That the flora and fauna that compose it are varied and consistent with that established in the Management Plan (Plan de Manejo), such as: Ceibo, Fruta Dorada, Guarumos, and Jinocuaves. As well as Escalera de mono, Uña de Gato, among others. Also observed during the visit carried out by MINAE officials was a great variety of birds such as the pájaro chanco and tucancillo; frogs and tracks of reptiles, amphibians, and mammals.
5th—That the described area constitutes a very important nucleus for the conservation of Wildlife within the management category of Private Wildlife Refuge, clearly located in the zone where the property is situated, due to the inherent characteristics of the environment.
That as forests and wildlife species continue to disappear from our environment and therefore from our planet, this management category allows them to be conserved and managed within a framework of sustainable development, simultaneously serving as an environmental regulator.
6th—That the technical document presented and carried out in the zone demonstrates that it is a wild area that protects biodiversity and serves to provide opportunities for scientific research, recreation, and education; the primary objectives of this refuge being to conserve and protect the natural forest.
7th—That the owner of said property voluntarily agreed to join this wildlife protection regime, committing not to develop any activity that endangers the fragility of the different ecosystems existing in the zone. Therefore, THEY DECREE:

Likewise, they commit to complying with the provisions set forth for this purpose by the Wildlife Conservation Law, the Forest Law, their respective regulations, and other current provisions regarding environmental legal regulations.

In the event of not wishing to maintain said management category, the owner must express their desire to release the property from this designation by means of a written submission presented to the competent sub-region of the Cordillera Volcánica Central Conservation Area.

Likewise, the present declaration shall be repealed in the event of disregard by the owner for the technical provisions and recommendations issued by the Cordillera Volcánica Central Conservation Area and the Ministry of Environment and Energy.

4Que la naturaleza del área que se quiere someter, es bosque secundario en diferentes sucesiones de recuperación. No existen evidencias de trochas ni claros producidos por aprovechamientos anteriores, ya que fueron colonizados por especies heliófitas. Que la .ora y fauna que lo componen es variada y concordante con la que se establece en el Plan de Manejo, como: Ceibo, Fruta Dorada, Guarumos y Jinocuaves. Así como Escalera de mono, Uña de Gato, entre otras. También se logró apreciar durante el recorrido realizado por funcionarios del MINAE, gran variedad de aves como el pájaro chanco y tucancillo; ranas y huellas de reptiles, anfibios y mamíferos.
5Que el área descrita, constituye un núcleo muy importante para la conservación de la Vida Silvestre dentro de la categoría de manejo de Refugio de Vida Silvestre Privado, localizada claramente en la zona donde se ubica el inmueble, por las características propias del medio ambiente.
Que por continuar desapareciendo de nuestro medio y por ende de nuestro planeta los bosques y las especies de vida silvestre esa categoría de manejo permite conservarlas y manejarlas dentro de un desarrollo sostenible sirviendo a la vez como regulador ambiental.
6Que en el documento técnico presentado efectuado en la zona, se demuestra que es un área silvestre que protege la biodiversidad y que sirve para brindar oportunidades a la investigación cientí.ca, la recreación y la educación; siendo objetivos primordiales de este refugio, conservar y proteger el bosque natural.
7Que el propietario de dicho inmueble accedió voluntariamente a incorporarse a este régimen de protección de la vida silvestre, comprometiéndose a no desarrollar ninguna actividad que ponga en peligro la fragilidad de los diferentes ecosistemas, existentes en la zona. Por tanto,

(Nota de Sinalevi: Mediante el artículo 1° del decreto ejecutivo N° 44023 del 24 de abril del 2023, se acordó: Renuévese la categoría de manejo para -la Reserva Nogal, como "Refugio Nacional de Vida Silvestre Privado Nogal", creado mediante Decreto Ejecutivo N° 32818-MINAE, el cual fue publicado en la Gaceta N° 11 del dieciséis de enero de 2006; comprendido por los tres fragmentos de bosque y el área de infraestructura que suman noventa y dos hectáreas trescientos treinta y cuatro metros cuadrados (92,0334 hectáreas), ubicados en la hoja cartográfica río Sucio 3 447 III, coordenadas geográficas (Datum WGS84) en la provincia de Heredia, cantón décimo, Sarapiquí, distrito primero Puerto Viejo, que forman parte de los inmuebles matrículas: N° 4-263623-000, con el plano N 04-20822972018 con un área de 584892m2, la finca bajo matrícula 4-263621-000, con el plano N° 42073856-2018, con un área de 310997m2, la finca bajo matrícula con el plano 4-2076825-2018, con un área de 4084m2 y la finca bajo matrícula N° 4-263624-000 con el plano N° 4-2078801-2018, con un área de 20361m2; propiedad de Chiquita Brands Costa Rica Sociedad de Responsabilidad Limitada, cédula jurídica N° 3-102-009490. En caso de no querer mantener dicha categoría de manejo, el propietario deberá de manifestar su deseo de desafectar la finca mediante escrito presentado ante la subregión competente del Área de Conservación Cordillera Volcánica Central.

De igual forma, se derogará la presente declaratoria en caso de desacato por parte del propietario, a las disposiciones técnicas y recomendaciones que gire el Área de Conservación Cordillera Volcánica Central y Ministerio del Ambiente y Energía.
