WHEREAS
I.In accordance with the facts established at both levels of proceedings and which are undisputed, Mr. Juan Diego Vargas Soto appears as the registered holder (titular registral) of right 001, and Ms. Kattia Salas Castro as the registered owner (dueña registral) of right 002, over the property recorded in the Alajuela registry district, folio 293864, known as parcel 48-1 of Proyecto Salinas I, located in the fifth district, Ceiba, ninth canton, Orotina. It has an area of 123.513,90 square meters. As of 27 de setiembre de 2007—the date on which the judicial inspection (reconocimiento judicial) was conducted—it contained the following structures: a) in the northern sector, a house with an adjacent garage, another house behind it, and sheds; b) a cement structure that appears to be a swimming pool, with an adjoining cement slab; c) a stable; d) a corral made of “perling” with a tile-patterned zinc roof; e) an enclosure made of “perling,” partially roofed, measuring 7,60 x 14,90 meters; f) internal prefabricated cement fences; g) a large structure located in the northern area, with a type of terrace; h) an internal gravel road; i) in the sector south of the stream, another house with a dirt floor, telephone cable, electricity, and water; j) a sports field; k) a wall-less pavilion, apparently intended for parties, with a quarter-stone floor and a tile-patterned zinc roof, having a constructed area of 25 m x 12 m and supplied with electricity and water; and l) a heliport.
It also contains crops and trees consisting of: a) grafted orange trees, b) palm trees, c) teak trees, d) plantain, e) tempate, and f) large pochote trees. In the southern part of the property there is pastureland and livestock. The property is subject to restrictions under Ley no. 2825, Ley de Tierras y Colonización, which, according to the Registro Público, began on 25 de mayo de 1995 and ended on 25 de mayo de 2010. On 13 de febrero de 1986, Mr. Ubaldo Rojas Fallas and Mr. Juan Diego Vargas Soto executed a private document (documento privado), which they called a “contract for the sale and purchase of improvements to a parcel” (“contrato de compra venta de mejora de una parcela”). In that document, they stipulated that Mr. Rojas Fallas had been the beneficiary of parcel number 48-A of the Salinas project, which he sold to Mr. Vargas Soto, including the improvements and eight years of possession, while retaining one hectare.
The Board of Directors of the then Instituto de Desarrollo Agrario—IDA—approved that transfer at meeting number 399, held on 17 de junio de 1986, resolution no. nine. By means of a public deed (escritura pública) executed on 25 de mayo de 1995, the IDA’s general attorney-in-fact with unlimited authority as to amount segregated a lot identified as number 48-1 from the property recorded in the Alajuela registry district under real-property folio 80070-000 and sold it to Juan Diego Vargas Soto and Kattia María Salas Castro. That public instrument stipulated that the purchasers accepted the sale with the understanding that it was subject to restrictions, including that they could not transfer title to the property, encumber it, lease it, or subdivide it (subdividirlo) without the prior authorization of the selling Institute, unless 15 years had elapsed from that date. Transactions entered into with the nationalized banking system, the Consejo Nacional de Producción—CNP—or any other State credit institution were exempted from that prohibition.
It was also stated that any disposal of the parcel or parcels which, in the IDA’s judgment, could result in excessive concentration or subdivision of the property would entitle it to acquire the property offered for sale. Likewise, it was agreed that any failure by the purchasers, or by persons to whom the parcel had been transferred, to comply with any of the obligations established in the Ley de Tierras Colonización would entitle the IDA to revoke the award (adjudicación) administratively and request that the Registro Público again record the sold property in favor of that entity, paying the person appearing in the Registry as owner at the time of revocation the original purchase price, as well as the value of the improvements made to the property, in accordance with an appraisal performed for that purpose by an expert from the selling institution. The aforementioned parcel, no. 48-1(A), was recorded in the Alajuela registry district under folio 293.864-001-002.
By a resolution adopted at meeting number 30-95, held on 6 de junio de 1995, the IDA Board of Directors authorized don Juan Diego and doña Kattia María to grant a first-ranking mortgage over that parcel in favor of a bank belonging to the Sistema Bancario Nacional, for an amount of ₡15.000.000,00. This was for planting tomatoes, melons, watermelons, and purchasing drip-irrigation equipment. In a public deed executed on 9 de noviembre de 1995, Mr. Vargas Soto and Ms. Salas Castro, with the instrument stating that the transaction had been authorized by the IDA Board of Directors, issued in their favor a first-ranking mortgage certificate (cédula hipotecaria) for ₡20.000.000,00, secured by the property recorded in the Alajuela registry district under folio number 293.864-001-002. That document stated that the property given as security was subject to IDA restrictions that expired on 25 de mayo de 2010.
On 11 de setiembre de 1998, the mortgage certificate was endorsed in favor of Banco de Costa Rica—BCR. By means of a written submission filed with the IDA’s Dirección Regional Coyolar, Mr. Vargas Soto, as president of Asociación de Productores Trinidad y La Uvita, requested the removal of the restrictions contained in the deeds executed in Asentamiento Salinas 1. On property folio 293.864, until approximately the year 2000, don Juan Diego and doña Kattia María cultivated papaya, melon, orange, avocado, pipián, watermelon, mango, chili pepper, cucumber, and tomato; installed a drip-irrigation system; and built a house. On 4 de diciembre de 1998, Ms. Salas Castro, Mr. Vargas Soto, and the company Blinky de Orotina Sociedad Anónima—hereinafter BLINKY—represented by Ms. Julia Ibarra Seas, executed a private lease agreement (contrato de arrendamiento) for a section of the aforementioned property folio 293.864-001-002.
The parties stated that the section leased to BLINKY corresponded to the sector where the dwelling house stood and comprised an approximate area of 2 hectares. They likewise established that the lease term would be three years—from 1 de diciembre de 1998 through 30 de noviembre de 2001—and could be renewed for an equal term if the parties so agreed three months before the end of the term. They also agreed that the rent would be ₡500.000,00 per year, payable in a single installment for the first year, with the annual statutory increase of 15% over the previous balance, which would be paid on the first day of December of each year beginning in 1999, in cash and at the lessor’s domicile. They further stipulated that the lessee would use the property for residential and recreational purposes and could make improvements to it without changing the style of the house or changing the property’s use to one other than that agreed upon.
The improvements could not be removed once the agreement ended. Upon its termination for any reason, the lessee would deliver the property in the condition in which it had received it, together with the improvements made. They also stated that the lessors, or persons duly authorized for that purpose, would have the right to inspect the property at least once a month to verify that it was being used properly, in accordance with the agreement and accepted standards of conduct. The lessee could not sublease or assign the agreement in whole or in part, nor could it negotiate any right arising from it. By public deed executed on 5 de febrero de 1999, Mr. Pedro Adrián Borges Fiol and Mr. Heliodoro Enrique Galván Castro incorporated the company Cienfuegos Eco Rancho Limitada—hereinafter CIENFUEGOS—which was assigned corporate identification number 3-102-237715. On 14 de julio of that year, Mr. Borges Fiol, in his capacity as manager of CIENFUEGOS, applied to Municipalidad de Orotina for a tourism-project permit.
That municipal government granted it. The project included a restaurant, trails, lodging units, and multipurpose courts. By letter dated 14 de julio de 1999 and addressed to that Local Government, don Juan Diego and doña Kattia María, in their capacity as lessors and owners of property folio 293.864, expressed their consent to the business-license application filed by CIENFUERGOS. In a letter dated 16 de julio de 1999, don Pedro Adrián, in the capacity already stated, requested that Instituto Costarricense de Turismo—ICT—approve the corresponding tourism agreement. As stated in that letter, the project was an agroecological-development option offering a wide variety of recreational areas and facilities, such as a restaurant, equestrian center, multisport complex, gymnasium, bullring, ecological trails, and hotel, based on a sustainable model for developing vacation lodging units. By public deed executed on 31 de mayo de 1999, don Juan Diego and doña Kattia María incorporated the company called Juvakasa Oro Sociedad Anónima—hereinafter JUVAKASA—with corporate identification number 3-101-244145.
At 10 hours on 27 de julio de 1999, an extraordinary general shareholders’ meeting of CIENFUEGOS resolved to authorize shareholder Pedro Adrián Borges Fiol to sell JUVAKASA 10 common ownership interests or registered certificates called “Common Series A,” which he owned and which were identified by numbers 01 through 10, for a value of ₡2.000.000,00 each, totaling ₡20.000.000,00. It was stated that the purchasing company would pay the price with a first-ranking mortgage certificate valued at ₡20.000.000,00, issued in favor of the purchasing company’s legal representatives and duly endorsed to the company they represented, which, in turn, endorsed it to the selling company. It was indicated that the certificate was past due and secured by the property recorded in the Registro Público, Alajuela registry district, under folio number 293.864. It was further indicated that the property was subject to IDA restrictions—Ley no. 2825—and reservations under the Ley de Aguas and Ley de Caminos.
The mortgage certificate also secured obligations owed to BCR in the approximate amount of ₡4.800.000,00, and the purchasing company and its attorneys-in-fact undertook to obtain its release, which the seller accepted. Mr. Vargas Soto and Ms. Salas Castro were present at that Meeting. On an unspecified date, Municipalidad de Orotina granted a business license to Proyecto Turístico CIENFUEGOS. On 12 de julio de 1999, Ministerio de Salud granted a one-year health operating permit to the establishment called CIENFUEGOS ECO RANCHO, located in La Ceiba de Orotina. On 21 de julio de 1999, CIENFUEGOS obtained an occupational-risk insurance policy for hotel and cabin operations in Orotina. During the months of January, February, March, April, June, July, and August, all in the year 2001, electricity bills issued in CIENFUEGOS’s name were paid. The company also paid for services provided by Acueducto Salinas I during the months of May, June, September, and August, all in the aforementioned year 2001.
By letter dated 21 de junio de 2001, Mr. Borges Fiol offered to sell don Juan Diego and doña Kattia María, representatives of JUVAKASA, 89 ownership interests in CIENFUEGOS, as well as the sole ownership interest held by Mr. Eliodoro Enrique Galván Castro. On 22 de enero de 2002, Mr. Vargas Soto and Ms. Salas Castro filed an eviction action (demanda de desahucio) against BLINKY on the ground that the term had expired; however, the action was dismissed. Letter number OSO-180-2002 of 6 de febrero de 2002, issued by the Head of the IDA’s Orotina Subregional Office, certified that don Juan Diego and doña Kattia María had neither applied for nor obtained authorization to lease parcel 48-1 of the Salinas I settlement, folio 293.864-001-002.
On 18 de febrero of that year, Mr. Borges Fiol, as attorney-in-fact (apoderado) for CIENFUEGOS, filed a complaint for the crime of fraud (estafa) against Mr. Juan Diego and Ms. Kattia María, both in their personal capacities and as attorneys-in-fact for JUVAKASA. This proceeding was processed under expediente no. 02-200022-553-PE. By means of official letter number OSO-177-2003 of 13 de febrero de 2003, IDA issued a single warning (amonestación única) to Juan Diego Vargas Soto and Kattia María Salas Castro for indirect exploitation (explotación indirecta) of parcel no. 48-1 in Asentamiento Salinas 1. They were advised that, within 10 days, the alleged violations of Ley no. 2825 had to cease and that they had to come into compliance with the law. They were warned that proceedings could be brought against them, which could result in the loss of the award (adjudicación) and the subsequent extinguishment of their right to the parcel.
In a document dated 4 de marzo of that year, Mr. Juan Diego and Ms. Katia María opposed the warning. In an official letter filed that same day—4 de marzo de 2003—with the Board of Directors of IDA, they requested the intervention of that Institute so that they could enter parcel 48-1. In a public deed (escritura pública) executed on 10 de noviembre de 2005, Mr. Juan Diego and Ms. Kattia María, as owners of property registration 293864, requested cancellation of the mortgage certificates (cédulas hipotecarias), thereby releasing the aforementioned property from that encumbrance. In a document filed with the Orotina Subregional Office of IDA on 17 de noviembre de 2005, Ms. Kattia María Salas Castro requested that the warning concerning the indirect exploitation of the aforementioned parcel 48-1(A) be permanently closed. In a document filed on 14 de diciembre de 2005 with the Executive Presidency of IDA, Mr.
Borges Fiol requested the initiation of proceedings to revoke the award and annul the title (nulidad de título) against Mr. Juan Diego and Ms. Kattia María. By means of an official letter dated 18 de octubre de 2006, signed by the head of BCR in Orotina, it was reported that the security instrument for credit transactions 303-824 and 846—the mortgage certificate—had been delivered to Mr. Juan Diego Vargas Soto, without specifying the date.
II.On 10 de abril de 2002, Mr. Juan Diego Vargas Soto and Ms. Kattia María Salas Castro filed this ordinary proceeding (proceso ordinario) against Julia Ibarra Seas and Pedro Adrián Borges Fiol, both personally and as representatives of BLINKY and CIENFUEGOS, seeking principally a judgment declaring that they are the lawful owners of the property recorded in the Public Registry, Alajuela section, registration number 293.864, interests 000, 001 and 002. Before the dispossession (despojo), they exercised all ownership rights (atributos del dominio) over that property; therefore, they are not merely its registered owners but its actual owners, whereas the defendants are unlawful possessors (poseedores ilegítimos). The property unlawfully possessed by the defendants is the same property they claim as their own. The defendants’ unlawful possession (posesión ilegítima) is in bad faith (mala fe). Because they acted in bad faith, they should be denied any right to improvements (mejoras) and fruits (frutos), as well as any right of retention (derecho de retención) over the property.
They further request a declaration that payment for improvements is inadmissible because of the IDA restrictions to which the estate (heredad) is subject and of which the defendants are aware. They request that the defendants be ordered to restore the property to them; if the defendants do not do so voluntarily, the plaintiffs should be placed in possession by judicial order so that they may enjoy all ownership rights. They also request that the defendants be held jointly and severally liable (de forma solidaria) for the damages and losses (daños y perjuicios) caused, which they quantify as follows: A. DAMAGE:
III.The representative of INDER filed a counterclaim (contrademanda) against Mr. Juan Diego and Ms. Kattia María. He requested a declaration that the property registered in the Province of Alajuela under folio 293.864-001-002 is subject to the restrictions of Ley no. 2825 for a period of 15 years, running from May 25, 1995 through May 25, 2010, which renders it public-domain property (bien demanial) and, therefore, outside private commerce (fuera del comercio de los hombres). The counterclaim defendants (reconvenidos), who were awarded parcel no. 48-1 of Asentamiento Salinas 1, neither exploit nor work it. Illegal contracts exist, entered into without the authorization required by law, thereby changing the uses and purposes for which it was granted. They abandoned it by allowing it to be worked and exploited indirectly and illegally by Mr. Pedro Adrián Borges Fiol and Ms. Julia Ibarra Seas, both personally and on behalf of the companies they represent, respectively, CIENFUEGOS and BLINKY, whose possession is therefore unlawful because they lack the authorization of the entity he represents.
Mr. Vargas Soto and Ms. Salas Castro, as well as Mr. Pedro Adrián and Ms. Julia, both personally and on behalf of the companies they represent, conducted transactions without the Institute’s knowledge, even though authorization from its Board of Directors was required before any transaction could take place. The contracts entered into by Mr. Juan Diego and Ms. Kattia Matía with Mr. Pedro Adrián and Ms. Julia, both personally and on behalf of the companies they represent, are null and void by operation of law (nulas de pleno derecho), as provided by section 67 of the Ley de Tierras y Colonización of October 14, 1961. A breach of the obligations, conditions, and restrictions contained in sections 66, 67, and 68 thereof causes the awardees (adjudicatarios) to lose their right to the parcel awarded to them. In light of all the alleged violations and unlawful acts, he requests revocation of the award (adjudicación) made by IDA, through a resolution of its Board of Directors, in favor of Mr.
Juan Diego and Ms. Kattia María. Consequently, he requests cancellation of the registration in their names of property folio 293.864-001-002 and reversion of the property to the Institute, together with an order evicting them and any other person occupying the property. Regarding improvements (mejoras), the unsuccessful parties, or anyone who proves in court to be their owner, may remove the movable improvements, while only those other improvements that are useful and necessary for development of the parcel and were paid for with their own funds must be compensated, as shall be determined in the corresponding enforcement proceedings (proceso de ejecución). He requests cancellation in the Public Registry of any notice ordered by the judicial authority in this litigation (lite) that encumbers property folio 293.864-001-002. Since it has been established in these proceedings that the principles of the Ley de Tierras y Colonización were violated while the statutory restriction period remained in effect, he requests that the filing of this action be deemed to have interrupted the limitation period (prescripción).
He requests that the unsuccessful parties be ordered to pay, in their respective proportions, both costs and attorneys’ fees (ambas costas) arising from this counterclaim; otherwise, the entity he represents should be exempted from their payment because its actions were in accordance with law. Subsequently—folio 725 of the main case file, Volume II—he clarified that the contracts described as illegal are those that gave rise to the present dispute: the lease agreement (contrato de arrendamiento) (folios 176 to 178), the transfer of shares (traspaso de acciones) purportedly involving parcel number 48-1 of Asentamiento Salinas 1, and the purported sale alleged by the defendants in their response to the original complaint, which purportedly forms the basis for their continued possession of the property, all of which would be null and void. INDER expanded its counterclaim against Julia Ibarra Seas and Pedro Adrián Borges Fiol, personally and as representatives, respectively, of BLINKY and CIENFUEGOS.
It requests the same relief, as well as a declaration that the contracts—the lease and transfers of shares involving the parcel—entered into by Mr. Juan Diego and Ms. Kattia with Mr. Pedro Adrián and Ms. Julia, both personally and on behalf of the companies they represent, respectively, CIENFUEGOS and BLINKY, are null and void by operation of law. Likewise, should these proceedings establish that the property was transferred or sold, it requests that such transfer or sale be declared null and void pursuant to article 67 of Ley no. 2825. INDER also filed a counterclaim against JUVAKASA, requesting a judgment upholding the counterclaim upon confirmation of the awardees’ breach of the obligations imposed upon them, which constitutes sufficient grounds for loss of their right to the property registered under folio 293864-001-002, corresponding to parcel number 48-1(A) of the rural settlement (Asentamiento campesino) known as Salinas 1.
That property was granted by the former IDA under a special agreement, namely a land-allocation agreement (contrato de asignación de tierras), and remained subject to the limitations—obligations, conditions, and restrictions—of the Ley de Tierras y Colonización and its amendments. It is subject to the restrictions of Ley no. 2825 for a period of 15 years, running from May 25, 1995 through May 25, 2010, which gives it the status of public-domain property and therefore places it outside private commerce. The awardees of parcel no. 48-1, personally and on behalf of the company they represent, JUVAKASA, neither exploit, cultivate, nor work it and have physically and permanently abandoned it for more than 10 years. They have also allowed it to be worked, cultivated, and exploited indirectly and illegally by Pedro Adrián Borges Fiol and Julia Ibarra Seas, both personally and on behalf of the companies they represent, respectively, CIENFUEGOS and BLINKY, who have changed the uses and purposes for which it was granted by erecting lavish structures and developing ecotourism projects; their possession is unlawful because they lack authorization from the Institute.
Mr. Juan Diego and Ms. Kattia, both personally and on behalf of the company they represent, JUVAKASA, as well as Mr. Borges Fiol and Ms. Ibarra Sea, both personally and on behalf of the companies they represent, entered into leases, transferred shares, and conducted transactions involving the mortgage certificate (cédula hipotecaria) and this parcel; they also carried out construction and other work on it and developed ecotourism projects without the Institute’s knowledge or the required authorization from its Board of Directors. They likewise conducted transactions without the necessary permission, even though authorization from the Board of Directors was required before entering into any contract involving the disputed parcel. The contracts—including the lease, the transfers of shares involving the parcel, and payment with the mortgage certificate—entered into by Mr. Juan Diego and Ms.
Kattia María with Mr. Pedro Adrián and Ms. Julia, both personally and on behalf of the companies they represent, respectively, JUVAKASA, CIENFUEGOS, and BLINKY, are null and void by operation of law. Likewise, should these proceedings establish that the property was transferred or sold, such transfer or sale is also null and void, as provided by article 67 of Ley no. 2825. A breach of the obligations, conditions, and restrictions contained in that legislation causes the awardees to lose their right to the parcel awarded by the Institute, requiring revocation of the award and cancellation of the deed of ownership (título de propiedad), with the disputed property reverting to IDA, now INDER. As a consequence of all the alleged violations and unlawful acts, it requests the eviction of the defendants and any other person occupying the property without authorization from the Institute. Regarding the improvements, the unsuccessful parties, or anyone who proves in court to be their owner, may remove the movable improvements, while only those other improvements that are useful and necessary for development of the parcel and were paid for with their own funds must be compensated, as shall be determined in the corresponding enforcement proceedings, pursuant to the second paragraph of section 66 of the Ley de Tierras y Colonización.
It requests cancellation in the Registry of any notice ordered by the judicial authority in these proceedings that encumbers the disputed property. Since the restrictions remained in effect when this counterclaim was filed, and since it has been established in this litigation that the legal principles of the Ley de Tierras y Colonización were violated, the expiration of those restrictions should be deemed interrupted by operation of law. It requests that the unsuccessful parties be ordered to pay, in their respective proportions, both costs and attorneys’ fees arising from this action. Otherwise, the entity it represents should be exempted from their payment because its actions were in accordance with law. The defendants and counterclaim defendants Julia Ibarra Seas, Pedro Borges Fiol, CIENFUEGOS, and BLINKY opposed the relief sought in the counterclaim. They raised defenses (excepciones) based on lack of a legal right, present interest, cause of action, standing to sue, and standing to be sued.
They also invoked the general plea “sine actione agit.” Likewise, the plaintiffs and counterclaim defendants opposed the relief sought in the counterclaim. They asserted defenses based on lack of a legal right, present interest, and standing. They raised the defenses of extinctive prescription (prescripción negativa) and forfeiture through expiration (caducidad). The forfeiture defense was decided on an interlocutory basis (interlocutoriamente) by an order entered at 15 hours 41 minutes on June 22, 2007. For its part, JUVAKASA, as a counterclaim defendant, raised the defenses of extinctive prescription and forfeiture through expiration.
IV.Insofar as relevant, the trial judge (juzgadora A quo), with regard to the complaint against Pedro Borges Fiol, Julia Ibarra Seas, CIENFUEGOS, and BLINKY, rejected the defenses (defensas) of lack of legal right, present interest, and standing to sue and be sued (legitimación activa y pasiva), as well as the generic plea “sine actione agit.” She denied the principal claims in all respects. She granted the first alternative claim (pretensión subsidiaria primera) solely to deny the defendants any right to improvements, fruits, or payment for improvements. Likewise, she granted the second alternative claim, but only insofar as the lease agreement (contrato de arrendamiento) entered into between BLINKY and the plaintiffs concerning the disputed parcel is void because it lacked authorization from the then IDA, since the restrictions under the Ley de Tierras y Colonización remained in effect. She ruled without an award of costs.
With respect to the complaint against the IDA, now INDER, she upheld the defenses of lack of legal right and standing. She declined to rule on the generic plea “sine actione agit,” stating that it was encompassed within the foregoing defenses. Consequently, she denied the complaint in all respects. The matter was resolved without an award of costs. With regard to the counterclaim (contrademanda) filed against Juan Diego Vargas Soto, Kattia María Salas Castro, Julia Ibarra Seas, and Pedro Adrián Borges Fiol—the latter two in their personal capacities and as representatives of CIENFUEGOS and BLINKY—she rejected the defenses of statute of limitations (prescripción), expiration (caducidad), and lack of a cause of action, legal right, present interest, and standing to sue and be sued, as well as the generic plea “sine actione agit.” Consequently, she partially granted the counterclaim on the following terms:
V.In his first claim of error, at folio 4, the appellant refers to the motion to submit an untimely document (incidente de presentación de documento extemporáneo). He asserts that it cannot be rejected for the reasons stated in the judgment. Judgments, he states, must resolve every issue submitted to the judge. He notes that the appellate court acquired jurisdiction over this dispute in accordance with the grounds of error raised by the parties in their appeals. Among the objections set forth in the appeal, he states, he argued that the motion concerning untimely documents could not be rejected for the reasons given in the judgment, because those documents were essential to resolving this matter. In his view, the challenged judgment failed to address this ground of error, thereby violating the rights of defense and due process and rendering the decision void, because, he insists, not all the grounds of error presented to the Court were resolved.
He argues that the motion was filed because the documents are closely related to the matter to be proved (thema probandum), since, he adds, they demonstrate that the field recommendation was to lift the restrictions and that the Legal Department also recommended lifting them. It is evident, he asserts, that the evidence offered is connected to the subject matter of the proceedings. He therefore concludes that the judgment must be vacated because the documentary evidence offered is essential to resolving this case.
