017, de las 14 horas 15 minutos del 21 de febrero de 2017). De lo expuesto se sigue, el Estado no podía haberse apersonado al proceso en carácter de coadyuvante, como lo pretendió en un inicio, ni tampoco como tercero interesado, como lo dispuso el juez de trámite. Por el contrario, en mérito de la titularidad que eventualmente podría ostentar sobre los terrenos en discusión y, de darse una sentencia estimatoria, el reintegro de ellos a su patrimonio, es evidente tiene un interés directo en el asunto que, por mandato legal y está obligado a tutelar a través del ejercicio de esta acción; ello en virtud de la demanda que ya fue incoada por la Asociación actora en defensa de lo que alega ser un interés difuso. Con fundamento en lo anterior, debe entonces el Estado integrarse al proceso en carácter de litis consorte pasivo necesario.

IV.Ahora bien, en lo tocante a la segunda disconformidad planteada por la parte casacionista, estima esta Cámara, lleva razón en cuanto a que en el asunto de examen, se está en presencia de un litisconsorcio pasivo necesario incompleto, vicio que, como se dirá, invalidaría la sentencia. Según se expuso supra, la Asociación demandante pretende no sólo la nulidad de la titulación e inscripción registral de la finca de Guanacaste, matrícula no. 26153-000 a favor de Sabomar S.A., sino también de todas las posteriores segregaciones que de esa finca se derivaron e inscribieron a favor de terceros. No obstante, se advierte, con fundamento en las certificaciones registrales que rolan de folios 2814 al 2841, existen otros sujetos que podrían verse directamente afectados con las resultas de este proceso, quienes no fueron llamados al proceso para ejercer su derecho de defensa, pese a que se trata de litisconsortes pasivos necesarios.

Estos deben ser traídos como parte demandada al proceso, de conformidad con el numeral 106 del Código Procesal Civil (CPC), aplicable a la materia por remisión expresa del precepto 220 del CPCA. Estas personas, físicas y jurídicas, adquirieron terrenos que fueron segregados de la finca madre matrícula no. 5-26153-000, heredad que en un primer momento Sabomar S.A. tituló mediante información posesoria, la cual fue tramitada en sede administrativa, ante el entonces Instituto de Tierras y Colonización, en aplicación del Transitorio III de la Ley 4558 del 12 de mayo de 1970. Se trata de los señores Alexandra Marshall Lara, Manfred Marshall Facio, Edelmira García de Izeppi y las sociedades Volesc MMIV S.A., Playa Grande del Tamarindo PGT S.A., Reventazón Riviera Villa Ltda. y Palo Seco de Playa Grande RPS S.A. Dada la relación jurídica material sometida a debate, acorde a la cual, la validez de tales títulos derivados pende directamente de lo que se resuelva respecto en cuanto a la titulación originaria, no podía el Tribunal sentenciar válidamente el asunto por el fondo sin antes haber integrado a todos los litisconsortes pasivos, cuya participación en el proceso es estrictamente necesaria. De ahí que se torna obligatoria su incorporación al presente litigio, en su calidad de litis consortes pasivos necesarios.

V.Finalmente, en lo que se refiere a la participación de la Junta Administrativa del Registro Público, no concibe esta Sala, lleve razón la recurrente. Lo anterior por cuanto, si bien el Registro y la pretensión deducida en la demanda está parcialmente encaminada a cuestionar la legalidad de la titulación de una parcela realizada por el Instituto de Tierras y Colonización a favor de Sabomar S.A., acto que se aduce, incluyó al menos en parte la ZMT, es evidente, aún y cuando ello resultara ilegítimo, lo que se resuelva en el asunto de estudio, no causa estado para el Registro Nacional. Por el contrario, es evidente, el objeto de la acción no incide sobre sus competencias, ni sobre actos explícitos del Registro Nacional. De esa suerte no se estima, la Junta Administradora del Registro Nacional deba apersonarse como litis consorte pasivo necesario. Por ende, en cuanto a tal extremo, el recurso deberá desestimarse.

VI.En mérito de lo expuesto, se admitirá el recurso formulado, se anulará la sentencia. Fallando por el fondo, se acogerá la excepción de falta de legitimación ad causam pasiva. Se reenviará el asunto al Tribunal de origen, a fin de que retrotraiga los trámites y de traslado de la demanda al Estado, a Alexandra Marshall Lara, Manfred Marshall Facio, Edelmira García de Izeppi, Volesc MMIV S.A., Playa Grande del Tamarindo PGT S.A., Reventazón Riviera Villa Ltda. y Palo Seco de Playa Grande RPS S.A, ordenándoles integrarse al proceso en su calidad de litisconsortes pasivos necesarios, dándoseles el respectivo traslado de la acción. Por la forma cómo se resuelve, se omite pronunciamiento sobre los restantes agravios formulados en la presente impugnación, así como en cuanto a los demás recursos planteados ante esa sede.

POR TANTO

Se declara parcialmente con lugar el recurso. Se anula la sentencia. Se dispone el reenvío del expediente al Tribunal para que proceda a incorporar al proceso al Estado, a Alexandra Marshall Lara, Manfred Marshall Facio, Edelmira García de Izeppi, Volesc MMIV S.A., Playa Grande del Tamarindo PGT S.A., Reventazón Riviera Villa Ltda. y Palo Seco de Playa Grande RPS S.A, en su calidad de litisconsortes pasivos necesarios.
