throughout the entire text - Complete Text of Norm 086 Establishes a total closure for sport fishing and small-scale commercial fishing, except for small-scale commercial tourist fishing, during the period from May 1 to July 31, 2023, both dates inclusive COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/086-2023.-Puntarenas, on the twenty-fifth day of April, two thousand twenty-three.

1. That the Directorate of Fisheries and Aquaculture Management, after coordinating a meeting with representatives of small-scale commercial fishing and the semi-industrial sardine fleet; as well as the National Closures Commission, by official communication INCOPESCA-DOPA-040-2023 recommends the conditions for the closure in the Gulf of Nicoya, also ratifying the technical opinion provided by the Research Department by official communication INCOPESCA-DOPA-DINV-024-2023.

2. That INCOPESCA has scientific studies that support the establishment of this closure period on the proposed dates.

3. That by official communication DOPA-014-2023, the results of the research on the capture of bycatch (fauna de acompañamiento) in the semi-industrial fishing of Sardine species of the Ophistonema sp. complex in the Gulf of Nicoya, carried out by the Research Department, were presented, in which it was once again confirmed that the incidental catch for sardine fishing represents less than 3% of the total catch of said vessels; which is not significant and falls within the 10% maximum tolerance margin allowed according to point 1.4 of the Board of Directors agreement 100-2021.

4. That by Board of Directors agreement AJDIP/040-2023, dated 02-28-2023, the research report cited above was ratified.

5. That the proposal for a total closure in the Gulf of Nicoya for fishing during the year 2023 is presented for study and assessment.

6. That in the fishing activity of the Gulf of Nicoya, a new activity of small-scale commercial tourist fishing has been developing, whose representatives have joined the National Closures Commission.

7. That once the proposal was discussed and analyzed by the directors, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, THEREFORE; AGREES 1. To establish a total closure for sport fishing and small-scale commercial fishing, except for small-scale commercial tourist fishing, during the period from May 1 to July 31, 2023, both dates inclusive, in the area bounded by an imaginary straight line running from Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Isla Negritos Outer Lighthouse (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from there inshore to the mouth of the Tempisque River, as shown on the attached map.

2. During the months of June and July 2023, semi-industrial sardine purse seiner vessels are permitted to enter to operate solely in the area defined by an imaginary line that starts at Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Isla Negritos Outer Lighthouse (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from there to the Puntarenas Lighthouse (9° 58´ 36.03´´ North Latitude 84° 51´ 03.93´´ West Longitude), for the purpose of supplying sardine for bait to the national fishing fleet and any surplus may be marketed for other purposes as established.

3. That all landings made by the semi-industrial sardine purse seiner fleet shall be duly inspected by the Institution's inspectors. Said inspection must cover not only the landings of sardine, but also those of bycatch (fauna de acompañamiento). In turn, the Research Department will carry out biological sampling of said catches to evaluate the reproductive behavior of the sardines and to ensure that the sizes caught comply with the legal minimum catch sizes.

4. That a maximum incidental catch quota of 10% is established, relative to the total catch of sardine by the boats of the semi-industrial sardine purse seiner fleet.

5. Fishing for barracuda or candado (Sphyraena ensis) is authorized only for fishers who are authorized in their fishing license to operate with handline, during the months of May, June, and July 2023.

6. In the case of small-scale commercial tourist fishing that has been developing as part of the fishing activity in the Gulf of Nicoya, given that an analysis has not been established within the Closures Commission to adequately evaluate the characteristics of this activity in terms of whether they can qualify for the economic aid granted during this prohibition and given that there are few permit holders, they will be authorized to fish solely in the area defined by an imaginary line extending from the Puntarenas Lighthouse (9° 58´ 36.03´´ North Latitude 84° 51´ 03.93´´ West Longitude) to the eastern end of Punta Cuchillo (09°50´03" North Latitude, 084°53´42" West Longitude) offshore towards the oceanic part.

7. The extraction of pianguas (pianguas) is not included in this closure. Marine organism cultivation activities carried out in the Gulf of Nicoya are not subject to this closure.

8. Taking into consideration the difficult socioeconomic situation of the coastal communities, fishing for domestic consumption will be permitted in the zone covered in point 1 of this agreement during the current closure. Those who choose to carry out this fishing must comply with the regulations established by Board of Directors agreement AJDIP-511-2017.

9. Carry out the pertinent coordination among INCOPESCA, SENASA, and the Ministry of Public Security, in order to guarantee control and surveillance operations during the closure period.

10. What is established in agreement AJDIP-166-2017, "Regulation for the fulfillment of Community Work Service by the fisher registered during Closure," is rendered without effect during this year 2023.

11. In the case of fishers who have in their fishing license the possibility of carrying out fishing operations outside the zone subject to closure, established in point one of this agreement, and who decide not to avail themselves of the closure, they may directly submit the documents as appropriate to the Registration Department of INCOPESCA for processing, or coordinate with the Fishers' Associations that represent them so that said organization prepares a list of the fishers in this condition. Said list must contain the name and identification number of each fisher, the commercial fishing license number and its expiration date, the name of the vessel and registration number, likewise, all crew members are required to carry a valid fishing license. The organization must submit said list to the Registration Department of Incopesca, as well as the permit holders who decide to carry out the process personally, so as to be able to engage in fishing activity outside the closed area, in accordance with the conditions established in the respective fishing license and to be able to request the benefit of competitively priced fuel. The Registration Department must forward said list to the National Coast Guard Service. What is established in this point applies only to those vessels that can operate outside the zone subject to this closure.

13. Agreement is final.

The possibility of holding Tourist Sport Fishing Tournaments, in the catch-and-release modality, within the closure area is authorized, provided that INCOPESCA approval is obtained and all requirements established for holding this type of event are met.

CONSIDERING

en la totalidad del texto - Texto Completo Norma 086 Establece veda total para la pesca deportiva y pesca comercial en pequeña escala, excepto para la pesca turística comercial de pequeña escala, en el periodo que va desde el 01 de mayo hasta el 31 de julio del 2023, ambas fechas incluidas INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/086-2023.-Puntarenas, a los veinticinco días del mes de abril de dos mil veintitrés.

1. Que la Dirección de Ordenamiento Pesquero y Acuícola luego de coordinar una reunión con los representantes de pesca comercial de pequeña escala y la flota semiindustrial de sardina; así como, la Comisión Nacional de Vedas, mediante oficio INCOPESCA-DOPA-040-2023 recomienda las condiciones para la veda en el Golfo de -Nicoya, ratificando además el criterio técnico brindado por el Departamento de Investigación mediante oficio INCOPESCA-DOPA-DINV-024-2023.

2. Que el INCOPESCA cuenta con estudios científicos que fundamentan el establecimiento de este periodo de veda en las fechas propuestas.

3. Que mediante oficio DOPA-014-2023, se presentan los resultados de la investigación sobre la captura de fauna de acompañamiento en la pesca semi-industrial de las especies de Sardina del complejo Ophistonema sp., en el Golfo de Nicoya, realizado por el Departamento de Investigación, en el cual se volvió a confirmar que la captura incidental para la pesca de sardina, representa menos del 3% de la captura total de dichas embarcaciones; lo cual no es significativo y se ubica dentro del 10% máximo del margen de tolerancia permitido conforme a lo normado mediante el punto 1.4. del acuerdo de junta directiva 100-2021 4. Que mediante el acuerdo de Junta Directiva AJDIP/040-2023, de fecha 28-02-2023, se ratificó el informe de investigación citado anteriormente.

5. Que se presenta para estudio y valoración la propuesta de veda total en el Golfo de Nicoya, para la pesca durante el año 2023.

6. Que en la actividad pesquera del Golfo de Nicoya se ha venido desarrollando una nueva actividad de pesca comercial turística de pequeña escala, quienes se han incorporado al seno de la Comisión Nacional de Vedas.

7. Que una vez discutida y analizada la propuesta por los señores directores, Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, POR TANTO; ACUERDA 1. Establecer una veda total para la pesca deportiva y pesca comercial en pequeña escala, excepto para la pesca turística comercial de pequeña escala, en el periodo que va desde el 01 de mayo hasta el 31 de julio del 2023, ambas fechas incluidas, en el área delimitada por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y de ahí aguas adentro hasta la desembocadura del río Tempisque, según se observa en el mapa adjunto.

2. Durante los meses de junio y julio del 2023, se permite el ingreso a las embarcaciones semiindustriales sardineras, para faenar únicamente en el área definida por una línea imaginaria que inicia en Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y de ahí hasta el Faro de Puntarenas (9° 58´ 36.03´´ Latitud Norte 84° 51´ 03.93´´Longitud Oeste), a efectos que suplan sardina para carnada a la flota pesquera nacional y los excedentes podrán ser comercializados para otros fines según lo establecido.

