throughout the entire text - Full Text of Regulation 40464 Regulations for the Implementation of the National REDD+ Strategy Nº 40464-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Pursuant to the powers conferred upon them by Articles 50 and 140, subsections 3) and 18), of the Political Constitution, Ley Orgánica del Ambiente No 7554 of October 4, 1995, Ley Forestal Nº 7575 of February 13, 1996, and Ley de Biodiversidad Nº 7788 of April 30, 1998.
Whereas:
REDD+ is a cooperative effort to design and implement policies and positive incentives to combat climate change by reducing emissions from deforestation and forest degradation in developing countries, and by recognizing the role of conservation, sustainable forest management, and enhancement of forest carbon stocks in developing countries, in the context of providing adequate and predictable support to developing countries, with a view to collectively reducing, halting, and reversing the loss of forest cover (cobertura forestal) and carbon, in accordance with national circumstances.
The initiative operates through two funds administered by the World Bank and directed by the Participants Assembly, composed of donors and countries that have expressed an interest in implementing REDD+, to assist a REDD country in its efforts to reduce emissions from deforestation and/or forest degradation by providing financial and technical assistance to develop the capacity needed to participate fully in a future system of positive incentives for REDD+, as defined by each country according to its national interests and circumstances. These funds are the “Readiness Fund” and the “Carbon Fund,” the latter of which will serve as a pilot initiative for purchasing emission reductions derived from REDD+.
This entails a REDD+ readiness process consisting of the development of a National REDD+ Strategy (EN-REDD+), a National Monitoring, Reporting, and Verification System, a national Forest Reference Level, and an Information System concerning how the REDD+ Safeguards are being addressed and respected.
The country has also submitted a Project Idea Note to the Carbon Fund, which has been accepted, and a Letter of Intent has been signed for that Fund to acquire a portion of the emission reductions to be generated through REDD+ initiatives implemented before 2020.
Those stocks result from public-policy efforts and the participation of national and international social and private stakeholders. It is also necessary to address and reduce the causes of deforestation and degradation of forest resources; strengthen successful programs and policies such as payment for environmental services (pago por servicios ambientales); and create the additional capacities required for this purpose within Sistema Nacional de Áreas de Conservación and Fondo Nacional de Financiamiento Forestal, as well as within other key public and private entities.
These must be appropriately coordinated within the new model for planning and delivering public services arising from the National Development Plan and require concerted action by the relevant government entities having jurisdiction over various subject matters. Accordingly, REDD+ is characterized as a sector-wide activity, and some of its actions will even be cross-sectoral.
This instrument of international law seeks to establish an agreement for combating climate change through commitments by member countries to reduce greenhouse-gas emissions, as well as through the establishment of financial and cooperative mechanisms.
Consistent with this position, the country submitted a highly ambitious INDC (Intended Nationally Determined Contribution) through which it adopted a transformational commitment to reach net emissions of 9,373,000 TCO2 e by 2030, equivalent to a 25% reduction compared with 2012 emissions. Given the country’s interest in fostering public involvement, scenarios are being developed using the following trajectories: 1.73 tonnes per capita by 2030, 1.19 tonnes per capita by 2050, and - 0,27 tonnes per capita by 2100.
The Agreement recognizes the importance of forests as greenhouse-gas sinks and reservoirs and conceptualizes REDD+ as an instrument for implementing climate policy by encouraging the Parties, in Article 5, to take measures to implement and support the existing framework under the Convention concerning policies and positive incentives to reduce emissions caused by deforestation and forest degradation and to increase forest carbon stocks in developing countries. It also encourages the promotion of alternative approaches combining mitigation and adaptation for the integrated and sustainable management of forests, while reaffirming the importance of incentivizing the non-carbon benefits arising from those approaches.
HEREBY DECREE:
“REGULATIONS FOR THE IMPLEMENTATION OF THE NATIONAL REDD+ STRATEGY”
Therefore,
The Estrategia Nacional REDD+, hereinafter referred to as “the Strategy,” shall form part of the Programa de Bosques y Desarrollo Rural of the Sistema Nacional de Áreas de Conservación and shall serve as an instrument contributing to the achievement of the goals of the Plan Nacional de Desarrollo, the Nationally Determined Contributions (Contribuciones Nacionalmente Determinadas), and the climate policies currently in force (Estrategia Nacional de Cambio Climático and Plan de Acción), as well as the Plan Nacional de Desarrollo Forestal 2011-2020, through actions that help prevent deforestation and forest degradation (degradación de los bosques), promote forest conservation and sustainable management (manejo sostenible), and increase carbon stocks (reservas de carbono). The entire REDD+ Strategy and the actions implemented must be framed within the Estrategia Nacional de Cambio Climático and sectoral Climate Change policies.
It shall also define actions for the development of forest plantations (plantaciones forestales) and agroforestry systems (sistemas agroforestales).
Likewise, it seeks to strengthen State control and oversight of forest resources (recursos forestales) and State Natural Heritage lands (terrenos Patrimonio Natural del Estado).
The Strategy is a State initiative that incorporates a participatory process gathering input from all sectors involved through a process of outreach, participation, and consultation.
The Strategy shall comprise three phases: 1. development and preparation; 2. the initial implementation phase, including the pilot plan; and 3.
The full implementation or results-based payment phase.
As an essential principle, the Strategy shall be financed with resources generated through its implementation by means of market instruments or non-market approaches, provided by individuals, companies, or public or private entities, whether national or international.
Authority and responsibility for coordinating and implementing the various phases of the Strategy shall be assumed by the Administración Forestal del Estado through the Fondo Nacional de Financiamiento Forestal (FONAFIFO) and the Sistema Nacional de Áreas de Conservación (SINAC), in accordance with the powers and responsibilities granted to each of these bodies under the legal framework.
The Sistema Nacional de Áreas de Conservación and the Fondo Nacional de Financiamiento Forestal, within the framework of the Plan Nacional de Desarrollo, the Plan Nacional de Desarrollo Forestal, and the Programa de Bosques y Desarrollo Rural of SINAC, shall establish a specific Work Plan setting forth all actions and coordination and implementation mechanisms required to fulfill the REDD+ Strategy, in accordance with the terms of this Decree.
An Executive Secretariat of the Estrategia Nacional REED+ is hereby created, with the participation and coordination of two officials from the Sistema Nacional de Áreas de Conservación and two officials from the Fondo Nacional de Financiamiento Forestal. They shall designate a coordinator from among themselves.
A REDD+ Governing Council is hereby created, composed of the Executive Director of the Sistema Nacional de Áreas de Conservación, the Executive Director of the Fondo Nacional de Financiamiento Forestal, and the Vice Minister responsible for the Environment sector. Its functions shall be to provide oversight and policy direction to this Executive Secretariat, negotiate emission reductions (reducciones de emisiones), and ensure compliance with the Estrategia REDD+ Costa Rica.
The principal functions of the Secretariat shall be:
a- To coordinate the implementation of the various phases of the Strategy.
b- To ensure compliance with the safeguards (salvaguardas) established for the REDD+ Strategy.
c- To establish and manage specific agreements with State entities and with private entities or companies.
d- To submit the relevant reports to the various authorities.
e- To submit quarterly progress and performance reports on the REDD+ Strategy to the Governing Council.
f- To convene the various assemblies for the appointment of the members of the Monitoring Committee (Comité de Seguimiento) established in Article 18 of this Decree.
g- To supervise the processes for administering the financial resources generated by the Strategy.
h- To ensure that complaints are addressed and answered.
i- To perform any other functions necessary for fulfillment of the Strategy.
All bodies of the Ministerio de Ambiente y Energía shall cooperate, within the scope of their respective powers and functions, in implementing the Programa de Bosques y Desarrollo Rural and the REDD+ Strategy. For this purpose, they may allocate human and budgetary resources to their implementation.
The Instituto Meteorológico de Costa Rica and the Dirección de Cambio Climático shall assist throughout the implementation process of the REDD+ Strategy and, for this purpose, shall provide advice and cooperation in the processes for which the Secretariat established by this Decree requests them.
The Government of the Republic undertakes to comply with the safeguards defined by the Climate Change Convention, pursuant to Anexo 1 of decision 1 PC 16 of the CMNUCC and its subsequent decisions, as well as the provisions of the Paris Agreement. It likewise undertakes to maintain and comply with those safeguards throughout the entire implementation period of the REDD+ Strategy, in a manner consistent with each phase.
The Sistema Nacional de Áreas de Conservación and the Fondo Nacional de Financiamiento Forestal are authorized to enter into any legal transaction (negocio jurídico) involving emission reductions, greenhouse-gas mitigation activities or actions (actividades o acciones de mitigación de gases de efecto invernadero) carried out in Costa Rica and resulting from afforestation (forestación) or reforestation (reforestación) processes. The international sale of carbon credits (créditos de carbono) resulting from the aforementioned activities must be approved by the Dirección de Cambio Climático, which shall ensure compliance with the climate commitments arising from the INDC and shall provide reasons for its decision. They are additionally and expressly authorized to issue instruments, certificates, or any other mechanism representing the metric tons when those tons originate under any of the following circumstances:
a- State Natural Heritage lands that form part of protected wild areas (áreas silvestres protegidas), or that are located outside them.
b- Lands owned by State Institutions and forming part of their assets, where an agreement authorizing this has been entered into.
c- Rights obtained by the Fondo Nacional de Financiamiento Forestal through assignments of rights (cesiones de derechos) under contracts for payment for environmental services (pago por servicios ambientales), whether already executed or to be executed in the future.
d- Rights obtained, or that may be obtained in the future, through purchase options (opciones de compra) or any other transaction arranged by the Fondo Nacional de Financiamiento Forestal with private landowners.
If carbon-credit transactions are conducted within the REDD+ mechanism, the Ministerio de Ambiente y Energía shall establish the minimum requirements and conditions necessary to ensure that the negotiation of these greenhouse-gas reduction actions meets the requirements for legal standing (legitimación), quantification, and verification, thereby creating transparency and certainty in the markets.
Any financial resources received from the sale or disposition of emission-reduction instruments or greenhouse-gas mitigation actions shall be deposited with and administered by the Fundación Banco Ambiental (FUNBAM), created under Article Four of Ley N°8640, published in the Diario Oficial La Gaceta 128 on Thursday, July 3, 2008, through a trust (fideicomiso) or any other arrangement to be established for administering these resources and making payments to the owners of the mitigation actions, whether public-law or private-law entities, among other actions, in accordance with the agreements or contracts executed for that purpose and setting forth the guidelines for managing these resources.
To establish a reliable and transparent mechanism that guarantees the origin and sale of emission reductions, greenhouse-gas mitigation actions, or their respective instruments or certificates, the Dirección de Cambio Climático is authorized to establish a registry of greenhouse-gas mitigation actions and/or contract for the services of an existing registry, in accordance with cost-benefit criteria. The regulations and operating mechanisms shall be established in an operating manual.
The Registry referred to in the preceding paragraph shall be developed by the Dirección de Cambio Climático within six months following publication of this Decree. Notwithstanding the foregoing, it may contract for the services of an existing registry abroad if required by the REDD+ Governing Council.
Resources derived from the sale of emission reductions or greenhouse-gas mitigation actions under the REDD+ Strategy, or obtained through contributions and donations for this purpose, shall be distributed according to the percentage contributed by each public-law or private-law entity.
Resources originating from State-owned protected wild areas and State Natural Heritage lands under its administration shall belong to the Sistema Nacional de Áreas de Conservación, which may use them according to its needs but shall give priority to strengthening controls against illegal logging, forest-fire prevention and response actions, and the monitoring system for forests and other forest resources, as well as any other actions designated as priorities by SINAC.
Resources derived from other State lands belonging to public institutions shall be used in accordance with the respective agreement entered into, while those derived from assignments of rights under the payment for environmental services program shall be used to compensate landowners and possessors and to expand the payment for environmental services program implemented by the Fondo Nacional de Financiamiento Forestal.
Resources generated through purchase options or other mechanisms used by FONAFIFO shall be used to pay private producers who have entered into purchase-option contracts or other arrangements, or who enter into new contracts in the future. Those contracts shall establish a duty to protect and sustainably manage forests.
All program participants shall have deducted from their respective payments, in proportion to their contributions, the costs of establishing, administering, marketing, supervising, and monitoring future commitments. The same procedure shall apply when guarantee mechanisms are established with respect to those same mitigation actions.
The prices of emission reductions and greenhouse-gas mitigation actions shall, at a minimum, cover all production, accounting, measurement, oversight, monitoring, and marketing costs throughout the entire term of the commitments.
When implementation of the REDD+ Strategy requires actions and collaboration by other State institutions, the Secretariat shall endeavor to establish a specific cooperation agreement for that purpose, with the endorsement of the Governing Board (Consejo Directivo).
A Monitoring Committee is hereby created, whose essential function shall be to ensure compliance with the Strategy throughout its various phases. This Committee shall consist of: two representatives of the Indigenous peoples established in Costa Rica; two representatives of small-scale forestry producers (pequeños productores forestales), as defined in Article Two, subsection “y” of the Regulations to Ley Forestal (Reglamento a la Ley Forestal), Decreto Ejecutivo 25721-MINAE and its amendments; two representatives of nonprofit nongovernmental organizations operating in the environmental sector; two representatives of the owners of primary industries that process timber in the country; two representatives of public universities that offer degree programs in forestry sciences; one representative of the Colegio de Ingenieros Agrónomos; and one representative of one of the associations of forestry professionals existing in the country.
The Committee shall be coordinated by the Secretariat, which shall provide the assistance necessary for its operation.
The representatives shall be selected through independent Assemblies (Asambleas), which shall be promoted, coordinated, and supervised by the Secretariat, except for the representative of the Colegio de Ingenieros Agrónomos. These Assemblies shall be called at least 30 business days in advance and shall be publicized through various media outlets with national or regional coverage.
The representatives shall be appointed by a simple-majority vote of those present.
Once the individuals have been appointed, the Secretariat shall convene the representatives for an initial meeting. This Committee shall meet in ordinary session at least once every two months and shall adopt its own operating regulations (reglamento de operación).
The functions of the Monitoring Committee shall primarily be to oversee or monitor compliance with the REDD+ Strategy by the various stakeholders, insofar as resources are available for that purpose. It may request any information it considers necessary that is held by public entities and may issue formal notices of complaint (notas de queja), as appropriate, when the Strategy is not implemented.

Considerando:
Estos fondos son el "Fondo de Preparación" y el "Fondo de Carbono", éste último que será una experiencia piloto para la compra de reducciones de emisiones provenientes de REDD+.
Asimismo, el país ha presentado una Nota de Idea de Proyecto al Fondo de Carbono, el cual ha sido aceptado y se ha firmado una Carta de Intenciones para que dicho Fondo adquiera una porción de las reducciones de emisiones que serán generadas a través de iniciativas REDD+ a ser ejecutadas antes del año 2020.
12 º-Que en el vigésimo primer periodo de sesiones de la Conferencia de las Partes de la Convención Marco sobre el Cambio Climático, celebrada en diciembre del 2015 en París se acordó el denominado " Acuerdo de París", instrumento del Derecho Internacional, que pretende lograr un acuerdo para la lucha contra el cambio climático, por medio de compromisos de reducción de emisiones de gases de efecto invernadero por parte de los países miembros, así como el establecimiento de mecanismos financieros y de cooperación.
En consistencia con esta postura, el país presentó una INDC (Contribución Nacionalmente Determinada e Intencionada por sus siglas en inglés) muy ambiciosa y mediante la cual adoptó un compromiso transformacional para llegar a una emisión neta de 9,373,000 TCO2 e al 2030, lo cual equivale a una reducción del 25% con respecto a las emisiones del 2012. Dado el interés del país en buscar el involucramiento ciudadano, se trabajan escenarios con las siguientes trayectorias; de 1.73 Toneladas Per Cápita al 2030, 1.19 Toneladas Per Cápita al 2050 y - 0,27 Toneladas Per Cápita al 2100.
