in the entirety of the text - Complete Text of Norm 0049 Establishes a closed season for the semi-industrial sardine purse-seine (bolichera) (de cerco) fishery, from April 2 through May 31, 2020 Complete Text of record: 143728 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/0049-2020.-Puntarenas, on the second day of April, two thousand twenty.
I.-That Mr. Álvaro Otárola Fallas, Acting General Technical Director, presented the proposal for a sardine purse-seine (bolichera) closed season for the year 2020, in accordance with the agreement of the National Closed Season Commission adopted at the Ordinary Working Session Record CNV-01-2020, held on January 24, 2020, by means of which technical report DDI-004-20-2020 issued by the Department of Research and Development is accepted, the following proposal for a closed season for the semi-industrial sardine purse-seine (bolichera) (de cerco) fishery is submitted for study and evaluation, during the year 2020.
II.-That for this proposal for a sardine closed season for 2020, the most advisable course is to establish a closed season with the same characteristics as the one established in agreement AJDIP/043-2016, on the grounds that, to date, there are no new scientific investigations that would determine a substantive modification of the agreement in question.
III.-That for reasons of structural quorum, the Board of Directors of INCOPESCA was unable to adopt this agreement before the dates contemplated; therefore, the Executive Presidency of INCOPESCA, by official communication, issues a communiqué with the corresponding justifications, requesting in good faith and reaching an agreement to accept the closed season for the current year and that, once sessions are resumed, the corresponding agreement shall be adopted.
IV.-That with the implementation of this closed season, exactly as conceived, the imperative need to protect the sardine resource during its reproductive stage is addressed in pursuit of the sustainability of this fishery resource, reason for which, the Board of Directors; Therefore, AGREES:
1.1 To establish a closed season for the semi-industrial sardine purse-seine (bolichera) (de cerco) fishery, in the area comprised by an imaginary line running from Punta Agujas (84º38´57´´West Longitude, 09º43´46´´ North Latitude) to the Faro de la Isla Negritos offshore (84º49´35´´ West Longitude, 09º49´14´´ North Latitude) and from there to the eastern part of Punta Cuchillo on the Península de Nicoya (09º50´03" North Latitude, 084º53´42" West Longitude) and from these lines seaward inward to the mouth of the río Tempisque; from the month of March through the month of May.
1.2 To permit during the month of May 2021, two access days per month for each semi-industrial sardine vessel, to operate in the area running from Punta Agujas to the Faro de Isla Negritos offshore and from there to Punta Cuchillo and from this point in a straight imaginary line to the Peñón (area known as Tárcoles), for the purpose of supplying sardine for bait to the national fishing fleet, and any surplus may be marketed for other purposes as established. This access shall be used in 12-hour daytime shifts each on an alternating weekly basis by each vessel such that both vessels may not be within said area in the same week, and prior to their entry, their owners, vessel operators (armadores), or Captain must coordinate the week in which each vessel will enter. Additionally, prior to entering said zone, they must notify the date and time to the Department of Registration and the Department of Enforcement of Incopesca.
1.3 That all inspections carried out on landings (descargas) by the semi-industrial sardine purse-seine (bolichera) fleet be duly inspected by the Institution's inspectors. Said inspection must cover not only the sardine landings, but also that of the bycatch (fauna de acompañamiento). In turn, the Department of Development and Research shall carry out biological sampling of said catches to evaluate the reproductive behavior of the sardines and to ensure that the sizes caught comply with the legal minimum size at first capture (tallas legales de primera captura).
1.4 To establish a maximum incidental catch quota of 10%, relative to the total sardine catch by the vessels of the semi-industrial sardine purse-seine (bolichera) fleet.
1.5 To establish the sardine closed season on a permanent basis for at least 5 years, until such time as new scientific investigations are available that determine a change to the agreement.

3°-To establish a maximum incidental catch quota of 10%, relative to the total sardine catch by the vessels of the semi-industrial sardine purse-seine (bolichera) fleet.
4°-To establish the sardine closed season on a permanent basis for at least 5 years, until such time as new scientific investigations are available that determine a change to the agreement.
5°-Final and binding agreement. Let it be communicated.
Considering:
en la totalidad del texto - Texto Completo Norma 0049 Establece veda para la pesca semi-industrial sardinera bolichera (de cerco), desde el 02 de abril hasta el 31 de mayo de 2020 Texto Completo acta: 143728 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/0049-2020.-Puntarenas, a los dos días del mes de abril de dos mil veinte.
