throughout the entire text - Full Text of Norm 37352 Implementation of the Executive Secretariat to Support the Establishment and Execution of the REDD+Costa Rica Strategies Full Text of Session Record: 1189C3 No. 37352-MINAET (This executive decree was repealed by Article 19 of the Regulation for the Execution of the National REDD+ Strategy, approved by Executive Decree No. 40464 of April 3, 2017) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS Based on the powers granted to them by Articles 50 and 140, subsections 3) and 18) of the Political Constitution; Articles 25 subsection 1), 27 subsection 1), and 28 subsection 2), paragraph b) of the General Public Administration Law No. 6227 of May 2, 1978, and Articles 1, 5, 46, and 47 of the Forest Law (Ley Forestal) No. 7575 of February 13, 1996.
1st-That Article 50 of the Political Constitution of Costa Rica and the jurisprudence of the Constitutional Chamber establish a healthy and ecologically balanced environment as a right of citizens.
2nd-That the Forest Law (Ley Forestal) establishes as an essential and priority function of the State to ensure the conservation, protection, and administration of natural forests and the production, use, industrialization, and promotion of forest resources. Also ensuring the generation of employment and the improvement of the standard of living of the rural population, through their effective incorporation into silvicultural activities. To fulfill these purposes, the Forest Law (Ley Forestal) creates the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO), which must channel resources to fulfill the mandates of the law and the Political Constitution.
3rd-That within the framework of the United Nations Framework Convention on Climate Change (UNFCCC), the mechanism known as Reduction of Emissions from Deforestation and Forest Degradation (REDD+) is being developed, which is an international effort to combat climate change by promoting policies and actions to decrease, halt, and reverse the loss of forest cover (cobertura forestal) and carbon in developing countries, particularly in the tropics, and to offer financial incentives or rewards for these reductions, a mechanism in which the Ministry of Environment, Energy and Telecommunications has actively participated.
4th-That The Forest Carbon Partnership Facility (FCPF) is a pilot and learning-generation project to be executed through a Fund established by the World Bank to assist a REDD country in its efforts to reduce its emissions from deforestation and/or forest degradation, providing them with financial and technical assistance to build capacities for the benefit of a future system of positive incentives for REDD+.
5th-That the Ministry of Environment, Energy and Telecommunications, together with the National Forest Financing Fund (FONAFIFO), submitted at the PC6 Assembly held within the framework of The Forest Carbon Partnership Facility (FCPF) meeting from June 28 to July 1, 2010, in Georgetown, Guyana, a proposal to develop the REDD+Costa Rica Strategy, which was accepted.
6th-That at the PC6 Participants Committee meeting, the implementation of the Readiness Preparation Proposal for REDD+ (R-PP) was approved through Resolution No. PC-2008-2, which aims to establish a readiness package for REDD+ consisting of a REDD+ Strategy, a National Monitoring, Reporting and Verification System, a National Reference Level, and a Socio-Environmental Management System.
7th-That through Resolution No. PC-2008-2, the Participants Committee of The Forest Carbon Partnership Facility (FCPF) approved a grant in favor of Costa Rica for an amount of $3.6 million US dollars, with the possibility of expansion up to $5 million US dollars.
8th-That on June 29, 2012, the Supplementary Grant Agreement for Costa Rica Readiness Preparation Proposal was signed between The Forest Carbon Partnership Facility (FCPF) and the National Forest Financing Fund (FONAFIFO) to implement the project.
9th-That to support the establishment and execution of the REDD+ Strategy, according to the terms and conditions established in the FCPF Readiness Donation Agreement between The Forest Carbon Partnership Facility (FCPF) and the National Forest Financing Fund (FONAFIFO), it is necessary to have infrastructure and logistics to carry out the project within the National Forest Financing Fund (FONAFIFO) for the execution of the REDD+Costa Rica Strategy, for which FONAFIFO will be responsible for the administration of Grant TF012692 for an amount of $3.6 million US dollars; in addition to seeking the collaboration of the institutions involved to achieve the project goals. Therefore, They Decree:
IMPLEMENTATION OF THE EXECUTIVE SECRETARIAT TO SUPPORT THE ESTABLISHMENT AND EXECUTION OF THE REDD+COSTA RICA STRATEGY
Considering:
The Executive Secretariat will be based at the National Forest Financing Fund (FONAFIFO) of the Ministry of Environment, Energy and Telecommunications, as the body responsible for the administration of the grant.
1. Support the Executive Committee.
2. Develop a communication strategy.
3. Preparation and execution of workshops with relevant involved groups, especially with peasant and indigenous communities.
4. Develop a preparation and consultation plan.
5. Development of the REDD+Costa Rica Strategy, carrying out studies on land use (uso del suelo), land use, forest policies, and governance, including land-use dynamics, forest degradation and restoration, and opportunity costs or alternative land use.
6. Develop studies to design a financing strategy for the REDD+Costa Rica Strategy.
7. Support the establishment of the implementation framework for the REDD+Costa Rica Strategy.
8. Execute a Socio-Environmental Assessment Strategy (SESA) for future REDD+Costa Rica activities, projects, or Strategies.
