across the entirety of the text - Full Text of Regulation 43301 Declaration of public utility for the interests of the State of the Rural Aqueduct Administrative Association of the Community of Hatillo of the Veintisiete de Abril District of the Canton of Santa Cruz Guanacaste No. 43301-MJP (This executive decree was repealed by Article 1 of Executive Decree No. 44504 of April 8, 2024) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Pursuant to the provisions of Articles 140, subsection 18) and 146 of the Political Constitution, Article 32 of the Law of Associations No. 218 of August 8, 1939, and Articles 27 et seq. of the Regulations to the Law of Associations No. 29496-J, published in La Gaceta No. 96 of May 21, 2001, as well as the provisions of Article 3, subsection ch) of the Income Tax Law No. 7092 and Articles 103 and 104 of the Code of Tax Standards and Procedures No. 4755.
I.-That Article 32 of the Law of Associations No. 218 of August 8, 1939, and its amendments, grants the Executive Branch the power to declare of public utility simple, federated, or confederated associations whose development and activities are particularly useful for the interests of the State, and which thereby contribute to meeting a social need.
II.-That the Rural Aqueduct Administrative Association of the Community of Hatillo of the Veintisiete de Abril District of the Canton of Santa Cruz Guanacaste, legal identification number: 3-002-572087, was registered in the Associations Registry of the National Public Registry as of December 6, 2008, volume two thousand nine, entry forty-one thousand four hundred twenty-one.
III.-That the purposes pursued by the Association, according to its bylaws, are: "A) To administer, operate, maintain, develop, and conserve in good condition the aqueduct, in accordance with the provisions and regulations issued in that regard by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), which shall be mandatory. B) To achieve the effective participation of the community in the construction, operation, maintenance, and development of the Aqueducts." IV.-That such purposes meet a social need of the highest order, for which they merit the support of the Costa Rican State. Therefore, They Decree:

I.-Que el artículo 32 de la Ley de Asociaciones N° 218 de 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Administradora de Acueducto Rural de la Comunidad de Hatillo del Distrito Veintisiete de Abril del Cantón de Santa Cruz Guanacaste, cédula de persona jurídica número: 3-002-572087, se inscribió en el Registro de Asociaciones del Registro Público Nacional desde el día 06 de diciembre del 2008, tomo dos mil nueve, asiento cuarenta y un mil cuatrocientos veintiuno.
III.-Que los fines que persigue la Asociación, según sus estatutos son: "A) Administrar, operar, dar mantenimiento, desarrollo y conservación en buenas condiciones el acueducto, de conformidad con las disposiciones, reglamentación que al respecto emite el Instituto costarricense de Acueductos y Alcantarillados, que serán de acatamiento obligatorio. B) Obtener la participación efectiva de la comunidad en la construcción, operación, mantenimiento y desarrollo del Acueductos." IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado costarricense. Por tanto,
