Resolution No. 0541-2016-MINAE, published in Supplement number 4 to La Gaceta number 5 of January six, two thousand seventeen, is amended to establish for the National Forest Financing Fund, the number of hectares to be financed for the sub-activity of Forest Plantations with Reduced Rotation Cycles (Plantaciones Forestales con Turnos de Rotación Reducidos, PFTRR), within the Payment for Environmental Services Program, the amount to be paid based on the resources allocated in the National Budget and approved by the Comptroller General of the Republic for said Fund, the National Conservation Policies, and the prioritization criteria defined by the National System of Conservation Areas and formalized by the Executive Branch.

1. 1That on January six, 2017, resolution number R-0541-2016 MINAE was published in Supplement No. 4 to La Gaceta No. 5, the purpose of which is to determine a series of relevant factors for the Payment for Environmental Services Program for the year two thousand seventeen, as provided in Article 38 of the Regulation to the Forestry Law 7575, Executive Decree 25721-MINAE and its amendments.
2. 2That given the decrease in payment for environmental services projects in the reforestation activity, the National Forestry Office proposes a new sub-activity offering more advantageous and attractive conditions, to utilize scientific and technological schemes to reduce the rotation cycles of certain species, which will be dedicated to packaging and dendro-energy projects.
3. 1That Article 38 of the Regulation to the Forestry Law No. 7575, Executive Decree No. 25721-MINAE of October 17, 1996, and its amendments, provides that the Minister of Environment and Energy, as head of the institution, shall annually issue, by Ministerial Resolution, the activities to be financed under the Payment for Environmental Services Program and the amounts to be paid based on the resources allocated in the National Budget for the National Forest Financing Fund.
4. 2That for the year 2016, it is estimated, according to statistics maintained by the National Forestry Office, that the primary wood processing industry, both stationary and portable mills, processed 965,602 cubic meters of roundwood (m3-r). Of this volume, 745,267 m3-r (77.2%) come from forest plantations, 171,017 m3-r from agricultural lands (17.7%), and 49,318 m3-r from forests (5.1%). The wood processed in the forestry industries is mainly destined for the following uses: packaging 46.7%, construction 25.1%, furniture 9.0%, raw and sawn lumber exports 18.9%, and 0.3% for other uses (board manufacturing, vehicle bodies, among others.)
5. 3That despite the efforts made by the National Forest Financing Fund in recent years, a decline in the national reforestation rate has been experienced, preventing the fulfillment of the National Forestry Development Plan goal of reaching at least 6,200 hectares of reforestation in the year 2017, due to a series of factors influencing the decision of landowners not to undertake these projects, to the detriment of the country's production, which partially reduces the supply of wood for various uses and increases imports of plantation wood from other parts of the world, among other aspects.
6. 4That the National Forestry Office, concerned about this loss of interest by producers in establishing forest plantations, proposes to the Board of Directors of the National Forest Financing Fund the creation of a new forest plantation model or scheme, which allows for greater attractiveness to producers, as they can harvest in a shorter timeframe, by virtue of more efficient techniques and a technology package prepared with the assistance of the forestry engineers managing the projects. This proposal was accepted by the Board of Directors of the National Forest Financing Fund, through the tenth agreement of ordinary session No. 07-2017 held on Tuesday, July 18, two thousand seventeen, generating a recommendation to the Office of the Minister of Environment and Energy to issue the resolution creating and regulating the new activity in the payment for environmental services program called Forest Plantations with Reduced Rotation Cycles (PFTRR).
7. 5That the new reforestation activity will allow established forest plantations to better supply the wood necessary for industries, both for the production of pallets and packaging for agricultural products and for export, as well as for novel activities such as energy production, or other purposes required in the market.
8. 6That for the year 2017, an initial goal of establishing up to two thousand hectares under this reforestation activity is considered, which will be financed with resources duly budgeted for payment for environmental services activities under the reforestation modality. Therefore,

Se modifica la Resolución N° 0541-2016-MINAE publicada en el Alcance número 4 a La Gaceta número 5 del seis de enero del dos mil diecisiete, para establecer al Fondo Nacional de Financiamiento Forestal, la cantidad de hectáreas a financiar para la subactividad de Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), en el Programa de Pago por Servicios Ambientales, el monto a pagar con base en los recursos asignados en el Presupuesto Nacional y aprobados por la Contraloría General de la República al citado Fondo, las Políticas Nacionales de Conservación y los criterios de priorización definidos por el Sistema Nacional de Áreas de Conservación y oficializados por el Poder Ejecutivo.

1. 1Que el día seis de enero de 2017, se publica en el Alcance N° 4 a La Gaceta N° 5, la resolución número R-0541-2016 MINAE, la cual tiene como finalidad determinar una serie de factores relevantes para el Programa de Pago por Servicios Ambientales para el año dos mil diecisiete, según dispone el artículo 38 del Reglamento a la Ley Forestal 7575, Decreto Ejecutivo 25721-MINAE y sus reformas.
2. 2Que ante la disminución de proyectos de pago por servicios ambientales en la actividad de reforestación, la Oficina Nacional Forestal propone una nueva subactividad que ofrezca condiciones más ventajosas y atractivas, para utilizar esquemas científicos y tecnológicos para lograr reducir los turnos de corta de ciertas especies, las cuales serán dedicadas a embalajes y proyectos dendro energéticos.
3. 1Que el artículo 38 del Reglamento a la Ley Forestal N° 7575, Decreto Ejecutivo N° 25721-MINAE del día 17 de octubre de 1996 y sus reformas, dispone que el Ministro de Ambiente y Energía como Jerarca, emitirá anualmente mediante Resolución Ministerial, las actividades a financiar en el Programa de Pago por Servicios Ambientales y los montos a pagar con base en los recursos asignados en el Presupuesto Nacional del Fondo Nacional de Financiamiento Forestal.
4. 2Que para el año 2016, se estima según estadísticas llevadas por la Oficina Nacional Forestal, que la industria de transformación primaria de madera, entre estacionarias y portátiles, procesaron 965.602 metros cúbicos de madera en rollo (m3-r). De este volumen, 745.267 m3-r (77,2%) provienen de plantaciones forestales, 171.017 m3-r de terrenos de uso agropecuario (17,7%) y 49.318 m3-r de bosques (5,1%). La madera procesada en las industrias forestales se destina principalmente a los siguientes usos: embalajes 46,7%, construcción 25,1%, mueblería 9,0%, exportación en bruto y aserrado 18,9% y un 0,3% en otros usos (fabricación de tableros, carrocerías, entre otros.)
5. 3Que pese a los esfuerzos realizados por el Fondo Nacional de Financiamiento Forestal en los últimos años se ha experimentado una baja en la tasa de reforestación nacional, impidiendo cumplir la meta del Plan Nacional de Desarrollo Forestal de alcanzar al menos 6200 hectáreas de reforestación en el año 2017, debido a una serie de factores que inciden en la decisión de los dueños de finca de no realizar estos proyectos, con el perjuicio para la producción del país, que reduce en parte el abastecimiento de madera para diversos usos y aumenta las importaciones de madera de plantación de otras partes del mundo entre otros aspectos.
6. 4Que la Oficina Nacional Forestal preocupada por esta pérdida de interés de los productores en establecer plantaciones forestales, propone a la Junta Directiva del Fondo Nacional de Financiamiento Forestal la creación de un nuevo modelo o esquema de plantación forestal, que permite ser más atractiva a los productores, pues pueden cosechar en un plazo menor, ello en virtud de técnicas más eficientes y un paquete tecnológico preparado con ayuda de los ingenieros forestales regentes de los proyectos. Esta propuesta fue aceptada por la Junta Directiva del Fondo Nacional de Financiamiento Forestal, mediante acuerdo décimo de la sesión ordinaria N° 07-2017 celebrada el día martes 18 de julio del dos mil diecisiete, generando la recomendación hacia el Despacho del Ministro de Ambiente y Energía a fin de que emita la resolución que crea y regule la nueva actividad en el programa de pago por servicios ambientales denominada Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR).
7. 5Que la nueva actividad de reforestación permitirá que las plantaciones forestales establecidas puedan suplir de una mejor forma la madera necesaria para las industrias, tanto para la producción de tarimas y embalajes para los productos agrícolas y para la
