Amendment to Resolution 010-2019-MINAE on PSAReforma Establece el límite de gasto al Fondo Nacional de Financiamiento

010-2019 MINAE published in Supplement 40 of La Gaceta of Wednesday, the twentieth of February of two thousand nineteen, the National Forest Financing Fund was authorized for the year 2019 regarding the number of hectares to be financed per activity, in the Payment for Environmental Services Program, the amounts to be paid based on the resources allocated in the National Budget and approved by the Comptroller General of the Republic for the aforementioned Fund.

Said spending plan was approved by the Comptroller General of the Republic.

7575, Executive Decree No. 25721-MINAE of the 17th day of October 1996 and its amendments, provides that the Minister of Environment and Energy as Head of the Institution, shall annually issue, by means of a Ministerial Resolution, the activities to be financed in the Payment for Environmental Services (Pago por Servicios Ambientales) Program and the amounts to be paid based on the resources allocated in the National Budget to the National Forest Financing Fund. Therefore, THE MINISTER OF ENVIRONMENT AND ENERGY, HEREBY RESOLVES:

010-2019 MINAE, published in Supplement 40 of La Gaceta of Wednesday, the twentieth of February of two thousand nineteen, in point 2.1, subparagraph g), so that it reads as follows:

• g)The National Forest Financing Fund is instructed to incorporate into the Payment for Environmental Services contracts for the activity of Reforestation and Agroforestry Systems en bloc, the minimum acceptable reference values for making payments.

The minimum reference values (valores de referencia mínimos, VRM) for diameter and total height, required to proceed with the payments for each year, are as follows:

To calculate the total volume, the following equation must be used:

Vtot = Total volume per hectare expressed in cubic meters.

л = (pi) is the ratio of the length of a circumference to its diameter in Euclidean geometry.

DBH = Diameter at 1.3 m height expressed in meters.

Htot = Total height expressed in meters.

Fr = Form factor equal to 0.5.

N = Number of trees per hectare.

*The reference values come from data from permanent sampling plots of companies that reforest contributed by the National Forestry Office (Oficina Nacional Forestal, ONF), data from the plots contributed by Forestry Regents and recorded by FONAFIFO, both data sets validated by Dr. Edgar Ortiz Malavassi, Professor at the Technological Institute of Costa Rica.

• j)Fonafifo may modify, when so requested, those contracts signed before the year 2009, which demonstrate having reached a minimum production of 13 cubic meters of mean annual increment per hectare. For such purposes, Fonafifo may request any information it deems pertinent.

• d)Mixed Systems in Agroforestry for small producers:

The conditions for this modality are: When carrying out forest protection activities, a payment of thirty-five thousand four hundred thirty- five colones (¢35,435) per hectare per year for a period of five years, (here, if necessary, existing fractions of hectares shall be calculated, to the first decimal place). When these are denuded areas or areas in the process of regeneration, a payment of twenty-two thousand seven hundred colones (¢22,700) per year shall be recognized for a period of five years. When carrying out reforestation activities with timber or multi-use species outside the forest cover (cobertura boscosa) area, a payment of two hundred eighty-seven colones per tree (¢287) per year; a minimum quantity of two hundred trees planted or existing trees identified shall be recognized, up to a maximum of one thousand six hundred trees. In this sub-activity, a single contract may be executed that encompasses the different activities, and the term shall be five years counted from the signing of the contract.

• a)The amount to be paid shall be three hundred fifty-four thousand three hundred fifty colones with 00/100 (¢354,350) disbursed in ten annual payments of 10% over a period of ten years. When dealing with applications that are located within zones of hydrological importance, identified by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), the Water Directorate, and Fonafifo, an additional amount of eighty-eight thousand five hundred ninety-two colones (¢88,592) colones per hectare shall be recognized, disbursed in ten annual payments of 10% over a period of ten years.

This additional amount shall be applied until the budget allocated for this activity is exhausted.

Dicho plan de gastos fue aprobado por la Contraloría General de la República.

Por tanto, LA MINISTRA DE AMBIENTE Y ENERGÍA,

• g)Se instruye al Fondo Nacional de Financiamiento Forestal para que incorpore en los contratos de Pago por Servicios Ambientales en la actividad de Reforestación y Sistemas Agroforestales en bloque, los valores de referencia mínimos aceptables para realizar los pagos.

Los valores de referencia mínimos (VRM) para el diámetro y altura total, requeridos para proceder a los pagos de cada año, son los siguientes:

Cuadro 2. Valores de referencia mínimos para el diámetro (DAP) y la altura total (Htot) esperados por año para plantaciones de especies de mediano crecimiento (Tectona grandis, Pinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp, Cedrela odorata, otras).

Para el cálculo del volumen total se debe usar la siguiente ecuación:

Vtot = Volumen total por hectárea expresado en metros cúbicos.

л = (pi) es la relación entre la longitud de una circunferencia y su diámetro en geometría euclidiana.

DAP = Diámetro a la altura de 1,3m expresado en metros.

Htot = Altura total Fr = Factor de forma igual que 0,5.

N = Número de árboles por hectárea.

*Los valores de referencia provienen de datos de parcelas permanentes de muestreo de empresas que reforestan aportados por la Oficina Nacional Forestal (ONF), datos de las parcelas que aportan los Regentes Forestal y registra el FONAFIFO, ambos, set de datos validados por él Dr. Edgar Ortiz Malavassi, Catedrático del Instituto Tecnológico de Costa Rica.

• j)El Fonafifo podrá modificar cuando así se solicite, aquellos contratos suscritos antes del año 2009, que demuestren haber alcanzado una producción mínima de 13 metros cúbicos de incremento medio anual por hectárea. Para tales efectos, el Fonafifo podrá solicitar la información que considere pertinente.

• d)Sistemas Mixtos en Agroforestería para pequeños productores:

Las condiciones para esta modalidad son: Cuando realicen actividades de protección de bosque, un pago de treinta y cinco mil cuatrocientos treinta y cinco colones (¢35.435) por hectárea por año durante un periodo de cinco años, (aquí de ser necesario se calcularán las fracciones de hectáreas existentes, hasta el primer decimal. Cuando sean áreas denudadas o en proceso de regeneración un reconocerá un pago de veintidós mil setecientos colones (¢22.700) por año durante un periodo de cinco años. Cuando realice actividades de reforestación de especies maderables o de uso múltiple fuera del área boscosa un pago de doscientos ochenta y siete colones por árbol (¢287) por año; se reconocerá una cantidad mínima de doscientos árboles plantados o árboles existentes identificados hasta un máximo de mil seiscientos árboles. En esta sub - actividad podrá realizarse un solo contrato que comprenda las diferentes actividades y el plazo será de cinco años contados a partir de la firma del contrato.

• a)El monto a pagar será de trescientos cincuenta y cuatro mil trescientos cincuenta colones con 00/100 (¢354.350) desembolsados en diez pagos anuales de 10% durante un período de diez años. Cuando se trate de solicitudes que se ubiquen dentro de las zonas de importancia hídrica, identificadas por el Instituto Costarricense de Acueductos y Alcantarillados, la Dirección de Aguas y el Fonafifo, se reconocerá un monto adicional de ochenta y ocho mil quinientos noventa y dos colones (¢88.592) colones por hectárea, desembolsados en diez pagos anuales de 10% durante un período de diez años.

Este monto adicional se aplicará hasta agotar el presupuesto asignado en esta actividad.
