Amendment to the ESPH Water Supply, Sewerage and Fire Hydrant Service RegulationsReforma al Reglamento de prestación de servicios de agua potable, alcantarillado sanitario e hidrantes de la ESPH

Said request must be submitted on the Services Platform of the Public Services Company of Heredia or at the regional office; for the granting of potable water availability, the property owner must comply with the presentation of the following requirements:

• a)Request signed by the property owner clearly indicating the farm (finca) number and cadastral map number, the nature of the project intended to be developed, the purpose of the availability certification, and indicating the means and/or place to receive notifications.
• b)In the case of a natural person, the identity card, or residence document, or valid passport in the case of a foreigner, must be presented for verification.
• c)In the case of legal entities, a valid certification of legal status (personería jurídica), issued no more than 30 days prior. In the case of digital certifications, in accordance with the respective legal validity.
• d)A copy of the cadastral map.
• e)Literal certification of the property (original).

In the event that more than three simultaneous availability services are requested on a single farm (finca), they must adhere to the requirements regulated in the Regulation for the Provision of Services to Urbanizations, Subdivisions, and Condominiums, Network Extensions, and their Financing, of the Public Services Company of Heredia, Sociedad Anónima.

Said request must be submitted on the Services Platform of the Public Services Company of Heredia or at the regional office.

• a)Transaction Request (Solicitud de Trámites) document, available on the Services Platform of ESPH S.A., duly completed and signed by the registered owner, authorized representative, or the executor (albacea), as applicable, as well as completing the document: Contract for the Provision of Aqueduct and/or Sanitary Sewerage Service between the Public Services Company of Heredia S.A. and its subscribers (Must indicate on the Services Platform of ESPH S.A., if it also includes the wastewater service).
• b)In the case of a natural person, a valid identity card or residence document must be presented.
• c)In the case of legal entities, a valid legal status (personería) certification, issued no more than 30 days prior, must be presented. In the case of digital certifications, in accordance with the respective legal validity, valid identification.
• d)That the applicant has no debts with ESPH S.A. (This condition is verified internally by the institution).
• e)Copy of the cadastral map.
• f)Literal certification of the property (original).
• g)Duly signed Informed Consent (Consentimiento informado) document, available on the Services Platform.
• h)Payment on the Services Platform of ESPH S.A., of the cost of the service installation. ESPH S.A. has five (5) business days for the connection of the new potable water service and ten (10) business days for the new wastewater service, as long as the applicant meets the required technical conditions.

To provide the aqueduct and wastewater service in the case of possessors on unregistered lands, and when technically feasible, the applicant must appear on the Services Platform of the Public Services Company of Heredia or at the regional office and meet the following requirements:

• a)Transaction Request (Solicitud de Trámites) document, available on the services platform of ESPH S.A., duly completed and signed by the registered owner, authorized representative, or the executor (albacea), as applicable, as well as the document Contract for the Provision of Aqueduct and/or Sanitary Sewerage Service between the Public Services Company of Heredia S.A. and its subscribers. (Indicate on the services platform of ESPH S.A., if it also includes the wastewater service).
• b)In the case of a natural person, present identity card, valid residence document, or valid passport for verification.
• c)In the case of legal entities, legal status (personería) certification, issued no more than 30 days prior. In the case of digital certifications, in accordance with the respective legal validity.
• d)Present, on the part of the interested party: an affidavit (declaración jurada), signed and duly authenticated by a Notary Public, with a description of the lot or property, indicating what its possessory acts consist of, the existence of construction, the improvements made, and that the property is not registered.
• e)A suitable document that allows locating the land over which the possessory right is exercised, preferably a copy of a duly cadastrated map.
• f)Pay the corresponding connection fee.
• g)That the applicant has no debts with ESPH S.A. (This condition is verified internally by the institution).
• h)Duly signed Informed Consent (Consentimiento Informado) document.

ESPH S.A. has 5 business days for the connection of the new potable water service and 10 business days, counted from the day after the corresponding application is received satisfactorily, for the new wastewater service, as long as the applicant meets the required technical conditions.

To make said request, the interested party must appear on the Services Platform of the Public Services Company of Heredia or at the regional office; the user must meet the following requirements:

• a)Fill out the transaction request form.
• b)Indicate the contract number or numbers to which the name change procedure must be applied.
• c)Duly signed informed consent (consentimiento informado) document.
• d)Identity card of the current property owner, valid residence document, or valid passport in the case of a foreigner, for verification.

If it is a legal entity, the legal status (personería jurídica) and the identity card of the legal representative must also be presented.

• e)Literal certification of the property (original).
• f)The billing cannot have pending receipts. (This condition is verified internally by the institution).
• g)In the event that the titleholder cannot appear, the signatures on the form and the informed consent must be authenticated by a lawyer, or a notarized power of attorney must be presented.

If there is a pending amount in the accounts receivable category, the property owner must pay it before ESPH S.A. proceeds to execute the request.

The response to this request is given immediately on the platform, with a maximum resolution period of one day.

2. Publish in the Official Gazette La Gaceta.

3. Firm agreement.

Dicha solicitud debe realizarse en la Plataforma de Servicios de la Empresa de Servicios Públicos de Heredia o en la oficina regional; para el otorgamiento de la disponibilidad de agua potable, el propietario del inmueble deberá cumplir con la presentación de los siguientes requisitos a) Solicitud firmada por el dueño de la propiedad indicando claramente el número de finca y número de plano catastrado, la naturaleza del proyecto que pretende desarrollar, el propósito de la certificación de disponibilidad y señalar medio y/o lugar para recibir notificaciones.

• b)En caso de persona física, deberá presentar la cédula de identidad o documento de residencia o pasaporte vigente en caso de ser extranjero, para su verificación.
• c)En caso de personas jurídicas, certificación de personería jurídica vigente, con un máximo de 30 días de emitida. Tratándose de certificaciones digitales, conforme a la vigencia legal respectiva.
• d)Una copia del plano catastrado.
• e)Certificación literal de la propiedad (original).

En caso, que se soliciten más de tres servicios de disponibilidad simultáneos en una misma finca, se deberán acoger a los requisitos que se encuentran regulados en el Reglamento de Dotación de Servicios a Urbanizaciones, Fraccionamientos y Condominios, extensiones de Redes y su Financiamiento, de la Empresa de Servicios Públicos de Heredia, Sociedad Anónima.

Dicha solicitud debe realizarse en la Plataforma de Servicios de la Empresa de Servicios Públicos de Heredia o en la oficina regional.

• a)Documento Solicitud de Trámites, disponible en la Plataforma de servicios de la ESPH S.A., debidamente completado y firmado por el propietario registral apoderado, o el albacea, según corresponda, así como llenar el documento: Contrato para la Prestación del Servicio de Acueducto y/o Alcantarillado Sanitario entre la Empresa de Servicios Públicos de Heredia S.A. y sus abonados (Debe indicar en la Plataforma de Servicios de la ESPH S.A., si también incluye el servicio de aguas residuales).
• b)En caso de persona física, deberá presentar la cédula de identidad o documento de residencia vigente.
• c)En caso de personas jurídicas, certificación de personería vigente con un máximo de 30 días de emitida. Tratándose de certificaciones digitales, conforme a la vigencia legal respectiva, identificación vigente.
• d)Que el solicitante no tenga deudas con la ESPH S.A. (Esta condición se verifica a lo interno de la institución).
• e)Copia del plano de catastro.
• f)Certificación literal de la propiedad (original).
• g)Documento Consentimiento informado debidamente firmado, disponible en la Plataforma de Servicios.
• h)Cancelación en Plataforma de Servicios de la ESPH S.A., del costo de la instalación del servicio. La ESPH S.A. dispone de cinco (5) días hábiles para la conexión del servicio nuevo de agua potable y diez (10) días hábiles para el servicio nuevo de agua residual siempre y cuando el solicitante cumpla con las condiciones técnicas requeridas.

Para brindar el servicio de acueducto y aguas residuales en el caso de poseedores en terrenos sin inscribir, y cuando técnicamente sea factible, el solicitante deberá presentarse en la Plataforma de Servicios de la Empresa de Servicios Públicos de Heredia o en la oficina regional y cumplir con los siguientes requisitos:

• a)Documento Solicitud de Trámites, disponible en la Plataforma de servicios de la ESPH S.A., debidamente completado y firmado por el propietario registral apoderado, o el albacea, según corresponda, así como el documento Contrato para la Prestación del Servicio de Acueducto y/o Alcantarillado Sanitario entre la Empresa de Servicios Públicos de Heredia S.A. y sus abonados. (Indicar en la plataforma de servicios de la ESPH S.A., si también incluye el servicio de aguas residuales).
• b)En caso de persona física, presentar cédula de identidad, documento de residencia vigente o pasaporte vigente para su verificación.
• c)En caso de personas jurídicas, certificación de personería vigente con un máximo de 30 días de emitida. Tratándose de certificaciones digitales, conforme a la vigencia legal respectiva.
• d)Presentar por parte del interesado: declaración jurada, firmada y debidamente autenticada por Notario Público, con una descripción del lote o propiedad, señalando en qué consisten sus actos posesorios, la existencia de edificación, las mejoras realizadas y que la propiedad no se encuentra inscrita.
• e)Un documento idóneo que permita ubicar el terreno sobre el cual se ejerce el derecho posesorio, preferiblemente copia de plano debidamente catastrado.
• f)Cancelar la tarifa de conexión correspondiente.
• g)Que el solicitante no tenga deudas con ESPH S.A. (Esta condición se verifica a lo interno de la institución).
• h)Documento Consentimiento Informado debidamente firmado.

La ESPH S.A. dispone de 5 días hábiles para la conexión del servicio nuevo de agua potable y 10 días hábiles, contados a partir del día siguiente de reciba a satisfacción la solicitud correspondiente, para el servicio nuevo de agua residual, siempre y cuando el solicitante cumpla con las condiciones técnicas requeridas.

Para realizar dicha solicitud el interesado debe presentarse en la Plataforma de Servicios de la Empresa de Servicios Públicos de Heredia o en la oficina regional, el usuario deberá cumplir con los siguientes requisitos:

• a)Llenar formulario solitud de trámites.
• b)Indicar número o números de contrato al cual hay que realizarle el trámite de cambio de nombre.
• c)Documento consentimiento informado debidamente firmado.
• d)Cédula de identidad del propietario actual del inmueble, documento de residencia vigente o pasaporte vigente en caso de ser extranjero, para su verificación.

Si es persona jurídica debe presentarse además la personería jurídica y la cédula del representante legal.

• e)Certificación literal de la propiedad (original).
• f)La facturación no podrá tener recibos pendientes. (Esta condición se verifica a lo interno de la institución).
• g)En caso, que no pueda presentarse el titular, las firmas del formulario y del consentimiento informado deben venir autenticadas por abogado o presentar un poder protocolizado.

Si existiere un monto pendiente en el rubro de cuentas por cobrar, el propietario del inmueble deberá cancelarlo antes que la ESPH S.A. proceda a ejecutar la solicitud.

La respuesta a esta solicitud se realiza en forma inmediata en la plataforma con un plazo máximo de un día de resolución.
