in the entirety of the text - Full Text of Norm 41758 Declaration of public utility for the interests of the State of the Administrative Association for the Aqueduct and Sanitary Sewer of Barrio La Unión and Rótulo Rita Pococí Limón Full Text acta: 1737DF No. 41758-MJP (This executive decree was rendered without effect by Article 1 of executive decree No. 44914 of January 15, 2025) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of Articles 140, subsection 18) and 146 of the Political Constitution, Article 32 of the Law of Associations number 218 of August eight, 1939, and Articles 27 and following of the Regulation to the Law of Associations number 294964, published in La Gaceta number 96 of May 21, 2001, as well as the provisions of Article 3, subsection ch) of the Income Tax Law number 7092, and Articles 103 and 104 of the Code of Tax Norms and Procedures number 4755.
I.-That Article 32 of the Law of Associations number 218 of August eight, 1939, and its amendments, grants the Executive Branch the power to declare of public utility simple, federated, or confederated Associations whose development and activities are particularly useful for the interests of the State, and which thereby contribute to solving a social need.
II.-That the Administrative Association of the Aqueduct and Sanitary Sewer of Barrio La Unión and Rótulo Rita Pococí Limón, legal identification number 3-002-373861, was registered in the Associations Registry of the Public Registry at volume 509, entry 10503, as of June 18, 2004.
III.-That the purposes pursued by the Association, according to its bylaws, are: "[...] 1) Administer, operate, maintain, develop, and conserve in good condition the aqueduct in accordance with the provisions and regulations issued in this regard by the Instituto Costarricense de Acueductos y Alcantarillados, which shall be mandatory. 2) Obtain the effective participation of the communities in the construction, operation, maintenance, and development of the aqueduct. 3) Collaboration in educational programs and campaigns undertaken. 4) Assist in explaining and disseminating within the community the provisions and regulations of the Instituto Costarricense de Acueductos y Alcantarillados. 5) Cooperate with the plans, projects, and works undertaken by the Instituto Costarricense de Acueductos y Alcantarillados in the community. 6) Participate in matters relating to the administration, conservation, and rational exploitation of waters; control of their contamination or alteration; definition of the measures and actions necessary for the protection of hydrographic basins and ecological stability. 7) Ensure that all systems and their aqueduct or sanitary sewer installations comply with the basic principles of public service, in terms of quality, quantity, coverage, efficiency, cost rationalization, etc. 8) Provide public services in an efficient, equitable, and timely manner to all its users, without distinctions of any nature. I.-Que el artículo 32 de la Ley de Asociaciones número 218 de ocho de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Barrio La Unión y Rótulo Rita Pococí Limón, cédula de persona jurídica número 3-002-373861, se inscribió en el Registro de Asociaciones del Registro Público al tomo 509 asiento 10503 desde el día 18 de junio de 2004.
III.-Que los fines que persigue la Asociación, según sus estatutos, son: "[...] 1) Administrar, operar, dar mantenimiento, desarrollo y conservar en buenas condiciones el acueducto de conformidad con las disposiciones y reglamentos que al respecto emite el Instituto Costarricense de Acueductos y Alcantarillados que serán de acatamiento obligatorio. 2) Obtener la participación efectiva de las comunidades, en la construcción, operación, mantenimiento y desarrollo del acueducto. 3) Colaboración en los programas y campañas de índole educativa que se emprendan. 4) Ayudar a explicar y divulgar en la comunidad las disposiciones y reglamentos del Instituto Costarricense de Acueductos y Alcantarillados. 5) Cooperar con los planes, proyectos y obras que emprenda el Instituto Costarricense de Acueductos y Alcantarillados en la comunidad. 6) Participar en asuntos relativos a la administración, conservación y explotación racional de las aguas; control de su contaminación o alteración, definición de las medidas y acciones necesarias para la protección de las cuencas hidrográficas y la estabilidad ecológica. 7) Velar por todos los sistemas, sus instalaciones de acueductos o alcantarillado sanitario cumplan los principios básicos del servicio público, tanto en calidad, cantidad, cobertura, eficiencia, racionalización de gastos, etc. 8) Otorgar los servicios públicos, en forma eficiente, igualitaria y oportuna a todos sus usuarios, sin distinciones de ninguna naturaleza.
