Creation of Canton XVI Río Cuarto of the Province of Alajuela No. 9440 THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF COSTA RICA, DECREES:
CREATION OF CANTON XVI RÍO CUARTO, OF THE PROVINCE OF ALAJUELA
Canton XVI, of the province of Alajuela, is created, with the name of Río Cuarto, resulting from the segregation of the district of Río Cuarto, sixth district of the canton of Grecia.

The National Commission of Administrative Territorial Division (Comisión Nacional de División Territorial Administrativa) shall advise the Executive Branch for the creation of the districts of the new canton. Said Commission shall determine the technical criteria that must be applied for these purposes.
Once compliance with those technical requirements is certified, the Executive Branch shall agree, by means of executive decree, upon the creation of the districts of the canton, indicating, for such purposes, its head city, the towns that form them, and their detailed boundaries.
These boundaries must follow natural terrain features, preferably rivers, streams (quebradas), roads, watershed divides, etc.
The territory of each district must have a minimum population of ten percent (10%) of the total population of the respective canton, provided it is not less than two thousand inhabitants.
The Supreme Electoral Tribunal (Tribunal Supremo de Elecciones, TSE) shall convene all registered electors in the canton of Río Cuarto, in accordance with the electoral roll as of the month prior to the entry into force of this law, to a plebiscite to decide, from among the head cities of its districts, which will be the head city of the canton. This consultation must be carried out within the three months following the entry into force of this law and shall be organized and financed by the Supreme Electoral Tribunal, for which purpose the National Budget Directorate (Dirección de Presupuesto Nacional) shall include, in the corresponding budget line item, the resources necessary for that purpose, in accordance with what the Tribunal indicates.

To the east: with the canton of Sarapiquí.
To the west: with the canton of San Carlos.
To the north: with the canton of San Carlos.

West: at the point with coordinates north latitude: 249,253 (1,134,641.53), east longitude: 507,171 (470,870.83), southwestern part of the district of Río Cuarto that passes through the Pilas stream (quebrada Pilas); this point adjoins district 21203 Toro Amarillo, of the canton of Valverde Vega of Alajuela. From this coordinate point, continuing downstream along the Toro River, until reaching the coordinate of north latitude: 266,667 (1,152,054.70), east longitude: 507,682 (471,399.81), on the Toro River, maximum western extent of the district of Río Cuarto, which adjoins districts 21005 Venecia and 21006 Pital, of the canton of San Carlos of Alajuela.
North: following the same geographic feature of the Toro River, up to the point with coordinates north latitude: 284,242 (1,169,617.45), east longitude: 517,456 (481,191.24), its maximum point in the northern zone, on this same river, and which adjoins district 21006 Pital, of the canton of San Carlos, province of Alajuela.
East: in the eastern zone corresponds to an imaginary azimuth line that starts at coordinates north latitude: 284,013 (1,169,388.00), east longitude: 518,629 (482,363.96), on the Toro River, which adjoins districts 21006 Pital of San Carlos, province of Alajuela, and district 41005 Cureña, of the canton of Sarapiquí, province of Heredia, and district 41002 La Virgen, of the canton of Sarapiquí, province of Heredia; heading due south, until reaching the coordinate point of north latitude: 266,106 (1,151,482.15), east longitude: 518,662 (482,377.90), on the Sardinal River, adjoining district 41002 La Virgen, of the canton of Sarapiquí, province of Heredia.

It shall be effective upon its publication.

--- Transitory Provision II- The Municipality of Grecia shall continue to administer the local interests and services of the territory of the canton of Río Cuarto, as well as collecting municipal taxes and carrying out budget management, until its respective municipal authorities assume office on May 1, 2020.
(Thus added by Article 4 of Law No. 9634 of December 11, 2018) --- Transitory Provision III- The Municipality of Grecia is authorized to transfer to the Municipality of the canton of Río Cuarto the economic resources that have been generated from the collection of municipal or national taxes collected by the Local Government of Grecia, within the territory of the new canton up to April 30, 2020, and that have not been executed by May 1, 2020. The same procedure shall apply to the specific line items that are allocated to organizations or projects of the canton of Río Cuarto.

Creación del Cantón XVI Río Cuarto de la provincia de Alajuela N° 9440 LA ASAMBLEA LEGISLATIVA DE LA REPÚBLICA DE COSTA RICA, DECRETA:
CREACIÓN DEL CANTÓN XVI RÍO CUARTO, DE LA PROVINCIA DE ALAJUELA
Se crea el cantón XVI, de la provincia de Alajuela, con el nombre de Río Cuarto, resultante de la segregación del distrito de Río Cuarto, sexto del cantón de Grecia.
La Comisión Nacional de División Territorial Administrativa asesorará al Poder Ejecutivo para la creación de los distritos del nuevo cantón. Dicha Comisión determinará los criterios técnicos que deberán aplicarse para estos efectos.
Una vez que se acredite el cumplimiento de esos requerimientos técnicos, el Poder Ejecutivo acordará, mediante decreto ejecutivo, la creación de los distritos del cantón, indicando, para tales efectos, su cabecera, los poblados que los forman y sus límites detallados.
Esos límites deberán seguir accidentes naturales del terreno, preferentemente, ríos, quebradas, caminos, divisorias de aguas, etc.
El territorio de cada distrito deberá tener una población mínima del diez por ciento (10%) de la población total del respectivo cantón, siempre que no sea menor de dos mil habitantes.
El Tribunal Supremo de Elecciones (TSE) convocará a todos los electores inscritos en el cantón de Río Cuarto, de acuerdo con el padrón con corte al mes anterior a la entrada en vigencia de la presente ley, a un plebiscito para decidir, de entre las cabeceras de sus distritos, cuál será la cabecera del cantón. Dicha consulta deberá realizarse dentro de los tres meses siguientes a la entrada en vigencia de esta ley y será organizada y financiada por el Tribunal Supremo de Elecciones, para lo cual la Dirección de Presupuesto Nacional incluirá, en la partida presupuestaria que corresponda, los recursos que sean necesarios para tal fin, de conformidad con lo que indique el Tribunal.

El cantón colinda con lo siguiente:
Al este: con el cantón de Sarapiquí.
Al oeste: con el cantón de San Carlos.
Al norte: con el cantón de San Carlos.

Con fundamento en las hojas topográficas editadas por el Instituto Geográfico Nacional, en su segunda edición, a escala 1:50 000 3346-1 Poás 3346-1V Quesada 3347-1 Chaparrón 3347-II Río Cuarto 3347-111 Aguas Zarcas Este cantón tendrá la siguiente descripción de límites, de acuerdo con las coordenadas en el sistema de Proyección Lambert Norte para Costa Rica y la proyección CRTM05, entre paréntesis.
Oeste: en el punto con coordenadas latitud norte: 249 253 (1 134 641,53), longitud este: 507 171 (470 870,83), parte suroeste del distrito de Río Cuarto que pasa por la quebrada Pilas, este punto colinda con el distrito de 21203 Toro Amarillo, del cantón de Valverde Vega de Alajuela. Desde este punto en coordenadas, continuando aguas abajo por el río Toro, hasta llegar a la coordenada de latitud norte: 266 667 (1 152 054,70), longitud este: 507 682 (471 399,81), sobre río Toro extremo máximo del lado oeste del distrito de Río Cuarto, que colinda con los distritos de 21005 Venecia y 21006 Pital, del cantón de San Carlos de Alajuela.
Norte: siguiendo el mismo elemento geográfico del río Toro, hasta subir en el punto con coordenadas latitud norte: 284 242 (1 169 617,45), longitud este: 517 456 (481 191,24), su punto máximo en la zona norte, sobre este mismo río y que colinda con el distrito 21006 de Pital, del cantón de San Carlos, provincia de Alajuela.
Este: en la zona este corresponde a una línea de azimut imaginaria que tiene por inicio en las coordenadas latitud norte: 284 013 (1 169 388,00), longitud este: 518 629 (482 363,96), sobre el río Toro, que colinda con los distritos 21006 Pital de San Carlos, provincia de Alajuela y el distrito 41005 Cureña, del cantón de Sarapiquí, provincia de Heredia y el distrito 41002 La Virgen, del cantón de Sarapiquí, provincia de Heredia; con rumbo sur franco, hasta llegar al punto en coordenadas de latitud norte: 266 106 (1 151 482,15), longitud este: 518 662 (482 377,90), sobre el río Sardinal, colindante con el distrito 41002 La Virgen, del cantón de Sarapiquí, provincia de Heredia.
Sur: siguiendo desde el último punto en coordenadas latitud norte: 266 106 (1 151 482,15), longitud este: 518 662 (482 377,90), de la línea de azimut en la zona este del distrito, se continúa aguas arriba por el río Sardinal hasta llegar al punto en coordenadas de latitud norte: 252 056 (1 137 437,93), longitud este: 513 805 (477 506,97), sobre el puente, a doscientos cincuenta metros (250 m) al oeste de la escuela o colegio, de este último punto, se continúa sobre la carretera, que va en dirección sureste, hasta llegar al puente que pasa sobre el río María Aguilar, en las coordenadas de latitud norte: 251 679 (1 137 060,14), longitud este: 514 436 (478 137,49), aproximadamente a novecientos cincuenta metros (950 m) de la escuela o colegio. De este punto en coordenadas se continúa, aguas arriba sobre el río María Aguilar, hasta llegar a las coordenadas - latitud norte: 247 121 (1 132 507,20), longitud este: 509 788 (473 485,42), su punto máximo al sur, sobre la quebrada Gata colindante con los distritos de 21203 Toro Amarillo, del cantón de Valverde Vega, provincia de Alajuela y del distrito 20114 Sarapiquí, del cantón Alajuela, provincia de Alajuela. Sobre esta coordenada se continúa aguas abajo por la quebrada Gata hasta culminar en la coordenada de latitud norte: 249 253 (1 134 641,53), longitud este: 507 171 (470 870,83), que es el punto de inicio de la presente descripción de límites.
La Contraloría General de la República deberá brindar al nuevo cantón, en coordinación con Mideplán y el IFAM, cada una en el ámbito de sus competencias, el asesoramiento necesario para facilitar la transición presupuestaria correspondiente.
