1.1. Activities to be financed:

For the year 2017, two modalities will be considered for financing: a-Recovery of Forest Cover, which includes the activities of Reforestation, Regeneration, and Agroforestry Systems, and b-Maintenance of Forest Cover, which includes Protection and Forest Management. To this end, the following distribution is established:

The National Forest Financing Fund may vary the distribution established in the previous table, according to the supply, based on the requests received for each of the activities, provided they do not exceed the approved budget for the Payment for Environmental Services Program.

If a greater allocation of resources is available, according to Article 5 of the Tax Simplification and Efficiency Law No. 8114 published in La Gaceta No. 131, of July 9, 2001, and other financial resources that Fonafifo obtains for the Payment for Environmental Services, they will be distributed according to the criteria of the financiers and Fonafifo. In any case, the resources used for these purposes must be incorporated into the institutional budget and be approved by the Comptroller General of the Republic.

1.2. Of the payment amounts per activity and other conditions:

1.2.1. Reforestation Activity: The conditions that will govern the processing of requests, for the recognition of environmental services in the Reforestation activity, are the following:

• a)The amount to be paid for fast-growing species referred to as: *Gmelina arborea*, *Acacia mangium*, *Vochysia guatemalensis*, and *Vochysia hondurensis*, will be six hundred forty-three thousand one hundred seven colones with 00/100 (¢643,107) per hectare, disbursed over a five-year period. The payments will be distributed in the following manner: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.
• b)The amount to be paid for medium-growing species referred to as: *Tectona grandis*, *Pinus* sp, *Cordia alliodora*, *Vochysia ferruginea*, *Eucalyptus* sp, and *Cedrela odorata*, will be seven hundred fifty-seven thousand six hundred thirty-four colones with 00/100 (¢757,634) per hectare, disbursed over a five-year period. The payments will be distributed in the following manner: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.
• c)The amount to be paid for native species contained in Executive Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, will be one million one hundred thirty-six thousand four hundred fifty-one colones (¢1,136,451) per hectare, disbursed over a five-year period. The payments will be distributed in the following manner: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.
• d)The National Forest Financing Fund is instructed to incorporate into the Payment for Environmental Services contracts in the Reforestation and block Agroforestry Systems activity, the minimum acceptable values for making the payments.

The National Forest Financing Fund will use the following reference values to process the payments corresponding to each year:

*The volume increment reference values correspond to the growth model reported by Gompertz (reference from Dr. Edgar Ortiz Malavassi, Professor at the Technological Institute of Costa Rica, 2015).

• e)The State, through Fonafifo, will acquire the environmental services produced by forest plantations, understood as set forth in subsection k of Article 3 of the Forest Law No. 7575.
• f)Specifically, the environmental services in plantations and blocks in agroforestry systems will be paid according to the annual growth of biomass in accordance with parameters established in this resolution. Said payments correspond to the total years of the agreed term; however, in order to allow the establishment of the plantation and its maintenance, payment will be advanced during the first five years.
• g)Fonafifo may modify, when so requested, those contracts signed before the year 2006, that demonstrate having achieved a minimum production of 13 cubic meters of annual volume per hectare. For such purposes, Fonafifo may request the information it deems pertinent.
• h)Fonafifo, to verify the data presented in all cases, will require the submission of data from the individual measurements of the trees included in the measurement plots that for such purposes must be established in the reforestation projects.
• i)The National System of Conservation Areas must establish a plan for the promotion of forest plantations so that the six thousand two hundred hectares of reforestation, included in this resolution, are distributed in the following manner: Brunca Region 375 hectares, Central Region 160 hectares, Chorotega Region 2,755 hectares, Huetar Atlántica Region 504 hectares, Huetar Norte Region 1,779, and Central Pacific Region 908 hectares. If the goal is achieved in any Region, Fonafifo may allocate the resources to other regions.

