The person interested in obtaining potable water service for an urbanization or a subdivision (fraccionamiento) of more than ten housing units or a multi-family unit, must submit a detailed application for the project to the Aqueduct Department of the Municipality, with a copy to the Urban Development Department.
The application shall contain a study carried out by an engineer expert in hydrology, duly incorporated into the respective professional association, which clearly determines whether or not it is possible to supply potable water to the project using the sources of the Municipal Aqueduct. For such procedure, the interested person may previously request the necessary information at the Municipal Aqueduct Department.
Within one month, the Aqueduct Department, through a reasoned technical analysis, shall determine whether or not potable water service is provided based on the study presented by the interested party, a copy of which shall be forwarded to the Municipal Council for its knowledge.
Against the decision made by the Aqueduct Department, the remedies of revocation before the same Department and appeal before the Municipal Mayor shall be available, which must be filed within five business days following notification.
The revocation and the appeal may be based on reasons of legality or opportunity, which shall suspend the execution of the act.
In cases where the Aqueduct Department issues a positive determination of potable water feasibility, the interested party shall present the construction plans to the Urban Development Department, for the corresponding procedure pursuant to the provisions of the Urban Regulatory Plan of the Canton and the Costa Rican legal system.
