- a)Provide the solid waste collection service in an accessible, periodic, and efficient manner for all users.
- b)The vehicles used for waste collection must be correct for the type of waste they collect and be duly identified. The vehicles must have the following characteristics:
1. For the collection of recoverable materials, non-traditional or bulky waste (residuos no tradicionales o voluminosos), electronic waste, scrap, and metal waste: A non-compacting truck with a covered cargo bed, adequate load capacity for transport needs, sealed to prevent the leakage of solids and liquids onto the public thoroughfare, and comply with other requirements established in current legislation.
2. For non-recoverable waste and hazardous waste (properly separated and packaged): A Compactor Truck with adequate load capacity for transport needs, must guarantee the correct provision of the service and not permit the spillage of liquids and leachates or solid waste, and comply with the provisions of current legislation.
- c)Collection personnel must have, at all times during the execution of their duties, appropriate occupational safety implements such as: gloves, comfortable non-slip shoes, long pants, and have a fire extinguisher and an appropriate first-aid kit available in the vehicle.
- d)Guarantee collection in the area under their responsibility. The frequency of collection is decided by mutual agreement with municipal officials. The collector may be the Municipality or a private company granted a concession; for this, preference will be given to social and charitable organizations that qualify as an organization with business capacity. However, responsibility to the user remains with the Municipality.
- e)If the collector is a private company, it must:
1. Adhere to the municipal segregated collection system if one exists, and this must be stipulated in the contract; comply with vehicle and occupational safety requirements and everything stipulated in this regulation and binding legislation.
2. Be duly registered and authorized by the Ministry of Health (Ministerio de Salud).
3. Every collector without exception, in order to perform these tasks in the canton, must be registered and authorized by the Municipality. The registration will be valid for twelve months, and to renew its status as an authorized collector, it must deliver in writing at least one month in advance the collection agreements with users, a collection service plan, communication lines available for users and the municipality, and a copy certified by a notary public of the destination of the recovered recyclables in the twelve months of prior service, backed by sales invoices.
4. Provide semi-annual reports on the manner of service execution, indicate the weights of the collected materials, the exact address for the treatment or final disposal (disposición final) of the collected waste, and deliver documents certifying the foregoing.
5. Comply with the following requirements: an occupational hazard insurance policy (póliza de riesgos del trabajo), a property or building with a current sanitary operating permit (permiso sanitario de funcionamiento), be licensed (patentado) and up to date with municipal taxes, be up to date with employer-employee obligations with the CCSS.
- f)The private collector will lose authorization to provide the service without legal or economic liability for the Municipality if it: changes its address without reporting it; fails to maintain an efficient communication line with the Municipality and with users; ceases to be up to date with the Ministry of Health, the Municipality, the CCSS, or the INS; three proven and justified complaints are received for incorrect management of collected waste, neglect, or mistreatment of users; if the registered collection truck(s) no longer have the characteristics required for their operation. Should any of the cited faults be committed, a period of six months will be granted to correct the situation and the respective documentation before the Municipality.
- g)Should waste be left scattered on the public thoroughfare at the time of collection, the Municipality or the responsible company must pick it up and deposit it in the collection truck, as well as take any other appropriate means to prevent contamination.
