article 6 of the Political Constitution, over its territorial waters within a distance of twelve miles from the low-tide line and exercises special jurisdiction over the seas adjacent to its territory within an extent of two hundred miles from the same line, which is called the Exclusive Economic Zone, in order to protect, conserve and exclusively exploit all the natural resources and wealth existing in the waters, the soil and the subsoil of those zones, in accordance with the principles of International Law.

Article 56 reaffirms the sovereign rights of States over the Exclusive Economic Zone for the purposes of exploration, exploitation, conservation and management of natural resources.

article 11 of the Biodiversity Law obliges the State, through its institutions, to intervene and apply the Precautionary and Preventive Principle, when there is loss, danger or threat of serious or imminent damage to elements of biodiversity. Likewise, in accordance with its objective of conserving biological diversity, measures must be established that reduce the impact of fisheries on populations of elasmobranchs, sharks, turtles, billfish and marine mammals.

10.-That in accordance with articles 20 and 21 of Executive Decree No. 38681-MAG-MINAE of 9 October 2014, the Executive Presidency of the Institute Costa Rican Institute of Fisheries and Aquaculture, through Official Letter INCOPESCA-PE-770-2021 of 21 June 2021, made known to the Minister of Agriculture and Livestock and the Minister of Environment and Energy the technical opinion INCOPESCA-DOPA-069-2021 of 14 June 2021, signed by Lic. Miguel Durán Delgado, Director of Fisheries and Aquaculture Planning (Ordenamiento Pesquero y Acuícola) of INCOPESCA, through which the Executive President was informed of the need to modify article 16, second paragraph, of Executive Decree No. 38681-MAG-MINAE, taking into consideration the large number of vessels that make up the medium-scale commercial fleet, the difficult situation of the fisheries sector in relation to the overexploitation of the fishery resource, the globalization of markets and the socioeconomic hardship that the sector is experiencing, coupled with the impact caused by COVID-19 and in response to Executive Decree 42227-MP-S of 16 March 2020, which declares a state of national emergency throughout the territory of the Republic of Costa Rica, it is necessary to adopt measures that allow minimizing the impacts on health and the economy caused by the COVID-19 pandemic to all productive sectors, and in this case to the affected national fisheries sector.

11.-That the Minister of Agriculture and Livestock, through official letter number DM-MAG-622-2021 of 23 June 2021, deemed that the INCOPESCA request for an extension of the deadline in the second paragraph of article 16 of Executive Decree No. 38681-MAG-MINAE of 9 October 2014 is reasonable and proportional, and therefore endorses said extension as it adheres to the current fisheries legal framework.

12.-That in accordance with the second and third paragraphs of article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of 22 February 2012, this Decree does not create or modify procedures, requirements or formalities, and therefore does not require the Regulatory Improvement Process. Therefore, They Decree REFORM TO EXECUTIVE DECREE NO. 38681-MAG-MINAE OF 9 OCTOBER 2014; ENTITLED:

"MANAGEMENT FOR THE EXPLOITATION (ORDENAMIENTO PARA EL APROVECHAMIENTO) OF TUNA AND RELATED SPECIES IN THE EXCLUSIVE ECONOMIC ZONE OF THE COSTA RICAN PACIFIC OCEAN"

Así mismo en razón de su objetivo de conservación de la diversidad biológica se deben establecer medidas que reduzcan el impacto de las pesquerías sobre las poblaciones de elasmobranquios, tiburones, tortugas, picudos y mamíferos marinos.

10.-Que de conformidad con los artículos 20 y 21 del Decreto Ejecutivo N° 38681-MAG-MINAE del 09 de octubre del 2014, la Presidencia Ejecutiva del Instituto Costarricense de Pesca y Acuicultura, mediante Oficio INCOPESCA-PE-770-2021 del 21 de junio del 2021 puso en conocimiento al Ministro de Agricultura y Ganadería y a la Ministra de Ambiente y Energía del criterio técnico INCOPESCA-DOPA-069-2021 del 14 de junio del 2021, suscrito por el Lic. Miguel Durán Delgado, Director Ordenamiento Pesquero y Acuícola del INCOPESCA, mediante el cual se comunicó al Presidente Ejecutivo la necesidad de modificar el artículo 16 párrafo segundo del Decreto Ejecutivo Nº38681-MAG-MINAE, tomando en consideración el gran número de embarcaciones que conforman la flota comercial de mediana escala, la difícil situación del sector pesquero en relación con la sobreexplotación del recurso pesquero, la globalización de mercados y la afectación socioeconómica que vive el sector, aunado al impacto provocado por la COVID-19 y atendiendo el Decreto Ejecutivo 42227-MP-S del 16 de marzo 2020, en donde se declara estado de emergencia nacional en todo el territorio de la República de Costa Rica, es necesario adoptar medidas que permitan minimizar los impactos en la salud y la economía que ha provocado la pandemia de COVID-19 a todos los sectores productivos y en este caso al afectado sector pesquero nacional.

11.-Que el Ministro de Agricultura y Ganadería, mediante el oficio número DM-MAG-622-2021 del 23 de junio del 2021; estimó que la solicitud del INCOPESCA de ampliación del plazo del párrafo segundo del artículo 16 del Decreto Ejecutivo Nº38681-MAG-MINAE del 09 de octubre del 2014, es razonable y proporcional, por lo que avala dicha prórroga al apegarse al ordenamiento jurídico pesquero vigente.

12.-Que de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012; el presente Decreto no crea ni modifica trámites, requisitos o procedimientos por lo que no requiere del Trámite de Mejora Regulatoria. Por tanto,

REFORMA AL DECRETO EJECUTIVO Nº38681-MAG-MINAE DEL 09 DE OCTUBRE DEL 2014; DENOMINADO:

"ORDENAMIENTO PARA EL APROVECHAMIENTO DE ATÚN Y ESPECIES AFINES EN LA ZONA ECONÓMICA EXCLUSIVA DEL OCÉANO PACÍFICO COSTARRICENSE"

A efectos de la instalación de los dispositivos de Seguimiento Satelital o balizas a las embarcaciones de la flota pesquera costarricense, se establece un máximo de 36 meses para la flota comercial avanzada y para la flota comercial de mediana escala un máximo de 86 meses a partir de la entrada en vigencia del presente Decreto para su debida implementación.