"REGLAMENTO PARA LA EJECUCIÓN DE LA ESTRATEGIA NACIONAL REDD+"
Por tanto,
DECRETAN:
Que la Estrategia Nacional REDD+ en adelante denominada "La estrategia" será parte del Programa de Bosques y Desarrollo Rural del Sistema Nacional de Áreas de Conservación, la cual será un instrumento que contribuya con el cumplimiento de las metas del Plan Nacional de Desarrollo, de las Contribuciones Nacionalmente Determinadas (National Determined Contributions) y de las políticas climáticas vigentes ( Estrategia Nacional de Cambio Climático y Plan de Acción), así como el Plan Nacional de Desarrollo Forestal 2011-2020, mediante acciones que coadyuven a evitar la deforestación y degradación de los bosques, favoreciendo su conservación y manejo sostenible, y aumento de las reservas de carbono. Toda la estrategia de REDD+ y las acciones que se ejecuten deben estar enmarcadas dentro de la Estrategia Nacional de Cambio Climático y las políticas sectoriales de Cambio Climático.
Asimismo definirá acciones para el desarrollo de plantaciones forestales y sistemas agroforestales.
De igual manera, pretende el fortalecimiento del control y supervisión estatal de los recursos forestales y de los terrenos Patrimonio Natural del Estado.
La Estrategia es una iniciativa de Estado, que incorpora un proceso participativo que recoge el aporte de todos los sectores involucrados, mediante un proceso de socialización, participación y consulta.
La Estrategia estará planteada en tres fases, 1. la de construcción y preparación; 2. La fase de inicio de acciones, entre ellas el plan piloto; y 3.
La fase de la de plena implementación o pago por resultados.
La Estrategia deberá como un principio esencial estar financiada con recursos que generen su desarrollo mediante instrumentos de mercado o enfoques de no mercado, por medio de personas, empresas, o entidades públicas o privadas, nacionales o internacionales.
La competencia y responsabilidad para coordinar y ejecutar las diferentes fases de la Estrategia, será asumida por la Administración Forestal del Estado por medio del Fondo Nacional de Financiamiento Forestal (FONAFIFO) y el Sistema Nacional de Áreas de Conservación (SINAC), de acuerdo con las facultades y competencias que le otorgan el marco legal a cada uno de estos órganos.
El Sistema Nacional de Áreas de Conservación y el Fondo Nacional de Financiamiento Forestal, en el marco del Plan Nacional de Desarrollo, el Plan Nacional de Desarrollo Forestal y el Programa de Bosques y Desarrollo Rural del SINAC, establecerán un Plan de Trabajo específico, que determinará todas las acciones y los mecanismos de coordinación y ejecución para el cumplimiento de la Estrategia REDD+, según los términos del presente Decreto.
Se crea una Secretaría Ejecutiva de la Estrategia Nacional REED+ con participación y coordinación de dos funcionarios del Sistema Nacional de Áreas de Conservación y dos funcionarios del Fondo Nacional de Financiamiento Forestal. Entre ellos designarán un coordinador encargado.
Se crea un Consejo Directivo REDD+, el cual estará compuesto por el Director Ejecutivo del Sistema Nacional de Áreas de Conservación, el Director Ejecutivo del Fondo Nacional de Financiamiento Forestal y el Viceministro encargado del sector Ambiente, y su función será la supervisión y dirección política de esta Secretaría Ejecutiva, la negociación de las reducciones y velar por el cumplimiento de la Estrategia REDD+ Costa Rica.
Las principales funciones de la Secretaría serán:
a- Coordinar el cumplimiento de las diversas fases de la Estrategia.
b- Velar por el cumplimiento de las salvaguardas, establecidas para la estrategia REDD+.
c- Establecer y gestionar los acuerdos específicos con entidades estatales, así como entes o empresas privadas.
d- Presentar los informes pertinentes, a las diferentes instancias.
e- Rendir informes trimestrales de avance y desempeño de la estrategia REDD+ al Consejo Directivo.
f- Convocar las diferentes asambleas para el nombramiento de los miembros del Comité de Seguimiento, establecido en el artículo 18 de este Decreto.
g- Supervisar los procesos de administración de recursos financieros que produzca la estrategia.
h- Garantizar la atención de quejas y su respuesta.
i- Otras que sean necesarias para el cumplimiento de la Estrategia.
Todos los órganos del Ministerio de Ambiente y Energía deberán colaborar según sus competencias y funciones en el cumplimiento del Programa de Bosques y Desarrollo Rural y la Estrategia REDD+, para su cumplimiento podrán destinar recursos humanos y presupuestarios en su cometido.
