I.—That it is in the Government's interest to strengthen the administrative structures in the field of natural resources, in order to have defined policies that guarantee the rational use of said resources.
II.—That the Nogal Reserve was created as a Private Wildlife Refuge (Refugio de Vida Silvestre Privado) by Executive Decree No. 32818-MINAE, which was published in La Gaceta No. 11 of January sixteen, 2006, for a period of 10 years.
III.—That in November 2019, Mr. José Luis Gómez Solano, residential identity card 172400251121, at that time, legal representative of the company Chiquita Brands Costa Rica Sociedad de Responsabilidad Limitada, legal ID No. 3-102009490, by written note; submitted to the Sarapiquí subregional office of the Sistema Nacional de Áreas de Conservación, a request to renew the management category of the Nogal Reserve as a Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado).
IV.—That by legal opinion No. SINAC-AJ-CJ-001-2021, the Legal Advisory Office of the Executive Secretariat of the Sistema Nacional de Áreas de Conservación, considers that there is legal viability for the renewal of the management category of the Nogal Reserve as a Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado).
V.—That the Nogal Reserve, property of Chiquita Brands Costa Rica Sociedad de Responsabilidad Limitada, legal ID No. 3-102-009490, located in the province of Heredia, tenth canton, Sarapiquí, first district, Puerto Viejo; encompasses the properties registered under the registration numbers 4: No. 4-263623-000, with survey plan No. 4-20822972018 with an area of 584892 m2, the farm under registration 4-263621-000, with survey plan 04-2073856-2018, with an area of 310997m2 the farm under registration 4-263622-000, with survey plan 4-2076825-2018, with an area of 4084m2 and the farm under registration No. 4-263624-000 with survey plan No. 4-2078801-2018, with an area of 20361 m2, that is, a total area of 92.0334 hectares.
VI.—That the area of the Nogal Reserve that is currently intended to be renewed as a Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado), is located 8 kilometers from La Selva Biological Station between the Río Sucio and a banana plantation; it is composed of three forest fragments connected by the Nogal-La Selva Local Biological Corridor (Corredor Biológico Local Nogal-La Selva) and a fragment of an area occupied by infrastructure and gardens that together total 92.0334 hectares. Its slopes range from 0 to 5%, it is flooded annually by the floods of said river and it is located at 45 m.a.s.l. Apart from being included in the proposed Mesoamerican Biological Corridor (Corredor Biológico Mesoamericano), its area is included within the protection priorities for the payment of environmental services (pago de servicios ambientales), as well as the perpetuation and protection of species with threatened and reduced populations of flora and fauna.
VII.—That the nature of the area whose management category is desired to be renewed as a Private Wildlife Refuge (Refugio de Vida Silvestre Privado) is mostly secondary forest in different stages of natural succession and there are no signs of skid trails or clearings produced by previous harvesting, since they were colonized by heliophilous species. That the flora and fauna that compose it are varied and consistent with that established in the General Management Plan (Plan General de Manejo), such as: Desmopsis schippii, Pseudobombax septenatum, Virola koschnyi, Cecropia sp, Bursera simaruba, Bauhinia sp, among others. There is also a great variety of fauna species, some considered to have reduced populations and others as endangered: such as Tapirus bairdii (tapir), Leopardus pardalis (ocelot), Leopardus weidii (margay), Odocoileus virginianus (white-tailed deer), Eira barbara (tayra), Agouli paca (lowland paca), Canis latrans (coyote), Choloepus hoffmanni (two-toed sloth), Galictis vitiata (grison), in addition to Ateles geoffroyi (spider monkey), Cebus imitator (white-faced capuchin) and Alouatta palliata (mantled howler). That regarding birds, there are several psittacid species with reduced populations and two endangered species such as Ara ambiguus (great green macaw) and Ara macao (scarlet macaw), species of the stringidae family, of which two species are considered with reduced populations Megascops guatemalae and Lophostrix cristata, a great variety of species of the trochilidae, trogonidae, picidae, furnaridae, tirannidae, parulidae, thraupidae and accipifridae families. That as for amphibians, the species Oophagu pumilio abounds and Agalychnis callidryas is present, both species considered with reduced populations, as is a reptile species, Crocodylus acutus (crocodile), present in the Río Sucio, an immediate ecosystem directly associated with the Reserve in the north and east sector.