(*)1.2.1.A. Sub-activity called Forest Plantations with Short Rotation Periods (PFTRR). The conditions that will govern the processing of requests, for the recognition of environmental services in the activity of Forest Plantations with short rotation periods, will be the following:

• a)Of the payment amounts per activity and other conditions:

For the year 2017, the sub-activity of Forest Plantations with Short Rotation Periods (PFTRR) will be included within the Recovery of Forest Cover modality, up to a maximum quantity of 2,000 hectares, which are part of the 6,210 hectares planned for the reforestation activity in 2017 with fast-growing species.

• b)The amount to be paid for Forest Plantations with Short Rotation Periods (PFTRR), will be three hundred sixty-one thousand five hundred thirty- one colones 00/100 (361,531 colones with 00/100) per hectare. The payments will be distributed in the following manner: 50% the first year, 25% the second year, and 25% the fourth year.
• c)The National Forest Financing Fund will use the following minimums to process the payments corresponding to each year:

Minimum values for the diameter (DBH cm) and total height (m), expected per year for Forest Plantations with Short Rotation Periods (PFTRR) for the species *Gmelina arborea* and species of the fast-growing group:

* DBH, minimum reference diameter at breast height in centimeters ** Ht, minimum reference total height in meters For plantations for Dendroenergy production, densities may vary between 2,000 trees/ ha and 5,000 trees/ha; likewise, the final harvest may not be carried out before six years.

(*) (Point 1.2.1.A) above thus added by Article 1 of Resolution No. R-016 of August 31, 2017) 1.2.2. Natural Regeneration Activity: The conditions that will govern the processing of requests, for the recognition of environmental services in the Natural Regeneration activity, are detailed below.

• a)The amount to be paid in Natural Regeneration will be one hundred nine thousand one hundred six colones with 00/100 (¢109,106) per hectare, disbursed in five annual payments of 20% over a five-year period.

1.2.3. Agroforestry Systems Activity: The conditions that will govern the processing of requests, for the recognition of environmental services in the Agroforestry Systems activity, are detailed below.

• a)The amount to be paid will be nine hundred thirty-one colones with 00/100 (¢931) per tree integrated into Agroforestry Systems and disbursed over a five-year period. The payments will be distributed in the following manner: 50% the first year, 25% the third year, and 25% the fifth year.
• b)The amount to be paid will be one thousand three hundred seventy-nine colones with 00/100 (¢1,379) per tree, integrated into Agroforestry Systems, strictly with native species contained in Executive Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, disbursed over a five-year period. The payments will be distributed in the following manner: 50% the first year, 25% the third year, and 25% the fifth year.
• c)The amount to be paid will be one thousand three hundred seventy-nine colones with 00/100 (¢1,379) per tree under the activity of Agroforestry Systems established in Forest Harvest Plantations (PPAF), financed through forest credit. The payments will be distributed in the following manner: 80% upon signing the contract, once the trees have reached 36 months of age, and the remaining 20% in the fifth year of the project when the trees have reached 60 months of age.

1.2.4. Forest Protection Activity: The conditions that will govern the processing of requests, for the recognition of environmental services in the Forest Protection activity, are detailed below:

• a)The amount to be paid will be one hundred seventy thousand three hundred twelve colones with 00/100 (¢170,312) disbursed in five annual payments of 20% over a five-year period. In the case of requests located within areas of water importance, identified by the Costa Rican Institute of Aqueducts and Sewers, the Water Directorate, and Fonafifo, an additional amount of forty-two thousand five hundred seventy-nine colones with 00/100 (¢42,579) will be recognized, making the total amount to be paid per hectare two hundred twelve thousand eight hundred ninety-one colones (¢212,891) disbursed in five annual payments of 20% over a five-year period. This additional amount will be applied until the budget allocated for this activity is exhausted.

1.2.5. Forest Management Activity. The conditions that will govern the processing of requests for the recognition of environmental services in the Forest Management activity are detailed below:

• a)The amount to be paid will be one hundred thirty-three thousand fifty-seven colones with 00/100 (¢133,057) per hectare, disbursed in five annual payments of 20% over a five-year period.