9. Development of a Reference Level, carrying out studies and fieldwork to develop a reference level for carbon stocks.
10. Design a measurement, reporting, and verification system for changes in carbon stocks and co-benefits of REDD+, considering the social and environmental impacts of the Payment for Environmental Services (Pago de Servicios Ambientales) program.
11. Act as a focal point and represent the country before the Forest Cooperative Fund, the REDD+ Project of the German Cooperation (GIZ), and any other project that supports the REDD+Costa Rica Strategy.
12. Maintain a record of accounted donations for REDD+ and report to the voluntary database kept for these purposes by the Forest Cooperative Fund.
13. Decide on the essential aspects of the Strategy in accordance with the best national interests.
14. Seek subsequent financing for the REDD+Costa Rica Strategy.
15. Prepare the final version of the REDD+ Strategy and submit it for approval to the Minister of Environment, Energy and Telecommunications.

7. Monitoring of the Socio-Environmental Management System (SESA).
8. Systematization of the consultation processes of all sectors and channeling the results.
9. Develop and approve the Regulations of the working group.
10. Guarantee the attention to complaints and their response.
11. Guarantee the proposal of the REDD+ Strategy with free, prior, and informed consent.

IMPLEMENTACIÓN DE LA SECRETARÍA EJECUTIVA DE APOYO PARA EL ESTABLECIMIENTO Y EJECUCIÓN DE LA ESTRATEGIA REDD+COSTA RICA
Considerando:
Decretan:
La Secretaría Ejecutiva tendrá su sede en el Fondo Nacional de Financiamiento Forestal (FONAFIFO) del Ministerio de Ambiente, Energía y Telecomunicaciones, como órgano responsable de la administración de la donación.
1. Apoyar al Comité Ejecutivo.
2. Desarrollar una estrategia de comunicación.
3. Preparación y ejecución de talleres con grupos involucrados relevantes especialmente con comunidades campesinas e indígenas.
4. Desarrollar un plan de preparación y consulta.
5. Desarrollo de la Estrategia de REDD+Costa Rica, realizando estudios de uso del suelo, uso de la tierra, políticas forestales y gobernanza, incluyendo la dinámica del uso de la tierra, la degradación y restauración de bosques y los costos de oportunidad o uso alternativo de la tierra.
6. Desarrollar los estudios para diseñar una estrategia de financiamiento de la Estrategia REDD+Costa Rica.
7. Apoyar el establecimiento del marco de la implementación de la Estrategia REDD+Costa Rica.
8. Ejecutar una Estrategia de Evaluación Socio Ambiental (SESA) de las futuras actividades, proyectos o Estrategias de REDD+Costa Rica.
9. Desarrollo de un nivel de Referencia llevando a cabo estudios y trabajo de campo para desarrollar un nivel de referencia para los stocks de carbono.
10. Diseñar un sistema de medición, reporte y verificación de los cambios en los stocks de carbono y co-beneficios de REDD+, considerando los impactos sociales y ambientales del programa de Pago por Servicios Ambientales.
11. Ejercer como punto focal y representar al país ante el Fondo Cooperativo de los Bosques, Proyecto REDD+ de la Cooperación Alemana (GIZ) y cualquier otro proyecto que apoye la Estrategia REDD+Costa Rica.
12. Llevar un registro de donaciones contabilizadas para REDD+ y reportar a la base de datos voluntaria que para estos efectos lleva el Fondo Cooperativo de los Bosques.
13. Decidir los aspectos esenciales de la Estrategia de acuerdo con los mejores intereses nacionales.
14. Buscar el Financiamiento posterior de la Estrategia REDD+Costa Rica.
15. Elaborar la versión final de la Estrategia REDD+ y someterla a aprobación del Ministro de Ambiente, Energía y Telecomunicaciones.
1. Un representante de los pequeños productores forestales.
2. Un representante de los industriales de la madera.
3. Un representante del sistema bancario nacional.
4. Un representante de los pueblos indígenas.
5. Un representante del Ministerio de Agricultura y Ganadería.
6. Un representante del Ministerio de Ambiente, Energía y Telecomunicaciones.
7. Un representante de la Sociedad Civil o de los dueños de terrenos en sobreuso.
Las funciones de este Comité Ejecutivo serán las siguientes:
1. Emitir las recomendaciones de políticas para REDD+.
2. Resolver los conflictos en el marco de la Propuesta de Preparación a REDD+.
3. Garantizar la participación sustancial y consistente de los actores claves involucrados.
4. Promover el intercambio e información coherente, transparente entre las partes interesadas relevantes.
5. Apoyar el diseño desarrollo e implementación de las políticas nacionales relativas a REDD+, incluyendo a todos los sectores y en los distintos niveles de gobierno.
6. Aprobación de Estudios Técnicos requeridos para la propuesta de preparación de REDD+.
7. Seguimiento del Sistema de Gestión Socio Ambiental (SESA).
8. Sistematización de los procesos de consulta de todos los sectores y canalizar los resultados.
9. Desarrollar y aprobar el Reglamento del grupo de trabajo.
10. Garantizar la atención de quejas y su respuesta.
11. Garantizar la propuesta de la Estrategia REDD+ con el consentimiento libre, previo e informado.
Estos recursos podrán ser administrados por el Fideicomiso 544 BNCR-FONAFIFO.
