throughout the entire text - Complete Text of Norm 08 Extension of the validity of agreement No. 05-028 "Suspends for a period of one year the granting of water availability and construction permits in the districts of Aserrí Centro and Salitrillos" MUNICIPALITY OF ASERRÍ (Sinalei Note: By means of an agreement published in La Gaceta No. 200 of October 22, 2019, it is agreed to extend the present agreement and suspend for a period of one year from this date, the granting of water availability and construction permits in the districts of Aserrí Centro and Salitrillos") NOTICE Agreement No. 08-087, article three, issued by the Municipal Council of Aserrí in ordinary session No. 087, held on December 27, 2017, is transcribed, which was definitively approved as final and unanimously, and which textually states:

*The initiative dated December 27, 2017, presented by Proprietary Council Members José Alberto Castro Porras and Vera Morales Meza, is acknowledged and read, by means of which they request a decision be taken decreeing an extension of municipal agreement No. 05-028, Article Three, issued by this Council in ordinary session No. 028 of November 07, 2017, which authorized the restriction on the granting of water availability and the granting of water rights (pajas de agua) in the municipal aqueduct. Based on said initiative, the following agreement is taken:

"It is agreed to extend Agreement No. 05-028, article three, of ordinary session No. 028 held on September 07, 2016, and therefore this Council approves the following:

"A) Suspend for a period of one year from this date, the granting of water availability and construction permits in the districts of Aserrí Centro and Salitrillos, as a preventative measure to avoid the collapse of the municipal aqueduct in the provision of drinking water service, except for those reconstruction requests that already have a water right (paja de agua) installed, or expansion, improvements, and remodeling of already existing buildings.

• B)Notwithstanding the urgency faced by families in our canton, who suffer from a vulnerable socioeconomic condition, and who, due to the previous agreement, are having their process halted before the authorized entity, which would allow them to obtain a social welfare housing, acquired through the Housing Voucher (Bono de la Vivienda) with State resources, and consequently it is authorized that from this date, these persons (who process the Voucher individually) be granted the respective water right (paja de agua) and therefore be approved the construction permit; with the fundamental purpose that the validation period of the Housing Voucher does not expire; thereby causing them to have to restart the process, incurring loss of time and expenditure of resources.
• C)In the same manner, said benefit shall be granted to families intending to build with the Housing Voucher, as well as to social welfare families who, without a housing voucher, wish to build because they do not have their own home, provided that the value of the work does not exceed the maximum cap of ¢25,000,000.00, duly ratified as such, by the contribution of the necessary information consisting of the construction plans.
• D)Likewise, the moratorium exempts those requests from persons qualifying under the previous categories B) and C), whose dwelling is supported by an environmentally friendly (ecoamigable) construction design, for which the following elements, not mutually exclusive, will serve as parameters for its evaluation:
• i)Having technological systems that allow families to save on the consumption of basic services such as water, electric energy, solid waste management, ii) That the dwelling they wish to build has low-consumption faucets, toilets, and showers, that uses a treated water reserve tank for reuse, with installation of solar panels, that has its own wastewater treatment plant. When these conditions are demonstrated, the maximum cap on the value of the work permitted to opt for water availability and the construction permit shall be increased by 50%, and it must be proven in the construction plans that the price is less than ¢37,500,000.00. The procedures and fulfillment of the requirement to obtain the authorization established in this section shall be initiated and analyzed in the Department of Urban and Rural Control (Dirección de Control Urbano y Rural), where the responsible official shall render a report with the respective attestations to the Municipal Council for its final approval.
• E)It is agreed to request that the Municipal Administration present to this Council a technical report on the water problem in districts 01 and 07 of the canton of Aserrí."

en la totalidad del texto - Texto Completo Norma 08 Prorroga vigencia del acuerdo N° 05-028 "Suspende por el plazo de un año el otorgamiento de la disponibilidad de agua y permisos constructivos en los distritos de Aserrí Centro y Salitrillos" MUNICIPALIDAD DE ASERRÍ (Nota de Sinalei: Mediante acuerdo publicado en La Gaceta N° 200 del 22 de octubre del 2019 se acuerdo prorrogar el presente acuerdo y suspender por el plazo de un año a partir de esta fecha, el otorgamiento de la disponibilidad de agua y permisos constructivos en los distritos de Aserrrí Centro y Salitrillos") AVISO Se transcribe Acuerdo N° 08-087, artículo tercero, emitido por el Concejo Municipal de Aserrí en la sesión ordinaria N° 087, celebrada el día 27 de diciembre del 2017, el cual fue definitivamente aprobado en firme y por unanimidad, que textualmente dice:

*Se conoce y da lectura a la iniciativa de fecha 27 de diciembre del 2017, presentada por los Regidores Propietarios José Alberto Castro Porras y Vera Morales Meza, por medio de la cual solicitan tomar un acuerdo en el que se decrete una prórroga del acuerdo municipal N° 05-028, Artículo Tercero, emitido por este Concejo en la sesión ordinaria N° 028 del 07 de noviembre del 2017, que autorizó la restricción del otorgamiento de la disponibilidad de agua y la concesión de pajas de agua en el acueducto municipal. Con base en dicha iniciativa se toma el siguiente acuerdo:

"Se acuerda prorrogar el Acuerdo N° 05-028, artículo tercero, de la sesión ordinaria N° 028 celebrada el día 07 de setiembre del 2016 y por tanto este Concejo aprueba lo siguiente:

"A) Suspender por el plazo de un ario a partir de esta fecha, el otorgamiento de la disponibilidad de agua y permisos constructivos en los distritos de Aserrí Centro y Salitrillos, como medida de prevención para evitar el colapso del acueducto municipal en la prestación del servicio de agua potable, excepto en aquellas solicitudes de reconstrucción que ya cuentan con una paja de agua instalada, ampliación, mejoras y remodelación de edificaciones ya existentes.

• B)No obstante ante la urgencia que tienen familias de nuestro cantón, que sufren una condición socioeconómica vulnerable, y que debido al anterior acuerdo se les está paralizando el proceso ante el ente autorizado, que les permitirá obtener una vivienda de bien social, adquirida por medio del Bono de la Vivienda con recursos del Estado, y en consecuencia se autoriza para que a partir de esta fecha, se les otorgue a estas personas, (que tramitan el Bono en forma individual), la respectiva paja de agua y por ende se les apruebe el permiso de construcción; con el propósito fundamental que no expire el plazo de validación que tiene el Bono de la Vivienda; ocasionándoles con esto que de nuevo deban iniciar el trámite, incurriendo en pérdida de tiempo y gastos de recursos.
• C)De igual manera que se otorgue dicho beneficio a las familias que pretendan construir con el Bono de la Vivienda, así como para las familias de bienestar social que sin bono de la vivienda quieran construir por no tener casa propia, siempre que el valor de la obra no sobrepase el tope máximo de ¢25.000.000,00 debidamente ratificadas como tal, por el aporte de la información necesaria que conste de los planos constructivos.
• D)Así mismo, se exceptúa la moratoria aquellas solicitudes de personas que califiquen en las categorías B) y C) anteriores, cuya vivienda este respaldada en un diseño constructivo ecoamigable, para lo cual serán parámetros para su valoración los siguientes elementos, no excluyentes entre sí:
• i)Contar con sistemas tecnológicos que permitan a las familias abonar en el consumo de servicios básicos como agua, energía eléctrica, manejo de residuos sólidos, ii) Que la vivienda que desea construir cuente con griferías, inodoros y duchas de bajo consumo, que utilice un tanque de reserva de agua tratada para su reutilización, con instalación de paneles solares, que cuente con su propia planta de tratamiento de aguas residuales. Cuando se demuestren estas condiciones el tope máximo del valor de la obra permitido para optar por la disponibilidad de agua y el permiso de construcción, se incrementará en un 50%, debiendo acreditarse en los planos constructivos que el precio es de menos de 37.500.000,00. Los trámites y el cumplimiento de requisito para obtener la autorización establecida en este acápite se iniciarán y analizaran en la Dirección de Control Urbano y Rural, donde el funcionario responsable rendirá un informe con los atestados respectivos al Concejo Municipal para su aprobación definitiva.
• E)Se acuerda solicitarle a la Administración Municipal presentarle a este Concejo un informe técnico sobre la problemática del agua en los distritos 01 y 07 del cantón de Aserrí."