1.3. Updating of payment amounts:

The amounts established per activity within the Payment for Environmental Services Program will be updated annually using the Consumer Price Index (CPI), calculated by the National Institute of Statistics and Census (INEC), at the close of the previous year's period.

2.1. Of the validity periods of the contracts:

The validity periods of the Payment for Environmental Services contracts, generated by the activities corresponding to the modalities of recovery and/or maintenance of forest cover, will be the following:

• a)Contracts corresponding to the Reforestation activity through the establishment of fast-growing species will have a validity of ten years from their signing. Those incorporating medium-growing species and native species contained in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, their validity will be sixteen years from their signing, and for those that incorporate several forest species with different harvest rotation periods, the validity of the contract will be equal to that of the species with the longest harvest rotation period, which must not exceed sixteen years, in which case this would be the maximum validity period.
• b)Contracts corresponding to the activity of establishing trees in Agroforestry Systems will have a validity of five years from their signing. Contracts corresponding to the Systems program under the activity of Agroforestry Systems established in Forest Harvest Plantations (PPAF) will have the same validity; however, given that they are already planted, they will be recognized retroactively for three years for their prior establishment.
• c)Contracts corresponding to the Forest Protection activity will have a validity of five years from their signing.
• d)Contracts corresponding to the Natural Regeneration activity will have a validity of five years from their signing.
• e)Contracts corresponding to the Forest Management activity will have a validity of five years from their signing. Prior to signing the contract, the file must contain certification that the management plan was approved, according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decree No. 27388-MINAE published on November 2, 1998, and Executive Decree No. 34559-MINAE published in La Gaceta No. 115, of June 16, 2008.
• f)Contracts corresponding to the sub-activity of Forest Plantations with Short Rotation Periods (PFTRR) will have a validity of six years.

Conditions established for the amounts and activities of the PSA requests:

3.1. The National Forest Financing Fund is empowered to establish activities and amounts different from those indicated in this resolution, in accordance with agreements, covenants, contracts, or specific projects with entities that provide financial resources to the Payment for Environmental Services Program, recognizing amounts and conditions different from those established for the various environmental services; for these projects, the prioritization criteria detailed above will not apply, but rather those agreed upon in each covenant. Payments will be made provided there is budgetary availability to cover the commitments acquired through the Payment for Environmental Services Program.

3.2. The amounts pending payment for contracts from previous years will be governed by the provisions set forth in the respective Executive Decrees for each year.

3.3. To cover the cost of registering the contract with the National Registry, the National Forest Financing Fund will withhold 0.6% from the first disbursement of the total contract amount.

3.4. The resources corresponding to the payment for environmental services not used by Fonafifo and the resources recovered due to non-compliance with payment for environmental services contracts, or those corresponding to prescribed payments, will be deposited into an account established for this purpose by the National Forest Financing Fund and will be budgeted for the execution of new promotion activities; such as forest credits.

3.5. The beneficiary of each contract must have, throughout the entire term of the contract, a forest regent duly registered with the College of Agronomists. Except in those cases where it has been determined that the project will be supervised directly by the National Forest Financing Fund. Without prejudice to other provisions, the beneficiary or beneficiaries must provide an annual certification, or an annual regency report issued by a forest regent for the payment process.

Additionally, for fast-growing Reforestation contracts, the beneficiary must submit visit reports certifying the status of the projects in years 8 and 10 from their planting date; for medium-growing and other species projects, they must submit such reports in year 8, 12, and 16 from their planting date.

3.6. Without prejudice to other actions that represent non-compliance with the contract obligations, for fast-growing Reforestation contracts or blocks, from 12 months onward, and for medium-growing plantations or blocks, from 24 months after the plantation is established, the contract is considered breached if the plantation does not present the minimum growth established in subsection d of point 1.2.1 of this resolution, or that previously indicated in the respective technical study for other species. As a consequence of this non-compliance, the producer will not receive the payment corresponding to that year, and the National Forest Financing Fund must suspend the respective payments and terminate the contract with liability for the beneficiary, after due process has been followed.

