in the entirety of the text - Complete Text of Norm 42772 Reform of the Regulation for the control of pollutant emissions produced by automotive vehicles with internal combustion engines Complete Text acta: 13E83F No. 42772-MOPT- MINAE-S THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF PUBLIC WORKS AND TRANSPORT, THE MINISTER OF ENVIRONMENT AND ENERGY AND THE MINISTER OF HEALTH In the exercise of the powers and attributions conferred by article 140, subsections 3) and 18) of the Political Constitution; Law No. 3155, of August 5, 1963 and its reforms, the Organic Law of the Ministry of Public Works and Transport, reformed by Law No. 4786; the Road Administration Law No. 6324, of May 24, 1979 and its reforms; the Organic Law of the Environment, No. 7554, of October 4, 1995; the General Health Law, No. 5395, of October 30, 1973 and its reforms; the Organic Law of the Ministry of Health, No. 5412, of November 8, 1973, the Law on Transit on Public Land Roads and Road Safety, No. 9078, of October 4, 2012 and article 28, second paragraph, subsection b) of the General Law of Public Administration, Law No. 6227 of May 2, 1978.

Considering:

39724 MOPT-MINAE-S, which is the "Regulation for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines", published in Supplement No. 87, to La Gaceta No. 103, of May 30, 2016 and its reform No. 40108 MOPT-MINAE-S, published in Supplement No. 321, to La Gaceta No. 247, of December 23, 2016, it becomes necessary to reform articles 6 and 7 of Executive Decree 39724-MOPT-MINAE-S and thereby enable the actions and normative provisions contained in the aforementioned regulation in the context of the corresponding application dates.

7554 and its reforms, as well as what is prescribed by the World Health Organization (WHO), with respect to the effects on public health and the conservation of the environment, it becomes pertinent to adjust the dates indicated in articles 6 and 7 of Executive Decree No. 39724 MOPT-MINAE-S.

Therefore; THEY DECREE REFORM TO EXECUTIVE DECREE 39724-MOPT-MINAE-S, REGULATION FOR THE CONTROL OF POLLUTANT EMISSIONS PRODUCED BY VEHICLES WITH INTERNAL COMBUSTION ENGINES

39724 -MOPT-MINAE-S, "Regulation for the Control of Pollutant Emissions Produced by Vehicles with Internal Combustion Engines", published in Supplement No. 87, to La Gaceta No. 103, of May 30, 2016, so that henceforth it reads as follows:

"Article 6.- Technical specifications of emission reduction systems for compression-ignition vehicles: Diesel-powered vehicles entering the country as of January 1, 2018, that have an injection pump with a mechanical controller, must have seals on the pump adjustment elements.

If they have an exhaust gas recirculation system and/or engine crankcase ventilation system, or other technologies that produce equivalent effects, these systems must not be eliminated.

Diesel-powered vehicles entering the country as of January 1 of 2018 must have an exhaust gas recirculation system, engine crankcase ventilation system, and injection pump with electronic controller, or other technologies that produce equivalent effects. As of January 1, 2022, they must also have a three-way catalytic converter and particulate filter, or other technologies that produce equivalent effects."

"Article 7.- Emission standards for vehicle entry. New and used vehicles in the automobile and light-duty categories of up to 3,500 kilograms gross vehicle weight entering the country as of January 1, 2018 must comply with the following emission standards issued by the European Union or the Federal specifications of the United States of America, in accordance with the following schedule:

As of January 1, 2018	Euro 4, Tier 2 or higher
As of January 1, 2022	Euro 6, Tier 3 or higher

Considerando:

39724 MOPT-MINAE-S, que es el "Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos con Motor de Combustión Interna", publicado en el Alcance N° 87, a La Gaceta N° 103, del 30 de mayo del 2016 y su reforma No. 40108 MOPT-MINAE-S, publicado en el Alcance No. 321, a La Gaceta No. 247, del 23 de diciembre del 2016, se hace necesario realizar la reforma a los artículos 6 y 7 del Decreto Ejecutivo 39724-MOPT-MINAE-S y con ello habilitar las actuaciones y disposiciones normativas contenidas en el citado reglamento en el contexto de las fechas de aplicación que corresponden.

7554 y sus reformas, así como lo prevenido por la Organización Mundial de la Salud (OMS), con respecto a las afectaciones de la salud pública y la conservación del medio ambiente, se hace pertinente un ajuste en las fechas señaladas en los artículos 6 y 7 del Decreto Ejecutivo No. 39724 MOPT-MINAE-S.

Por tanto;

REFORMA AL DECRETO EJECUTIVO 39724-MOPT-MINAE-S, REGLAMENTO PARA EL CONTROL DE LAS EMISIONES CONTAMINANTES PRODUCIDAS POR LOS VEHÍCULOS CON MOTOR DE COMBUSTIÓN INTERNA

DECRETAN

"Artículo 6.- Especificaciones técnicas de los sistemas de reducción de emisiones para vehículos de encendido por compresión: Los vehículos con motor a diésel que ingresen a partir del 1º de enero del 2018, que cuenten con bomba de inyección con controlador mecánico, deben tener precintos en los elementos de ajuste de la bomba.

Si cuentan con sistema de recirculación de gases de escape y/o purga del cárter del motor, u otras tecnologías que produzcan efectos equivalentes, estos sistemas no se deben eliminar.

Los vehículos con motor a diésel que ingresen a partir del 1º de enero del 2018 deben contar con sistema de recirculación de gases de escape, purga del cárter del motor y bomba de inyección con controlador electrónico, u otras tecnologías que produzcan efectos equivalentes. A partir del 1° de enero de 2022, deberán contar, además, con convertidor catalítico de tres vías y filtro de partículas, u otras tecnologías que produzcan efectos equivalentes."

"Artículo 7.- Estándares de emisiones para el ingreso de vehículos. Los vehículos nuevos y usados de las categorías automóviles y carga liviana de hasta 3.500 kilogramos de peso bruto vehicular que ingresen al país a partir del 1º de enero de 2018 deberán cumplir con los siguientes estándares de emisiones emitidos por la Unión Europea o las especificaciones Federales de los Estados Unidos de América, de acuerdo con el siguiente cronograma:
