39316-S of August 10, 2015, "Reglamento para el manejo y disposición final de lodos y biosólidos," published in Alcance No. 106 to the Official Gazette La Gaceta No. 234 of December 2, 2015, are hereby amended to read as follows:
"Article 19º - Concerning the sanitary operating permit (permiso sanitario de funcionamiento) and the Waste Manager Registry (Registro de Gestor): Every natural or legal person who carries out collection, transport, treatment, and final disposal activities for sludge from septic tanks or other treatment systems, whether totally or partially for third parties, must have the Sanitary Operating Permit granted in accordance with Executive Decree N° 39472 of January 18, 2016, "Reglamento General para Autorizaciones y Permisos Sanitarios de Funcionamiento Otorgados por el Ministerio de Salud," and Article 47 of Executive Decree No. 37567-S-MINAET-H of November 2, 2012, "Reglamento General a la Ley para la Gestión Integral de Residuos." The application for a sanitary operating permit must be accompanied by the following information, solely for sludge collection and transport service providers:
- A)Total number of collection vehicles with the following information for each:
a.1) License plate number.
a.2) Capacity of the tank or gondola in cubic meters.
a.3) Authorization document number from the Ministerio de Obras Públicas y Transportes for the transit of heavy vehicles on national roads.
The Ministry of Health, on the corresponding Sanitary Operating Permit certificate, must include the license plate numbers of the vehicles registered by the applicant.
- B)Sludge treatment service contract signed with a third party, which must contain the following information:
b.1) Operating Permit number of the company providing the sludge treatment service and its validity period.
b.2) Authorized Waste Manager Certificate number of the company providing the sludge treatment service and its validity period.
b.3) Validity period of the sanitary operating permit and the Authorized Waste Manager Registry, and type of authorized activity.
b.4) Estimated volume per year and type of sludge collected.
b.5) Validity period and termination date of the contract.