El Instituto Meteorológico de Costa Rica y La Dirección de Cambio Climático, coadyuvara a todo el proceso de ejecución de la Estrategia REDD+, para tal fin brindarán asesoría y colaboración en los procesos en los cuales la Secretaría establecida en este Decreto lo solicite.
El Gobierno de la República se compromete a cumplir las salvaguardas definidas por la Convención de Cambio Climático, según el Anexo 1 de la decisión 1 PC 16 de la CMNUCC y sus decisiones posteriores, así como lo dispuesto en el Acuerdo de París. De igual forma se compromete a mantener y cumplir dichas salvaguardas durante todo el periodo de ejecución de la Estrategia REDD+ de manera consistente con cada fase.
Se faculta al Sistema Nacional de Áreas de Conservación y al Fondo Nacional de Financiamiento Forestal a realizar cualquier negocio jurídico, con las reducciones de emisiones, actividades o acciones de mitigación de gases de efecto invernadero, realizadas en Costa Rica, derivadas de los procesos de forestación o reforestación. La comercialización externa de los créditos de carbono derivados de las actividades antes mencionadas deberá contar con el visto bueno de la Dirección de Cambio Climático, quien velará por el cumplimiento de los compromisos climáticos derivados del INDC y deberá justificar la decisión adoptada. Adicionalmente podrán expresamente emitir los títulos, certificados, o cualquier otro mecanismo que representen las toneladas, cuando sean originadas en los siguientes supuestos:
a- Terrenos Patrimonio Natural del Estado que forman parte de las áreas silvestres protegidas, o fuera de ellas.
b- Los terrenos que sean propiedad de las Instituciones del Estado que conforman su Patrimonio, cuando haya un convenio que así lo faculte.
c- Los derechos obtenidos por el Fondo Nacional de Financiamiento Forestal en virtud de cesiones de derechos de los contratos de pago por servicios ambientales, suscritos o que se suscribirán en el futuro.
d- Los derechos obtenidos o los que pueda conseguir en el futuro por medio de opciones de compra o cualquier otro negocio gestionado por el Fondo Nacional de Financiamiento Forestal, con propietarios privados.
En el caso de que se realicen transacciones de crédito de carbono dentro del mecanismo REDD+ el Ministerio de Ambiente y Energía establecerá los requisitos y condiciones mínimos para que la negociación de estas acciones de reducción de gases de efecto invernadero cumplan con los elementos de legitimación, cuantificación, y de verificación, generando con ello transparencia y certeza en los mercados.
Los recursos financieros que pueda percibir por el concepto de venta o disposición de títulos de reducción de emisiones, acciones de mitigación de gases de efecto invernadero, serán depositados y administrados por la Fundación Banco Ambiental (FUNBAM) creada mediante el artículo cuarto de Ley N°8640, publicada en el Diario Oficial La Gaceta 128 el jueves 3 de julio del 2008, a través de un fideicomiso o de cualquier otra figura que se constituirá para la administración de estos recursos y el pago a los dueños de las acciones de mitigación sean sujetos de derecho público o privado, entre otras acciones, según los convenios, contratos o acuerdos que al efecto se establezcan en donde se dispongan las directrices de gestión de estos recursos.
A fin de lograr un mecanismo confiable y transparente que garantice el origen y comercialización de las reducciones de emisiones, las acciones de mitigación de gases de efecto invernadero o sus respectivos títulos o certificados, se faculta a la Dirección de Cambio Climático para que establezca un registro de acciones de mitigación de gases de efecto invernadero y/o contrate los servicios de uno existente, de acuerdo a los criterios de costo- beneficio. La regulación y mecanismos de operación serán establecidos mediante un manual de operación.
El Registro a que hace referencia el párrafo anterior, deberá ser elaborado por la Dirección de Cambio Climático dentro de los seis meses posteriores a la publicación de este Decreto, no obstante lo anterior, podrá contratar los servicios de uno existente en el exterior, si así se requiere por parte del Consejo Directivo REDD+.
