2- In accordance with Executive Decree No. 34681-MAGMINAE regarding the "Management Plan for the exploitation of tuna and related species in the Costa Rican Pacific exclusive economic zone," published in La Gaceta No. 213 of November 5, 2014, its Article 11 establishes that vessels of the medium-scale commercial fishing fleet and the advanced commercial fishing fleet that carry out fishing activities or operations for tuna and related species within the areas established in Article 2, subsections a), b), c), and d) of said Decree must obligatorily carry a fishing logbook and record all the information on fishing operations requested therein: the objective of the fishing trip, the gear and preparation of the vessel at the time of departure, a record by set stating the dates, the positions of the fishing sets, including the start and end of each one, the quantity of catches and the type of species caught per fishing set, a record of transshipments during the fishing trip conducted to ascertain the destination given to the catch and the quantities transshipped by species at the port of arrival, the name of the captain and crew, and any other important information about the fishing trip. Therefore, the information on their fishing operations must be reflected and detailed in the books called the Fishing Operations Logbook, the Set-by-Set Logbook, and the Transshipment Logbook.

1. 3That Articles 41, 105, and 152 of the Fisheries and Aquaculture Law state that those holding a license, authorization, permit, or concession must keep an operations logbook for their activity; in this regard, the Fishing Operations Logbook, the Set-by-Set Logbook, and the Transshipment Logbook must be kept on board with complete and correct information.

4.- That Executive Decree No. 36782-MINAET-MAG-MOPT-TUR-SP-S-MTSS, related to the Regulations to the Fisheries and Aquaculture Law No. 8436, in Article 114 establishes the obligation to carry the Fishing Operations Logbook, indicated in Article 105 of the LPA, on board the fishing vessel at all times, which must be duly legalized beforehand by the Executing Authority, through its Legal Department.

5.- That the Tariff Commission proposes a fee of ¢-10,000.00 for the Fishing Operations Logbook (pad of 50 sheets), a fee of ¢-5,000.00 for the Set Form (pad of 25 forms), and a fee of ¢-5,000.00 for the Transshipment Form (pad of 50 forms), based on the process cost model involving elements of time, human resources, and materials.

6.- Having read the official letter in question, and having analyzed the fee definition process, the Board of Directors agrees to its implementation. Therefore; THE BOARD OF DIRECTORS OF INCOPESCA AGREES:

1- To establish the obligation to carry at all times, for vessels with medium-scale commercial and advanced commercial licenses, the Fishing Operations Logbook, the Set-by-Set Logbook, and the Transshipment during Fishing Trip Logbook, without prejudice to the obligation to carry the ordinary logbook issued by the Ministry of Public Works and Transport; indicated in Articles 41 and 105, 102 of the Fisheries and Aquaculture Law, as well as in Article 114 of Executive Decree No. 36782-MINAET-MAG-MOPT-TUR-SPS-MTSS and Articles 11 and 2 of Executive Decree No. 34681-MAGMINAE.

2.- A fee of ¢-10,000.00 is approved for the Fishing Operations Logbook (pad of 50 sheets), a fee of ¢-5,000.00 for each set form (pad of 25 forms), and a fee of ¢-5,000.00 for each transshipment form (pad of 50 forms); according to the proposal submitted by the Tariff Commission of INCOPESCA.

3.- To request the Executive Presidency to undertake all necessary administrative procedures for the due implementation of this agreement.

4. The aforementioned books must be renewed annually together with the fee for their license; otherwise, immediate suspension of the services and benefits derived from the license, permit, or authorization will occur, and administrative proceedings will follow due process leading to the penalty established in Article 152 of the Fisheries and Aquaculture Law.

5. The mandatory compliance with the use and carrying of these books is established as a provision or regulation of a technical nature for conducting fishing operations or tasks, and the non-observance or non-compliance thereof incurs penal liability in accordance with Article 148 of the Fisheries and Aquaculture Law and administrative and civil liability in accordance with Article 116 of the Fisheries and Aquaculture Law.

6.- Agreement is final. It takes effect upon its publication.

