42075-S-MINAE of November 12, 2019 "Reglamento para la disposición al subsuelo de aguas residuales ordinarias tratadas", published in Alcance No. 87 to La Gaceta No. 80 of April 14, 2020, so that they shall henceforth read as follows:

"Article 2.- Scope of application. Dwellings and those activities that generate ordinary wastewater and, once treated, dispose of it by infiltration into the subsoil are subject to the regulations of this Regulation. This regulation shall be applicable throughout the national territory. Annexes 1, 2, 3, 4, 5 and 6 form an integral and binding part of this regulation.

The following definitions are established for the better interpretation of this Regulation:

1.Aquifer: Geological formation or formations that are capable of storing and transmitting water in usable quantities under the action of hydraulic gradients.

2.Wastewater: Water that has received a use and whose quality has been modified by the incorporation of contaminating agents. For the purposes of this Regulation, two types are recognized: ordinary and special.

3.Treated Wastewater: That wastewater which has received treatment through a set of physical, chemical, or biological processes whose purpose is to improve its quality.

4.Ordinary wastewater or ordinary-type wastewater: Wastewater generated by basic human activities, such as the use of toilets, showers, sinks, kitchen sinks, laundry, and that which meets the limits established for the parameters specified in Tables 2 and 3 of articles 18 and 19 of Decreto Ejecutivo No. 33601-MINAE-S of August 9, 2006 "Reglamento de Vertido y Reúso de Aguas Residuales", published in Alcance Nº 8 to La Gaceta No. 55 of March 19, 2007 and its reforms.

5.Special wastewater or special-type wastewater: Wastewater generated by any activity that does not meet the definition of ordinary wastewater or ordinary-type wastewater.

6.Sanitary Sewer: System formed by collectors, sub-collectors, accessory works, piping or conduits, generally closed, that convey ordinary, special, or both types of water, to be treated and disposed of in compliance with the effluent quality standards established by the Reglamento de Vertido y Reúso de Aguas Residuales.

7.Infiltration area: Area of the bottom and walls of the infiltration trenches, below the level of perforated piping, through which the infiltration of treated wastewater into the subsoil occurs.

8.Flow Rate: Volume of a liquid that passes a point in a given time.

9.Slope crest: Upper section of the slope.

10.Effluent: Flow rate of treated wastewater leaving the last unit of the treatment system.

11.Generator Entity: Natural or legal person, public or private, who, through the activity they carry out, is responsible for the sanitary disposal of wastewater by its drainage into the subsoil.

12.Return Factor: Relationship between the volume of wastewater discharged and the volume of water supplied.

13.Infiltration: The downward flow of water traveling through the unsaturated zone or through preferential zones until reaching the saturated zone.

14.Latrine and cesspool or blackwater well: The latrine is the booth used for defecating, utilizing a cesspool or blackwater well, and this is an excavation in the ground in the form of a well for the disposal of human excreta without the use of water.

15.Calculation Report (memoria de cálculo): Written account complementary to the project plans and explanatory of the determinants of its operation.

16.Finished Ground Level: Ground level where a civil work will be settled after carrying out the removal of topsoil and debris.

17.Infiltration Test: Trial to determine the absorption capacity of the subsoil where the construction of the drainage system is planned.

18.Setback (retiro): Distance between the property boundary, buildings, water bodies, or other clearly identified elements, and the nearest edge of the drainage system and the treatment system, if applicable.

19.Treatment System: Set of physical, chemical, and biological processes whose purpose is to improve water quality, which includes at least treatment at a secondary level. For the purposes of this Regulation, it includes the drainage system.

20.Drainage System: Set of civil and hydraulic works that allow the final disposal of treated wastewater into the subsoil. Its minimum components are: distribution boxes, drainage piping, filter medium, and sampling boxes.

21.Subsoil: Stratum below the soil consisting mainly of rocks and minerals.

22.Remolded Soil: Soil whose natural structure has been modified by manipulation.

23.Dry-composting toilets (Sanitarios secos y composteros): Toilets that do not require water to evacuate urine or feces, using only gravity to fulfill their function, with a separation between urine and feces for subsequent composting and use as fertilizer.

24.Ground (Suelo): Consisting of the soil surface plus the subsoil.

25.Septic Tank: Treatment unit that combines sedimentation and biodigestion of ordinary wastewater as a solution for single-family dwellings or other activities with flow rates less than or equal to 5 cubic meters per day (equivalent to 190 cubic meters monthly of water consumption with a return factor of 0.8).

26.Infiltration Rate: Volume of water that is absorbed by the subsoil in a given area and time. Its typical units are L/m2/day.

27.Pollutant Transit: Refers to the change in the concentration of pollutants, organic, inorganic, and bacterial, in the flow of groundwater through the soil.

28.Single-family Dwelling (Vivienda unifamiliar): That dwelling in which a single family occupies the entirety of the building.

29.Infiltration Trenches: Excavations in the ground, inside which the piping, gravel, sand, and other elements are placed to allow the infiltration of treated wastewater into the subsoil." "Article 6.- Of the use of drainage systems. The use of drainage systems for the disposal of treated ordinary wastewater will be acceptable only in those cases that meet each of the following conditions:

1.That there is no availability of a functioning public and/or private sanitary sewer system.

2.That the project site is not located in an area with an express prohibition on the use of this type of wastewater disposal, established by regulations, or institutional or municipal regulations clearly defined by the competent entities.

3.That the drainage system be located in non-public green areas. And that they are not located in: vehicular transit zones, parking lots (cargo and unloading vehicles), parks (areas with public access), playing areas on sports courts, paths, green strips, islands and roundabouts, sidewalks, or under structures with concrete or asphalt slabs, blocks, paving stones, plastic covers, or any other type of impermeable cover.

4.That the water table not be located at a depth less than 1.5 meters, taking as a reference the bottom of the infiltration trench (figure A, Annex 2 of this Regulation).

5.The requirements of chapters II and III of this Regulation must be met.

To dispose of ordinary-type wastewater from treatment systems corresponding to generator entities whose actual or projected monthly potable water consumption does not exceed 190 cubic meters, by means of drainage systems, they must:

1.Treat said water, prior to its disposal, through the use of septic tanks or other treatment systems approved in accordance with Decreto Ejecutivo No.39887-S-MINAE of April 18, 2016 "Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales", published in La Gaceta No. 179 of September 19, 2016.

2.Design and comply with the minimum requirements established in Annex 1 of this Regulation regarding septic tanks.

3.Design the drainage system in accordance with the specifications of article 11 and Annex 2 of this Regulation.

4.Attach the calculation report (memoria de cálculo) of the drainage system, in accordance with the guidelines stipulated in article 17 of this Regulation, as well as the cadastral plan and the site design with the location of the treatment and drainage systems. In addition, the calculation report (memoria de cálculo) must include the estimation or calculation of the average monthly potable water consumption, according to the Update of the "Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial del AyA (acuerdo No. 2017-281) and its reforms, published in La Gaceta No.164 of August 26, 2021, or that established in Table 3 of Annex 3 of this Regulation.

5.Attach the results report of the infiltration tests that have been carried out according to Annex 3 of this Regulation.

That established in subsections 3, 4, and 5 of this article must be submitted in the construction project prepared in accordance with Decreto Ejecutivo No. 36550-MP-MIVAH-S-MEIC of April 28, 2011 "Reglamento para el Trámite de Revisión de los Planos para la Construcción", published in La Gaceta No. 117 of June 17, 2011 and its reforms.

To dispose of ordinary-type wastewater from treatment systems corresponding to generator entities whose actual or projected monthly potable water consumption exceeds 190 cubic meters, by means of drainage systems, they must:

1.Treat all wastewater prior to its disposal with treatment systems approved according to Decreto Ejecutivo No. 39887-S-MINAE of April 18, 2016, "Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales", published in La Gaceta No. 179 of September 19, 2016, including the construction plans for the drainage system.

2.Design the drainage system in accordance with the specifications of article 11 and Annex 2 of this Regulation and have a manhole at the beginning of the drainage system that allows for sampling and flow rate measurement.

3.Attach the calculation report (memoria de cálculo) of the drainage system in accordance with the guidelines stipulated in article 17 of this Regulation, as well as the cadastral plan and the site design with the location of the treatment and drainage systems. In addition, the calculation report (memoria de cálculo) must include the estimation or calculation of the average monthly potable water consumption, according to the Update of the "Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial del AyA (acuerdo No. 2017-281) and its reforms, published in La Gaceta No.164 of August 26, 2021, or that established in Table 3 of Annex 3 of this Regulation.

4.Attach the results report of the infiltration tests that have been carried out according to Annex 3 of this Regulation.

5.Present operational reports and comply with the limits for the parameters established in Table 1 of this Regulation, for the quality of the treated wastewater to be drained.

That established in subsections 2, 3, 4, and 5 of this article must be submitted in the construction project prepared in accordance with Decreto Ejecutivo No. 36550-MP-MIVAH-S-MEIC of April 28, 2011 and its reforms "Reglamento para el Trámite de Revisión de los Planos para la Construcción", published in La Gaceta No. 117 of June 17, 2011.

In the case of the development of urban projects whose use is exclusively residential, these may use an individual treatment and drainage system for each housing unit; provided that the project has the exoneration for the construction of the sanitary sewer and treatment plant granted by AyA, in accordance with the Reglamento de Prestación de Servicios, Acuerdo de Junta Directiva de AyA 2020-442, published in Alcance No. 29 to La Gaceta No. 27 of February 9, 2021.

In the case of Subclasses CR 8510.0 "Preschool and primary education", 8521.0 "General secondary education", established in the Table 1 "Classification of Economic Activities of Costa Rica (CAECR), based on ISIC.4" of Annex 6 of this regulation; the flow rate of the average monthly potable water consumption may be estimated for each sanitary block. If the results obtained are consumptions less than 190 m3/month for each of the blocks, what is stipulated in article 7 of this regulation must be met.

For the estimation or calculation of the monthly potable water consumption, the following documentation will be accepted:

1.For existing activities, documents based on the average consumptions of the potable water service for the last six months provided by the operating entity will be accepted.

2.For new residential and other projects, estimates based on the allocations according to the Update of the "Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial del AyA (acuerdo No. 2017-281) and its reforms, published in La Gaceta No.164 of August 26, 2021, will be accepted. For the case of projects other than residential, that established in the "Código de Instalaciones Hidráulicas y Sanitarias en Edificaciones (Edición 2017)" of the Colegio Federado de Ingenieros y de Arquitectos de Costa Rica, published in Alcance No. 38 to La Gaceta No. 37 of February 21, 2017.

3.For the case of subsections 1 and 2 of this article, the estimates may be used for those activities that generate ordinary wastewater that is subsequently intended to be disposed of by means of a drainage system (see Table 3 of Annex 3 of this Regulation).

The drainage system must maintain the following setbacks measured from the external edges and must be noted on the construction plans:

(a)With slopes less than 30% and measured from the slope crest.

(b)Applies to underground storage tanks or those seated on the ground.

(c)Refers to the building closest to the drainage system, located within the property.

(d)In accordance with Ley No. 276 Ley de Aguas and Ley No. 7575 Ley Forestal.

(e)Alignment as indicated by Ley No. 7575 Ley Forestal." "Article 12.- Responsibility of the owner and the professional. The professionals in charge of the design, execution, and technical direction of the work shall be responsible, according to their competencies, for any deficiency in the system that is attributable to problems in the design or construction of the septic tank and drainage system. The owner of the property shall be responsible for its operation and maintenance. Any change made to the system once the work has been handed over by the professional in charge of the technical direction shall be the responsibility of the owner and of whomever they contract for those changes." "Article 35.- Of subsurface disposal of special wastewater. Disposal into the subsoil, by means of the drainage system, of treated or untreated special wastewater is prohibited.

For those activities that dispose of their treated wastewater in the subsoil by means of drainage systems authorized by the Ministry of Health before the enactment of Decreto Ejecutivo No. 39887-S-MINAE of April 18, 2016, "Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales", published in La Gaceta No. 179 of September 19, 2016; they may continue with the same form of disposal, provided they demonstrate that their wastewater is characterized as ordinary type, in accordance with the "Procedure for the characterization of ordinary-type waters", established in Annex 6 of this regulation." "Article 40.- Add to article 5 of Decreto Ejecutivo No. 39887-S-MINAE of April 18, 2016 "Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales", published in Alcance No. 186 to La Gaceta No. 179 of September 19, 2016, subsection j) which states: "In the case of projects with disposal by infiltration of treated ordinary wastewater that exceed 190 cubic meters in their actual or projected monthly potable water consumption, the environmental viability of the project must contemplate the evaluation of the treatment and disposal of wastewater, in accordance with Decreto Ejecutivo No. 42015-MAG-MINAE-S-MIVAH of October 25, 2019 "Reglamento de coordinación interinstitucional para la protección de los recursos hídricos subterráneos", published in Alcance No. 237 to La Gaceta No. 203 of October 25, 2019. The Secretaría Técnica Nacional Ambiental (SETENA), when it so deems, may make consultations or request support for the analysis of this evaluation from the Servicio Nacional de Aguas Subterráneas Riego y Avenamiento (SENARA)." "ANNEX 1 SEPTIC TANKS A)GENERAL GUIDELINES FOR A SEPTIC TANK:

i Setbacks (retiros): The minimum setback must be one meter (1.0 m) from the septic tank and its drainage system with respect to the property boundaries.

ii Inlet and outlet elements: Every septic tank must have flow regulating elements (baffles) at the inlet and outlet, for which T-joints may be used, with downward nipples (see table 1 of this Annex) and upward nipples leaving two centimeters (2 cm) free before the upper slab or lid. The inlet pipe and the outlet pipe must have a minimum diameter of 0.1 m.

iii Quality of materials: The septic tank and its lids must be hermetic. The walls and floor of the tank must be impermeable and resistant to corrosion.

iv Gas evacuation: The gases generated in the septic tank must be vented by means of a dedicated pipe of a minimum diameter of 38 mm (1.5 inches). The pipe must exit from the upper part of the tank.

v Retention time: The hydraulic retention time is calculated as T.R.H.= V/Q, where V will be the useful volume of the unit and Q will be the average daily design flow rate of the system. The use of other design methodologies will be permitted as long as the minimum T.R.H. requirement and the other requirements of Table 1 of this Annex are met.

vi Septic tanks with more than one chamber: For rectangular septic tanks with more than one chamber, the first compartment must meet the requirements established in Table 1 of this Annex; additionally, that compartment must have a minimum length of L/2, and a 60-75% share of the design volume is recommended. The interconnections between compartments must avoid the passage of scum and sludge.

B)TECHNICAL REQUIREMENTS FOR SEPTIC TANKS: The minimum technical requirements that must be met for the design of the septic tank are shown in the following table:

D)GENERAL PROVISIONS FOR WASTEWATER:

a. It is mandatory that all ordinary wastewater (toilets, showers, kitchen sink, hand washing, laundry, dishes, and similar) be disposed of into the septic tank. These contributions must be considered in the calculation of the average daily flow rate for the septic tank design.

b. In the case of water from dishwashing, it must pass through a double-chamber grease trap before discharge into the septic tank. Said grease trap must have periodic maintenance, which consists of removing and disposing of solid waste and fats every three months.

c. It is the responsibility of the owner to carry out the extraction of sludge from the septic tank with a minimum frequency of two years according to its design. The disposal of the sludge is governed by what is established in Decreto Ejecutivo No. 39316-S of August 10, 2015 "Reglamento para el manejo y disposición final de lodos y biosólidos", published in Alcance N° 106 to La Gaceta No. 234 of December 2, 2015." "ANNEX 2 REQUIREMENTS FOR INFILTRATION TRENCHES i The width W must have a length between 0.30 m and 0.90 m (see Figure A of this Annex).

ii The pipe must be specific for drainage, perforated or slotted, with a seal or cap at the end of each drainage line and a minimum commercial diameter of 100 mm (see Figure A of this Annex).

iii The pipe must rest on a layer of gravel (7 to 10 cm in diameter), 30 cm to 90 cm wide and 30 cm to 90 cm high D (see Figure A of this Annex).

iv The drainage pipe must be surrounded by quarter or third stone, whose average size is between 2 cm and 5 cm, with a minimum cover of 5 cm above the crown of the pipe plus an additional 5 cm of sand over this stratum (see Figure A of this Annex).

v. Finally, a soil cover must be placed over the sand backfill with a maximum height of 30 cm (see Figure A of this Annex).

vi. The slope of the trench bottom and the drainage pipe must be "zero" (there must be no slope). (see Figures A, B, C of this Annex) vii. The distance between the center line of the trenches must be greater than the width plus 1.5 m, with a minimum of 1.8 m.

viii. The maximum length of the longest infiltration trench (zanja de infiltración) shall not exceed 60 m and every 20 m must have a manhole (caja de registro).

ix. On flat terrain, where the ground slope does not exceed 1% in any direction, the trenches may be arranged in series or in parallel.

x. On sloping terrain, where the slope is between 1% and 30%, the distribution of trenches must be done in accordance with the following:

x.1. The infiltration trenches (zanjas de infiltración) must approximately follow the contours of the ground surface (parallel to the contour lines) so that variations in the depth of the trenches are minimal.

x.2. Adjacent trenches are connected to each other by means of a Tee connection or preferably by means of manholes (cajas de registro) with a drop (see Figure D of this Annex).

x.3. The separation between trenches for sloping terrain must be a minimum of 5 m from center to center. (see Figure D of this Annex).

xi. The use of plastics or other impermeable materials as a barrier between the various layers that make up the drainage system is not permitted.

"Article 13 bis. Characterization of ordinary wastewater (caracterización de las aguas residuales ordinarias). For the purpose of determining the qualities of ordinary-type wastewater, the procedure for its characterization is established in Annex 6 of this Executive Decree." "ANNEX 6 PROCEDURE FOR THE CHARACTERIZATION OF ORDINARY-TYPE WASTEWATER

I. GENERAL CONSIDERATIONS FOR ORDINARY-TYPE WASTEWATER

For existing activities and projects in progress for a construction permit, the following are considered ordinary-type wastewater:

• a)Wastewater from: single-family and multi-family dwellings, housing condominiums, urbanizations, residential developments, and subdivisions (fraccionamientos).
• b)Wastewater from activities whose generation is solely from toilets, showers, washbasins, sinks, and basic hygiene basins.
• c)Wastewater from activities whose CR subclass is 5610.0, 5621.0, 5629.0, or 5630.0 (Restaurant and mobile food service activities), established in Annex 1 of Executive Decree No. 43432-S of March 9, 2022, "General Regulation for sanitary operating permits, qualification permits, and authorization for temporary mass gathering events, granted by the Ministry of Health" (Reglamento general para permisos sanitarios de funcionamiento, permisos de habilitación y autorización para eventos temporales de concentración masiva de personas, otorgados por el Ministerio de Salud), must have at least a grease trap or floating solids and objects interceptor system, a sampling box (caja de toma de muestras) prior to the inlet of the wastewater treatment system, according to figures 7.6 and 7.7 of the "Code of Hydraulic and Sanitary Installations in Buildings (2017 Edition)" of the Federated College of Engineers and Architects of Costa Rica (Colegio Federado de Ingenieros y de Arquitectos de Costa Rica), published in Supplement No. 38 to La Gaceta No. 37 of February 21, 2017, or the current technical standard in its absence.
• d)Wastewater from those activities indicated without an asterisk (*) in Table 1 of this Annex.

II. PROCEDURE FOR THE CHARACTERIZATION OF ORDINARY WASTEWATER

This procedure is applicable to those regulated entities with existing activities in operation and for projects in the process of obtaining a construction permit through the APC platform of the Federated College of Engineers and Architects of Costa Rica (CFIA), which are required to present the characterization of wastewater as ordinary to the Ministry of Health:

• A)EXISTING ACTIVITIES IN OPERATION:

Wastewater from activities in operation and indicated with an asterisk (*) in Table 1 of this Annex has the option to demonstrate that it is ordinary-type, by complying with the following:

• 1)Present the following documentation to the corresponding Health Area Directorate (Área Rectora de Salud, ARS):

i. Description of the activities (main and ancillary).

ii. Description of the processes of the different services provided by the establishment.

iii. Description of the handling and final disposal of solid and liquid waste in each of the processes.

iv. Laboratory analysis of raw wastewater from at least the last three (3) months before discharging to the existing treatment system, for the universal parameters established in Table 2 and complementary parameters for those activities indicated in Table 1 of Executive Decree No. 33601-MINAE-S of August 9, 2006, "Regulation for discharge and reuse of wastewater" (Reglamento de vertido y reúso de aguas residuales), published in Supplement No. 8 to La Gaceta No. 55 of March 19, 2007. The laboratory analyses must be based on a composite sample of the raw wastewater.

