indicating that it is inalienable and imprescriptible, and that its protection and its natural resources are the obligation of the State, its institutions, and all the inhabitants of the country. Regarding the administration, use, and enjoyment of this zone, according to articles 2, 34, and 35 of the aforementioned Law, it corresponds to the Costa Rican Tourism Institute and the respective area's municipality. However, article 73 of the cited Law establishes that said regulatory body will not apply to the marine-terrestrial zone included in national parks and equivalent reserves, which, according to the Office of the Attorney General of the Republic, in its Opinion C-174-87, must be understood as "all the protected wild areas, together with the national parks that make up the State Forest Heritage: biological reserves, protected zones, forest reserves, and national wildlife refuges, which, with an inalienable and unattachable character, are subject to specific public management plans that guarantee the adequate protection, conservation, and rational use of resources, for sustained development."

AMENDMENT OF ARTICLE 152 OF EXECUTIVE DECREE N°32633 OF MARCH 10, 2005, REGULATION TO THE WILDLIFE CONSERVATION LAW FOR FISHING AND NATIONAL WILDLIFE REFUGES

"Article 152.- SINAC may grant use permits, in the Marine-Terrestrial Zone (restricted zone) comprised within the limits of State Property and Mixed Refuges, in accordance with article 82 of the Wildlife Conservation Law, Nº 7317, article 18 of the Forestry Law 7575, and article 11 of the Regulation to the Forestry Law, Executive Decree 25721-MINAE, and other related laws."

indicando recursos naturales son obligación del Estado, de sus instituciones y de todos los habitantes del país. En cuanto a la administración, uso y disfrute de esta zona, según los artículos 2, 34 y 35 de la mencionada Ley, corresponde al Instituto Costarricense de Turismo y a la municipalidad del área respectiva. No obstante, el artículo 73 de la citada Ley establece que dicho cuerpo normativo no le aplicará a la zona marítimo terrestre que está incluida en parques nacionales y reservas equivalentes, las cuales, según la Procuraduría General de la República, en su Dictamen C-174-87, deben entenderse como "todas las áreas silvestres protegidas, junto con los parques nacionales que conforman el Patrimonio Forestal del Estado: reservas biológicas, zonas protectoras, reservas forestales y refugios nacionales de fauna silvestre, las cuales, con carácter inalienables e inembargables, están sometidos a planes específicos de manejo público que garanticen la adecuada protección, conservación y uso racional de los recursos, para un desarrollo sostenido."

"Artículo 152.- El SINAC podrá otorgar permisos de uso, en la Zona Marítimo Terrestre (zona restringida) comprendida dentro de los límites de los Refugios de Propiedad Estatal y Mixta, de acuerdo al artículo 82 de la Ley de Conservación de la Vida Silvestre, Nº 7317, al artículo 18 de la Ley Forestal 7575 y el artículo 11 del Reglamento a la Ley Forestal, Decreto Ejecutivo 25721-MINAE y otras leyes conexas."