3.7. Grounds for exemption from liability for breach of contract shall be fortuitous events, force majeure, and the act of a third party as general exemptions. Similarly, action will be taken when the plantation owner demonstrates that a pest or disease affected the plantation and that the actions taken in a timely manner failed to eradicate it. The same procedure will apply when the damage is the result of a fire that could not be controlled despite reported preventive measures.

3.8. Projects may not be executed on farms that have been subject to pests, diseases, or fires and where, for such causes, the contract was terminated with liability; in such a case, the farm may not be subject to contracts for Reforestation and/or SAF for a period of 3 years from the last contract finalized for this cause.

3.9. Fonafifo will be responsible for monitoring the forest plantations that enter the Program, and must not only conduct follow-up at the regional level, but also implement a control protocol, through a random visitation mechanism according to its technical and administrative capacity. Similarly, it must safeguard the information from the permanent measurement plots of the plantations, in order to support the payments and back the carbon fixation and other greenhouse gas determinations.

3.10. In the event that the submitted requests are found to have overlaps or displacement among them and/or with other farms, Fonafifo will assess the approval or rejection of the entry requests according to technical and legal criteria.

3.11. In the case of entry requests submitted for the protection activity that include several farms, the qualification will depend on the largest farm included in the request.

3.12. In the case of entry requests for Reforestation and Agroforestry Systems that involve mixtures of fast-growing, medium-growing, and/or endangered species, the contract value will depend on the lowest amount established for these types of species.

3.13. The arrangements of Agroforestry Systems that involve multiple-use and timber species must be carried out with at least 20% of the trees being timber species.

3.14. To cover the cost of registering the contract with the National Registry, the National Forest Financing Fund will withhold 0.6% from the first disbursement of the total contract amount for Forest Plantations with Short Rotation Periods (PFTRR).

The beneficiary of the PFTRR project must have, throughout the entire contract period, a forest regent duly registered with the College of Agronomists, who must report, prior to each payment, the status of the plantation and its growth in diameter and height.

Prior to each payment for each PFTRR project, a certification from a forest regent is required, detailing the status of the plantation and confirming that the minimum conditions indicated in Article 1 of this resolution and those established in the Procedure Manual for the Payment of Environmental Services 2009 and its amendments are met.

Fonafifo, to verify the data presented, will in all cases require the submission of data from the individual measurements of the trees included in the measurement plots, which for these purposes must be established in the forest plantation projects.

1.1.Actividades a financiar:

Para el año 20·11, se considerarán dos modalidades a financiar a-Recuperación de la Cobertura Forestal, que incluye las actividades de Reforestación, Regeneración y Sistemas Agroforestales y b-Mantenimiento de la Cobertura Forestal, que incluye Protección y Manejo de Bosque. Para tal fin, se establece la siguiente distribución:

De disponer de una mayor asignación de recursos, según el artículo 5 de la Ley de Simplificación y Eficiencia Tributarias N°8114 publicada en La Gaceta N° 131, del día 9 de julio de 2001 y otros recursos financieros que capte el Fonafifo para el Pago por Servicios Ambientales, se distribuirán según el criterio de los financiadores y del Fonafifo. En todo caso, los recursos utilizados para estos fines, deberán ser incorporados en el presupuesto institucional y ser aprobados por la Contraloría General de la República.

1.2.De los montos de pago por actividad y otras condiciones:

1.2.1. Actividad de Reforestación: Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Reforestación, son las siguientes:

• a)El monto a pagar para las especies de rápido crecimiento referidas a: Gmelina arbórea, Acacia mangium, Vochysia guatemalensis y Vochysia hondurensis, será de seiscientos cuarenta y tres mil ciento siete colones con 00/100 (¢643.107) por hectárea, desembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y 5% el quinto año.
• b)El monto a pagar para las especies de mediano crecimiento referidas a: Tectona grandis, Pinus sp, Cordia alliodora, Vochysia ferruginea, WEucalyptus sp y Cedrela odorata, será de setecientos cincuenta y siete mil seiscientos treinta y cuatro colones con 00/100 (¢757.634) por hectárea, desembolsados durante un período de cinco años.

