throughout the entire text - Full Text of Norm 41608 Amendment to the Registration of Technical-Grade Active Ingredients Imported into the Country for the Formulation of Chemical Pesticides in National Formulators, under the Active Improvement Regime, Free Zone, or Similar Regimes for Export Purposes No. 41608-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Pursuant to the powers and attributions contained in articles 47, 50, 140, subsections 3) and 18), and 146 respectively of the Political Constitution; articles 25, 27, first paragraph, article 28, subsection 2), subparagraph b) of the General Law of Public Administration, Law No. 6227 of May 2, 1978; articles 2, subsection e), 5, subsection o), 23, 24, and 30 of the Phytosanitary Protection Law, Law No. 7664 of April 8, 1997; articles 1, 30, 6, 10, II, and 13; articles 109 and 110 of the General Customs Law, Law No. 7557 of October 20, 1995, its amendments and modifications; Law Approving the Rotterdam Convention for the Application of the Prior Informed Consent Procedure for Certain Hazardous Pesticides and Chemical Products in International Trade, Law No. 8705 of February 13, 2009; Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal, Law No. 7438 of October 6, 1994; articles 1 and 3 of the Law Approving the Stockholm Convention on Persistent Organic Pollutants, Law No. 8538 of August 23, 2006.

Considering:

7664, of April 8, 1997, establishes in article 23 that all chemical, biological, or related substances and application equipment for agricultural use must be registered in the registry that the State Phytosanitary Service shall create to have information on their characteristics available and to ensure their correct use in the country, according to the requirements to be set forth in the regulation to the Phytosanitary Protection Law.

Likewise, in article 24, it establishes that no natural or juridical person may import, export, manufacture, formulate, store, distribute, transport, repack, refill, advertise, handle, mix, sell, or use chemical, biological, or related substances for agricultural use that are not registered in accordance with Law No. 7664 and its amendments; furthermore, those natural and juridical persons must register in the registry that the State Phytosanitary Service maintains for such purposes, as so ordered by article 25 of the cited Law.

26921-MAG, Regulation to the Phytosanitary Protection Law of March 20, 1998; and complying with the requirements established in article 2, numeral 18.3, of Executive Decree 33495-MAGSMEIC-MINAET, dated October 31, 2006, which maintains the validity of that norm, as provided in Transitory Six of Executive Decree No. 40059-MAGMINAE-S published on January 12, 2017.

Likewise, it is responsible for issuing the final act in the summary or special procedures provided for in the Law or Regulations in matters within its competence.

39461-MAG of November 12, 2015, establishes a special registration scheme different from ordinary registrations, as it deals with an exclusive registration for export products, that is, for products not used in the country; consequently, they do not have an agricultural use; even the requirements and the procedure for evaluating the information and granting the registration differ substantially from that established for products registered and marketed in the country.

8702 of January 14, 2009, the tax rate established in Transitory 1 of Law 7664 was increased from zero point five percent (0.5%) to one point five percent (1.5%); however, this amendment was solely and exclusively limited to increasing the percentage of the tax rate but left unchanged the taxable event for the tribute, which is the definitive importation of chemical products for agricultural use in the country. In the specific case of the temporary entry of Technical-Grade Active Ingredients for formulation purposes and of the formulated products for repacking and refilling that are requested and carried out under Executive Decree No. 39461-MAG of November 12, 2015, these are not for agricultural use purposes; indeed, the agricultural use of these products is prohibited because their entry is authorized exclusively for export purposes.

First, it points out that Decree 39461-MAG does not bear the nature of a technical regulation (therefore, it did not need to be issued as such nor undergo consultation before the ORT), since in reality, it develops what is provided in article 23 of the Phytosanitary Protection Law, Law No. 7664 of April 8, 1997.

39461-MAG of November 12, 2015, is hereby amended to read henceforth as follows:

The Technical-Grade Active Ingredients and the formulated chemical pesticides, exclusively for export, that are temporarily entered into the country for formulation, relabeling, repacking, and refilling, must be exported within a maximum period of one year from the date the product entered the national formulation company.”

Considerando:

Así mismo, en el artículo 24, establece que ninguna persona física o jurídica podrá importar, reenvasar, anunciar, manipular, mezclar, vender ni emplear sustancias químicas, biológicas o afines para uso agrícola, que no estén registradas conforme a la ley número 7664y sus reformas, además esas personas físicas y jurídicas deben registrarse en el registro que para dichos efectos tiene el Servicio Fitosanitaro del Estado, por así disponerlo el artículo 25 de la citada Ley.

Así mismo, es el encargado de dictar el acto final en los procedimientos sumarios o especiales dispuestos en la Ley o Reglamentos en materia de su competencia.

Por tanto,

REFÓRMESE EL ARTICULO 1 DEL DECRETO EJECUTIVO N° 39461-MAG EL 12 DE NOVIEMBRE DEL 2015QUE CREA EL REGISTRO DE INGREDIENTE ACTIVO GRADO TÉCNICOS IMPORTADOS AL PAÍS PARA LA FORMULACIÓN DE PLAGUICIDAS QUÍMICOS EN FORMULADORA NACIONALES, BAJO EL RÉGIMEN DE PERFECCIONAMIENTO ACTIVO (P.A.), ZONA FRANCA (Z.F.) U OTROS REGÍMENES SIMILARES CON FINES EXCLUSIVOS DE EXPORTACIÓN LOS PRODUCTOS FORMULADOS EN DICHOS REGÍMENES

Decretan:

"Artículo 1º-Ámbito de aplicación: Este reglamento aplica a los Ingredientes Activos Grado Técnico que se utilicen en la formulación de plaguicidas químicos formulados tanto en las formuladoras nacionales como en los regímenes de perfeccionamiento activo, zona franca u otros regímenes similares, con fines exclusivos de al amparo de los dispuesto en el artículo 5 de este-1 Decreto Ejecutivo, que sean internados temporalmente, con propósitos de reempaque o reenvase en empresas formuladoras nacionales y su posterior exportación.

Los Ingredientes Activos Grado Técnico y los plaguicidas químicos formulados, exclusivos para exportación que se internen temporalmente al país para formulación, reetiquetado, reempaque y reenvase, deberán ser exportados en un plazo máximo de un año contado a partir de la fecha en que se ingresó el producto a la empresa formuladora nacional."