Los recursos provenientes de la comercialización de las reducciones de emisiones o de las acciones de mitigación de gases de efecto invernadero de la Estrategia REDD+, o los que se logren por aportes y donaciones para este fin, serán distribuidos de acuerdo con los porcentajes del aporte de cada uno de los sujetos de derecho público o privado.
Los que se originen de áreas silvestres protegidas propiedad estatal y los terrenos Patrimonio Natural del Estado bajo su administración corresponderán al Sistema Nacional de Áreas de Conservación, el cual podrá utilizarlas según sus necesidades, pero deberá prioritariamente fortalecer el control de tala ilegal, las acciones de lucha contra los incendios forestales y el sistema de monitoreo de bosques y otros recursos forestales; así como otras acciones que se definan como prioritarias por el SINAC.
Los derivados de otros terrenos estatales de instituciones públicas según el respectivo convenio que se suscriba, y los derivados de cesiones de derechos del programa de pago por servicios ambientales, serán utilizados para retribuir a los propietarios y poseedores y para ampliar el programa de pago por servicios ambientales, ejecutado por el Fondo Nacional de Financiamiento Forestal.
Los recursos generados por las opciones de compra u otros mecanismos utilizados por FONAFIFO, serán utilizados para pagar a los productores privados que hayan suscrito los contratos de opción de compra u otros mecanismos o que suscriban nuevos contratos en el futuro. En dichos contratos deberá establecerse el deber de protección y el manejo sostenible de los bosques.
Todos los participantes en el programa se les deducirán de sus respectivos pagos en forma proporcional a su aporte el costo del establecimiento, administración, comercialización, supervisión y control de los compromisos futuros. De igual forma se procederá cuando se establezcan mecanismos de garantía respecto de las mismas acciones de mitigación.
Los precios de las reducciones de emisiones y las acciones de mitigación de gases de efecto invernadero, al menos deberán cubrir todos los costos de producción, contabilización, medición, supervisión, monitoreo, comercialización, durante todo el plazo de los compromisos.
Cuando la ejecución de la Estrategia REDD+ requiera la realización de acciones y colaboración de otras instituciones del Estado, la Secretaría deberá procurar establecer un convenio de colaboración específico para tal fin, con el aval del Consejo Directivo.
Se crea un comité de seguimiento, cuya función esencial será velar por el cumplimiento de la Estrategia, en sus diversas fases. Este comité estará conformado por: dos representantes de los pueblos indígenas establecidos en Costa Rica, dos representantes de los pequeños productores forestales, según la definición del artículo segundo, inciso "y" del Reglamento a la Ley Forestal Decreto Ejecutivo 25721-MINAE y sus reformas, dos representantes de organizaciones no gubernamentales sin fines de lucro que se desempeñen en el sector ambiente, dos representantes de los propietarios de las industrias primarias que procesen madera en el país, dos representantes de las universidades públicas que impartan la carrera de ciencias forestales, un representante del Colegio de Ingenieros Agrónomos, y un representante de una de las asociaciones de profesionales forestales existentes en el país.
El Comité será coordinado por la Secretaría, quien brindará la colaboración necesaria para su operación.
Los representantes serán escogidos mediante Asambleas independientes las cuales serán promovidas, coordinadas y supervisadas por la Secretaría. Salvo el representante del Colegio de Ingenieros Agrónomos. Estas Asambleas deberán ser convocadas con al menos 30 días hábiles de anticipación y deberán ser publicitadas mediante diferentes medios de cobertura nacional o regional.
Los nombramientos de los representantes se realizarán mediante la votación de la mayoría simple de los presentes.
Una vez nombradas las personas, la Secretaría convocará a los representantes a una primera reunión. Este comité deberá reunirse en forma ordinaria al menos una vez cada dos meses, siendo que aprobarán su propio reglamento de operación.
Las funciones del Comité de seguimiento serán principalmente: velar o monitorear que los diferentes actores cumplan con la Estrategia REDD+ en el tanto existan los recursos para tal fin. Podrá solicitar la información que considere necesaria en poder de las entidades públicas, así como establecer las notas de queja según corresponda, cuando no se cumpla con la ejecución de la Estrategia.
Deróguese el Decreto Ejecutivo N°37352- MINAE, publicado en el Diario Oficial La Gaceta N°220 del 14 de noviembre de 2012.
