across the entirety of the text - Complete Text of Norm 092 Reform Establishes a total closure for sport fishing and small-scale commercial fishing, except for small-scale commercial tourism fishing, during the period from May 1 to July 31, 2023, both dates inclusive COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/092-2023.—Puntarenas, on the second day of May of two thousand twenty-three.
1.—That by Board of Directors Agreement AJDIP/086-2023, a total closure is established for sport fishing and small-scale commercial fishing, except for small-scale commercial tourism fishing in the Gulf of Nicoya, for the current year 2023.
2.—That in the por tanto number 11 of the referenced Agreement, the procedure to be followed is determined in the case of those fishers who, having on their fishing license the possibility of conducting fishing operations outside the closure zone, decide not to avail themselves of the established closure period, in order to be able to engage in fishing activity outside the closed area, in accordance with the conditions established in the respective fishing license and likewise to be able to request the benefit of fuel at a competitive price.
3.—That in said Por Tanto, it was determined that it will be through the Fishers' Associations that the lists of member fishers who decide to avail themselves of such a process are sent; however, the foregoing does not negate the possibility that the interested permit holders themselves may be the ones who deliver the documents to avail themselves of such an option.
4.—That the Members of the Board consider the feasibility and advisability of adding to Por Tanto 11 of the aforementioned Agreement the possibility that, in addition to the Associations, the permit holders as directly interested parties may deliver the corresponding documents to not avail themselves of the established closure period, for which the established requirements must be met at all times.
5.—That once discussed, analyzed, and evaluated by the Members of the Board, regarding the need to modify the aforementioned closure Agreement so that those permit holders whose small-scale commercial fishing license allows them to operate outside the closed area are not negatively impacted during the closure months, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture. Therefore, AGREES:
1°—To modify Por Tanto 11° of Board of Directors Agreement AJDIP/086-2023, published in Alcance N°.76 of the Official Gazette La Gaceta N° 74 of April 28, 2023, so that henceforth it reads as follows:
11°. "In the case of those fishers who, having on their fishing license the possibility of conducting fishing operations outside the zone subject to closure, established in item number one of this agreement, and decide not to avail themselves of the closure, they may deliver the corresponding documents directly to the Registration Department of INCOPESCA for processing, or coordinate with the Fishers' Associations that represent them so that said organization prepares a list of the fishers in this condition. Said list must contain the name and ID number of each fisher, the commercial fishing license number and its expiration date, the name of the vessel and registration number, likewise, all crew members are required to carry a valid fishing license. The organization must submit said list to the Registration Department of Incopesca, as well as the permit holders who decide to carry out the process personally, in order to be able to engage in fishing activity outside the closed area, in accordance with the conditions established in the respective fishing license and to be able to request the benefit of fuel at a competitive price. The Registration Department must forward said list to the National Coast Guard Service. What is established in this item applies only to those vessels that can operate outside the zone subject to this closure." 2°—Firm agreement.
3°—Effective upon its adoption. Let it be published.
Considering:
en la totalidad del texto - Texto Completo Norma 092 Reforma Establece veda total para la pesca deportiva y pesca comercial en pequeña escala, excepto para la pesca turística comercial de pequeña escala, en el periodo que va desde el 01 de mayo hasta el 31 de julio del 2023, ambas fechas incluidas INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/092-2023.-Puntarenas, a los dos días del mes de mayo de dos mil veintitrés.
1.-Que mediante Acuerdo de Junta Directiva AJDIP/086-2023, se establece una veda total para la pesca deportiva y pesca comercial en pequeña escala, excepto para la pesca turística comercial de pequeña escala en el Golfo de Nicoya, correspondiente al presente año 2023.
2.-Que en el por tanto número 11 del Acuerdo de referencia, se determina el procedimiento a seguir en el caso de aquellos pescadores que teniendo en su licencia de pesca la posibilidad de realizar faenas de pesca fuera de la zona de veda, decidan no acogerse al periodo de veda establecida, con el fin de poder ejercer la actividad de pesca fuera del área vedada, conforme a las condiciones establecidas en la licencia de pesca respectiva y asimismo poder solicitar el beneficio del combustible a precio competitivo.
3.-Que en dicho Por Tanto, se determinó que serán a través de las Asociaciones de Pescadores, quienes remitan las listas de los pescadores agremiados que decidan acogerse a tal tramite, sin embargo, lo anterior no enerva la posibilidad que puedan ser los mismos permisionarios interesados directos quienes puedan entregar los documentos para acogerse a tal opción.
4.-Que consideran los Señores Directivos, la viabilidad y conveniencia de adicionar al Por Tanto 11 del Acuerdo supra, la posibilidad de que además de las Asociaciones, los permisionarios como interesados directos puedan realizar la entrega de los documentos que corresponda para no acogerse al periodo de veda establecida, para lo cual se debe cumplir en todo momento con los requisitos establecidos.
5.-Que una vez discutida, analizada y valorada por los Señores Directores, sobre la necesidad de modificar el Acuerdo de veda supracitado; para que aquellos permisionarios cuya licencia de pesca comercial en pequeña escala les permita faenar fuera del área vedada, no se vean impactados negativamente durante los meses de veda; la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura. Por tanto, ACUERDA:
1°-Modificar el Por Tanto 11°, del Acuerdo de Junta Directiva AJDIP/086-2023, publicado en el Alcance N°.76 del Diario Oficial La Gaceta N° 74 del 28 de abril de 2023, para que en lo sucesivo se lea de la siguiente manera:
11°. "En el caso de aquellos pescadores que teniendo en su licencia de pesca la posibilidad de realizar faenas de pesca fuera de la zona objeto de veda, establecida en el inciso número uno del presente acuerdo y decidan no acogerse a la veda, podrán realizar la entrega directa de los documentos que corresponda al Departamento de Registro del INCOPESCA para su tramitación, o bien coordinar con las Asociaciones de Pescadores que los representan para que dicha organización prepare una lista de los pescadores en esta condición. Dicha lista debe contener el nombre y número de cedula de cada pescador, el número de carne de pesca comercial y su fecha de vencimiento, nombre de la embarcación y número de matrícula, asimismo, todos tripulantes están obligados a portar el carné de pesca vigente.