I.-Que el Sr. Álvaro Otárola Fallas, Director General Técnico a.í., presentó la propuesta de veda de sardina bolichera para el año 2020, de conformidad con el acuerdo de la Comisión Nacional de Vedas adoptado en la Sesión de Trabajo Ordinaria Acta CNV-01-2020, celebrada el 24 de enero del 2020, mediante el cual se acoge informe técnico DDI-004-20-2020 emitido por el Departamento de Investigación y Desarrollo, se remite para su estudio y valoración la siguiente propuesta de veda para la pesca semi-industrial sardinera bolichera (de cerco), durante el año 2020.
II.-Que para esta propuesta de veda de sardina para el 2020, lo más recomendable es establecer una veda con las mismas características de la que se estableció en el acuerdo AJDIP/043-2016 en razón de que a la fecha no existen nuevas investigaciones científicas, que determinen una modificación de fondo del acuerdo en mención.
III.-Que por motivo de quorum estructural, la Junta Directiva del INCOPESCA, no logró tomar el presente acuerdo antes de las fechas contempladas, por lo anterior, la Presidencia Ejecutiva del INCOPESCA mediante oficio realiza comunicado con las justificaciones correspondientes, solicitando de buena fe y llegando a un acuerdo de acoger la veda para el presente año y que una vez sean retomadas las sesiones se procede a tomar el acuerdo correspondiente IV.-Que con la puesta en marcha de esta veda, tal cual se ha concebido, se atiende la imperiosa necesidad de proteger el recurso sardina en su etapa de reproducción en procura de la sostenibilidad de este recurso pesquero, razón por la cual, la Junta Directiva; Por tanto, ACUERDA:
1.1 Establecer una veda para la pesca semi-industrial sardinera bolichera (de cerco), en el área comprendida por una línea imaginaria que va desde Punta Agujas (84º38´57´´Longitud Oeste, 09º43´46´´ Latitud Norte) al Faro de la Isla Negritos afuera (84º49´35´´ Longitud Oeste, 09º49´14´´ Latitud Norte) y desde ahí hasta la parte Este de Punta Cuchillo en la Península de Nicoya (09º50´03" Latitud Norte, 084º53´42" Longitud Oeste) y de estas líneas aguas adentro hasta la desembocadura del río Tempisque; desde el mes de marzo hasta el mes de mayo.
1.2 Permitir durante el mes de mayo de 2021, dos días de acceso al mes a cada embarcación semi-industrial sardinera, para faenar en el área que va desde Punta Agujas al Faro de Isla Negritos afuera y de ahí a Punta Cuchillo y desde este punto en una línea recta imaginaria hasta el Peñón (área conocida como Tárcoles), a efectos que puedan suplir sardina para carnada a la flota pesquera nacional y los excedentes podrán ser comercializados para otros fines según lo establecido. Este acceso será utilizado en franjas diurnas de 12 horas cada una de forma semanal alterna por cada embarcación de modo que no podrán estar dentro de dicha área las 2 embarcaciones en la misma semana y de previo a su ingreso, deberán sus propietarios, armadores o Capitán; coordinar la semana en que ingresará cada embarcación. Además, previo al ingreso a dicha zona, deberán notificar la fecha y hora al Departamento de Registro y al Departamento de Fiscalización del Incopesca.
1.3 Que todas las inspecciones que se realicen a las descargas por parte de la flota semi-industrial bolichera de sardina sean debidamente inspeccionadas por parte de los inspectores de la Institución. Dicha inspección debe cubrir no solo las descargas de sardina, sino también la de fauna de acompañamiento. A su vez el Departamento de Desarrollo e Investigación realizará muestreos biológicos de dichas capturas para evaluar el comportamiento reproductivo de las sardinas y que las tallas capturadas cumplan con las tallas legales de primera captura.
1.4 Que se establezca una cuota de captura incidental máxima del 10%, con respecto a la captura total de sardina por parte de los barcos de la flota semi-industrial bolichera de sardina.
1.5 Establecer la veda de sardina de manera permanente durante al menos 5 años, hasta tanto, no se tengan nuevas investigaciones científicas, que determinen el cambio del acuerdo.
