In compliance with Agreement JD TWO HUNDRED FIFTY DASH TWO THOUSAND NINETEEN approved by the Board of Directors of the Empresa de Servicios Públicos de Heredia S.A., in Session number THREE THOUSAND NINE HUNDRED SEVENTY-FIVE- C dated the eleventh of November, two thousand nineteen, in its ARTICLE FOUR, SUBSECTION ONE, and through which it approved the REGULATION FOR THE PROVISION OF POTABLE WATER, SANITARY SEWERAGE, AND FIRE HYDRANT SERVICES OF THE EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA S.A., and published in SUPPLEMENT NUMBER 270 in LA GACETA Nº 231 OF DECEMBER 4, 2019; the following forms that are part of said regulation are hereby published:

By these means, I authorize the Empresa de Servicios Públicos de Heredia S.A. to deposit the money owed in my name into the account detailed below. Likewise, I release the Empresa de Servicios Públicos de Heredia S.A. from all contractual or extracontractual liability that, for any motive, reason, or consequence, could arise from the issuance of the deposit requested into the account indicated by me.

Remember that the name of the beneficiary and the owner of the account to be deposited into must be the same.

Likewise, I state that I have been informed of the existence of the database used by the Empresa de Servicios Públicos de Heredia, Sociedad Anónima, which is required as a requisite to provide quality services, for which reason I consent to the use of the personal information that has been requested from me, for purposes that will be exclusively for the internal administrative use of the Company, as well as those requested by the Municipalities associated with the Empresa de Servicios Públicos de Heredia, Sociedad Anónima and those corresponding to public purposes (Article 9, second paragraph, Ley 8968). I also consent that the Empresa de Servicios Públicos de Heredia, Sociedad Anónima, on its electronic page, facilitates web access to learn details about my billing (services provided, amounts to be paid with detail, service classification), using as a system entry requirement: my service contract number or identity card number. FIRST: Provision of Service: "ESPH" shall supply the aqueduct and/or sanitary sewerage service requested by the "SUBSCRIBER" for the uses and rates established by the Autoridad Reguladora de los Servicios Públicos, hereinafter ARESEP (residential, industrial, commercial, government, or preferential), with the current rates established under the terms set forth in the Service Provision Regulation, Technical Standard for Water Meters, and Sectoral Regulation of ARESEP, and the current Ley de Aguas, for the property volume ______ , Entry _______ , cadastral map number _____ ,, at the address _____________________ , for which it shall have a maximum period of five (5) business days for the Potable Water Service and ten (10) business days for the Sanitary Sewerage Service, counted from the signing of this contract, to make its connection, provided that conditions of force majeure, unforeseen events, or limitations or restrictions specified in the Regulation for the Provision of Potable Water, Sanitary Sewerage, and Fire Hydrant Services of ESPH S.A. do not arise.

SECOND: Regarding Internal Installations: The "SUBSCRIBER" is obligated to construct, operate, and maintain the internal installations on their property, in accordance with what is stipulated in the applicable technical standards required for this purpose, approved by ARESEP, as well as any other issued or adopted, or any applicable in Costa Rica.

THIRD: Due Date and Collection of the Bill: The bills for each monthly period shall be put up for collection according to the estimated or approximate schedules established by "ESPH," and communicated previously to the "SUBSCRIBER" on the Company's website.

When the "SUBSCRIBER" pays the bill corresponding to the consumption of their service on a date after the one indicated for its due date, they must pay an additional amount of 2% on the billed amount, in order to cover the costs incurred by "ESPH" for not timely receiving the income for the services already provided.

For the reconnection of the aqueduct service suspended due to lack of payment, the "SUBSCRIBER" must pay the sum set by the Autoridad Reguladora de los Servicios Públicos to cover the reconnection cost, in addition to the additional amount for late payment and the outstanding accounts for the suspended service.

FOURTH: Liability for Damages: "ESPH" shall not be liable for any damage caused by the misuse, operation, and poor condition of the "SUBSCRIBER'S" internal installation, even if it had inspected them on its own initiative or at the latter's request, nor for the consequences of any cause originating in said installations.

FIFTH: Damages to Metering Equipment: The "SUBSCRIBER" shall ensure the good condition of the metering equipment installed on their property, and must timely inform "ESPH" of any damage that occurs to it. If it is proven that the damages to said equipment are attributable to the "SUBSCRIBER," they must assume the corresponding costs for its repair or replacement, and such action must be recorded in a file. "ESPH", for its part, shall provide preventive maintenance to its water meters, in accordance with its respective programs established for this purpose.

SIXTH: Upon signing this contract, the parties understand and accept the obligations and rights defined in the current Regulation for the Provision of Aqueduct, Sanitary Sewerage, and Fire Hydrant Services issued by ARESEP, the Ley de Aguas, and the binding rules for the provision of the public service of potable water, sanitary sewerage, and fire hydrants.

