in the entirety of the text - Complete Text of Norm 42845 Reform Declare the Electrical Interconnection System for the Countries of Central America (SIEPAC) Project of public interest and national convenience No. 42845-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In use of the powers granted in articles 50, 140 subsections 3) and 18) and 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) item b) of the General Law of Public Administration, No. 6227 of May 2, 1978; article 32 subsection b) of the Framework Treaty for the Electricity Market of Central America ratified by Law No. 7848 of November 20, 1998; articles 3 subsection m), 19 subsection b), 33 and 34 of the Ley Forestal, No. 7575 of February 13, 1996; and article 2 subsection m) of the Reglamento a la Ley Forestal, Decreto Ejecutivo No. 25721-MINAE of October 17, 1996.

1. 1That articles 19 subsection b) and 34 of the Ley Forestal No. 7575 prohibit land-use change (cambio de uso de suelo) and the felling of trees on private lands covered by forest, as well as the felling of trees in the protection areas defined in numeral 33 of the same normative body, excepting those state or private projects that the Executive Branch declares of National Convenience, these being those projects whose social benefits are greater than the socio-environmental costs.
2. 2That the Framework Treaty for the Electricity Market of Central America ratified by Law No. 7848, in its article 32 subsection b), declared of public interest the electrical infrastructure works necessary for the activities of the regional electricity market.
3. 3That the Electrical Interconnection System for the Countries of Central America (SIEPAC) project, developed and administered by the Empresa Propietaria de la Red S. A., legal identification number 3-012-328405, is part of the Plan Mesoamérica, and its purpose is to reinforce the electrical grid of Central America (Panama, Costa Rica, Nicaragua, El Salvador, Honduras, and Guatemala), for the sale, commercialization, and transport of electricity along these six nations, in addition to having a fiber optic cable network that would facilitate and reduce the cost of communications and allow interconnection with the existing submarine cabling. All of this with the purpose of guaranteeing a better distribution of Central America's energy resources, which would aid the development of the region.
4. 4That the Secretaría Técnica Nacional Ambiental granted environmental viability to the Project "Electrical Interconnection System for the Countries of America Central (SIEPAC)" through resolution No. 848-2005-SETENA of nine hours fifty-five minutes of April nineteen, two thousand five, corresponding to file No. 548-2002-SETENA.
5. 5That through Decreto Ejecutivo No. 33973-MINAE of July 31, 2007, the project called "Electrical Interconnection System for the Countries of Central America (SIEPAC)" is declared of National Convenience and Public Interest.
6. 6That for Costa Rica, the project consisted of the construction of 494 km of line from the border area of Peñas Blancas in the north of the country, to Los Planes de Corredores on the southern border of Costa Rica. The line was divided into five segments in the country, numbered 15 to 19: border with Nicaragua-Cañas; Cañas-Parrita; Parrita-Palmar Norte; Palmar Norte-Río Claro; and Río Claro-border with Panama. The line entered into operation in the year 2011 and has been operating normally since that date.
7. 7That the cited project is not new, as its construction phase began in 2008 and ended in 2011, and its operational phase continues to this day. That by reason of the foregoing, it is now essential to clear the line along the 494 km to perform the respective maintenance of the vegetation adjacent to the line, an aspect that was not contemplated in Decreto Ejecutivo No. 33973-MINAE that declared the project of National Convenience.
8. 8That through official communication CE-0001-2020 of December 10, 2020, the Energy Directorate of the Ministry of Environment and Energy certified regarding the administrative file of the Empresa Propietaria de la Red, S. A. (EPR, S. A.), that the record contains resolution No. R-004-2005-MINAE-DSE of July twenty-nine, two thousand five, which granted the effectiveness of the public service concession for electrical energy supply in the transmission stage for the construction and operation of the first regional electrical interconnection system to the cited company, for a term of thirty years, which is in force and up to date with its obligations.
9. 9That through official communication SETENA-SG-1536-2020 of eleven hours on December eleven of two thousand twenty, the Secretaría Técnica Nacional Ambiental certified: "I) That the administrative file FEAP-0548-2002-SETENA, corresponding to the project called "SIEPAC Transmission Line", has been provided for this act by the Institutional Archive of the Administrative Directorate of this Secretariat. II. That through resolution No. 848-2005-SETENA, Environmental Viability was granted to the project in question. III. That the current status of the administrative file FEAP-548-2002-SETENA is active. That is all."

10.-That in accordance with the Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo No. 37045-MP-MEIC and its reforms, it was determined that this proposal does not establish or modify procedures, requirements, or formalities that the administered party must comply with, a situation for which the prior control procedure was not carried out. Therefore; They decree:

Reform to article 1 of Decreto Ejecutivo No. 33973-MINAE of July 31, 2007 called "Declare Electrical Interconnection System for the Countries of Central America (SIEPAC) Project of public interest and national convenience"

Considering:

en la totalidad del texto - Texto Completo Norma 42845 Reforma Declaran Proyecto Sistema Interconectado Eléctrico para los Países de América Central (SIEPAC) de interés público y conveniencia nacional Nº 42845-MINAE EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE AMBIENTE Y ENERGÍA En uso de las facultades conferidas en los artículos 50, 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de Administración Pública, N° 6227 del 2 de mayo de 1978; artículo 32 inciso b) del Tratado Marco del Mercado Eléctrico de América Central ratificado mediante la Ley N° 7848 del 20 de noviembre de 1998; los artículos 3 inciso m), 19 inciso b), 33 y 34 de la Ley Forestal, N° 7575 del 13 de febrero de 1996; y el artículo 2 inciso m) del Reglamento a la Ley Forestal, Decreto Ejecutivo N° 25721- MINAE del 17 de octubre de 1996.

