AJDIP/247-2022.-Puntarenas, on the ninth day of November of two thousand twenty-two.
- 1That through agreement AJDIP/077-2020, the Board of Directors approved the "REGLAMENTO PARA EL SEGUIMIENTO, CONTROL Y VIGILANCIA DE EMBARCACIONES PESQUERAS DE LAS FLOTAS NACIONAL Y EXTRANJERA".
- 2That agreement AJDIP/077-2020 was amended by means of Agreement AJDIP/076-2022, with the objective of having an agreement that harmonizes and regulates the measures for the monitoring, control and surveillance of vessels of the national and foreign fishing fleet, in addition to resolving a series of gaps present in some regulations, in light of new regulations and technology availability. Establishing, among other aspects, in its Transitory Provision II: "For Sport and Tourism Fishing vessels, this regulation shall be applicable six months after its entry into force".
- 3That a request for an extension was received from the Asociación Nacional de Operadores de Transportes Acuáticos de Quepos (ANOTA), based mainly on the economic difficulties the sector has faced in dealing with the consequences generated in the context of the Covid-19 pandemic, as well as to carry out the coordination involved in implementing the beacons (balizas), regarding the installation of equipment and software.
- 4That based on the request and having carried out the technical and socioeconomic analysis the matter implies, through official communication INCOPESCA-PE-DOPA-126-2022, the Dirección de Ordenamiento Pesquero y Acuícola, as well as the Departamento de Extensión Pesquera y Acuícola, recommend proceeding with the requested extension, in order to extend the mandatory use and installation deadline for the satellite beacon (baliza satelital) for Sport and Tourism Fishing vessels.
- 5That, the proposed amendment having been duly analyzed and deemed appropriate, the Board of Directors of the Instituto Costarricense de Pesca y Acuicultura, Therefore;
AGREES 1º-To approve the requested extension and amend the agreement of the Board of Directors of the Instituto Costarricense de Pesca y Acuicultura AJDIP/076-2022, in its Transitory Provision II, so that henceforth it reads as follows:
Transitory Provision II: "For Sport and Tourism Fishing vessels, this regulation shall be applicable as of Tuesday, February 28, 2023".
(Note from Sinalevi: Through agreement N° AJDIP/030-2023 of February 7, 2023, the following is established: "That in relation to the provisions of Board of Directors Agreement AJDIP/247-2022, the same shall be applicable only to medium-scale vessels of Tourism and Sport Fishing, for which the provisions of said agreement shall take effect as of February 28, 2023")