En cumplimiento del Acuerdo JD DOSCIENTOS CINCUENTA GUIÓN DOS MIL DIECINUEVE aprobado por La Junta Directiva de la Empresa de Ser1icios Públicos de Heredia S.A., en la Sesión número TRES MIL NOVECIENTOS SETENTA Y CINCO- C de fecha once de noviembre del año dos mil diecinueve, en su ARTÍCULO CUARTO, INCISO UNO y mediante el cual aprobó el REGLAMENTO DE PRESTACIÓN DE SERVICIOS DE AGUA POTABLE, ALCANTARILLADO SANITARIO E HIDRANTES DE LA EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA S.A., y publicado en el ALCANCE NUMERO 270 en la GACETA Nº 231 DE 4 DE DICIEMBRE DE 2019; publíquense los siguientes formularios que forman parte de dicho reglamento:

Por este medio autorizo a la Empresa de Servicios Públicos' de Heredia S.A. a depositar el dinero adeudado a mi nombre en la cuenta que se detalla a continuación. Así mismo consiento que la Empresa de Servicios Públicos de Heredia, Sociedad Anónima en su página electrónica sea facilitado el acceso vía web para con0cer detalles sobre mi facturación (servicios brindados, montos a cancelar con detalle, clasificación del servicio), utilizando como requisito de ingreso al sistema: mi número de contrato de servicio o cédula de identidad. PRIMERA: Suministro del Servicio: La "ESPH", suministrará el servicio de acueducto y/o alcantarillado sanitario solicitado por el "ABONADO" para los usos y tarifas establecidas por la Autoridad Reguladora de los Servicios Públicos en adelante ARESEP (residencial, industrial, comercial, gobierno o preferencial) con las tarifas vigentes establecidos en los términos establecidos en el Reglamento de Prestación de Servicios, Norma Técnica de Hidrómetros y Reglamento Sectorial, de la ARESEP y de la Ley de Aguas vigente, para el inmueble tomo ______ , Asiento _______ 􀂶 número de plano _____ ,, en la dirección _____________________ , para lo cual contará con un plazo máximo de cinco(S) días hábiles para el Servicio de Agua Potable y diez (10) días hábiles para el Servicio de Alcantarillad Sanitario, contados a partir de la firma del presente contrato, para realizar su conexión, siempre y cuando no se den condiciones de fuerza mayor, caso fortuito, limitaciones o restricciones especificadas en el Reglamento de Prestación de Servicios de Agua Potable, Alcantarillado Sanitario e Hidrantes de la ESPH S.A.

SEGUNDA: De las instalaciones internas: El "ABONADO" tiene la obligación de construir, operar y mantener las instalaciones internas de su propiedad, de conformidad en lo que corresponda, con lo estipulado en las normas técnicas exigibles al efecto, aprobadas por la ARESEP, así como cualquier otra que emita o adopte, o cualquiera aplicables en Costa Rica.

TERCERA: Vencimiento y cobro de la factura: Las facturas por cada período mensual se pondrán al cobro de acuerdo a los cronogramas estimados o aproximados establecidos por la "ESPH", y comunicados previamente al "ABONADO" en el sitio web de la Empresa, Cuando el 'ABONADO" cancele la factura correspondiente al consumo de su servicio, en fecha posterior a la indicada para su vencimiento, deberá pagar un importe adicional del 2% sobre el monto facturado, con el fin de cubrir los costos en que incurre "ESPH" por no percibir oportunamente los ingresos por los servicios ya brindados.

Por la reconexión del servicio de acueducto suspendido por falta de pago, el "ABONADO", deberá cancelar la suma que fije la Autoridad Reguladora de los Servicios Públicos para cubrir el costo de la reconexión, además del importe adicional por cancelación atrasada y las cuentas pendientes por el servicio suspendido.

CUARTA: Responsabilidad por daños: "ESPH" no será responsable por ningún daño ocasionado por el mal uso, funcionamiento y mal estado de la instalación interna del "ABONADO", aun cuando las hubiese revisado por propia iniciativa o a pedido de éste, ni por las consecuencias de causa alguna que tengan su origen en dichas instalaciones.

QUINTA: Daños al equipo de medición: El "ABONADO" velará por el buen estado del equipo de medición instalado en su inmueble, debiendo informar oportunamente a "ESPH" sobre cualquier daño que le ocurra. De comprobarse que los daños en dicho equipo son atribuibles al "ABONADO", este deberá asumir los costos correspondientes a su reparación o reposición, debiendo constar en un expediente tal acción. "ESPH", por su parte dará mantenimiento preventivo a sus hidrómetros, de acuerdo con sus respectivos programas que para tal efecto tiene establecidos SEXTA: Con la firma de este contrato, las partes entienden y aceptas las obligaciones y derechos definidos en el Reglamento de Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes vigente por parte de la ARESEP, la Ley de Aguas y las normas vinculantes a la prestación del servicio público de agua potable, alcantarillado sanitario e hidrantes.