1. 1Que los artículos 19 inciso b) y 34 de la Ley Forestal Nº 7575 prohíben el cambio de uso de suelo y la corta de árboles en terrenos privados cubiertos de bosque, así como la corta de árboles en las áreas de protección definidas en el numeral 33 del mismo cuerpo normativo, exceptuando aquellos proyectos estatales o privados que el Poder Ejecutivo declare de Conveniencia Nacional, constituyéndose en estos, aquellos proyectos cuyos beneficios sociales sean mayores a los costos socio ambientales.
2. 2Que el Tratado Marco del Mercado Eléctrico de América Central ratificado mediante la Ley N° 7848, en su artículo 32 inciso b), declaró de interés público las obras de infraestructura eléctrica necesarias para las actividades del mercado eléctrico regional.
3. 3Que el proyecto Sistema de Interconexión Eléctrica de los Países de América Central (SIEPAC) desarrollado y administrado por la Empresa Propietaria de la Red S. A., cédula jurídica N° 3-012- 328405, es parte del Plan Mesoamérica, y tiene como finalidad reforzar la red eléctrica de América Central (Panamá, Costa Rica, Nicaragua, El Salvador, Honduras y Guatemala), para la venta, comercialización y transporte de electricidad a lo largo de estas seis naciones, además de contar con una red de cableado óptico que facilitaría y disminuiría el costo de las comunicaciones y permitiría la interconexión con el cableado submarino existente. Todo esto con la finalidad de garantizar una mejor distribución de los recursos energéticos de Centroamérica lo que ayudaría al desarrollo de la región.
4. 4Que la Secretaría Técnica Nacional Ambiental otorgó la viabilidad ambiental del Proyecto "Sistema Interconectado Eléctrico para los Países de América Central (SIEPAC)" mediante resolución N° 848-2005-SETENA de las nueve horas cincuenta y cinco minutos del diecinueve de abril de dos mil cinco, correspondiente al expediente N°548-2002-SETENA.
5. 5Que mediante Decreto Ejecutivo N° 33973-MINAE del 31 de julio de 2007 se declara de Conveniencia Nacional e Interés Público el proyecto denominado "Sistema Interconectado Eléctrico para los Países de América Central (SIEPAC)".
6. 6Que para Costa Rica, el proyecto consistió en la construcción de 494kms de línea desde la zona fronteriza de Peñas Blancas en el norte del país, hasta Los Planes de Corredores en la frontera sur de Costa Rica. La línea se dividió en cinco tramos en el país, numerados del 15 al 19: frontera con Nicaragua-Cañas; Cañas- Parrita; Parrita-Palmar Norte; Palmar Norte-Río Claro; y Río Claro-frontera con Panamá. La línea entró en operación en el año 2011 y se encuentra operando normalmente desde esa fecha.
7. 7Que el proyecto citado no es nuevo, pues su fase constructiva inició en el 2008 y finalizó en el 2011, y su fase operativa se mantiene hasta la fecha. Que en razón de lo anterior, es indispensable ahora la corta para libranza de la línea a lo largo de los 494 kms para realizar el respectivo mantenimiento de la vegetación colindante con la línea, aspecto que no fue contemplado en el Decreto Ejecutivo N° 33973-MINAE que declaró al proyecto de Conveniencia Nacional.
8. 8Que mediante oficio CE-0001-2020 del 10 de diciembre de 2020, la Dirección de Energía del Ministerio de Ambiente y Energía certificó sobre el expediente administrativo de la Empresa Propietaria de la Red, S. A. (EPR, S. A.), que consta la resolución N° R-004-2005-MINAE-DSE del veintinueve de julio de dos mil cinco, que otorgó la eficacia de la concesión de servicio público de suministro de energía eléctrica en la etapa de transmisión para la construcción y explotación del primer sistema de interconexión eléctrica regional a la citada sociedad, por un plazo de treinta años, misma que se encuentra vigente y al día con sus obligaciones.
9. 9Que mediante oficio SETENA-SG-1536-2020 de las once horas del once de diciembre de dos mil veinte, la Secretaría Técnica Nacional Ambiental certificó: "I) Que el expediente administrativo FEAP-0548-2002-SETENA, correspondiente al proyecto denominado "Línea de Transmisión SIEPAC", ha sido suministrado para este acto por el Archivo Institucional de la Dirección Administrativa de esta Secretaría. II. Que mediante resolución Nº 848-2005-SETENA se otorgó la Viabilidad Ambiental al proyecto de marras. III. Que el estado actual del expediente administrativo FEAP-548-2002-SETENA es activo. Es todo."

10.-Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto;

Reforma al artículo 1 del Decreto Ejecutivo N° 33973-MINAE del 31 de julio de 2007 denominado "Declaran Proyecto Sistema Interconectado Eléctrico para los Países de América Central (SIEPAC) de interés público y conveniencia nacional"
