in the entirety of the text - Complete Text of Norm 42050 Amendment to the Organic Agriculture Regulation Complete Text of Act: 1322FE N° 42050-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers and attributions conferred upon them by numerals 46, 50 and 140, subsections 3) and 18) of the Political Constitution, articles 25.1, 27.1 of the General Law of Public Administration, Nº 6227 of May 2, 1978; the Law for the Promotion of Agricultural and Livestock Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, Nº 7064 of April 29, 1987; Law 7664 of April 8, 1997, Phytosanitary Protection Law, Law Nº 7554 of November 13, 1995, Organic Environmental Law; Law Nº 7472 of December 20, 1994, on the Promotion of Competition and Effective Consumer Defense; Law Nº 7473 of December 20, 1994, Implementation of the Agreements of the Uruguay Round of Multilateral Trade Negotiations.

1. 1That organic agriculture (agricultura orgánica) is of utmost importance for the country in relation to public health, environmental conservation, job creation, and the improvement of human beings' quality of life.
2. 2That Executive Decree Nº 29782-MAG of August 21, 2001, "Organic Agriculture Regulation" ("Reglamento de Agricultura Orgánica"), has the purpose of establishing regulations for the production, processing, and marketing of organic agricultural and livestock products in Costa Rica, as well as defining the standards for the different stages of their production and certification processes.
3. 3That a partial adaptation of the Organic Agriculture Regulation (Reglamento de agricultura orgánica) is necessary to achieve, in a more effective and efficient manner, the promotion of the organic agriculture activity, for which it is necessary to amend articles 75, 79, 80, and 85 of Executive Decree 29782-MAG, to eliminate the cost of the annual fee for producers who register during the transition period (periodo de transición) and, in turn, facilitate the simplification of procedures through the use of technology.
4. 4That in accordance with Directive N° 052-MP-MEIC called "Moratorium on the creation of new Procedures, Requirements, or Formalities for citizens to obtain permits, licenses, or authorizations" dated June 19, 2019, and Executive Decree N° 41795-MP-MEIC "On the Streamlining of Procedures in Public Entities, Through the Use of the Sworn Statement" and CIRCULAR Nº 001-2019-MEIC-MP of July 17, 2019, on the application of Directive N° 052-MPMEIC, no new requirements are being incorporated.
5. 5That article 8 of the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, N° 8220, establishes the inter-institutional coordination procedure to obtain photocopies, certificates, attestations, maps, or any information required to resolve citizens' petitions.
6. 6That in accordance with article 12 bis, second and third paragraphs of the Regulation to the Law for the Protection of Citizens from the Excess of Administrative Requirements and Procedures, Executive Decree N° 37045-MP-MEIC of February 22, 2012, published in the Official Gazette La Gaceta N° 60 of March 23, 2012; Section I, called "Prior Control of Regulatory Improvement" of the "Cost-Benefit Assessment Form", was completed. From the evaluation of the proposed regulation under discussion, it is important to highlight that its result was negative, meaning that it contains no procedures, requirements, or formalities; therefore, it was determined that it conforms to the Law for the Protection of Citizens from the Excess of Administrative Requirements and Procedures, Law N° 8220 of March 4, 2002, and its Regulation. Therefore;

en la totalidad del texto - Texto Completo Norma 42050 Reforma Reglamento de agricultura orgánica Texto Completo acta: 1322FE N° 42050-MAG EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En uso de las facultades y atribuciones que les confiere los numerales 46, 50 y 140, inciso 3) y 18) de la Constitución Política, los artículos 25.1, 27.1 de la Ley General de la Administración Pública, Nº 6227 del 2 de mayo de 1978; la Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, Nº 7064 del 29 de abril de 1987; la Ley 7664 de 08 de abril de 1997, Ley de Protección Fitosanitaria, Ley Nº 7554 del 13 de noviembre de 1995, Ley Orgánica del Ambiente; la Ley Nº 7472 de 20 de diciembre de 1994, de Promoción de la Competencia y Defensa Efectiva del Consumidor; la Ley Nº 7473 de 20 de diciembre de 1994, Ejecución de los Acuerdos de la Ronda Uruguay de Negociaciones Comerciales Multilaterales.

1. 1Que la agricultura orgánica es de suma importancia para el país en relación con la salud de la población, la conservación del ambiente, la generación de fuentes de empleo y el mejoramiento de la calidad de vida de los seres humanos.
2. 2Que el Decreto Ejecutivo Nº 29782-MAG de 21 de agosto del 2001 "Reglamento de Agricultura Orgánica" tiene como finalidad establecer la regulación de la producción, elaboración y comercialización de productos agropecuarios orgánicos en Costa Rica, así como definir la normativa para las diferentes etapas de los procesos de producción y certificación de los mismos.
3. 3Que es necesaria una adecuación parcial del Reglamento de agricultura orgánica, para lograr de una manera más eficaz y eficiente el fomento de la actividad de agricultura orgánica, para lo cual se hace necesario reformar los artículos 75,79,80 y 85 del Decreto Ejecutivo 29782-MAG, para eliminar el costo del pago de la anualidad para las personas productoras que se registran en periodo de transición y a su vez facilitar la simplificación de trámite con el uso de la tecnología.
4. 4Que de conformidad a la Directriz N° 052-MP-MEIC denominada "Moratoria a la creación de nuevos Trámites, Requisitos o Procedimientos al ciudadano para la obtención de permisos, licencias o autorizaciones" de fecha 19 de junio del año 2019 y Decreto Ejecutivo N° 41795-MP-MEIC "Sobre La Agilización de los Trámites en las Entidades Públicas, Mediante el Uso de la Declaración Jurada y la CIRCULAR Nº 001-2019-MEIC-MP del 17 de julio del 2019, sobre la aplicación de la Directriz N° 052-MPMEIC, no se incorpora ningún nuevo requisito.
5. 5Que el artículo 8 de la Ley de Protección al Ciudadano del exceso de requisitos y trámites administrativos, N° 8220, establece el procedimiento de coordinación inter-institucional para obtener fotocopias, constancias, certificaciones, mapas o cualquier información requerida para resolver gestiones de los ciudadanos.
6. 6Que de conformidad con el artículo 12 bis párrafos segundo y tercero del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012, publicado en al Diario Oficial La Gaceta N° 60 del 23 de marzo de 2012; se procedió a llenar la Sección I denominada "Control Previo de Mejora Regulatoria" del "Formulario de Evaluación Costo Beneficio". De la evaluación de la propuesta normativa en comentario, es importante destacar que su resultado fue negativo, es decir, que no contiene trámites, requisitos ni procedimientos, por lo que se determinó la conformidad de ésta con la Ley de Protección al ciudadano del exceso de requisitos y trámites administrativos, Ley N° 8220 del 04 de marzo de 2002 y su Reglamento. Por tanto;
