in the entirety of the text - Full Text of Norm 40444 Increases the maximum budget expenditure set for 2017 for the National Groundwater, Irrigation, and Drainage Service (SENARA) Full Text acta: 118000 No. 40444-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Articles 25, subsection 1), 27, subsection 1), and 28, subsection 2), paragraph b) of Law No. 6227, the General Public Administration Law of May 2, 1978, and its reforms; Law No. 8 13 1, the Financial Administration of the Republic and Public Budgets Law of September 18, 2001, and its reforms; its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006, and its reforms; Law No. 6877, the Law Creating the National Groundwater, Irrigation, and Drainage Service (SENARA) of July 18, 1983, and its reforms; Executive Decree No. 32452-H of June 29, 2005, and its reforms; and Executive Decree No. 396 13-H, General Guidelines on Budgetary, Salary, Employment, Investment, and Indebtedness Policy for public entities, ministries, and deconcentrated bodies, as applicable, covered by the scope of the Budget Authority, for the year 2017, of March 3, 2016, and its reforms.

1. That through Law No. 6877, published in La Gaceta No. 143 of July 29, 1983, and its reforms, the National Groundwater, Irrigation, and Drainage Service (hereinafter SENARA) was created, as an autonomous institution of the State, with its own legal personality and administrative independence, politically subject to the institutional guidelines of the Minister of Agriculture and Livestock, whose objectives, among others, are to promote the country's agricultural development through the establishment and operation of irrigation, drainage, and flood protection systems, to seek the optimal and fair use of both surface and groundwater land and water resources in the country's agricultural activities, to contribute preferably to developing those agricultural development projects that are based on a just distribution of land, and to ensure that in the territory benefited by the creation of irrigation and drainage districts, a rational and democratic modification of land ownership is carried out.

2. That by means of official communication identified as SENARA-GG-0214-2017 of April third, two thousand seventeen, which was subsequently supplemented through official communication SENARA-GG-0221-2017 of April fifth, two thousand seventeen, the General Manager of SENARA, requested the increase of said entity's maximum budget expenditure for the year 2017, in the amount of ¢6,655,306,699.60 (six thousand six hundred fifty-five million three hundred six thousand six hundred ninety-nine colones and sixty céntimos), to budget the expenditures necessary to address the institutional management and the projects it executes. Said request was approved by the Board of Directors of that entity, according to Agreement No. 5399 of Regular Session No. 710-2017 of March 27, 2017, and was endorsed through official communication DM-MAG-11 1-2017 of February tenth, two thousand seventeen, by the Minister of Agriculture and Livestock.

3. That said amount must be increased by way of Executive Decree and will be financed with resources from both specific and free surplus. Of the indicated amount, ¢6,519,075,192.00 (six thousand five hundred nineteen million seventy-five thousand one hundred ninety-two colones exact), come from specific surplus, to cover expenditures of the Water Supply System Project for the Middle Basin of the Río Tempisque and Coastal Communities (Proyecto Sistema de Abastecimiento de Agua para la Cuenca Media del Río Tempisque y Comunidades Costeras, PAACUME), the Integrated Water Resources Management Program (Programa de Gestión Integrada de Recursos Hídricos, PROGIRH), the Flood Control System Project in the Limoncito de Limón Area (Proyecto Sistema de Control de Inundaciones en el Área de Limoncito de Limón, PSCIAL), and the Arenal Tempisque Irrigation District (Distrito de Riego Arenal Tempisque, DRAT), as well as to reinforce the "Durable Goods" Budget Line; and with free surplus of ¢136,231,507.60 (one hundred thirty-six million two hundred thirty-one thousand five hundred seven colones and sixty céntimos) to make the current transfer to the National Institute for Innovation and Transfer in Agricultural Technology (Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria), and to reinforce the sub-line "installations"; all of the foregoing expenditures being considered necessary to fulfill the institution's objectives.

