PJEDITOR Document Decision No. 000369-C-S1-2022 FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nueve horas treinta y cuatro minutos del veinticuatro de febrero de dos mil veintidos.

In the plenary proceeding (proceso de conocimiento) brought by EVA CHAVES CHAVES, represented by Dr. Mario Muñoz Quesada, against CARLOS LUIS CASTRO JIMÉNEZ, represented by attorney Mainrald Hernández García, and the MUNICIPALIDAD DE GOLFITO, the Collegiate Civil Court of First Instance of the First Judicial Circuit of the Southern Zone, sua sponte, declared that it lacked subject-matter jurisdiction (incompetencia en razón de la materia), referring the matter to the Administrative Litigation and Civil Treasury Court. The latter assumed jurisdiction over the matter, with which the plaintiff disagreed, requesting a declaration of lack of subject-matter jurisdiction, which was denied. The plaintiff expressed her disagreement with that ruling, for which reason the matter is now before this Chamber.

WHEREAS

I.The plaintiff instituted a civil proceeding, in which she stated the following claims: “1.- Because a first-ranking mortgage was negotiated and created over inalienable public-domain property (bien de dominio público inalienable), pursuant to the Ley de la Zona Marítimo-Terrestre, public instrument number ciento veintidós, executed before Notary Public Sergio Badilla Montoya at dieciocho horas del veintidós de Julio de dos mil seis, is absolutely null and void. 2.- That the defendant herein breached the aforementioned agreement regarding payment of the balance of the price for the assignment and transfer of improvements (cesión y traspaso de mejoras), because he did not pay the plaintiff in full for el año dos mil nueve and, as of this date, has also failed to pay her the amount corresponding to el año dos mil diez. 3.- That, by reason of those breaches, the private agreement for the assignment and transfer of possessory rights and improvements and occupancy rights (derecho de ocupación), entered into through public instrument number ciento veintidós at dieciocho horas del veintidós de Julio de dos mil seis, is rescinded, and the defendant must return to the plaintiff, once the judgment becomes final, all property that was the subject of that agreement, including possession of the land in the restricted zone (zona restringida) of the maritime-terrestrial strip (milla marítimo-terrestre) of Playa Zancudo, as well as the buildings and commercial establishments Cabinas El Coquito, Bar y Restaurante el Coquito, Sodas Evita y Tayita, which are specifically described in the rescinded agreement. 4.- That, should the defendant refuse to return to the plaintiff all property covered by the rescinded agreement, including possession of the land, it shall be recovered through the Fuerza Pública, which shall place the plaintiff in lawful possession of all her property. 5.- That the defendant must pay the plaintiff all damages (daños y perjuicios) caused, which shall be quantified during enforcement of the judgment (ejecución de sentencia). 6.- That the defendant must pay both categories of legal costs (ambas costas) of this action.” The Collegiate Civil Court of First Instance of the First Judicial Circuit of the Southern Zone (Pérez Zeledón) ordered that the Municipalidad de Golfito be joined to the proceeding, which the plaintiff complied with in a filing dated 15 de julio del 2019, stating the following claims: “1.- That the decision issued by the Municipalidad de Golfito through final Mayoral Resolution number R-AM-MG-047-2010, in compliance with the order of the Civil Judge of Golfito, be affirmed and approved. 2.- That the Municipalidad de Golfito bears no civil or other liability for the agreement between Chávez Chávez and Castro Jiménez contained in public instrument number 122 at 18 horas del 22 de Julio de 2006, executed before Notary Public Sergio Badilla Montoya. 3.- That the Municipalidad de Golfito had no involvement in, did not consent to or authorize, and did not otherwise participate in the private transaction between Chávez Chaves and Castro Jiménez set forth in the aforementioned instrument number 122. 4.- That the Municipalidad de Golfito, pursuant to artículos 45 y 71 de la Ley 6043 y su reglamento, has sufficient legal authority to declare absolutely null and void instrument number 122 at 18 horas del 22 de Julio de 2006, which forms the basis for opening expediente N. 2009-6635. 5.- That the Municipalidad de Golfito not be ordered to pay legal costs.”

II.The Collegiate Civil Court of First Instance of the First Judicial Circuit of the Southern Zone, sua sponte, through resolution No. 186-2019 at 07 horas 43 minutos del 16 de julio de 2019, declared that it lacked subject-matter jurisdiction because the Municipalidad de Golfito had been joined and because the real property at issue in this proceeding was inalienable public-domain property, referring the matter to the Administrative Litigation and Civil Treasury Court. The latter assumed jurisdiction over the matter, with which the plaintiff disagreed, requesting a declaration of lack of subject-matter jurisdiction, which was denied. It stated: “Although it is true that the claims do not entail the nullification of any administrative act (acto administrativo) or administrative conduct (conducta administrativa), they do entail the court ordering the Municipalidad de Golfito to take affirmative action.

