in the entirety of the text - Full Text of Standard 40165 Increases for the National System of Conservation Areas (SINAC), the maximum budgetary expenditure set for 2017 Full Text of record: 1150C7 N° 40165-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by articles 140 subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) heading b) of Law N° 6227, General Law of Public Administration of 2 May 1978 and its amendments; Law N° 8131, Law of Financial Administration of the Republic and Public Budgets of 18 September 2001 and its amendments; its Regulation, Executive Decree N° 32988-H-MP-PLAN of 31 January 2006 and its amendments; Law N° 7317, Wildlife Conservation Law of 30 October 1992 and its amendments; Law N° 7575, Forestry Law (Ley Forestal) of 13 February 1996 and its amendments; Law N° 7554, Organic Environmental Law of 4 October 1995 and its amendments; Law N° 6084 of 24 August 1977 and its amendments; Law N° 5417, Law on the Issuance of Commemorative Coins on Nature Conservation of 14 November 1973 and its amendment; Law N° 7788, Biodiversity Law of 30 April 1998 and its amendments; Executive Decree N° 32452-H of 29 June 2005 and its amendments; and Executive Decree N° 39613-H of 3 March 2016.

I.-That through Law N° 7788, published in La Gaceta N° 101 of 27 May 1998 and its amendments, the National System of Conservation Areas (SINAC) was created as a deconcentrated and participatory institutional management and coordination system, which will integrate competencies in forestry, wildlife, protected areas, and the Ministry of Environment and Energy, in order to issue policies, plan, and execute processes aimed at achieving sustainability in the management of Costa Rica's natural resources.

II.-That through official communication SINAC-DE-1757-2016 of 20 October 2016, the Acting Executive Director of SINAC requested an increase to the maximum budgetary amount of ¢7,236,279,204.00 (seven thousand two hundred thirty-six million two hundred seventy-nine thousand two hundred four colones exactly), with the purpose of financing 130 positions being transferred from the National Parks Fund to the SINAC Fund in 2016, plus 124 positions to be transferred in 2017, as well as expenses of the Sustainable Tourism Project, whose budget was not considered in the calculation of the limit, given that this project was request was endorsed by the Minister of Environment and Energy, through official communication DM-1040-2016 of 8 November 2016, and furthermore the restatement of the increase request was authorized by the National Council of Conservation Areas (CONAC) in agreement N° 9 taken at session N° 12-2016 of 12 December of the current year.

III.-That of said amount, the sum of ¢1,070,291,088.00 (one thousand seventy million two hundred ninety-one thousand eighty- eight colones exactly) is to be increased via Executive Decree, which will be covered with resources from free and specific surplus (superávit libre y específico), which will give substance to substantive, recurrent, essential, and necessary expenditures for institutional purposes, required to finance travel expenses for officials of the Executing Unit of the Sustainable Tourism Project, as well as various infrastructure and maritime works in some of the country's Protected Wild Areas.

IV.-That through Executive Decree N° 39613-H, published in Supplement (Alcance) N° 46 to La Gaceta N° 61 of 30 March 2016, the General Guidelines for Budgetary, Salary, Employment, Investment, and Indebtedness Policy for 2017 were issued, establishing in article 12 that for public entities and deconcentrated organs, the maximum budgetary expenditure for 2017 will be established based on the projection of total revenues (current, capital, and financing) for 2017, defined by the public entities and deconcentrated organs in coordination with the STAP. For this purpose, the STAP will use as input the historical series of revenues from the 2013-2015 period, as well as the revenue estimate for 2016 and 2017 provided by the entities and deconcentrated organs no later than the last day of March 2016. In accordance with said provision, the resulting maximum budgetary established at the sum of ¢31,431,040,983.00 (thirty-one thousand four hundred thirty-one million forty thousand nine hundred eighty-three colones exactly), which was communicated in official communication STAP-0616-2016 of 27 April 2016; the same is modified by official communication STAP-2555-2016 of 16 December 2016, being set at the sum of ¢37,306,605,940.21 (thirty-seven thousand three hundred six million six hundred five thousand nine hundred forty colones with twenty-one cents); a figure that does not include the expenditure previously indicated in this decree.

V.-That through Executive Decree N° 32452-H, published in La Gaceta N° 130 of 6 July 2005 and its amendments, the "Guideline for the application of article 6 of Law N° 8131, Law of the Financial Administration of the Republic and Public Budgets and the regulation of the class of revenues of the Public Sector called Financing (Financiamiento)" was issued.

VI.-That article 7 of the Decree cited in the preceding whereas clause provides that financing resources originating from prior fiscal years—free surplus—are part of the equity of the organs and entities and may be used in subsequent periods to finance expenditures that relate to their ordinary activity, which serve the interest of the community, the public service, and institutional purposes, provided they are not permanent in nature or generate an obligation requiring financing over time, such as the creation of positions for fixed posts, or any other commitment of the same nature.

VII.-That in relation to the specific surplus, numeral 9 of the referenced Executive Decree N° 32452-H enables its use for the payment of expenditures defined in the purposes established in the special or legal provisions applicable to such resources.

VIII.-That due to the foregoing, it is necessary to increase the maximum budgetary expenditure set for SINAC for 2017, increasing it by the sum of ¢1,070,291,088.00 (one thousand seventy million two hundred ninety-one thousand eighty-eight colones exactly). Therefore;

INCREASE OF THE MAXIMUM BUDGETARY 2017 FOR THE NATIONAL SYSTEM OF AREAS OF CONSERVATION

I.-Que mediante la Ley N° 7788, publicada en La Gaceta N° 101 de 27 de mayo de 1998 y sus reformas, se crea el Sistema Nacional de Áreas de Conservación (SINAC) como un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integrará las competencias en materia forestal, vida silvestre, áreas protegidas y el Ministerio del Ambiente y Energía, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.

II.-Que mediante el oficio SINAC-DE-1757-2016 de 20 de octubre de 2016, el Director Ejecutivo a. i. del Sinac solicitó incrementar el gasto presupuestario máximo de dicha institución para el ario 2017, por un monto total de ¢7.236.279.204,00 (siete mil doscientos treinta y seis millones doscientos setenta y nueve mil doscientos cuatro colones exactos), con la finalidad de financiar 130 puestos que se trasladan del Fondo de Parques Nacionales al Fondo SINAC en el año 2016, más 124 puestos a trasladar en el año 2017, así como gastos del Proyecto Turismo Sostenible, cuyo presupuesto no fue considerado en el cálculo del límite, dado que se esperaba que este proyecto finalizara en el año 2016, así como para incorporar recursos adicionales. Dicha solicitud fue avalada por el señor Ministro de Ambiente y Energía, mediante el oficio DM- 1040-2016 de 8 de noviembre de 2016 y además el replanteamiento de la solicitud de ampliación fue autorizada por el Consejo Nacional de Áreas de Conservación (CONAC) en el acuerdo N° 9 tomado en la sesión N° 12-2016 del 12 de diciembre del ario en curso.

III.-Que de dicho monto, corresponde ser ampliada por la vía de Decreto Ejecutivo la suma de ¢1.070.291.088,00 (mil setenta millones doscientos noventa y un mil ochenta y ocho colones exactos), misma que será sufragada con recursos provenientes de superávit libre y específico, que le darán contenido a gastos sustantivos, recurrentes, esenciales y necesarios para los fines institucionales, requeridos para financiar los gastos de viajes de los funcionarios de las Unidad Ejecutora del Proyecto de Turismo Sostenible, así como las diversas obras de infraestructura y marítimas en algunas de las Áreas Silvestres Protegidas del país.

IV.-Que mediante el Decreto Ejecutivo N° 39613-H, publicado en el Alcance N° 46 a La Gaceta N° 61 de 30 de marzo de 2016, se emitieron las Directrices Generales de Política Presupuestaria, Salarial, Empleo, Inversión y Endeudamiento, para el año 2017, estableciéndose en el artículo 12, que para las entidades públicas y órganos desconcentrados, el gasto presupuestario máximo del año 2017, se establecerá con base en la proyección de ingresos totales (corrientes, capital y financiamiento) 2017, definida por las entidades públicas y órganos desconcentrados en coordinación con la STAP. Para tal efecto, la STAP utilizará como insumo la serie histórica de ingresos del periodo 2013-2015, así como la estimación de ingresos para los años 2016 y 2017 que suministren las entidades y órganos desconcentrados a más tardar el último día del mes de marzo del año 2016. En correspondencia con dicha disposición, el monto de gasto presupuestario máximo para el ario 2017 resultante para el SINAC, fue establecido en la suma de ¢31.431.040.983,00 (treinta y un mil cuatrocientos treinta y un millones cuarenta mil novecientos ochenta y tres colones exactos), el cual fue comunicado en el oficio STAP-0616-2016 del 27 de abril de 2016; mismo que se modifica mediante el oficio STAP-2555-2016 de 16 de diciembre de 2016, fijándose en la suma de ¢37.306.605.940,21 (treinta y siete mil trescientos seis millones seiscientos cinco mil novecientos cuarenta colones con veintiún céntimos); cifra que no contempla el gasto indicado previamente en este decreto.

V.-Que mediante el Decreto Ejecutivo N° 32452-H, publicado en La Gaceta N° 130 de 6 de julio de 2005 y sus reformas, se emite el "Lineamiento para la aplicación del artículo 6° de la Ley N° 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".

VI.-Que el artículo 7° del Decreto citado en el considerando anterior, dispone que los recursos de financiamiento que provienen de vigencias anteriores -superávit libre- son parte del patrimonio de los órganos y las entidades y pueden utilizarlos en períodos subsiguientes para financiar gastos que se refieran a la actividad ordinaria de éstas, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, siempre que no tengan el carácter permanente o generen una obligación que requiera financiarse a través del tiempo, como la creación de plazas para cargos fijos, o cualquier otro compromiso de la misma naturaleza.

VII.-Que en relación con el superávit específico, el numeral 9° del referido Decreto Ejecutivo N° 32452-H, posibilita la utilización de éste, para el pago de gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a tales recursos.

VIII.-Que por lo anterior, resulta necesario ampliar el gasto presupuestario máximo fijado al SINAC para el año 2017, incrementándolo en la suma de ¢1.070.291.088,00 (mil setenta millones doscientos noventa y un mil ochenta y ocho colones exactos). Por tanto;
