TO THE JUDICIAL OFFICES OF THE COUNTRY, ATTORNEYS, AND THE GENERAL PUBLIC BE IT KNOWN THAT:
The Full Court, in session N° 53-2020, held on September 21, 2020, article XV, accepted the proposal of the Planning Directorate contained in study N° 555-PLA-RH-MI-2020 entitled "Organizational and budgetary impact on the Judicial Branch following the enactment of the New Agrarian Procedural Code for 2021. Law 9609", consequently, the creation of the Agrarian Court of Jicaral was approved, as well as the change of territorial jurisdiction of the Agrarian Court of Puntarenas and the Agrarian Court of the Second Judicial Circuit of Guanacaste, Santa Cruz seat, to wit:
The current territorial jurisdiction of the Agrarian Courts of the Second Circuit of Guanacaste, Santa Cruz Seat and Puntarenas is:
Agrarian Court of the Second Judicial Circuit of Guanacaste (Santa Cruz).
It encompasses the cantons of Nicoya, Santa Cruz, Nandayure, and Hojancha. From the Central canton of Puntarenas, the district of Lepanto and from the district of Paquera the towns of Gigante and Pueblo Nuevo.
Agrarian Court of Puntarenas.
It encompasses, from the Central canton of Puntarenas, the districts of Puntarenas, Pitahaya, Chomes, Paquera (except the towns of Pueblo Nuevo and Gigante), Manzanillo, Guacimal, Barranca, Monteverde, Isla del Coco, Cóbano, Chacarita, Chira, Acapulco, El Roble, and Arancibia.
The cantons of Esparza, Montes de Oro, Quepos, Parrita, and Garabito.
By reason of the creation of the Agrarian Court of Jicaral, the territorial jurisdiction that will correspond to the involved courts is the following:
(*)Agrarian Court of the Second Judicial Circuit of Guanacaste (Santa Cruz) It encompasses the cantons of Santa Cruz, Nicoya, and Hojancha.
From the canton of Nicoya, the districts of Mansión, San Antonio, and Quebrada Honda.
From the canton of Hojancha, the districts of Hojancha, Monte Romo, Huacas, and Matambú.
Agrarian Court of Puntarenas It encompasses, from the central canton of Puntarenas, the districts of Puntarenas, Pitahaya, Chomes, Manzanillo, Guacimal, Barranca, Monteverde, Isla del Coco, Chacarita, Chira, Acapulco, El Roble, and Arancibia.

The foregoing, with the understanding that case files (expedientes) that, due to jurisdiction, are transferred to the Agrarian Court of Puntarenas, Jicaral seat, shall be remitted directly to that new office, without the need for them to first be transferred to the Agrarian Tribunal.
(*) (Thus amended by circular N° 88-2021 of April 29, 2021) The foregoing with the proviso that this latter office, upon commencing its functions, does not assume territorial jurisdiction over the cantons of Paquera and Cóbano, until such time as public transportation service is provided to those localities, as stipulated in the referenced agreement.
Therefore, while public service is not provided to those localities, territorial jurisdiction shall remain as it currently corresponds to the agrarian courts of the Second Judicial Circuit of Guanacaste, Santa Cruz Seat, and of Puntarenas. Publish once in the Judicial Bulletin.

A LOS DESPACHOS JUDICIALES DEL PAÍS, ABOGADOS, ABOGADAS Y PÚBLICO EN GENERAL SE LES HACE SABER QUE:
Que la Corte Plena en sesión N° 53-2020, celebrada el 21 de setiembre de 2020, artículo XV acogió la propuesta de la Dirección de Planificación contenida en el estudio N° 555-PLA-RH-MI-2020 denominado "Impacto organizacional y presupuestario en el Poder Judicial a partir de la promulgación del Nuevo Código Procesal Agrario para el 2021. La competencia territorial actual de los Juzgados Agrarios del Segundo Circuito de Guanacaste, Sede Santa Cruz y Puntarenas es:
Juzgado Agrario del Segundo Circuito Judicial de Guanacaste (Santa Cruz).
Abarca los cantones de Nicoya, Santa Cruz, Nandayure y Hojancha. Del cantón Central de Puntarenas el distrito de Lepanto y del distrito de Paquera los poblados de Gigante y Pueblo Nuevo.
Juzgado Agrario de Puntarenas.
Abarca del cantón Central de Puntarenas, los distritos de Puntarenas, Pitahaya, Chomes, Paquera (excepto los poblados de Pueblo Nuevo y Gigante ), Manzanillo, Guacimal, Barranca, Monteverde, Isla del Coco, Cóbano, Chacarita, Chira, Acapulco, El Roble y Arancibia.

En razón de la creación del Juzgado Agrario de Jicaral la competencia territorial que le corresponderá a los juzgados involucrados, es la siguiente:
(*)Juzgado Agrario del Segundo Circuito Judicial de Guanacaste (Santa Cruz) Abarca los cantones de Santa Cruz, Nicoya y Hojancha.
Del cantón de Nicoya, los distritos de Mansión, San Antonio y Quebrada Honda.
Del cantón de Hojancha, los distritos de Hojancha, Monte Romo, Huacas y Matambú.
Juzgado Agrario de Puntarenas Abarca del cantón central de Puntarenas, los distritos de Puntarenas, Pitahaya, Chomes, Manzanillo, Guacimal, Barranca, Monteverde, Isla del Coco, Chacarita, Chira, Acapulco, El Roble y Arancibia.

Por lo tanto, mientras no se brinde el servicio público a esas localidades la competencia territorial sigue conforme corresponde actualmente para los juzgados agrarios del Segundo Circuito Judicial de Guanacaste, Sede Santa Cruz y de Puntarenas. Publíquese una sola vez en el Boletín Judicial.
