CONSIDERING
Likewise, by reason of its objective of conserving biological diversity, measures must be established that reduce the impact of fisheries on populations of elasmobranchs, sharks, turtles, billfish, and marine mammals.
Article 56 of UNCLOS and Article V of the Antigua Convention; instruments that confirm sovereignty over the resources of the Exclusive Economic Zone.
38681 MAG-MINAE of October 9, 2014, the Executive Presidency of the Costa Rican Institute of Fisheries and Aquaculture, through Official Letter PESJ-115-2020 of April 20, 2020, informed the Minister of Agriculture and Livestock and the Minister of Environment and Energy of Official Letter DGT-050-2020 dated April 16, 2020, signed by the Acting General Technical Directorate, whereby the Executive President was notified of the need to modify the second paragraph of Article 16 of Executive Decree No. 38681-MAG-MINAE, taking into consideration the large number of vessels that make up the commercial medium-scale fleet, the difficult situation of the fisheries sector in relation to the overexploitation of fishery resources, the globalization of markets, and the difficult socioeconomic situation facing the sector, coupled with the impact caused by the COVID-19 disease, and in response to Executive Decree number 42227-MP-S of March 16, 2020, where a state of national emergency was declared throughout the territory of the Republic of Costa Rica, it is necessary to adopt measures to minimize the impacts on health and the economy caused by the COVID-19 disease on all productive sectors and in this case on the affected national fisheries sector.
38681-MAG-MINAE of October 9, 2014, is reasonable and proportional, and therefore endorses said extension as it complies with the current fisheries legal framework.

THEY DECREE Amendment to Executive Decree No. 38681-MAG-MINAE of October 9, 2014; entitled: "Management Plan for the Use of Tuna and Related Species in the Exclusive Economic Zone of the Costa Rican Pacific Ocean," published in the Official Gazette La Gaceta No. 213, on November 5, 2014.
Therefore,
38681-MAG-MINAE is hereby modified, such that a period of 8 months is added to those originally established for the commercial medium-scale fleet for the installation of Satellite Tracking devices, so that henceforth it shall read as follows:

For the installation of Satellite Tracking devices or beacons on vessels of the Costa Rican fishing fleet, a maximum of 36 months is established for the advanced commercial fleet and for the commercial medium-scale fleet, a maximum of 74 months from the entry into force of this Decree for its proper implementation."

CONSIDERANDO
Así mismo en razón de su objetivo de conservación de la diversidad biológica se deben establecer medidas que reduzcan el impacto de las pesquerías sobre las poblaciones de elasmobranquios, tiburones, tortugas, picudos y mamíferos marinos.
Reforma al Decreto Ejecutivo No.38681-MAG-MINAE del 09 de octubre del 2014; denominado: "Ordenamiento para el Aprovechamiento de Atún y especies afines en la Zona Económica Exclusiva del Océano Pacífico Costarricense", publicado en el Diario Oficial La Gaceta N° 213, el día 05 de noviembre del año 2014.
