in the entirety of the text - Complete Text of Standard 40428 N° 40428-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by articles 140 subsections 3) and 18) and 146 of the Constitution; articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of Law N° 6227, General Law of Public Administration of May 2, 1978 and its amendments; Law N° 8131, Law of Financial Administration of the Republic and Public Budgets of September 18, 2001 and its amendments; its Regulation, Executive Decree N° 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law N° 8023 of September 27, 2000, Law for the Management and Administration of the Reventazón River Basin and its amendment; Executive Decree N° Executive Decree N° 30331-MINAE of March 8, 2002, Regulation to the Law for the Management and Administration of the Upper Reventazón River Basin; Executive Decree N° 32452-H of June 29, 2005 and its amendments; and Executive Decree N° 39613-H of March 3, 2016 and its amendments.

1. 1That through Law N° 8023, published in La Gaceta N° 203 of October 24, 2000, the Commission for the Management and Administration of the Reventazón River Basin was created, hereinafter COMCURE, as a body of maximum deconcentration of the Ministry of Environment and Energy, which shall have instrumental legal personality for the administration of its material, human, budgetary, and financial resources; to define, execute, and control the Plan for the management and administration of the Reventazón river basin, with the support of its functional structure.
2. 2That through official letter COMCURE 501-2016 received on December 15, 2016; COMCURE 055-2017 received on January 16, 2017, the Manager of COMCURE requested to increase the maximum budgetary expenditure of said institution for 2017, by a total amount of ¢102,600,000.50 (one hundred two million six hundred thousand colones and 50/100), for the purpose of complying with what is established in the Budget and the Institutional Operational Plan for the year 2017. Said request has the endorsement of the Minister of Environment and Energy, granted through official letters DM-1163-2016 dated December 21, 2016, and DM-0069-2017 dated January 23, 2017.
3. 3That of said amount, the sum of ¢39,000,000.00 (thirty-nine million colones exactly) is to be

from free surplus (superávit libre), to be used to address institutional needs in specific areas of maintenance and equipment repair, conducting Environmental Education workshops, purchase of machinery and equipment for production, required for the execution of the Conservationist Livestock Program, additional requirements for Durable Goods, which are fundamental to execute the Horticultural Greenhouses Project in the lower basin (Cuenca baja), as well as the purchase of a work vehicle.

1. 4That the expansion of the sum ¢6,000,000.00 (six million colones exactly) incorporated in the sub-item of "Engineering Services" is disapproved, because it contravenes the provisions of paragraph f) of article 7 of Executive Decree N° 32452-H, published in La Gaceta N° 130 of July 6, 2005, and its amendments, which establishes that resources from free surplus (superávit libre) may not finance expenses under the sub-item of "Management and support services".
2. 5That through Executive Decree N° 39613-H, published in Supplement N° 46 to La Gaceta N° 61 of March 30, 2016, and its amendments, the General Policy Guidelines for Budgetary, Salary, Employment, Investment, and Indebtedness for the year 2017 were issued, establishing in article 12 that for public entities and deconcentrated bodies, the maximum budgetary expenditure for the year 2017 shall be established based on the projection of total revenues (current, capital, and financing) for 2017, defined by public entities and deconcentrated bodies in coordination with the Technical Secretariat of the Budgetary Authority (STAP). For this purpose, the STAP shall use as input the historical series of revenues for the period 2013-2015, as well as the revenue estimate for the years 2016 and 2017 provided by the entities and deconcentrated bodies no later than the last day of March 2016.
3. 6That in correspondence with said provision, the amount of the maximum budgetary expenditure for the year 2017 resulting for COMCURE was established at the sum of ¢251,700,000.00 (two hundred fifty-one million seven hundred thousand colones exactly), which was communicated in official letter STAP-0587-2016 of April 26, 2016; a figure that does not contemplate the expenditure previously indicated in this decree.
4. 7That through Executive Decree N° 32452-H, the "Guideline for the application of article 6 of Law N° 8131, Law of Financial Administration of the Republic and Public Budgets, and the regulation of the class of Public Sector revenues called Financing" is issued.
5. 8That article 7 of the Decree cited in the previous considering clause provides that financing resources coming from prior periods—free surplus (superávit libre)—are part of the equity of the bodies and entities and may be used in subsequent periods to finance expenditures related to their ordinary activity, with which the interest of the community, the public service, and the institutional goals are addressed, provided they do not have a permanent nature or generate an obligation requiring financing over time, such as the creation of permanent positions, or any other commitment of the same nature.
6. 9That due to the foregoing, it is necessary to expand the maximum budgetary expenditure set for COMCURE for the year 2017, increasing it by the sum of ¢39,000,000.00 (thirty-nine million colones exactly). Therefore:

Considering:

en la totalidad del texto - Texto Completo Norma 40428 Amplía para la Comisión para el Ordenamiento y Manejo de la Cuenca del Río Reventazón (COMCURE), el gasto presupuestario máximo fijado para el 2017 N° 40428-H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley N° 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley N° 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo N° 32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas; Ley N° 8023 del 27 de setiembre de 2000, Ley de Ordenamiento y Manejo de la Cuenca del Río Reventazón y su reforma; el Decreto Ejecutivo N° Decreto Ejecutivo N° 30331-MINAE del 8 de marzo de 2002, Reglamento a la Ley del Ordenamiento y Manejo de la Cuenca Alta del Río Reventazón; el Decreto Ejecutivo N° 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto Ejecutivo N° 39613-H de 3 de marzo de 2016 y sus reformas.

1. 1Que mediante la Ley N° 8023, publicada en La Gaceta N° 203 de 24 de octubre de 2000, se crea la Comisión para el Ordenamiento y Manejo de la Cuenca del Río Reventazón, en adelante COMCURE, como un órgano de máxima desconcentración del Ministerio de Ambiente y Energía, la cual tendrá personalidad jurídica instrumental para la administración de sus recursos materiales, humanos, presupuestarios y financieros; para definir, ejecutar y controlar el Plan de ordenamiento y manejo de la cuenca del río Reventazón, con el apoyo de su estructura funcional.
2. 2Que mediante el oficio COMCURE 501-2016 recibido el 15 de diciembre de 2016; COMCURE 055-2017 recibido el 16 de enero de 2017, el Gerente del COMCURE solicitó incrementar el gasto presupuestario máximo de dicha institución para el 2017, por un monto total de ¢102.600.000,50 (ciento dos millones seiscientos mil colones con 50/100), con la finalidad de cumplir con lo establecido en el Presupuesto y el Plan Operativo Institucional para el año 2017. Dicha solicitud cuenta con el aval del señor Ministro de Ambiente y Energía, otorgado mediante los oficios DM-1163-2016 de fecha 21 de diciembre de 2016 y DM-0069-2017 de fecha 23 de enero de 2017.
3. 3Que de dicho monto, corresponde ser ampliado por la vía de Decreto Ejecutivo la suma de ¢39.000.000,00 (treinta y nueve millones de colones exactos), la cual será sufragada con recursos provenientes de superávit libre, que se utilizarán para solventar necesidades institucionales en áreas específicas de mantenimiento y reparación de equipo, impartir talleres de Educación Ambiental, compra de maquinaria y equipo para la producción, requerido para la ejecución del Programa de Ganadería Conservacionista, requerimientos adicionales de Bienes Duraderos, que son fundamentales para ejecutar el Proyecto de Invernaderos Hortícolas en la Cuenca baja, así como la compra de un vehículo de trabajo.
4. 4Que se imprueba la ampliación por la suma ¢6.000.000,00 (seis millones de colones exactos) incorporados en la subpartida de "Servicios de Ingeniería", por cuanto contraviene lo dispuesto en el inciso f) del artículo 7 del Decreto Ejecutivo N° 32452-H, publicado en La Gaceta N° 130 de 6 de julio de 2005 y sus reformas, el cual establece que con recursos provenientes del superávit libre no se podrán financiar gastos de la subpartida de "Servicios de gestión y apoyo".
5. 5Que mediante el Decreto Ejecutivo N° 39613-H, publicado en el Alcance N° 46 a La Gaceta N° 61 de 30 de marzo de 2016 y sus reformas, se emitieron las Directrices Generales de Política Presupuestaria, Salarial, Empleo, Inversión y Endeudamiento, para el año 2017, estableciéndose en el artículo 12, que para las entidades públicas y órganos desconcentrados, el gasto presupuestario máximo del año 2017, se establecerá con base en la proyección de ingresos totales (corrientes, capital y financiamiento) 2017, definida por las entidades públicas y órganos desconcentrados en coordinación con la Secretaría Técnica de la Autoridad Presupuestaria (STAP). Para tal efecto, la STAP utilizará como insumo la serie histórica de ingresos del periodo 2013-2015, así como la estimación de ingresos para los años 2016 y 2017 que suministren las entidades y órganos desconcentrados a más tardar el último día del mes de marzo del año 2016.
6. 6Que en correspondencia con dicha disposición, el monto de gasto presupuestario máximo para el año 2017 resultante para la COMCURE, fue establecido en la suma de ¢251.700.000,00 (doscientos cincuenta y un millones setecientos mil colones exactos), el cual fue comunicado en el oficio STAP-0587-2016 del 26 de abril de 2016; cifra que no contempla el gasto indicado previamente en este decreto.
7. 7Que mediante el Decreto Ejecutivo N° 32452-H, se emite el "Lineamiento para la aplicación del artículo 6 de la Ley N° 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
8. 8Que el artículo 7° del Decreto citado en el considerando anterior, dispone que los recursos de financiamiento que provienen de vigencias anteriores -superávit libre- son parte del patrimonio de los órganos y las entidades y pueden utilizarlos en períodos subsiguientes para financiar gastos que se refieran a la actividad ordinaria de éstas, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, siempre que no tengan el carácter permanente o generen una obligación que requiera financiarse a través del tiempo, como la creación de plazas para cargos fijos, o cualquier otro compromiso de la misma naturaleza.
9. 9Que por lo anterior, resulta necesario ampliar el gasto presupuestario máximo fijado a la COMCURE para el año 2017, incrementándolo en la suma de ¢39.000.000,00 (treinta y nueve millones de colones exactos). Por tanto:
