throughout the entire text - Complete Text of Standard 14 Sanitary measures to prevent the introduction and spread of the small hive beetle (Aethina tumida) in the national territory Complete Text of act: 1382D4 NATIONAL ANIMAL HEALTH SERVICE Resolution SENASA DG-R0 14-2017— General Directorate of the National Animal Health Service, at nine o'clock on the seventh of March of two thousand seventeen.
The General Directorate of the National Animal Health Service (SENASA) proceeds to issue sanitary measures to prevent the risk of introduction, establishment, and spread of the small hive beetle (Aethina tumida) to other areas of the national territory in which it is not present, and other complementary measures.
I.That, as it is an essential function of the State to protect the health and life of animals, it is fundamental to monitor and regulate the use and exchange of animals, as well as to issue those measures necessary for the prevention, eradication, and control of pests that, due to their characteristics, may jeopardize veterinary public health or animal health and the country's livestock economy.
II.That it is within the competence of SENASA to promulgate and ensure the execution of sanitary standards that prevent the propagation and dissemination of animal diseases.
III.That the National Animal Health Service, as the competent body for the protection of animal health and human health, based on technical, sanitary, and legal criteria, is empowered to apply the corresponding sanitary measures, also based on the Precautionary Principle, established in the Agreement on Sanitary and Phytosanitary Measures of the World Trade Organization (WTO).
IV.That the small hive beetle (Aethina tumida) is a scavenger parasite, characterized by causing the death of brood, the eviction of adult bees, and is easily transported in bee colonies, protective equipment, apicultural materials, swarms, and by individual flight, and is very difficult to detect in its initial stages of infestation.
V.That said coleopteran has been detected in the canton of La Cruz, Guanacaste, and notification has been received through the formal notification channels of the World Organisation for Animal Health (OIE), WAHIS system, that there are seven infestation foci of the hive beetle in different points of the geography of the Republic of Nicaragua.
VI.That the hive beetle has been detected in the canton of La Cruz in a sentinel establishment (which was located at a strategic point for SENASA to discover the entry of pests into the country in initial infestations). The foregoing allows for control of the beetle to reduce the levels of infestation that enter naturally.
VII.That the cantons of La Cruz in Guanacaste, Sarapiquí in Heredia, Pococí in Limón, Upala, Guatuso, Los Chiles, and San Carlos in Alajuela are bordering with the Republic of Nicaragua and therefore have a higher risk for the introduction, establishment, and spread of said pest, making it important to protect other areas of the national territory in which said beetle is not present.
VIII.That it is necessary to take measures to prevent the indicated coleopteran from spreading into other cantons of the Costa Rican territory, whether originating from the canton of La Cruz or from the Republic of Nicaragua.

—That, for the purpose of issuing this resolution, this General Directorate holds as true the facts referred to in the first through eighth whereas clauses.
article regulates the power to implement the necessary measures for the national and international transit and exchange of domestic, aquatic, wild, or other animals, in order to avoid outbreaks of pests or diseases that, due to their characteristics, put veterinary public health or animal health at risk; B).— That in accordance with Article 44 of Law No. 8495, regulated parties must contribute to the conservation of the health of the animal population, the protection and safety of food of animal origin, as well as the control of zoonosis, the protection of the community and the environment, as well as apply the mandatory sanitary measures established to prevent, fight, control, and eradicate animal diseases, or consent to their application, and facilitate the authorities in carrying out and applying the due safety measures for both the animals and the personnel who execute them. The regulated party who fails to comply with the duties mentioned above shall be subject, among others, to the administrative sanctions established in Law No. 8495; C).— That Article 50 of the aforementioned Law prohibits the importation, transit, or movement of domestic, wild, aquatic, or other animals, their genetic material, their products, by-products, derivatives, their waste, dangerous substances, veterinary medicines, animal feed, biotechnological products of animal origin or intended for the use or consumption of animals, as well as material of any other kind that may be potential carriers or vehicles of infectious, parasitic, or toxic agents that put the environment, veterinary public health, or animal health at risk; D).— That subsequently, Article 51 empowers SENASA to apply the slaughter of animals, their return to the country or place of origin, their destruction, or any other measure that the legislation provides, when the interested parties do not comply with the requirements imposed by law, with the importers, private parties, or their representatives being responsible for covering the costs of applying said measures; E).— That this authority may carry out the sanitary measures it deems pertinent, in order to fulfill the objectives of Law No. 8495 (Article 89); F).— That the precautionary principle (Article 4 of Law No. 8495) provides that in situations of danger or serious harm to the environment or public health, the National Animal Health Service has the duty to order all precautionary measures that are necessary—within the scope permitted by law—in order to prevent irreversible damage from occurring to veterinary public health.
Based on the considering clauses described herein, on the current legislation cited above, and in application of the precautionary principle, and with the objective of avoiding outbreaks of pests or diseases that, due to their characteristics, put veterinary public health or animal health at risk, sanitary measures must be ordered. La Dirección General del Servicio Nacional de Salud Animal (SENASA), procede a dictar medidas sanitarias para evitar el riesgo de introducción, establecimiento y difusión del pequeño escarabajo de las colmenas (Aethina tumida) a otras zonas del territorio nacional en las que no se encuentra presente y otras medidas complementarias.
I.Que al ser función esencial del Estado proteger la salud y la vida de los animales, resulta fundamental vigilar y regular el uso e intercambio de los animales, así como dictar aquellas medidas necesarias para la prevención, erradicación y el control de plagas que por sus características puedan poner en 1 la salud pública veterinaria o la salud animal y la economía pecuaria del país.
II.Que es competencia del SENASA promulgar y velar por la ejecución de las normas sanitarias que impiden la propagación y diseminación de las enfermedades de los animales.
III.Que el Servicio Nacional de Salud Animal, como Órgano competente para la protección de la salud animal y la salud humana, fundado en criterios técnicos, sanitarios y legales, está facultado para aplicar las medidas sanitarias que correspondan, basado además en el Principio Precautorio o de Cautela, establecido en Acuerdo sobre Medidas Sanitarias y Fitosanitarias de la Organización Mundial del Comercio (OMC).
IV.Que el pequeño escarabajo de las colmenas (Aethina tumida) es un parásito carroñero, que se caracteriza por provocar la muerte de las crías, desalojo de abejas adultas y fácilmente en las colonias de abejas, equipos de protección, materiales apícolas, enjambres y por vuelo individual y es de muy difícil detección en sus etapas iniciales de infestación.
V.Que dicho coleóptero ha sido detectado en el cantón de La Cruz, Guanacaste y se ha recibido noticia a través de los canales formales de notificación de la Organización Mundial de Sanidad Animal (OIE), sistema WAHIS, que se encuentran siete focos de infestación del escarabajo de la colmena en diferentes puntos de la geografía de la República de Nicaragua.
VI.Que el escarabajo de la colmena se encuentra detectado en el cantón de La Cruz en un establecimiento centinela (el cual se ubicó en un punto estratégico para descubrir por parte del SENASA el ingreso de plagas al país en infestaciones iniciales). Lo anterior permite realizar un control del escarabajo para bajar los niveles de infestación que ingresan de manera natural.
VII.Que los cantones de La Cruz en Guanacaste, de Sarapiquí en Heredia, de Pococí en Limón, de Upala, Guatuso, Los Chiles y San Carlos en Alajuela, son limítrofes con la República de Nicaragua y por ello tienen un mayor riesgo para la introducción, establecimiento y difusión de dicha plaga, por lo que es importante proteger otras zonas del territorio nacional en las cuales no se encuentra presente dicho escarabajo.
VIII.Que es necesario tomar medidas para evitar que el coleóptero indicado se disemine en otros cantones del territorio costarricense proveniente éste del cantón de La Cruz o de la República de Nicaragua.

-Que al efecto para dictar la presente resolución, esta Dirección General tiene por ciertos los hechos a que se refieren en los resultandos primero al octavo.
Con fundamento en los considerandos acá descritos, en la legislación vigente antes señalada y en aplicación del principio precautorio y con el objetivo de evitar brotes de plagas o enfermedades que por sus características, pongan en riesgo la salud pública veterinaria o la salud animal se deben ordenar medidas sanitarias. Por tanto, EL DIRECTOR GENERAL DEL SERVICIO NACIONAL DE SALUD ANIMAL DEL MINISTERIO DE AGRICULTURA Y GANADERÍA,
RESUELVE:

(Nota de Sinalevi: Mediante resolución N° SENASA DG-R-030-2020 del 4 de junio del 2020, se acordó que para evitar la introducción y dispersión del pequeño escarabajo de las colmenas (Aethina tumida) a otros cantones libres de su presencia, se establece someter al cumplimiento de las disposiciones y procedimientos sanitarios establecidos en la Resolución SENASA DG-R014-2017 de las nueve horas del siete de marzo del dos mil diecisiete, a todos los productores y establecimientos apícolas que se ubiquen o realicen actividad apícola en los cantones de la provincia de Guanacaste, a saber, Abangares, Bagaces, Cañas, Carrillo, Hojancha, Liberia, Nicoya, Santa Cruz, Nandayure, Tilarán, los cuales en adelante se entenderán como zonas de riesgo, quedando, en especial, prohibida la salida, trasiego y comercialización a otros cantones de individuos (abejas reinas, obreras, y zánganos) paquetes de abejas, núcleos, colmenas de abejas melíferas domésticas (apis mellifera) y silvestres o nidos de abejas nativas.)
