in the entirety of the text - Full Text of Norm 0085 Tariff Methodology Reform for the Protection of Water Resources PUBLIC SERVICES REGULATORY AUTHORITY Resolution RE-0085-JD-2019.—Escazú, at eleven hours and fifteen minutes on the twenty-third of April of two thousand nineteen.— Correction of a material error in resolution RE-0213-JD-2018, of 11:30 hours on December 4, 2018.
By agreement 12-20-2019, from the minutes of ordinary session 20-2019, held on April 23, 2019, the Board of Directors of Aresep resolved: to rectify the material error detected in the case file number indicated in the heading of resolution RE-0213-JD-2018, of December 4, 2018. (Case File OT-193-2015).
I.That by resolution RE-0213-JD-2018, of 11:30 hours on December 4, 2018, published in Digital Supplement No. 214 to La Gaceta of December 18, 2018, this Board of Directors established the "Tariff Methodology for the Protection of Water Resources (Metodología tarifaria para la protección del recurso hídrico, MTPRH)".
II.—That by official communication OF-0125-CDR-2019 of March 25, 2019, the General Directorate Center for Regulatory Development (Centro de Desarrollo de la Regulación, CDR), recommended correcting the material error identified in the reference to the case file number under which the "Tariff Methodology for the Protection of Water Resources (MTPRH)" was processed. The following is extracted from that communication:
"The heading of the resolution erroneously recorded the case file number in which all the proceedings for the public hearing where the approval of the 'Tariff Methodology for the Protection of Water Resources (MTPRH)' was processed have been carried out, and since it is a public case file to which all documentation related to that matter is referred, in order not to affect the regulated parties, the appropriate course is to correct the case file number so that instead of OT-193-2018 it reads OT-193-2015.
Likewise, for purposes of updating the case file, it is appropriate to request that the CDR review whether there is documentation related to the case file that has not been incorporated due to this error and to proceed before the Document Management Department with the respective correction procedures." III.—That the General Law of Public Administration, in article 157, provides that, at any time, the Administration may rectify material or factual errors and arithmetic errors.
IV.—That, in accordance with the foregoing, the explanations of what occurred having been offered, the appropriate course is to correct said material error, as is hereby ordered. Therefore:
THE BOARD OF DIRECTORS OF THE PUBLIC SERVICES REGULATORY AUTHORITY, RESOLVES:
I.—To rectify the material error detected in the case file number indicated in the heading of resolution RE-0213-JD-2018, of December 4, 2018, as explained below: The heading recorded case file number OT-193-2018, the correct number being OT-193-2015.
II.—To order the General Directorate Center for Regulatory Development to carry out the procedures before the Document Management Department to incorporate the documents that have not been included in this case file due to the indicated error. Let it be published, notified, and communicated.
Considering:
en la totalidad del texto - Texto Completo Norma 0085 Reforma Metodología tarifaria para la protección del recurso hídrico AUTORIDAD REGULADORA DE LOS SERVICIOS PÚBLICOS Resolución RE-0085-JD-2019.-Escazú, a las once horas y quince minutos del veintitrés de abril de dos mil diecinueve.- Corrección de error material en la resolución RE-0213-JD-2018, de las 11:30 horas del 04 de diciembre del 2018.
Mediante acuerdo 12-20-2019, del acta de la sesión ordinaria 20-2019, celebrada el 23 de abril de 2019, la Junta Directiva de la Aresep resolvió: rectificar el error material detectado en el número del expediente indicado en el encabezado de la resolución RE-0213-JD-2018, del 04 de diciembre de 2018. (Expediente OT-193-2015).
I.Que mediante la resolución RE-0213-JD-2018, de las 11:30 horas del 04 de diciembre del 2018, publicada en el Alcance Digital N° 214 a La Gaceta del 18 de diciembre de 2018, esta Junta Directiva estableció la "Metodología tarifaria para la protección del recurso hídrico (MTPRH)".
II.-Que mediante el OF-0125-CDR-2019 del 25 de marzo del 2019, la Dirección General Centro de Desarrollo de la Regulación (CDR), recomendó corregir el error material identificado en la referencia al número de del recurso hídrico (MTPRH)". De ese oficio se extrae lo siguiente:
"En el encabezado de la resolución se consignó en forma errónea el número de expediente en el que se han llevado a cabo todas las diligencias para la audiencia pública en la cual se tramitó la aprobación de la "Metodología tarifaria para la protección del recurso hídrico (MTPRH)", siendo que es un expediente público al que se remite toda la documentación referente a ese tema, con el fin de no afectar a los administrados, lo que corresponde es corregir el número de en lugar de OT-193-2018 se lea OT-193-2015.
Asimismo, para efectos de actualizar el expediente corresponde solicitar al CDR que revise si existe documentación relacionada al expediente que no haya sido incorporada por este error y proceda a realizar ante el Departamento de Gestión Documental las gestiones de corrección respectivas." III.-Que la Ley General de la Administración Pública, en el numeral 157, dispone que, en cualquier tiempo, podrá la Administración rectificar los errores materiales o de hecho y los aritméticos.
IV.-Que, de conformidad con lo expuesto, habiéndose ofrecido las tal y como se dispone. Por tanto:
LA JUNTA DIRECTIVA DE LA AUTORIDAD REGULADORA DE LOS SERVICIOS PÚBLICOS, RESUELVE:
I.-Rectificar el error material detectado en el número del expediente indicado en el encabezado de la resolución RE-0213-JD-2018, del 04 de diciembre del 2018, según se explica a continuación: En el encabezado se consignó el número de expediente OT-193-2018, siendo lo correcto el número OT-193-2015.
II.-Ordenar a la Dirección General Centro de Desarrollo de la Regulación realizar las gestiones ante el Departamento de Gestión Documental para incorporar los documentos que no se hubieran incluido en este expediente por el error indicado. Publíquese, notifíquese y comuníquese.