Los pagos serán distribuidos de la siguiente forma: 50010 el primer año, 20% el segundo año, 15% el tercer año. 10% el cuarto año y 5% el quinto año.

• c)El monto a pagar para especies nativas contenidas en los Decretos Ejecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, será de un millón ciento treinta y seis mil cuatrocientos cincuenta y un colones (¢1.136.451) por hectárea, desembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y 5% el quinto año.
• d)Se instruye al Fondo Nacional de Financiamiento Forestal para que incorpore en los contratos de Pago por Servicios Ambientales en la actividad de Reforestación y Sistemas Agroforestales en bloque, los valores mínimos aceptables para realizar los pagos.

El Fondo Nacional de Financiamiento Forestal utilizará los siguientes valores de referencia para tramitar los pagos correspondientes a cada año:

Cuadro 2. Incremento medio anual volumétrico (en m3/hectárea) mínimo esperado por año para plantaciones de especies de mediano crecimiento (Tectona grandis, Pinus sp, Cordia alliodora. Vochysia, ferruginea. Eucalvptus sp. Cedrela oclorata. otras).

*Los valores de referencia del incremento volumétrico corresponden al modelo de crecimiento reportado por Gompertz (referencia del Dr. Edgar Ortiz Malavassi, Catedrático del Instituto Tecnológico de Costa Rica, 2015).

• e)El Estado a través del Fonafifo, adquirirá los servicios ambientales que produzcan las plantaciones forestales, entendidos éstos según dispone el inciso k del artículo 3 de la Ley Forestal N°7575.
• f)Específicamente, los servicios ambientales en plantaciones y bloques en sistemas agroforestales se pagarán según el crecimiento anual de la biomasa de acuerdo con parámetros establecidos en esta resolución. Dichos pagos corresponden al total de años del plazo convenido; no obstante, a fin de permitir el establecimiento de la plantación y su mantenimiento, se adelantará durante los primeros cinco años.
• g)El Fonafifo podrá modificar cuando así se solicite, aquellos contratos suscritos antes del año 2006, que demuestren haber alcanzado una producción mínima de 13 metros cúbicos de volumen anual por hectárea. Para tales efectos, el Fonafifo podrá solicitar la información que considere pertinente.
• h)El Fonafifo para constatar los datos presentados en todos los casos requerirá la presentación de los datos de las mediciones individuales de los árboles incluidos en las parcelas de medición que para sus efectos se tienen que establecer en los proyectos de reforestación.
• i)El Sistema Nacional de Áreas de Conservación, deberá establecer un plan para el fomento de las plantaciones forestales de manera que las seis mil doscientas hectáreas de reforestación, incluidas en la presente resolución se distribuyan de la siguiente manera: Región Brunca 375 hectáreas, Región Central 160 hectáreas. Región Chorotega 2755 hectáreas, Región Huetar Atlántica 504 hectáreas. Región Huetar Norte 1 779 y Región Pacífico Central 908 hectáreas. De conseguirse la meta en alguna Región, el Fonafifo podrá destinar los recursos a otras regiones.

(*)1.2.1.A. Sub-actividad denominada Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR). Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Plantaciones Forestales con turnos de rotación reducidos serán las siguientes:

• a)De los montos de pago por actividad y otras condiciones:

Para el año 2017, se incluirá dentro de la modalidad de Recuperación de la Cobertura Forestal, la subactividad de Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), hasta por una cantidad máxima de 2,000 hectáreas, las cuales son parte de las 6,210 hectáreas previstas para la actividad de reforestación en 2017 con especies de rápido crecimiento.

• b)El monto a pagar para las Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), será de trecientos sesenta y un mil quinientos treinta y un colones 00/100 (361.531 colones con 00/100) por hectárea. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 25% el segundo año y 25% el cuarto año.
• c)El Fondo Nacional de Financiamiento Forestal utilizará los siguientes mínimos para tramitar los pagos correspondientes a cada año:

Valores de mínimos para el diámetro (DAP cm) y la altura total (m), esperada por año para las Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR) para la especie Gmelina Arborea y especies del grupo de rápido crecimiento:

* DAP, diámetro a la altura de pecho mínima de referencia en centímetros ** Alt, Altura total mínima de referencia en metros Para las plantaciones para producción de Dendroenergía, las densidades pueden variar 2000 árboles/ ha, y 5000 árboles/ha, igualmente la cosecha final no podrá realizarse antes de los seis años.

