Registration No. 43884-MAG-S-MINAE THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF AGRICULTURE AND LIVESTOCK, THE MINISTER OF HEALTH, AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on the powers and authorities granted in Articles 46, 47, 50, and 140, subsections 3) and 18), and Article 146 of the Political Constitution; Articles 27.1 and 28.2.b) of the General Law of Public Administration, No. 6227 of May 2, 1978; Article 2, subsection e), Article 5, subsections c), d), and o), Articles 23 through 39, and related articles of the Phytosanitary Protection Law, No. 7664 of April 8, 1997; Articles 1, 2, 4, 7, 244, 245, and 252 of the General Health Law, No. 5395 of October 30, 1973; Articles 2, subsections b), c), and g) of the Organic Law of the Ministry of Health, and related articles, No. 5412 of November 8, 1973; Article 50 of the Biodiversity Law, No. 7788 of April 30, 1998; Law on the Use, Management, and Conservation of Soils, No. 7779 of April 30, 1998; Organic Law of the Ministry of Environment and Energy, No. 7152 of June 5, 1990; Articles 1, 2, 4, and 60 of the Organic Law of the Environment, No. 7554 of October 4, 1995; Law of the National Quality System, No. 8279 of May 2, 2002; Law for the Promotion of Competition and Effective Consumer Defense, No. 7472 of December 20, 1994; Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, No. 8220 of March 4, 2002; Law on Trademarks and Other Distinctive Signs, No. 7978 of January 6, 2000; Law on Undisclosed Information, No. 7975 of January 4, 2000; Law No. 7475 of December 20, 1994, Approving the Final Act Embodying the Results of the Uruguay Round of Multilateral Trade Negotiations, and Law No. 9981 of May 21, 2021, by which the "Agreement on the Terms of Accession of the Republic of Costa Rica to the Convention on the Organisation for Economic Co-operation and Development" is ratified.

1. 1That Article 50 of the Political Constitution enshrines the right of all persons to a healthy and ecologically balanced environment, it being the duty of the State to guarantee, defend, and preserve that right.
2. 2That Article 46 of the Political Constitution establishes the constitutional right of consumers and users to the protection of their health, environment, safety, and economic interests, as well as to receive adequate and truthful information, to freedom of choice, and to equitable treatment.
3. 3That the MAG-SFE, MINAE, and the Ministry of Health are responsible for issuing the directives, guides, or guidelines for the evaluations that the ministries apply for the review provided by applicants, in the matters within their respective competencies.
4. 4That, for inter-institutional interest, it is convenient and necessary to amend Article 4 of Executive Decree No. 43838-MAG-S-MINAE of December 14, 2022, titled: "RTCR 509:2022. Agricultural Inputs. Formulated Synthetic Pesticides, Technical Grade Active Ingredient, Adjuvants, Physical Carriers, and Related Substances for Agricultural Use. Registration," regarding its entry into force and application.
5. 5That in accordance with the second and third paragraphs of Article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, this Decree does not create or modify procedures, requirements, or formalities, and therefore does not require the Regulatory Improvement Procedure. Therefore;

They decree:

Considering:

1. 1Que el artículo 50 de la Constitución Política consagra el derecho de todas las personas a un ambiente sano y ecológicamente equilibrado, siendo el deber del Estado garantizar, defender y preservar ese derecho.
2. 2Que el artículo 46 de la Constitución Política establece el derecho constitucional de los consumidores y usuarios a la protección de su salud, ambiente, seguridad e intereses económicos, así corno a recibir información adecuada y veraz, a la libertad de elección y a un trato equitativo.
3. 3Que, el MAG-SFE, MINAE y Ministerio de Salud son los responsables de emitir las directrices, guías o lineamientos para las evaluaciones que los ministerios aplican para la revisión aportada por los solicitantes, en las materias propias

de sus competencias.

1. 4Que, por un interés interinstitucional, se hace conveniente y necesario reformar el artículo 4 del Decreto Ejecutivo N° 43838-MAG-S-MINAE del 14 de diciembre del 2022; denominado: "RTCR 509:2022. Insumos Agrícolas. Plaguicidas Sintéticos Formulados, Ingrediente Activo Grado Técnico, Coadyuvantes, Vehículos Físicos y Sustancias Afines de Uso Agrícola. Registro, con respecto a entrada en vigencia y aplicación.
2. 5Que de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012; el presente Decreto no crea ni modifica trámites, requisitos o procedimientos por lo que no requiere del Trámite de Mejora Regulatoria. Por tanto;

REFORMA DEL ARTÍCULO 4 DEL DECRETO EJECUTIVO N° 43838-MAG-S-MINAE, RTCR 509:2022. INSUMOS AGRÍCOLAS. PLAGUICIDAS SINTÉTICOS FORMULADOS, INGREDIENTE ACTIVO GRADO TÉCNICO, COADYUVANTES, VEHÍCULOS FÍSICOS Y SUSTANCIAS AFINES DE USO AGRÍCOLA.