It must also be added that the plaintiff herself, who challenges this jurisdiction, states that the subject matter of this proceeding is an agreement entered into between persons governed by private law concerning property located in the maritime-terrestrial zone (zona marítimo terrestre); accordingly, because the merits of a dispute concerning public property (bien demanial) located in the maritime-terrestrial zone are at issue, the proceeding must necessarily, by operation of law, be heard by this jurisdiction.” The plaintiff expressed her disagreement with that ruling, for which reason the matter is before this Chamber.

III.In the case under consideration, the matters in dispute are the nullity of a mortgage, as well as ownership, assignment of rights, and improvements concerning land that, according to the plaintiff, is located within the maritime-terrestrial zone, together with the payment of damages. Section one of the Ley Sobre la Zona Marítimo Terrestre provides: “The maritime-terrestrial zone forms part of the national patrimony, belongs to the State, and is inalienable and not subject to acquisitive prescription (imprescriptible). Its protection, as well as the protection of its natural resources, is an obligation of the State, its institutions, and all inhabitants of the country. Its use and exploitation are subject to the provisions of this law.” Section 108 of the Ley de Biodiversidad (Ley 7788), in turn, states: “Jurisdiction. In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative litigation courts.

As exceptions to the foregoing rule, offenses against biodiversity shall be adjudicated by the criminal courts; likewise, disputes arising between private parties that do not involve an administrative act or public-domain property shall fall within the jurisdiction of the agrarian courts.” In accordance with the foregoing, because the subject matter of the proceeding is public-domain land, it is clear that jurisdiction over the proceeding lies with the Administrative Litigation courts, pursuant to section 108 of the Ley de Biodiversidad, which extends to any matter in which the State has a direct interest and in accordance with section 2 of the Código Procesal Contencioso Administrativo.

THEREFORE

Jurisdiction over this proceeding is declared to lie with the Administrative Litigation and Civil Treasury Court. Documento PJEDITOR Res. Nº 000369-C-S1-2022 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cuatro minutos del veinticuatro de febrero de dos mil veintidos .

En proceso de conocimiento de EVA CHAVES CHAVES, representada por el Dr. Mario Muñoz Quesada, contra CARLOS LUIS CASTRO JIMÉNEZ, representado por el licenciado Mainrald Hernández García, y la MUNICIPALIDAD DE GOLFITO, el Tribunal Colegiado de Primera Instancia Civil del Primer Circuito Judicial de la Zona Sur, de oficio declaró su incompetencia en razón de la materia, remitiendo el asunto al Tribunal de lo Contencioso Administrativo y Civil de Hacienda. El último se arrogó el conocimiento del asunto, de lo cual disintió la parte actora, solicitando la incompetencia en razón de la materia, la cual fue rechazada. La actora manifestó su inconformidad contra lo resuelto, motivo por el que se conoce el asunto ante esta Sala.

CONSIDERANDO

I.La parte actora interpuso proceso civil, en el cual señaló como pretensión: “1.- Por haberse negociado y constituido una hipoteca de primer grado sobre un bien de dominio público inalienable, conforme a la Ley de la Zona Marítimo-Terrestre, la escritura pública número ciento veintidós, otorgada ante el Notario Público Sergio Badilla Montoya, a las dieciocho horas del veintidós de Julio de dos mil seis, es absolutamente nula. 2.- Que el aquí demandado incumplió el citado convenio por cuanto pago del saldo del precio de la cesión y traspaso de mejoras, pues no ha pagado a la actora de forma completa el año dos mil nueve, y a esta fecha tampoco le ha pagado el que corresponde para el año dos mil diez. 3.- Que en razón de tales incumplimientos, el contrato privado de cesión y traspaso de derechos de posesión y mejoras y derecho de ocupación celebrado mediante la escritura pública número ciento veintidós de las dieciocho horas del veintidós de Julio de dos mil seis, queda resuelto, debiendo el demandado restituir a la actora, una vez firme la sentencia, todos los bienes que fueron objeto de tal contratación, incluyendo la posesión del terreno en la zona restringida de la milla marítimo-terrestre de Playa Zancudo, así como las construcciones y negocios comerciales Cabinas El Coquito, Bar y Restaurante el Coquito, Sodas Evita y Tayita, y que específicamente describe el contrato resuelto.4.- Que en caso de que el demandado se niegue a restituir a la actora todos los bienes objeto del contrato resuelto, así como la posesión del terreno por medio de la Fuerza Pública, quien pondrá la actora en legítima posesión de todos sus bienes. 5.- Que el demandado debe pagar a la actora todos los daños y perjuicios causados, los cuales se liquidarán en ejecución de sentencia. 6.- Que el demandado debe pagar ambas costas de esta acción”.