(*) (Así adicionado el punto 1.2.1.A) anterior por el artículo 1° de la resolución N° R-016 del 31 de agosto de 2017) 1.2.2. Actividad de Regeneración Natural: Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Regeneración Natural, se detallan a continuación.

• a)El monto a pagar en Regeneración Natural. será de ciento nueve mil ciento seis colones con 00/1 00 (¢109.106) por hectárea, desembolsados en cinco pagos anuales de 20% durante un período de cinco años.

1.2.3. Actividad de Sistemas Agroforestales: Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Sistemas Agroforestales, se detallan a continuación.

• a)El monto a pagar será de novecientos treinta y un colones con 00/100 (¢931)) por árbol. integrados a Sistemas Agroforestales y desembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año. 25% el tercero año y 25% el año quinto.
• b)El monto a pagar será de mil trescientos setenta y nueve colones con 00/100 (¢1.379) por árbol, integrados a Sistemas Agroforestales, estrictamente con especies nativas contenidas en los Decretos Ejecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, desembolsados durante un período de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año. 25% el tercer año y 25% el año quinto.
• c)El monto a pagar será de mil trescientos setenta y nueve colones con 00/100 (¢1.379) por árbol bajo la actividad de Sistemas Agroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF), financiados mediante el crédito forestal. Los pagos serán distribuidos de la siguiente forma: 80% a la firma del contrato, una vez que los árboles hayan alcanzado los 36 meses de edad y 200/0 restante en el año quinto del proyecto cuando los árboles hayan alcanzado los 60 meses de edad.

1.2.4. Actividad de Protección de Bosque: Las condiciones que regirán para el trámite de solicitudes, para el reconocimiento de los servicios ambientales en la actividad de Protección de Bosque. se detallan a continuación:

• a)El monto a pagar será de ciento setenta mil trescientos doce colones con 00/100 (¢170.312) desembolsados en cinco pagos anuales de 20% durante un período de cinco años. Cuando se trate de solicitudes que se ubiquen dentro de las zonas de importancia hídrica, identificadas por el Instituto Costarricense de Acueductos y Alcantarillados, la Dirección de Aguas y el Fonafifo, se reconocerá un monto adicional de cuarenta y dos mil quinientos setenta y nueve colones con 00/100 (¢42.579) siendo el monto total a pagar por hectárea doscientos doce mil ochocientos noventa y un colon (¢212,891) desembolsados en cinco pagos anuales de 20% durante un período de cinco años. Este monto adicional se aplicará hasta agotar el presupuesto asignado en esta actividad.

1.2.5. Actividad de Manejo de Bosque. Las condiciones que regirán para el trámite de solicitudes para el reconocimiento de los servicios ambientales en la actividad de Manejo de Bosque se detallan a continuación:

• a)El monto a pagar será de ciento treinta y tres mil cincuenta siete colones con 00/100 (¢133.057) por hectárea, desembolsados en cinco pagos anuales de 20% durante un período de cinco años.

1.3.Actuaiización de los montos a pagar:

Los montos establecidos por actividad dentro del Programa de Pago por Servicios Ambientales, se actualizarán anualmente con el Índice de Precios al Consumidor (IPC). calculado por el Instituto Nacional de Estadística y Censo (INEC), al cierre del período del año anterior.

2.1.De los plazos de vigencia de los contratos:

Los plazos de vigencia de los contratos de Pago por Servicios Ambientales, generados por las actividades que corresponden a las modalidades de recuperación y/o mantenimiento de cobertura forestal serán los siguientes:

• a)Los contratos correspondientes a la actividad de Reforestación mediante el establecimiento de las especies de rápido crecimiento, tendrán una vigencia de diez años a partir de su firma. Los que incorporen especies de mediano crecimiento y las especies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, su vigencia será de dieciséis años, a partir de su firma y aquellos que incorporen varias especies forestales y con diferentes turnos de cosecha, la vigencia del contrato será igual a la de la especie que tenga el turno más largo de cosecha y que éste no exceda de dieciséis años, en cuyo caso éste sería el lapso máximo de vigencia.
• b)Los contratos correspondientes a la actividad de establecimiento de árboles en Sistemas Agroforestales tendrán una vigencia de cinco años a partir de su firma. Los contratos correspondientes al programa de Sistemas bajo la actividad de Sistemas Agroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF) tendrán la misma vigencia sin embargo, dado que ya están plantados se les reconocerán retroactivamente tres años por su establecimiento previo.
• c)Los contratos correspondientes a la actividad de Protección de Bosque tendrán una vigencia de cinco años a partir de su firma.
• d)Los contratos correspondientes a la actividad de Regeneración Natural tendrán una vigencia de cinco años a partir de su firma.
• e)Los contratos correspondientes a la actividad de Manejo de Bosque, tendrán una vigencia de cinco años a partir de su firma. De previo a la firma del contrato, deberá constar en el expediente la certificación de que fue aprobado el plan de manejo, según los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Prácticas y Manual de Procedimientos, Decreto Ejecutivo N° 27388-MINAE publicado el 2 de noviembre de 1998, y el Decreto Ejecutivo N° 34559-MINAE publicado en La Gaceta N° 115, del día 16 de junio de 2008.
• f)Los contratos correspondientes a la subactividad de Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), tendrán una vigencia de seis años.

Condiciones establecidas para los montos y actividades de las solicitudes PSA:

3.1. Se faculta al Fondo Nacional de Financiamiento Forestal a establecer actividades y montos diferenciados a los señalados en esta resolución, de conformidad con acuerdos, convenios o contratos o proyectos específicos con entidades, que aporten recursos financieros al Programa de Pago por Servicios Ambientales, que reconozcan montos y condiciones diferentes a los establecidos para los diferentes servicios ambientales; para estos proyectos no aplicarán los criterios de priorización que se detallaron anteriormente, sino los pactados en cada convenio. Los pagos se realizarán siempre y cuando se tenga disponibilidad presupuestaria para cubrir los compromisos adquiridos mediante el Programa de Pago por Servicios Ambientales.

3.2. Los montos pendientes por pagar por contratos de años anteriores, se regirán según lo establecido en los Decretos Ejecutivos respectivos para cada año.

3.3. Para cubrir el costo de inscripción del contrato ante el Registro Nacional, el Fondo Nacional de Financiamiento Forestal retendrá en el primer desembolso del monto total del contrato un 0,6%.

3.4. Los recursos correspondientes al pago por servicios ambientales no utilizados por el Fonafifo y los recursos recuperados en virtud de los incumplimientos de contratos de pago por servicios ambientales, o los correspondientes a los pagos prescritos, serán depositados en una cuenta, que al efecto establezca el Fondo Nacional de Financiamiento Forestal y serán presupuestados para la ejecución de nuevas actividades de fomento; tales como créditos forestales.

3.5. El beneficiario de cada contrato deberá contar durante todo el plazo del mismo, con un regente forestal debidamente inscrito en el Colegio de Ingenieros Agrónomos. Salvo en aquellos casos que se haya determinado que el proyecto será supervisado directamente por el Fondo Nacional de Financiamiento Forestal. Sin perjuicio de otras disposiciones, el o los beneficiarios deberán aportar una certificación anual, o un informe de regencia anual emitido por un regente forestal para el trámite de pago.

Adicionalmente. para los contratos de Reforestación de rápido crecimiento, deberá presentar los informes de visita, donde certifique el estado de los proyectos en los años 8 y 10, a partir de su fecha de plantación para los proyectos de mediano crecimiento y otras especies, deberán presentar dichos informes al año 8. 12 y 16, a partir de su fecha de plantación.