VI.The crux of the allegation in this challenge lies in the fact that, in the appellant’s view, the grounds for grievance set forth in the hierarchical appeal (recurso vertical) asserted that the motion to admit untimely documents (incidente de documentos extemporáneos) could not be denied for the reasons given in the A quo judgment, since they were essential to resolving this dispute. However, “The second-instance judgment makes no reference to this grievance, which violates the rights of defense and due process, whihc [sic] renders the judgments [sic] null and void, since it did not resolve all the grievances that were brought [sic] before the Tribunal, and I therefore request that the judgment be annulled.” If the cassation appellant’s argument were borne out, it would constitute a ground for cassation (motivo casacional) based on procedural grounds. Specifically, the defect of incongruence (vicio de incongruencia). In this regard, it should first be noted that the labor-procedure reform introduced through Ley no. 9343 del 25 de enero de 2016 has been in force since el 25 de julio de 2017. Transitional provision I states: “This reform shall apply to proceedings commenced before the entry into force of this law, subject to the following exceptions: /
VII.Along these lines, regarding the propriety of alleging before this Chamber procedural violations in agrarian matters under the prior procedural legislation, such as the one invoked by the cassation appellant, this adjudicative body has stated: “V.- […] beginning with judgment 583 at 11:35 a.m. on el 14 de julio del 2004, as subsequently reiterated in, among others, judgments 608 at 9:10 a.m. on el 23 de julio, 1074 at 11:20 a.m. on el 16 de diciembre, both of 2004, and 892 at 9:00 a.m. on el 25 de noviembre del 2005, this Chamber determined that a cassation appeal on that ground was admissible in agrarian matters under certain circumstances. In this regard, article 559 of the Código de Trabajo, applicable to this type of proceeding by express reference in provision 61 of the Ley de Jurisdicción Agraria, provides: ‘CASSATION APPEAL. SUMMARY DISMISSAL. Upon receipt of the case file, the Chamber shall summarily dismiss the appeal if it was filed in contravention of articles 556 and 557.
It shall do the same when the appeal seeks solely the correction, reinstatement, or performance of procedural steps.’ (Emphasis not in original). With respect to this matter, the second part of the provision under discussion is relevant. Procedural-law scholarship has indicated that the grounds for cassation established in provision 594 of the Código Procesal Civil may arise during three stages of a proceeding:
VIII.In recital III (considerando III) of her judgment, the A quo judge stated: “III. MOTION TO ADMIT AN UNTIMELY DOCUMENT: At folio 2085 of the principal Volume VI, a document filed by plaintiff and counterclaim defendant Juan Diego Vargas Soto appears in the record. It is a copy of judgment number 30 at 14:30 hours on el 22 de marzo de 2010, issued by the Juzgado Tercero Civil de San José in case number 09-000022-182-CI. That party does not clearly state the relief sought through the motion in connection with the filing of this document; therefore, pursuant to article 483, subsection 1), of the Código Procesal Civil, this motion is denied. […]” For its part, the Ad quem stated the following, insofar as relevant, in section IV of the challenged judgment: “IV. […] Juan Diego Vargas Soto filed a separate appeal. […] II. The motion to admit untimely documents cannot be denied for the reasons set forth in the judgment.
Documents related to the subject matter of proof (tema probandum) were submitted through that motion, as they confirm the field recommendation to remove the restrictions. This denial must be challenged because the documentary evidence offered is essential to resolving the matter.” The judges then held in recital V: “V. The appeal filed by plaintiff and counterclaim defendant Juan Diego Vargas Soto shall be decided first. The issue concerns the motion based on new facts (incidente de hechos nuevos), which was denied in the judgment; he considers that the documents offered by that party are relevant to deciding the matter. He says that it should be granted [sic] because these documents analyze matters concerning the removal of the restrictions. However, the denied motion relates to copies of two judgments issued in the ordinary proceeding brought by Cien Fuegos Rancho Limitada against Juan Diego Vargas Soto, under number 09-000022-182-CI, processed before the Juzgado Tercero Civil de San José.
The first judicial decision is the first-instance decision at 14:30 hours on el 22 de marzo de 2010, which declared that proceeding abandoned (Escritorio virtual Juzgado Agrario de Alajuela, associated-document archive, volume VI, images of folios 2079 to 2084). The other is the second-instance decision, which declared that the appeal against that ruling had been improperly admitted. Article 293 of the Código Procesal Civil, which applies supplementarily, contains a list setting forth the grounds on which an untimely document may be admitted. The complainant’s [sic] argument is that they postdate the filing of the complaint; however, this is not relevant to resolving the matter, nor is it supplementary evidence or evidence intended to rebut the defenses. A reading of those documents establishes only the existence of a proceeding, without showing that it bears a direct relationship to the matter disputed here.” (Emphasis in original).
In light of the foregoing quotations, and contrary to the appellant’s assertion, the Tribunal did rule on the grievance challenging the denial of the motion to admit untimely documents; consequently, the alleged error did not occur. Moreover, the cassation appellant did not challenge the grounds relied upon by the Tribunal in denying admission of the judgments submitted out of time. He merely reiterated the arguments made in the appeal. Therefore, the alleged violations of the principle of due process and, specifically, of the right of defense did not occur because, contrary to the appellant’s interests, the Tribunal did, as noted, resolve the objection raised in the appeal. Consequently, the ground of disagreement under review must be rejected.
IX.In the second claim, page 6, the appellant alleges an error of fact in the assessment of the evidence. He states that an allotment cannot be revoked for an alleged breach by the parcel holder (parcelero) if the restrictions had expired and the obligations had been fulfilled. Regarding administrative delay (morosidad administrativa), he notes that the judgments under appeal adopt a formalistic, exegetical interpretation of the rules, without a systematic, substantive, evolutionary interpretation adjusted to the reality reflected in the evidence in the record. He says that administrative delay is recognized in the legal opinions of the IDA—now INDER. He adds that the Board of Directors has even ordered the lifting of restrictions based on administrative delay. He notes that the challenged judgments disregarded this, as though it were not a practice consistently applied by that Institute. In his view, they merely conduct a formal analysis of the law and the information recorded in the Registry, without assessing the substance of his actual situation as reflected in the evidence in the record.
He argues that an initial allotment (adjudicación primaria) is not the same as a transfer of an allotment (traspaso de la adjudicación). No parcel was allotted to him; rather, a parcel was transferred to him in exchange for payment for the improvements (mejoras). He states that, upon acquiring the allotment already granted, he assumed the legal position of the transferors: obligations, time elapsed, remaining restrictions, etc. He says that he only had to complete the remaining term for the restrictions or limitations to expire. He asserts that the rules governing an initial allotment cannot be applied to him because his legal position did not arise “ex novo,” but was derivative. Consequently, he adds, the transferors’ legal position was assigned to him. Neither he nor his wife was subject to a probationary period for determining whether the parcel would be allotted to them. On the contrary, he states that when he acquired the property with its existing legal history, the terms of the restrictions had begun in 1981; therefore, when he acquired it, he received the benefit of the time that had already elapsed for his transferor.
He explains that the transfer occurred as follows: pursuant to a resolution of the Board of Directors, Article XVI of session no. 2450 of 3 March 1981, parcel no. 48 was allotted to Mr. Dagoberto Rojas Fallas. He argues that on 11 June 1983, under Article XII of session no. 122, the Board of Directors authorized its division into two parcels, creating parcels numbers 48-l(A) and 48-2(B), and allotted no. 48-1(A) to Ubaldo Rojas Fallas. He continues that on 11 June 1984, under Article IX of session no. 399, the Board of Directors authorized the transfer of parcel 48-1 from Ubaldo Rojas Fallas to him, Juan Diego Vargas Soto. The IDA transferred that parcel to him, and the transfer was executed by deed on 25 May 1995 in his name and that of his wife, Kattia Salas Castro, in equal shares (although the improvements were acquired solely by him, the law required the transfer to be made in favor of the married couple).
It was recorded in the Public Property Registry under registration number 293.864-001-002. He emphasizes that the administrative delay is evident because the parcel at issue—no. 48-1(A)—was allotted in 1981 but was not conveyed by deed until 1995, even though it had been transferred to him in 1984. He notes that, according to the Registry but not as a matter of law, the property is subject to the restrictions established by the Ley de Tierras y Colonización, Law no. 2825 of 14 October 1961. It was allotted on 3 March 1981 and transferred on 11 June 1984, meaning that 26 years had passed since the allotment. He observes that this demonstrates the administrative delay and negligence of the IDA (INDER), because the Asociación de Productores de Trinidad de Uvita had repeatedly requested the lifting of the restrictions since 24 July 1998. He explains that in approximately the year 2000, he again requested the lifting of the restrictions and completed all the necessary procedures at the Regional Office.
Indeed, he recounts that the Regional del Pacífico Central in Coyolar, through its technical personnel, assessed the parcel’s condition at that time and determined that there had been administrative delay and that he met the requirements established by the Institution for lifting the restrictions. He maintains that, in view of the conditions of parcel no. 48-1(A) in the Salinas 1 settlement (asentamiento), the legal opinion of the Regional del Pacífico Central recommended releasing it from the restrictions due to the administrative delay of the IDA (INDER). He finds it surprising that, in the counterclaim (reconvención) filed by the IDA (INDER), its legal representative, acting as the Institution’s manager, forwarded to the Board of Directors, with his approval, the recommendations of the Regional del Pacífico Central in Coyolar that the restrictions on the parcel in question be lifted, as shown in the administrative record.
He maintains that, when the events giving rise to this dispute occurred, the property was no longer legally subject to restrictions; they appeared only in the Registry as a formal matter because they had long since expired. Nor, he adds, were there any outstanding obligations to the Institute. He asserts that the Procuraduría General de la República—PGR—determined that the term of the restrictions begins to run from the date of the allotment. He calculates that, if the parcel was allotted on 3 March 1981, the restrictions expired on 3 March 1996. He states that this opinion is the legal basis on which the IDA (INDER) has lifted restrictions on beneficiaries due to administrative delay in every case. He argues that the challenged judgments disregard the opinions of the PGR, as well as the administrative practice that has developed in the INDER in similar cases. Furthermore, he continues, they incorrectly assess the evidence and misapply the law because they fail to recognize that his acquisition and that of his wife were derivative, instead treating them as original acquisitions and thereby depriving them, to their detriment, of more than 10 years of the allotted term.
Based on the foregoing and in observance of the constitutional principle of equality, he asserts that no restriction burdened the property when they leased the house built on it; consequently, the IDA (INDER) lacks a right, a current interest, and standing (legitimación). He insists that the challenged judgments improperly assessed the evidence and misapplied substantive law by finding that there had been a new allotment when that was not the case, as the evidence presented does not establish this. He has undergone probation. He alleges that, since acquiring the parcel, he has made it productive, and his title was never subject to a probationary period. He states that the parcel has been free of restrictions since 3 March 1996. Whenever an act of disposition (acto de disposición) was to be carried out, authorization was requested from the Board of Directors. When the livestock project financed by the Banco Popular y de Desarrollo Comunal—BPDC—through the Asociación de Productores de la Trinidad y Uvita was undertaken, he notes, the corresponding authorization was requested.
Likewise, he adds, when the mortgage procedures were carried out, the Board of Directors authorized them. During that transitional period, he states, the IDA empowered them to take any necessary action so that they would not lose the parcel as a result of the mortgage granted by the Sistema Bancario Nacional. They also explain that they requested the corresponding authorization from the Regional Office to lease only the dwelling. He indicates that the foregoing is made clear by the witnesses’ testimony, which corroborates what was stated from the outset of these proceedings; the judgment cited them but did not properly assess their testimony. The witness Leonel Alpízar Solórzano (page 1557 of scanned volume V) stated that he works as Regional Head of the IDA (INDER) in Orotina. He said that he knew the parcel. He visited it for inspections when he provided technical assistance. He has worked at the Institute since 1982.
He has not visited the parcel since approximately 2002. The appellant reports that the witness was emphatic that he did not authorize the lease of this parcel. He recalls that don Juan Diego applied for the lifting of the restrictions but does not know the outcome. The appellant argues that he acknowledged that the lifting of the restrictions was sought on the ground of administrative delay, which in turn serves as the basis for lifting restrictions on other parcels. In any event, he states, the restrictions had already expired, and the only remaining requirement was the formality of removing them from the Registry; however, the term for lifting them had elapsed, and there were no outstanding obligations to the Institute. For his part, the witness Juan Abarca Chacón (page 1560 of scanned volume V) said that he was a parcel holder in the settlement and had known the parcel at issue for 20 years.
He personally knew that don Juan Diego grew chili peppers, papayas, tomatoes, and sweet peppers. He stated that, around the year 2000, he worked as a laborer for don Pedro. He did not know what business arrangement existed between don Pedro and don Juan Diego. Likewise, he states, the witness Gerardo Muñoz Romero (page 1561, volume V) described the acts of possession (actos posesorios) performed by don Pedro Borges on the parcel in late 1998 or early 1999. He did not know what relationship don Pedro had with don Juan Diego Vargas, but he knew that don Pedro was on the property. The witness had known the property since 1990 or earlier, had lived in the area since that year, and lived near the parcel. He attested to the crops planted by don Juan Diego and to the fact that don Juan Diego lived on the parcel. He stated that, beginning in late 1998 or early 1999, don Juan Diego moved to Orotina and that he then saw don Pedro move onto the parcel, although don Juan Diego continued cultivating it.
He also mentioned the structures that existed on the property. The appellant notes that the witness Constantino Mondragón Medrano (page 1529 of volume V) stated that he worked at the IDA until approximately 1998. He drafted a memorandum concerning the lease of the house (only the house), but it was not signed. He did not see the formal application. He does not know what happened to that document. He says that don Juan Diego submitted it. The appellant indicates that the foregoing demonstrates that he requested authorization after being advised by the Institute’s own officials. He notes that, as a farmer, he does not know why the request was not processed. He understood that the steps he had taken authorized him to act and enter into the lease. If that was not the case, he did not understand that he lacked authorization. In any event, he states, authorization was unnecessary because the restrictions had expired, an issue that was not analyzed in the challenged judgment.
He maintains that the authorization required by law was requested even though the restrictions had expired. They must be calculated from the only allotment that occurred, which was made in favor of Dagoberto Rojas Fallas; moreover, there were no commitments or obligations owed to the Institute. He insists that the IDA (INDER) requested revocation of the parcel even though the restrictions had already expired as a result of its own delay. In his view, this is nothing more than an attempt to benefit from its own willful misconduct because, despite knowing that it is in default and that the restrictions have expired, it relies on its own delay to request revocation. He asserts that this unacceptable situation is endorsed by the challenged judgments, which adopt a formalistic assessment contrary to the principles underlying Agrarian Law (Derecho Agrario). He reiterates that the restrictions had expired, yet authorization was nevertheless requested despite being unnecessary.
He states that there has been no breach of his obligations and no unlawful contracts. If he did not directly work the parcel at issue, he states, it was because he had been unlawfully dispossessed (despojado ilegítimamente). He has been unable to exploit or work the parcel in any manner because, with the consent and indifference of the IDA, don Pedro Borges Fiol and doña Julia Ibarra Seas prevented him from approaching his property and turned it into a fortress with heavy weapons and guards everywhere. The argument concerning administrative delay set forth in the challenged judgment is not accepted.
He transcribes, insofar as relevant, the findings of the A quo judge in recital VIII of her judgment. Likewise, he reproduces, as pertinent, the statements made by the Ad quem in recital V. He argues that the reasoning for rejecting administrative delay (morosidad administrativa) cannot be sustained for the following reasons:
X.The formulation of the grievance (agravio) under review is unclear. Nevertheless, following a detailed analysis, this Chamber determines that the central argument involves two points: 1) parcel no. 48 of the Salinas 1 settlement was awarded by the Board of Directors of the then IDA, on 3 de marzo de 1981, to Mr. Dagoberto Rojas Fallas. On 11 de junio de 1983, it authorized him to divide it, thereby creating parcels 48-1(A) and 48-2(B). Parcel no. 48-1(A) was awarded to Ubaldo Rojas Fallas. On 11 de junio de 1984, the Board of Directors authorized its transfer to him, Juan Diego Vargas Soto. However, the deed was not formalized until 25 de mayo de 1995. Consequently, his acquisition was derivative, not original. He therefore benefits from the period accrued by the previous allottee (Dagoberto Rojas Fallas). The evidence was improperly assessed and the law was erroneously applied by treating his award (adjudicación) as a new one when, in fact, it was derivative.
If the award was made on 3 de marzo de 1981, the restrictions expired on 3 de marzo de 1996. Although their removal had been requested, the Administration failed to remove them, thereby incurring administrative delay (morosidad administrativa). 2) The doctrine of positive administrative silence (silencio positivo) applies to this litigation (lite) with respect to the request for authorization to remove the restrictions. However, this is immaterial or irrelevant because the restrictions had already expired.
XI.The appellant in cassation (casacionista) alleges an error of fact (error de hecho) in the assessment of the evidence. However, according to the grounds for the objection, what is alleged is not merely material error in the appraisal of the evidentiary record, but rather its improper assessment, which, if established, would give rise to a defect consisting of an indirect violation of law, but due to an error of law (error de derecho). For a full understanding, it is necessary to reproduce, insofar as relevant and despite its length, what the appellate court (Ad quem) stated in recitals (considerandos) VI, VII, and VIII of the challenged judgment. “Regarding the grievance concerning administrative delay, the appellant is partially correct, although this is insufficient to modify the decision in its entirety, for the reasons explained below. This Chamber is of the view that the period of limitations under land-allocation contracts begins to run upon issuance of the administrative act of allocation (acto administrativo de adjudicación).
In other words, it begins when the Board of Directors of the Instituto de Desarrollo Rural, hereinafter identified as INDER or the Institute, grants the parcel to the administered persons (personas administradas). Note that section 65 of the Ley de Tierras y Colonización establishes the distinction indicated above: first, the allocation act (acto de adjudicación) is issued, and then title to the property is granted. In the case under review, the disputed property (fundo en litis) had been allocated by INDER to a third party. In 1986, the agreement of the Board of Directors of the Institute in question was issued—agreement 9, Article IX of session number 399, held on 17 de junio de 1986—which is contained in official letter ORCC-754-86 dated 29 de diciembre de 1986, addressed to appellant Vargas Soto. Insofar as relevant, it states: ‘...the transfer to you of parcel N°48-A, in Asentamiento Salinas, allocated to Mr.
UBANDO [sic] ROJAS FALLAS, was approved’ (emphasis in the original in Escritorio virtual Juzgado Agrario de Alajuela, associated-document file, volume IV, image of folio 1220). It therefore follows that, irrespective of the date on which the public instrument (instrumento público) permitting registration of the disputed property in the Registro Nacional was executed, the limitation period began on 17 de junio de 1986. In support of the foregoing position, the Sala Primera de la Corte Suprema de Justicia, in decision number 275-S1-F-2011 at 09 hours 10 minutes on 17 de marzo de 2011, explained: […] As the High Chamber notes, the public instrument consummates the agreement adopted by the Board of Directors. In this matter, it was also established that the public deed (escritura pública) was executed before Notary Public […] at 16 hours on 25 de mayo de 1995, as shown by the copy of the certified deed (testimonio de escritura) in volume I, images of folios 33 to 34.
Nevertheless, as indicated, the 15-year limitation period began on 17 de junio de 1986; consequently, upon calculating the period, the limitations expired on 17 de junio de 2001, and not on 25 de mayo de 2010 as stated in the registry information contained in the certifications at folios 357 and 360 in the images of volume II of the case file, based on section 140 of the Ley General de Administración Pública. The other matter that must be clarified in light of the grievance is how to proceed when faced with a situation such as the one described, in which there is a significant time difference between the allocation act and registry registration (inscripción registral). Because this is an administrative act whose implementation entails a time difference detrimental to the rights of the administered person, the registry information must be amended or made retroactive so that it coincides with the administrative act.
The party authorized to do so in this case is the Institute itself. The administrative body must carry out the appropriate procedures, and the resulting amendment [sic] must be registered in the Registro Nacional to provide the corresponding public notice through the registry (publicidad registral). It must be emphasized, however, that the administered person cannot de facto amend the registry information. Until that person obtains a judicial or administrative decision expressly stating the actual limitation period, that person must continue complying with the obligations undertaken under the land-allocation contract. In addition to the foregoing, INDER has identified and clarified this situation, as it has been acknowledged in various documents containing legal opinions cited by the parties; these, in turn, incorporate opinions of the Procuraduría General de la República that are binding upon the Public Administration.
Official letter AJORO 65 of 07 de julio de 2003, signed by attorney […] in his capacity as legal-affairs adviser for the Región Pacífico Central, appears in the record and cites opinion C-072-2001 of the state’s legal representative. Insofar as relevant, it highlights a portion of the consultation from which it follows that the omission must be remedied through indisputable evidence of when the allocation act may have occurred. At the same time, the aforementioned professional explained: ‘...it is the Institute’s responsibility to verify such facts on the basis of the technical opinions issued in each case....’ Accordingly, the administered person must carry out the appropriate procedures to adjust the limitation periods recorded in the Registro Nacional. In this case, the application to lift the limitations (levantamiento de las limitaciones) appears in an official letter signed by the appellant, but in his capacity as President of the Asociación de Productores Trinidad y La Uvita, dated 24 de junio de 1998, in which he requested: ‘Please accept this letter as our request for the removal of the limitations appearing [sic] in our deeds, which were granted many years after the allocation of the Salinas uno lands....
We request this removal because Salinas uno is [sic] located in the area designated for industrial use, and this presents us with circumstances different from those of the agricultural sector....’ (appearing in image 4 of evidentiary file V). It may be inferred from the foregoing that the appellant knew he had to complete a procedure to lift the restrictions in question. In addition to the fact that he had previously requested authorization to pledge the property (copy of the mortgage certificate and certified deed creating the encumbrance in images of folios [sic] 35 and 36 of volume I, respectively), this Court concludes that the appellant knew of his duty to complete the appropriate procedure before undertaking any action intended to dispose of the parcel. Note that the images in volume V corresponding to folios 1801 to 1822 contain various memoranda among several INDER officials analyzing the application to lift the limitations.
These documents were signed between 18 de noviembre de 1999 and 04 de enero de 2000. They mention the possibility of lifting them; however, the reasoning was to add the period during which other persons had possessed the property, rather than considering only the period corresponding to the counterclaim defendants (actores reconvenidos), Vargas Soto and Salas Castro. As will be seen below, these notes are insufficient to deem the limitations lifted; moreover, by that time, 1999, the property had already been leased to Pedro Borges and companies. In support of the foregoing, witness Jorge Arturo Gutiérrez Rojas, who served as director of the Región Pacífico Central, explained the procedure for lifting the restrictions: ‘...To lift the IDA limitations, ordinarily, fifteen years must elapse from the time the deed is signed, pursuant to law 2825, before the institution may consider lifting the limitations; all debts owed to the Institution must be current; the farm must be operated by the original beneficiary; and an inspection is conducted.
The Subregional office submits a recommendation to the Legal Advisory Office of the Directorate, which assesses it and forwards it to the Legal Directorate, after which it is sent to Management [sic] and then to the Board of Directors, which decides.... The Board of Directors may deny the lifting, for example, when there are debts for land and to Caja Agraria, or grounds [sic] exist for annulment of the title’ (image of folio [sic] 1542 of volume V). The statements of that official, which this Court finds credible in view of his experience, are consistent with the transcription in the aforementioned legal report, the cited legislation, and the testimony of INDER official Leonel Alpízar Solorzano (image of page 1559 of volume V). VII. The commencement of the calculation of the period arises in connection with the claim concerning the aforementioned delay. As extensively stated in the preceding recital, calculation of the period begins with the agreement of the INDER Board of Directors.
The complainant nevertheless repeatedly contends that the limitations commenced on 03 de marzo de 1981. To reach that conclusion, he argues that there was administrative delay and, consequently, that the prohibitions did not exist when the property was leased. That position, however, is inadmissible for the following reasons. The land-allocation contract has a term of fifteen years during which the parcel holders (personas parceleras) must demonstrate their suitability to operate the property properly. In essence, no ownership right is granted at the time of allocation because, as this is a contract of duration (contrato de duración), ownership is perfected only upon completion of the specified period and fulfillment of the obligations set forth in the agreement, as well as demonstration of technical ability and experience. It is therefore a contract requiring proof of skills and aptitude in carrying out agricultural activity, and the person receiving the allocation may not benefit from possession exercised by previous contracting parties.
The beneficiary must personally demonstrate, over a period of fifteen years, compliance with the obligations contained in sections 65, 66, 67, and 68 of the Ley de Tierras y Colonización. Under the cited rules, the position that the period for expiration of the limitations begins when the property is first allocated is unfounded. As established, the allocation contract in question commenced on 17 de junio de 1986 for appellant Vargas Soto and his wife, Kattia Salas, and therefore could not expire until 17 de junio de 2001. Finally, among this series of grievances, the appellant asserts that his allegation can be proven through witness testimony. However, as stated, in this case, the period of [sic] the prohibitions required obtaining proper notice from the Board of Directors in order to make the effects retroactive. In their testimony, some INDER officials referred to the appellant’s possessory acts (actos posesorios).
Constantino Mondragón Medrano (volume V, image of folio 1529) stated that he knew the property and had worked for the Institute. His statements do not relate to applications to lift the prohibitions, but rather to an alleged permit to lease the parcel. Similarly, witness José Fabio Salas Villegas referred to alleged applications to lease the farm and to the appellant’s possessory acts (image of folio 1533 of volume V). Witness Álvaro Enrique Chaves Monge, for his part, provided information about Pedro Borges’s possession and the visit of an INDER official who stated that an application to ‘remove the limitations’ was pending, but that the aforementioned co-defendant Borges was aware of it (image of page 1538 of volume V). Institute employee Jorge Arturo Gutiérrez Rojas, who stated that he had been director of the Región Pacífico Central between 1984 and 1986, provided no relevant information on this issue.
He added that he had happened to be present when the appellant came to speak with the person who was at that time the Executive President of IDA, […] regarding the lifting of the restrictions (levantamiento de las limitaciones). Moreover, official Leonel Alpízar Solórzano, who at the time of giving testimony served as the Regional Head of Orotina and was cited in the appellate brief (memorial de apelación), explained that he had conducted a field visit for the lifting of the restrictions, which, as he explained, is the first step in that process, stating: “...I do not know how far [sic] it went, but it is clear that the restrictions were not lifted; the process did not conclude with a Board resolution...” (image of page 1559 of volume V). He also added that he believed the Regional Head at that time took steps to have them withdraw the application, but he had no direct knowledge of this.
Counsel […] (image 1543), […] (image of page 1547, volume V), the witness […] (image of page 1551), Mr. […] (image of page 1560), and […] (image of folio 1561), all located in volume V of the virtual case file (expediente virtual), likewise provide no information relevant to this issue. When the evidence (probanzas) is assessed as a whole pursuant to section 54 of the Ley de Jurisdicción Agraria, it is evident that there is insufficient evidence to support the appellant’s assertion. He also faults INDER for benefiting from its failure to lift the restrictions and for seeking revocation (revocatoria). This Court finds that argument fallacious and unfounded because, on the contrary, the cited statements by INDER officials showed that, during various inspections, they became aware that the land was being used in a manner different from that with which the parcel holders (parceleros) were required to comply, yet a review of that Institute’s administrative case file (expediente administrativo) reveals no response consistent with the legal system (images from evidence file VI), with a warning (amonestación) not being issued until February 13, 2003 (image of folio 95, volume I), despite the existence of a note from the awardees (adjudicatarios) dated March 06, 2002 (image of page 117, volume I), in which they disclosed the lease agreement (contrato de arrendamiento) for their house; this demonstrates neglect in the performance of INDER’s oversight obligations [sic].
It bears emphasizing that the record shows that, as a result of those warnings, an administrative proceeding (procedimiento administrativo) was never completed. When a warning was issued, according to official letter FVB-OSO-003-2006 dated January 05, 2006, signed by engineer […], he informed engineer […] that, in view of the criminal proceeding (proceso penal) pursued in this matter, the administrative process had at the time been suspended because he considered that the Courts of Justice were responsible for deciding on the rights and breaches of the contract (image 145 of evidence volume VI). Later, the administrative case file shows that a new warning was issued because a field inspection had been ordered [sic] (image [sic] of page 188, evidence volume VI) on March 30, 2007, without culminating in a recommendation and referral of the case file to the Board of Directors, or in a decision formally suspending the administrative proceeding.
VIII. The objections concerning administrative silence (silencio administrativo) likewise have no legal basis. Article 330 of the Ley General de Administración General governs this doctrine. Subsection 1) states that the Administration’s silence shall be deemed affirmative when expressly so provided or when the matter concerns authorizations or approvals that must be granted in the exercise of oversight and supervisory functions. Subsection 2), in turn, provides that silence shall be deemed affirmative when the matter concerns applications for permits, licenses, and authorizations. As the appellant correctly points out, what had to be obtained was an authorization in order to apply the consequences of administrative delay (morosidad administrativa) to the restrictions. For this doctrine to apply, the party filing an application with the Administration must satisfy all requirements, because the second subsection refers to mandatory administrative acts (actos reglados).
However, in the case under consideration (subexamine), not all the requirements for giving retroactive effect to the registry information (información registral) were met. As stated above, the restrictions expired in 2001 and not before.” (Underlining in the original).
XII.This Chamber agrees with the Tribunal’s view that, for purposes of this litigation (lite), the limitations period began with the administrative act (acto administrativo) issued by the Board of Directors of the then IDA granting the parcel to the plaintiff spouses on 17 de junio de 1986, and not with the execution of the corresponding public deed (escritura pública) (provisions 65 of the Ley de Tierras y Colonización and 140 of the LGAP). This Chamber so recognized in the decision cited by the Ad quem, no. 275 de las 9 horas 10 minutos del 17 de marzo de 2011, which cites other precedents and states, insofar as relevant: “[…] The notarized public instrument (instrumento público notarial) does not diminish the importance of, much less replace, the administrative act in question. Accordingly, the legal effects of the land-allocation contract (contrato de asignación de tierras) arise upon the Board’s resolution, since it is a duly reasoned administrative act that meets the legal requirements necessary for distributing IDA property among the parcel holders who are parties to the contract.” To the same effect, see, mutatis mutandis, judgment no. 1018 de las 13 horas 45 minutos del 23 de agosto de 2012.
As the judges correctly stated, under the land-allocation or land-award contract (contrato de asignación o adjudicación de tierras), pursuant to provisions 65, 66, 67 and 68 of the Ley de Tierras y Colonización, parcel holders must demonstrate their suitability for the proper exploitation of the property throughout the limitations period, that is, for 15 años. Accordingly, and in agreement with the Tribunal, that institution does not grant an ownership right because this is a continuing contract (contrato de duración). The public interest underlying this type of contract is reflected in the limitations imposed by the Ley de Tierras y Colonización. Their purpose is to fulfill the social function of property (función social de la propiedad), since the beneficiaries will be those who meet certain conditions for qualification as such so that they may develop the agricultural enterprise (empresa agraria).
Along the same lines, this Chamber stated long ago: “[…] a land-allocation contract is a continuing contract under which the agrarian entity awards an agricultural property (fundo agrario) to a beneficiary of land-distribution programs, previously qualified according to the parameters established by its own [sic] regulations, and undertakes to transfer it, for a possible price or free of charge, if the beneficiary demonstrates the technical capacity to develop the agricultural enterprise and fulfills the obligations imposed during a probationary period; transfer of ownership is completed subject to numerous obligations on the beneficiary’s part, the breach of which allows the entity to revoke the award during a period of 15 años or until no outstanding debts remain, and the beneficiary may not dispose of the property in any manner without the Institute’s prior express authorization because, by operation of law, the allocating entity may recover the property to award it to another beneficiary and must always exercise direct oversight over the activity conducted by the award recipient.
One very important characteristic of this contract, established by law and interpreted by legal scholarship, is that it is a continuing contract. Its completion does not occur upon the transfer of ownership of the property; on the contrary, it is perfected when the beneficiary fulfills the relevant obligations during the period established by law and carries out the activity for which the property was granted. Full ownership is acquired only after the period has elapsed.” (Emphasis added. In this regard, see judgments numbers 229 de las 15 horas del 20 de julio de 1990, 275 de las 9 horas 10 minutos del 17 de marzo de 2011, 1018 de las 13 horas 45 minutos del 23 de agosto de 2012, 1506 de las 14 horas 50 minutos del 20 de noviembre de 2014 and 967 de las 10 horas 42 minutos del 17 de agosto de 2017). The latter decision further states: “[…] during the 15 años established by the aforementioned provision 67, the beneficiary does not yet hold a full ownership right, insofar as the property must be used for the purposes for which it was awarded; consequently, if the parcel is used for a purpose other than the one assigned, INDER (as oversight body) must institute an administrative proceeding (procedimiento administrativo) against the beneficiary to revoke the award of the real property.
In other words, even though the beneficiary holds title to the property and that title is recorded in the Registro Nacional, the powers of disposition, use, and enjoyment are neither full nor absolute, but are subject to the limitations imposed by the same Law for a specified period (15 años).” (Emphasis added). Consequently, title to the property becomes vested upon fulfillment not only of the stated period but also of the obligations set forth in the respective contract. The beneficiaries of the grant of the parcel must demonstrate the skills and aptitudes required to engage in agricultural activity throughout the entire period in which the limitations remain in force or, equivalently, throughout the term of the contract. In this regard, see, mutatis mutandis, among others, the aforementioned judgments of this Chamber. It may be said to be a strictly personal contract (contrato personalísimo, intuito personae), by virtue of the social function fulfilled by the property—provision 50 of the Constitución Política.
This is demonstrated by the fact that provision 67 of the Ley de Tierras y Colonización stipulates, among other things, that the beneficiary may not transfer ownership of the parcel without the Institute’s authorization, unless 15 años have elapsed since acquisition of the parcel and all obligations owed to that entity have been discharged. That is, where a transfer occurs before expiration of the limitations period, the consent of the Board of Directors of what is now the Instituto de Desarrollo Rural –INDER is required. Therefore, the award recipient does not benefit from possession exercised by previous parcel holders. It is from that act, it bears repeating, that the 15 años period during which the limitations or restrictions remain in force begins to run. In this litigation, pursuant to the aforementioned resolution of the Board of Directors of the then IDA—adopted on 17 de junio de 1986—and as established in the record, on 25 de mayo de 1995 the public instrument by which the then IDA transferred the property at issue to the plaintiff spouses was executed.
That agreement expressly provided: “The purchasers may not transfer ownership of their parcel, encumber it, lease it, or subdivide it without the prior authorization of the selling Institute, unless fifteen years have elapsed from this date; transactions entered into with the Banca Nacionalizada, the Consejo Nacional de Producción, or any State lending institutions are excepted from the foregoing prohibition. […]” The plaintiff did not seek annulment of that provision, which implies acceptance of it. On the contrary, the plaintiff acknowledged that it existed when the lease agreement (contrato de arrendamiento) was executed. In this regard, principal claim number six of the complaint against BLINKY, CIENFUEGOS, Julia Ibarra Seas and Pedro Adrián Borges Fiol requested: “Because the defendants’ possession is in bad faith, they shall be denied the right to improvements and fruits, as well as the right of retention (derecho de retención) over the real property.
Furthermore, payment for such improvements is improper because of the IDA limitations to which the real property is subject and of which the defendants were aware.” (Emphasis added). Likewise, in the first alternative claim (pretensión subsidiaria), point five, the plaintiff requested: “Because there was an express waiver in the contract, and because the defendants’ exercise of entitlements over the property was also in bad faith and abusive, they shall be denied the right to improvements and fruits. Furthermore, payment for such improvements is improper because of the IDA limitations to which the real property is subject and of which the defendants were aware.” (Emphasis not in the original). Even clearer is the second alternative claim, points three and five, which requests: “III) Should the judge find that a contractual relationship of any kind exists with the defendants, the absolute nullity (nulidad absoluta) of those contractual relationships shall be declared because IDA limitations existed when they were executed. […] V) Because there was an express waiver in the contract, and because the manner in which the defendants exercised their entitlements over the property was also in bad faith and abusive, they shall be denied the right to improvements and fruits.
Furthermore, payment for such improvements is improper because of the IDA limitations to which the real property is subject and of which the defendants were aware.” (Emphasis added). Even when the then IDA was joined in the litigation (litis), the claim identified as number six requested: “Because the defendants’ possession is in bad faith, they shall be denied the right to improvements and fruits, as well as the right of retention. Furthermore, payment for such improvements is improper because of the IDA limitations to which it is subject, since the defendants were aware of them.” (Emphasis not in the original). In the first alternative claim, point five, against that entity, the plaintiff requested: “Because there was an express waiver in the contract, and because the defendants’ exercise of entitlements over the property was also in bad faith and abusive, they shall be denied the right to improvements and fruits.
Furthermore, payment for such improvements is improper because of the IDA limitations to which the real property is subject and of which the defendants were aware.” Likewise, in the second alternative claim against that institution, points 3 and 5, the plaintiff requested: “3) Should the judge find that a contractual relationship of any kind exists with the defendants, the absolute nullity of those contractual relationships shall be declared because IDA limitations existed when they were executed. […] 5) Because there was an express waiver in the contract, and because the manner in which the defendants exercised their entitlements over the property was also in bad faith and abusive, they shall be denied the right to improvements and fruits. Furthermore, payment for such improvements is improper because of the IDA limitations to which the real property is subject and of which the defendants were aware.” (Emphasis added).
For the reasons stated, this Chamber agrees with the position set forth by the Ad quem that the plaintiff’s contention—that the period for expiration of the limitations begins to run when the property is first awarded—is unfounded. Proven fact number 6 in the lower court’s judgment, which the Tribunal upheld, established that resolution no. nueve, adopted at session no. 399 of the Board of Directors of the then IDA, held on 17 de junio de 1986, approved the award of the parcel at issue to the married couple comprising Mr. Juan Diego Vargas Soto and Ms. Kattia María Salas Castro. Therefore, as the judges stated, the 15 años limitations period began to run at that time. Accordingly, the appellant in cassation (casacionista) is incorrect in asserting that the limitations had expired when the property at issue was leased—in 1998. Indeed, apart from contradicting the allegations made in the claims, their expiration, it bears repeating, occurred on 17 de junio de 2001. This Chamber also agrees with the Tribunal’s ruling concerning the doctrine of affirmative administrative silence (silencio positivo).
As correctly stated, for it to apply, the applicant must satisfy all legal requirements for the granting of the permit, license, or authorization, as provided in subsection 1) of section 331 of the LGAP. In this proceeding, those requirements were not satisfied. The plaintiff requested authorization to lease the property while the restrictions were still in effect; therefore, the doctrine of positive administrative silence (silencio positivo) did not apply. Furthermore, the appellant did not challenge the judges’ finding that the testimony offered did not substantiate the appellant’s assertions. The appellant merely reiterated the arguments made in the appeal to the higher court (recurso vertical). In light of the foregoing, the ground of appeal (agravio) under consideration must be rejected.
XIII.In the third ground for disagreement, at folio 28, the appellant alleges error in the assessment of the evidence (valoración probatoria), asserting that the IDA’s claim is barred by the statute of limitations (prescripción). He reproduces, insofar as relevant, the discussion in recital VII (considerando VII) of the Trial Court’s judgment, as well as the discussion by the Ad quem in section IX of the challenged judgment. He asserts that the reasoning set forth in the judgment under appeal is based on incorrect premises. Namely:
XIV.In this regard, the judges stated the following in the challenged judgment: “IX. Regarding the limitations period applicable to the INDER’s claim, the appellant calculates it on the basis that the restrictions were 26 years old but had expired due to administrative delay. He uses this purported conclusion as the starting point for the limitations period. However, as noted in the preceding sections, the restrictions had not expired when the INDER was joined to the litigation (litis), because it was served with notice of this claim on May 22, 2006, according to the certificate of service (acta de notificación) shown in the image on pages 653 to 655 of volume II. As explained at length in recital VI, the prohibitions under the land-award agreement (contrato de adjudicación de tierras) with the private parties Vargas Soto and Salas Castro began [sic] on June 17, 1986, and expired on June 17, 2001. Applying the appellant’s argument, only approximately four years and ten months had elapsed when the Institute was served with notice of the claim. Under Article 868, in conjunction with ordinal provision 876, subsection 2), both of the Civil Code, the final deadline had not elapsed; accordingly, the ruling on this issue shall be affirmed, but for the reasons stated at this level of review.” (Underlining in the original)
XV.In this regard, it must be recalled that this Chamber, in judgment no. 505 at 8:45 a.m. on April 14, 2011, citing other precedents, stated: “[…] one characteristic of an appeal in cassation (recurso de casación) in agrarian matters is that it must be organized in a technically proper manner. The objections to the judgment must be enumerated and structured, and the grounds for its lack of legal validity must be substantiated. The appellant has a duty to explain clearly and precisely the reasons supporting the appeal. The appellant must systematically challenge the legal grounds of the judgment under appeal. The appellant is exempt only from expressly identifying the legal provisions violated or the type of violation committed. In this regard, see, among many others, judgment number 892 at 9:00 a.m. on November 25, 2005.” (Voto 596-f-06 at 2:55 p.m. on August 30, 2006). Thus, although appeals in agrarian matters are governed by the Labor Code and have been regarded as a third instance available only upon application (tercera instancia rogada), this does not exempt the appellant from the duty to state clearly and precisely the aspects of the second-instance judgment being challenged and, in every case, to explain the nature of the alleged errors.” No. 300 at 10:00 a.m. on April 25, 2008.” (Underlining added).
To the same effect, see, among others, judgments of this Chamber numbers 809 at 8:40 a.m. on July 5 and 1513 at 9:25 a.m. on November 15, both from 2012; 1196 at 9:50 a.m. on September 18, 2013; 29 at 1:30 p.m. on January 16, 2015; and 556 at 9:40 a.m. on May 17 and 1454 at 2:45 p.m. on November 23, both from 2017. Consistent with the foregoing, although no special formalities are required for an agrarian appeal in cassation, this does not mean that it is entirely informal, because the objections to the judgment must be structured in a technically proper manner. Thus, the objections to the factual and legal grounds of the judgment under appeal must be stated clearly and precisely; the appellant is exempt only from identifying the provisions of the legal system that were violated or the type of violation committed. The appellant does not properly challenge the Tribunal’s reasoning. In essence, he merely reiterated the arguments presented in the appeal; therefore, the statements made in the appeal in cassation are ineffectual for purposes of overturning the judgment.
Without prejudice to the foregoing, and by way of further reasoning, this Chamber endorses the Ad quem’s determination. As stated in recital XII of this judgment, it likewise agrees that the period of restrictions on the property at issue began to run upon the administrative act awarding it by the Board of Directors to the married couple consisting of Don Juan Diego and Doña Kattia María, that is, on June 17, 1986, and therefore expired on June 17, 2001, not on the date asserted by the appellant. Consequently, as the judges correctly observed, when the INDER was served on May 22, 2006, with notice of the claim brought against it by the plaintiffs, only 4 years and 10 months had elapsed since the restrictions ended. Ergo, pursuant to provisions 868 and 876, subsection 2), of the Civil Code, the counterclaim filed by the INDER was brought within the period prescribed by the former provision. Therefore, the ground for appeal under review must be rejected.
XVI.In the fourth challenge to the judgment under appeal, at folio 33, the appellant in cassation alleges an error of fact (error de hecho) in the assessment of the evidence because, in his view, annulment of the lease agreement (contrato de arriendo) is unwarranted. He reproduces, insofar as relevant, the discussion in recital IX of the A quo’s judgment, as well as section X of the Ad quem’s judgment. He characterizes the ruling as contrary to the principles of equity, reasonableness, proportionality, and “in dubio pro farmer” (“indubio pro agricultor”). He argues this because:
XVII.In recital X of the challenged judgment, the judges, regarding INDER’s claim seeking annulment of the lease agreement, stated: “[…] As has been extensively explained, according to this Chamber’s reasoning, the restrictions expired, upon application of administrative delay (morosidad administrativa), on 17 June 2001. The lease agreement was signed on 04 December 1998 (document in the image on page [sic] 57 of Volume I), at which time they remained subject [sic] to the obligations inherent in the land-award agreement (contrato de adjudicación de tierras), pursuant to Article 67 of the Ley de Tierras y Colonización, which stipulates, among other restrictions on the property, that the beneficiary may not lease it. It was explained that, because of the social function performed by the parcel, which is closely related to the philosophy of Article 50 of the Constitución Política, the beneficiaries must demonstrate their technical capacity and experience in agricultural work.
If they chose to build a dwelling, that was within the powers granted to them under the land-award agreement. However, by the express and unequivocal mandate of the provision, they lacked the authority to lease part of the property because authorization was required. The extensive body of documentary and testimonial evidence does not show that any application for authorization to lease was made. This Court considers that the necessary steps must be taken before any agreement is signed or any oral agreement is reached. Regardless of whether the justifications provided by the counterclaim defendants Vargas Soto and Salas Castro are valid, they were fully aware of their obligations toward INDER. Moreover, irrespective of the steps they took to lift the prohibitions, a separate application had to be made for the lease. It should be noted that the agreement was signed in December 1998, while the record of the request to lift the restrictions is dated 24 July 1998 (image 3 of Evidence Volume V); the field-inspection visits intended to determine whether the restrictions could be lifted took place on 18 November 1999, by which time the lease agreement had already taken effect.
Moreover, as explained, the procedure for lifting the restrictions had to culminate in a resolution by the Institute’s Board of Directors, since this was necessary to amend the information in the Registro Nacional, which reflected the term stated in the public deed documenting the transfer in favor of the aforementioned parcel holders (personas parceleras).”
XVIII.Despite quoting the aforementioned recital from the Tribunal’s judgment, the appellant in cassation (casacionista) does not properly challenge the grounds given for rejecting the objection raised in the appeal to the higher court (recurso vertical). What he has done is essentially repeat the objection raised in the appeal. In other words, his argument is wholly disconnected from the decision of the Ad quem. Instead, it amounts merely to an argumentative assertion. This renders his allegations futile for the purpose of overturning the judgment. Therefore, the ground of disagreement under consideration must be rejected. In any event, as already noted, this Chamber agrees with the judges’ reasoning. Unproven facts 1 and 2 of the Trial Court’s judgment, as affirmed by the Tribunal, state: “1) That the plaintiffs had applied to IDA for authorization to lease the parcel involved in these proceedings. 2) That the Instituto de Desarrollo Agrario, now INDER, had authorized Mr.
Juan Diego Vargas Soto and Ms. Katia María Salas Castro to lease a portion or the entirety of the property registered in the Alajuela registry district under property registration number 293864-001-002 (see the certificate issued by Ing. Juan L. Salas Vega, Subregional Chief in Orotina, dated 6 February 2002, appearing at folio 225 of Evidence Volume I, which states that no such authorization had been processed or approved).” As indicated, the appellant does not challenge this. Furthermore, proven fact no. 15 established: “On four December nineteen ninety-eight, Mr. Juan Diego Vargas Soto, Ms. Kattia María Salas Castro, and Blinky de Orotina Sociedad Anónima, represented by Ms. Julia Ibarra Seas, executed a private lease agreement for a portion of the property registered in the Alajuela registry district under property registration number two hundred ninety-three thousand eight hundred sixty-four-zero zero one and zero zero two (document at folio 55 of the scanned main case file).” Nor does the appellant in cassation challenge this.
In other words, as the judges correctly stated, that agreement was executed while the restrictions encumbering the property at issue remained in force and without the required authorization from the Institute’s Board of Directors. Consequently, it is null and void under Article 67 of the Ley de Tierras y Colonización, as declared.
XIX.In his fifth challenge to the contested judgment, at folio 37, the appellant in cassation alleges an error in the assessment of the evidence, because, in his view, there was no indirect operation (explotación indirecta) of the parcel. This is because, he states, the parcel was worked and used for agricultural purposes. He notes that this continued until he was unlawfully dispossessed (despojado ilegítimamente). He argues that he can prove this through the projects carried out on the parcel. With the Universidad de Costa Rica -UCR-, he says, he conducted hot-pepper seed experiments to reproduce a variety called “Jalapeño M,” as well as experimental plantings of different passion-fruit varieties to identify the one best suited to the area. He planted pochote timber trees with the Ministerio de Agricultura y Ganadería -MAG-. He carried out a dairy- and beef-cattle project financed by BPDC. IDA, he asserts, authorized that project to be implemented through the Asociación de Productores de la Trinidad y Uvita.
He further adds that a planting project for the export of melons, watermelons, and other agricultural products was submitted to him, and that authorization to mortgage the parcel was requested from IDA as required by law. The entity granted it through its Board of Directors. As a result, he notes, a 10-year mortgage certificate (cédula hipotecaria) was created to implement the project; it served as security before the Sistema Bancario Nacional, and, consequently, the project benefited the community, particularly by creating employment. He states that the parcel was directly worked and operated from 1984, through various agricultural and livestock activities, until the day he was unlawfully dispossessed by Mr. Pedro Borges and others. He adds that he repeatedly asked IDA to assist him because the restrictions had not been formally lifted, but it did not do so. As evidence of the malicious conduct of IDA officials, he states that when he filed his counterclaim, they did not proceed against Mr.
Borges and the other defendants but instead offered them as witnesses, which he characterizes as “unlawful collusion between those parties.” He quotes, insofar as relevant, the statements made by the A quo Judge in recital IX of her judgment. He notes that the challenged judgments proceed from the premise that the lease agreement facilitated the dispossession. However, he argues that an analysis of the quoted text shows that it acknowledges that they were dispossessed of the parcel. Only two hectares were leased; they were unlawfully dispossessed of the remainder. He quotes, insofar as relevant, recital X of the Trial Court’s judgment. For its part, he states, although the Ad quem determined that he had been unlawfully dispossessed of the property, it sanctioned him for failing to comply with the formal demand (prevención) issued by INDER. Most seriously, he argues, the preliminary negotiations (tratativas preliminares), which never resulted in the execution of any agreement whatsoever (there was never a transfer agreement), are confused with an actual agreement, and he is punished as though an agreement had existed.
He notes that it is unjustified to say that he placed himself in that situation when no transfer agreement ever existed; rather, it was Mr. Borges’s unilateral and unlawful acts that dispossessed him of the property and prevented him from complying with the formal demands issued. He reproduces recital XI of the Tribunal’s judgment. Pedro Borges’s and the defendant companies’ operation of the property is unlawful, but he cannot be implicated with them for the following reasons:
XX.In this regard, in recital XI (considerando XI) of the challenged judgment, the judges held as follows: “Another error alleged against the appealed decision concerns the ground of indirect exploitation of the parcel. The appeal contends that they were unlawfully dispossessed and attempted to recover the property through eviction proceedings (proceso de desahucio). However, by entering into a contract without the required authorization, as explained in the preceding recital, they unquestionably placed themselves in a position of risk and breached their duties. Furthermore, we do not agree with the allegation that they are being held liable for the actions of co-defendants Pedro Borges, Julia Ibarra, and the companies; once again, however, that is a theory lacking support. Indeed, as the challenged judgment noted, the appellant was fully aware of what was occurring on the parcel because he signed documents consenting to the processing of a business license (patente).
This letter was signed [sic] by the appellant and his wife, who expressly stated: ‘...in our capacity as owners of the registered property... and in our capacity as lessors, we express our agreement with the business-license application submitted to you by CIENFUEGOS ECO RANCHO LIMITADA’ (image of folio 429 of evidence volume I). First, the letter is crystal clear regarding the application that was to be processed; and second, the lease agreement (contrato de arrendamiento) was entered into with the commercial company Blinky de Orotina Sociedad Anónima, which demonstrates that an activity other than residential use was being developed on the parcel, since another legal entity had been authorized. Given the knowledge that co-defendant Salas Castro possessed as an employee of the Municipal Corporation, it is considered that they knew enough to understand that a license is not required for residential use, but rather for other types of activities, such as the one being conducted on the parcel.” (Underlining in the original).
XXI.In this regard, as already explained, in proven fact number 15, the A quo judge—whose finding was endorsed by the Court—established that on December 4, 1998, Mr. Juan Diego, Ms. Kattia María, and BLINKY, represented by Ms. Julia Ibarra, signed a private lease agreement for a section of the property at issue. Likewise, unproven facts 1 and 2 stated that Mr. Juan Diego did not request authorization from the then IDA to lease the parcel and, consequently, that the Institute did not authorize that lease. In light of the foregoing, this Chamber finds correct the Court’s assertion that entering into that lease agreement with BLINKY—which the petitioner in cassation himself acknowledges—without the required authorization from the then IDA inexorably placed him in a position of risk and in breach of his contractual duties, pursuant to sections 65, 66, 67, and 68 of the Ley de Tierras y Colonización.
In a different vein, in proven fact no. 23, the first-instance judge made the following finding, which the Court upheld and which was likewise not challenged: “By letter dated July 14, 1999, addressed to the Municipalidad de Orotina, Juan Diego Vargas Soto and Katia [sic] María Salas Castro state that, in their capacity as lessors and owners of the property registered in the Alajuela registry district under registration number 293864, they agree to the business-license application submitted by Cienfuegos Eco Rancho Limitada (document at folio 429 of Evidence Volume I).” As the judges correctly observed, it bears repeating that the lease agreement, as already indicated, was entered into with BLINKY. The proven fact transcribed above reveals that an activity different from the one required under the grant awarded by the IDA was being conducted on the parcel at issue, because exploitation through a legal entity had been authorized.
The Court also added that, because co-plaintiff Salas Castro is an employee of the Municipality, she was fully aware that a license is not required for residential use, but rather for other types of activities, such as the one being conducted on the parcel. The appellant did not challenge these arguments in his appeal before this Chamber. He merely stated: “For its part, the second-instance judgment, despite determining that I was unlawfully dispossessed of the property, penalizes m e [sic] for failing to comply with the warning issued by INDER. Most seriously, it confuses preliminary negotiations that never resulted in the execution of any contract (there was never a transfer agreement), penalizing me as though there had been a contract [sic]. There is no justification for saying that I placed myself in that situation when there was never a transfer agreement; it was Mr. Borges’s unilateral and unlawful acts that dispossessed me of the property, thereby preventing me from complying with the warnings issued to me.” In addition to failing to contest the findings of the Ad quem, the foregoing statement is confusing.
First, in the transcribed recital, the judges did not find that the alleged unlawful dispossession had occurred. They merely recounted his assertion without endorsing it. The appellant states that no transfer agreement existed; yet later, in the same claim of error, he acknowledges that there was a residential lease agreement. Moreover, the Ad quem was clear and precise in stating: “Furthermore, we do not agree with the allegation that they are being held liable for the actions of co-defendants Pedro Borges, Julia Ibarra, and the companies; once again, however, that is a theory lacking support.” Contrary to what was asserted both in the ordinary appeal and now before this Chamber, the liability attributed to him arises from his own acts, such as leasing the property without the corresponding authorization and, in his capacity as lessor and owner of the parcel at issue, applying to the Local Government of Orotina for the issuance of a business license to CIENFUEGOS, all of which demonstrates that the designated use (destino) of the property allocated by the IDA was changed. For the foregoing reasons, this claim of error must be rejected.
XXII.In the sixth and final claim of error against the challenged judgment, at folio 49, the appellant alleges an error of fact in the assessment of the evidence because the revendicatory action (acción reivindicatoria) was dismissed for lack of standing to sue (legitimación en la causa activa). He reproduces the portions relevant to his position from recital XIII of the Trial Court’s judgment, as well as section XII of the Ad quem’s decision. He contends that the reasoning set forth there was based on the revocation of the parcel award (revocatoria de la parcela). He asserts, however, that this is improper for the following reasons:
XXIII.In this regard, the appellate court (Ad quem), in recital XII (considerando XII) of the challenged judgment, stated: “XII. As a corollary of the foregoing, the challenge to the dismissal of the action for recovery of ownership (acción reivindicatoria) shall fail as unfounded, since the ruling concerning the revocation of the land award contract (contrato de adjudicación de tierras) and the consequent invalidation of title shall be affirmed; therefore, they lack standing (legitimación activa) to bring the claim. Because even one of the procedural requirements for the action is lacking, the relief sought must fail. Article 320 of the Civil Code provides that the owner is entitled to bring the claim; however, having lost their status as beneficiaries of the award contract for the parcel in dispute, they lack the capacity required to support the claim. At the same time, they again allege as an error in the judgment that the restrictions had expired, but, as has been amply explained, the doctrine of administrative delay (mora administrativa) was inapplicable.
Likewise, the grievance alleging that it was impossible for them to comply with the warning concerning dispossession shall fail as unfounded. Nevertheless, this Court agrees with the reasoning of the trial court (a quo) that the party placed itself at a disadvantage by breaching the obligations undertaken when the parcel was awarded to it. It bears repeating that the ownership right had not vested when the lease agreement was entered into, even if only for part of the property, which is sufficient reason to reject the grievance.” (Underlining in the original).
XXIV.The cassation appellant (casacionista) reiterates a series of arguments that have already been analyzed in this judgment. The Tribunal clearly states that, because it affirmed the revocation of the land award contract entered into by the plaintiff, Juan Diego Vargas Soto, and his wife with the IDA—now INDER—and the consequent invalidation of title, he lacks standing to bring an action for recovery of ownership. Because one of the prerequisites for such an action—namely, ownership of the property in dispute—is absent, the claim cannot succeed—Article 320 of the Civil Code. The judges stated that, upon losing their status as beneficiaries of the award contract for the parcel at issue in these proceedings, they no longer satisfy that standing requirement. In light of the matters set forth in the preceding recitals, this Chamber agrees with the ruling. The cassation appellant’s breach of the limitations or restrictions encumbering the awarded parcel has been established, as he entered into the aforementioned lease agreement with the company BLINKY without the Institute’s consent.
This circumstance requires revocation of the grant. Consequently, it also means that he does not hold the status of owner necessary to institute the action for recovery of ownership. The Chamber likewise agrees with the challenged judgment’s finding that reasons have already been provided for deeming the argument of administrative delay, based on the expiration of the restrictions, unfounded. The Chamber also agrees with the judges’ conclusion—which was not properly challenged—that the plaintiff placed himself at a disadvantage by breaching the restrictions and obligations undertaken when the parcel was awarded to him, since the ownership right had not vested when the lease agreement was entered into, even if only for part of the property. Consequently, the plaintiff lacks standing to seek recovery of ownership of the property in dispute. Therefore, this grievance must be rejected.
XXV.In view of the reasons stated, the majority shall dismiss the agrarian cassation appeal (casación agraria) and affirm the Tribunal’s judgment.
POR TANTO
By majority vote, the agrarian cassation appeal is denied. The challenged judgment is affirmed.
Luis Guillermo Rivas Loáiciga Román Solís Zelaya Rocío Rojas Morales William Molinari Vílchez José Rodolfo León Díaz MJIMENEZ DISSENTING OPINION (VOTO SALVADO) OF JUSTICE LEÓN DÍAZ The right to property (Derecho de Propiedad) (or, if preferred, property rights (Derechos de Propiedad), as legal scholarship has maintained based on the teachings of Professor Pugliatti) is one of the most controversial and intricate legal institutions, essentially changing in accordance with each legal and social environment and a country’s historical development. It is therefore inevitable that divergences will arise in the interpretation of the legal provisions governing it, particularly when special property is involved, such as that arising from a State award (adjudicación estatal) for the agricultural exploitation of landholdings. In this context, and with due respect, I disagree with the majority opinion on several fundamental points that led it to dismiss the appeal on points of law (recurso de casación).
First, I consider lease agreements (contratos de arrendamiento), land-use concessions (concesiones de utilización de tierras), and land awards (adjudicaciones) to differ in their nature and effects. Under the first two, temporary use of the property is granted, without the property leaving the assets or ownership of the respective public entity. Under the last, the award entails the transfer of a special property right, recordable in the Public Registry, governed by a distinct regime—and hence constituting special property—that temporarily limits certain aspects of the use, transformation, disposition, or alienation of the property, whether inter vivos or mortis causa. This follows clearly from the provisions governing the parceling of land (parcelación de tierras), set forth primarily in Articles 49 through 81 of Ley de Tieras y Colonización No. 2825. In particular, Article 49 establishes that the purpose of parceling is to achieve a better distribution of land, not to retain it indefinitely in the hands of the respective public entity; Article 54 provides that lands acquired by INDER shall be divided to promote the farmer’s economic emancipation, not the farmer’s unlimited or excessive subordination to the entity beyond the parameters of proportionality and reasonableness; Article 58 provides for the possibility of granting parcels for consideration, even allowing the sale price to be lower than their cost, thereby indisputably referring to a transfer of the property; Article 59 governs the amortization of payments, which is appropriate only in the event of a sale; Article 62, in turn, establishes the requirements for applicants’ requests to acquire land and does not state that acquisition is by lease or subject to limitations exceeding the statutory term; Article 65 begins to address the sale of parcels and the manner in which the Instituto will proceed to convey title, secured by a mortgage, which, in the event of default, would entail foreclosure through the sale of the property; and, regarding a parcel holder’s breaches of obligations, Article 66 provides for the possibility of reversing the award, resulting in the loss of the right to the property, in which case the parcel would revert to the ownership of the Insitututo, making it evident that, before then, the property belonged not to its assets but to those of the award recipient.
The most relevant provision is found in Article 67, which literally states: “The beneficiary may not transfer title to the property or encumber, lease, or subdivide it without authorization from the Instituto, except where fifteen years have elapsed since acquisition of the parcel and all obligations owed to that entity have been discharged. Nor may the beneficiary, without such authorization and during the same period, encumber the crops, seeds, animals, implements, tools, or equipment necessary for exploitation of the parcel, unless all obligations owed to the Instituto have been discharged. Authorization to encumber the real property requires four concurring votes of the Board of Directors. Any contract entered into without compliance with the foregoing provisions shall be absolutely null and void. Once fifteen years have elapsed and the property right has been acquired, any alienation of a parcel that, in the judgment of the Instituto, could result in excessive concentration or subdivision of the property shall entitle it to acquire the parcel or parcels offered for sale at the price determined by the experts appointed by the parties or, in the event of disagreement, by a third expert.
This third expert shall be appointed by the other two experts. The Public Registry shall enter a notation of the limitations referred to in this Article.” In my opinion, this provision establishes only a limitation on the powers to dispose of the property, which is not novel in the legal system, since this possibility was established in French civil legislation as early as 1800 and is embodied in Article 242 of our Civil Code. Limiting one of the attributes of ownership for a reasonable term of 15 years does not mean that the property remains in the public domain. Moreover, the provision clearly establishes that a transfer would occur. In this regard, the provision even establishes the possibility of reacquiring the property when, after the 15 years have elapsed, transfers occur that could be deemed intended to create an excessive concentration or subdivision of ownership, but only upon payment of the price determined by expert appraisal.
This provision also establishes the power to encumber the property to obtain funds, subject to a qualified majority, demonstrating that mortgages could exist that might eventually lead to a judicial auction of the parcel, which is permissible only where a property right exists. Accordingly, this property may be transferred with INDER’s authorization or through a judicial auction when that entity previously permitted it to be encumbered and such auction becomes necessary because the acquired debts were not paid. Similarly, Article 68, subsection 1), also establishes that, before the respective obligations have been fulfilled, the property may be transferred or encumbered only with INDER’s prior authorization. In this regard, if the established obligations have been fulfilled, the property right is not subject to any limitation, nor may INDER extend the limitations that previously existed.
Subsection 2), for its part, demonstrates that no authorization is required after the obligations have been fulfilled, although INDER could potentially reacquire the parcel if there is a possibility that it will be concentrated or subdivided. In my view, this mechanism would constitute a form of expropriation that could be legitimate only if it fundamentally conforms to the parameters established by Article 45 of the Constitución Política. At no time, it bears emphasizing, is the public entity authorized to restart the limitation period once a transfer has been authorized because the essence of every transfer of a right is precisely that the legal status transferred remains intact. Continuing to impose limitations beyond the initial 15 years means leaving the property in a state of uncertainty beyond what proportionality and reasonableness permit. Furthermore, under the principle of legality, public entities may do only what the Law expressly permits them to do, and at no time did the legislature establish that the 15-year period would begin to run anew whenever a transfer was authorized.
This does not occur in transfers, whether inter vivos or mortis causa. The regime established by Article 69 of that Law governs the transfer of ownership upon the beneficiary’s death, while recognizing the existence of a property right. If there are heirs who, because of their personal circumstances, cannot acquire the parcel, the Instituto may have the parcel judicially awarded to it, thereby recovering title upon prior payment of its appraised value. In my view, all the foregoing demonstrates that this is special property, but it may not be subject to limitations other than those expressly provided for by the legal system, and such limitations may not be interpreted expansively because they restrict a fundamental right of an economic nature—namely, the right to property—recognized and protected by Article 45 of the Constitución Política. For these reasons, I consider the second ground of the appeal on points of law, described in recital IX (considerando IX) of the majority opinion, to be well-founded; it is omitted from transcription because doing so is unnecessary, since I consider that the limitation period established with respect to lot NO. 48-1(A) had long since elapsed from the time of its original award, irrespective of subsequent authorizations to segregate or transfer the property, because no statutory provision—the only kind that could justify limitations on a property right—allows the Instituto successively to extend the period restricting the powers of disposition.
Accordingly, in dissent, I consider that the judgment challenged on appeal must be vacated, the first-instance ruling reversed, and the principal claims in the action brought by Juan Diego Vargas Soto and Kattia María Salas Castro against Julia Ibarra Seas and Pedro Adrián Borges Fiol granted in its place, with the assessment of damages reserved for the judgment-enforcement phase and all affirmative defenses raised by those defendants dismissed. Regarding the counterclaim filed by Inder, I consider in dissent that it must be dismissed in its entirety because the counterclaim defendants’ property right has vested, and that the defense of lack of a right and present interest must be sustained, since INDER has no such interest in property over which full ownership has already vested. Regarding costs, as a consequence of this dissenting position, I consider that they must be paid by the parties that did not prevail on the complaint and counterclaim to the plaintiffs and counterclaim defendants.

Proceso ordinario establecido por JUAN DIEGO VARGAS SOTO, cédula de identidad no. 203260381 y KATTIA MARÍA SALAS CASTRO, cédula de identidad no.203910768; contra JULIA IBARRA SEAS, cédula de identidad no. 106800592; PEDRO ADRIÁN BORGES FIOL, cédula de identidad no. 800780225, ambos en condición personal y como apoderados generalísimos sin límite de suma de BLINKY DE OROTINA SOCIEDAD ANÓNIMA, cédula jurídica número 3-101-137158; CIENFUEGOS ECO RANCHO LIMITADA, cédula jurídica 3-102-237715; INSTITUTO DE DESARROLLO RURAL, representado por su apoderada generalísima sin límite de suma Annie Alicia Saborío Mora, cédula de identidad no. 202960102. El actor formula recurso de casación contra la resolución no. 000322-F-2017 de las 13 horas 28 minutos del 17 de abril de 2017, emitida por el Tribunal Agrario del Segundo Circuito Judicial de San José.

CONSIDERANDO
I.Acorde a los hechos demostrados en ambas instancias y que no son controvertidos, se tiene que el señor Juan Diego Vargas Soto figura como titular registral del derecho 001 y la señora Kattia Salas Castro como dueña registral del derecho 002 de la finca inscrita al partido de Alajuela, matrícula 293864, denominada parcela 48-1 del Proyecto Salinas I; situada en el distrito quinto, Ceiba; cantón noveno, Orotina. Tiene una cabida de 123.513,90 metros cuadrados. Al 27 de setiembre de 2007 -fecha en que se hizo el reconocimiento judicial-, tenía las siguientes construcciones: a) en el sector norte una casa, junto a la cual hay una cochera; otra casa detrás y galerones; b) una construcción de cemento que aparenta ser una piscina y un planché de cemento contiguo; c) una cuadra; d) un corral hecho en “perling” con techo de zinc teja; e) encierro en “perling” con techo en parte de 7,60 x 14,90 metros; f) cercas prefabricadas internas en cemento; g) construcción grande ubicada en la parte norte con una especie de terraza; h) camino interno de lastre; i) en el sector sur de la quebrada, hay otra casa con piso de tierra, cable telefónico, electricidad y agua; j) una plaza de deportes; k) un rancho sin paredes, que aparenta ser para fiestas, con piso de piedra cuarta, techo de zinc teja con un área de construcción de 25 m x 12 m; cuenta con electricidad y agua y l) un helipuerto.
Asimismo, hay cultivos y árboles de: a) naranja injertada, b) palmeras, c) árboles de teca, d) plátano, e) tempate y f) árboles de pochote grandes. En la parte sur de la heredad hay potrero y semovientes. La propiedad presenta limitaciones de la Ley no. 2825, Ley de Tierras y Colonización, las cuales, según Registro Público, iniciaron el 25 de mayo de 1995 y finalizaron el 25 de mayo de 2010. El 13 de febrero de 1986, los señores Ubaldo Rojas Fallas y Juan Diego Vargas Soto suscribieron documento privado, el cual denominaron “contrato de compra venta de mejora de una parcela”. En dicho documento estipularon que el señor Rojas Fallas ha sido beneficiario de la parcela número 48-A del proyecto de Salinas, la cual vende al señor Vargas Soto, incluyendo mejoras, posesión de ocho años, y reservándose una hectárea. La Junta Directiva del entonces Instituto de Desarrollo Agrario -IDA-, en sesión número 399 celebrada el 17 de junio de 1986, acuerdo no. nueve, aprobó dicho traspaso.
Mediante escritura pública otorgada el 25 de mayo de 1995, el apoderado generalísimo sin límite de suma del IDA, segregó un lote, identificado con el número 48-1 de la finca inscrita al partido de Alajuela folio real 80070-000 y lo vendió a Juan Diego Vargas Soto y Kattia María Salas Castro. En dicho instrumento público se estipuló que los compradores aceptaban la venta, entendidos que se hacía con limitaciones, entre las cuales estaba que no podrían traspasar el dominio del predio, gravarlo, arrendarlo o subdividirlo sin la autorización previa del Instituto vendedor, excepto que hubiesen transcurrido 15 años contados a partir de esa fecha. Se excepturon de esa prohibición las operaciones celebradas con la banca nacionalizada, el Consejo Nacional de Producción -CNP- o cualesquiera otras instituciones de crédito del Estado. También se consignó que cualquier enajenación de la o las parcelas que, a juicio del IDA, puedan producir la concentración o subdivisión excesiva de la propiedad, le daría derecho para adquirir la propiedad ofrecida en venta.
De la misma manera, se pactó, el incumplimiento de los compradores o de las personas a quienes se haya transmitido la parcela de cualquiera de las obligaciones dispuesta en la Ley de Tierras Colonización, da derecho al IDA para revocar, administrativamente, la adjudicación y solicitarle al Registro Público que la finca vendida sea inscrita, nuevamente, a favor de ese ente, cancelándole, a quien en el Registro aparezca como dueño al momento de la revocatoria, el precio original de compra, así como el valor de las mejoras introducidas en el inmueble, de conformidad con el avalúo que al respecto realice un perito de la institución vendedora. La referida parcela, no. 48-1(A) fue inscrita al partido de Alajuela, matrícula 293.864-001-002. La Junta Directiva del IDA, en acuerdo tomado en la sesión número 30-95, celebrada el 6 de junio de 1995, autorizó a don Juan Diego y a doña Kattia María a hipotecar en primer grado dicha parcela a favor de un Banco del Sistema Bancario Nacional, por un monto de ₡15.000.000,00.
Lo anterior, para la siembra de tomate, melón, sandía y adquisición de equipo de riego de goteo. En escritura pública otorgada el 9 de noviembre de 1995, el señor Vargas Soto y la señora Salas Castro, estipulándose que fue autorizada por la Junta Directiva del IDA, constituyeron, a su favor, una cédula hipotecaria de primer grado por ₡20.000.000,00, garantizada con la finca inscrita al partido de Alajuela matrícula número 293.864-001-002. En dicho documento se consignó que el inmueble dado en garantía soportaba limitaciones del IDA y que vencían el 25 de mayo de 2010. El 11 de setiembre de 1998, la cédula hipotecaria se endosó a favor del Banco de Costa Rica -BCR-. Mediante escrito presentado a la Dirección Regional Coyolar del IDA, el señor Vargas Soto, como presidente de la Asociación de Productores Trinidad y La Uvita, solicitó la liberación de las limitaciones en las escrituras otorgadas en el Asentamiento Salinas 1.
En la finca matrícula 293.864, hasta aproximadamente el año 2000, don Juan Diego y doña Kattia María realizaron cultivos de papaya, melón, naranja, aguacate, pipián, sandía, mango, chile, pepino, tomate; introdujeron sistema de riego por goteo y construyeron una casa. El 4 de diciembre de 1998, la señora Salas Castro, el señor Vargas Soto y la empresa Blinky de Orotina Sociedad Anónima -en lo sucesivo, BLINKY-, representada por la señora Julia Ibarra Seas, suscribieron un documento privado de contrato de arrendamiento de una sección de la indicada finca matrícula 293.864-001-002. Los comparecientes consignaron que la sección arrendada a BLINKY correspondía al sector donde estaba la casa de habitación y comprendía un área aproximada de 2 hectáreas. De igual manera, establecieron que el plazo del arrendamiento era por tres años -del 1 de diciembre de 1998 y hasta el 30 de noviembre de 2001-, prorrogable por un plazo igual en caso de acordarlo las partes con tres meses de antelación al término del plazo.
También acordaron que su precio era de ₡500.000,00 por año, pagadero en un solo tracto el primer año, con el aumento de ley anual de 15% sobre el saldo anterior, el cual se cancelaría el primero de diciembre de cada año a partir de 1999 en dinero efectivo y en el domicilio del arrendante. También estipularon que la arrendataria destinaría la finca para la habitación y recreo, pudiéndole introducir mejoras sin cambiar el estilo de la casa ni modificar el destino del inmueble a otro tipo del pactado. Las mejoras no podrían ser retiradas una vez finalizado el contrato. A su término, por cualquier causa, la arrendataria entregaría el inmueble en las condiciones en que lo recibió, además de las mejoras realizadas. También consignaron que los arrendantes o personas debidamente autorizadas al efecto, tendrían derecho de inspeccionar el inmueble por lo menos una vez al mes, para comprobar que se le estaba dando el uso correcto, de acuerdo con contrato y las buenas costumbres.
La arrendataria no podría subarrendar, ceder total o parcialmente el contrato, tampoco negociar ningún derecho derivado de él. En escritura pública otorgada el 5 de febrero de 1999, los señores Pedro Adrián Borges Fiol y Heliodoro Enrique Galván Castro, constituyeron la sociedad Cienfuegos Eco Rancho Limitada -para futuras citas, CIENFUEGOS-, a la cual se le otorgó la cédula jurídica número 3-102-237715. El 14 de julio de ese año, el señor Borges Fiol, en su calidad de gerente de CIENFUEGOS, solicitó licencia para proyecto turístico ante la Municipalidad de Orotina. Dicho Ayuntamiento la otorgó. El proyecto incluye restaurante, senderos, módulos habitacionales y canchas multiuso. Mediante oficio datado 14 de julio de 1999, dirigido a ese Gobierno Local, don Juan Diego y doña Kattia María, en su condición de arrendantes y propietarios de la finca matrícula 293.864, manifestaron su anuencia en la solicitud de patente efectuada por CIENFUERGOS.
En oficio fechado 16 de julio de 1999, don Pedro Adrián, en su calidad ya indicada, le solicitó al Instituto Costarricense de Turismo -ICT- la aprobación del respectivo contrato turístico. Según se indicó en dicho oficio, se trata de una opción de desarrollo agroecológico, ofreciendo una gran variedad de áreas y sitios de esparcimiento, tales como: restaurante, centro hípico, polideportivo, gimnasio, redondel de toros, senderos ecológicos y hotel (basado en un modelo sostenible de desarrollo de módulos habitacionales vacacionales). En escritura pública otorgada el 31 de mayo de 1999, don Juan Diego y doña Kattia María constituyen la sociedad denominada Juvakasa Oro Sociedad Anónima -en lo sucesivo JUVAKASA-, con cédula jurídica número 3-101-244145. Al ser las 10 horas del 27 de julio de 1999, en Asamblea general extraordinaria de CIENFUEGOS, se acordó autorizar al socio Pedro Adrián Borges Fiol, para venderle a JUVAKASA 10 cuotas comunes o títulos nominativos denominados “Comunes Serie A” de su propiedad, identificados con la numeración del 01 al 10, por un valor de ₡2.000.000,00 cada una, para un total de ₡20.000.000,00.
Se consignó que la sociedad compradora cancelaría el precio con una cédula hipotecaria de primer grado por un valor de ₡20.000.000,00, constituida a favor de los representantes legales de la sociedad compradora y debidamente endosada a su representada, quien, a su vez, la endosó a la compañía vendedora. Se indicó que dicha cédula es de plazo vencido, y estaba garantizada mediante la finca inscrita en el Registro Público partido de Alajuela matrícula número 293.864. Además, que dicha heredad soporta limitaciones del IDA -Ley no. 2825-, reservas de la Ley de Aguas y Ley de Caminos. Asimismo, la cédula hipotecaria garantizaba obligaciones ante el BCR por un monto de ₡4.800.000,00 aproximadamente, comprometiéndose, la sociedad compradora, al igual que sus apoderados, a liberarla, lo cual fue aceptado por la vendedora. En dicha Asamblea estuvieron presentes el señor Vargas Soto y la señora Salas Castro.
Sin precisarse la fecha, la Municipalidad de Orotina otorgó patente al Proyecto Turístico CIENFUEGOS. El 12 de julio de 1999, el Ministerio de Salud concedió permiso sanitario de funcionamiento, por el plazo de un año, al establecimiento denominado CIENFUEGOS ECO RANCHO, el cual está situado en La Ceiba de Orotina. El 21 de julio de 1999, la sociedad CIENFUEGOS obtuvo contrato de póliza por seguro de riesgos del trabajo para labores de hotel y cabinas en Orotina. Durante los meses de enero, febrero, marzo, abril, junio, julio y agosto, todos del año 2001, fueron cancelados servicios de electricidad a nombre de CIENFUEGOS. Asimismo, esta empresa pagó los servicios brindados por el Acueducto Salinas I durante los meses mayo, junio, setiembre y agosto, todos del indicado año 2001. Mediante oficio fechado 21 de junio de 2001, el señor Borges Fiol le ofreció a don Juan Diego y a doña Kattia María, representantes de JUVAKASA, la venta de 89 cuotas participativas de CIENFUEGOS, así como la única cuota participativa del señor Eliodoro Enrique Galván Castro.
El 22 de enero de 2002, el señor Vargas Soto y la señora Salas Castro interpusieron demanda de desahucio contra BLINKY, basados en la causal de vencimiento del plazo; sin embargo, fue declarada sin lugar. En oficio número OSO-180-2002 del 6 de febrero de 2002, emitido por el Jefe Subregional Orotina del IDA, se hizo constar que don Juan Diego y doña Kattia María no tramitaron, como tampoco se les ha aprobado, autorización para arrendar la parcela 48-1 del asentamiento Salinas I, matrícula 293.864-001-002. El 18 de febrero de ese año, el señor Borges Fiol, como apoderado de CIENFUEGOS, denunció, por el delito de estafa, a don Juan Diego y a doña Kattia María, tanto en su calidad personal como apoderados de JUVAKASA. Este proceso fue tramitado con el expediente no. 02-200022-553-PE. Mediante oficio número OSO-177-2003 del 13 de febrero de 2003, el IDA impuso amonestación única a Juan Diego Vargas Soto y Kattia María Salas Castro por explotación indirecta de la parcela no. 48-1 de Asentamiento Salinas 1.
Se les advirtió que, en 10 días, debían suspenderse las supuestas violaciones a la Ley no. 2825 y ponerse a derecho. Se les apercibió de seguirse proceso en su contra, el cual puede causar la pérdida de la adjudicación y la subsecuente extinción del derecho sobre la parcela. En escrito datado 4 de marzo de ese año, don Juan Diego y doña Katia María se opusieron a la amonestación. En oficio presentado ese mismo día -4 de marzo de 2003- ante la Junta Directiva del IDA, solicitaron la intervención de ese Instituto para su ingreso a la parcela 48-1. En escritura pública otorgada el 10 de noviembre de 2005, don Juan Diego y doña Kattia María, en su calidad de propietarios de la finca matrícula 293864, solicitan la cancelación de las cédulas hipotecarias, dejando libre de ese gravamen la indicada finca. En escrito presentado ante la Oficina Subregional de Orotina del IDA el 17 de noviembre de 2005, la señora Kattia María Salas Castro solicitó el archivo definitivo de la amonestación por explotación indirecta de la susodicha parcela 48-1(A).
En escrito presentado el 14 de diciembre de 2005 a la Presidencia ejecutiva del IDA, el señor Borges Fiol solicitó se procediera a iniciar un procedimiento de revocatoria de la adjudicación y nulidad de título en contra de don Juan Diego y doña Kattia María. Mediante oficio fechado 18 de octubre de 2006, suscrito por el jefe del BCR de Orotina, se informó que el documento de garantía de las operaciones de crédito 303-824 y 846, la cédula hipotecaria, fue entregado al señor Juan Diego Vargas Soto, sin precisarse la fecha.
II.El 10 de abril de 2002, don Juan Diego Vargas Soto y doña Kattia María Salas Castro interpusieron este proceso ordinario en contra de Julia Ibarra Seas, Pedro Adrián Borges Fiol, ambos en su condición personal y como representantes de BLINKY y CIENFUEGOS, a fin de que en sentencia se declare, en forma principal, que son los legítimos propietarios de la finca inscrita en el Registro Público, partido de Alajuela, matrícula 293.864, derechos 000, 001 y 002. Sobre ese inmueble, previo al despojo, han ejercido todos los atributos del dominio, por lo que, más que simples propietarios registrales, son sus dueños; mientras que los demandados son poseedores ilegítimos. El inmueble, sobre el que ejercen ilegítimamente posesión los demandados, es el mismo que reclaman como de su propiedad. La posesión ilegítima ejercida por los demandados es de mala fe. Por ser de mala fe, se les niegue el derecho de mejoras, frutos; así como el derecho de retención del inmueble.
También, que dicho pago de mejoras es improcedente, por las limitaciones del IDA a que está sujeta la heredad, y que es de conocimiento de los demandados. Piden se ordene a los demandados restituirles la finca; de no hacerlo voluntariamente, se les ponga en posesión por orden judicial, de tal forma que queden disfrutando todos los atributos del dominio. Asimismo solicitan se les condene, en forma solidaria, al pago de los daños y perjuicios causados, los cuales liquidan de la siguiente manera: A. DAÑO:
III.El representante del INDER contrademandó a don Juan Diego y a doña Kattia María. Solicitó se declare que la finca del partido de Alajuela, matrícula 293.864-001-002 se encuentra sujeta a las limitaciones de la Ley no. 2825, por un período de 15 años, contados a partir del 25 de mayo de 1995 y hasta el 25 de mayo de 2010, lo cual la convierte en bien demanial y, por ende, fuera del comercio de los hombres. Los reconvenidos, adjudicatarios de la parcela no. 48-1 del Asentamiento Salinas 1, no la explotan ni la trabajan. Existen contratos ilegales, sin autorización conforme a la ley, con lo que se tiene por cambiados los usos y fines para los que se otorgó. La abandonaron, al permitir que fuera trabajada y explotada en forma indirecta e ilegal por don Pedro Adrián Borges Fiol y doña Julia Ibarra Seas, tanto en lo personal como en nombre de sus representadas, por su orden, CIENFUEGOS y BLINKY, cuya posesión deviene ilegal, al estar sin autorización de su representado.
El señor Vargas Soto y la señora Salas Castro, así como don Pedro Adrián y doña Julia, tanto en lo personal como en nombre de sus representadas, negociaron a espaldas del Instituto, ya que, previo a cualquier negocio, era necesario la autorización de su Junta Directiva. Son nulas, de pleno derecho, las contrataciones realizadas por don Juan Diego y doña Kattia Matía con don Pedro Adrián y doña Julia, tanto en lo personal como en nombre de sus representadas, por así indicarlo el canon 67 de la Ley de Tierras y Colonización del 14 de octubre de 1961. La violación a las obligaciones, condiciones y restricciones, contenidas en los numerales 66, 67 y 68 íbid, conlleva a que los adjudicatarios pierdan el derecho sobre la parcela adjudicada. A raíz de todas las violaciones e ilegalidades imputadas, pide se revoque la adjudicación que hizo el IDA en acuerdo de Junta Directiva a favor de don Juan Diego y doña Kattia María.
En consecuencia, se anule la inscripción registral a nombre de ellos sobre la finca matrícula 293.864-001-002 y se revierta a nombre del Instituto, ordenándose su desalojo y el de cualquier otra persona que se encuentre en la indicada finca. En cuanto a las mejoras, los vencidos o quien en juicio demuestre ser su propietario, puede retirar las mobiliarias y, sobre las demás, se deben reconocer solo las útiles y necesarias para el desarrollo de la parcela, hechas con su propio peculio, lo cual se determinará en el respectivo proceso de ejecución. Solicita se ordene la cancelación en el Registro Público de cualquier anotación ordenada por la autoridad judicial en esta lite y que pese sobre la referida finca matrícula 293.864-001-002. Teniéndose por comprobado en este proceso que los principios de la Ley de Tierras y Colonización fueron violentados, estando en vigencia el período de las limitaciones legales, al incoar esta acción, se tenga por interrumpida su prescripción.
Se condene, en su proporción, al pago de ambas costas de la presente contrademanda a los vencidos, en caso contrario, se exima de su pago a su representado por ser su accionar conforme a derecho. Posteriormente -folio 725 del expediente principal Tomo II- aclaró que los contratos referidos como ilegales son los que han provocados el presente conflicto: el contrato de arrendamiento (folios 176 a 178), el traspaso de acciones que involucra supuestamente la parcela número 48-1 del asentamiento Salinas 1, así como la supuesta venta que alegan los demandados en la contestación de la demanda original y que supuestamente es lo que los mantiene en posesión del inmueble, la cual devendrían nulos. El INDER amplió la contrademanda en contra de Julia Ibarra Seas y Pedro Adrián Borges Fiol, en su condición personal y como representantes, por su orden, de BLINKY y CIENFUEGOS. Solicita se declare las mismas pretensiones; así como la nulidad, de pleno derecho, de las contrataciones: arrendamiento y traspasos de acciones que involucran la parcela, realizadas por don Juan Diego y doña Kattia con don Pedro Adrián y doña Julia, tanto en lo personal como en nombre de sus representadas, por su orden, CIENFUEGOS y BLINKY.
De igual forma, si quedara demostrado en este proceso que hubo traspaso o venta del inmueble, su nulidad, por así disponerlo el artículo 67 de la Ley no. 2825. De igual modo, contrademandó a JUVAKASA, requiriendo se declare en sentencia la procedencia de la contrademanda por quedar corroborado el incumplimiento de las obligaciones impuestas a los adjudicatarios, causa suficiente para la pérdida del derecho sobre la finca del partido matrícula 293864-001-002, que corresponde a la parcela número 48-1(A) del Asentamiento campesino, conocido como Salinas 1. Dicha heredad fue otorgada por el entonces IDA mediante un contrato especial, como lo es el de asignación de tierras, quedando sujeta a limitaciones (obligaciones, condiciones y restricciones) de la Ley de Tierras y Colonización y sus reformas. Se sujeta a las limitaciones de la Ley no. 2825 por un período de 15 años, contados a partir del 25 de mayo de 1995 hasta el 25 de mayo de 2010, lo cual le otorga un carácter de demanialidad y, por ende, se encuentra fuera del comercio de los hombres.
Los adjudicatarios de la parcela no. 48-1 en lo personal y en nombre de su representada, JUVAKASA, no la explotan, siembran, ni trabajan, manteniendo un abandono físico y permanente desde hace más de 10 años. Asimismo, han permitido que sea trabajada, sembrada, explotada en forma indirecta e ilegal, por parte de Pedro Adrián Borges Fiol y Julia Ibarra Seas tanto en lo personal como en nombre de sus representadas, por su orden, CIENFUEGOS y BLINKY, quienes han cambiado los usos y fines para los que se otorgó, realizando suntuosas construcciones y desarrollando proyectos ecoturísticos, cuya posesión deviene en ilegal, al no contar con la autorización del Instituto. Que don Juan Diego y doña Kattia tanto en lo personal como en nombre de su representada, JUVAKASA; así como el señor Borges Fiol y la señora Ibarra Sea tanto en lo personal como en nombre de sus representadas, contrataron arriendos, traspasaron acciones y negociaron con la cédula hipotecaria, involucrando esta parcela; efectuando en ella construcciones, trabajos y desarrollando proyectos ecoturísticos a espaldas del Instituto, ya que no contaron con la debida autorización de la Junta Directiva.
Asimismo, negociaron sin el permiso respectivo, ya que, previo a cualquier contrato que involucrara la parcela en litigio, era necesario la autorización de la Junta Directiva. Son nulas de pleno derechos las contrataciones (como el arrendamiento, los traspasos de acciones que involucran la parcela, el pago con la cédula hipotecaria), realizadas por don Juan Diego y doña Kattia María con don Pedro Adrián y doña Julia tanto en lo personal como en nombre de sus representadas, por su orden, JUVAKASA, CIENFUEGOS, y BLINKY. De igual forma, si quedara demostrado en este proceso que hubo traspaso o venta del inmueble, también es nulo, por así indicarlo el artículo 67 de la Ley no. 2825. La violación a las obligaciones, condiciones y restricciones contenidas en dicha legislación conlleva a que los adjudicatarios pierdan el derecho sobre la parcela adjudicada por el Instituto, revocándose la adjudicación; con la anulación del título de propiedad, revirtiéndose a nombre del IDA, hoy INDER, la finca en litigio.
Como consecuencia de todas la violaciones e ilegalidades imputadas, solicita se ordene el desalojo en contra de los demandados y de cualquier otra persona que se encuentre en la indicada heredad sin autorización del Instituto. En cuanto a las mejoras, los vencidos o quien en juicio demuestre ser su propietario, podrán retirar las mobiliarias y, sobre las demás, se deben reconocer solo las útiles y necesarias para el desarrollo de la parcela, hechas de su propio peculio, lo cual se determinará en el respectivo proceso de ejecución, conforme lo estipula el párrafo segundo del numeral 66 de la Ley de Tierras y Colonización. Pide se ordene la cancelación, en el Registro, de cualquier anotación ordenada por la autoridad judicial en este proceso, y que pese sobre el fundo en litigio. Dado que, al momento de incoarse la presente reconvención, las limitaciones se encuentran vigentes, y al estar comprobado en esta lite que los principios legales de la Ley de Tierras y Colonización fueron violentados, se tenga de pleno derecho por interrumpido su vencimiento.
Solicita se condene, en su proporción, al pago de ambas costas de la presente demanda a los vencidos. En caso contrario, se exima de su reconocimiento a su representado por ser su accionar conforme a derecho. Los demandados-reconvenidos Julia Ibarra Seas, Pedro Borges Fiol, CIENFUEGOS y BLINKY se opusieron a las pretensiones de la contrademanda. Interpusieron las excepciones de falta de: derecho, interés actual, acción, legitimación activa y pasiva. También invocaron la expresión genérica “sine actione agit”. De igual manera, los actores-reconvenidos se opusieron a las pretensiones de la reconvención. Alegaron las defensas de falta de: derecho, interés actual y legitimación. Alegaron las excepciones de prescripción negativa y caducidad. En cuanto a la caducidad, fue resuelta interlocutoriamente mediante auto de las 15 horas 41 minutos del 22 de junio de 2007. Por su lado, la empresa reconvenida JUVAKASA opuso las excepciones de prescripción negativa y caducidad.
IV.En lo conducente, la juzgadora A quo, tocante a la demanda en contra de Pedro Borges Fiol, Julia Ibarra Seas, CIENFUEGOS y BLINKY, rechazó las defensas de falta de: derecho, interés actual, legitimación activa y pasiva; así como la expresión genérica “sine actione agit”. Declaró sin lugar, en todos sus extremos, las pretensiones principales. Acogió la pretensión subsidiaria primera, solo para denegar el derecho de mejoras, frutos y el pago de mejoras a los demandados. De igual manera, declaró con lugar la pretensión subsidiaria segunda, únicamente en cuanto a que el contrato de arrendamiento suscrito entre BLINKY y los actores, respecto de la parcela en litigio, es nulo por no contar con la autorización del entonces IDA, por encontrarse vigentes las limitaciones de la Ley de Tierras y Colonización. Resolvió sin condena en costas. Respecto a la demanda en contra del IDA, hoy INDER, declaró procedentes las defensas de falta de: derecho y legitimación.
Omitió pronunciamiento en cuanto a la expresión genérica “sine actione agit”, según indicó, por estar comprendida dentro de las anteriores. En consecuencia, declaró sin lugar la demanda en todos sus extremos. Se resuelve sin condena en costas. En relación con la contrademanda formulada en contra de Juan Diego Vargas Soto, Kattia María Salas Castro, Julia Ibarra Seas y Pedro Adrián Borges Fiol, los dos últimos, en su condición personal y como representantes de las entidades CIENFUEGOS y BLINKY, rechazó las excepciones de prescripción, caducidad, falta de: acción, derecho, interés actual, legitimación activa y pasiva; así como la expresión genérica “sine actione agit”. En consecuencia, la acogió parcialmente en los siguientes términos:
V.En la primera censura, folio 4, alude el recurrente al incidente de presentación de documento extemporáneo. Afirma, no puede ser rechazado por las razones dadas en la sentencia. Las sentencias, indica, deben resolver todos los aspectos puestos en conocimiento a la persona juzgadora. El Ad quem, anota, adquirió la competencia en esta lite conforme a los agravios formulados por las partes en los recursos de apelación interpuestos. Dentro de las objeciones expuestas en el recurso vertical, señala, indicó que el incidente de documentos extemporáneos no podía ser rechazado por las razones dadas en la sentencia, toda vez que esos documentos eran fundamentales para la solución del presente asunto. En su criterio, la sentencia impugnada omitió hacer referencia a este agravio, lo cual viola los derechos de defensa y el debido proceso, generando la nulidad del fallo, ya que, insiste, no se resolvieron todos los agravios puestos en conocimiento del Tribunal.
El incidente, arguye, se presentó porque los documentos tienen íntima relación con el tema “probandum”, dado que, agrega, con ellos se demuestra la recomendación de campo de levantar las limitaciones; así como que el Departamento Jurídico también recomendó su levantamiento. Es evidente, afirma, las pruebas ofrecidas tienen conexión con el objeto del proceso. Por ello, concluye, la sentencia debe anularse, pues la documental ofrecida es fundamental para la resolución de este caso.
VI.El meollo de lo alegado en el reparo estriba en que, a criterio del recurrente, dentro de los agravios expuestos en el recurso vertical se afirmó que el incidente de documentos extemporáneos no podía ser rechazado por las razones brindadas en la sentencia de la A quo, ya que resultaban fundamentales para la solución de esta lite. Sin embargo, “En la sentencia de segunda instancia, no se hace referencia a este agravio, lo cual viola los derechos de defensa y el debido proceso, oq ue [sic] genera la nulidad de la sentencias [sic], pues la misma no resolvió todos los agravios que al Tribunal se les puso [sic] en conocimiento, por lo que pido que la sentencia sea anulada.” De darse lo argüido por el casacionista, configuraría un motivo casacional por razones procesales. En concreto, el vicio de incongruencia. Al respecto, precisa indicar, en primer lugar, la reforma procesal laboral introducida mediante Ley no. 9343 del 25 de enero de 2016 está vigente desde el 25 de julio de 2017. En la norma transitoria I se indica: “La presente reforma será aplicable a los procesos iniciados antes de la vigencia de esta ley, con las siguientes excepciones: /
VII.Dentro de esta línea de pensamiento, en torno a la pertinencia de alegar ante esta Sala quebrantos de naturaleza procesal en materia agraria con la legislación procesal anterior, como el invocado por el casacionista, este órgano decisor ha indicado “V.- […] a partir de la sentencia 583 de las 11 horas 35 minutos del 14 de julio del 2004, lo cual es reiterado, entre otras, en las números 608 de las 9 horas 10 minutos del 23 de julio, 1074 de las 11 horas 20 minutos del 16 de diciembre, ambas del 2004 y 892 de las 9 horas del 25 de noviembre del 2005, esta Sala determinó la procedencia, en la materia agraria y en ciertos supuestos, del recurso de casación por ese motivo. Al respecto, el artículo 559 del Código de Trabajo, aplicable a este tipo de procesos por expresa remisión del canon 61 de la Ley de Jurisdicción Agraria, dispone: “RECURSO DE CASACIÓN. RECHAZO DE PLANO. Recibidos los autos, la Sala rechazará de plano el recurso si se ha interpuesto contra lo que disponen los artículos 556 y 557.
Lo mismo hará cuando en el recurso se pida únicamente la corrección, reposición o práctica de trámites procesales.” (Lo subrayado no es del original). En relación con este asunto, interesa la segunda parte del numeral en comentario. La doctrina procesalista ha indicado que los motivos de casación dispuestos en el ordinal 594 del Código Procesal Civil, pueden darse en las tres fases del proceso:
VIII.La juzgadora A quo, en el considerando III de su sentencia, indicó: “III. INCIDENTE DE DOCUMENTO EXTEMPORÁNEO: A folio 2085 del Tomo VI principal, consta presentado documento por parte del actor reconvenido Juan Diego Vargas Soto. Corresponde a copia de sentencia número 30 de las 14:30 horas del 22 de marzo de 2010, del Juzgado Tercero Civil de San José, en expediente número 09-000022-182-CI. Dicha parte no expone con claridad su pretensión incidental, en cuanto a la presentación de este documento, por lo cual de conformidad con el artículo 483 inciso 1) del Código Procesal Civil, se rechaza esta articulación. […]”. Por su parte, el Ad quem, en el apartado IV de la sentencia impugnada, en lo conducente, indicó: “IV. […] Por separado, Juan Diego Vargas Soto apeló. […] II. El incidente de documentos extemporáneos no puede ser rechazado por las razones expuestas en la sentencia. En tal articulación se aportaron documentos relacionados con el tema probandum, al comprobarse la recomendación de campo de hacer el levantamiento de limitaciones.
Este rechazo debe impugnarse porque la documental ofrecida es fundamental para la resolución del asunto.” Luego, en el considerando V, las personas juzgadoras consideraron: “V. Se resuelve en primer orden el recurso del actor reconvenido Juan Diego Vargas Soto. El tema concierne al incidente de hechos nuevos, el cual fue rechazado en sentencia, estima los documentos ofrecidos por esa parte son relevantes para la decisión del asunto. Dice se debe aceptar [sic] porque se trata de documentos donde se analiza lo concerniente al levantamiento de las limitaciones. Sin embargo, el incidente rechazado, se relaciona con las copias de dos sentencias emitidas dentro del proceso ordinario de Cien Fuegos Rancho Limitada contra Juan Diego Vargas Soto, bajo el número 09-000022-182-CI, tramitado en el Juzgado Tercero Civil de San José. La primera decisión judicial es de primera instancia, de las 14 horas 30 minutos del 22 de marzo de 2010 donde se decretó la deserción de ese proceso (Escritorio virtual Juzgado Agrario de Alajuela, archivo de documentos asociados, tomo VI, imágenes de los folios 2079 a 2084).
