across the entirety of the text - Complete Text of Norm 42003 Declaration of public utility of the Water Association of San Antonio de León Cortés Complete Text record: 132D7F N° 42003-MJP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, on article 32 of the Associations Act No. 218 of August 8, 1939 and articles 27 and following of the Regulations to the Associations Act No. 29496-J, published in La Gaceta No. 96 of May 21, 2001, as well as the provisions of article 3, subsection ch) of the Income Tax Act No. 7092 and articles 103 and 104 of the Code of Tax Norms and Procedures No. 4755.
I.-Article 32 of the Associations Act No. 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State and thereby contribute to solving a social need.
II.-The Water Association of San Antonio de León Cortés (Asociación de Acueducto de San Antonio de León Cortés), legal entity identification number 3-002-228234, was registered in the Associations Registry of the National Public Registry on July 30, 1998, through case file (expediente) No. 10000, in volume 442; entry 1156.
III.-The purposes pursued by the association, according to the third article of its bylaws, are the following: "a-) Maintenance of the aqueduct in San Antonio de León Cortés, first district of the twentieth canton of the province of San José. b-) Administer, operate, and maintain in good condition the aqueduct, in accordance with the provisions and Regulations issued in this regard by the Institute of Aqueducts and Sewers (AyA), c-) Obtain the effective participation of the community, in the construction and maintenance of the aqueduct. d-) Collaboration in the programs and campaigns of an educational nature that are undertaken. e-) Help to explain and disseminate within the community the provisions and regulations of the Institute of Aqueducts and Sewers. f-) Cooperate with the plans, projects, and works undertaken by the Institute of Aqueducts and Sewers in the community. g-) Participate in the monitoring and protection of the supply sources of the Aqueduct, prevent their contamination, and assist in the protection of the hydrographic basins of the region." I.-El artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado y que por ello contribuyan a solventar una necesidad social.
II.-La Asociación de Acueducto de San Antonio de León Cortés, cédula de persona jurídica número 3-002-228234, se inscribió en el Registro de Asociaciones del Registro Público Nacional desde el día 30 de julio de 1998, mediante expediente N° 10000, al tomo 442; asiento 1156.
III.-Los fines que persigue la asociación, según el artículo tercero de sus estatutos son los siguientes: "a-) Mantenimiento del acueducto en la San Antonio de León Cortés distrito primero del cantón veinte de la provincia de San José. b-) Administrar, operar y conservar en buenas condiciones el acueducto, de acuerdo con las disposiciones y Reglamentos que al respecto emita Acueductos y Alcantarillados, c-) Obtener la participación efectiva de la comunidad, en la construcción y mantenimiento del acueducto. d-) Colaboración en los programas y campañas de índole educativa que se emprendan. e-) Ayudar a explicar y divulgar en la comunidad las disposiciones y reglamentos de Acueductos y Alcantarillados. f-) Cooperar con los planes, proyectos y obras que emprendan acueductos y alcantarillados en la comunidad. g-) Participar en la vigilancia y protección de las fuentes de abastecimiento del Acueducto, evitar las contaminaciones de las mismas y ayudar a la protección de las cuencas hidrográficas de la región".
