2- In accordance with Executive Decree (Decreto Ejecutivo) Nº 34681-MAGMINAE regarding the "Ordenamiento para el aprovechamiento de atún y especies afines en la zona económica exclusiva del océano pacífico-costarricense", published in La Gaceta N° 213 of November 05, 2014, it is established in its article 11 that vessels of the commercial medium-scale fishing fleet and the advanced commercial fishing fleet, that carry out fishing activities or tasks for tuna and related species within the areas established in Article 2, subsections a), b), c) and d), of said Decree; must obligatorily carry a fishing logbook (bitácora de pesca) and record all the information on the fishing operations requested therein, including the objective of the fishing trip, the equipment and readiness of the vessel at the time of departure, a record per set (lance) stating the dates, the positions of the fishing sets, including the start and end of each one, the quantity of catches and the type of species caught per fishing set, a record of the Transshipments (Transbordos) during the Fishing Trip carried out to know the destination given to the catch and quantities transshipped per species at the port of arrival, name of the captain and the crew, and any other important information about the fishing trip), therefore the information on their fishing operations must be reflected and detailed in the books called the Fishing Operations Logbook (libro de Registro de Operaciones de Pesca), the Logbook by Set (Libro de Registro Por Lance), and the Transshipment Log (Registro de Transbordo).
- 3That articles 41 and 105, and 152 of the Fisheries and Aquaculture Law (Ley de Pesca y Acuicultura) indicate that those who hold a license, authorization, permit, or concession must keep a logbook ( libro de registro de operaciones) of their activity; in this sense, the Fishing Operations Logbook, the Logbook by Set, and the Transshipment Log must be kept on board with complete and correct information.
