I.That Article 12 of Executive Decree Nº 39703-S-TUR of February 22, 2016, and its amendments, "Reglamento para la Operación de Actividades de Turismo de Aventura" (Regulation for the Operation of Adventure Tourism Activities) (hereinafter the Regulation), establishes that to develop any adventure tourism activity, the tourism service provider must have the participation of trained and qualified guides for each specific activity carried out, who must hold the corresponding tourist guide license or credential issued by the Instituto Costarricense de Turismo in the respective category, in accordance with Decree N° 31030-MEICTUR of January 17, 2003, "Reglamento de los guías de turismo" and its amendments.
II.That by Executive Decree Nº 42487-S-TUR of July 27, 2020, the sole Single Transitory Provision (Transitorio único) of Executive Decree Nº 39703-S-TUR of February 22, 2016, and its amendments, "Reglamento para la Operación de Actividades de Turismo de Aventura" (hereinafter the Regulation), was amended, establishing a deadline, until June 6, 2022, in accordance with the provisions of Article 12 of the same regulation, so that tourism service providers for adventure tourism activities would have the participation of trained and qualified guides for each specific activity carried out, who were required to hold the corresponding tourist guide license or credential issued by the Instituto Costarricense de Turismo in the respective category, in accordance with Decree N° 31030-MEIC-TUR of January 17, 2003, "Reglamento de los guías de turismo" and its amendments.
III.That, as a consequence of the national emergency caused by the Covid 19 pandemic, many of the training sessions necessary for the granting of the tourist guide license or credential issued by the Instituto Costarricense de Turismo were suspended or reduced as a preventive sanitary measure, making it impossible to complete the training process planned for the last two years of the Transitory Provision that ended this June 6, whereby the need arises to add to the Regulation a Transitory Provision that grants a new deadline of 3 months for the execution of said process.
IV.That the processes of coordination and construction of the training required for the tourist guide license or credential granted by the Instituto Costarricense de Turismo must also include the scope and implementation of the sanitary protocols required for the development of any type of tourism activity, for which the latest updates in the country's sanitary regulations and the particular requirements of each tourism activity must be taken into account, in this new stage of reactivation due to COVID 19, therefore it is necessary to have a new Transitory Provision of three months for compliance with the requirement referring to the tourist guide license or credential established in Article 12 of the Regulation.
V.That, as results derived from this reform to the Regulation, it is expected to have updated technical and training tools adjusted to the current needs of the reactivation of the tourism sector in the face of COVID 19.
VI.That, in accordance with Article 12 bis of Executive Decree Nº 37045-MPMEIC of February 22, 2012, "Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos" and its amendment, it is considered that due to the nature of the present regulation, it is not necessary to complete Section I, called Control Previo de Mejora Regulatoria, that makes up the Cost-Benefit Evaluation form, since it does not establish procedures or requirements for the administered party.

l. Que, el artículo 12 del Decreto Ejecutivo Nº 39703-S-TUR del 22 de febrero del 2016 y sus refo1mas, "Reglamento para la Operación de Actividades de Turismo de Aventura", establece que para desarrollar cualquier actividad de turismo aventura, el prestador de servicios turísticos debe contar con la intervención de guías capacitados y calificados para cada actividad específica que se realiza, los cuales deben tener la debida licencia o credencial de guía turístico otorgada por el Instituto Costarricense de Turismo en la categoría respectiva, de conformidad al Decreto N° 31030-MEICTUR del 17 de enero del 2003, "Reglamento de los guías de turismo" y sus reformas.
II.Que mediante Decreto Ejecutivo Nº 42487-S-TUR del 27 de julio del 2020, se modificó el Transitorio único del Decreto Ejecutivo Nº 39703-S-TUR del 22 de febrero del 2016 y sus reformas, "Reglamento para la Operación de Actividades de Turismo de Aventura" (en adelante el Reglamento), estableciendo un plazo, hasta el 6 de junio de 2022, en apego a lo establecido en el artículo 12 del mismo reglamento, para que los prestadores de servicios turísticos de las actividades de turismo de aventura, contaran con la intervención de guías capacitados y calificados para cada actividad específica que se realiza, los cuales debían tener la debida licencia o credencial de guía turístico otorgada por el Instituto Costarricense de Turismo en la categoría respectiva, de conformidad al Decreto N° 31030-MEIC-TUR del 17 de enero del 2003, "Reglamento de los guías de turismo" y sus reformas.
III.Que, como consecuencia de la emergencia nacional provocada por la pandemia Covid 19, muchas de las capacitaciones necesarias para el otorgamiento de la licencia o credencial de guía turístico otorgada por el Instituto Costarricense de Turismo fueron suspendidas o reducidas como medida sanitaria preventiva, por lo que resultó imposible finalizar el proceso de capacitaciones planificado para el período de los últimos dos años del Transitorio que finalizó este 6 de junio, por lo cual surge la necesidad de adicionar al Reglamento un Transitorio que otorgue un nuevo plazo de 3 meses para la ejecución de dicho proceso.
IV.Que los procesos de coordinación y construcción de las capacitaciones requeridas para la licencia o credencial de guía turístico que otorga el Instituto Costarricense de Turismo, deberán además incluir los alcances e implementación de los protocolos sanitarios exigidos para el desarrollo de cualquier tipo de actividad turística, para lo cual deberá tomarse en cuenta las últimas actualizaciones en las normativas sanitarias del país y los requerimientos particulares de cada actividad turística, en esta nueva etapa de reactivación por motivo de la COVID 19, por lo que es necesario contar con un nuevo Transitorio de tres meses para el cumplimiento del requisito referido a la licencia o credencial de guía turístico establecido en el artículo 12 del Reglamento.
V.Que, como resultados derivados de esta reforma al Reglamento, se espera contar con herramientas técnicas y de capacitación actualizadas y ajustadas a las necesidades actuales de la reactivación del sector turismo frente a la COVID 19.
VI.Que, de conformidad con el artículo 12 bis del Decreto Ejecutivo Nº 37045-MPMEIC del 22 de febrero del 2012, "Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos" y su reforma, se considera que por la naturaleza del presente reglamento no es necesario completar la Sección I denominada Control Previo de Mejora Regulatoria, que conforma el formulario de Evaluación Costo Beneficio, toda vez que el mismo no establece trámites ni requerimientos para el administrado.
