in the entirety of the text - Full Text of Norm 39949 Declares of Public Utility for the interests of the State the Administrative Association of the Aqueduct and Sanitary Sewer of General Viejo, Miraflores, La Hermosa and Santa Cruz de General Full Text record: 112904 N° 39949-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Law of Associations No. 218 of August 8, 1939 and articles 27 and following of the Regulation to the Law of Associations No. 29496-J, published in La Gaceta No. 96 of May 21, 2001.
I.Article 32 of the Law of Associations No. 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated or confederated Associations, whose development and activities are particularly useful for the interests of the State, and which thereby contribute to solving a social need.
II.The Administrative Association of the Aqueduct and Sanitary Sewer of General Viejo, Miraflores, La Hermosa and Santa Cruz de General, legal entity identification number 3-002-671339, was registered in the Associations Registry of the Public Registry since July 11, 2013, volume number 2013, entry 79916.
III.The purposes pursued by the Association, according to its bylaws, are: " ... ARTICLE THREE: The purposes of the Association are the following: ... I) Administer, operate, maintain, develop and keep in good conditions the aqueduct, in accordance with the provisions and regulations issued in this regard by the Instituto Costarricense de Acueductos y Alcantarillados which shall be mandatory. II) Obtain the effective participation of the community, in the construction, operation, maintenance and development of the aqueduct. III) Collaboration in educational programs and campaigns undertaken. IV) Help explain and disseminate in the community the provisions and regulations of the Instituto Costarricense de Acueductos y Alcantarillados. V) Cooperate with the plans, projects and works undertaken by the Instituto Costarricense de Acueductos y Alcantarillados in the community. VI) Participate in matters relating to the administration, conservation and rational exploitation of waters; control of their contamination or alteration, definition of measures and actions necessary for the protection of hydrographic basins and ecological stability. VII) Ensure that all systems, their aqueduct or sanitary sewer installations, comply with the basic principles of public service, both in quality, quantity, coverage, efficiency, cost rationalization, etc. VIII) Provide public services, efficiently, equitably and timely to all its users, without distinctions of any nature".
IV.Such purposes solve a social need of the first order, for which reason they deserve the support of the Costa Rican State. Therefore,

en la totalidad del texto - Texto Completo Norma 39949 Declara de utilidad Pública para los intereses del Estado la Asociación Administradora del Acueducto y Alcantarillado Sanitario de General Viejo, Miraflores, La Hermosa y Santa Cruz de General Texto Completo acta: 112904 N° 39949-JP EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones Nº 29496-J, publicado en la Gaceta Nº 96 del 21 de mayo del 2001.
I.El artículo 32 de la Ley de Asociaciones Nº 218 de 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.La Asociación Administradora del Acueducto y Alcantarillado Sanitario de General Viejo, Miraflores, La Hermosa y Santa Cruz de General, cédula de persona jurídica número 3-002-671339, se inscribió en el Registro de Asociaciones del Registro Público desde el día 11 de julio de 2013, tomo número 2013, asiento 79916.
III.Los fines que persigue la Asociación, según sus estatutos, son: " ... ARTÍCULO TERCERO: Los fines de la Asociación son los siguientes: ... I) Administrar, operar, dar mantenimiento, desarrollo y conservar en buenas condiciones el acueducto, de conformidad con las disposiciones y reglamentos que al respecto emite el Instituto Costarricense de Acueductos y Alcantarillados que serán de acatamiento obligatorio. II) Obtener la participación efectiva de la comunidad, en la construcción, operación, mantenimiento y desarrollo del acueducto. III) Colaboración en los programas y campañas de índole educativa que se emprendan. IV) Ayudar a explicar y divulgar en la comunidad las disposiciones y reglamentos del Instituto Costarricense de Acueductos y Alcantarillados. V) Cooperar con los planes, proyectos y obras que emprenda el Instituto Costarricense de Acueductos y Alcantarillados en la comunidad. VI) Participar en asuntos relativos a la administración, conservación y
definición de medidas y acciones necesarias para la protección de las cuencas hidrográficas y estabilidad ecológica. VII) Velar porque todos los sistemas, sus instalaciones de acueductos o alcantarillados sanitarios, cumplan los principios básicos del servicio público, tanto en calidad, cantidad, cobertura, eficiencia, racionalización de gastos, etc. VIII) Otorgar los servicios públicos, en forma eficiente, igualitaria y oportuna a todos sus usuarios, sin distinciones de ninguna naturaleza".
IV.Tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado costarricense. Por tanto,