3. Que todas las descargas que se realicen por parte de la flota semi-industrial bolichera de sardina serán debidamente inspeccionadas por parte de los inspectores de la Institución. Dicha inspección debe cubrir no solo las descargas de sardina, sino también la de fauna de acompañamiento. A su vez el Departamento de Investigación realizará muestreos biológicos de dichas capturas para evaluar el comportamiento reproductivo de las sardinas y que las tallas capturadas cumplan con las tallas legales de primera captura.

4. Que se establece una cuota de captura incidental máxima del 10%, con respecto a la captura total de sardina por parte de los barcos de la flota semi-industrial bolichera de sardina.

5. Se autoriza únicamente la pesca de barracudas o candado (Sphyraena ensis) a los pescadores que así lo tengan autorizado en su licencia de pesca para faenar con cuerda de mano, durante los meses de mayo, junio y julio del 2023.

6. En el caso de la pesca comercial turística de pequeña escala que se ha venido incorporando a la actividad pesquera en el Golfo de Nicoya, dado que no se ha establecido un análisis en el seno de la Comisión de Veda para evaluar adecuadamente las características de esta actividad en el sentido de si pueden calificar para el auxilio económico que se otorga durante esta prohibición y dado que son pocos los permisionarios, se les autorizará la pesca únicamente en el área definida por una línea imaginaria que se extiende desde el Faro de Puntarenas (9° 58´ 36.03´´ Latitud Norte 84° 51´ 03.93´´Longitud Oeste) hasta el extremo este de Punta Cuchillo (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) aguas afuera hacia la parte oceánica.

7. En esta veda no se incluye la extracción de pianguas. Los cultivos de organismos marinos que se desarrollan en el Golfo de Nicoya no están sujetos a esta veda.

8. Tomando en consideración la difícil situación socioeconómica de las comunidades costeras, se permitirá en la zona comprendida en el punto 1 de este acuerdo, la pesca para el consumo doméstico durante la presente veda. Quienes opten por realizar esta pesca, deberán cumplir con la normativa según lo establecido por el acuerdo de Junta Directiva AJDIP-511-2017.

9. Realizar las coordinaciones pertinentes entre el INCOPESCA, SENASA y el Ministerio de Seguridad Pública, con el fin de garantizar los operativos de control y vigilancia durante la época de veda.

10. Se deja sin efecto durante este año 2023, lo establecido en el acuerdo AJDIP-166-2017 "Regulación para el cumplimiento del Servicio de Trabajo Comunal por parte del pescador inscrito en Veda".

11. En el caso de aquellos pescadores que teniendo en su licencia de pesca la posibilidad de realizar faenas de pesca fuera de la zona objeto de veda, establecida en el inciso número uno del presente acuerdo y decidan no acogerse a la veda, podrán realizar la entrega directa de los documentos que corresponda al Departamento de Registro del INCOPESCA para su tramitación, o bien coordinar con las Asociaciones de Pescadores que los representan para que dicha organización prepare una lista de los pescadores en esta condición. Dicha lista debe contener el nombre y número de cedula de cada pescador, el número de carne de pesca comercial y su fecha de vencimiento, nombre de la embarcación y número de matrícula, asimismo, todos tripulantes están obligados a portar el carné de pesca vigente. La organización deberá presentar dicha lista ante el Departamento de Registro del Incopesca, así como, los permisionarios que decidan realizar el trámite personalmente, con el fin de poder ejercer la actividad de pesca fuera del área vedada, conforme a las condiciones establecidas en la licencia de pesca respectiva y poder solicitar el beneficio del combustible a precio competitivo. El Departamento de Registro, deberá trasladar dicho listado al Servicio Nacional de Guardacostas. Lo establecido en el presente inciso aplica únicamente para aquellas embarcaciones que puedan faenar fuera de la zona objeto de la presente veda.

13. Acuerdo firme.

Se autoriza la posibilidad de realizar Torneos de Pesca Deportiva Turística, en la modalidad de pesca y liberación dentro del área de veda, siempre que se cuente con la aprobación del INCOPESCA y se cumpla con todos los requisitos establecidos para la realización de este tipo de eventos.