2- De acuerdo con el Decreto Ejecutivo Nº 34681-MAGMINAE referente al "Ordenamiento para el aprovechamiento de atún y especies afines en la zona económica exclusiva del océano pacífico-costarricense", publicado en La Gaceta N° 213 del 05 de noviembre 2014, se establece en su artículo 11 que las embarcaciones de la flota pesquera comercial mediana escala y la flota pesquera comercial avanzada, que realicen las actividades o faenas de pesca de atún y especies afines dentro de las áreas establecidas en el Artículo 2 incisos a), b), c) y d), de dicho Decreto; deberán obligatoriamente portar una bitácora de pesca y registrar toda la información de las operaciones de pesca que en ella se solicite objetivo del viaje de pesca, los equipos y alistos de la embarcación al momento del zarpe, un registro por lance donde se consigne las fechas, las posiciones de los lances de pesca, incluyendo el inicio y el fin de cada uno, la cantidad de capturas y el tipo de especie capturado realizados por lance de pesca, un registro de los Transbordos en Viaje de pesca que se realice para conocer el destino que se le dio a la captura y cantidades transbordadas por especie en el puerto de arribo, nombre del capitán y la tripulación y cualquier otra información importante del viaje de pesca), por lo que la información de sus operaciones de pesca deberán verse reflejadas y detalladas en los libros llamados libro de Registro de Operaciones de Pesca, el Libro de Registro Por Lance, y el Registro de Transbordo.

1. 3Que los artículos 41 y 105, y 152 de la Ley de Pesca y Acuicultura señala que quienes posean una licencia, autorización, permiso o concesión, deberán llevar un libro de registro de operaciones de su actividad; en tal sentido se deberá llevar a bordo el libro de Registro de Operaciones de Pesca, el Libro de Registro Por Lance, y el Registro de Transbordo con la información completa y correcta.

4.-Que el Decreto Ejecutivo N° 36782-MINAET-MAG-MOPT-TUR-SP-S-MTSS, relacionado con el Reglamento a la Ley de Pesca y Acuicultura N° 8436, en el artículo 114 se establece la obligatoriedad de portar en todo momento en la embarcación de pesca, el Libro de Registro de Operaciones de Pesca, señalado en el artículo 105 de la LPA, mismo que deberá ser legalizado de previo por la Autoridad Ejecutora, por medio de su Departamento Legal.

5.-Que la Comisión de Tarifas propone una tarifa de ¢-10.000.00 para el Libro de Registro de Operaciones de Pesca (block de 50 folios), una tarifa de ¢-5.000.00 para el Formulario de Lances (block de 25 formularios) y una tarifa de ¢-5.000.00 para el Formulario de Transbordo (block de 50 formularios), lo anterior basados en el modelo de costos por proceso que involucra los elementos del tiempo, recurso humano e insumos.

6.-Leído el oficio en mención, así como analizado el proceso de definición de la tarifa, la Junta Directiva acuerda su implementación, Por tanto; LA JUNTA DIRECTIVA DE INCOPESCA ACUERDA:

1- Establecer la obligatoriedad de portar en todo momento para las embarcaciones con licencia comercial de mediana escala y comercial avanzada los Libros de Registro de Operaciones de Pesca, de Registro por Lance, Registro de Transbordo en viaje de pesca, sin perjuicio de la obligatoriedad de portar el libro de bitácora de uso ordinario que otorga el Ministerio de Obras Públicas y Transportes; señalados en los artículos Artículo 41 y 105, 102 de la Ley de Pesca y Acuicultura, así como en el artículo 114 del Decreto Ejecutivo N° 36782-MINAET-MAG-MOPT-TUR-SPS-MTSS y el artículos 11 y 2 del Decreto Ejecutivo Nº 34681-MAGMINAE.

2.-Se aprueba una tarifa de ¢-10.000.00 para el Libro de Registro de Operaciones de Pesca (block de 50 folios), una tarifa de ¢-5.000.00 por cada formulario de lances (block de 25 formularios) y una tarifa de ¢-5.000.00 por cada formulario de trasbordo (block de 50 formularios); según la propuesta presentada por la Comisión de Tarifas del INCOPESCA.

3.-Solicitar a la Presidencia Ejecutiva realizar todas las gestiones administrativas necesarias para la debida implementación de este acuerdo.

4. Los libros supra mencionados deberán ser renovados anualmente de manera conjunta con el canon de su licencia, de lo contrario se dará suspensión inmediata de los servicios y beneficios derivados de la licencia, permiso o autorización y se procederá administrativamente posterior al debido proceso a la sanción establecida en el artículo 152 de la Ley de Pesca y Acuicultura.

5. La obligatoriedad del cumplimiento del uso y portación de estos libros se establece como una disposición o regulación de naturaleza técnica para realizar las faenas o labores de pesca, y la inobservancia o incumplimiento de la misma acarrea responsabilidad penal de conformidad con el artículo 148 de la Ley de Pesca y Acuicultura y responsabilidad en materia administrativa y civil de conformidad con el artículo 116 de la Ley de Pesca y Acuicultura.