La otra, de segunda instancia donde se declaró mal admitida la apelación contra esa resolución. De acuerdo al artículo 293 del Código Procesal Civil de aplicación supletoria contiene una lista donde se elencan las causales por las que se puede admitir un documento extemporáneo. El alegato de la quejosa [sic] radica en que son posteriores a la presentación de la demanda, sin embargo, no constituye relevante para la resolución del asunto; tampoco es prueba complementaria o bien para combatir las excepciones. De la lectura de esas piezas solo se infiere la existencia de un proceso donde no se desprende tenga relación directa con lo aquí debatido.” (Lo subrayado es del original). A la luz de lo anteriormente transcrito, distinto a lo señalado por el recurrente, el Tribunal sí se pronunció acerca del agravio interpuesto por el rechazo del incidente de documentos extemporáneos, razón por la cual, no se configura el yerro invocado.
Asimismo, el casacionista no cuestionó los fundamentos esgrimidos por el Tribunal a efecto de denegar la admisión de las sentencias aportadas extemporáneamente. Se limitó a reiterar lo argüido en el recurso de apelación. Ergo, no se producen los quebrantos al principio del debido proceso y, en concreto, al derecho de defensa invocados en el reparo, ya que el Tribunal, se repite, contrario a los intereses del apelante, resolvió la objeción formulada en el recurso vertical. Corolario, se impone el rechazo del motivo de disconformidad en estudio.
IX.En la segunda censura, folio 6, alega el recurrente error de hecho en la valoración probatoria. Manifiesta, no es posible revocar una parcela por supuesto incumplimiento de parte del parcelero, si las limitaciones estaban vencidas y las obligaciones cumplidas. A propósito de la morosidad administrativa. En las sentencias recurridas, anota, se hace una interpretación normativa, exegética, formalista, sin un contenido interpretativo sistemático, material, evolutivo ni ajustado a la realidad de las probanzas constantes en autos. El tema de la morosidad administrativa, dice, está reconocido en los dictámenes legales del IDA -hoy INDER-. Incluso, añade, la Junta Directiva ha establecido levantamientos de limitaciones fundados en la morosidad administrativa. En las sentencias impugnadas, anota, se desconoció, como si no fuera un aspecto que ha sido aplicado constantemente en dicho Instituto. En su criterio, solo hacen un análisis formal de la ley y de lo inscrito en el Registro, pero sin valorar el fondo de su realidad, reflejada en las probanzas constantes en autos.
No es lo mismo, arguye, adjudicación primaria a traspaso de la adjudicación. No se dio una adjudicación de parcela a su favor; sino un traspaso de parcela a cambio del pago de las mejoras. Al adquirir la adjudicación ya otorgada, manifiesta, obtuvo la situación jurídica de los transmitentes: obligaciones, plazos transcurridos, faltantes de limitaciones, etc. Solo debía completar, dice, el plazo faltante para que las restricciones o limitaciones vencieran. No se le puede aplicar las regulaciones de una adjudicación primaria, afirma, pues, su situación jurídica no era “ex novo”; sino derivada. En consecuencia, agrega, se le cedió la situación jurídica de los transmitentes. No estuvo sujeto, ni su esposa, a un plazo de prueba para determinar si se les adjudicaba la parcela. Por el contrario, señala, al adquirir el fundo con el historial jurídico que tenía, los plazos de las limitaciones iniciaron en 1981, por lo que, cuando la adquirió, tenía el plazo transcurrido por su transmitente a su favor.
Dicho traspaso, explica, se efectuó de la siguiente manera: según acuerdo de la Junta Directiva, artículo XVI de la sesión no. 2450 del 3 de marzo de 1981, se le otorgó al señor Dagoberto Rojas Fallas la adjudicación de la parcela no. 48. El 11 de junio de 1983, arguye, artículo XII de la sesión no. 122, la Junta Directiva autorizó su división en dos, originan las parcelas números 48-l(A) y 48-2(B), adjudicándole la no. 48-1(A) a Ubaldo Rojas Fallas. El 11 de junio de 1984, prosigue, la Junta Directiva, en el artículo IX de la sesión no. 399, autorizó el traspaso de la parcela 48-1 de Ubaldo Rojas Fallas a él, Juan Diego Vargas Soto. El IDA le traspasó dicha parcela, siendo escriturado el traspaso el 25 de mayo de 1995 a nombre suyo y de su esposa, Kattia Salas Castro en partes iguales (a pesar de que las mejoras fueron adquiridas solo por él, la ley obligaba que el traspaso fuera a favor del matrimonio).
Se inscribió en el Registro Público de la Propiedad con la matrícula 293.864-001-002. La morosidad administrativa, subraya, es clara, pues, la parcela en litigio -no. 48-1(A), fue adjudicada en 1981, pero fue escriturada en 1995, a pesar de que se le traspasó en el año 1984. El inmueble, anota, se encuentra sujeto, registralmente, mas no legalmente, a las limitaciones de la Ley de Tierras y Colonización, Ley no. 2825 del 14 de octubre de 1961. Fue adjudicado el 3 de marzo de 1981 y traspasado el 11 de junio de 1984, por lo que, habían pasado 26 años desde la adjudicación. Esto, acota, evidencia la morosidad administrativa y negligencia del IDA (INDER), porque solicitó, en reiteradas ocasiones desde el 24 de julio de 1998 por parte de la Asociación de Productores de Trinidad de Uvita, su levantamiento. Aproximadamente en el año 2000, expone, volvió a solicitar el levantamiento de las limitaciones, realizando, para ello, todos los trámites necesarios en la Regional.
Tan es así, relata, la Regional del Pacífico Central en Coyolar, diagnosticó, por medio de sus técnicos, las condiciones en que se encontraba en ese momento la parcela y que existía morosidad administrativa; además de que cumplía con lo establecido por la Institución para el levantamiento de las limitaciones. El criterio legal de la Regional del Pacífico Central, recomendó, por las condiciones presentadas por la parcela no. 48-1(A) del asentamiento Salinas 1, sostiene, su liberación por la morosidad administrativa del IDA (INDER). Le causa extrañeza que en la reconvención presentada por el IDA (INDER), su representante legal, en calidad de gerente de la institución, elevó, con el visto bueno, las recomendaciones de la Regional del Pacífico Central en Coyolar a la Junta Directiva para el levantamiento de las limitaciones de la indicada parcela, lo cual aparece en el expediente administrativo.
El inmueble, al momento de los hechos que originan este conflicto, sostiene, ya no tenía limitaciones jurídicamente hablando, solo aparecen en el Registro, pero formalmente, pues, están sobradamente vencidas. Tampoco, agrega, existen obligaciones pendientes con el Instituto. La Procuraduría General de la República -PGR-, afirma, dictaminó que el plazo de las limitaciones comienza a contar a partir de la fecha de la adjudicación. Calcula, si la parcela fue adjudicada el 3 de marzo de 1981, las limitaciones vencieron el 3 de marzo de 1996. Tal dictamen, manifiesta, es la base legal mediante el cual el IDA (INDER), en todos los casos, ha levantado limitaciones a beneficiarios por morosidad administrativa. Las sentencias cuestionadas, arguye, desconocen los dictámenes de la PGR, así como la costumbre administrativa que al respecto se ha generado en el INDER en casos similares. Además, prosigue, aprecian mal la prueba y aplican erróneamente el derecho, ya que no reconocen que su adquisición y la de su esposa fue derivada, aplicando como si fuera originaria, negándoles más de 10 años de plazo adjudicado en su perjuicio.
Con base en lo anterior, y respetándose el principio constitucional de igualdad, asevera, cuando alquilaron la casa edificada en el inmueble, no pesaba limitación alguna, en consecuencia, el IDA (INDER) carece de derecho, interés actual y legitimación. Las sentencias objetadas, insiste, valoraron indebidamente la prueba, aplicaron erróneamente el derecho de fondo, al considerar que hay una nueva adjudicación, cuando no fue de esa manera, ya que así no consta en la prueba evacuada. Ha estado sometido a prueba. Desde que adquirió la parcela, alega, la ha producido y su titularidad nunca estuvo sujeta a un período de prueba. La parcela, señala, está exenta de limitaciones desde el 3 de marzo de 1996. Siempre que se iba a llevar a cabo un acto de disposición se solicitó permiso a la Junta Directiva. Cuando se dio el proyecto de ganado, acota, financiado por el Banco Popular y de Desarrollo Comunal -BPDC-, por medio de la Asociación de Productores de la Trinidad y Uvita, se solicitó la autorización respectiva.
De igual maniera, agrega, cuando se realizan los trámites para una hipoteca, la Junta Directiva los autorizó. Durante ese período de transición, manifiesta, el IDA los facultó a tramitar cualquier gestión para no perder la parcela por la hipoteca otorgada por el Sistema Bancario Nacional. También, explican, le solicitaron a la Regional el permiso correspondiente para alquilar solo la casa de habitación. Lo anterior, indica, queda claro con la declaración de los testigos, quienes corroboran lo expresado desde el inicio del presente proceso; la sentencia los citó, pero no los valoró adecuadamente. El testigo Leonel Alpízar Solórzano (folio 1557 del tomo V escaneado), manifestó que labora como Jefe Regional de Orotina del IDA (INDER). Afirmó conocer la parcela. La visitaba para inspecciones cuando daba asistencia técnica. Desde 1982 trabaja en el Instituto. Como desde el año 2002 no visita la parcela.
Fue enfático, refiere, en que no autorizó el arrendamiento de esta parcela. Recuerda que don Juan Diego gestionó el levantamiento de las limitaciones, pero no conoce el resultado. Reconoce, arguye, gestionó el levantamiento de las limitaciones con el argumento de la morosidad administrativa, que sirve, a su vez, de fundamento para levantamientos en otras parcelas. En todo caso, señala, las limitaciones ya estaban vencidas, y lo único que hacía falta era una formalidad de levantamiento registral, pero el plazo para levantarlas estaba cumplido y no se tenían obligaciones con el Instituto. Por su lado, el testigo Juan Abarca Chacón (folio 1560 Tomo V escaneado) dijo ser parcelero del asentamiento y que conoce la parcela en litigio desde hace 20 años. Le consta que don Juan Diego sembraba chile, papaya, tomate, chile dulce. Afirmó que, como en el año 2000, trabajó como peón a don Pedro. Ignora qué negocio había entre don Pedro y don Juan Diego.
Asimismo, señala, el testigo Gerardo Muñoz Romero (folio 1561, tomo V), refiere los actos posesorios realizados por don Pedro Borges en la parcela a finales del año 1998 o inicios de 1999. No sabe qué relación tenía con don Juan Diego Vargas, pero le consta que en el terreno se encontraba don Pedro. El deponente conoce el inmueble desde 1990 o más, vive en la zona desde ese año y cerca de la parcela. Dio fe acerca de los sembradíos hechos por don Juan Diego y que vivía en la parcela. Afirmó que, a partir de finales del año 1998 o inicios de 1999, don Juan Diego se fue a Orotina y, desde entonces, vio que don Pedro se fue a vivir a la parcela, pero don Juan Diego siguió sembrándola. También mencionó las construcciones que existían en el terreno. El declarante Constantino Mondragón Medrano (folio 1529 del tomo V), comenta, indicó que trabajó en el IDA hasta aproximadamente el año 1998. Redactó una nota en borrador, la cual no se firmó, referida al alquiler de la casa (tan solo la casa).
No vio la solicitud oficial. Desconoce qué pasó con ese documento. Expresa que don Juan Diego la presentó. Indica el recurrente, lo anterior demuestra que pidió permiso, asesorado por los mismos personeros del Instituto. El que no se tramitara, apunta, no es de su conocimiento porque es campesino. Entendió que, con las gestiones realizadas, estaba autorizado para actuar y hacer el arrendamiento. Si eso no fue así, no comprendió que no tuviera permiso. En todo caso, señala, el permiso era innecesario, porque las limitaciones estaban vencidas, lo cual no fue analizado en la sentencia impugnada. Se solicitó la autorización indicada en la ley, sostiene, a pesar de que las limitaciones se encontraban vencidas. Se deben contabilizar desde la única adjudicación que hubo, la cual fue a favor de Dagoberto Rojas Fallas; además, no se tenían compromisos ni obligaciones con el Instituto. El IDA (INDER), insiste, solicitó la revocatoria de parcela, a pesar de que las limitaciones ya se encuentran vencidas, producto de su propia morosidad.
Esto, en su criterio, no es más que tratar de sacar provecho de su propio dolo, ya que, sabiendo que es moroso y que ya vencieron las limitaciones, se vale de su morosidad para solicitar la revocatoria. Esta situación, afirma, inaceptable, es avalada por las sentencias impugnadas, las cuales hacen una valoración formalista y contraria a los principios que informan el Derecho Agrario. Las limitaciones estaban vencidas, reitera, a pesar de ello, se pidió permiso, pese a no requerirse. No ha habido incumplimiento de sus obligaciones, señala, tampoco contratos ilegales. Si no explotaba directamente la parcela en litigio, señala, es porque ha sido despojado ilegítimamente. No ha podido explotar ni trabajar la parcela en ninguna forma porque, con consentimiento y apatía del IDA, don Pedro Borges Fiol y doña Julia Ibarra Seas, le impidieron acercarse a su finca, la convirtieron en un fortín con armas pesadas y guardas por doquier.
No se comparte el alegato de morosidad administrativa señalado en la sentencia impugnada. Transcribe, en lo de su interés, lo considerado por la juzgadora A quo en el considerando VIII de su sentencia. De la misma manera, reproduce, en lo conducente, lo expuesto por el Ad quem en el considerando V. El argumento para rechazar la morosidad administrativa, arguye, no se sostiene por las siguientes razones:
X.La formulación del agravio en estudio es confusa. No obstante, y luego de su análisis pormenorizado, esta Cámara determina que el argumento central se enmarca en dos puntos: 1) la parcela no. 48 del asentamiento Salinas 1, fue adjudicada por la Junta Directiva del entonces IDA, el 3 de marzo de 1981, a señor Dagoberto Rojas Fallas. El 11 de junio de 1983, lo autorizó a dividirla, constituyéndose las parcelas 48-1(A) y 48-2(B). A Ubaldo Rojas Fallas le fue adjudicada la no. 48-1(A). El 11 de junio de 1984, la Junta Directiva autorizó se le traspasara a él, Juan Diego Vargas Soto. No obstante, la escritura se formalizó hasta el 25 de mayo de 1995. En consecuencia, su adquisición es derivada, no originaria. Por ello, se beneficia del plazo gozado por el anterior adjudicatario (Dagoberto Rojas Fallas). Se valoró indebidamente la prueba y se aplicó erróneamente el derecho al considerarse que su adjudicación fue nueva; cuando, en realidad, fue derivada.
Si la adjudicación se realizó el 3 de marzo de 1981, las limitaciones vencieron el 3 de marzo de 1996. Pese a haberse solicitado su levantamiento, la Administración no lo hizo, incurriendo en morosidad administrativa. 2) a esta lite le resulta aplicable la figura del silencio positivo, en cuanto a la solicitud de autorización de levantamiento de las limitaciones. Sin embargo, resulta intrascendente o irrelevante, ya que, se encontraban vencidas.
XI.El casacionista invoca error de hecho en la valoración de la prueba. Empero, acorde a la fundamentación del reparo, lo invocado no son meros yerros materiales en la apreciación del material probatorio; sino su indebida valoración, lo cual, de darse, originaría un vicio por violación indirecta de ley, pero por error de derecho. Para tener una cabal compresión, es menester reproducir, en lo de interés y pese a su extensión, lo expuesto por el Ad quem en los considerandos VI, VII y VIII de la sentencia cuestionada. “Respecto al agravio de la morosidad administrativa lleva parcialmente razón el apelante, aunque no es suficiente para modificar todo lo resuelto por lo que se explica de seguido. Esta Cámara es del criterio, que el inicio del cómputo de las limitaciones en los contratos de asignación de tierras es con el acto administrativo de adjudicación. En otros términos, es en el momento en el cual la Junta Directiva del Instituto de Desarrollo Rural, en lo sucesivo identificado como INDER o el Instituto, otorga la parcela a las personas administradas.
Nótese el canon 65 de la Ley de Tierras y Colonización, establece la diferencia arriba indicada: primero se da el acto de adjudicación y luego se otorga el título de propiedad. En el caso bajo examen, el fundo en litis había sido adjudicado por el INDER a una tercera persona. En el año 1986 se emitió el acuerdo de Junta Directiva del Instituto en referencia, acuerdo 9, artículo IX de la sesión número 399, celebrada el 17 de junio de 1986, el cual está contenido en el oficio ORCC-754-86 datado del 29 de diciembre de 1986, dirigido al apelante Vargas Soto. En lo que interesa indica: “...se aprobó el traspaso de la parcela N°48-A, del Asentamiento Salinas, adjudicada al señor UBANDO [sic] ROJAS FALLAS, a su favor’ (lo destacado es del original en Escritorio virtual Juzgado Agrario de Alajuela, archivo de documentos asociados, tomo IV, imagen de folio 1220). De ahí se tiene, indistintamente de la fecha en que se rubricó el instrumento público que permitió la inscripción en el Registro Nacional del inmueble en conflicto, el plazo de las limitaciones inicia a partir del 17 de junio de 1986.
En apoyo a la tesis esbozada, la Sala Primera de la Corte Suprema de Justicia en voto número 275-S1-F-2011 de las 09 horas 10 minutos del 17 de marzo de 2011 explicó: […] Como lo señala la Alta Cámara el instrumento público finiquita el acuerdo tomado por la Junta Directiva. En este asunto también se comprobó, la escritura pública fue otorgada ante los oficios del Notario Público […] a las 16 horas del 25 de mayo de 1995, según consta en la copia del testimonio de escritura en el tomo I imagen del folio 33 a 34. No obstante, como se indicó el inicio de los 15 años de limitaciones es a partir del 17 de junio de 1986, por lo que realizado el cómputo del plazo, las limitaciones se vencieron el 17 de junio de 2001, y no el 25 de mayo de 2010 como lo señala la información registral emanada de las certificaciones de fojas 357 y 360 de las imágenes del tomo II del expediente, lo anterior con fundamento en el canon 140 de la Ley General de Administración Pública.
El otro asunto que resulta imperante clarificar dado lo agraviado, es la manera de proceder cuando se está frente a una situación como la relatada, donde hay una diferencia temporal importante entre el acto de adjudicación y la inscripción registral. Dado se trata de un acto administrativo, desde la perspectiva de su ejecución, se da una diferencia temporal en detrimento de los derechos de la persona administrada, es necesario modificar lo consignado en la información registral o retrotraer esos datos a efecto sea coincidente con el acto administrativo. Quien se encuentra legitimado para hacerlo en este caso es el mismo Instituto. Es menester, el órgano administrativo ejecute los trámites pertinentes, la cual [sic] deberá ser inscrita en el Registro Nacional a efecto de brindar la publicidad registral correspondiente. Empero, ha de subrayarse, la persona administrada de facto no puede realizar esa reforma a la información registral.
Mientras no cuente con una resolución judicial o administrativa donde expresamente se le indique el plazo real de las limitaciones debe continuar cumpliendo con las obligaciones a las cuales se sujetó en virtud del contrato de asignación de tierras. Adicionado a lo expresado, el INDER ha tenido este escenario puntualizado y clarificado, al ser reconocida en diversos documentos con criterios legales, señalados por los intervinientes; los cuales a su vez recogen razonamientos de la Procuraduría General de la República, vinculantes para la Administración Pública. En autos consta el oficio AJORO 65 del 07 de julio de 2003, rubricado por el letrado […] en su condición de asesor de asuntos jurídicos de la Región Pacífico Central, donde cita el criterio de la representación estatal C-072-2001. En lo que interesa, se resalta un segmento de la consulta, donde se desprende se debe solventar la conducta omisiva, mediante prueba indubitable del momento en que pudo haberse producido el acto adjudicatorio.
Al mismo tiempo, el antedicho profesional explicó: "... corresponde al Instituto la verificación de tales hechos, fundamentándose en criterios técnicos que se rinden en cada caso...”. Por lo anterior, es necesario la persona administrada realice los trámites pertinentes para hacer los ajustes a los plazos de limitaciones constatados en el Registro Nacional. En la especie, la gestión para el levantamiento de las limitaciones, constan en un oficio rubricado por el apelante, pero en su condición de Presidente de la Asociación de Productores Trinidad y La Uvita del 24 de junio de 1998 donde solicitó: “Sirva la presente para solicitarle la liberación de las limitaciones que sostenta (sic) nuestras escrituras las que fueron otorgadas muchos años después de la adjudicación de las tierras de Salinas uno... Esta liberación la solicitamos porque Salinas uno esta [sic] ubicada en la zona declarada industrial y esto nos representa un panorama diferente de lo que es el sector agropecuario...” (consta en la imagen 4, del legajo de pruebas V).
De lo anterior se infiere era de conocimiento del apelante que debía realizar un trámite para el levantamiento de las restricciones en cita. Sumado al hecho, con anterioridad había solicitado autorización para pignorar el bien (copia de cédula hipotecaria y testimonio de escritura de constitución de gravamen en imagen de folio [sic] 35 y 36 del tomo I respectivamente), esta Sede arriba a la conclusión, el apelante era conocedor de su deber de efectuar el trámite pertinente para realizar cualquier gestión tendiente a la disposición de la parcela. Nótese en las imágenes del tomo V, que corresponden a los folios 1801 a 1822 se agregaron diversos memorandos entre varios funcionarios del INDER, donde se analiza la gestión del levantamiento de las limitaciones. Pliegos rubricados entre el 18 de noviembre de 1999 al 04 de enero de 2000. En estos se menciona la posibilidad de levantarlas, sin embargo, el razonamiento era sumar el tiempo en que otras personas la habían tenido en su posesión, y no separando solo el lapso de los actores reconvenidos Vargas Soto y Salas Castro.
Estas notas, como se verá de seguido, no es suficiente para tener por levantadas las limitaciones, abonado, para ese momento, 1999, ya el bien había sido dado en arrendamiento a Pedro Borges y compañías. En apoyo a lo anterior, el declarante Jorge Arturo Gutiérrez Rojas, quien fungió como director de la Región Pacífico Central explicó el procedimiento a seguir para el levantamiento de las restricciones: “...Para levantar las limitaciones del IDA, en lo normal, a partir del momento en que se firma la escritura, por ley 2825 deben transcurrir quince años para que la institución pueda entrar a conocer el levantamiento de limitaciones, y se debe estar al día con las deudas con la Institución, que la finca esté explotada por el beneficiario original, se le hace una inspección; la oficina Subregional recomienda a la Asesoría jurídica de la Dirección la cual valora y lo pasa a Dirección de Jurídicos y luego se pasa a Gerrencia (sic), y después a Junta Directiva quien decide ...
La junta directiva puede negar el levantamiento ejemplo cuando hay deudas por tierra y Caja Agraria, hayas (sic) causales para nulidad del título” (imagen de la foja [sic] 1542 del tomo V). Las manifestaciones de tal funcionario, las cuales por su experiencia le merecen credibilidad a esta Instancia, son concordantes con lo trascrito en el informe jurídico supra aludido, con la legislación en cita y lo declarado por el también funcionario del INDER Leonel Alpízar Solorzano (imagen de la página 1559 del tomo V). VII. Relacionado con el reclamo de la aludida morosidad, emerge el inicio del cómputo del plazo. Como se expresó de manera amplia en el considerando anterior, el cálculo del plazo inicia a partir del acuerdo de la Junta Directiva del INDER. Empero, considera el quejoso, de manera reiterada, las limitaciones empezaron a partir del 03 de marzo de 1981. Para alcanzar esa conclusión, expresa hay morosidad administrativa, consecuentemente no existían las prohibiciones al momento de alquilar el bien.
No obstante, esa tesis no es admisible por lo siguiente. El contrato de adjudicación de tierras, posee un plazo de quince años, mediante el cual, las personas parceleras deben de comprobar la idoneidad para la adecuada explotación del fundo. En esencia, en el momento de la adjudicación, no se concede un derecho de propiedad, porque al ser un contrato de duración, esa titularidad se consolida al cumplir además del lapso indicado, con las obligaciones señaladas en el convenio, su capacidad técnica y experiencia. De ahí, es un contrato que exige demostrar destrezas y aptitudes en el ejercicio de la actividad agraria, sin que se pueda beneficiar a quien se le adjudica de la posesión ejercida por anteriores contratantes. Debe demostrar la persona beneficiaria por sí, durante quince años, el cumplimiento de las obligaciones contenidas en los ordinales 65, 66, 67 y 68 todos de la Ley de Tierras y Colonización.
Es infundada la tesis, de acuerdo a la normativa señalada, el cómputo del plazo para el vencimiento de las limitaciones, se inicia cuando es adjudicada por primera vez. Como se tuvo por demostrado, el contrato de adjudicación en cita inició el 17 de junio de 1986 para el recurrente Vargas Soto y su esposa Kattia Salas, siendo el vencimiento era dable hasta el 17 de junio de 2001. Por último, en este cúmulo de agravios, señala el apelante con la testimonial se puede probar su dicho. Sin embargo, como se expuso, en la especie, el plazo se [sic] las prohibiciones se debía obtener la debida comunicación de la Junta Directiva para retrotraer los efectos. Las declaraciones, algunos funcionarios del INDER refieren sobre los actos posesorios del recurrente. Constantino Mondragón Medrano (tomo V, imagen de folio 1529), sostiene conocer la propiedad, adujo haber laborado para el Instituto. Sus manifestaciones no guardan relación con las gestiones del levantamiento de las prohibiciones sino con un presunto permiso para alquilar la parcela.
En igual línea de relato, el deponente José Fabio Salas Villegas se refirió a presuntas gestiones para alquilar la finca y actos posesorios del recurrente (imagen del folio 1533 del tomo V). Por otro lado, el testigo Álvaro Enrique Chaves Monge, suministró datos sobre la posesión de Pedro Borges y la visita de un funcionario del INDER donde indicó había una gestión para “eliminar las limitaciones” pero que era de conocimiento del citado codemandado Borges (imagen de página 1538 del tomo V). No aportó datos de relevancia el empleado del Instituto en este aspecto, Jorge Arturo Gutiérrez Rojas quien adujo ser el director de la Región Pacífico Central entre los años 1984 a 1986. Agregó haber estado presente, de manera circunstancial, cuando el apelante llegó a conversar con quien era en ese momento el Presidente Ejecutivo del IDA, […] sobre el levantamiento de las limitaciones. Por otra parte, el funcionario Leonel Alpízar Solórzano, quien al momento de rendir declaración fungía como Jefe Regional de Orotina, citado en el memorial de apelación, explicó haber realizado una visita de campo para el levantamiento de las limitaciones, que según explicó es el primer paso para esa gestión, afirmando; “...no tengo conocimiento hasta donde [sic] llegó, pero es claro que el levantamiento no se dio, no culminó con acuerdo de Junta...” (imagen de foja 1559 del tomo V).
También agregó, creer que el Jefe Regional en aquel momento gestionó para que declinaran la gestión, pero no le consta. El letrado […] (imagen 1543), […] (imagen de página 1547 tomo V), el declarante […] (imagen de foja 1551), el señor […] (imagen de la página 1560); y […] (imagen del folio 1561), todos ubicados en el tomo V del expediente virtual, tampoco aportan datos de interés para este punto. Valorada en conjunto las probanzas al tenor del canon 54 de la Ley de Jurisdicción Agraria, es evidente hay una carencia de elementos probatorios para sostener el dicho del apelante. También recrimina el INDER sacó provecho de no hacer el levantamiento de las limitaciones y pedir la revocatoria. Tal alegato, estima esta Sede, es falaz e infundado, porque más bien de las declaraciones citadas de los funcionarios del INDER se denotó el conocimiento en diversas inspecciones, había una explotación diversa a la cual debían cumplir los parceleros sin que existiera, del estudio del expediente administrativo de ese Instituto una reacción acorde con el ordenamiento jurídico (imágenes del legajo de prueba VI), donde se da una amonestación hasta el 13 de febrero de 2003 (imagen del folio 95, tomo I), a pesar de existir una nota de los adjudicatarios del 06 de marzo de 2002 (imagen de foja 117 tomo I) donde dan cuenta del contrato de arrendamiento de su casa, lo cual evidencia una desidia en el cumplimiento de las obligaciones fiscalizadores [sic] del INDER.
Se desea subrayar, consta en autos, producto de tales amonestaciones, no se llegó a culminar un procedimiento administrativo. Cuando se verificó una amonestación, según el oficio FVB-OSO-003-2006 del 05 de enero de 2006 rubricado por el ingeniero […], señaló al ingeniero […], ante el proceso penal seguido en este asunto, en su momento se suspendió el trámite administrativo porque considera son los Tribunales de Justicia los que deciden sobre los derechos e infracciones cometidos al contrato (imagen 145 del tomo de prueba VI). Más adelante, en el expediente administrativo consta, que se realizó una nueva amonestación, dado se ordenó [sic] una inspección de campo (imágen [sic] de la página 188, tomo VI de prueba), el 30 de marzo de 2007, sin que culminara en una recomendación y remisión de los autos a la Junta Directiva, como tampoco una resolución para suspender formalmente el procedimiento administrativo.
VIII. Los reproches del silencio administrativo tampoco tienen asidero legal. El artículo 330 de la Ley General de Administración General, regula lo concerniente a esta figura. El inciso 1) indica, el silencio de la Administración se entenderá positivo cuando así se establezca expresamente o cuando se trate de autorizaciones o aprobaciones que deban acordarse en el ejercicio de funciones de fiscalización y tutela. Por otra parte, el acápite 2) contempla, se entenderá positivo el silencio cuando se trate de solicitudes de permisos, licencias y autorizaciones. Efectivamente como lo apunta el recurrente, es una autorización lo que debía obtener para aplicar la morosidad administrativa a las limitaciones. Es menester, para su procedencia, quien gestiona ante la Administración cumpla con todos los requisitos, porque en el segundo inciso se hace referencia a actos reglados. Empero, en el subexamine, no se cumplieron todos los requisitos para retrotraer los efectos de la información registral. Tal y como se ha indicado en líneas anteriores, las restricciones se vencían en el año 2001 y no antes.” (Lo subrayado es del original).
XII.Esta Sala comparte el criterio del Tribunal, en el sentido de que, para esta lite, el plazo de las limitaciones inició con el acto administrativo emitido por la Junta Directiva del entonces IDA de otorgamiento de la parcela al matrimonio actor el 17 de junio de 1986 y no con el otorgamiento de la respectiva escritura pública (preceptos 65 de la Ley de Tierras y Colonización y 140 de la LGAP). Así lo ha reconocido esta Sala en el fallo indicado por el Ad quem, no. 275 de las 9 horas 10 minutos del 17 de marzo de 2011, en donde se citan otros precedentes, al indicar, en lo de interés: “[…] El instrumento público notarial no alcanza a disminuir la importancia, ni mucho menos sustituir el acto administrativo en cuestión. De ahí que los efectos del contrato de asignación de tierras, nazcan a la vida jurídica, con el acuerdo de Junta, en tanto se trata de un acto administrativo, debidamente fundamentado, que cumple con los requisitos legales necesarios a fin de distribuir bienes del IDA entre los parceleros objeto del contrato.” En igual sentido, puede consultarse, mutatis mutandis, la sentencia no. 1018 de las 13 horas 45 minutos del 23 de agosto de 2012.
Como bien lo indicaron las personas juzgadoras, en el contrato de asignación o adjudicación de tierras, al amparo de lo previsto en los cánones 65, 66, 67 y 68 de la Ley de Tierras y Colonización, las personas parceleras deben comprobar su idoneidad para la adecuada explotación del fundo durante todo el plazo de las limitaciones, es decir, durante los 15 años. Es por ello, compartiéndose lo afirmado por el Tribunal, que dicha institución no concede un derecho de propiedad, por ser un contrato de duración. El interés público que subyace en este tipo de contratos se refleja en las limitaciones impuestas por la Ley de Tierras y Colonización. Estas tienen como objeto cumplir con la función social de la propiedad, ya que las personas beneficiarias serán aquellas que cumplan ciertas condiciones para ser calificadas como tales, a efecto de que desarrollen la empresa agraria. En esta misma línea de pensamiento y desde vieja fecha, esta Sala ha indicado: “[…] el contrato de asignación de tierras es un contrato de duración por el cual el ente agrario adjudica a un beneficiario de los programas de dotación de tierras, previamente calificados conforme a los parámetros establecidos por propia [sic] normativa, un fundo agrario, comprometiéndose a traspasarlo, por un eventual precio o a título gratuito, si el beneficiario demuestra tener capacidad técnica para desarrollar la empresa agraria y cumple con las obligaciones impuestas durante un período de prueba; el traspaso en propiedad se verifica sujeto a una multiplicidad de obligaciones de parte del beneficiario, cuyo incumplimiento permite al ente revocar la adjudicación, durante un plazo de 15 años o hasta el momento de no existir deudas pendientes, sin que pueda en ninguna forma enajenarlo si no media previamente una autorización expresa del Instituto, pues por disposición de la Ley el ente asignante puede recuperar el bien para adjudicarlo a otro beneficiario, debiendo siempre ejercer un control directo sobre la actividad realizada por el adjudicatario.
Una característica muy importante de este contrato establecida en la Ley, e interpretada por la doctrina, es la de ser un contrato de duración. Su perfeccionamiento no opera con el traspaso en propiedad del fundo, por el contrario éste se cristaliza en cuanto el beneficiario cumple sus obligaciones, durante el tiempo establecido por la Ley, y realiza la actividad para la cual le fue otorgado. La propiedad se adquiere plenamente hasta que el plazo haya transcurrido.” (Lo subrayado es suplido. Al respecto, pueden consultarse las sentencias números 229 de las 15 horas del 20 de julio de 1990, 275 de las 9 horas 10 minutos del 17 de marzo de 2011, 1018 de las 13 horas 45 minutos del 23 de agosto de 2012, 1506 de las 14 horas 50 minutos del 20 de noviembre de 2014 y 967 de las 10 horas 42 minutos del 17 de agosto de 2017). En este último fallo se agrega, “[…] durante los 15 años que fija el numeral 67 citado, el beneficiario aún no cuenta con un derecho de propiedad pleno, en el tanto, el bien debe ser utilizado para los fines sobre los cuales se le adjudicó, de modo tal que, si la parcela obtiene un uso distinto al encomendado, el INDER (como órgano contralor) debe iniciar un procedimiento administrativo en contra del beneficiario para revocar la adjudicación del inmueble.
En otras palabras, aunque el beneficiario ostente la titularidad del bien y así conste en el Registro Nacional, la facultad de disposición, incluso las de uso y disfrute, no son plenas ni absolutas, sino que están sujetas a las limitaciones que impone la misma Ley por un determinado plazo (15 años).” (Lo subrayado es suplido). En consecuencia, la titularidad sobre el bien se consolida al cumplirse, no solo el plazo indicado, sino también, las obligaciones previstas en el respectivo contrato. Los beneficiarios de la concesión de la parcela deben demostrar las destrezas y aptitudes para el ejercicio de la actividad agraria durante todo el tiempo de vigencia de las limitaciones; o, lo que es lo mismo, durante la vigencia del contrato. Al respecto, pueden consultarse, mutatis mutandis, entre otras, las indicadas sentencias de eta Cámara. Se trata, puede afirmarse, de un contrato personalísimo (intuito personae), en virtud de la función social que cumple el bien -precepto 50 de la Constitución Política-.
Esto se demuestra con el hecho de que, el canon 67 de la Ley de Tierras y Colonización, preceptúa que el beneficiario no puede, entre otros, traspasar el dominio de su predio, sin autorización del Instituto, excepto que hayan transcurrido 15 años desde la adquisición de la parcela y que todas las obligaciones con ese ente estén canceladas. Es decir, en caso de tratarse de un traspaso previo al vencimiento del plazo de las limitaciones, se requiere la anuencia de la Junta Directiva del hoy Instituto de Desarrollo Rural –INDER. Por ello, la persona adjudicataria no se beneficia de la posesión ejercida por anteriores parceleros. Es a partir de ese acto, se insiste, que empieza a contarse el plazo de 15 años de vigencia de las limitaciones o restricciones. En esta lite, en virtud del referido acuerdo de la Junta Directiva del entonces IDA –tomado el 17 de junio de 1986-, según se acreditó, el 25 de mayo de 1995, se suscribió el instrumento público mediante el cual el entonces IDA le traspasó al matrimonio actor la finca en litis.
En dicho convenio, de manera expresa se pactó: “Que los compradores no podrán traspasar el dominio de su predio, ni gravarlo, arrendarlo, o subdividirlo sin la autorización previa del Instituto vendedor, excepto que haya transcurrido quince años contados a partir de esta fecha, exceptuándose de la prohibición anterior, las operaciones que se celebren con la Banca Nacionalizada, con el Consejo Nacional de Producción o cualesquiera Instituciones de crédito del Estado. […]”. La parte actora no solicitó la nulidad de ese pacto, lo cual implica su conformidad. Por el contrario, reconoció su existencia para el momento en que se suscribió el contrato de arrendamiento. En este sentido, en la pretensión principal número seis de la demanda en contra de BLINKY, CIENFUEGOS, Julia Ibarra Seas y Pedro Adrián Borges Fiol, se solicitó: “Que por ser de mala fe la posesión de los demandados, se les niegue el derecho de mejoras, frutos, así como el derecho de retención del inmueble.
Además, que dicho pago de mejoras es improcedente, por las limitaciones del IDA a que está sujeto el inmueble, y que era de conocimiento de los demandados.” (Lo subrayado es suplido). Asimismo, en la pretensión subsidiaria primera, punto quinto, requirió: “Que por haber renuncia expresa en el contrato, y además por ser de mala fe y abusiva el ejercicio de las prestaciones en la finca por parte de los demandados, se les niegue el derecho de mejoras, frutos. Además que dicho pago de mejoras es improcedente, por las limitaciones del IDA a que está sujeto el inmueble, y que era de conocimiento de los demandados.” (Lo subrayado no es del original). Aún más clara es la pretensión subsidiaria segunda, puntos tercero y quinto, al solicitar: “III) Que de considerar el juzgador que existe relación contractual con los demandados, de cualquier naturaleza, se declare la nulidad absoluta de dichas relaciones contractuales, por existir limitaciones del IDA a la hora de haberse suscrito. […] V) Que por haber renuncia expresa en el contrato, y además por ser de mala fe y abusivas las forma de ejercicio de las prestaciones en la finca, por parte de los demandados, se les niegue el derecho de mejoras, frutos.
Además, que dicho pago de mejoras es improcedente, por las limitaciones del IDA a que está sujeto el inmueble, y que era de conocimiento de los demandados.” (Lo subrayado es suplido). Incluso, cuando se integró la litis con el entonces IDA, en la pretensión marcada con el número seis, se solicitó: “Que por ser de mala fe la posesión de los demandados se les niegue el derecho de mejoras, frutos, así como el derecho de retención. Además, que dicho pago de mejoras es improcedente, por las limitaciones del IDA a que está sujeto, ya que era de conocimiento de los demandados.” (Lo subrayado no es del original). En la pretensión subsidiaria primera, punto quinto, en contra de dicho ente, se pidió: “Que por haber renuncia expresa en el contrato, y además, por ser de mala fe y abusivas el ejercicio de las prestaciones en la finca, por parte de los demandados, se les niegue el derecho de mejoras, frutos.
Además, que dicho pago de mejoras es improcedente, por las limitaciones del IDA a que está sujeto el inmueble, y que era de conocimiento de los demandados.” De igual manera, en la pretensión subsidiaria segunda en contra de esa institución, puntos 3 y 5, se pidió: “3) Que de considerar el juzgador que existe relación contractual con los demandados, de cualquier naturaleza, se declare la nulidad absoluta de dichas relaciones contractuales, por existir limitaciones del IDA a la hora de haberse suscrito. […] 5) Que por haber renuncia expresa en el contrato, y además de ser de mala fe y abusivas las formas del ejercicio de las prestaciones en la finca, por parte de los demandados, se les niegue el derecho de mejoras, frutos. Además, que dicho pago de mejoras es improcedente, por las limitaciones del IDA a que está sujeto el inmueble, y que era de conocimiento de los demandados.” (Lo subrayado es suplido).
Por las razones indicadas, esta Cámara comparte la posición expuesta por el Ad quem, en el sentido de ser infundada la tesis de la parte actora de que el cómputo del plazo para el vencimiento de las limitaciones inicia cuando es adjudicada por vez primera. En el hecho probado de la sentencia del Juzgado antecedido con el número 6, avalado por el Tribunal, se acreditó que en el acuerdo no. nueve, tomado en la sesión de la Junta Directiva del entonces IDA no. 399, celebrada el 17 de junio de 1986, se aprobó la adjudicación de la parcela en litigio al matrimonio compuesto por el señor Juan Diego Vargas Soto y la señora Kattia María Salas Castro. Por lo tanto, es a partir de ese momento, tal y como lo señalaron las personas juzgadoras, que inició el cómputo del plazo de limitaciones por 15 años. Por ello, no lleva razón el casacionista al indicar que las limitaciones, cuando se otorgó en arriendo la finca en litigio -en el año 1998-, se encontraban vencidas.
Ello por cuanto, además de contradecir lo expuesto en las pretensiones, se insiste, su finalización se produjo el 17 de junio de 2001. Esta Cámara también comparte lo resuelto por el Tribunal en torno a la figura del silencio positivo. Como bien lo indicó, para su procedencia, se requiere que la persona gestionante cumpla con todos los requisitos legales para el otorgamiento del permiso, licencia o autorización, según lo dispone el inciso 1) del numeral 331 de la LGAP. En este proceso, no se cumplieron. La solicitud de autorización para arrendar la propiedad la realizó la parte actora cuando aún estaban vigentes las limitaciones; por ello, no procedía dicha figura del silencio positivo. Por otro lado, el recurrente no cuestionó lo afirmado por las personas juzgadoras respecto a que, con la prueba testimonial ofrecida no se demostró su dicho. Se limitó a reiterar lo afirmado en el recurso vertical. En mérito de lo indicado, se impone el rechazo del agravio en estudio.
XIII.En el tercer motivo de disconformidad, folio 28, alega el recurrente error en la valoración probatoria, pues, indica, la demanda del IDA está prescrita. Reproduce, en lo de su interés, lo expuesto en el considerando VII de la sentencia del Juzgado; así como lo expuesto por el Ad quem en el apartado IX de la sentencia cuestionada. El argumento expuesto en la sentencia recurrida, afirma, parte de premisas incorrectas. A saber:
XIV.Al respecto, en la sentencia cuestionada, las personas juzgadoras consideraron lo siguiente: “IX. Sobre la prescripción de la demanda del INDER, el recurrente hace un conteo partiendo las limitaciones tenían 26 años, pero estaban vencidas por morosidad administrativa. Utiliza esta supuesta conclusión como punto de partida de la prescripción. Sin embargo, como se apuntó en los segmentos anteriores, las limitaciones no estaban vencidas al momento de integrar a la litis al INDER, puesto fue notificado de la presente demanda el 22 de mayo de 2006 según acta de notificación que corresponde a la imagen de la página 653 a 655 del tomo II. Según lo explicado ampliamente en el considerando VI, las prohibiciones del contrato de adjudicación de tierras entre los administrados Vargas Soto y Salas Castro, inició [sic] a partir del 17 de junio de 1986, venciendo el 17 de junio de 2001. Utilizando el argumento de quien recurre, al momento de la notificación de la demanda al Instituto habían transcurrido únicamente cuatro años y diez meses aproximadamente. Al tenor del artículo 868 relacionado con el ordinal 876 inciso 2) ambos del Código Civil el plazo fatal no se había verificado, por lo que procederá confirmar lo resuelto en este punto, pero por los motivos dados en esta instancia.” (Lo subrayado es del original)
XV.Al respecto, es menester recordar que esta Sala, en la sentencia no. 505 de las 8 horas 45 minutos del 14 de abril de 2011, citando otros precedentes, señaló: “[…] dentro de las características del recurso de casación en materia agraria está la de que debe ordenarse técnicamente. Se han de enumerar y estructurar los reproches a la sentencia y fundamentar su falta de juridicidad. El recurrente tiene el deber de explicar, de manera clara y precisa, las razones en las cuales sustenta su gestión. Ha de combatir, de modo sistemático, los fundamentos jurídicos de la sentencia recurrida. Sólo se le exime de señalar, en forma expresa, las normas jurídicas violadas, o el tipo de infracción cometida. En relación, véase, entre muchas otras, la sentencia número 892 de las 9 horas del 25 de noviembre del 2005.” (Voto 596-f-06 de las 14 horas 55 minutos del 30 de agosto del 2006). Entonces, pese a que el recurso en materia agraria se rige por el Código de Trabajo, y se ha considerado como tercera instancia rogada, ello no exime a la parte recurrente del deber de expresar de manera clara y precisa los aspectos de la sentencia de segunda instancia que combate, explicando en todo caso en qué consisten los yerros alegados”.
No. 300 de 10 horas del 25 de abril de 2008.” (Lo subrayado es suplido). En igual sentido, pueden consultarse, entre otros, los fallos de esta Cámara números 809 de las 8 horas 40 minutos del 5 de julio, 1513 de las 9 horas 25 minutos del 15 de noviembre, ambas del año 2012; 1196 de las 9 horas 50 minutos del 18 de setiembre de 2013, 29 de las 13 horas 30 minutos del 16 de enero de 2015; 556 de las 9 horas 40 minutos del 17 de mayo y 1454 de las 14 horas 45 minutos del 23 de noviembre, ambas del año 2017. Acorde a lo expuesto, aunque en el recurso de casación agrario no se exigen formalidades especiales, no significa sea por completo informal, ya que los reparos al fallo deben estructurarse de modo técnico. Así, habrá de exponerse, con claridad y precisión, las objeciones a los fundamentos fácticos y jurídicos de la sentencia recurrida; lo único de lo que está exento el recurrente es de señalar las disposiciones del ordenamiento jurídico conculcadas o el tipo de infracción cometida.
El recurrente no combate, en debida forma, lo argüido por el Tribunal. En esencia, se limitó a reiterar lo argumentos expuesto en el recurso de apelación; por lo que lo indicado en el recurso resulta anodino a efecto de quebrar el fallo. Sin perjuicio de lo anterior, y a mayor abundamiento de razones, esta Sala avala lo señalado por el Ad quem. Como fue expuesto en el considerando XII de esta sentencia, también participa del criterio de que el inicio del cómputo del plazo de las restricciones sobre la propiedad en litigio, se dio con el acto administrativo de adjudicación por parte de la Junta Directiva al matrimonio compuesto por don Juan Diego y doña Kattia María; sea, el 17 de junio de 1986, por lo que su vencimiento se dio el 17 de junio de 2001, no en la fecha indicada por el recurrente. Esto hace que, como bien lo señalaron los juzgadores, al momento en que fue notificado el INDER de la demanda interpuesta por los actores en su contra, el 22 de mayo de 2006, transcurrieran apenas 4 años y 10 meses desde la terminación de las limitaciones.
Ergo, en aplicación de los preceptos 868 y 876 inciso 2) del Código Civil, la contrademanda interpuesta por el INDER se hizo dentro del plazo previsto en el primer numeral. Por lo tanto, el agravio en estudio deberá ser rechazado.
XVI.En la cuarta censura a la sentencia impugnada, folio 33, invoca el casacionista error de hecho de la valoración de la prueba, pues, en su criterio, no procede la nulidad del contrato de arriendo. Reproduce, en lo de su interés, lo expuesto en el considerando IX de la sentencia de la A quo; así como el apartado X de la sentencia del Ad quem. Califica lo resuelto contrario a los principios de equidad, razonabilidad, proporcionalidad e “indubio pro agricultor”. Ello por cuanto:
XVII.En el considerando X de la sentencia cuestionada, las personas juzgadoras, en torno a la pretensión del INDER de anulación del contrato de arrendamiento, señalaron: “[…] Como se ha explicado de manera abundante, las limitaciones, de acuerdo al razonamiento de esta Cámara, vencían aplicando la morosidad administrativa el 17 de junio de 2001. El convenio de arrendamiento fue rubricado el 04 de diciembre de 1998 (documento en imagen de foja [sic] 57 del tomo I), momento para el cual se encontraban sujetos [sic] a las obligaciones inherentes del contrato de adjudicación de tierras, según el artículo 67 de la Ley de Tierras y Colonización, donde estipula, el beneficiario está imposibilitado para arrendarlo, entre otras disposiciones del bien. Se explicó, por la función social que cumple la parcela, íntimamente relacionada con la filosofía del ordinal 50 de la Constitución Política, las personas beneficiarias deben demostrar su capacidad técnica y experiencia en el trabajo agrario.
Si optaron por construir una vivienda, estaba dentro de las potestades que les concede el contrato de adjudicación de tierras. Empero, por mandato expreso y diáfano de la norma, carecían de la posibilidad de arrendar parte del bien, porque era menester contar con una autorización. Del abundante acervo probatorio, documental y testimonial, no se infiere un trámite para pedir autorización para alquilar. Estima esta Sede, las gestiones se deben realizar, previa a la suscripción de cualquier convenio o acuerdo verbal. Al margen de las justificaciones que sean o no procedentes dadas por los actores reconvenidos Vargas Soto y Salas Castro, conocían plenamente las obligaciones que tenían con el INDER. Además, al margen que efectúan gestiones para el levantamiento de las prohibiciones, se debía realizar uno para el arrendamiento. Nótese, el contrato fue rubricado en diciembre de 1998 y la constancia que hay del pedido para levantamiento de restricciones data del 24 de julio de 1998 (imagen 3 del tomo de pruebas V); las visitas para la inspección de campo a fin de verificar si procedía o no el levantamiento es del 18 de noviembre de 1999, momento para el cual ya se habían desplegado los efectos del contrato de arrendamiento.
A mayor abundamiento de razones, se explicó, era necesario, el trámite para el levantamiento de las limitaciones llegara a coronarse con un acuerdo de Junta Directiva del Instituto, pues esto era necesario para modificar la información del Registro Nacional la cual reflejaba el plazo indicado en la escritura pública donde se plasmó el traspaso a favor de las citadas personas parceleras.”
XVIII.El casacionista, pese a transcribir el considerando antes indicado de la sentencia del Tribunal, no cuestiona, en debida forma, los fundamentos brindados a fin de denegar la censura interpuesta en el recurso vertical. Lo efectuado, básicamente, es una reiteración del reparo interpuesto en el recurso de apelación. Es decir, realiza un alegato divorciado, por completo, de lo decidido por el Ad quem. Configura, más bien, una manifestación meramente argumentativa. Esto torna fútil sus alegaciones a efecto de quebrar el fallo. Ergo, se impone el rechazo del motivo de disconformidad en estudio. En todo caso, como ya se ha apuntado, esta Sala comparte lo esgrimido por las personas juzgadoras. En los hechos no probados 1 y 2 de la sentencia del Juzgado, avalados por el Tribunal, se indica: “1) Que los actores hubieran gestionado ante IDA autorización para arrendar la parcela relacionada en este proceso. 2) Que el Instituto de Desarrollo Agrario ahora INDER hubiese autorizado a los señores Juan Diego Vargas Soto y Katia María Salas Castro a arrendar una sección o la totalidad de la finca inscrita al partido de Alajuela matrícula número 293864-001-002 (ver constancia emitida por Ing. Juan L. Salas Vega Jefe Subregional en Orotina de fecha 6 de febrero de 2002 visible a folio 225 en el Tomo I de Pruebas en el cual se indica no ha tramitado, ni aprobado autorización al respecto).” Esto, como se indicó, no es cuestionado por el recurrente.
Por otro lado, en el hecho probado en el hecho probado antecedido con el no. 15, se acreditó: ”El día cuatro de diciembre de mil novecientos noventa y ocho, los señores Juan Diego Vargas Soto, Kattia María Salas Castro y Blinky de Orotina Sociedad Anónima representada por la señora Julia Ibarra Seas, suscribieron documento privado de contrato de arrendamiento de una sección de la finca inscrita al partido de Alajuela matrícula número doscientos noventa y tres mil ochocientos sesenta y cuatro-cero cero uno y cero cero dos (documento a folio 55 de expediente principal escaneado).” Esto tampoco es impugnado por el casacionista. Es decir, como bien lo indicaron las personas juzgadoras, ese convenio se suscribió estando vigentes las limitaciones que pesaban sobre la propiedad en litigio y sin contar con la debida autorización de la Junta Directiva del Instituto. Por lo tanto, deviene nulo a tenor de lo dispuesto en el canon 67 de la Ley de Tierras y Colonización, según fue declarado.
XIX.En el quinto embate a la sentencia impugnada, folio 37, alega el casacionista error en la valoración de la prueba, ya que, a su entender, no hubo explotación indirecta de la parcela. Esto por cuanto, indica, fue trabajada y explotada en el campo agrícola. Así se hizo, anota, hasta que fue despojado ilegítimamente. Esto, arguye, lo puede demostrar con los proyectos realizados en ella. Con la Universidad de Costa Rica -UCR-, comenta, efectuó experimentos de semilla de chile picante para reproducir una variedad denominada “Jalapeño M”; la siembra experimental de diferentes variedades de maracuyá, a efecto de sacar la más adecuada para la zona. La siembra de maderables de pochote con el Ministerio de Agricultura y Ganadería -MAG-. El proyecto de ganadería de leche y carne, realizado y financiado por el BPDC. El IDA, afirma, dio la autorización para que ese proyecto se ejecutara por medio de la Asociación de Productores de la Trinidad y Uvita.
También, agrega, se le presentó un proyecto de siembra para exportación de melón, sandía y otros productos agrícolas, solicitándosele la autorización como dice la ley, para hipotecar la parcela. Dicho ente la concedió por medio de la Junta Directiva. Producto de ello, anota, se constituyó una cédula hipotecaria por 10 años para la ejecución del proyecto, la cual sirvió de garantía ante el Sistema Bancario Nacional y, como consecuencia de eso, el proyecto generó beneficios a la comunidad, especialmente en mano de obra. La parcela, indica, fue trabajada y explotada en forma directa desde el año 1984, con las diferentes actividades agrícolas y ganaderas hasta el día del despojo ilegítimo por parte del señor Pedro Borges y otros. En reiteradas ocasiones, acota, le ha solicitado al IDA que lo ayude, pues no se levantaban, formalmente, las limitaciones; empero, no lo hizo. Prueba de la maliciosa actuación de los funcionarios del IDA, refiere, es que, cuando contrademandó, no lo hicieron contra el señor Borges y demás demandados; sino, los ofrecen como testigos, lo cual califica como “colusión ilícita entre dichas partes”.
Transcriben, en lo de su interés, lo expuesto por la Jueza A quo en el considerando IX de su sentencia. En las sentencias impugnadas, apunta, se parte de la base que, lo que facilitó el despojo, fue el contrato de arriendo. Empero, expone, si se analiza el texto trascrito, reconoce que fueron despojados de la parcela. Lo arrendado fueron solo dos hectáreas, el resto fue despojado ilegítimamente. Transcribe, en lo conducente, lo expuesto en el considerando X de la sentencia del Juzgado. Por su parte, señala, el Ad quem, a pesar de determinar que fue despojado ilegítimamente del inmueble, lo sancionó, al no cumplir con la prevención que llevó a cabo el INDER. Lo más grave, manifiesta, es que se confunden las tratativas preliminares, que nunca desembocaron en la realización de contrato alguno (nunca existió contrato de traspaso), castigando como si hubiera habido contrato. No se justifica, anota, que se diga que se puso en esa situación, cuando nunca hubo contrato de traspaso, fueron los actos del señor Borges, unilaterales e ilícitos, los que lo despojaron del bien, lo que no le permitió cumplir con las prevenciones hechas. Reproduce el considerando XI de la sentencia del Tribunal. La explotación de Pedro Borges y sociedades demandadas es ilícta, pero no pueden involucrarlo con él, por lo siguiente:
XX.En relación, en el considerando XI de la sentencia impugnada, las personas juzgadoras consideraron lo siguiente: “Otro yerro acusado a la pieza apelada, trata de la causal de explotación indirecta de la parcela. Aduce en el recurso, fueron despojados ilegítimamente y trataron de recuperar el bien por medio del proceso de desahucio. Pero ciertamente, al participar en un contrato sin la autorización debida, según se expuso en el considerando anterior, se colocaron en una situación de riesgo e incumplimiento de sus deberes. Además, no se comparte el alegato que se les está endilgando responsabilidad por las acciones de los codemandados Pedro Borges, Julia Ibarra y empresas, sin embargo, nuevamente es una tesis carente de sustento. Efectivamente, como lo señaló la sentencia impugnada, el apelante tenía pleno conocimiento de lo que acontecía en la parcela, al firmar documentos para consentir la gestión de una patente.
Esta nota fue rubricado [sic] por el apelante y su esposa, expresamente indican: “...en nuestra condición de propietarios de la finca inscrita... y en nuestra condición de arrendantes manifestamos nuestro acuerdo en la solicitud de patente que realiza ante ustedes CIENFUEGOS ECO RANCHO LIMITADA’’ (imagen del folio 429 del tomo de pruebas I). Primero, la misiva es cristalina sobre el trámite que se iba a ejecutar; y en segundo orden, el contrato de arrendamiento fue acordado con la mercantil Blinky de Orotina Sociedad Anónima, lo cual deja en evidencia, se estaba gestando en la parcela una actividad diversa a la de vivienda, al autorizar a otra persona jurídica. Por el conocimiento que tenía la codemandada Salas Castro como funcionaria de la Corporación Municipal, se estima que tenían el suficiente conocimiento para saber, que para habitación no se requiere una patente, sino para otro tipo de actividades como se estaba realizando en la parcela.” (Lo subrayado es del original).
XXI.Al respecto, como ya fue expuesto, en el hecho probado antecedido con el número 15, la juzgadora A quo, lo cual fue prohijado por el Tribunal, acreditó que el 4 de diciembre de 1998 don Juan Diego, doña Kattia María y BLINKY, representada por doña Julia Ibarra, firmaron un documento privado de contrato de arrendamiento de una sección de la finca en litigio. De la misma manera, en los hechos no probados 1 y 2, se consignó que don Juan Diego no solicitó autorización al entonces IDA para arrendar la parcela y, por consiguiente, que dicho Instituto no autorizó ese arrendamiento. Al amparo de lo anterior, esta Cámara estima acertado el aserto del Tribunal, en el sentido de que, participar en dicho contrato de arrendamiento con la empresa BLINKY -lo cual es aceptado por el propio casacionista-, sin contar con la debida autorización del entones IDA, lo colocó, inexorablemente, en una situación de riesgo e incumplimiento de sus deberes contractuales, de conformidad con lo previsto en los cánones 65, 66, 67 y 68 de la Ley de Tierras y Colonización.
En otro orden de ideas, en el hecho probado no. 23, la jueza de primera instancia, lo cual avaló el Tribunal, aspecto que tampoco fue cuestionado, acreditó: “Mediante oficio de fecha 14 de julio de 1999, dirigido a la Municipalidad de Orotina, los señores Juan Diego Vargas Soto y Katia [sic] María Salas Castro comunican que en su condición de arrendantes y propietarios de la finca inscrita al partido Alajuela matrícula número 293864 manifiestan su acuerdo en la solicitud de patente que realiza Cienfuegos Eco Rancho Limitada (documento a folio 429 del Tomo I de pruebas).” Como bien lo indican las personas jugadoras, se insiste, el contrato de arrendamiento, según ya se indicó, fue acordado con la empresa BLINKY. Lo expuesto en el hecho probado antes transcrito pone en descubierto que, en la parcela en litis, se estaba produciendo una actividad diversa a la que debía desarrollarse en virtud de la concesión otorgada por el IDA, al autorizarse la explotación a través de una persona jurídica.
Asimismo, agregó el Tribunal que, en virtud de que la co actora Salas Castro es funcionaria del Ayuntamiento, tenia pleno conocimiento de que, para habitación, no se requiere una patente, sino para otro tipo de actividades como se estaba realizando en la parcela. Estos argumentos no fueron cuestionados por el recurrente en su recurso ante esta Sala. Se limitó a indicar: “Por su parte en la sentencia de Segunda Instancia, a pesar de determinar que he sido despojado ilegítimamente del inmueble, s eme [sic] sanciona, al no cumplir con la prevención que llevó a cabo el INDER. Lo más grave es que confunden las tratativas preliminares que nunca desembocaron en la realización de contrato alguno (nunca existió contrato de traspaso), sancionado como hubiera habido contrato [sic]. No se justifica que se diga que me puse en esa situación, cuando nunca hubo contrato de traspaso, fueron los actos del señor Borges, unilaterales e ilícitos los que me despojaron del bien, lo que no me permitió cumplir con las prevenciones que se me hicieron.” Además de no combatirse lo señalado por el Ad quem, resulta confuso lo antes expuesto.
En primer lugar, las personas juzgadoras, en el considerando transcrito, no determinaron el despojo ilegítimo alegado. Solo refieren su dicho, sin avalarlo. Afirma el recurrente que no existió contrato de traspaso; empero, más delante, en el mismo reparo, acepta que sí hubo un contrato de arrendamiento de vivienda. Por otro lado, el Ad quem fue claro y preciso al afirmar “Además, no se comparte el alegato que se les está endilgando responsabilidad por las acciones de los codemandados Pedro Borges, Julia Ibarra y empresas, sin embargo, nuevamente es una tesis carente de sustento.” Distinto a lo señalado tanto en el recurso vertical, como ahora, ante esta Cámara, la responsabilidad que se le achaca es por hechos propios, como haber arrendado el bien sin la correspondiente autorización y gestionar ante el Gobierno Local de Orotina, en su condición de arrendantes y propietarios de la parcela en litigio, el otorgamiento de una patente a la empresa CIENFUEGOS, todo lo cual evidencia que el destino del bien asignado por el IDA fue modificado. Por las razones dichas, se impone el rechazo del agravio de mérito.
XXII.En el sexto y último agravio en contra de la sentencia impugnada, folio 49, alega el recurrente error de hecho en la valoración de la prueba, al haberse rechazado la acción reivindicatoria por no contarse con legitimación en la causa activa. Reproduce, en lo de su interés, lo expuesto en el considerando XIII de la sentencia del Juzgado; así como el apartado XII del fallo del Ad quem. El razonamiento ahí expuesto, considera, se fundamentó en la revocatoria de la parcela. Empero, afirma, no es procedente por lo siguiente:
XXIII.Sobre el particular, el Ad quem, en el considerando XII de la sentencia impugnada, señaló: “XII. Corolario de lo anterior, perecerá por infundado el rechazo de la acción reivindicatoria, dado que procederá confirmar lo concerniente a la revocatoria del contrato de adjudicación de tierras y consecuente nulidad de título, carecen de legitimación activa para hacer el reclamo. Al faltar tan solo uno de los requisitos de procedibilidad de la acción, lo pedido ha de perecer. El numeral 320 del Código Civil establece, es el dueño el legitimado para realizar el reclamo, sin embargo, al perder la condición de beneficiarios del contrato de adjudicación de la parcela en conflicto, carecen de esa cualidad para sustentar el reclamo. Al mismo tiempo, reitera como yerro a la sentencia, las limitaciones se habían vencido, pero como sobradamente se ha explicado, era inaplicable la figura de la mora administrativa.
Igualmente, perecerá por infundado el agravio, en cuanto les era imposible cumplir con la prevención de la amonestación por el despojo, no obstante, se comparte lo razonado por la a quo, que esa parte se colocó en una situación de desventaja al infringir las obligaciones adquiridas al momento de adjudicarles la parcela. Debe reiterarse, el derecho de propiedad no se había consolidado al momento de realizar el convenio de arriendo, aunque fuera parcial, razón suficiente para descartar el agravio.” (Lo subrayado es del original).
XXIV.El casacionista insiste en una serie de alegatos que ya fueron objeto de análisis en esta sentencia. El Tribunal es elocuente al indicar que, en virtud de confirmar la revocatoria del contrato de adjudicación de tierras suscrito por el actor, Juan Diego Vargas Soto y su esposa con el IDA -hoy INDER-, y la consecuente nulidad del título, es que carece de legitimación activa para intentar una acción reivindicatoria. Al no existir uno de los presupuestos para su procedencia, como lo es, ser propietario del inmueble en litigio, la pretensión no puede prosperar -canon 320 del Código Civil-. Al perder la condición de beneficiarios del contrato de adjudicación de la parcela objeto de este proceso, indicaron las personas juzgadoras, no ostentan ese presupuesto legitimante. Esta Sala, al amparo de lo expuesto en los considerandos anteriores, comparte lo resuelto. Ha sido acreditado el incumplimiento del casacionista de las limitaciones o restricciones que pesaban en la parcela adjudicada, al suscribir el referido contrato de arrendamiento con la empresa BLINKY sin contarse con la anuencia del Instituto.
Esta situación impone revocar la concesión otorgada. Por añadidura, implica que no ostente la condición de propietario, necesaria para incoar la acción reivindicatoria. De igual manera, se comparte lo señalado en la sentencia impugnada, tocante a que ya se han brindado las razones por las cuales se estima que el argumento de la mora administrativa, por el vencimiento de las limitaciones, resulta improcedente. También se participa del criterio de las personas juzgadoras, lo cual no fue cuestionado en debida forma, de que la parte actora se colocó en una situación de desventaja al quebrantar las restricciones y obligaciones adquiridas cuando le fue adjudicada la parcela, pues el derecho de propiedad no se había consolidado cuando se realizó el contrato de arrendamiento, aunque fuera parcial. En consecuencia, carece el actor de legitimación activa para pretender la reivindicación del inmueble en litigio. Ergo, se impone el rechazo del presente agravio.
XXV.En mérito de las razones expuestas, por mayoría, se desestimará el recurso interpuesto ante casación agraria y confirmará la sentencia del Tribunal.
POR TANTO
Por mayoría, se declara sin lugar el recurso ante casación agraria. Se confirma la sentencia objetada.
Luis Guillermo Rivas Loáiciga Román Solís Zelaya Rocío Rojas Morales William Molinari Vílchez José Rodolfo León Díaz MJIMENEZ VOTO SALVADO DEL MAGISTRADO LEÓN DÍAZ El Derecho de Propiedad (o si se quiere los Derechos de Propiedad, como ha sostenido la doctrina a partir de las enseñanzas del maestro Pugliatti), es uno de los institutos jurídicos más polémicos e intrincados, esencialmente cambiante de acuerdo con cada entorno jurídico y social y la evolución histórica de un país. Resulta inevitable, entonces, encontrar divergencias de interpretación de las normas jurídicas que lo regulan, sobre todo cuando se trata de una propiedad especial, como es la proveniente de adjudicación estatal para la explotación agraria de fundos. En este contexto, y con el debido respeto, difiero de lo indicado en voto de mayoría en cuanto a algunos puntos fundamentales que llevaron a rechazar el recurso de casación interpuesto.
En primer lugar, estimo, son diferentes en cuanto a su naturaleza y efectos los contratos de arrendamiento, concesión de utilización de tierras y el de adjudicación de ellas. En los primeros dos, se otorga un uso temporal del bien, sin que estos salgan del patrimonio y titularidad del ente público respectivo. En el último, la adjudicación conlleva la trasmisión de un derecho de propiedad especial, inscribible en el Registro Público, regido por un régimen singular -y de ahí que se trate de una propiedad especial- que limita temporalmente algunos aspectos en cuanto a la utilización, transformación, disposición o enajenación del bien, ya sea inter vivos o mortis causa. Ello se desprende claramente de la normativa relativa a la parcelación de tierras, contemplada fundamentalmente del artículo 49 al 81 de la Ley de Tieras y Colonización No. 2825. En particular, el artículo 49 establece como finalidad de la parcelación lograr una mejor distribución de la tierra, no su pertenencia indefinida en manos del ente público respectivo; el 54 indica que las tierras adquiridas por el INDER, serán divididas para procurar la emancipación económica del agricultor, no su vinculación ilimitada o excesiva al ente, fuera delos parámetros de proporcionalidad y razonabilidad; el 58 señala la posibilidad de otorgar las parcelas a título oneroso, permitiendo incluso que el precio de la venta podría ser menor a su costo, con lo cual se alude indiscutiblemente a un traspaso del bien; el 59 regula la amortización de pagos, lo cual solo es procedente en caso de venta; por su parte, el numeral 62 establece los requisitos de la solicitud para la adquisición de la tierra por parte de los solicitantes, no indica que sea para arrendamiento o con limitaciones que excedan el plazo legal; el 65 comienza a referirse a la venta de las parcelas y la forma en la cual el Instituto procederá a otorgar título de propiedad, garantizado con hipoteca, lo cual conllevaría en caso de incumplimiento su ejecución mediante la venta del bien; en cuanto a los incumplimientos de las obligaciones del parcelero, establece el 66 la posibilidad de revertir la adjudicación, con la pérdida del derecho sobre el bien, en cuyo caso la parcela volvería a dominio del Insitututo, con lo cual resulta evidente que antes de eso dicho inmueble no estaba en su patrimonio, sino en el del adjudicatario.
La disposición más relevante, la encontramos en el artículo 67, que literalmente indica: “El beneficiario no podrá traspasar el dominio de su predio ni gravarlo, arrendarlo o subdividirlo sin autorización del Instituto, excepto que hayan transcurrido quince años desde la adquisición de la parcela y de que todas las obligaciones con dicho organismo estuvieren canceladas. Tampoco podrá, sin esa autorización y durante el mismo término, gravar las cosechas, semillas, animales, enseres, útiles o equipos necesarios para la explotación de la parcela, a menos que todas sus obligaciones con el Instituto estuvieren canceladas. Para autorizar el gravamen del inmueble se requieren cuatro votos conformes de la Junta Directiva. Será absolutamente nulo cualquier contrato que se celebre sin que se cumplan las disposiciones anteriores. Transcurridos los quince años y adquirido el derecho de propiedad, cualquier enajenación de parcela que, a juicio del Instituto, pueda producir la concentración o subdivisión excesiva de la propiedad, dará derecho a éste para adquirir la o las parcelas que se ofrezcan en venta por el precio que fijen los peritos nombrados por las partes, o por un tercero, en caso de discordia.
Este tercer perito será nombrado por los otros dos expertos. El Registro Público tomará nota de las limitaciones a que se refiere este artículo.”. Esta norma, opino, establece tan solo una limitación en cuanto a las facultades de disposición del bien, lo cual no es novedoso en el ordenamiento jurídico, pues desde la legislación francesa civil de 1800 se establecida esta posibilidad, recogida en el numeral 242 del Código Civil nuestro. Limitar uno de los atributos del dominio, por un plazo razonable de 15 años, no significa que el bien continúe en dominio público. Es más, la norma establece claramente que se trataría de un traspaso. En este sentido, la norma establece incluso una posibilidad de readquirir el bien cuando transcurridos los 15 años existieran traspasos que pudieran considerarse dirigidos a una concentración o subdivisión excesiva de la propiedad, pero pagando el precio establecido pericialmente.
De esta disposición también se desprende la facultad de gravar el bien para obtener recursos, con una mayoría calificada, lo cual denota que podrían existir hipotecas que eventualmente pudieran conducir al remate de la parcela, lo que es admisible solo si estamos frente a un derecho de propiedad. Por ende, esta propiedad se puede trasmitir con autorización del INDER o bien por remate cuando dicho ente previamente permitió que se gravara y esto resulte necesario por el no pago de los créditos adquiridos. En igual sentido, el artículo 68, inciso 1), también establece que la propiedad solo puede ser traspasada o gravada con previa autorización del INDER, antes de que se cumplan con las obligaciones respectivas. En este sentido, si se hubieran cumplido las obligaciones establecidas, no hay limitación alguna al derecho de propiedad, ni el INDER puede alargar las que antes existieron. Su inciso 2) evidencia, por su parte, que luego de cumplir con las obligaciones no es necesaria autorización alguna, pero eventualmente el INDER podría adquirir de nuevo la parcela ante la posibilidad de concentración o subdivisión de ésta.
Esta figura, en mi concepto, evidenciaría una suerte de expropiación que solo podría encontrar legitimación si se ajusta fundamentalmente a los parámetros establecidos por el artículo 45 de la Constitución Política. En ningún momento, cabe insistir, se le autoriza al ente público a reiniciar el plazo de limitaciones una vez que se autorice un traspaso, pues, precisamente, en la esencia de toda trasmisión de un derecho está el mantener la situación jurídica trasmitida incólume. Continuar imponiendo limitaciones más allá de los 15 años iniciales, significa dejar los bienes en una situación de incertidumbre más allá de la proporcionalidad y razonabilidad. Además, conforme al principio de legalidad, los entes públicos solo pueden hacer lo que expresamente les está permitido por la Ley, y en ningún momento el legislador estableció que cada vez que se autorizara un traspaso comenzaban a contar de nuevo esos 15 años.
No sucede así en traspasos, ya sean inter vivos o mortis causa. El régimen del numeral 69 de esa Ley establece el traspaso de la propiedad en caso de muerte del beneficiario, pero reconociendo que hay un derecho de propiedad. Si hay herederos que no pueden adquirir por sus condiciones personales, el Instituto puede adjudicarse judicialmente la parcela, recobrando entonces su titularidad previo pago de su valor pericial. Todo lo indicado, considero, denota la condición de una propiedad especial, pero que no puede tener más limitaciones que aquellas previstas expresamente por el ordenamiento, sin que puedan ser interpretadas de manera extensiva por tratarse de la restricción de un derecho fundamental de contenido económico, como lo es el de propiedad, reconocido y tutelado por el numeral 45 de la Constitución Política. Por estas razones, estimo procedente el agravio segundo del recurso de casación planteado, reseñado en el considerando IX del voto de mayoría, el cual se omitie transcribir por innecesario, pues estimo que ya había transcurrido con creces el plazo de limitaciones establecido respecto del lote NO. 48-1(A), desde el momento de su adjudicación originaria, sin importar al efecto las autorizaciones posteriores para segregar el bien o traspasarlo, pues ninguna norma jurídica de rango legal - única que pudiera justificar limitaciones a un derecho de propiedad -, permite al Instituto estar ampliando sucesivamente el plazo de restricción a las facultades de disposición.
Por ende, en minoría, estimo ha de anularse el fallo cuya casación se pide, revocar lo resuelto en primera instancia, y en su lugar acoger las pretensiones principales de la demanda de Juan Diego Vargas Soto y Kattia María Salas Castro contra Julia Ibarra Seas y Pedro Adrián Borges Fiol, reservando la liquidación de daños y perjuicios para la fase de ejecución del fallo, rechazando todas las excepciones materiales interpuestas por dichos accionados. En cuanto a la reconvención presentada por el Inder, estimo en minoría debe rechazarse en todos sus extremos, por estar consolidado el derecho de propiedad de los reconvenidos, acogiendo la excepción de falta de derecho e interés actual, pues no tiene dicho interés el INDER en cuanto a bienes cuya propiedad plena ya se consolidó. En cuanto a las costas, como consecuencia de este criterio minoritario, estimo deben se pagadas por las partes vencidas en la demanda y reconvención a los actores reconvenidos.