VIII.—That the described area constitutes a very important nucleus for the conservation of Wildlife within the management category of Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado) due to the specific characteristics of the environment present in the zone. Because forests and wildlife species continue to disappear from our environment and, therefore, from our planet, this management category allows for their conservation and management within a framework of sustainable development, serving at the same time as an environmental regulator.
IX.—That in the General Management Plan (Plan General de Manejo) submitted as part of the requirements for the renewal of the category as a Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado), it is demonstrated that it is a wild area created with the primary objective of forest and biodiversity conservation, promoting forest cover (boscosa) connectivity, environmental education, citizen participation, and scientific research, as well as establishing and developing the management strategies and programs that allow the fulfillment of the creation objectives of this protected wild area.
X.—That the owner of the aforementioned properties voluntarily agreed to once again incorporate his properties described above, into the management category of Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado).
XI.—That, based on the management category renewal process, a new General Management Plan (Plan General de Manejo) is presented and approved by the CONAC in Agreement No. 15 of the Ordinary Session No. 23-2022, held on October 11, 2022.
XII.—That, in accordance with the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or formalities that the administered party must comply with, a circumstance for which the prior review procedure was not carried out. Therefore; They decree:

I.-Que es interés del Gobierno fortalecer las estructuras administrativas en el campo de los recursos naturales, a fin dg contar con políticas definidas que garanticen el uso racional de dichos recursos.
II.-Que la Reserva Nogal fue creada como Refugio de Vida Silvestre Privado mediante el Decreto Ejecutivo N° 32818-MINAE, el cual fue publicado en La Gaceta N° 11 del dieciséis de enero de 2006, por un período de 10 años.
III.-Que en noviembre de 2019 el señor José Luis Gómez Solano, cédula residencial" de identidad 172400251121, en su entonces, representante legal de la empresa Chiquita Brands Costa Rica Sociedad de Responsabilidad Limitada, cédula jurídica N° 3-102009490, mediante nota escrita; presentó ante la oficina subregional de Sarapiquí del Sistema Nacional de Áreas de Conservación, solicitud de renovar la categoría de manejo de la Reserva Nogal como Refugio Nacional de Vida Silvestre Privado.
IV.-Que mediante criterio legal N° SINAC-AJ-CJ-001-2021, la Asesoría Jurídica de la Secretaría Ejecutiva del Sistema Nacional de Áreas de Conservación, considera que existe viabilidad jurídica para la renovación de Categoría de manejo de la Reserva Nogal como Refugio Nacional de Vida Silvestre Privado.
V.-Que la Reserva Nogal, propiedad de Chiquita Brands Costa Rica Sociedad de Responsabilidad Limitada, cédula jurídica N° 3-102-009490, ubicada en la provincia de Heredia, cantón décimo, Sarapiquí, distrito primero, Puerto Viejo; abarca los inmuebles inscritos bajo las matrícula 4: N° 4-263623-000, con el plano N° 4-20822972018 con un área de 584892 m2, la finca bajo matrícula 4-263621-000, con el plano 04-2073856-2018, con un área de 310997m2 la finca bajo matrícula 4-263622-000, con el plano 4-2076825-2018, con un área de 4084m2 y la finca bajo matrícula N° 4-263624- 000 con el plano N° 4-2078801-2018, con un área de 20361 m2, es decir, un área total de 92,0334 hectáreas.
VI.-Que el área de la Reserva Nogal que actualmente se pretende renovar como Refugio Nacional de Vida Silvestre Privado, se localiza a 8 kilómetros de la Estación Biológica La Selva entre el Río Sucio y una plantación de banano; se compone de tres fragmentos de bosque conectados por el Corredor Biológico Local Nogal-La Selva y un fragmento de área ocupada por infraestructura y jardines que en total suman 92.0334 hectáreas. Sus pendientes van de 0 a 5%, se inunda anualmente por las crecidas de dicho río y se encuentra a 45 m.s.n.m. Aparte de estar incluida en la propuesta del Corredor Biológico Mesoamericano, su área está incluida dentro de las prioridades de protección para el pago de servicios ambientales, así como la perpetuación y protección de especies con poblaciones amenazadas y reducidas de flora y fauna.
VII.-Que la naturaleza del área que se desea renovar la categoría de manejo como Refugio de Vida Silvestre Privado es en su mayoría bosque secundario en diferentes etapas de sucesiones natural y no existen evidencias de trochas ni claros producidos por aprovechamientos anteriores, ya que fueron colonizados por especies heliófilas. Que la flora y fauna que lo componen es variada y concordante con la que se establece en el Plan General de Manejo, como: Desmopsis schippii, Pseudobombax septenatum, Virola koschnyi, Cecropia sp, Bursera simaruba, Bauhinia sp, entre otras. También se encuentran gran variedad de especies de fauna algunas consideradas con poblaciones reducidas y otras como en peligro de extinción: como Tapirus bairdii (danta), Leopardus pardalis (manigordo), Leopardus weidii (caucel), Odocoileus virginianus (venado cola blanca), Eira barbara tolomuco, Agouli paca (tepezcuintle), Canis latrans (coyote), Choloepus hoffmanni (perezoso de dos dedos), Galictis vitiata (grisón), además de Ateles geoffroyi (mono araña), Cebus imitator (mono cara blanca) y Alouatta palliata (mono aullador). Que respecto a aves se encuentran varias especies de psittacidos con poblaciones reducidas y dos especies con peligro de extinción como Ara ambiguus (lapa verde) y Ara macao (lapa roja), especies de la familia stringidae, de la cual dos especies son consideradas con poblaciones reducidas Megascops guatemalae y Lophostrix cristata, gran variedad de especies de la familia trochilidae, trogonidae, picidae, furnaridae, tirannidae, parulidae, thraupidae y accipifridae. Que en cuanto a anfibios abunda la especie Oophagu pumilio y está presente la Agalychnis callidryas, ambas especies consideradas con poblaciones reducidas, así como lo está una especie de reptil, el Crocodylus acutus (cocodrilo), presente en el Río Sucio, ecosistema inmediato y directamente asociado a la Reserva en el sector norte y este.
VIII.-Que el área descrita, constituye un núcleo muy importante para la conservación de la Vida Silvestre dentro de la categoría de manejo de Refugio Nacional de Vida Silvestre Privado por las características propias del medio ambiente presente en la zona. Por continuar desapareciendo de nuestro medio y por ende, de nuestro planeta los bosques y las especies de vida silvestre esta categoría de manejo permite conservarlas y manejarlas dentro de un desarrollo sostenible sirviendo a la vez como regulador ambiental.
IX.-Que, en el Plan General de Manejo presentado como parte de los requisitos para la renovación de la categoría como Refugio Nacional de Vida Silvestre Privado, se demuestra que es un área silvestre creada con el objetivo primordial de conservación del bosque y la biodiversidad, promover la conectividad boscosa, la educación ambiental, participación ciudadana y la investigación científica, así como el de establecer y desarrollar las estrategias y programas de manejo que permitan el cumplimiento de los objetivos de creación de esta área silvestre protegida.
X.-Que el propietario de los inmuebles antes mencionados accedió voluntariamente a incorporar nuevamente sus propiedades antes descritas, a la categoría de manejo de Refugio Nacional de Vida Silvestre Privado.
XI.-Que, partiendo del proceso de renovación de Categoría de Manejo, se presenta y aprueba un nuevo Plan General de Manejo por parte del CONAC en acuerdo N° 15 de la Sesión Ordinaria N° 23-2022, celebrada el 11 de octubre de 2022.
XII.-Que, de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites. requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto;

También se compromete a brindar toda la colaboración necesaria a los funcionarios del Sistema Nacional de Áreas de Conservación, para las labores de control y verificación de las políticas ambientales mediante el Área de Conservación Arenal Huetar Norte, así como a los investigadores e inspectores de recursos naturales, estudiantes y otros que esporádicamente visiten dicha área en las funciones propias de sus respectivos cargos, estudios e investigaciones. Asimismo, se compromete a cumplir con las disposiciones que al efecto señalan la normativa jurídica ambiental vigente.