4. That through Executive Decree No. 39613-H, published in Alcance No. 46 to La Gaceta No. 61 of March 30, 2016, and its reforms, the General Guidelines on Budgetary, Salary, Employment, Investment, and Indebtedness Policy were issued for public entities, ministries, and deconcentrated bodies, as applicable, covered by the scope of the Budget Authority, for the year 2017, determining in Article 12, that for public entities and deconcentrated bodies, the maximum budget expenditure for the year 2017 will be established based on the projection of total revenues (current, capital, and financing) for 2017, defined by the public entities and deconcentrated bodies in coordination with the Technical Secretariat of the Budget Authority (hereinafter STAP). For this purpose, the STAP used as input the historical revenue series for the 2013-2015 period, as well as the revenue estimate for the years 2016 and 2017 that the entities and deconcentrated bodies provided no later than the last day of March 2016.

5. That in accordance with said provision, the resulting maximum budget expenditure amount for the year 2017 for SENARA was established at the sum of ¢11,862,070,000.00 (eleven thousand eight hundred sixty- two million seventy thousand colones exact), which was communicated through official communication STAP-0658-2016 of April 29, 2016, a figure that does not contemplate the expenditure indicated previously in this decree.

6. That through Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005, and its reforms, the "Guideline for the application of Article 6 of Law No. 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the Public Sector revenue class called Financing" is issued.

7. That Article 7 of the Decree cited in the preceding considering clause provides that financing resources coming from previous fiscal years —free surplus— are part of the equity of the bodies and entities and may be used in subsequent periods to finance expenditures related to their ordinary activity, which serve the public interest, public service, and institutional purposes, provided they are not permanent in nature or generate an obligation that requires financing over time, such as the creation of positions for fixed posts, or any other commitment of the same nature.

8. That in relation to specific surplus, Section 9 of the aforementioned Executive Decree No. 32452-H enables its use for the payment of expenditures defined in the purposes established in the special or legal provisions applicable to such resources.

9. That due to the foregoing, it is necessary to increase the maximum budget sum of ¢6,655,306,699.60 (six thousand six hundred fifty-five million three hundred six thousand six hundred ninety-nine colones and sixty céntimos).

Therefore; They decree:

Considering:

PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley No. 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley No. 8 13 1, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo No. 32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas; la Ley No. 6877, Ley de Creación del Servicio Nacional de Aguas, Riego y Avenamiento (SENARA) del 18 de julio de 1983 y sus reformas; el Decreto Ejecutivo No. 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto Ejecutivo No. 396 13-H, Directrices Generales de Política Presupuestaria, Salarial, Empleo, Inversión y Endeudamiento para entidades públicas, ministerios y órganos desconcentrados, según corresponda, cubiertos por el ámbito de la Autoridad Presupuestaria, para el año 2017, de 3 de marzo de 2016 y sus reformas.

1. Que mediante la Ley No. 6877, publicada en La Gaceta No. 143 del 29 de julio de 1983 y sus reformas, se crea el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (en adelante SENARA), como una institución autónoma del Estado, que cuenta con personalidad jurídica propia e independencia administrativa, sujeta políticamente a las directrices institucionales del Ministro de Agricultura y Ganadería, cuyos objetivos entre otros, son fomentar el desarrollo agropecuario del país, mediante el establecimiento y funcionamiento de sistemas de riego, avenamiento y protección contra inundaciones, procurar el aprovechamiento óptimo y justo de los recursos de tierra y aguas tanto superficiales como subterráneas en las actividades agropecuarias del país, contribuir a desarrollar preferentemente aquellos proyectos de desarrollo agropecuario que se sustenten en una justa distribución de la tierra y procurar que en el territorio beneficiado por la creación de distritos de riego y avenamiento, se efectúe una modificación racional y democrática en la propiedad de la tierra.

2. Que mediante el oficio identificado como SENARA-GG-0214-2017 del tres de abril de 2017, que fue posteriormente complementado por medio del oficio SENARA-GG-0221-2017 del cinco de abril de 2017, la Gerente General del SENARA, solicitó la ampliación del gasto presupuestario máximo de dicho ente para el año 2017, en un monto de ¢6.655.306.699,60 (seis mil seiscientos cincuenta y cinco millones trescientos seis mil seiscientos noventa y nueve colones con sesenta céntimos), con el fin de presupuestar gastos necesarios para atender la gestión institucional y los proyectos que ejecuta. Dicha solicitud fue aprobada por la Junta Directiva de ese ente, según Acuerdo No. 5399 de la Sesión Ordinaria No. 710-2017 de 27 de marzo del 2017 y fue avalada mediante el oficio DM-MAG-11 1-2017 del diez de febrero de 2017, por el Ministro de Agricultura y Ganadería.

