in the entirety of the text - Complete Text of Standard 021 Reform of Sustainability Standards for Natural Forest Management: Code of Practices NATIONAL SYSTEM OF CONSERVATION AREAS R-SINAC-CONAC-021-2017.—Executive Secretariat, at fourteen hours and forty minutes on the eighth of May, 2017.
The National Council of Conservation Areas, in accordance with Agreement No. 28 of ordinary session No. 02-2017, held on February 27, 2017, and in compliance with articles 12 and 15, subsection a) of the Regulation to the Biodiversity Law No. 7788, Executive Decree No. 34433-MINAE, approves and issues the following:
"Modification to Resolution R-SINAC-021-2009, Code of Practices of the Sustainability Standards for the management of Natural Forests"
Whereas:
7788 of May 27, 1998, the National System of Conservation Areas (SINAC) is created, with instrumental legal personality, as a decentralized and participatory institutional management and coordination system, which integrates competencies in forestry, wildlife, and protected areas matters, for the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of the natural resources of Costa Rica.
34559-MINAE was published, which established the Sustainability Standards for the Natural Forest of Costa Rica, with the purpose that producers manage their forests sustainably, ensuring the permanence of the same, the integrality of their farms, and receiving a socioeconomic retribution for the conservation effort made.
77 of April 22, 2009, the National System of Conservation Areas issues the Code of Practices of the Sustainability Standards for the management of Natural Forests,
I.That it is the responsibility of the National System of Conservation Areas of the Ministry of Environment and Energy (MINAE), to resolve inconsistencies and update the regulations that are issued and other related regulations.
II.That it is necessary to define the concept of undetermined species contained in resolution R-SINAC-021-2009 dated the twenty-second of April of the year 2009, in order to establish its ecological guild (gremio ecológico), avoid erroneously expanding the percentage of ephemeral heliophytes (heliófitas efímeras), and facilitate both SINAC personnel and the administered parties in the processing of natural forest management plan applications.
III.That the National Council of Conservation Areas (CONAC) needs to make modifications to resolution R-SINAC-021-2009 in order to facilitate the interpretation of terminology related to ecological guilds (gremios ecológicos) within the Code of Practices of the Sustainability Standards for the management of Natural Forests and to facilitate both SINAC personnel and the administered parties in the processing of natural forest management plan applications.
IV.That CONAC, in Agreement No. 28 of the Ordinary Session No. 02-2017, held on February 27, 2017, agreed to modify the specific points of resolution R-SINAC-021-2009, related to the undetermined species included in the Code of Practices of the Sustainability Standards for the management of Natural Forests. Therefore,
THE NATIONAL COUNCIL OF CONSERVATION AREAS, RESOLVES:
Modify the sections indicated below of resolution R-SINAC-021-2009 dated the twenty-second of April of the year 2009, published in La Gaceta No. 77 of April 22, 2009, as follows:

"III.—TERMINOLOGY .
● Ecological Guilds (Gremios ecológicos): classification based on the light requirements for the germination and establishment of forest species and palms. For practical purposes, three guilds are considered:
Ephemeral heliophytes (Heliófitas efímeras): are species that require high levels of light for their germination and establishment, such that their recruitment is restricted to very young successional stages or large forest clearings. Generally, they are species that do not represent value from a timber perspective and their lifespan is short (between 15 to 50 years).
Durable heliophytes (Heliófitas durables): are species that are established in early successional stages, but have a considerably greater longevity than ephemeral heliophyte (heliófitas efímeras) species (Budowski, 1965; Finegan, 1996). This group of species has, for its regeneration, a broader range of requirements than ephemeral heliophyte (heliófitas efímeras) species (Finegan, 1996), and dominates the last phase of secondary succession (e.g. Budowski, 1965; Finegan, 1996; Richards, 1996). Currently, there is great interest in this group due to economic reasons and because they have high growth rates and are present in secondary forests at high densities (e.g. Müller and Solís, 1997). This group includes several species of high commercial value such as: pilón, almendro, cedro amargo, caoba.
Sciophytic species (Especies esciófitas): are species that can be established and develop under low light levels, so they can regenerate in successional stages dominated by heliophyte (heliófitas) species. Due to the above, the management of these ecological guilds (gremios ecológicos) has become a practical option for managing forests rich in floristic diversity, in contrast to the management of individual species (Panayotou and Ashton 1992). The State Forest Administration, through the National Forest Sustainability Commission (CNSF) shall form an Expert Subcommittee for the review and updating of those species that could not be classified into these ecological guilds (gremios ecológicos), which shall be designated as undetermined. Those individuals that cannot be identified shall be designated as unknown species."

"VI.—FINAL PROVISIONS .
● Management Plan System (Sistema de Planes de Manejo, SIPLAMA) The forestry professional responsible for the preparation of the Management Plan must use the "SIPLAMA electronic template" for the processing of field information and to verify if the forest conditions allow or not its harvesting (aprovechamiento). The information shall be recorded in the database established by the AFE for that purpose."
The forest subject to harvesting (aprovechamiento) must be under a Maximum Reference Value (Valor de Referencia Máximo, VRMx) of abundance of the ephemeral heliophyte (heliófitas efímeras) species guild. The abundance of trees of the ecological guild (gremio ecológico) composed of ephemeral heliophyte (heliófitas efímeras) species must not exceed 15% of the total trees above 10 cm dbh, based on the results of the number of trees from the inventory by sampling. Graphically, the use of the threshold is represented as shown in Figure 4.
The proportion of individuals above 10 cm dbh belonging to the ecological guild (gremio ecológico) of ephemeral heliophytes (heliófitas efímeras) estimated from the forest inventory (H) must be statistically less than or equal to 15%.

El Consejo Nacional de Áreas de Conservación, de conformidad al Acuerdo N° 28 de la sesión ordinaria N° 02-2017, celebrada el 27 de febrero del 2017, y en cumplimiento de los artículos 12 y 15 inciso a) del Reglamento a la Ley de Biodiversidad N° 7788, Decreto Ejecutivo N° 34433-MINAE, aprueba y emite la presente:
"Modificación a la Resolución R-SINAC-021-2009, Código de Prácticas de los Estándares de Sostenibilidad para el manejo de los Bosques Naturales"
Resultando:
I.Que corresponde al Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía (MINAE), resolver las inconsistencias y actualizar las normativas que se emiten y otra normativa relacionada.
II.Que requiere definirse el concepto de especies indeterminadas contenido en la resolución R-SINAC-021-2009 de fecha veintidós de abril del año 2009, a fin de establecer su gremio ecológico, evitar erróneamente la ampliación del porcentaje de las heliófitas efímeras y facilitar tanto al personal del SINAC como a los administrados, el trámite de la solicitud de los planes de manejo de bosque natural.
III.Que el Consejo Nacional de Áreas de Conservación (CONAC) requiere realizar modificaciones a la resolución R-SINAC-021-2009 con el fin de facilitar la interpretación de terminología referida a los gremios ecológicos dentro del Código de Prácticas de los Estándares de Sostenibilidad para el manejo de los Bosques Naturales y facilitar tanto al personal del SINAC como a los administrados, el trámite de la solicitud de los planes de manejo de bosque natural.
IV.Que el CONAC en Acuerdo N° 28 de la Sesión Ordinaria N° 02-2017, celebrada el 27 de febrero del 2017, acordó modificar los puntos específicos de la resolución R-SINAC-021-2009, referido a las especies indeterminadas incluidos en el Código de Prácticas de los Estándares de Sostenibilidad para el manejo de los Bosques Naturales. Por tanto,
EL CONSEJO NACIONAL DE ÁREAS DE CONSERVACIÓN, RESUELVE:
Modifíquese los apartados que a continuación se indican de la resolución R-SINAC-021-2009 de fecha veintidós de abril del año 2009, publicada en La Gaceta N° 77 del 22 de abril del 2009, de la siguiente manera:

"III.-TERMINOLOGÍA .
● Gremios ecológicos: clasificación basada en los requerimientos de luz para la germinación y establecimiento de especies forestales y palmas. Para efectos prácticos se consideran tres gremios:
Heliófitas efímeras: son especies que requieren de altos niveles de luz para su germinación y establecimiento, de tal manera que su reclutamiento está restringido a etapas sucesionales muy jóvenes o a claros de bosque grandes. Por lo general son especies que no representan valor desde el punto de vista maderero y su vida es corta (entre 15 a 50 años).
Heliófitas durables: son especies que se establecen en etapas sucesionales tempranas, pero tienen una longevidad considerablemente mayor a las especies heliófitas efímeras (Budowski, 1965; Fine gan, 1996). Este grupo de especies tiene para su regeneración un rango de requerimientos más amplio que las especies heliófitas efímeras (Finegan,1996), y domina la última fase de la sucesión secundaria (e.g. Budowski, 1965; Fine gan, 1996; Richards, 1996). Actualmente existe un gran interés por este grupo debido a razones económicas y a que tienen altas tasas de crecimiento y están presentes en bosques secundarios en altas densidades (e.g. Müller y Solís, 1997). Este grupo incluye varias especies de alto valor comercial tales como: pilón, almendro, cedro amargo, caoba.
Especies esciófitas: son especies que pueden establecerse y desarrollarse con bajos niveles de iluminación, por lo que se pueden regenerarse en etapas sucesionales dominadas por especies heliófitas. Debido a lo anterior, el manejo de estos gremios ecológicos se ha convertido en una opción práctica para manejar bosques ricos en diversidad florística, en contraste al manejo de especies individuales (Panayotou y Ashton 1992). La Administración Forestal del Estado, a través de la Comisión Nacional de Sostenibilidad Forestal (CNSF) conformará una Subcomisión de Expertos, para la revisión y actualización de aquellas especies que no se hayan podido clasificar en estos gremios ecológicos, las cuales se denominaran como indeterminadas. Aquellos individuos que no logren ser identificados, se señalarán como especies desconocidas."

"VI.-DISPOSICIONES FINALES .
● Sistema de Planes de Manejo (SIPLAMA) El profesional forestal encargado de la elaboración del Plan de Manejo, deberá utilizar la "Plantilla electrónica del SIPLAMA" para el procesamiento de la información de campo y verificar si las condiciones del bosque permiten o no, realizar su aprovechamiento. La información quedará registrada en la base de datos, establecida por la AFE para dicho fin."
"1.4.2. Valor de Referencia Máximo del porcentaje del gremio de las especies heliófitas efímeras.
El bosque sujeto de aprovechamiento debe encontrarse bajo un Valor de Referencia Máximo (VRMx) de abundancia del gremio de las especies heliófitas efímeras. La abundancia de los árboles del gremio ecológico conformado por las especies heliófitas efímeras no debe superar el 15% del total de árboles arriba de 10 cm dap, con base en los resultados del número de árboles del inventario por muestreo. Gráficamente la utilización del umbral se representa como lo muestra la Figura 4.
La proporción de individuos arriba de 10 cm de dap pertenecientes al gremio ecológico de heliófitas efímeras estimado a partir del inventario forestal (H) debe ser estadísticamente menor o igual al 15%.
