The municipalities and district municipal councils must update before March 30 of each year the information contained in the Municipal Plan for Integrated Waste Management, together with a progress report on the fulfillment of said Plan, based on its Action Plan.
Private sector generating entities must update before March 30 of each year the information contained in their integrated waste management programs.
The authorized waste managers (gestores autorizados) must update before March 30 of each year the information contained in their Waste Manager Operation Report (Reporte de Operación de Gestor).
The Compliance Units (Unidades de Cumplimiento) must update before March 30 of each year the information contained in their annual compliance report." "Article 33° - Access to Information. In accordance with the principles of access to information and duty to inform established by Law No. 8839 of June 24, 2010 "Ley para la Gestión Integral de Residuos", the Ministry of Health will prepare an Annual National Report on the state of integrated waste management.
The information of general data on integrated waste management from the SINIGIR platform will be accessible to the general population, respecting confidentiality and restricting access to the data of users registered in the system.
Likewise, the Ministry of Environment and Energy will have access to data and information on waste management contained in the SINIGIR system, especially for the purpose of supplying information to the Sistema Nacional de Información Ambiental (SINIA) and the Registro de Emisiones y Transferencia de Contaminantes (RETC)".
"Article 36° - The municipalities and district municipal councils may request to use funds from the Fund for Integrated Waste Management, indicated in article 24 of Law No. 8839 of June 24, 2010 "Ley para la Gestión Integral de Residuos", for promotion projects for integrated waste management in their communities." "Article 37° - Public institutions must promote the development of integrated waste management in their offices; for this purpose, they may establish a system of recognition for the achievements made." "Article 46° - Authorized Waste Manager (Gestor Autorizado). For the purposes of article 32 of Law No. 8839 of June 24, 2010 "Ley para la Gestión Integral de Residuos", the authorized waste manager (gestor autorizado) is that natural or legal person, public, private, or of mixed economy, dedicated to the total or partial integrated waste management of waste. Within this management are found the stages of collection (recolección), transportation (transporte), storage (acopio), recovery (valorización), disassembly (desensamblaje), "Article 47° - Requirements for the registration of waste managers (gestores). The Waste Manager Registry (Registro de Gestores) is hereby created in the Ministry of Health.
The requirements to register as a waste manager are the following:
a. Have a valid sanitary operating permit (permiso sanitario de funcionamiento) for the corresponding waste management stage, which will be verified during the registration process.
b. Pay the respective amount for registration, established in this regulation.
c. Have the integrated waste management program, in their capacity as waste generator, and a flowchart of their process, which are requirements of the sanitary operating permit.
d. For those applicants for the management of recovery, disassembly, treatment, and final disposal activity, they must indicate the installed capacity for one or more of the requested activities, in their integrated waste management program.
Municipalities that directly provide integrated waste management services are exempt from registering as waste managers." "Article 48° - Procedure for the registration of waste managers. The procedures for the Waste Manager Registry will be carried out through the SINIGIR platform of the Ministry of Health.
To this end, the applicant must register the information contained in Anexo II of this regulation and comply with the requirements indicated in the previous article.
The review procedure for the registration application, as well as the resolution deadlines by the Ministry of Health, are contemplated in the Regulation for the digital processing of registrations and authorizations of the Ministry of Health in integrated waste management on the SINIGIR platform.
The list of authorized waste managers will be available on the Ministry of Health's website: www.ministeriodesalud.go.cr/." "Article 49° - On the payment for registration. In accordance with article 32 of Law No. 8839 of June 24, 2010 "Ley para la Gestión Integral de Residuos", the waste managers will pay for registration for the first time and for each renewal of registration, the following amount:
a. Large Waste Managers: two thousand dollars (US$2000) b. Medium: one thousand dollars (US$1000) c. Small: one hundred dollars (US$100) d. Micro: twenty-five dollars (US$25).
The categorization by size is established in Executive Decree No. 39295-MEIC of June 22, 2015 "Reglamento de la Ley de Fortalecimiento de las Pequeñas y Medianas Empresas, Ley No. 8262 of May 2, 2002".
Micro and small enterprises that are registered as such in the PYMES Registry created in subsection i) of article 3 of Law No. 6054 of June 14, 1977 "Ley Orgánica del Ministerio de Economía, Industria y Comercio" and its amendments will pay an amount of five dollars (US$5)." "Article 50° - Renewal, modification, and cancellation of a Waste Manager registration. The procedures and requirements for the modification of the information registered by the authorized waste manager on the SINIGIR platform are contemplated in the Regulation for the digital processing of registrations and authorizations of the Ministry of Health in integrated waste management on the SINIGIR platform.
The registration certificate as an Authorized Waste Manager must be renewed every five years. The procedure and requirements for the renewal of the registration certificate of an authorized waste manager on the SINIGIR platform are contemplated in the Regulation for the digital processing of registrations and authorizations of the Ministry of Health in integrated waste management on the SINIGIR platform.
The registration of an Authorized Waste Manager may be canceled for the following reasons:
a. Voluntary withdrawal from the activity, for which the waste manager must notify the Ministry of Health in writing.
b. When they do not renew their registration.
c. When they do not have a valid sanitary operating permit.
d. When they fail to comply with the provisions of current regulations, following the corresponding administrative or judicial process." "Article 51° - Waste Manager Operation Report. Authorized waste managers must register an annual operation report (reporte de operación) on the SINIGIR platform, which is mandatory. Failure to comply with this implies a suspension of the registration as a Waste Manager.
The information to be registered in the report is contemplated in the Regulation for the digital processing of registrations and authorizations of the Ministry of Health in integrated waste management on the SINIGIR platform.
Authorized Waste Managers for the operation of a sanitary landfill (relleno sanitario) must register the operational report on the SINIGIR platform semi-annually, in accordance with article 38 of Executive Decree No. 38928-S of November 14, 2014 "Reglamento sobre Rellenos Sanitarios"." "Article 52° - Follow-up and control. In the Annual Operative Plan of the Ministry of Health, the plans and programs for follow-up and control of Authorized Waste Managers will be contemplated, as well as the attention of complaints received about them.
To this end, the Ministry of Health, using the information contained on the SINIGIR platform, will define the nature and frequency of said controls, which must be carried out regularly and on a scheduled basis. This will be done through the inspection of facilities and the control of documentation and information contained on the SINIGIR platform, which may be carried out without prior notice."