3. Que dicho monto, corresponde ser ampliado por la vía del Decreto Ejecutivo, y será financiado con recursos provenientes de superávit tanto específico como libre. Del monto señalado, 06.519.075.192,00 (seis mil quinientos diecinueve millones setenta y cinco mil ciento noventa y dos colones exactos), provienen de superávit específico, para atender gastos del Proyecto Sistema de Abastecimiento de Agua para la Cuenca Media del Río Tempisque y Comunidades Costeras (PAACUME), del Programa de Gestión Integrada de Recursos Hídricos (PROGIRH), del Proyecto Sistema de Control de Inundaciones en el Área de Limoncito de Limón (PSCIAL), y del Distrito de Riego Arenal Tempisque (DRAT), así como a reforzar la Partida de "Bienes Duraderos"; y con superávit libre 0136.231.507,60 (ciento treinta y seis millones doscientos treinta y un mil quinientos siete colones con sesenta céntimos) para realizar la transferencia corriente al Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria, y a reforzar la subpartida "instalaciones"; siendo todos los anteriores gastos que se consideran necesarios para cumplir los objetivos de la institución.

4. Que mediante el Decreto Ejecutivo No. 39613-H, publicado en el Alcance No. 46 a La Gaceta No. 61 de 30 de marzo de 2016 y sus reformas, se emitieron las Directrices Generales de Política Presupuestaria, Salarial, Empleo, Inversión y Endeudamiento para entidades públicas, ministerios y órganos desconcentrados, según corresponda, cubiertos por el ámbito de la Autoridad Presupuestaria, para el año 2017, determinándose en el artículo 12, que para las entidades públicas y órganos desconcentrados, el gasto presupuestario máximo del año 2017, se establecerá con base en la proyección de ingresos totales (corrientes, capital y financiamiento) 2017, definida por las entidades públicas y órganos desconcentrados en coordinación con la Secretaría Técnica de la Autoridad Presupuestaria (en adelante STAP). Para tal efecto, la STAP utilizó como insumo la serie histórica de ingresos del periodo 2013-2015, así como la estimación de ingresos para los años 2016 y 2017 que suministraron las entidades y órganos desconcentrados a más tardar ci último día del mes de marzo del año 2016.

5.Que en correspondencia con dicha disposición, el monto de gasto presupuestario máximo para el año 2017 resultante para el SENARA, fue establecido en la suma de 011.862.070.000,00 (once mil ochocientos sesenta y dos millones setenta mil colones exactos), el cual fue comunicado mediante el oficio STAP-0658-2016 del 29 de abril del 2016, cifra que no contempla el gasto indicado previamente en este decreto.

6. Que mediante el Decreto Ejecutivo No. 32452-H, publicado en La Gaceta No. 130 de 6 de julio de 2005 y sus reformas, se emite el "Lineamiento para la aplicación del artículo 6° de la Ley No. 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".

7. Que el artículo 7° del Decreto citado en el considerando anterior, dispone que los recursos de financiamiento que provienen de vigencias anteriores -superávit libre- son parte del patrimonio de los órganos y las entidades y pueden utilizarlos en períodos subsiguientes para financiar gastos que se refieran a la actividad ordinaria de éstas, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, siempre que no tengan el carácter permanente o generen una obligación que requiera financiarse a través del tiempo, como la creación de plazas para cargos fijos, o cualquier otro compromiso de la misma naturaleza.

8. Que en relación con el superávit específico, el numeral 9° del referido Decreto Ejecutivo No. 32452-H, posibilita la utilización de éste, para el pago de gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a tales recursos.

9. Que por lo anterior, resulta necesario ampliar el gasto presupuestario máximo fijado al SENARA para el año 2017, incrementándolo en la suma de 06.655.306.699,60 (seis mil seiscientos cincuenta y cinco millones trescientos seis mil seiscientos noventa y nueve colones con sesenta céntimos).

Por tanto;

Ampliación del gasto presupuestario máximo para el año 2017 del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento

Considerando:

Decretan:
