FIRST: That in accordance with Article 32 of the Organic Environmental Law, the Ministry of Environment and Energy is responsible for the administration of state-owned Protected Wild Areas.

SECOND: That Article 22 of the Biodiversity Law delegates to SINAC the authority to administer state-owned Protected Wild Areas, which establishes that the National System of Conservation Areas (SINAC) is a system of institutional management and coordination, deconcentrated and participatory, with instrumental legal personality that integrates competencies in forestry, wildlife, and protected areas matters, and is attached to the Ministry of Environment and Energy, with the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.

THIRD: That Chirripó National Park is administered by the La Amistad Pacífico Conservation Area (ACLA-P), which was created by Law No. 5773 of August 19, 1975, with an area of 43,700 hectares and expanded by Executive Decree No. 13496-A of March 31, 1982.

FOURTH: That Chirripó National Park is a protected area that experiences tourist demand exceeding its supply, which generates strong pressure from visitors wishing to enter and has led the Administration to develop, through technological tools, instruments that allow for better control and accessibility of the reservation and admission process to the park.

FIFTH: That, to develop facilities and services for visitor services, Chirripó National Park has a lodge with capacity for sixty people, called Crestones Lodge, which is located in the upper part of the protected wild area fourteen and a half kilometers from the last vehicle access in the community of San Gerardo de Rivas. This lodge is administered by a contractor through a Non-Essential Services Concession contract.

SIXTH: That on February 28, 2018, in Gazette number 38, the Resolution SINAC-ACLA-P-D-441-2017 of 2:00 p.m. on November 8, 2017, was published, establishing the Reservation Procedure for Chirripó National Park.

SEVENTH: That on February 28, 2018, in Gazette number 69, Resolution SINAC-ACLA- P-D-076-2018 of 2:00 p.m. on May 20, 2018, was published, modifying the Reservation Procedure for Chirripó National Park for the San Jerónimo and Herradura sectors.

FIRST: That due to the conditions of Chirripó National Park, there are sixty spaces available for tourists to stay overnight at the Crestones Base Lodge.

SECOND: That the update of the Carrying Capacity study for Chirripó National Park from 2010 indicates that the Tourism Carrying Capacity of the park's main trail is 22,507 tourists per year; however, the officially reported visitation records according to SEMEC do not exceed 13,000 tourists per year.

THIRD: That, as part of the operation of non-essential services, the ongoing preventive and corrective maintenance of the main access trail to the Park is the responsibility of the contractor, an aspect that improves the administrative capacity for trail management in terms of tourism carrying capacity.

FOURTH: That the reservation procedure used has generated constant questions and complaints from users who wish to visit the park without having to undergo intermediation processes with tour operators, making it necessary to establish a reservation mechanism that allows the administration to guarantee the transparency of the processes and access under equal conditions for all users.

FIFTH: That the Administration promoted improving the accessibility of the reservation process for Chirripó National Park through the institutional web portal (online reservations), seeking access under equal conditions for the entry of national and international visitors to this protected wild area.

SIXTH: That as of September 7, 2020, contract number 0432020001100059-00 was formalized from Public Tender Number 2019LN-000002-000680000 for the implementation of non-essential services in Chirripó National Park, with a term of one year, renewable.

THE RESERVATION PROCEDURE FOR CHIRRIPÓ NATIONAL PARK IS ESTABLISHED The reservation procedure for Chirripó National Park comprises:

• a)the obligation of the user to reserve and pay the park admission fees to the Administration.
• b)the obligation of the user to pay the amount corresponding to lodging to the contractor, provided that a Non-Essential Services Concession contract is in effect in the Park.
• c)the obligation of the tourist to report to the Park Administration before entering the protected wild area.

At times when a contract for the provision of lodging services is in effect in Chirripó National Park, the general provisions contained in points 5, 12, 14, and 15 of this resolution shall apply.

At times when a contract for the provision of lodging services is not in effect in Chirripó National Park, general provision number 26 of this resolution shall apply.

FIRST: Individuals or legal entities wishing to obtain spaces for the entry of tourists to Chirripó National Park must make their reservations through the online reservation system by accessing the electronic address www.sinac.go.cr or the link https://serviciosenlinea.sinac.go.cr/. In the event that the Online Reservations system is not operating due to proven system failure, reservations will be authorized, via official communication, to be made by telephone by calling the number 905- Chirrip (905-2447747) for all national users and the number 506-2742-5348 for international users, exclusively, as determined by the Administration for reasons of opportunity and convenience.

The auxiliary telephone reservation system will operate Monday through Friday from eight in the morning to twelve noon and from one to four in the afternoon. It does not apply on official holidays or days off declared by the Executive Branch.

Once the auxiliary system is put into effect, reservations may only be made up to one month in advance for entry to Chirripó National Park.

SECOND: The official trails for entering Chirripó National Park are: 1) the main trail San Gerardo - Crestones Base, known as the San Gerardo Sector; 2) the Herradura - Urán - Chirripó trail, known as the Herradura Sector; and 3) the San Jerónimo - Sabana de Los Leones - Crestones Base trail, known as the San Jerónimo Sector.

THIRD: Individuals or legal entities may make a reservation to enter via the main trail for a maximum of six individuals at a time. For entry via the Herradura Sector and San Jerónimo Sector trails, individuals or legal entities may make a reservation for a maximum of eight individuals at a time, provided that the corresponding use permits are in effect.

FOURTH: Individuals or legal entities may make reservations for a maximum stay of two nights and three days between the months of December to April, and up to three nights and four days between the months of May to November.

FIFTH: Tourists who wish to enter the park through the San Gerardo Sector for one day and who do not require overnight stays at the Crestones Lodge must pay their admission fees following the procedures established in the online reservation system.

SIXTH: For the person or group of persons who completes the reservation process for entry to Chirripó National Park, the system generates a reservation code. If for any reason they cannot attend, the user(s) will not have the right to make changes to the members in the reservation and will be entitled to a refund of the amount paid for admission, provided they process it at least 15 days in advance, a situation that may change according to the decree on admission fees to protected areas that is in effect.

The registered user who credited the payment of the reservation, interested in obtaining a refund of the money for admission, must submit a written application containing:

The registered user who credited the payment of the reservation, interested in being 1. Date of the application 2. Applicant's full name.

3. Address the application to the Administration of Chirripó National Park.

4. Request the cancellation of the generated code, the cancellation of the reservation, and the request for a refund of the money.

5. Reason for the application.

6. In the case of local refunds, the application must indicate the name of the bank, customer account number, and checking or savings account number of the user who credited the payment. For refunds to banks outside the country, they must indicate the bank name, branch, address, BIC, Swift, beneficiary, CIF, IBAN.

7. Copy of the applicant's identification document.

8. Copy of the reservation receipt or purchase history report generated by the online reservation system.

9. Indication of the place or means for receiving notifications, and 10. Applicant's signature identical to the identification document.

The lack of a signature will result in the rejection of the application and the filing of the same.

The interested party must submit the application using any of the following means:

1. In person at the Administration office of Chirripó National Park, located in San Gerardo de Rivas, Pérez Zeledón, province of San José.

2. Using the email address [email protected].

The administration will begin the process from the moment the user completes the requirements indicated in this article. It is the responsibility of the user to verify the complete receipt of the application and the requirements.

The Administration has no type of responsibility or participation in the case of refunds for lodging and other non-essential services acquired with the contractor.

In cases where the banking entity charges any type of commission for the refund transaction, it will be deducted from the amount to be refunded. The amount of the commission will be set by the banking entity responsible for making the corresponding refund.

As a consequence of this act, the Administration will make available in the online reservation system the spaces for which cancellation has been processed, which will be done on Tuesdays of each week starting at 10:00 a.m., becoming available from that moment to users who wish to acquire them. The Administration will send an email to the contractor at [email protected] with the list of cancelled reservations, so that both parties handle the information to proceed with the client.

In the event that, for reasons of force majeure, the Administration must proceed with the closure of Chirripó National Park, it will contact each of the users who made reservations on the dates corresponding to the event, to process the refund of the amounts for admission to Chirripó National Park according to the most appropriate procedure defined by the administrative office of this protected wild area.

SEVENTH: Tourists entering through the San Gerardo Sector and the Herradura Sector must register their entry in person at the Administration of Chirripó National Park, located in San Gerardo de Rivas, Pérez Zeledón, prior to their entry. Those wishing to enter from 3:00 a.m. (the permitted entry time) or in the early hours of the morning must register the day before during the hours of eight in the morning to four in the afternoon.

Those wishing to enter on the same day their entry is authorized must register from eight in the morning until nine in the morning. For security reasons, registration or entry to the Park after ten in the morning will not be permitted.

For tourists entering through the San Jerónimo Sector, they must register their entry to the Park before four in the afternoon on the day prior to their entry, or until ten in the morning on the same day of entry, and will do so in a logbook that the administration has provided to the permit holder.

EIGHTH: Tourists must enter and return only through the authorized sector in the reservation procedure and on the indicated date. In the event of non-compliance, the corresponding legal measure will be applied.

NINTH: The Administration of Chirripó National Park will establish such control mechanisms as it deems appropriate to guarantee that access to the protected area occurs once the corresponding admission fees have been paid.

TENTH: In the event of a failure of the online reservation system, once it has been determined that the normal functioning of the system cannot be initiated or restored, the information technology officer of the Executive Secretariat of SINAC or of the La Amistad Pacífico Conservation Area, as the case may be, will communicate via official letter to the Director of ACLA-P the technical reasons for the failure and the recommendation to initiate the auxiliary reservation procedure provided for by the administration via telephone for national and international calls. Upon receiving the communication, the Director of ACLA-P will instruct, via official letter, the administrator and the reservation officer of Chirripó National Park to initiate the auxiliary reservation system.

The administration will have the necessary time to resolve the system failures, and in the event of impossibility to restore it, it may take the decision to use the auxiliary telephone reservation system.

Once the problems of the online reservation system are resolved, the information technology officer of the Executive Secretariat or of ACLA-P will communicate via official letter to the Regional Directorate of ACLA-P to resume the online reservation process, who in turn will make the corresponding communications to the Park Administration, and the reopening of the Online Reservation System will take place once the administration has entered all the data resulting from the reservations made through the auxiliary telephone system.

General Provisions 1. Two seasons are defined for entry to Chirripó National Park: the season spanning the months of December to April, and the season covering the months from May to November.

2. In a single act, an individual or legal entity may make a reservation for one person and up to a maximum of six persons to enter through the San Gerardo Sector. For entry through the Herradura and San Jerónimo sectors, in a single act, a reservation may be made for one person and up to a maximum of eight persons.

Without exception, if for any reason the user(s) cannot attend, they will not have the right to make changes to the members in the reservation and will be entitled to a refund of the amount paid, provided they process it at least fifteen days in advance, a situation that may change according to the decree on admission fees to Protected Areas that is in effect.

3. When the reservation is made to enter through the San Gerardo Sector, during the months of December to April, they may make their reservation for a maximum of two nights and three days. For the months between May and November, they may make their reservations for a maximum of three nights and four days at the Crestones Base lodge. This does not apply to entry through the Herradura and San Jerónimo sectors, as they have a maximum permitted stay of two nights and three days.

4. When a tourist, being at Crestones Base and space availability exists, wishes to remain in the protected area and stay longer, they may complete the reservation procedure, provided they do not exceed the time intervals established for each season. In this case, they must register their continued stay with the SINAC official stationed at Crestones Base and the contractor.

5. For reservations to Chirripó National Park, the tourist may purchase their admission right up to six months in advance, provided they complete the procedure in its entirety, including the payment process for lodging services with the contractor or for ecotourism activities in cases of valid use permits.

This six-month advance period does not operate in cases where the auxiliary telephone reservation system becomes operational.

6. For purposes of tourist assistance and information, the telephone line 905-Chirrip, which corresponds to the number 905-2447747, is made available for all national users, and the number 506-2742-5348 for international users, Monday through Friday from eight in the morning to four in the afternoon.

7. The public service hours at the administrative offices of Chirripó National Park will be Monday through Sunday, from 8:00 a.m. to 12:00 noon and from 1:00 p.m. to 4:00 p.m.

8. The Administration of Chirripó National Park will make available to users a quantity of 60 (sixty) spaces per day to stay at the Crestones Base Lodge, Monday through Sunday, which may be reserved in their entirety for the authorized routes through the reservation system.

9. Of the total number of spaces, eight spaces per week are reserved for the ACLA-P directorate to assign to interest groups that support the management of the protected area, ACLA-P, or SINAC. To this end, the ACLA-P Directorate must coordinate with the Administration of Chirripó National Park the allocation of the spaces one month in advance; otherwise, the administration of the protected area will make the spaces available to users through the authorized procedure.

10. The Administration of Chirripó National Park will have 20 daily spaces for visitors who wish to enter the park for just one day, exclusively through the San Gerardo Sector, and who do not require lodging at the Crestones Base Lodge. They must complete the reservation procedure prior to their entry and registration with the Administration in accordance with this resolution.

In the event that the Administration opens a trail in the Llano Bonito sector, the Administration will permit the daily entry of a maximum of 15 visitors up to this sector, a trail that will be opened through the figure of a use permit.

11. The amount paid to SINAC for the admission fee covers only the right of daily entry for each person to Chirripó National Park, in accordance with the provisions of the current fee decree.

12. After payment of the reservation, the lodging service at the Crestones Base Lodge must be paid directly to the contractor through the process established for that purpose. The amount to be paid corresponds to the rate established in the contract with the contractor, and may be modified by the established mechanisms.

13. For entry through the Herradura and San Jerónimo Sectors, in addition to the procedure indicated in the previous point with the contractor, they must coordinate with the permit-holding organization regarding payment for duly authorized ecotourism activities.

14. The user must pay the contractor the corresponding lodging fees within a maximum period of five calendar days after the reservation; otherwise, the admission reservation will be cancelled, and the user must proceed to request a refund of the money paid for admission fees, within the timeframe established above and according to the current fee decree.

15. The user entering through the Herradura and San Jerónimo Sectors must pay the lodging fees to the contractor in accordance with the previous point, and the fees for ecotourism activities to the permit-holding organization within a period of five calendar days after the reservation, with the warning that their admission fee will be cancelled if they do not do so, and if applicable, the user must proceed to request a refund of the money within the established timeframes, according to the current fee decree.

16. In the case of reservations made with a time interval between the day of purchase and the day of the visit of less than or equal to fifteen days, the Administration will not process refund requests because there is no legal basis for their processing.

17. No tourist may enter Chirripó National Park after ten in the morning, nor may they enter before three in the morning on the day of their visit.

18. The tourist may occupy the corresponding room at the Crestones Lodge from twelve noon (12:00 p.m.) on the day of entry, which will be shared and will have a capacity for four persons.

19. Tourists must vacate the assigned room at the Crestones Base Lodge before eleven in the morning (11:00 a.m.).

20. Exemption from the payment of admission fees may be granted only based on the provisions of the executive decree regulating entry fees to protected wild areas. Any interested party seeking exempt entry to Chirripó National Park will be subject to the availability of space that the Park Administration establishes at the Crestones Base Lodge and must provide a copy of the resolution authorizing their entry. Once they have obtained the corresponding spaces from the administration of Chirripó National Park, in the event that they wish or need to acquire non-essential services, they must pay the contractor into the accounts they establish for that purpose.

21. Anyone who fails to comply with the aforementioned provisions may not enter or remain within Chirripó National Park and the Crestones Base Lodge. Likewise, those visitors who through their actions go against the provisions of the Public Use Regulations of Chirripó National Park will also be expelled from the protected area.

22. For the holding of the annual Chirripó Ecological Cultural Cross-Country Race, the Administration reserves all the spaces at the Crestones Base Lodge for the day before and the day of the race.

23. The La Amistad Pacífico Conservation Area, for reasons of convenience, visitor and employee safety, forest fires, and other environmental catastrophes and/or force majeure, reserves the right to close visitor entry to Chirripó National Park via a reasoned administrative resolution when it deems it pertinent, and is exempt from any liability. For the foregoing, the Administration will define the most suitable procedure for the corresponding refund for admission to the protected wild area.

24. For reasons of convenience, health emergency, and provisions of the Ministry of Health, the number of tourists and capacities permitted per sectors, trails, Crestones Base Lodge, Llano Bonito, and camping area at Paso de los Indios may be reduced, or a temporary closure may be implemented. As the case may be, the administration may suspend reservations and apply the refund procedure detailed in this resolution. In the event that the administration must define which reservations remain and which are eliminated, the criterion that will prevail will be first in time, first in right.

25. Every visitor staying within Chirripó National Park must demonstrate the legitimacy of their stay during their visit by presenting a photo identification document, and in accordance with the control measures established. In addition, they must carry all the sanitary safety implements established by the protocols of the protected wild area.

26. When there is no valid lodging service contract in Chirripó National Park, the payment and reservation confirmation mechanism for the lodging service to spend the night at the Crestones Base Lodge will be as follows:

. The user will enter the online reservation system to make and pay the park admission fees for the chosen dates. At this moment, the system generates an email with a confirmation code for the corresponding payment.

. The Administration of Chirripó National Park will notify the user, by email, before the date of their entry to the Park, that they have a period of fifteen calendar days from that notification to pay the amount indicated and into the account where they must make the deposit, which will be an essential requirement to secure their space and be able to spend the night in the protected wild area. The email address used to inform the user will be the same one they registered when reserving admission to the Park.

. If the user does not pay the amount within the indicated term, the reservation will be voided, and they must proceed as established in this resolution.

27. For the entry of tourists from Herradura de Rivas up to Cerro Uran and from San Jerónimo de San Pedro up to Sabana de Los Leones, the procedure for making reservations and registration is as follows:

Sectors:

• a)Herradura-Cerro Urán: It is a section of the Herradura-Urán trail that allows camping one night at Paso de Los Indios within Chirripó National Park and visiting Cerro Urán and Cerro Chirripó. Entry will only be permitted on Mondays, Wednesdays, and Saturdays in groups of a maximum of five tourists, and they must return through the same sector.
• b)San Jerónimo - Sabana de Los Leones: It is a section of the San Jerónimo - Sabana de Los Leones Trail that allows a one-day hike to Sabana de Los Leones on Tuesdays, Thursdays, Saturdays, and Sundays, and on official holidays that coincide with Mondays, Wednesdays, and Fridays, in groups of a maximum of twelve tourists.

Reservation Procedure:

San Jerónimo - Sabana de Los Leones Sector To reserve for Tuesdays, Thursdays, Saturdays, and Sundays, the reservation must be made through the online reservation system.

• a)In the case of official holidays that coincide with Mondays, Wednesdays, and Fridays, the reservation will be made by calling the telephone number 905-Chirrip (905-2447747) for all national users and the number 506-2742-5348 for international users.
• b)Once it is verified that there are spaces on the desired dates, the names and identification of the tourists making the visit will be requested, and the reservation number and the amount for the admission fees will be indicated, which must be deposited into the SINAC-National Parks Fund account. Subsequently, the payment receipt must be sent to the email address [email protected].
• c)To make and send the bank deposit, a maximum of three business days after the reservation date is allowed, and six business days to contract the services of the permit holder after the reservation date.

Herradura - Urán Sectors:

• a)To reserve, call 905-2447747. Once it is verified that there are spaces on the desired dates, the names and identification of the tourists making the visit will be requested, and the reservation number and the amount for the admission and camping fees, where applicable, will be indicated, which must be deposited into the SINAC-National Parks Fund account. Subsequently, the payment receipt must be sent to the email address [email protected].
• b)To make and send the bank deposit, a maximum of three business days after the reservation date is allowed, and six business days to contract the services of the permit holder after the reservation date.
• c)In the event that admission purchases are established within the online reservation system through the electronic address www.sinac.go.cr for these sectors, said reservation may be made through this means. Otherwise, the previous provisions apply.
• d)To enter these sectors, visitors must contract the services of the permit holder (permisionario) of the corresponding use permit (permiso de uso); for this purpose, the reference contacts will be provided via email at [email protected].
• e)The permit holder (permisionario) must send the administration confirmation of the services contracted, within a maximum of nine business days following the interested party's reservation. For this, the permit holder will indicate to the administration the reservation numbers that have complied with subsection c.
• f)If the reservation is not confirmed, users may request a refund as established in the fee decree for entry to protected wilderness areas (áreas silvestres protegidas).
• g)Reservations may be made up to six months in advance.

Entry Registration Procedure:

• a)Herradura Urán Sector: Tourists must personally register at the administrative offices of the Chirripó National Park in San Gerardo de Rivas one day before their entry, from 8:00 a.m. to 4:00 p.m., or on the same day of entry, from 8:00 a.m. to 10:00 a.m.
• b)San Jerónimo - Sabana de Los Leones: Tourists must personally register at the offices of the use permit (Permiso de Uso) permit holder (permisionario) in San Jerónimo de San Pedro, one day before their entry, from 8:00 a.m. to 4:00 p.m., or on the same day of entry, from 8:00 a.m. to 10:00 a.m.

28. Against this resolution, the ordinary remedies of revocation and/or appeal are available, in accordance with Article 343 and following of the General Law on Public Administration, which shall be resolved, the revocation by the same body that issued it and the appeal by the National Council of Conservation Areas. The remedies must be filed before the body issuing this resolution within three days following its publication.

This resolution repeals all previous provisions regarding reservation procedures for entry to the Chirripó National Park.

(Note from Sinalevi: Through resolution N° SINAC-ACLA-P-D-118-2021 dated March 11, 2021, the implementation of the Chirripó National Park Reservation Procedure is authorized for the purpose of expanding visitation capacity (aforo de visitación) solely for existing reservations during the months of March through August 2021, establishing the following: " The reservation procedure of Chirripó National Park comprises:

• a)the obligation of the user to reserve and pay the park admission fees to the Administration.
• b)the obligation of the user to pay the corresponding lodging amount to the contractor, provided a Non-Essential Services contract is in force in the Park.
• c)the obligation of the tourist to report to the Park Administration before entering the protected wilderness area (área silvestre protegida).

1º-Individuals or legal entities wishing to obtain spaces for tourist entry to Chirripó National Park must make their reservations through the online reservation system by accessing the electronic address www.sinac.go.cr or the link https://serviciosenlinea.sinac.go.cr/.

2º-In this resolution, an exception is made to the statement defined in the preceding point, which applies only to reservations from March through August 2021. This is for the purpose of having an official procedure to expand reservations that were made under the restrictions issued by the Ministry of Health, being 50% of the permitted visitation capacity (aforo de visitación) for protected wilderness areas (áreas silvestres protegidas). Therefore, the procedure to be applied by the Administration through its collaborators is described below.

Procedure to complete the visitation capacity (aforo de visitación) in Chirripó National Park for the period from March 2021 to August 31, 2021 a) The Administration, through its collaborators, will contact the users of reservations with entry dates from March 2021 to August 31, 2021, for the purpose of offering the opportunity to expand the list of members of the reservation, adjusted to the spaces identified after the room distribution process for the reservations made during the indicated period.

• b)In the initial communication email that the Administration will send through its collaborators, the client will have the opportunity to indicate if they wish to add more participants to the reservation or if they wish to keep it in its original form. It is important to indicate that the maximum capacity per reservation will be four people.
• c)If the user's response is "does not wish to add more participants to the reservation," the reservation will be maintained in its original manner.
• d)If the user's response is that they "do wish to add more participants to the reservation," they will have 5 calendar days to carry out the admission payment process and the lodging. For the admission payment, they must pay into the SINAC account, and for the corresponding lodging payment, into the accounts indicated to them.
• e)To make the admission payment deposit, you must consider the days of the reservation, the number of people, and nationality that you will add to the reservation. The deposit must be made to the official accounts of the National System of Conservation Areas SINAC-National Parks Fund detailed below:
• f)The user must send proof of the admission payment by email to [email protected] and continue with the reservation procedure for lodging and other non-essential services deemed of interest, as follows:

1. The user, in the email sent by the Administration through its collaborators, must enter the link to complete the steps that will allow them to add more participants to the reservation.

If the user made the admission payment deposit online from their personal account, they must download the payment receipt in PDF format. Or, if they made the admission payment at a Banco Nacional de Costa Rica branch, the user must take a legible photo or scan the receipt; it is mandatory that the detail of the receipt indicates the reservation number and number of people. With the payment receipt in hand, the user must attach the payment receipt in the admission tab of the link that the Administration sent through its collaborators. To continue with the reservation procedure, it is essential to make the corresponding payment; otherwise, the process will be terminated.

2. The user must download, print (if they have a digital signature, printing is not necessary), add information for the new participants, and sign the sworn statement (declaración jurada), located in the tab of the sent link, where they declare under oath that the new members of the reservation are part of the original reservation bubble, must fill in the information requested in the declaration, and attach it again in the sworn statements (declaraciones juradas) tab of the shared link.

The sworn statement (declaración jurada) releases the Administration and its collaborators from liability against any claim by the user. It will be the tool the Administration uses through its collaborators to add the new participants.

3. With the admission paid and the declaration uploaded to the indicated website, the user must pay the corresponding lodging amount through the payment gateway of the contractor of non-essential services, for which they will have five calendar days to make the payment.

The user must attach the deposit receipt to the website, indicating in the detail the reservation number and the number of people, with their respective names and identification numbers") (Note from Sinalevi: Through resolution SINAC-ACLA-P-DR-152-2021 dated April 5, 2021, the implementation of the Chirripó National Park Reservation Procedure is authorized for the purpose of expanding visitation capacity (aforo de visitación) solely for existing reservations during the months of April through August 2021, establishing the following: " That the reservation procedure of Chirripó National Park comprises:

• a)The obligation of the user to reserve and pay the park admission fees to the Administration.
• b)The obligation of the user to pay the corresponding lodging amount to the contractor, provided a Non-Essential Services contract is in force in the Park.
• c)The obligation of the tourist to report to the Park Administration before entering the protected wilderness area (área silvestre protegida).

FIRST: The implementation of the auxiliary system shall be as follows:

• a)The user interested in purchasing admissions may do so only by telephone call through number (905) 244-7747 for national calls and (506) 2742-5348 for international users, Monday through Friday from 8:00 a.m. to 12:00 p.m. and from 1:00 p.m. to 4:00 p.m. Not applicable on holidays.
• b)During the telephone call, a reservation code will be assigned, with which the user initiates the reservation process.
• c)The Administration, through its collaborators, will request the user's personal data (full name, identification number, email, and telephone number), and the specific date of the visit, to verify space availability.
• d)If spaces are available, the user will be given 24 hours from the call to make the deposit or transfer for the admission payment.
• e)The user may only reserve one four-person room per call, meaning reservations cannot be made for one, two, three, or more than four people.
• f)Once the call is received, the Administration, through its collaborators, will enter the user's information into the reservation assistant, which will generate an email for the user indicating the steps to follow:

. Admission Payment: In that first email, the user is provided with the reservation number for the pre-reserved room, the entry date, exit date, and the account numbers of the National Parks Fund to make the deposit or transfer. The user will be advised that the reservation number must be included in the detail of the deposit or transfer, and the user will be asked to provide the complete sworn statement (declaración jurada) with the respective signatures.

After making the admission payment, the user will be instructed to send an email to Chirripó National Park at reservaciones.chirripo@sinac. go.cr, attaching the payment receipt. In the body of the email, the user must write the information of the people who will occupy the room (full name, identification number, or passport). The user must copy the email to CRC Chirripó at [email protected].

Only those reservations that have correctly paid the admission will be considered firm reservations. If it is not done correctly, the user will be contacted to correct it, with a maximum period of 6 hours after being contacted. Otherwise, the room will be released. The user must assume the commission cost if applicable.

The accounts to which this payment must be made are:

. Sending Information to CRC Chirripó: in that first email sent by the Administration through its collaborators, the user will be given the link that will redirect them to the CRC Chirripó reservation portal, where the sworn statement (declaración jurada) must be completed (each sworn statement will be sent to SINAC by CRC Chirripó) with the data of the people to add to the reservation, and the established lodging amount must be paid.

• g)The user will have 24 hours to make the admission payment and 10 calendar days to complete the sworn statement (declaración jurada) process and lodging payment to CRC Chirripó.
• h)Once the lodging payment is received, CRC Chirripó will proceed to systematize the information and carry out the invoicing processes.
• i)Users may not make changes to the participants in the reservation(s).
• j)The process for canceling reservations is the same as in reservation resolution N° SINAC-ACLAP-D-374-2020 published in La Gaceta.
• k)In the event that, by the SICORE closing date of March 27, 2021, available admissions were evident for the San Jerónimo and Herradura entry sectors, users will have 8 spaces to reserve in the months not reserved by that date, considering the dates established in the reservation resolution for each sector. If the entry sectors do not use the spaces to fill the room or 2 rooms, the spaces will be enabled to sell the rooms through San Gerardo de Rivas, one month before the date.
• l)The reservation assistant will hold the administrative spaces from Friday to Sunday of each week, and they will be released one month before for sale through San Gerardo.

SECOND: The Auxiliary Reservation System is implemented under the following general conditions:

• a)It applies only for the period from April through August 31, 2021, and for dates on which the complete rooms identified in the analysis of existing reservations are available.
• b)The Administration of Chirripó National Park, together with its collaborators, will be implementing this procedure starting April 5, 2021.
• c)The auxiliary reservation system will be implemented to offer the opportunity to reserve complete rooms (4 visitors), with the understanding that reservations cannot be made for one, two, three, or more than four people, on specific dates, and for a determined time (1-2-3 nights) according to the history of available rooms for the established period.
• d)The available rooms for specific dates between the months of April and August 2021 have been identified.
• e)Users will not be served at SINAC offices to reserve in person.
• f)The reservation assistant does not apply to the sale of spaces for a one-day hike. One-day spaces will be sold through https://serviciosenlinea.sinac.go.cr/ g) Available rooms to reserve per month will be made available to users through the reservation assistant with a 7-day interval:

. Available rooms April 2021: will be sold through the reservation assistant starting March 29, 2021.

. Available rooms May 2021: will be sold through the reservation assistant starting April 5, 2021.

. Available rooms June 2021: will be sold through the reservation assistant starting April 12, 2021.

. Available rooms July 2021: will be sold through the reservation assistant starting April 19, 2021.

. Available rooms August 2021: will be sold through the reservation assistant starting April 26, 2021.)

THEREFORE,

en la totalidad del texto - Texto Completo Norma 374 Procedimiento de reservaciones del Parque Nacional Chirripó Texto Completo acta: 14B800 SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (Esta norma fue derogada por resolución N° SINAC-ACLA-P-DR-585-2021 del 18 de noviembre de 2021, "Procedimiento de reservaciones del Parque Nacional Chirripó considerando las modalidades acordes con los diferentes escenarios") RESOLUCIÓN SINAC-ACLA-P-D-374-2020 Ministerio del Ambiente y Energía, Sistema Nacional de Áreas de Conservación, Área de Conservación La Amistad Pacífico, San Isidro de El General, a las catorce horas del 25 de setiembre del dos mil veinte.

PRIMERO: Que de conformidad con el artículo 32 de la Ley Orgánica del Ambiente, al Ministerio del Ambiente y Energía, le compete la administración de las Áreas Silvestres Protegidas estatales.

SEGUNDO: Que el artículo 22 de la Ley de Biodiversidad, delega en el SINAC la competencia de administrar las Áreas Silvestres Protegidas de carácter estatal, el cual establece que el Sistema Nacional de Áreas de Conservación (SINAC) es un sistema de gestión y coordinación institucional, desconcentrado y participativo, con personería jurídica instrumental que integra las competencias en materia forestal, vida silvestre, áreas protegidas y adscrito al Ministerio del Ambiente y Energía, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.

TERCERO: Que el Parque Nacional Chirripó es administrado por el Área de Conservación La Amistad Pacífico (ACLA-P), el cual se creó mediante ley Nº 5773 del 19 de agosto de 1975, con una superficie de 43.700 hectáreas y ampliado mediante Decreto Ejecutivo Nº 13496-A del 31 de marzo de 1982.

CUARTO: Que el Parque Nacional Chirripó, es un área protegida que presenta una demanda turística superior a la oferta que posee, lo cual genera una fuerte presión por parte de los visitantes que desean ingresar y que ha llevado a la Administración a desarrollar, por medio de herramientas tecnológicas, instrumentos que permitan un mejor control y accesibilidad del proceso de reservaciones y admisión al parque.

QUINTO: Que, para desarrollar facilidades y servicios para la atención de visitantes, el Parque Nacional Chirripó cuenta con un albergue con capacidad para sesenta personas, denominado Albergue Crestones que se ubica en la parte alta del área silvestre protegida a catorce kilómetros y medio del último acceso para vehículos en la comunidad de San Gerardo de Rivas, este albergue es administrado por un contratista mediante un contrato de Concesión de Servicios No Esenciales.

SEXTO: Que el 28 de febrero del 2018, en la Gaceta número 38 se publicó la Resolución SINAC-ACLA-P-D-441-2017 de las 14:00 horas del 08 de noviembre del 2017 que estableció el Procedimiento de Reservaciones del Parque Nacional Chirripó.

SETIMO: Que el 28 de febrero del 2018, en la Gaceta número 69 se publicó la Resolución SINAC-ACLA- P-D-076-2018 de las 14:00 horas del 20 de mayo del 2018 en la que se modificó el Procedimiento de Reservaciones del Parque Nacional Chirripó, para los sectores de San Jerónimo y Herradura.

PRIMERO: Que por las condiciones del Parque Nacional Chirripó, se cuenta con sesenta espacios para que los turistas puedan pernoctar en el Albergue Base Crestones.

SEGUNDO: Que la actualización del estudio de Capacidad de Carga del Parque Nacional Chirripó del año 2010, indica que la Capacidad de Carga Turística del sendero principal del Parque es de 22.507 turistas al año, sin embargo, los registros de visitación oficialmente reportados según el SEMEC no sobrepasan los 13.000 turistas al año.

TERCERO: Que, como parte de la operación de los servicios no esenciales, el mantenimiento permanente preventivo y correctivo del sendero principal de acceso al Parque, es responsabilidad del contratista, aspecto que mejora la capacidad administrativa del manejo del sendero en términos de la capacidad de carga turística.

CUARTO: Que el procedimiento de reservación utilizado ha generado constantes cuestionamientos y denuncias por parte de usuarios, que desean visitar el parque, sin tener que someterse a procesos de intermediación con operadores turísticos, por lo que resulta necesario establecer un mecanismo de reservación que permita a la administración, garantizar la transparencia de los procesos y el acceso en igualdad de condiciones para todos los usuarios.

QUINTO: Que la Administración promovió mejorar la accesibilidad del proceso de reservaciones al Parque Nacional Chirripó mediante el portal web institucional (reservaciones en línea) procurando el acceso en igualdad de condiciones, para el ingreso de visitantes nacionales e internacionales a esta área silvestre protegida SEXTO: Que desde el 7 de setiembre del 2020 se formalizó el contrato número 0432020001100059-00 de la Licitación Pública Número 2019LN-000002-000680000 para la implementación de los servicios no esenciales en el Parque Nacional Chirripó con una vigencia de un año, prorrogable.

POR LO TANTO, SE ESTABLECE EL PROCEDIMIENTO DE RESERVACIONES DEL PARQUE NACIONAL CHIRRIPÓ El procedimiento de reservaciones del Parque Nacional Chirripó comprende:

• a)la obligación del usuario de reservar y cancelar ante la Administración los derechos de admisión al Parque.
• b)la obligación del usuario de cancelar el monto correspondiente al alojamiento ante el contratista, siempre que esté vigente algún contrato de Concesión de Servicios No Esenciales en el Parque.
• c)la obligación del turista de reportarse ante la Administración del Parque antes del ingreso al área silvestre protegida.

En los momentos en que esté vigente un contrato para la prestación del servicio de alojamiento en el Parque Nacional Chirripó, serán aplicables las disposiciones generales contenidas en los puntos 5, 12, 14 y 15 de la presente resolución.

En los momentos en que no esté vigente un contrato para la prestación del servicio de alojamiento en el Parque Nacional Chirripó, se aplicará la disposición general número 26 de la presente resolución.

PRIMERO: Las personas físicas o jurídicas que deseen obtener espacios para el ingreso de turistas al Parque Nacional Chirripó, deberán hacer sus reservaciones a través del sistema de reservaciones en línea accediendo a la dirección electrónica www.sinac.go.cr o al link https://serviciosenlinea.sinac.go.cr/. En caso que el sistema de Reservaciones en Línea no esté operando, debido a razones comprobadas de fallo en el sistema, se autorizará, mediante comunicado oficial, realizar las reservaciones por la vía telefónica llamando al número 905- Chirrip (905-2447747) para todos los usuarios a nivel nacional y al número 506-2742-5348 para los usuarios a nivel internacional, exclusivamente, según lo determine la Administración por razones de oportunidad y conveniencia.

El sistema auxiliar de reservaciones por la vía telefónica funcionará en el horario comprendido de lunes a viernes de ocho de la mañana a doce mediodía y de la una a las cuatro de la tarde. No aplica para días feriados de ley o asuetos declarados por el Poder Ejecutivo.

Una vez puesto en vigencia el Sistema auxiliar, únicamente podrá reservarse hasta con un mes de anticipación para el ingreso al Parque Nacional Chirripó.

SEGUNDO: Los senderos oficiales para el ingreso al Parque Nacional Chirripó son: 1) el sendero principal San Gerardo - Base Crestones conocido como el Sector San Gerardo. 2) el sendero Herradura - Urán - Chirripó conocido como Sector Herradura y 3) el sendero San Jerónimo- Sabana de Los Leones - Base Crestones conocido como Sector San Jerónimo.

TERCERO: Las personas físicas o jurídicas podrán realizar una reservación para ingresar por el sendero principal para un máximo de seis personas físicas a la vez. Para el ingreso por los senderos del Sector Herradura y el Sector San Jerónimo las personas físicas o jurídicas podrán realizar la reservación para un máximo de ocho personas físicas a la vez, siempre y cuando estén vigentes los permisos de uso correspondientes.

CUARTO: Las personas físicas o jurídicas, podrán realizar las reservaciones para una estadía máxima de dos noches y tres días entre los meses de diciembre a abril, y hasta tres noches y cuatro días entre los meses de mayo a noviembre.

QUINTO: Los turistas que desean ingresar al parque por el Sector San Gerardo por un día y que no requieren pernoctar en el Albergue Crestones, deberán cancelar sus derechos de admisión siguiendo los procedimientos establecidos en el sistema de reservaciones en línea.

SEXTO: A la persona o grupo de personas que realice el proceso de reservación para el ingreso al Parque Nacional Chirripó, el sistema le genera un código de reservación. Si por algún motivo no puede asistir, el o los usuarios, no tendrán derecho a realizar cambios de integrantes en la reservación y tendrán derecho a la devolución del monto pagado por concepto de admisión, siempre y cuando lo gestionen con al menos 15 días de anticipación, situación que puede cambiar según el decreto de tarifas de ingreso a las áreas protegidas que esté vigente.

El usuario registrado quién acreditó el pago de la reservación, interesado en que se le haga devolución del dinero por concepto de admisión, deberá presentar una solicitud por escrito que contenga:

El usuario registrado quién acreditó el pago de la reservación, interesado en que se le 1. Fecha de la solicitud 2. Nombre y apellidos del solicitante.

3. Dirigir la solicitud a la Administración del Parque Nacional Chirripó.

4. Solicitar la anulación del código generado, la cancelación de la reservación y la solicitud de reintegro del dinero.

5. Razón de la solicitud.

6. En el caso de reintegros a nivel nacional, la solicitud debe indicar del nombre del banco, número de cuenta cliente y número de cuenta corriente o de ahorros del usuario que acreditó el pago. Para el caso de reintegros a bancos fuera del país deben indicar nombre del banco, oficina, dirección, BIC, Swift, beneficiario, CIF, IBAN.

7. Copia del documento de identificación del solicitante.

8. Copia del comprobante de la reservación o informe histórico de compras generado por el sistema de reservaciones en línea.

9. Indicación del lugar o medio para recibir notificaciones y 10. Firma del solicitante igual que el documento de identificación.

La falta de firma producirá el rechazo de la solicitud y el archivo de la misma.

El interesado deberá presentar la solicitud utilizando cualquiera de los siguientes medios:

1. Personalmente en la oficina de la Administración del Parque Nacional Chirripó, ubicada en San Gerardo de Rivas de Pérez Zeledón, provincia de San José.

2. Utilizando el correo electrónico [email protected].

La administración iniciará el trámite a partir del momento en que el usuario complete los requisitos indicados en este artículo. Es responsabilidad del usuario verificar la recepción completa de la solicitud y los requisitos.

La Administración no tiene ningún tipo de responsabilidad ni participación en el caso de devoluciones por concepto de alojamiento y otros servicios no esenciales adquiridos con el contratista.

En los casos en que la entidad bancaria cobre algún tipo de comisión por la transacción de la devolución, la misma se les rebajará del monto a devolver. El monto de la comisión será fijado por la entidad bancaria encargada de realizar la devolución correspondiente.

Como consecuencia de este acto, la Administración estará habilitando en el sistema de reservaciones en línea los espacios en los que se ha gestionado la anulación, lo cual se hará los días martes de cada semana a partir de las 10:00 a.m., quedando disponibles a partir de ese momento a los usuarios que deseen adquirirlos. La Administración, enviará un correo al contratista un correo a [email protected] con el listado de reservaciones anuladas, para así ambas partes manejar la información para proceder con el cliente.

En caso que, por razones de fuerza mayor, la Administración deba proceder al cierre del Parque Nacional Chirripó, se estará contactando a cada uno de los usuarios que realizaron las reservaciones en las fechas correspondientes al evento, para gestionar el reintegro de los montos por concepto de admisión al Parque Nacional Chirripó de acuerdo al procedimiento más acorde definido por la oficina administrativa de esta área silvestre protegida.

SÉTIMO: Los turistas que ingresen por el Sector San Gerardo y el Sector Herradura, deberán registrar su ingreso de manera personal en la Administración del Parque Nacional Chirripó, ubicada en San Gerardo de Rivas de Pérez Zeledón previo a su ingreso. Para quienes deseen ingresar a partir de las 3:00 a.m. hora permitida de ingreso o en las primeras horas de la mañana, deberán registrarse el día antes en horario de ocho de la mañana a cuatro de la tarde.

Para quienes deseen ingresar el mismo día en que está autorizado su ingreso, deberán registrarse a partir de las ocho de la mañana y hasta las nueve de la mañana. Por razones de seguridad no se permitirá el registro ni ingreso al Parque después de las diez de la mañana.

Para los turistas que ingresan por el Sector San Jerónimo, deberán realizar el registro de ingreso al Parque antes de las cuatro de la tarde del día anterior a su ingreso o hasta las diez de la mañana del mismo día de ingreso y lo hará en una bitácora que la administración le entregó al permisionario.

OCTAVO: Los turistas deberán realizar el ingreso y retorno únicamente por el sector autorizado en el trámite de reservación y en la fecha indicada. En caso de incumplimiento se estará aplicando la medida legal correspondiente.

NOVENO: La Administración del Parque Nacional Chirripó establecerá los dispositivos de control que considere oportunos para garantizar que el acceso al área protegida se haga una vez cancelados los derechos de admisión correspondientes.

DÉCIMO: En caso de fallo del sistema de reservaciones en línea, una vez que se haya determinado que no se puede iniciar o restaurar el funcionamiento normal del sistema, el encargado de tecnologías de información de la Secretaría Ejecutiva del SINAC o del Área de Conservación La Amistad Pacífico, según sea el caso, comunicará vía oficio al Director del ACLA-P las razones técnicas de fallo y la recomendación de iniciar el procedimiento auxiliar de reservaciones previsto por la administración por la vía telefónica para llamadas nacionales e internacionales. Recibida la comunicación, el Director del ACLA-P instruirá mediante oficio al administrador y al encargado de reservaciones del Parque Nacional Chirripó para que den inicio al sistema auxiliar de reservaciones.

La administración dispondrá del tiempo necesario para resolver las fallas del sistema y en caso de imposibilidad de restablecerlo, podrá tomar la decisión de utilizar el sistema auxiliar de reservaciones por la vía telefónica.

Una vez resueltos los problemas del sistema de reservaciones en línea, el encargado de tecnología de información de la Secretaría Ejecutiva o del ACLA-P, comunicará por oficio a la Dirección Regional del ACLA-P para que se retome el proceso de reservaciones en línea, quien a su vez hará las comunicaciones correspondientes a la Administración del Parque y la reapertura del Sistema de Reservaciones en Línea se realizará una vez que la administración haya incluido todos los datos producto de las reservaciones del sistema auxiliar telefónico.

1. Se definen dos temporadas para el ingreso al Parque Nacional Chirripó; la temporada que va de los meses de diciembre hasta abril y la temporada que abarca los meses desde mayo hasta noviembre.

2. En un mismo acto, la persona física o jurídica, podrá realizar la reservación para una persona y hasta un máximo de seis personas para ingresar por el Sector San Gerardo. Para el ingreso por los sectores Herradura y San Jerónimo, en un mismo acto se podrá realizar la reservación para una persona y hasta un máximo de ocho personas.

Sin excepción si por algún motivo no pueden asistir, él o los usuarios, no tendrán derecho a realizar cambios de integrantes en la reservación y tendrán derecho a la devolución del monto pagado, siempre y cuando lo gestionen con al menos quince días de anticipación, situación que puede cambiar según el decreto de tarifas de ingresos a las Áreas Protegidas que esté vigente.

3. Cuando la reservación se realice para ingresar por el Sector San Gerardo, durante los meses de diciembre a abril, podrán realizar su reservación para un máximo de dos noches y tres días. Para los meses entre mayo y noviembre, podrán realizar sus reservaciones para un máximo de tres noches y cuatro días en el albergue Base Crestones. Esto no aplica para el ingreso por los sectores de Herradura y San Jerónimo, ya que tienen un máximo permitido de dos noches y tres días.

4. Cuando el turista, encontrándose en Base Crestones y existiendo disponibilidad de espacio, desee permanecer en el área protegida y alojarse por más tiempo, podrá desarrollar el procedimiento de reservaciones, siempre y cuando no exceda los intervalos de tiempo establecidos para cada temporada. En este caso deberá realizar el registro de permanencia ante el funcionario del SINAC destacado en Base Crestones y el contratista.

5. Para las reservaciones al Parque Nacional Chirripó, el turista podrá adquirir su derecho de admisión hasta con seis meses de antelación, siempre y cuando desarrolle el procedimiento en su totalidad incluyendo el trámite de cancelación de los servicios de hospedaje ante el contratista o de actividades ecoturísticas en los casos de permisos de uso vigentes.

Este plazo de seis meses de antelación no opera en los casos en que entre en funcionamiento el sistema auxiliar de reservaciones mediante la vía telefónica.

6. Para efectos de atención e información al turista, se pone a disposición la línea telefónica 905-Chirrip que corresponde al número 905-2447747 para todos los usuarios a nivel nacional y al número 506-2742-5348 para los usuarios a nivel internacional en un horario de lunes a viernes de ocho de la mañana a las cuatro de la tarde.

7. El horario de atención al público en las oficinas administrativas del Parque Nacional Chirripó, será de lunes a domingo, de las 8:00 a.m a las 12.00 m. d y de la 1:00 p.m. a las 4:00 p.m.

8. La Administración del Parque Nacional Chirripó pondrá a disposición de los usuarios la cantidad de 60 (sesenta) espacios por día para permanecer en el Albergue Base Crestones de lunes a domingo, los cuales podrán ser reservados en su totalidad para las rutas autorizadas mediante el sistema de reservaciones.

9. De la totalidad de espacios, se reservan ocho espacios por semana, para que la dirección del ACLA-P los asigne a grupos de interés que apoyan la gestión del área protegida, del ACLA-P o del SINAC. Para ello, la Dirección del ACLA-P deberá coordinar con la Administración del Parque Nacional Chirripó, la asignación de los espacios con un mes de anticipación, de lo contrario la administración del área protegida, pondrá los espacios a disposición de los usuarios a través del procedimiento autorizado.

10. La Administración del Parque Nacional Chirripó dispondrá de 20 espacios diarios para los visitantes que deseen ingresar al parque solo por un día, exclusivamente por el Sector San Gerardo y que no requieren alojamiento en el Albergue Base Crestones, los cuales deberán desarrollar el procedimiento de reservaciones previo a su ingreso y de registro ante la Administración conforme a esta resolución.

En el eventual caso que la Administración habilite un sendero en el sector de Llano Bonito, la Administración permitirá el ingreso diario de un máximo de 15 visitantes hasta este sector, sendero que se habilitará mediante la figura de permiso de uso.

11. El monto cancelado al SINAC por el derecho de admisión cubre únicamente el derecho de ingreso diario para cada persona al Parque Nacional Chirripó conforme a lo establecido en el decreto de tarifas vigente.

12. Posterior al pago de la reservación, el servicio de alojamiento en el Albergue Base Crestones debe ser cancelado de forma directa al contratista mediante el proceso que establezcan para tal efecto. El monto que debe cancelar corresponde a la tarifa establecida en el contrato con el contratista, y podrá ser modificado por los mecanismos establecidos.

13. Para el ingreso por los Sectores Herradura y San Jerónimo, además del trámite indicado en el punto anterior con el contratista, deberán coordinar con la organización permisionaria lo relacionado al pago por actividades ecoturísticas debidamente autorizadas.

14. El usuario deberá pagar al contratista los derechos correspondientes al alojamiento en un plazo máximo de cinco días naturales, posteriores a la reservación, de lo contrario se cancelará la reservación de la admisión y el usuario deberá proceder a realizar la solicitud de reembolso del dinero pagado por derecho de admisión, dentro del plazo establecido anteriormente y según el decreto de tarifas vigentes.

15. El usuario que ingrese por los Sectores Herradura y San Jerónimo, deberá pagar los derechos de alojamiento al contratista ajustándose a lo que indica el punto anterior y los derechos por actividades ecoturísticas a la organización permisionaria dentro de un plazo de cinco días naturales posteriores a la reservación, bajo la advertencia de que se le cancelará el derecho de admisión si no lo hace y de corresponder, el usuario deberá proceder a realizar la solicitud de reembolso del dinero en los plazos establecidos, según el decreto de tarifas vigentes.

16. Para el caso de las reservaciones realizadas con un intervalo de tiempo entre el día de la compra y el día de la visita menor o igual a quince días, la Administración no estará gestionando solicitudes de reintegro debido a que no existe amparo legal para su trámite.

17. Ningún turista podrá ingresar después de las diez de la mañana al Parque Nacional Chirripó, así como tampoco puede ingresar antes de las tres de la mañana del día de su visita.

18. El turista podrá ocupar la habitación correspondiente en el Albergue Crestones a partir de las doce mediodía (12 m.d) del día de ingreso, la cual será de uso compartido y con capacidad para cuatro personas.

19. Los turistas deberán desocupar la habitación asignada en el Albergue Base Crestones antes de las once de la mañana (11:00 a.m).

20. La exoneración del pago de derechos de admisión se podrá otorgar únicamente con base en lo establecido por el decreto ejecutivo que regula las tarifas de ingreso a las áreas silvestres protegidas. Todo interesado en ingresar exonerado al Parque Nacional Chirripó, estará sujeto a la disponibilidad de espacio que la administración del Parque establezca en el Albergue Base Crestones y deberá aportar copia de la resolución que le autoriza su ingreso. Una vez obtenidos los espacios correspondientes ante la administración del Parque Nacional Chirripó en el eventual caso que desee o deba adquirir los servicios no esenciales deberá cancelar ante el contratista y en las cuentas que ellos establezcan para tal fin.

21. Quien no acate las disposiciones antes mencionadas no podrá ingresar ni permanecer dentro del Parque Nacional Chirripó y en el Albergue Base Crestones. De igual manera, aquellos visitantes que con sus acciones vayan en contra de lo establecido en el Reglamento de Uso Público del Parque Nacional Chirripó, también serán expulsados del área protegida.

22. Para la realización de la Carrera anual Ecológica Cultural a campo traviesa del Chirripó, la Administración se reserva la totalidad de los espacios en el Albergue Base Crestones para el día previo y el día de la realización de la carrera.

23. El Área de Conservación La Amistad Pacífico por razones de conveniencia, seguridad para los visitantes y funcionarios, incendios forestales y otras catástrofes ambientales y/o fuerza mayor se reserva el derecho de cerrar el ingreso de visitantes al Parque Nacional Chirripó, vía resolución administrativa motivada cuando lo considere pertinente y se exime de cualquier responsabilidad. Para lo anterior, la Administración definirá el procedimiento que mejor se ajuste para el reintegro respectivo por concepto de admisión al área silvestre protegida.

24. Por razones de conveniencia, emergencia sanitaria y disposiciones del Ministerio de Salud, la cantidad de turistas y aforos permitidos por sectores, senderos, Albergue Base Crestones, Llano Bonito y área de acampar en el Paso de los Indios podrá disminuir el aforo o desarrollar un cierre temporal según sea el caso, la administración podrá suspender reservaciones y aplicar el procedimiento de devolución detallada en esta resolución. En caso que la administración tenga que definir cuales reservaciones permanecen y cuales se eliminan, el criterio que prevalecerá será el de primero en tiempo primero en derecho.

25. Todo visitante que permanezca dentro del Parque Nacional Chirripó, deberá demostrar la legitimidad de su permanencia durante su estadía, presentando un documento de identificación con fotografía y conforme a los medios de control que se establezcan. Además, deberá portar todos los implementos de seguridad sanitaria que establece los protocolos del área silvestre protegida.

26. Cuando no exista un contrato vigente de servicio de alojamiento en el Parque Nacional Chirripó, el mecanismo de pago y confirmación de las reservaciones del servicio de alojamiento para pernoctar en el Albergue Base Crestones será el siguiente:

. El usuario ingresará al sistema de reservaciones en línea para realizar y cancelar los derechos de admisión al parque en las fechas elegidas. En este momento el sistema le genera un correo con un código de confirmación del pago correspondiente.

. La Administración del Parque Nacional Chirripó, le comunicará por correo electrónico al usuario, antes de la fecha de su ingreso al Parque, que tiene un plazo de quince días naturales a partir de esa notificación, para cancelar el monto que le indicará y la cuenta donde debe hacer el depósito, que será requisito indispensable para que asegure su espacio y pueda pernoctar en el área silvestre protegida. La dirección de correo electrónico que será utilizada para informar al usuario será la misma que éste registre al momento de reservar la admisión al Parque.

. Si el usuario no cancela el monto en el término indicado la reservación quedará sin efecto y deberá proceder conforme lo establece la presente resolución.

27. Para el ingreso de turistas desde Herradura de Rivas y hasta Cerro Uran y desde San Jerónimo de San Pedro hasta Sabana de Los Leones, el procedimiento para realizar las reservaciones y registro es el siguiente:

Sectores:

• a)Herradura-Cerro Urán: Es un tramo del sendero Herradura -Urán que permite acampar una noche en Paso de Los Indios dentro del Parque Nacional Chirripó y visitar el Cerro Urán y el Cerro Chirripó que podrán únicamente ingresar los días lunes, miércoles y sábados en grupos de máximo cinco turistas y que obligatoriamente deberán regresarse por el mismo sector.
• b)San Jerónimo - Sabana de Los Leones: Es un tramo del Sendero San Jerónimo - Sabana de Los Leones que permite la caminata de un día hasta Sabana de Los Leones los días martes, jueves, sábados y domingos y días feriados de ley que coincidan con lunes, miércoles y viernes en grupos máximo de doce turistas.

Procedimiento para Reservación:

Sector San Jerónimo - Sabana de Los Leones Para reservar los días martes, jueves, sábados y domingos la reservación se deberán realizar mediante el sistema de reservaciones en línea.

• a)Para el caso de aquellos feriados de Ley que coincidan con lunes, miércoles y viernes la reservación se realizará mediante llamada a la vía telefónica llamando al número 905-Chirrip (905-2447747) para todos los usuarios a nivel nacional y al número 506- 2742-5348 para los usuarios a nivel internacional.
• b)Una vez que se corroboré que hay espacios en las fechas deseadas se le solicitaran los nombres e identificación de los turistas que realizarán la visita y se le indicará el número de reservación y el monto por los derechos de admisión, que deberá depositar en la cuenta del SINAC-Fondo de Parques Nacionales y posteriormente deberá enviar el recibo de pago al correo electrónico [email protected].
• c)Para realizar y enviar el depósito bancario tendrá un máximo de tres días hábiles posterior a la fecha de reservación y seis días hábiles para contratar los servicios del permisionario posterior a la fecha de reservación.

Sectores Herradura - Urán:

• a)Para Reservar deberá llamar al 905-2447747, una vez que se corroboré que hay espacios en las fechas deseadas se le solicitaran los nombres e identificación de los turistas que realizarán la visita y se le indicará el número de reservación y el monto por los derechos de admisión y acampar cuando corresponda, que deberá depositar en la cuenta del SINAC-Fondo de Parques Nacionales y posteriormente deberá enviar el recibo de pago al correo electrónico [email protected].
• b)Para realizar y enviar el depósito bancario tendrá un máximo de tres días hábiles posterior a la fecha de reservación y seis días hábiles para contratar los servicios del permisionario posterior a la fecha de reservación.
• c)En caso que se establezca para compra de admisión dentro del sistema de reservaciones en línea mediante la dirección electrónica www.sinac.go.cr estos sectores, se podrá realizar dicha reservación por este medio. De lo contrario aplican las disposiciones anteriores.
• d)Para realizar el ingreso a estos sectores obligatoriamente tendrán que contratar los servicios del permisionario del permiso de uso correspondiente, para ello mediante correo electrónico [email protected] se le indicaran los contactos de referencia.
• e)El permisionario deberá enviar a la administración la confirmación de la contratación de los servicios hasta un máximo de nueve días hábiles posterior a la reservación del interesado. Para ello indicará a la administración los números de reservación que han cumplido con el inciso c.
• f)En caso de que la reservación no se confirme los usuarios podrán solicitar el reintegro tal y como lo establece el decreto de tarifas para ingreso a las áreas silvestres protegidas.
• g)Las reservaciones se pueden realizar hasta con seis meses de antelación.

Procedimiento para el Registro de Ingreso:

• a)Sector Herradura Urán: Los turistas personalmente deberán registrarse en las oficinas administrativas del Parque Nacional Chirripó en San Gerardo de Rivas un día antes de su ingreso desde las 8:00 a.m. y hasta las 4:00 p.m., o el mismo día del ingreso desde las 8:00 a.m. y hasta las 10:00 a.m.
• b)San Jerónimo - Sabana de Los Leones: Los turistas personalmente se deberán registrar en las oficinas del permisionario del Permiso Uso en San Jerónimo de San Pedro, un día antes de su ingreso desde las 8:00 a.m. y hasta las 4:00 p.m., o el mismo día del ingreso desde las 8:00 a.m. y hasta las 10:00 a.m.

28. Contra la presente resolución proceden los recursos ordinarios de revocatoria y / o apelación, de conformidad con los artículos 343 y siguientes de la Ley General de la Administración Pública, los cuales serán resueltos, el de revocatoria por el mismo órgano que lo dictó y el de apelación por el Consejo Nacional de Áreas de Conservación. Los recursos deberán interponerse ante el órgano que dicta esta resolución dentro de los tres días posteriores a su publicación.

La presente resolución deroga todas las disposiciones anteriores referentes a procedimientos de Reservaciones para el ingreso al Parque Nacional Chirripó.

(Nota de Sinalevi: Mediante resolución N° SINAC-ACLA-P-D-118-2021 del 11 de marzo del 2021 se autoriza la implementación del Procedimiento de Reservación del Parque Nacional Chirripó por motivo de ampliación del aforo de visitación únicamente para las reservaciones ya existentes duranto los meses de marzo a Agosto del 2021 estableciéndose lo siguiente: " El procedimiento de reservaciones del Parque Nacional Chirripó comprende:

• a)la obligación del usuario de reservar y cancelar ante la Administración los derechos de admisión al Parque.
• b)la obligación del usuario de cancelar el monto correspondiente al alojamiento ante el contratista, siempre que esté vigente algún contrato de Servicios No Esenciales en el Parque.
• c)la obligación del turista de reportarse ante la Administración del Parque antes del ingreso al área silvestre protegida.

1º-Las personas físicas o jurídicas que deseen obtener espacios para el ingreso de turistas al Parque Nacional Chirripó, deberán hacer sus reservaciones a través del sistema de reservaciones en línea accediendo a la dirección electrónica www.sinac.go.cr o al link https://serviciosenlinea.sinac.go.cr/.

2º-En la presente resolución se hace una excepción al enunciado definido en el punto anterior que aplica únicamente para las reservaciones del mes de marzo al mes de agosto 2021. Esto con la finalidad de contar con un procedimiento oficial para ampliar las reservaciones que se realizaron bajo las restricciones emitidas por el Ministerio de Salud, siendo un 50% del aforo de visitación permitido para las áreas silvestres protegidas. Por lo cual, a continuación, se describe el procedimiento que se estará aplicando por parte de la Administración a través de sus colaboradores.

Procedimiento para completar el aforo de visitación en el Parque Nacional Chirripó correspondientes al periodo de marzo 2021 al 31 de agosto 2021 a) La Administración a través de sus colaboradores, contactará a los usuarios de las reservas con fecha de ingreso marzo 2021 al 31 de agosto 2021, con la finalidad de externar la oportunidad de ampliar la lista de integrantes de la reservación ajustado a los espacios identificados luego del proceso de distribución de habitaciones de las reservas realizadas en el lapso indicado.

• b)En el correo inicial de comunicación que estará enviando la Administración a través de sus colaboradores, el cliente tendrá la oportunidad de indicar si desea agregar más participantes a la reserva o si desea mantenerla de la forma original. Es importante indicar que la capacidad máxima por reservación será de cuatro personas.
• c)Si la respuesta del usuario es "no desea agregar más participantes a la reserva", se mantendrá la reserva de la manera original.
• d)Si la respuesta del usuario es que "si desea agregar más participantes a la reserva", contará con 5 días naturales, para realizar el proceso de pago de admisión y el hospedaje. Para el pago de la admisión deberá hacerlo a la cuenta del SINAC y para el pago correspondiente al hospedaje en las cuentas que se le indiquen.
• e)Para realizar el depósito de pago de admisión debe de considerar los días de la reserva, cantidad de personas y nacionalidad, que agregará a la reserva. El depósito debe realizarse a las cuentas oficiales de Sistema Nacional de Áreas de Conservación SINAC-Fondo de Parques Nacionales que se detallan a continuación:
• f)El usuario deberá enviar por correo electrónico el comprobante de pago de admisión al correo [email protected] y continuar con el procedimiento de reservación del hospedaje y otros servicios no esenciales que se consideren de interés de la siguiente manera:

1. El usuario en el correo enviado por la Administración a través de sus colaboradores deberá ingresar al enlace para concretar los pasos que le permitirán agregar más participantes a la reserva.

Si el usuario realizó el depósito del pago de admisión en línea desde su cuenta personal, deberá descargar el comprobante de pago en formato PDF. O bien si realizó el pago de admisión en la ventanilla del Banco Nacional de Costa Rica, el usuario deberá tomar una foto legible o escanear el comprobante, es obligatorio en el detalle del comprobante se indique el número de reserva y cantidad de personas. Con el comprobante de pago en mano el usuario debe adjuntar el comprobante de pago en la pestaña de admisión del enlace que la Administración a través de sus colaboradores le envió. Para seguir con el procedimiento de reservación es indispensable realizar el pago correspondiente de lo contrario se dará por finalizado el trámite.

2. El usuario deberá descargar, imprimir (si posee firma digital no es necesario imprimir), agregar información de los nuevos participantes y firmar la declaración jurada, colocada en la pestaña del enlace enviado, donde declara bajo juramento que los nuevos integrantes de la reserva son parte de la burbuja de la reserva original, debe rellenar la información solicitada en la declaración y adjuntarla de nuevo en la pestaña de declaraciones juradas del enlace compartido.

La declaración jurada exime de responsabilidad la Administración y sus colaboradores, ante cualquier reclamo del usuario. La misma será la herramienta que usará la Administración a través de sus colaboradores para agregar los nuevos participantes.

3. Con la admisión paga y la declaración subida al sitio web indicado, el usuario deberá cancelar el monto correspondiente al hospedaje, a través de la pasarela de pagos del contratista de los servicios no esenciales, para lo cual tendrá cinco días naturales para realizar el pago.

El usuario deberá adjuntar al sitio web, el comprobante de depósito, indicando en el detalle el número de reserva y la cantidad de personas, con sus respectivos nombres y números de cédula") (Nota de Sinalevi: Mediante resolución SINAC-ACLA-P-DR-152-2021 del 5 de abril del 2021 se autoriza la implementación del Procedimiento de Reservación del Parque Nacional Chirripó por motivo de ampliación del aforo de visitación únicamente para las reservaciones ya existentes duranto los meses de abril a Agosto del 2021 estableciéndose lo siguiente: " Que el procedimiento de reservaciones del Parque Nacional Chirripó comprende:

• a)La obligación del usuario de reservar y cancelar ante la Administración los derechos de admisión al Parque.
• b)La obligación del usuario de cancelar el monto correspondiente al alojamiento ante el contratista, siempre que esté vigente algún contrato de Servicios No Esenciales en el Parque.
• c)La obligación del turista de reportarse ante la Administración del Parque, antes del ingreso al área silvestre protegida.

PRIMERO: La implementación del sistema auxiliar será de la siguiente manera:

• a)El usuario interesado en la compra de admisiones podrá hacerlo únicamente por llamada telefónica a través del número (905) 244-7747 para llamadas nacionales y (506) 2742-5348 para usuarios a nivel internacional. De lunes a viernes en horario de 8:00 a 12 :00 p.m. y de 1:00 p.m. a 4:00 p.m. No aplica para días feriados.
• b)Durante la llamada telefónica se le asignará un código de reservación, con el cual el usuario inicia el proceso de reserva.
• c)La Administración por medio de sus colaboradores, le solicitará al usuario sus datos personales (nombre completo, número de cédula, correo electrónico y teléfono), fecha específica de la visita, con la finalidad de verificar la disponibilidad de espacios.
• d)En caso de existir espacios, se le brindará al usuario 24 horas a partir de la llamada para realizar el depósito o transferencia del pago de admisión.
• e)El usuario solo podrá reservar una habitación de cuatro personas por llamada, es decir, no se podrán realizar reservaciones para una, dos, tres o más de cuatro personas.
• f)Una vez recibida la llamada la Administración por medio de sus colaboradores, ingresarán la información del usuario en el asistente de reservaciones, el cual generará un correo para el usuario, donde se le indicarán los pasos a seguir; . Pago de admisión: En ese primer correo se le brinda el número de reserva de la habitación pre-reservada, la fecha de ingreso, fecha de salida, números de cuenta del Fondo de Parque Nacionales para que realice el depósito o la transferencia. Se le indicará al usuario que en el detalle del depósito o transferencia debe colocar el número de reserva, así como se le solicitará al usuario aportar la declaración jurada completa y con las firmas respectivas.

Posterior a realizar el pago de admisión, se le indicará al usuario que debe enviar un correo electrónico al Parque Nacional Chirripó reservaciones.chirripo@sinac. go.cr, adjuntando el comprobante de pago En el cuerpo del correo el usuario debe anotar la información de las personas que ocuparán la habitación (nombre completo, número de cédula o pasaporte). El usuario debe copiar el correo a CRC Chirripó [email protected].

Solo se considerarán reservaciones en firme aquellas que hayan pagado la admisión de manera correcta. Si no se realiza de manera correcta se procederá a contactar al usuario para que corrija, con un plazo máximo de 6 horas próximas al ser contactado. De lo contrario se liberará la habitación. El usuario deberá asumir el costo de comisión en caso de que aplique.

Las cuentas a las que se debe realizar este pago son:

. Envío de información a CRC Chirripó: en ese primer correo enviado por la Administración mediante sus colaboradores, se le colocará al usuario el enlace que lo redireccionará al portal de reservas de CRC Chirripó, donde se debe llenar la declaración jurada (cada declaración jurada será enviada al SINAC por CRC Chirripó) con los datos de las personas a agregar a la reserva, y pagar el monto establecido por concepto de hospedaje.

• g)El usuario contará con 24 horas para realizar el pago de admisión y con 10 días naturales para realizar el proceso de declaración jurada y pago de hospedaje a CRC Chirripó.
• h)Una vez recibido el pago del hospedaje, CRC Chirripó procederá a sistematizar la información y a realizar los procesos de facturación.
• i)Los usuarios no podrán realizar cambios de participantes en la reserva (as).
• j)El proceso para anular reservaciones es el mismo de la resolución de reservaciones N° SINAC-ACLAP-D-374-2020 publicada en La Gaceta.
• k)En caso que al día de cierre del SICORE 27 de marzo 2021, se evidenciaran admisiones disponibles por los sectores de ingreso de San Jerónimo y Herradura, los usuarios contarán con 8 espacios para reservar en los meses que no se hayan reservado a esta fecha, considerando las fechas establecidas en la resolución de reservaciones para cada sector, si los sectores de ingreso no utilizan los espacios para llenar la habitación o 2 habitaciones, se habilitarán los espacios para vender las habitaciones por San Gerardo de Rivas, un mes antes de la fecha.
• l)El auxiliar de reservaciones guardará los espacios administrativos de viernes a domingo de cada semana y se liberarán, un mes antes para vender por San Gerardo.

SEGUNDO: El Sistema Auxiliar de Reservaciones se implementa bajo las siguientes condiciones generales:

• a)Aplica únicamente para el periodo comprendido entre abril hasta el 31 de agosto 2021 y para las fechas en las que se encuentran disponibles las habitaciones completas identificadas en el análisis de las reservaciones ya existentes.
• b)La Administración del Parque Nacional Chirripó, en conjunto con sus colaboradores estarán implementando este procedimiento a partir del 5 de abril 2021.
• c)Se implementará el sistema auxiliar de reservaciones, con la finalidad de ofrecerles la oportunidad de reservar habitaciones completas (4 visitantes), en el entendido de que no se podrán realizar reservaciones para una, dos, tres o más de cuatro personas, en fechas específicas, y por tiempo determinado (1-2-3 noches) según el histórico de habitaciones disponibles para el periodo establecido.
• d)Se tienen identificadas las habitaciones disponibles por fechas específicas entre los meses de abril a agosto 2021.
• e)No se atenderán usuarios en las oficinas del SINAC para reservar de forma presencial.
• f)El auxiliar de reservaciones no aplica para la venta de espacios para caminata de un día. Los espacios de un día se venderán, a través, de https://serviciosenlinea.sinac.go.cr/ g) Las habitaciones disponibles para reservar por mes se colocarán a disposición de los usuarios, a través, del auxiliar de reservaciones con una distancia de 7 días:

. Habitaciones disponibles abril 2021; se venderán, a través, del auxiliar de reservaciones a partir del 29 de marzo 2021.

. Habitaciones disponibles mayo 2021; se venderán, a través del auxiliar de reservaciones a partir del 5 de abril 2021.

. Habitaciones disponibles junio 2021; se venderán, a través, del auxiliar de reservaciones a partir del 12 de abril 2021.

. Habitaciones disponibles julio 2021; se venderán, a través, del auxiliar de reservaciones a partir del 19 de abril 2021.

. Habitaciones disponibles agosto 2021; se venderán, a través, del auxiliar de reservaciones a partir del 26 de abril 2021.)