• 2)The ARS must review, analyze, and verify that the information presented in sub-sections i, ii, and iii of this Annex is consistent with the characteristics and conditions under which the Sanitary Operating Permit (PSF) was granted. Regarding activities that are granted the Veterinary Certificate of Operation (CVO), they must also present the documentation indicated in section 1) above.
• 3)The results obtained from the corresponding analyses must comply with the limits of the different parameters established in Table 2 and Table 3 (when applicable, according to the type of parameter) of Executive Decree No. 33601-S-MINAE-S of August 9, 2006, "Regulation for discharge and reuse of wastewater" (Reglamento de vertido y reúso de aguas residuales), published in Supplement No. 8 to La Gaceta No. 55 of March 19, 2007.
• 4)If points 2) and 3) above are met, the wastewater is considered ordinary-type.

The DARS must issue and notify an official letter of approval or non-approval of the requested process within a period of 22 calendar days counted from the receipt of the document.

The Ministry of Health, in case of any doubt regarding the type of wastewater from activities indicated without an asterisk (*) in Table 1, may order compliance with the provisions of section II of this annex.

In the event of any modification to the activities in the processes, and to the handling and final disposal of waste that could imply changes in the limits of the different established parameters and consequently could imply a change in the quality of the raw water; the generating entity must demonstrate through a new laboratory analysis that its wastewater continues to be ordinary-type.

As control and follow-up after the approval of the characterization as ordinary-type wastewater for the corresponding economic activity, the health authority may request a new water quality analysis in accordance with section 3) of part A) of this annex. In case of non-compliance, the ARS must issue an administrative act ordering that the wastewater treatment system be adjusted to the provisions of Executive Decree No. 39887-S-MINAE of April 18, 2016, "Regulation for the Approval of Wastewater Treatment Systems" (Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales).

• B)PROJECTS IN PROCESS OF OBTAINING A CONSTRUCTION PERMIT:
• 1)Construction projects in process for activities whose CR subclass is 5610.0, 5621.0, 5629.0, or 5630.0 (Restaurant and mobile food service activities), established in Annex 1 of Executive Decree No. 43432-S of March 9, 2022, "General Regulation for sanitary operating permits, qualification permits, and authorization for temporary mass gathering events, granted by the Ministry of Health" (Reglamento general para permisos sanitarios de funcionamiento, permisos de habilitación y autorización para eventos temporales de concentración masiva de personas, otorgados por el Ministerio de Salud), must provide in the construction plans the detail of a grease trap or floating solids and objects interceptor system, a sampling box (caja de toma de muestras) prior to the inlet of the wastewater treatment system, according to figures 7.6 and 7.7 of the "Code of Hydraulic and Sanitary Installations in Buildings (2017 Edition)" of the Federated College of Engineers and Architects of Costa Rica (Colegio Federado de Ingenieros y de Arquitectos de Costa Rica), published in Supplement No. 38 to La Gaceta No. 37 of February 21, 2017, or the current technical standard in its absence.
• 2)For construction projects whose wastewater comes from those activities indicated in Table 1 and with an asterisk (*) in this annex, which consider their wastewater to be ordinary-type, they must present the sworn statement (declaración jurada) referred to in this annex during the plan review process on the APC platform.
• 3)For construction projects whose wastewater comes from those activities indicated in Table 1 and with an asterisk (*) in this annex, which consider their wastewater to be ordinary-type but which already have other executed projects of a similar nature, they must comply with the provisions of section 1) of part A) "EXISTING ACTIVITIES IN OPERATION" of this annex before the APC platform of the CFIA.

Given at the Presidency of the Republic in San José, on the seventeenth day of April of two thousand twenty-three.

42075-S-MINAE del 12 de noviembre del 2019 "Reglamento para la disposición al subsuelo de aguas residuales ordinarias tratadas", publicado en el Alcance No. 87 a La Gaceta No. 80 del 14 de abril del 2020, para que en lo sucesivo se lean como sigue:

"Artículo 2.- Ámbito de aplicación. Quedan sujetos a las regulaciones del presente Reglamento, las viviendas y aquellas actividades que generan aguas residuales ordinarias y que tratadas las disponen por infiltración al subsuelo. Este reglamento será aplicable en todo el territorio nacional. Los Anexos 1, 2, 3, 4, 5 y 6 forman parte integral y vinculante del presente reglamento.

Se establecen las siguientes definiciones para la mejor interpretación del presente Reglamento:

1.Acuífero: Formación o formaciones geológicas que son capaces de almacenar y transmitir agua en cantidades aprovechables bajo la acción de gradientes hidráulicos.

2.Agua Residual: Agua que ha recibido un uso y cuya calidad ha sido modificada por la incorporación de agentes contaminantes. Para los efectos de este Reglamento, se reconocen dos tipos: ordinaria y especial.

3.Agua Residual Tratada: Es aquella agua residual que ha recibido tratamiento a través de un conjunto de procesos físicos, químicos o biológicos cuya finalidad es mejorar su calidad.

4.Agua residual ordinaria o de tipo ordinario: Es el agua residual generada por las actividades básicas del ser humano, tales como el uso de inodoros, duchas, lavatorios, fregaderos, lavado de ropa, y aquellas que cumplan con los límites establecidos para los parámetros especificados en las Tablas 2 y 3 de los artículos 18 y 19 del Decreto Ejecutivo No. 33601-MINAE-S del 9 de agosto de 2006 "Reglamento de Vertido y Reúso de Aguas Residuales", publicado en el Alcance Nº 8 a La Gaceta No. 55 del 19 de marzo del 2007 y sus reformas.

5.Agua residual especial o de tipo especial: Agua residual generada por cualquier actividad que no cumpla con la definición de agua residual ordinaria o de tipo ordinario.

6.Alcantarillado Sanitario: Sistema formado por colectores, subcolectores, obras accesorias, tuberías o conductos generalmente cerrados y que conducen aguas ordinarias, especiales o ambas, para ser tratadas y dispuestas cumpliendo las normas de calidad de vertidos que establece el Reglamento de Vertido y Reúso de Aguas Residuales.

7.Área de infiltración: Área de fondo y paredes de las zanjas de infiltración, bajo el nivel de tuberías perforadas, por donde se realiza la infiltración del agua residual tratada al subsuelo.

8.Caudal: Volumen de un líquido que pasa por un punto en un tiempo determinado.

9.Corona del talud: Sección superior del talud.

10.Efluente: Caudal de aguas residuales tratadas que sale de la última unidad del sistema de tratamiento.

11.Ente Generador: Persona física o jurídica, pública o privada, que a través de la actividad que desarrolla es responsable de la disposición sanitaria de aguas residuales mediante su drenaje al subsuelo.

12.Factor de retorno: Relación entre el volumen de agua residual que se descarga y el volumen de agua abastecida.

13.Infiltración: Es el flujo descendente del agua viajando por la zona no saturada o por zonas preferenciales hasta llegar a la zona saturada.

14.Letrina y pozo séptico o negro: La letrina es la caseta destinada a defecar utilizando un pozo séptico o negro, y este es una excavación en el terreno en forma de pozo para la disposición de excretas humanas sin el uso del agua.

15.Memoria de cálculo: Relato escrito complementario de los planos del proyecto y explicativo de los determinantes de su funcionamiento.

16.Nivel de terreno terminado: Nivel del suelo donde se asentará una obra civil luego de efectuadas las obras de remoción de suelo vegetal y escombros.

17.Prueba de infiltración: Ensayo para determinar la capacidad de absorción del subsuelo en donde se planea construir el sistema de drenaje.

18.Retiro: Distancia entre el lindero de la propiedad, edificaciones, cuerpos de agua u otros elementos claramente identificados, y el borde más cercano del sistema de drenaje y del sistema de tratamiento, en caso de que sea aplicable.

19.Sistema de Tratamiento: Conjunto de procesos físicos, químicos y biológicos cuya finalidad es mejorar la calidad del agua que incluye cómo mínimo tratamiento a nivel secundario. Para efectos de este Reglamento incluye el sistema de drenaje.

20.Sistema de drenajes: Conjunto de obras civiles e hidráulicas que permiten la disposición final de las aguas residuales tratadas al subsuelo. Sus componentes mínimos son: cajas de distribución, tuberías de drenaje, medio filtrante y cajas de muestreo.

21.Subsuelo: Estrato debajo del suelo constituido principalmente por rocas y minerales.

22.Suelo remoldeado: Suelo cuya estructura natural ha sido modificada por manipulación.

23.Sanitarios secos y composteros: Sanitarios que no requieren de agua para desalojar ni la orina ni las heces, usando únicamente la gravedad para cumplir su función, con una separación entre orina y heces para su posterior composteo y utilización como fertilizante.

24.Suelo: Constituido por la superficie del suelo más el subsuelo.

25.Tanque Séptico: Unidad de tratamiento que combina sedimentación y biodigestión de las aguas residuales ordinarias como solución para viviendas unifamiliares u otras actividades con caudales menores o iguales a 5 metros cúbicos por día (equivalentes a 190 metros cúbicos mensuales de consumo de agua con un factor de retorno de 0.8).

26.Tasa de Infiltración: Volumen de agua que es absorbido por el subsuelo en un área y tiempo determinados. Sus unidades típicas son L/m2/día.

27.Tránsito de contaminantes: Se refiere al cambio de la concentración de contaminantes, orgánicos, inorgánicos y bacterianos, en el flujo de aguas subterráneas a través del suelo.

28.Vivienda unifamiliar: Es aquella vivienda en la que una única familia ocupa el edificio en su totalidad.

29.Zanjas de Infiltración: Excavaciones en el terreno, dentro de las cuales se coloca las tuberías, grava, arena y otros elementos para permitir la infiltración del agua residual tratada en el subsuelo." "Artículo 6.- Del uso de sistema de drenajes. El uso de sistema de drenajes para la disposición de aguas residuales ordinarias tratadas, será aceptable únicamente en aquellos casos que cumplan con cada una de las siguientes condiciones:

1.Que no exista disponibilidad de alcantarillado sanitario de uso público y/o privado en funcionamiento.

2.Que el sitio del proyecto no esté ubicado en una zona con prohibición expresa del uso de este tipo de disposición de aguas residuales, establecida por reglamentación, o regulaciones institucionales o municipales claramente definidas por las entidades competentes.

3.Que el sistema de drenajes se ubique en áreas verdes no públicas. Y que no se ubiquen en: zonas de tránsito vehicular, estacionamientos (vehículos de carga y descarga), parques (áreas con acceso al público), áreas de juego en canchas deportivas, senderos, franjas verdes, islas y rotondas, aceras o debajo de estructuras con losas de concreto o asfalto, bloques, adoquines, cubiertas plásticas o cualquier otro tipo de cubierta impermeable.

4.Que el nivel freático no se ubique a una profundidad menor a 1.5 metros tomando como referencia el fondo de la zanja de infiltración (figura A, Anexo 2 del presente Reglamento).

5.Deben cumplirse con los requerimientos de los capítulos II y III del presente Reglamento.

Para disponer por medio de sistemas de drenaje las aguas residuales de tipo ordinario de sistemas de tratamiento que correspondan a entes generadores cuyos consumos reales o proyectados mensuales de agua potable no excedan los 190 metros cúbicos, deben:

1.Tratar dichas aguas, previo a su disposición, mediante la utilización de tanques sépticos u otros sistemas de tratamiento aprobados de conformidad con el Decreto Ejecutivo No.39887-S-MINAE del 18 de abril del 2016 "Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales", publicado en La Gaceta No. 179 del 19 de setiembre2016 .

2.Diseñar y Cumplir con los requerimientos mínimos establecidos en el Anexo 1 del presente Reglamento sobre los tanques sépticos.

3.Diseñar el sistema de drenajes de acuerdo con las especificaciones del artículo 11 y del Anexo 2 del presente Reglamento.

4.Adjuntar la memoria de cálculo del sistema de drenajes, de acuerdo con los lineamientos estipulados en el artículo 17 del presente Reglamento, así como el plano catastrado y el diseño del sitio con la ubicación del sistema de tratamiento y drenajes. Además, en la memoria de cálculo se debe aportar la estimación o cálculo del consumo promedio mensual de agua potable de acuerdo con la Actualización de la "Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial del AyA (acuerdo No. 2017-281) y sus reformas, publicada en la Gaceta No.164 del 26 de agosto del 2021 o lo establecido en la Tabla 3 del Anexo 3 del presente Reglamento.

5.Adjuntar el informe de resultados de las pruebas de infiltración que hayan sido efectuadas según Anexo 3 del presente Reglamento.

Lo establecido en los incisos 3, 4 y 5 del presente artículo, deben presentarse en el proyecto constructivo elaborado de conformidad con el Decreto Ejecutivo No. 36550-MP-MIVAH-S-MEIC del 28 de abril de 2011 "Reglamento para el Trámite de Revisión de los Planos para la Construcción", publicado en La Gaceta No. 117 del 17 de junio de 2011 y sus reformas.

Para disponer por medio de sistemas de drenaje las aguas residuales de tipo ordinario de sistemas de tratamiento que correspondan a entes generadores cuyos consumos reales o proyectados mensuales de agua potable que excedan los 190 metros cúbicos, deben:

1.Tratar todas las aguas residuales previo a su disposición con sistemas de tratamiento aprobados según el Decreto Ejecutivo No. 39887-S-MINAE del 18 de abril de 2016,"Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales", publicado en La Gaceta No. 179 del 19 de setiembre 2016, incluyendo los planos constructivos del sistema de drenajes.

2.Diseñar el sistema de drenajes de acuerdo con las especificaciones del artículo 11 y del Anexo 2 del presente Reglamento y contar con una caja de registro al inicio del sistema de drenajes que permita la toma de muestras y la medición del caudal.

3.Adjuntar la memoria de cálculo del sistema de drenajes de acuerdo con los lineamientos estipulados en el artículo 17 del presente Reglamento, así como el plano catastrado y el diseño del sitio con la ubicación del sistema de tratamiento y drenajes. Además, en la memoria de cálculo se debe aportar la estimación o cálculo del consumo promedio mensual de agua potable, de acuerdo con la Actualización de la "Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial del AyA (acuerdo No. 2017-281) y sus reformas, publicada en la Gaceta No.164 del 26 de agosto del 2021 o lo establecido en la Tabla 3 del Anexo 3 del presente Reglamento.

4.Adjuntar el informe de resultados de las pruebas de infiltración que hayan sido efectuadas según el Anexo 3 del presente Reglamento.

5.Presentar reportes operacionales y cumplir con los límites de los parámetros establecidos en la Tabla 1 del presente Reglamento, para la calidad de las aguas residuales tratadas a drenar.

Lo establecido en los incisos 2, 3, 4 y 5 del presente artículo, deben presentarse en el proyecto constructivo elaborado de conformidad con el Decreto Ejecutivo No. 36550-MP-MIVAH-S-MEIC del 28 de abril de 2011 y sus reformas "Reglamento para el Trámite de Revisión de los Planos para la Construcción", publicado en La Gaceta No. 117 del 17 de junio de 2011.

En el caso del desarrollo de proyectos urbanísticos cuyo uso sea exclusivamente habitacional, estos podrán utilizar sistema de tratamiento y drenaje individual para cada unidad habitacional; siempre y cuando el proyecto cuente con la exoneración de la construcción del alcantarillado sanitario y planta de tratamiento otorgado por el AyA, de conformidad con el Reglamento de Prestación de Servicios, Acuerdo de Junta Directiva de AyA 2020-442, publicado en el Alcance No. 29 a La Gaceta No. 27 del 9 de febrero del 2021.

En el caso de las Subclases CR 8510.0 "Enseñanza preescolar y primaria", 8521.0 "Enseñanza secundaria de formación general", establecidas en el Cuadro 1 "Clasificación de Actividades Económicas de Costa Rica (CAECR), basado en el CIIU.4 del anexo 6 del presente reglamento; se podrá estimar el caudal de consumo promedio mensual de agua potable por cada batería sanitaria. De obtenerse como resultados consumos menores a los 190 m3/mes para cada una delas baterías, debe cumplir lo estipulado en el artículo 7 del presente reglamento.

Para la estimación o cálculo del consumo mensual de agua potable se aceptará la siguiente documentación:

1.Para actividades existentes se aceptarán documentos basados en los consumos promedios del servicio de agua potable de los últimos seis meses suministrados por el ente operador.

2.Para proyectos nuevos habitacionales y de otra índole se aceptarán estimaciones basadas en las dotaciones según Actualización de la "Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial del AyA (acuerdo No. 2017-281) y sus reformas, publicada en la Gaceta No.164 del 26 de agosto del 2021.Para el caso de proyectos distintos a los habitacionales lo establecido en el "Código de Instalaciones Hidráulicas y Sanitarias en Edificaciones (Edición 2017)" del Colegio Federado de Ingenieros y de Arquitectos de Costa Rica, publicado en el Alcance No. 38 a La Gaceta No. 37 del 21 de febrero del 2017.

3.Para el caso de los incisos 1 y 2 de este artículo, se podrán utilizar las estimaciones para aquellas actividades que generen aguas residuales ordinarias que posteriormente se pretendan disponer mediante sistema de drenajes (ver Tabla 3 del Anexo 3 del presente Reglamento).

El sistema de drenajes debe guardar los siguientes retiros medidos a partir de los bordes externos y se deberá señalar en los planos constructivos:

(a)Con pendientes menores al 30% y medidos desde la corona del talud.

(b)Aplica para tanques de almacenamiento subterráneos o asentados sobre el terreno.

(c)Se refiere a la edificación más cercana al sistema de drenajes, ubicada dentro de la propiedad.

(d)De acuerdo con la Ley No. 276 Ley de Aguas y a la Ley No. 7575 Ley Forestal.

(e)Alineamiento según lo indique la Ley No. 7575 Ley Forestal." "Artículo 12.- Responsabilidad del propietario y del profesional. Los profesionales encargados del diseño, ejecución y de la dirección técnica de la obra, serán responsables según sus competencias de cualquier deficiencia del sistema, que sea atribuible a problemas en el diseño o la construcción del sistema de tanque séptico y drenaje. Por su parte el propietario del inmueble será responsable de su operación y mantenimiento. Cualquier cambio que se realice al sistema una vez entregada la obra por parte del profesional encargado de la dirección técnica, será responsabilidad del propietario y de quien contrate para esos cambios." "Artículo 35.- De la disposición en subsuelo de aguas residuales especiales. Se prohíbe la disposición en el subsuelo, mediante el sistema de drenajes, de aguas residuales especiales tratadas o no.

Para aquellas actividades que dispongan sus aguas residuales tratadas en el subsuelo mediante sistemas de drenaje autorizados por el Ministerio de Salud antes de la promulgación del Decreto Ejecutivo No. 39887-S-MINAE del 18 de abril de 2016, "Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales", publicado en La Gaceta No. 179 del 19 de setiembre 2016; podrán continuar con la misma forma de disposición, siempre y cuando demuestren que sus aguas residuales se caracterizan como tipo ordinario, de conformidad con el "Procedimiento para la caracterización de aguas de tipo ordinario", establecido en el anexo 6 del presente reglamento.

"Artículo 40.- Agréguese al artículo 5 del Decreto Ejecutivo No. 39887-S-MINAE del 18 de abril de 2016 "Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales" publicado en el Alcance No. 186 a La Gaceta No. 179 del 19 de setiembre 2016, el inciso j) que diga así: "En el caso de proyectos con disposición por infiltración de aguas residuales ordinarias tratadas que excedan los 190 metros cúbicos en sus consumos reales o proyectados mensuales de agua potable, la viabilidad ambiental del proyecto debe contemplar la evaluación del tratamiento y disposición de las aguas residuales, de conformidad con el Decreto Ejecutivo No. 42015-MAG-MINAE-S-MIVAH del 25 de octubre del 2019 "Reglamento de coordinación interinstitucional para la protección de los recursos hídricos subterráneos", publicado en el Alcance No. 237 a La Gaceta No. 203 del 25 de octubre del 2019. La Secretaría Técnica Nacional Ambiental (SETENA) cuando así lo considere, podrá realizar las consultas o solicitar apoyo para el análisis de esta evaluación al Servicio Nacional de Aguas Subterráneas Riego y Avenamiento (SENARA)." "ANEXO 1 TANQUES SÉPTICOS A)LINEAMIENTOS GENERALES DE UN TANQUE SEPTICO:

i Retiros: El retiro mínimo debe ser de un metro (1,0 m) desde el tanque séptico y su sistema de drenaje con respecto a los linderos de la propiedad.

ii Elementos de entrada y salida: Todo tanque séptico debe contar con elementos reguladores de flujo (pantallas) en la entrada y salida, para lo que pueden utilizar uniones en T, con niples hacia abajo (ver tabla 1 del presente Anexo) y niples hacia arriba dejando dos centímetros(2 cm) libres antes de la losa superior o tapa. La tubería de entrada y la tubería de salida debe tener un diámetro mínimo de 0.1 m.

iii Calidad de los materiales: El tanque séptico y sus tapas requieren ser herméticas. Las paredes y el piso del tanque deben ser impermeables y resistentes a la corrosión.

iv Evacuación de gases: Los gases generados en el tanque séptico se deben de ventilar pormedio de tubería exclusiva para tal fin en un diámetro mínimo de 38 mm (1.5 pulgadas). La tubería debe salir de la parte superior del tanque.

v Tiempo de retención: El tiempo de retención hidráulico se calcula como T.R.H.= V/Q, donde V será el volumen útil de la unidad y Q será el caudal promedio diario de diseño del sistema. Se permitirá el uso de otras metodologías de diseño siempre y cuando se cumpla con el requisito de T.R.H mínimo y los demás requerimientos de la Tabla 1 del presente Anexo.

vi Tanques sépticos con más de una recámara: Para tanques sépticos rectangulares con más de una recámara, el primer compartimento debe cumplir con los requerimientos establecidos en la Tabla 1 del presente Anexo, además ese compartimento debe tener como mínimo una longitud de L/2, y se recomienda un 60-75% del volumen de diseño. Las interconexiones entre compartimentos deben evitar el paso de natas y lodos.

B)REQUERIMIENTOS TÉCNICOS PARA TANQUES SÉPTICOS: Los requerimientos técnicos mínimos que se deben cumplir para el diseño del tanque séptico se muestran en la siguiente tabla:

Nota: Los tanques sépticos en su sección transversal pueden ser rectangular, trapezoidal o circular.

C.1. Diagrama de un tanque séptico.

D)DISPOSICIONES GENERALES DE LAS AGUAS RESIDUALES:

a. Es obligatorio que la totalidad de las aguas residuales ordinarias (inodoros, duchas, fregadero, lavado de manos, ropa, platos, y similares) se dispongan al tanque séptico. Estos aportes deben contemplarse en el cálculo del caudal promedio diario para el diseño del tanque séptico.

b. En el caso de las aguas provenientes del lavado de platos, deben pasar por una trampa de grasas de doble cámara antes de la descarga al tanque séptico. Dicha trampa de grasas debe tener mantenimiento periódico, que consiste en remover y disponer los residuos sólidos y degrasas cada tres meses.

c. Es responsabilidad del propietario que se realice la extracción de los lodos del tanque séptico con una frecuencia mínima de dos años de acuerdo con su diseño. La disposición de los lodos se rige según lo establecido en el Decreto Ejecutivo No. 39316-S del 10 de agosto del2015 "Reglamento para el manejo y disposición final de lodos y biosólidos" publicado en el Alcance N° 106 a La Gaceta No. 234 del 2 de diciembre del 2015." "ANEXO 2 REQUERIMIENTOS PARA ZANJAS DE INFILTRACIÓN i El ancho W debe tener una longitud entre 0,30 m y 0,90 m (ver Figura A del presente Anexo).

ii La tubería debe ser específica para drenaje, perforada o ranurada, con sello o tapón al finalde cada línea de drenaje y de diámetro mínimo comercial de 100 mm (ver Figura A delpresente Anexo).

iii La tubería debe descansar sobre una capa de grava (de 7 a 10 cm de diámetro), de 30 cm a90 cm de ancho y de 30 cm a 90 cm de altura D (ver Figura A del presente Anexo).

iv La tubería de drenaje debe estar rodeada de piedra cuarta o tercera, cuyo tamaño promediose encuentre entre 2 cm y 5 cm, con una cubierta mínima de 5 cm encima de la corona deltubo más 5 cm adicionales de arena sobre este estrato (ver Figura A del presente Anexo).

v Finalmente, se debe colocar una cubierta de tierra sobre el relleno de arena de una alturamáxima de 30 cm (ver Figura A del presente Anexo).

vi La pendiente del fondo de la zanja y la tubería de drenaje debe ser "cero" (no debe existirpendiente). (ver Figuras A, B, C del presente Anexo) vii La distancia entre la línea centro de las zanjas debe ser mayor al ancho más 1,5 m, con unmínimo de 1,8 m.

viii La longitud máxima de la zanja de infiltración más larga no deberá exceder los 60 m y cada20 m debe contar con una caja de registro.

ix En terrenos planos, donde el desnivel del terreno no exceda el 1% en cualquier dirección, laszanjas se pueden distribuir en serie o en paralelo.

x En terrenos inclinados, cuya pendiente esté entre el 1% y el 30%, la distribución de zanjasdebe hacerse de acuerdo con lo siguiente:

x.1. Las zanjas de infiltración deben seguir aproximadamente los contornos de la superficiedel terreno (paralelo a las curvas de nivel) para que las variaciones en la profundidad de laszanjas sean mínimas.

x.2. Las zanjas adyacentes se conectan entre sí mediante conexión Tee o preferiblementemediante cajas de registro con caída (ver Figura D del presente Anexo).

x.3. La separación entre zanjas para terrenos inclinados debe ser como mínimo de 5 m decentro a centro. (ver Figura D del presente Anexo).

xi.No se permite el uso de plásticos u otros materiales impermeables como barrera entre lasdiversas capas que conforman el sistema de drenajes.

42075-S-MINAE del 12 de noviembre del 2019 "Reglamento para la disposición al subsuelo de aguas residuales ordinarias tratadas", publicado en el Alcance No. 87 a La Gaceta No. 80 del 14 de abril del 2020, para que en lo sucesivo se lean como sigue:

"Artículo 13 bis. Caracterización de las aguas residuales ordinarias. Para efectos de determinar las cualidades del agua residual de tipo ordinario, se establece en el Anexo 6 del presente Decreto Ejecutivo, el procedimiento para su caracterización." "ANEXO 6 PROCEDIMIENTO PARA LA CARACTERIZACIÓN DE AGUAS RESIDUALES TIPO ORDINARIA I.CONSIDERACIONES GENERALES PARA AGUAS RESIDUALES DE TIPOORDINARIO Para actividades existentes y proyectos en trámite del permiso de construcción; se consideran aguas residuales de tipo ordinario:

a)Aquellas aguas residuales provenientes de: viviendas unifamiliares y multifamiliares, condominios habitacionales, urbanizaciones, residenciales y fraccionamientos.

b)Aquellas aguas residuales provenientes de actividades, cuya generación es únicamente de inodoros, duchas, lavatorios, fregaderos y pilas para aseo básico.

c)Aquellas aguas residuales provenientes de las actividades cuya subclase CR sea 5610.0,5621.0, 5629.0 ó 5630.0 (Actividades de restaurantes y de servicios móviles de comidas),establecidas en el Anexo 1 del Decreto Ejecutivo No. 43432-S del 9 de marzo del 2022"Reglamento general para permisos sanitarios de funcionamiento, permisos de habilitación y autorización para eventos temporales de concentración masiva de personas, otorgados por el Ministerio de Salud", como mínimo deben de contar con un sistema interruptor de grasas o de sólidos y objetos flotantes, una caja de toma de muestras previo a la entrada del sistema de tratamiento de aguas residuales, según las figuras 7.6 y 7.7 del "Código de Instalaciones Hidráulicas y Sanitarias en Edificaciones (Edición 2017)" del Colegio Federado de Ingenieros y de Arquitectos de Costa Rica, publicado en el Alcance No. 38 a La Gaceta No. 37 del 21 de febrero del 2017 o en su defecto la norma técnica vigente.

d)Aquellas aguas residuales provenientes de las actividades señaladas sin asterisco (*) en el Cuadro 1 de este Anexo.

II.PROCEDIMIENTO PARACARACTAREZACIÓN DE AGUAS RESIDUALES ORDINARIAS Este procedimiento es aplicable para aquellos administrados con actividades existentes en funcionamiento y para proyectos en trámite de construcción ante la plataforma APC del Colegio Federado de Ingenieros y de Arquitectos de Costa Rica (CFIA), que requieren presentar ante el Ministerio de Salud la caracterización de las aguas residuales como ordinarias:

A)ACTIVIDADES EXISTENTES EN FUNCIONAMIENTO:

Las aguas residuales provenientes de las actividades en funcionamiento y señaladas con asterisco (*) en el Cuadro 1 de este Anexo, tienen la opción de demostrar que son de tipo ordinario, cumpliendo con lo siguiente:

1)Presentar ante el Área Rectora de Salud (ARS) correspondiente la siguiente documentación:

i. Descripción de las actividades (principal y accesorias).

ii. Descripción de los procesos de los diferentes servicios que brinda el establecimiento.

iii. Descripción del manejo y disposición final de residuos sólidos y líquidos, en cada uno delos procesos.

iv. Análisis de laboratorio de las aguas crudas como mínimo de los últimos tres (3) meses antes de descargar al sistema de tratamiento existente, de los parámetros universales establecidos en la Tabla 2 y parámetros complementarios para aquellas actividades señaladas en la Tabla1 del Decreto Ejecutivo No. 33601-MINAE-S del 9 de agosto del 2006 "Reglamento devertido y reúso de aguas residuales" publicado en el Alcance No. 8 a La Gaceta No. 55 del19 de marzo del 2007. Los análisis del laboratorio deben basarse en una muestra compuesta de las aguas residuales crudas.

2)El ARS debe revisar, analizar y verificar que la información presentada en los subincisos i,ii y iii del presente Anexo, está acorde con las características y condiciones en que fue otorgado el Permiso Sanitario de Funcionamiento (PSF). Respecto a las actividades que se les otorga el Certificado Veterinario de Operación (CVO), de igual manera deben presentar la documentación indicada en el inciso 1) anterior.

3)Los resultados obtenidos de los análisis correspondientes deben cumplir con los límites delos diferentes parámetros establecidos en la tabla 2 y tabla 3 (cuando aplique, según tipo de parámetro) del Decreto Ejecutivo No. 33601-S-MINAE-S del 9 de agosto del 2006"Reglamento de vertido y reúso de aguas residuales" publicado en el Alcance No. 8 a La Gaceta No. 55 del 19 de marzo del 2007.

4)Si se cumple con los puntos 2) y 3) anteriores, las aguas residuales se consideran de tipo ordinario.

Las DARS deben emitir y notificar un oficio de aprobación o no aprobación del trámite solicitado en un plazo de 22 días naturales contados a partir de la recepción del documento.

El Ministerio de Salud, ante alguna duda del tipo de aguas residuales provenientes de actividades señaladas sin asterisco (*) en el Cuadro 1, podrá ordenar el cumplimiento de lo establecido en el inciso II de este anexo.

Ante cualquier modificación de las actividades en los procesos y del manejo y disposición final de los residuos que pudieran implicar cambios en los límites de los diferentes parámetros establecidos y que consecuentemente pudieran implicar una modificación en la calidad de las aguas crudas; el ente generador debe demostrar mediante un nuevo análisis de laboratorio que sus aguas continúan siendo de tipo ordinario.

Como control y seguimiento posterior a la aprobación de la caracterización como aguas residuales de tipo ordinaria de la actividad económica correspondiente, la autoridad sanitaria, podrá solicitar un nuevo análisis de calidad de agua residual de conformidad con el inciso 3) del apartado A) de este anexo. En caso de incumplimiento las ARS debe girar el acto administrativo donde se ordene que el sistema de tratamiento de aguas residuales se ajuste a lo establecido en el Decreto Ejecutivo No. 39887-S-MINAE del 18 de abril de 2016 "Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales".

B)PROYECTOS EN TRÁMITE DE PERMISO DE CONSTRUCCIÓN:

1)Los proyectos constructivos en trámite de las actividades cuya subclase CR sea 5610.0,5621.0, 5629.0 ó 5630.0 (Actividades de restaurantes y de servicios móviles de comidas),establecidas en el Anexo 1 del Decreto Ejecutivo No. 43432-S del 9 de marzo del 2022"Reglamento general para permisos sanitarios de funcionamiento, permisos de habilitación y autorización para eventos temporales de concentración masiva de personas, otorgados por el Ministerio de Salud", deben aportar en láminas constructivas el detalle de un sistema interruptor de grasas o de sólidos y objetos flotantes, una caja de toma de muestras previo a la entrada del sistema de tratamiento de aguas residuales, según las figuras 7.6 y 7.7 del "Código de Instalaciones Hidráulicas y Sanitarias en Edificaciones (Edición 2017)" del Colegio Federado de Ingenieros y de Arquitectos de Costa Rica, publicado en el Alcance No. 38 a La Gaceta No. 37 del 21 de febrero del 2017 o en su defecto la norma técnica vigente.

2)Para proyectos constructivos cuyas aguas residuales provenientes de aquellas actividades señaladas en el Cuadro 1 y con asterisco (*) de este anexo, que consideren que sus aguas residuales son de tipo ordinario, deben de presentar en el proceso del trámite de los planos en la plataforma del APC, la declaración jurada referida en este anexo.

3)Para proyectos constructivos cuyas aguas residuales provenientes de aquellas actividades señaladas en el Cuadro 1 y con asterisco (*) de este anexo, que consideren que sus aguas residuales son de tipo ordinario pero que ya cuenten con otros proyectos ejecutados de naturaleza similar, deberán cumplir con lo señalado en el inciso 1) del apartado A) "ACTIVIDADES EXISTENTES ENFUNCIONAMIENTO" de este anexo ante la plataforma APC del CFIA DECLARACIÓN JURADA El suscrito: ________________________________________________________ con domicilio en Provincia:____________,Cantón:_________Distrito:___________________, otras señas: _______________________________________, Cédula identidad, de pasaporte o de residencia N° _____________________, miembro del CFIA N°:________________________. Quedo apercibido de las consecuencias legales y judiciales, con que la legislación castiga los delitos de falsedad ideológica, que toda la información que se detalla en esta declaración es veraz y cierta.

Asimismo, dejo exonerado a las autoridades del Ministerio de Salud por el otorgamiento del visado sanitario del proyecto con base en la presente declaración. Además, tengo conocimiento de que dicho Ministerio puede suspender o cancelar dicho visado, si se llegase a comprobar alguna falsedad en la presente declaración, errores u omisiones en los documentos y planos aportados, por lo tanto dejo a las autoridades del Ministerio de Salud para que procedan a aplicar alguna de las medidas sanitarias especiales previstas en la Ley General de Salud y si fuere el caso, interponer la denuncia correspondiente ante el Ministerio Público y el colegio Federado de Ingenieros y de Arquitectos, siendo el suscrito responsable de todas las implicaciones que esto conlleva.