El Tribunal Colegiado Primera Instancia Civil del Primer Circuito Judicial de la Zona Sur (Pérez Zeledón), ordenó integrar al proceso a la Municipalidad de Golfito, lo cual fue cumplido por la parte actora por escrito de fecha 15 de julio del 2019, en el que indica como pretensiones: “1.- Que se confirma y aprueba lo resuelto por la Municipalidad de Golfito mediante resolución firme de la Alcaldía número R-AM-MG-047-2010, en acato a lo ordenado por el Juez Civil de Golfito. 2.- Que la Municipalidad de Golfito no tiene ninguna responsabilidad civil, ni de otra índole, por lo pactado entre los señores Chávez Chávez y Castro Jiménez en la escritura pública número 122 de las 18 horas del 22 de Julio de 2006, otorgada ante el Notario Público Sergio Badilla Montoya. 3.- Que la Municipalidad de Golfito no tuvo ninguna injerencia, ni dio consentimiento, ni autorizó y tampoco participó de la negociación privada entre Chávez Chaves y Castro Jiménez, que contempla la escritura número 122 antes citada. 4.- Que la Municipalidad de Golfito, en cumplimiento de lo que disponen los artículos 45 y 71 de la Ley 6043 y su reglamento, tiene suficiente facultad legal para decretar la nulidad absoluta de la escritura número 122 de las 18 horas del 22 de Julio de 2006, y la cual constituye la base de la apertura del expediente N. 2009-6635. 5.- Que no se condene en costas a la Municipalidad de Golfito”.

II.El Tribunal Colegiado de Primera Instancia Civil del Primer Circuito Judicial de la Zona Sur, de oficio mediante resolución No. 186-2019 de las 07 horas 43 minutos del 16 de julio de 2019, declaró su incompetencia en razón de la materia, al haberse integrado a la Municipalidad de Golfito y ser el inmueble objeto del presente proceso un bien de dominio público inalienable, remitiendo el asunto al Tribunal de lo Contencioso Administrado y Civil de Hacienda. El último, se arrogó el conocimiento del asunto, de lo cual disintió la parte actora, solicitando decretar la incompetencia en razón de la materia, la cual fue rechazada, señaló “Si bien es cierto no suponen la nulidad de ningún acto administrativo ni conducta administrativa, si supone la imposición por parte del despacho de conductas de hacer hacia la Municipalidad de Golfito, asimismo, debe adicionarse que la misma parte actora y cuestionante de la competencia en esta jurisdicción manifiesta que el objeto de este proceso es un contrato suscrito entre sujetos de derecho privado sobre un bien ubicado en la zona marítimo terrestre; por lo anterior al estar de por medio una discusión de fondo respecto a un bien demanial ubicado en la zona marítimo terrestre, por imperativo legal necesariamente el proceso debe ser conocido por esta jurisdicción”. La parte actora manifestó su inconformidad contra lo resuelto, motivo por el que se conoce ante esta Sala.

III.En el caso de estudio, se discute la nulidad de una hipoteca, así como el dominio, cesión de derechos y mejoras sobre un terreno que se ubica, según lo indica la parte actora, dentro de la zona marítimo-terrestre, así como el pago de daños y perjuicios. El numeral primero de la Ley Sobre la Zona Marítimo Terrestre establece: “La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su protección, así como la de sus recursos naturales, es obligación del Estado, de sus instituciones y de todos los habitantes del país. Su uso y aprovechamiento están sujetos a las disposiciones de esta ley”. Ahora bien, el numeral 108 de la Ley de Biodiversidad (Ley 7788) indica: “Competencia jurisdiccional En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso administrativa.

Como excepciones de la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria”. De conformidad con lo anterior, al ser el objeto del proceso un terreno del dominio público, es claro que el conocimiento del proceso corresponde a la jurisdicción Contenciosa Administrativa, de conformidad con lo establecido en el ordinal 108 de la Ley de Biodiversidad, extensiva a cualquier asunto en los que el Estado tenga interés directo y conforme lo preceptuado en el canon 2 del Código Procesal Contencioso Administrativo.

POR TANTO
