in the entirety of the text - Complete Text of Norm 158 Establishes the withdrawal of the Semi-Industrial Shrimp Trawl Fleet in the Pacific Ocean and marine spaces for sustainable shrimp harvesting for the small-scale fishing fleet in the Caribbean Sea INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA (This norm was repealed by agreement AJDIP/474-2017 of November 10, 2017 "Establishes a new commercial fishing License for the sustainable harvesting of the shrimp resource") AJDIP/158-2017.-Puntarenas, on the twentieth day of April, two thousand seventeen.

1. 1That by Presidential Directive Number 021-P published in the Official Gazette La Gaceta No. 101 of May 27, 2015, called "Para la Generación de una Política Nacional de Aprovechamiento Sostenible de Camarón, Generación de Empleo y Combate a la Pobreza" in its article 4°, the semi-industrial shrimp sector is requested and urged to initiate a voluntary process of a series of measures proposed by said sector, among which is the content in subsection c) that textually indicates "the withdrawal of 15 meters of bathymetry along the Pacific Coast", said measure began to be made effective through Agreement AJDIP-483-2015 published in La Gaceta No. 52 of March 15, 2016, extended according to agreement number AJDIP-213-2016 (09/06/2017).
2. 2That article 50 of the Political Constitution, in accordance with the precautionary and preventive principles, as well as the principle of democratic access to fishery resources, determines that it is an obligation of the Costa Rican State to adopt the necessary measures aimed at protecting fishery resources and guaranteeing the sustainable development of the fishing activity, through the implementation of responsible fishing practices in accordance with the ecosystem approach to the activity (EEP).
3. 3That in accordance with Law 7384, the Law Creating the Instituto Costarricense de Pesca y Acuicultura, as well as Law 8436, the Law of Fishing and Aquaculture, it is the responsibility of INCOPESCA as the executive authority for Fishing and Aquaculture: "To regulate the rational harvesting of fishery resources, tending to achieve greater economic yields, the protection of marine and aquaculture species."
4. 4That the Research Working Group, within the framework of the Dialogue Table process for the management of shrimp fishing, carried out exhaustive work over more than nine work sessions with the contribution of its members (small-scale fishing and mollusk sector, semi-industrial trawl and sardine fishing sector, sport-tourism fishing sector, academy, SINAC, Defensoría de los Habitantes, civil society, among others), to elaborate a participatory zoning map, along the entire Pacific coast and a work session was also held for participatory mapping in the Caribbean zone, with the objective of sustainably regulating the activities related to shrimp fishing. This process was coordinated by members of the academy and was also informed by, in addition to the traditional knowledge of the fishing sectors involved, the scientific knowledge of both the academy and the competent government institutions, so that the input is a very complete and consensual map showing the zones established for the withdrawal of the semi-industrial shrimp trawl fleet in the Pacific Ocean (annex 1), the marine spaces with available resource for sustainable shrimp harvesting for the small-scale commercial fleet in the Caribbean Sea (annex 2), the priority research zones (annex 3) and priority conservation features, such as turtle nesting, coral, reefs, mangrove, seagrass, seamounts, marine areas for responsible fishing, marine protected areas, marine mammal sighting and the Costa Rica thermal dome and upwellings (annex 4).
5. 5That at the National Dialogue Table on the Management of Shrimp Fishing held on October 7, 2016, said zoning map, elaborated over nine months, was presented and the agreement was made to approve said participatory map and begin the arrangements for it to be used as an input for the management and spatial planning (ordenamiento) of the fisheries it is aimed at by the competent authorities.
6. 6That the Instituto Geográfico Nacional (IGN), through official note DIG-0134-2017, of April 5 of the current year, sends maps provided by INCOPESCA which have been verified regarding the use of official cartographic data at the country outline level and its various represented basic geographic elements, as well as in the final composition of the maps, which is the competence of the IGN, in order to have a map officially endorsed by this institute, where the necessary adjustments were made to the proposed zoning in order to improve its operability, as was recommended by the Servicio Nacional de Guardacostas. In addition, the exact geographic coordinates of the zoning limits were determined.
7. 7That the participatory zoning map, both for the Pacific Ocean and for the Costa Rican Caribbean Sea, corresponds to an arduous effort to improve the management of the fisheries along the Pacific and Caribbean coast of our country, and must be understood as a flexible process, which can change, be improved or updated according to the best available scientific knowledge and scientific research that is carried out by the academy and competent institutions, in addition to changes in the populations of marine organisms, among others.
8. 8That the Board of Directors of INCOPESCA through agreement AJDIP-145-2017 adopted in session 014-2017 of April 6, 2017, approved the participatory zoning map that serves as the basis for establishing the present agreement.
9. 9That having analyzed in depth the regulatory proposal presented, the Members of the Board of Directors deem it appropriate to attend favorably to the supra proposal; reason for which,

REGULATION THAT ESTABLISHES THE WITHDRAWAL OF THE SEMI-INDUSTRIAL SHRIMP TRAWL FLEET IN THE PACIFIC OCEAN AND MARINE SPACES FOR SUSTAINABLE SHRIMP HARVESTING FOR THE SMALL-SCALE COMMERCIAL FISHING FLEET IN THE CARIBBEAN SEA TO CARRY OUT FISHING TASKS ACCORDING TO THE MAPS OF PARTICIPATORY ZONING ELABORATED BY THE RESEARCH WORKING GROUP, WITHIN THE FRAMEWORK OF THE DIALOGUE TABLE FOR THE MANAGEMENT OF SHRIMP FISHING

1. 1Que mediante Directriz Presidencial Número 021-P publicada en el Diario Oficial La Gaceta N°. 101 del 27 de mayo de 2015, denominada "Para la Generación de una Política Nacional de Aprovechamiento Sostenible de Camarón, Generación de Empleo y Combate a la Pobreza" en su artículo 4° se solicita e insta al sector semi-industrial camaronero a iniciar un proceso voluntario de una serie de medidas propuestas por dicho sector, entre las cuales está el contenido en inciso c) que textualmente indica "el alejamiento de 15 metros de batimetría a lo largo de la Costa Pacífica", dicha medida se comenzó a hacer efectiva mediante el Acuerdo AJDIP-483-2015 publicado en La Gaceta N° 52 del 15 de marzo del 2016, prorrogado según acuerdo número AJDIP-213-2016 (09/06/2017).
2. 2Que el artículo 50 de la Constitución Política, en concordancia con los principios precautorio y preventivo, así como el principio de acceso democrático a los recursos pesqueros, determina que es obligación del Estado Costarricense, adoptar las medidas necesarias tendientes a proteger los recursos pesqueros y garantizar el desarrollo sostenible de la actividad pesquera, mediante la realización de prácticas de pesca responsable en concordancia con el enfoque eco sistémico de la actividad (EEP).
3. 3Que de conformidad con la Ley 7384, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, así como la Ley 8436, Ley de Pesca y Acuicultura, corresponde al INCOPESCA como autoridad ejecutora de la Pesca y la Acuicultura: "Normar el aprovechamiento racional de los recursos pesqueros, que tiendan a lograr mayores rendimientos económicos, la protección de las especies marinas y de la acuicultura."
4. 4Que el Grupo de Trabajo de Investigación, en el marco del proceso de Mesa de Diálogo para el ordenamiento de la pesca de camarón, realizó una labor exhaustiva durante más de nueve sesiones de trabajo con el aporte de sus miembros (sector pesquero pequeña escala y molusqueros, sector pesquero semiindustrial de arrastre y sardinero, sector pesquero deportivo turístico, academia, SINAC, Defensoría de los Habitantes, sociedad civil, entre otros), para elaborar un mapa de zonificación participativa, a todo lo largo de la costa pacífica y también se realizó una sesión de trabajo para realizar el mapeo participativo en la zona caribe, con el objetivo de regular de manera sostenible las actividades relacionadas con la pesca de camarón. Este proceso fue coordinado por miembros de la academia y también se vertió, además del conocimiento tradicional de los sectores pesqueros involucrados, el conocimiento científico tanto de la academia como de las instituciones de gobierno competentes, de manera que el insumo es un mapa muy completo y consensuado que muestra las zonas establecidas para el alejamiento de la flota semiindustrial camaronera de arrastre en el Océano Pacífico (anexo 1), los espacios marinos con recurso disponible para aprovechamiento sostenible de camarón para la flota comercial de pequeña escala en el Mar Caribe (anexo 2), las zonas prioritarias de investigación (anexo 3) y elementos prioritarios de conservación, tales como anidación de tortugas, coral, arrecifes, manglar, pasto marino, montes submarinos, áreas marinas de pesca responsable, áreas protegidas marinas, avistamiento de mamíferos marinos y domo térmico de Costa Rica y surgencias (anexo 4).
5. 5Que en la mesa de Diálogo Nacional sobre el Ordenamiento de la Pesca de Camarón celebrada el 07 de octubre del 2016, se presentó dicho mapa de zonificación, elaborado a lo largo de nueve meses y se tomó el acuerdo de aprobar dicho mapa participativo y comenzar las gestiones para que se utilice como un insumo para el manejo y ordenamiento de las pesquerías a las que va dirigido por parte de las autoridades competentes.
6. 6Que el Instituto Geográfico Nacional (IGN), mediante oficio DIG-0134-2017, del 05 de abril del presente año, remite mapas aportados por el INCOPESCA los cuales han sido verificados en cuanto al uso del dato cartográfico oficial a nivel del contorno país y sus diversos elementos geográficos básicos representados, así como en la composición final de los mapas, lo cual es competencia del IGN, a efectos de contar con un mapa oficializado por parte de este instituto, en donde se realizaron los ajustes necesarios a la zonificación planteada a fin de mejorar su operatividad, según fue recomendado por el Servicio Nacional de Guardacostas. Además, se determinaron también las coordenadas geográficas exactas de los límites de la zonificación.
7. 7Que el mapa de zonificación participativa, tanto para el Océano Pacífico como para el Mar Caribe costarricense, corresponde a un arduo esfuerzo para mejorar el ordenamiento de las pesquerías a lo largo de la costa Pacífica y Caribe de nuestro país, y se debe de entender como un proceso flexible, que puede cambiar, mejorarse o actualizarse de acuerdo al mejor conocimiento científico disponible y a la investigación científica que se vaya realizando por parte de la academia y las instituciones competentes, además de cambios en las poblaciones de organismos marinos, entre otros.
8. 8Que la Junta Directiva del INCOPESCA por medio del acuerdo AJDIP-145-2017 adoptado en la sesión 014-2017 del 06de abril de 2017 aprobó el mapa de zonificación participativa que sirve de base para establecer el presente acuerdo.
9. 9Que habiéndose analizado a profundidad la propuesta de regulación presentada, estiman los Señores Miembros de Junta Directiva que resulta procedente atender favorablemente la propuesta supra; razón por la cual,

LA JUNTA DIRECTIVA DEL INCOPESCA, Por tanto; ACUERDA:

REGULACION QUE ESTABLECE EL RETIRO DE LA FLOTA PESQUERA SEMI-INDUSTRIAL CAMARONERA DE ARRASTRE EN EL OCEANO PACIFICO Y ESPACIOS MARINOS DE APROVECHAMIENTO SOSTENIBLE DE CAMARON PARA LA FLOTA PESQUERA COMERCIAL DE PEQUEÑA ESCALA EN EL MAR CARIBE PARA REALIZAR FAENAS DE PESCA DE ACUERDO A LOS MAPAS DE ZONIFICACION PARTICIPATIVA ELABORADOS POR EL GRUPO DE TRABAJO DE INVESTIGACION, EN EL MARCO DE LA MESA DE DIALOGO DE ORDENAMIENTO DE LA PESCA DE CAMARON