3.6. Sin perjuicio de otras acciones que representen incumplimiento a las obligaciones del contrato, para los contratos de Reforestación de rápido crecimiento o bloques a partir de los 12 meses y para las plantaciones de mediano crecimiento o bloques a partir de los 24 meses de establecida la plantación, se considera incumplido el contrato si la plantación no presenta el crecimiento mínimo establecido en el inciso d del punto 1 .2.1 de esta resolución, o el indicado de previo en el estudio técnico respectivo para otras especies. Como consecuencia de este incumplimiento, el productor no recibirá el pago correspondiente a este año, siendo que el Fondo Nacional de Financiamiento Forestal debe suspender los pagos respectivos y dar por terminado el contrato con responsabilidad para el beneficiario, previo cumplimiento del debido proceso.

3.7. Serán motivo de eximente de responsabilidad por incumplimiento del contrato, el caso fortuito, la fuerza mayor, el hecho de un tercero como eximentes generales. De igual forma, se procederá cuando el propietario de la plantación demuestre que una plaga o enfermedad afectó la plantación y que las acciones oportunamente realizadas no lograron erradicarla. Se procederá de igual manera, cuando el daño sea producto de un incendio que no pudo ser controlado a pesar de las medidas preventivas reportadas.

3.8. No podrán ejecutarse proyectos en fincas que hayan sido objetos de plagas, enfermedades, o incendios y que por esas causas se haya finiquitado el contrato con responsabilidad, el tal supuesto, la finca no podrá ser objeto de contratos en Reforestación y/o SAF en un plazo de 3 años, a partir del último contrato finalizado por esta causa.

3.9. El Fonafifo, será el responsable de monitorear las plantaciones forestales que ingresen al Programa, debiendo no solo hacer un seguimiento a nivel regional, sino un protocolo de control, mediante un mecanismo aleatorio de visitas según su capacidad técnica y administrativa. De igual forma, deberá custodiar la información de las parcelas permanentes de mediciones de las plantaciones, a fin de sustentar los pagos y respaldar las fijaciones de carbono y otros gases de efecto invernadero.

3.10. En caso de que en las solicitudes presentadas se determinara la existencia de traslapes o desplazamiento entre ellas y/o con otras fincas, el Fonafifo valorará de acuerdo a criterios técnicos y legales la aprobación o no de las solicitudes de ingreso.

3.11. En el caso de las solicitudes de ingreso presentadas en la actividad de protección y que presenten varias fincas; la calificación dependerá de la finca de mayor tamaño que se incluya en la solicitud.

3.12. En el caso de las solicitudes de ingreso de Reforestación y Sistemas Agroforestales que involucren mezclas de especies de rápido, mediano y/o en vías de extinción, el valor del contrato dependerá del monto menor establecido en estos tipos de especies.

3.13. Los arreglos de los Sistemas Agroforestales que involucren especies de uso múltiple y maderables deberán realizarse con al menos un 20 % de los árboles de especies maderables.

3.14. Para cubrir el costo de inscripción del contrato ante el Registro Nacional, el Fondo Nacional de Financiamiento Forestal retendrá en el primer desembolso del monto total del contrato, un 0,6% para las Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR).

El beneficiario del proyecto PFTRR deberá contar durante todo el plazo del contrato, con un regente forestal debidamente inscrito en el Colegio de Ingenieros Agrónomos, quien deberá informar de previo a cada pago, el estado de la plantación y sus crecimientos en diámetro y altura.

Previo a cada pago de cada proyecto PFTRR, se debe contar con una certificación de un regente forestal, donde se detalle el estado de la plantación y que se cumplen las condiciones mínimas indicadas en el artículo 1 de esta resolución y lo establecido en el Manual de Procedimiento para el Pago de Servicios Ambientales 2009 y sus modificaciones.

El Fonafifo para constatar los datos presentados, en todos los casos requerirá la presentación de los datos de las mediciones individuales de los árboles incluidos en las parcelas de medición, que para sus efectos se tienen que establecer en los proyectos de plantaciones forestales.
